Geo.W.Hahn, respndent, vs. Guardian Assurance Company, appellant, appeal from Multnomah county; judgement reversed and the cause remanded to the couty below for such further proceedings as are not inconsistent with this opinion. Opinion by Lord, C.J. Joseph Hughes, respondent, vs. Edward Holman, appellant. The motion to recall the mandat in this cause and for the modification of the judgement as to the allowance of costs to the respondent is allowed upon the authority of the judgement as of this couty in the case of Wood vs. Fitzgerald. 3 OR 568. While the court feels bound ot respect the decision in that case as the law of th epresent case, its correctness is doubted, and when a question is properly presented and brought here upon appeal it will be re examined. L.W. Nelson, appellant, vs. S.W. Blaisdell et al., espondents. The motion for modification of the decree herein in the court below is overruled and denied. Held, that the modification suggested would probably affect parties to the decree no tbrought before the court on appeal, and cannot therefore be made.
