The evidence showed that James Johns, founder of St.Johns, died in 1886. He devised all of his property to the public. By the terms of his will it was sold by his executors, P.T.Smith, C.W.Burrage and P.A.Marquan, 15 years after his demise. The proceeds were to be donated to instruction and maintanence of a free school at St.Johns. Mr. Johns had no directr heirs. Some time ago the heirs of his brother, Ira Johns, and his sister, Mrs. Elizabeth Erwin, of Indiana, learned of the death of their uncle and petitioned to have the will set aside. They asserted that he was not in his right mind when he made the testament in 1883. Edward A.Deady and H.B.Nicholas, who witnessed the will,stated that Mr.Johns' mind was perfectly clear at all times. The case will be resumed this morning.The property is said to be woth $100,00.
