All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/or/orfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Sheron Faynor nitwittwin@hotmail.com November 28, 2006, 8:26 pm Canby Herald December 18, 1924 Case May be Aired In State of Wshington,Is The Latest Report Investigations made Commenting on Bancy case,mr Hall Says Washington Laws Will Be Enforced When Possible Recent investigations and developments in the Shaw-Samuelson nuptial event indicate that it is likely to be aired in another state and county Joe E Hall,prosecuting attorney of Clarke County,Washington,in speaking of the marriage which set gossip on a rampage throughout the State of Oregon,said in substance: "Whenever we have had information that the law was being violated,in time so that we could arrest the offending parties within this state,we have always done so.Many witnesses who have perjured themselves in regard to the age of one of the contracting parties have been confined in the county jail ofr variuos lengths of time" Rosamund Lee Shae,in making application for a marriage license at Vancouver,Wash.,gave her age as 19 years,and her home address in Seattle,Wash.In her application for a drivers license,which was issued in Portland,on the 23rd day of February,1924,before she thought of marrying her pupil husband,gave her age as 27 years,and date of birth as February 9,1897.In this she represented as a journalist and not a teacher. Young Samuelson,at the time of making application for a marriage license,gave his age as 21 years ,and his home address Portland,oregon.in ihs application for a drivers liocense the boy said he was 16 years of age,and that he was born on the 31st day of May 1908.Garnet Hansen of North 20th Street,Portland,on the 10th day of November,1924,said "I,mrs garnet Hansen,being first duly sworn ,state that I am personally acquainted with rev Roy Samuelson of Portland,Oregon,and know him to be over the age of 21 years,and that I am personally acquainted with Miss Lee Shaw od Seattke,Washington,and know her to be over the age of 18 years." In the certificate of marriage the groom is represented to be 21 years of age at his last birthday,and the bride as 19,and they fixed their signatures,Ray Samuelson,groom and lee Shaw,bride,beneath the following statement;"We the groom and the bride named in this certificate,hereby certify that the information given herein is correct to the best of our knowledge and belief" To prevent such perjury and misrepresentations as this Washington has provided laws.Section 3725-License-(Pierces Code of the State of Washington,1923)"the county auditor,before a marriage license is issued,upon the payment of a license fee of $2.00,shall require each applicant therefore to make and file in this office upon blanks provided showing that the applicant is qualified mentally and physically.And that the female is over the age of 18 years and the male is over the age of 21 years.Anyone knowingly swearing falsely to any o fthe statements contained in the affadavit mentioned in this act shall be deemed guilty of perjury and punished as provided by the laws of the state of Washington. Section 3726 provides that any person knowingly violating any of the provisions of this act shall upon conviction,be punished by a fine of not more than one thousand dollars,or by imprisonment in the state penitentiary for a period of not more than three years,or by both such fine and imprisonment. There is also a statute of that state thet termed"second degree perjury,which seems to cover the case referred to herein"Every person who.wether orally or in wrting,and wether as a volunteer,or in a proceeding or investigation,authorized by law,shall knowingly swear falsely concerning any matter whatsoever,sahll be guilty of perjury in the second degree and shall be punished by imprisonment in theState penitentiary for not more than five years,or by imprisonment in the county jail for not more than one year." Investigations growing out of the Canby High School Affray are in rapid progress by interested parties in Canby,it is said,ans some startling facts in connection with the Shaw-Samuelson marriage have been brought to light.It is intimated that the interested parties in this contract,and the witness may be called upon to explain matters before the courts of Washington at some future date.
