All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/or/orfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Sheron Faynor nitwittwin@hotmai.com December 26, 2007, 11:05 am Morning Oregonian November 3,1904 Mrs.Dolph Granted Divorce Judge Galloay Hods Grounds of Desertion Valid Salem,Or.Nov.2-(Special)-Chester V.Dolph and Augusta Armstrong Dolph were granted a decree of divorce today by Circuit Judge William Galloway,in a suit brought by the wief.Desertion was the cause alleged.The complaint was filed late last night after the ususal office hours,and the case was tried today without a contest. The complaint was not served upon the defendant in the usual manner,but C.V.Dolph made a voluuntray appearance by filling a demurer by his attorney George G.Bingham. The demurrer was overrulled without argument and a stipulation was then filed,signed by J.Fred Yates,for the plaintiff and Mrs.Bingham for the defendant,agreeing to the decree which should be rendered,if any. Judge Galloway took the testimony of the plaintiff as to the deseertion,and gave a decree in her behalf,in accordance with the stipulation.The decree allows Mrs.Dolph a life estate in two thirds interest in C.V.Dolph's real property,anf gives her custody of the three children-Ruth,Dorothy,and Adelaide.Mr.Dolph is required by the decree to pay MrsDolph $110 per month,but it is specified tat this shallbe paid only in case the net profits from one half the propoerty interests awarded to her do not amount to $100 per month. Dolph is to pay only the deficiency.he is also required to keep up the patments in certain insurance policies in which Mrs.Dolph and children are named as benificiary. Efforts were made to keep the divorce proceedings from the public,and only the parties,court officers and witnesses knew what was going on.The Dolphs were married in Vicotria,B.C. in 1892.The desertion is alleged to have covered a period of four years.Neither of the parties to the suit resides here.
