John Mock has filed suit in teh State Ciruit Court against Anna L.Caples,Nancy Caples,Daisy Caples,Vernon Caples and Agnes L.Miller,to be relieved fro mthe further performance of a trust relating to a tract of land near St.Johns.The compaint states that on April 4,1899,Nancy Caples made a deed of trust covering the property withot his knowledge or consent,for the benefit of Dasiy,Esther and Vernon Caples,minor children of Anna L.Caples,during their infancy,and upon arrival of the youngest at majority to convey the same to them by a good and sufficient deed. It is alleged that Mock has collected the rents of the property and carried out the provisions of the trust.The deed,it is asserted,was afterward delivered by Nancy Caples to Daisy Caples without the consent or knowledge of Mock,and Daisy Caples caused it to be filed for record on April 16,1904.She reached her majority about that time.Esther Caples died in 1899,while still a minor. Mock asks to be allowed to renounce the trust,and that a trustee be appointed who may be designated by the parties interested. He waives all compensation,and requests the court to allow the attroneys reasonable compensation for bringing this suit.
