Monring Oregonian October 29, 1904
Lakeview,Oct.28-(Special)_ Accused of the murder of Timothy Ahern,November 
21,1903,at Plush,Philip Bery was pronounced not guilty by a trial jury. At the 
time of the shooting,according to the testimony,Barry was on norseback in a 
drunken condition. Two shots were fired,one of which strcuk Ahern. Testimony 
introduced at this trial was materially different from that brought out at the 
frist trial,when the jury disagreed.
