Under the law as intrepreted by the Oregon Supremem Court,she is not his wife,and under a decision of the Supreme Court of Washington,in which state the marriage ceremony was performed,she is the legal wife of Trigg. She was divorced from a former husband named Talbert,and within six months was married to Trigg at Vancouver,Was. The Oregon statute provides that a divorced person shall not become married to a third person until the expiration of six months,and the Supreme Court has held that such marriage within six months is void wether solemnized in this or any other state.The divorce statute of Washington is similar,but the Washington Supreme Court has decided that the marriage of a person in California who was divorced in Washington within six months before the California marriage was good. Mrs.Talbert in her complaint alleges that Trigg was aware it was unlawful for her to go to Vancouver and have a marriage ceremony betweeen them performed: and that when she ascertained the fact later on and asked him to leave a second wedding,and make her his legal wife,he refused. Trigg has filed an answer through his attorney J.F.Boothe,in which he alleges that the Vancouver marriage was lawful,and says Mrs.Talbert deserted him.he also alleges that he offered to marry her over again,but when the time came she declined unless he would make a deed in her favor covering valuable property. Trigg,when the suit was filed,gave the Deputy Sheriffs a lively chase,and they were unable to find him and serve him with the papers in the suit for some time.He was finally discovered attending a Grand Army encampment at Hood River and given a copy of the complaint. Judge N.H.Bloomfield,counsel for Mrs.Talbert,says Trigg has sued her for a divorce in Vancouver,and avers that they were lawfully wedded. Two decisions of the United States Supreme Court are said to follow the rule laid down by the Oregon court in this class of case.
