David W.West was released from the county jail at 9:30 o'clock yesterday morning on the pardon granted by Governor Pennoyer,which was mentioned in the morning dispatches. West is the deputy United States Marshall of Seattle, who, with Ah Louie, a Chinaman, arrested Mrs.Sue Wing in this city in January, and carried her off to Seattle without going to the trouble of having his papers endorsed by the federal officials here, and then made false returns on the warrant to the United States Commissioner Spriggs.The woman was released and brought back to Portland on a writ of habeus corpus issude by the United States Circuit Judge Gibert, and then West and Ah Louie were indicted by the grand jury for kidnapping. On February 15 they were convicted of assault and battery. Owing to the gravity of the offense Judge Stearns, sitting in the criminal court, refused to impose a fine, but sentenced each of them to six months in the county jail, the extreme penalty of the law.Ever since his conviction, West's friends have een working for a pardon. Deputy Collector McKenzie, of Seattle, circulated a petition which was numerously signed and was presentd to Governor Pennoyer. The plea was made that West's intentions were good but he acted ignorantly. West left for Seattle on the afternoon train. Before his departure he calle don Judge Munly, of the criminal court, who allowed him to withdraw his commission as Deputy United States Marshall, which had been introduced into evidence. West said that he never felt etter in his life, despute his two month's imprisonment. He remarked he would be more careful about serving his papers in the future. The pardon did not include Ah Louie, who is still confined in the county jail.
