Last winter Mr.Melson was driving on Williams avenue in a two horse wagon, when one of the horses suddenly disappeared in a sewer trench.It required about six hours to extricate the animal, and he received injuries that caused his death. The plaintiff alleged that he was offered $125 damages by the contractors, but he would not take less that $150, which was refused. Melson valued the horse at $200, and his trouble and expense on consequence of the accident at $27- making a total of $227 damages. Several witnesses were examined to prove that the horse was valued at $200. The attorney for the plaintiff said that he has examined the records and found the sewer had not yet been accepted by the city at the time of the accident. The defense presented no evidence. A judgement was given for the full amount asked against P.Touchy and P.Frainey, it being shown that James Frainey had nothing to do with the contract. An appeal will be taken.
