All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/or/orfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Sheron Faynor nitwittwin@hotmail.com May 1, 2008, 10:36 am Morning Oregonian September 14, 1904 Aged Man Says That He Was Cheated Out Of Home Signed Deed Instead of Will Peter Fisher,a Cripple Aged 87,With A Wife Aged 84,Sues HIs Son,J.R.Fisher,For Recovery Of Property Peter Fisher, a cripple87 years old,whose wife,Caroline,has passed the 84 mark,says their son,J.R.Fisher,has endeavored to cheat them out of a house and two lots at Sellwood.The old man says he signed what he supposed was a will and which afterward transpired to be a deed of property in favor of his son.The latter is accused by his aged parent of compelling him to cut cordwood and eat at the second table. Mr.Fisher yesterday filed suit in the State Circuit Court to revoer the property which he values at $1000 and which he avers is all he has to support himself and his aged helpmate,and his only income if from the retn of the house or sale of the property.He alleges that he has reared,cared for and brought to a man's estate his son John,the defendant in this action. In the year 1902 John came to him with protestations of friendship and fillial devotion and induced him to give up his home where he was happily situated and live with him,John. He was to will the property to the son,but by misrepresentations and fraud he avers he was induced to sign a deed. The compaint recites further that Fisher is able to understand the German language and was not aware the he signed a deed in which the consideration for the transfer wa splaced at $900. Shortly after the deed was signed the old man asserts that he and his wife were treated so badly that they were compelled to leave their son's home and seek aid from the county. Judge Webster investigated the case and advised his clerk,Jay Upton,who is an attorney, to bring this suit.
