Graduated at West Point in 1844. Was commissioned second lieutenant in the Eighth Infantry, and won special distinction in the Mexican campaign. He resigned his commission in 1848, and from 1854 till 1861 was a civil engineer in Pittsburg. At the out-break of the Civil War Hays re-entered the service as colonel of the Sixty-third Pennsylvania. He took part in the Peninsula and Maryland campaigns, and in September, 1862, was appointed brigadier-general of volunteers. In the battle of Chancellorsville he was wounded while at the head of his brigade. He served in the battles of Gettysburg, Auburn, and Mine Run, and as commander of the Second Brigade of Birney's Third Division of the Second Corps gallantly met his death in the battle of the Wilderness, May 5, 1864.
