Portland, Or., April 1 -- Pat C. Lavey, promoter of the Oregon Land Development company, and who confessed in the United States court some time ago to defrauding people out of more that $22,000, yesterday was sentened by Judge Wolverton to serve one year in the county jail and pay a fine of $1000. The sentence was given on the recommendation of the United States Attorney Johnson. Following the sentence Lavey said: "The government has given me a square deal all the way through, I have no complaint to make." There were tears in his eyes when he shook hands with the United States attorny and Inspector Harry Durand of the postoffice department, who was instrumental in having the case brought into court. He was given a few days before commitment to arrange his affairs. Lavey secured a contract with John Vesson to buy about 35,000 acres of land in southern Oregon in September, 1900. He immediately began to sell contracts to this land. In November his contract was canceled, and when he continued to operate, the government arrested him and charged him with using the mails to defraud. The case hung for nearly a year as Lavey requested time, and then finally the realty operator came into court and pleaded guilty. On the grounds that Lavey will pay back all the money he secured under false pretenses, through the sale of lots he owns in southern Oregon, that he pleaded guilty, and that he started into the Oregon Land Development company with honest intentions, the attorney for the defense this morning asked the Judge that Lavey be not sent to the federal jail. The United States attorney outlined the case, pointing out how the government had given in time after time and allowed the defendant extensions, how after he had pleaded guilty he asked for 30 days in which to pay back his creditors and failed to do so, and declared that the government cannot act as a collection agency, but can only prosecute the case on its merits. He recommended, however, that since Lavey has shown and inclination to do all he can in the way of restitution, and since if he is confined in the county jail, he can continue this work, that the defendant be sentenced to pay a fine of $1000, and to serve one year in the county jail. Judge Wolverton adopted the recommendation of the prosecuting attorney.
