J. R. Bryson Judge of the County Court of the State of Oregon, for the County of Benton The petition of Eldridge Hartless of said County respectfully shows : That Eldridge Hartless died on or about the 1st day of September A. D. 1882, in the county of Benton State of Oregon. That said deceased at the time of his death was a resident and inhabitant of the County of Benton State of Oregon. That said deceased left estate in the County of Benton State of Oregon consisting of personal property: That the value and character of said property are as follows, to wit: principally horses and cattle of the probable value of $400.00 That the estate and effects for or in respect of which the probate of the will hereinafter mentioned is hereafter applied for, does not exceed the sum of _(blank)____ dollars: That said deceased left a will bearing date the 25th day of June A.D. 1881 in the possession of Emily C. Hartless which your petitioner believe and therefore allege to be the last will and testament of said deceased, and which is herewith presented to the County Court: That Emily C. Hartley named in said will as executor thereof; and is the widow of deceased aged about 58 years, residing in Benton County, State of Oregon, Sarah Oglesby, Virginia Stilson, Wm H. Hartless, Clara A. Hartless – and Eldridge Hartless are devisees named in said will. That the subscribing witnesses to said will are F. A. Chinoweth & W. M. Johnson residing in the County of Benton and State of Oregon. That the next of kin of said testator whom your petitioner is advised and believe and therefore allege to be the heirs at law of said testator, and the names ages and residence of said heirs Emily C. Hartless, widow aged about 68 years, residing at Benton County, Oregon Sarah Oglesby, aged about 32 years, residence Fossil Gilliam County, Oregon Virginia Stilson, aged about 30 years Residence Fossil Gilliam County, Oregon Wm H. Hartless aged about 31 years Residence Corvallis, Benton County, Oregon Clara A. Zimmerman, formerly a Hartless aged about 26 years Residence Benton County, Oregon Eldridge Hartless aged 23 years, residence Benton County, Oregon Additional Comments: I don't have the complete copy of this court request. I do not know when it was filed but likely shortly after Eldridge Hartless's death on September 1, 1882. The community of Fossil, Oregon is today in Wheeler County. This is where two of the heirs, Sarah Oglesby and Virgina Stilson, were said to have lived at the time. Eldridge had also adopted his step-son, John Henry Bates, son of Emily from her first marriage to John Bates. I do not know if John Henry had any claim against the estate. The heirs listed were all Eldridge's blood children. Sarah, Virgina and William were children of first wife Lucy Willet whom Eldridge divorced. Clara and Eldridge (Jr.) were the children of Emily.
