Rutherford IN THE PROBATE COURT For Letters of Guardianship for Eli Clinesmith Of ROGER MILLS COUNTY O.T. PETITION Now Comes W.F. Rutherford, applicant herein and respectfully, States to the Court that he is a resident of said County of Roger Mills and Territory of Oklahoma. That C.A. Clinesmith, wife of Eli Clinesmith and Lulu Rutherford, grand daughter of said Eli Clinesmith, only surviving heirs of the estate of said Eli Clinesmith, have each given their consent in writing that applicant be appointed guardian of the person and property of the said Eli Clinesmith, and each of said heirs have given their written waiver of notice of this application. That said Eli Clinesmith has a homestead undeeded ,and also two pony horses in said county and Territory; that said ponys are worth the sum of thirty $30.00 and the rent of said homestead claim is worth thirty $30.00 dollars annualy. That the said Eli Clinesmith has become insane to such an extent as to render him mentaly incompetent to manage his business affairs; to conduct his own business, or to properly care for himself personaly; that in order to protect his property from being uselessly squandered by himself, and in order to prevent him from making useless and unnecessary expenditures; and in order to protect and preserve said property to the best advantage to the said Eli Clinesmith and his said heirs; and also to properly protect the person of the said Eli Clinesmith, it has become necessary that a guardian be appointed over both his person and property. WHEREFORE premises considered applicant prays that a guardian be appointed over both the person and the property of the said Eli Clinesmith, and that that applicant herein, W.F. Rutherford, be appointed and constituted such guardian and for other orders and decrees of court, as may seem right and proper to the court. W.F.
