THOMAS M'KEAN, Governor Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act declaring a marriage to be fraudulent, null and void. Whereas the marriage contract, ought, above all contracts, to be free from fraud, artifice and collusion, and it hath accordingly been the policy of legislators of every age and country to annul the same, whenever it appears that either party, being of tender years, hath been seduced and ensnared by menaces, intimidation, imposition, falsehood and deceit, to enter into an engagement, without the consent or privity of parents, guardians or friends, whereas a French emigrant named ALEXANDER DE TILLY, (commonly called COUNT DE TILLY) did by bribing and corrupting the servants of WILLIAM BINGHAM of the city of Philadelphia, commence and prosecute a secret correspondence with MARIA M. DE TILLY (then MARIA M. BINGHAM) the daughter of William Bingham, of the tender age of 15 years, and in the course of such correspondence, by acts most seducing, fraudulent and iniquitous, as well as by menace and intimidations, ensnared Maria M. de Tilly into a midnight elopement from the house of her parents, and conveyed her to the house of a minister, who was induced to pronounce the marriage ceremony between the parties, and whereas Alexander de Tilly, actuated by no motive religious, moral or civil, but intending thereby merely to obtain and extort a sum of money from William Bingham, did, soon after the fraudulent marriage, offer to sell and surrender, and did actually sell and surrender all his marital rights for a pecuniary consideration, and hath since withdrawn himself from the United States, leaving and deserting Maria M. de Tilly, therefore, the marriage of Alexander de Tilly and Maria M. de Tilly, is hereby declared null and void and they are declared separate, set free from all duties as fully as if they had never been joined in matrimony. 17 Jan 1800. 2. An act for erecting part of York county into a separate county. That the REV. ALEXANDER DOBBIN and DAVID MOORE SEN., of Adams county, are hereby appointed trustees for the county of Adams. 22 Jan 1800. 7. An act for raising moneys by lottery, to build churches. That JACOB WEIRICH, PHILIP GREENAWALT JR., JACOB PEIFFER, HENRY SHEFFER, JOHN GRUM and VALENTINE MILLER, are hereby appointed commissioners to raise no more then $2000.00 to defray the expence of erecting the church lately built by the German Reformed congregation in the borough of Lebanon, Dauphin county, and for defraying the expense of erecting the church lately built by the German Reformed congregation in the town of Heidelberg, Dauphin county. That DAVID DRAUSE, FREDERICK HUBLEY, JOHN WEIDMAN, HENRY GILBERT, PETER SHINDLE and CHRISTOPHER UHLER, are hereby appointed commissioners to raise by lottery, a sum not exceeding $2400.00, to be applied for defraying the expense of erecting the church lately built by the German Lutheran congregation in the borough of Lebanon aforesaid. 10 Feb 1800. 8. An act for erecting parts of the counties of Mifflin, Northumberland, Lycoming and Huntingdon, into a separate county. That ANDREW GREGG, WILLIAM SWANZEY, and ROBERT BOGGS of Bald Eagle, are hereby appointed trustees for Centre county for the payment of money and grants of land, as hath been stipulated for by JAMES DUNLOP and JAMES HARRIS, by their bond, and the inhabitants shall hold their their elections at the house now occupied by ARCHIBALD STEWART, and so much of Franklin twp., included in Centre county, shall hold their elections with the inhabitants of Potter and Patton, at the house now occupied by WILLIAM KING, in Potters twp. 13 Feb 1800. 9. An act to compensate the heirs and devisees of JOHN RANKIN, late of York county, dec. Whereas John Rankin, late of York county, dec., did, in Oct 1779 purchase from the agents for confiscated estates a tract of land situate in Newbury twp., forfeited by JAMES RANKIN, for which land ELIZABETH RANKIN, widow of John Rankin, obtained from this commonwealth a deed of conveyance, made to her as sole executrix, named in the last will of the deceased, and in order to gain possession of the premises, Elizabeth brought a writ of ejection against SAMUEL BRADY then in possession of the premises, claiming the same under a title paramount, in the court of York, which was tried in Sep. term, 1797, and verdict given for Samuel Brady against Elizabeth Rankin, deciding she did not have a good deed, therefore, the state treasurer is to pay $310.00 to Elizabeth Rankin, as full compensation for all costs and damages sustained through the defect of the deed. 19 Feb 1800. 10. An act to appropriate a sum of money to defray funeral expenses of the late GENERAL THOMAS MIFFLIN. Whereas on the 20 Jan 1800, resolve that the remains of the late Major General Thomas Mifflin be interred at the sole expense of this commonwealth conceiving it due to his memory, and thereby manifesting their sense of his numerous and many important services, therefore, the state treasurer is hereby authorized to pay $192.45, to WILLIAM PENROSE, chairman of the committee of accounts, for discharging the funeral expenses of the late Thomas Mifflin. 19 Feb 1800. 11. An act to declare part of Shaver's creek, Huntingdon county, a public highway. Shaver's creek from its mouth up to the line of JOHN CRAWFORD and JAMES CRAWFORD's land, is hereby declared a public highway. 19 Feb 1800. 13. An act to enable owners of a tract of marsh meadow, situate on the west side of Darby creek, and adjoining the Delaware river, in Ridley twp., Delaware county, to keep banks, dams, sluices and floodgates in repair, and to raise a fund to defray the expenses. That the owners of the tract of meadow, shall be called the Ridley Meadow Company, and shall meet every year at the house now occupied by THOMAS WEST. Beginning at the fast land near the house late of SWAN CULIN, dec., to a post, shall belong to CALEB DAVIS ESQ., to a stake at the beginning of the dam, shall belong to WILLIAM PAUL, to a white oak, shall belong to the estate late of WILLIAM HOSKIN, dec., to a stake at a dam shall belong to JACOB PAINTER, and heirs of THOMAS SMITH, dec., to a stake, shall belong to WILLIAM PAUL, to a stake, shall belong to JOHN CROZER, to a stake, shall belong to AARON MORTON, to a stake, shall belong to PETER HILL, to the fast land near the house late of ISAAC HENDRICKSON, belong to the said company. 26 Feb 1800. 14. An act to authorize the sale and disposal of real estate. Whereas JOHN B. PALMER and FREDERICK HEISZ were duly appointed a committee, to take care of the person and estate of JACOB PALMER, a lunatic, and it appears Jacob Palmer hath not any personal estate, therefore, it shall be lawful for the committee to sell and convey all the real estate of Jacob Palmer, to provide for the necessary substance and clothing for Jacob Palmer. 1 Mar 1800. 17. An act authorizing the commissioners of Northampton county, to receive for a limited time the toll from travelers passing over the bridge erected over the Lehigh, where the road leading from Easton to Philadelphia crosses the same. Whereas, ABRAHAM HORN, in pursuance of a low passed 4 Apr 1796, erected a bridge, which proved insufficient and failed, and he at his own expense, erected a bridge at the same place, and he had expended $2333.34, in erecting permanent pillars to support the bridge, over and above the expenses of building the same, therefore, the commissioners of Northampton county, shall receive the tolls, and pay the amount due of $2333.34 to Abraham Horn. 1 Mar 1800. 22. An act to grant restitution for lost certificates. Whereas certificates of funded debt were issued for militia pay, bearing interest from Jul 1783, #5798, for 1 pound, 18 shillings, and 6 pence, in favor of JAMES BOGGS, #5813, for 1 pound, 1 shilling, in favor of JOHN BOGGS, and #5848, for 9 pounds, in favor of WILLIAM ATKINS, on all of which 2 years interest hath been paid, and as interest is payable only to the 1st day of Aug, 1792, therefore, the state treasurer is authorized to pay James Boggs, John Boggs and William Atkins the interest due from the 1 Jul 1785 until 1 Aug 1792. 3 Mar 1800. 25. An act to revive and amend an act incorporating a company, for the purpose of promoting the cultivation of vines. That SAMUEL MILES, TIMOTHY PICKERING, ISRAEL WHELEN, BENJAMIN SMITH BARTON, BENJAMIN SAY, WILLIAM SHEAFF, PETER STEPHEN DUPONCEAU, JOHN VAUGHAN, B.H. LATROBE, SIMON CHAUDRON, SAMUEL COATES, STEPHEN GERARD, JAMES GIBSON, SAMUEL WETHERILL and CASPER WISTAR JR., are hereby appointed commissioners. 7 Mar 1800. 27. An act to incorporate the town of Frankford, in Philadelphia county. That the town of Frankford is hereby erected into a borough, bounded, beginning at Frankford creek, between land of RUDOLPH NEFF and land now or late of HENRY BOVER, to the mouth of Tacony creek, to JACOB SMITH's land, by land of Jacob Smith, ROBERT SMITH, and others to the beginning. 7 Mar 1800. 28. An act to enable executors to make certain conveyances. Whereas JOHN STEIN, late of the city of Philadelphia, dec., being seized of a lot situate in Upper Merion twp., Montgomery county, containing 50 acres, by parole contract, agree to sell and convey the same to WILLAM HENDERSON, for the sum of 400 pounds, but John Stein died before a deed of conveyance was executed, therefore, CATHARINE STEIN, ABRAHAM STEIN and CHARLES MARQUEDANT, executors of the last will and testament of John Stein, dec., are authorized to make and execute a deed for the lot beginning at a chestnut oak on JOHN PHILLIPS' land, to HENRY lain GRIFFITH's land, by THOMAS REES' land, to the beginning. Whereas CHRISTIANA M'CAMMON has administered upon the estate of SAMUEL M'CAMMON, dec., her late husband, who died intestate, and that Samuel laid out and contracted for the sale of 10 lots in the town of Shirleysburg, Huntingdon county, but departed this life without executing conveyances for the purchasers, therefore, it shall be lawful for Christiana M'Cammon to execute deeds to the purchasers. 12 Mar 1800. 29. An act to empower the commissioners of Chester county, to sell lots belonging to the county, and also to purchase a lot on the west side of the goal. That WILLIAM ROGERS, EVAN EVANS and JOHN MENOUGH JR., commissioners of Chester county, to purchase the ground on the west side of the goal for a goal yard, and the commissioners are empowered to sell and convey by deed, the property of the county, on the north side of the courthouse, prison and prison yard, and shall permit the same to remain forever an open highway. 12 Mar 1800. 30. An act to authorize the erection of a mill dam in Swatara creek, Dauphin creek. Whereas CHRISTIAN BEAR, a proprietor of a plantation situated for water works, adjoining Swatara Creek, which was declared a public highway, is hereby authorized to erect, support and maintain a mill dam opposite his plantation, about a half mile from Hummelstown, having first obtained permission of PETER EVERSOLL, the owner of the land opposite his, provided the rights of every person shall remain inviolate, and especially the privileges granted to ADAM HAMAKER, and the company incorporated for the purpose of opening a canal and lock navigation from Susquehanna and Schuylkill, shall not be impaired. 12 Mar 1800. 31. An act vesting in the city of Philadelphia, a lot of ground. Whereas by an act passed 8 Apr 1786, disposing of the house and lots in High street, in the city of Philadelphia, late the estate of JOSEPH GALLOWAY, and forfeited to the commonwealth, council was authorized to reserve public lots and a burial ground, which is now so full future interments have been prohibited, the other lot having previously granted by patent to WILLIAM ADCOCK and CHRISTIAN RITIZ, therefore, the lot bounded by Ninth street, Lombard street, etc. is hereby vested in the city of Philadelphia for the purpose of interring deceased strangers. 12 Mar 1800. 34. An act to erect parts of Allegheny, Westmoreland, Washington and Lycoming counties, into separate counties. That part of Armstrong county, westward of the Allegheny river, shall be a separate election district, and the inhabitants shall hold their elections at the house now occupied by JOHN SMITH ESQ. That part of Washington county, annexed to Beaver county, shall be annexed to and be part of Allegheny county, with RUEL REED's land east of the state line shall hold thier elections at the house now occupied by SAMUEL LYON in Georgetown, and the inhabitants that part formerly Washington, now Beaver county, shall hold thier elections at the house of SAMUEL WILSON. The inhabitants of the parts of the counties of Beaver and Mercer, in the first and second districts of donation lands, shall hold their elections at the house now occupied by JOHN ELLIOTT, and the inhabitants of part of Mercer county, in the 3rd, 4th, and 5th districts of donation lands, shall hold their elections at the house now occupied by BENJAMIN STOKELY. DAVID MEADE, FREDERICK HAMAKER and JAMES GIBSON, are hereby appointed trustees for the county of Crawford, and JONATHAN COULTER, JOSEPH HEMPHILL and DENNY M'LURE, are hereby appointed turstees for the county of Beaver, and JUDAH COLT, THOMAS REES and JOHN D. HAY, for the county of Erie, and WILLIAM MILES, THOMAS MILES and JOHN ANDREWS for the county of Warren, and GEORGE FOWLER, ALEXANDER M'DOWELL and JAMES M'CLARION for the county of Venango, and ADIEL M'LURE, JAMES AMBERSON and WILLIAM in ELLIOTT, are hereby appointed trustees of Butler county, and BENJAMIN STOKELY, WILLIAM M'MILLAN and JOHN WILLIAMSON, for the county of Mercer, and JOHN CRAIG, JAMES SLOAN and JAMES BARR, for the county of Armstrong. 12 Mar 1800. 39. A supplement to an act raising by lottery, a sum not exceeding $10,000.00 for completing the building of the Roman Catholic Church of Saint Augustin, in the city of Philadelphia. EDWARD CARRELL, JOHN TAGGARD and THOMAS SHORTALL, are hereby appointed commissioners in common with the commissioners already appointed. 13 Mar 1800. 43. An act to authorize the building of a toll bridge across the river Youghiogheny, at Connelsville, in Fayette county. It shall be lawful for ISAAC MEASON and ZACHARIAH CONNELL, to erect, build, support and maintain a good and substantial bridge. 15 Mar 1800. 44. A supplement to an act erecting part of the county of York into a separate county. Whereas the REV. ALEXANDER DOBBIN and DAVID MOORE, are appointed trustees to erect public buildings in Adams county, therefore it shall be lawfull for WILLIAM M'CLELLAN, HENRY HOKE, and WILLIAM HAMILTON, to contract for a lot in the town of Gettysburg, to erect and build a courthouse and prison. 15 Mar 1800. 45. An act vesting lots for the use of a church. Whereas the trustees of the Fourth Presbyterian church, in the city of Philadelphia are unable to purchase a lot to build a church on, and to inter the dead, request a city lot, therefore, the right, title and interest of the commonwealth to the city lot bounded by 12th street, Lombard street, and south by AMOS WICKERESHAM and RICHARD P RICE, is hereby vested in the trustees of the Fourth Presbyterian church. 15 Mar 1800. 50. An act to open and improve the road from Mifflin to Cumberland county. Whereas, after opening the road from DAVID BEALE's in Mifflin county, over the en of Tuscarora, and over West Conecocheague mountains, to GEORGE M'MULLIN's in Shearman's valley, in Cumberland county, is too difficult to be accomplished by the twps., therefore, David Beale and JOSEPH M'COY of Mifflin county, are appointed commissioners. 15 Mar 1800. An act for erecting election districts in the county of Luzerne. That Huntingdon twp., Luzerne county, shall be an election district, and the electors shall hold their elections at the house now occupied by CHARLES E. GAYLORD. That the township of Brantum, Luzerne county, shall be an election district, and the electors shall hold their elections at the house ow occupied by JAMES WHEELER. That part of Wyalusing, Wysock, Tioga and Willingborough twps., shall be a separate election district, and the electors shall hold their elections at the house now occupied by EZEKIEL HYDE. 1 Dec 1800. 3. An act to raise by lottery, a sum of money to complete a church. That FREDERICK SEGAR, ADAM MILLER JR., GEORGE ECARD JR., JACOB COLSRODE, JACOB RENGEWALT, PHILIP DIFFENDEFFER and HENRY REAM, are hereby appointed commissioners, to raise no more then $4000.00 to defray the expense of completing a church, lately built by the German Calvinist congregation in the village of New Holland, Lancaster county. 1 Dec 1800. 6. An act erecting two election districts. It is hereby enacted that beginning at the three forks of Buffalo creek, up the westerly fork called Buck run to JOHN GRAHAM's to ALEXANDER GRAY's, etc., thence to Williamson's road at JOSEPH LAURAMORE's, to beginning, in Washington county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by JAMES KERR, in the town of Brunswick. That the following in Washington county, beginning at the state line, where Greene county line intersects, up Wheelen creek and Enlow's fork, etc., to the house of Alexander Gray, to John Graham's, down Buck run to West Liberty road, to beginning, shall be a separate election district, and the electors shall hold their elections at the house now occupied by ROBERT STEVENSON. The following bounds shall be annexed to the 6th district, beginning at the late REV. JOSEPH SMITH's meeting house, thence to Cross Creek twp., along the line to the road from Canonsburg to _____ WELL's mills, to JOHN MARSHALL's, to the REV. THOMAS MARQUAS' old place, to HARMONIS COLE's, along the Mingo bottom road to the state line. 1 Dec 1800. 7. An act to erect a new election district in the county of Huntingdon. That so much of Allegheny twp., Huntingdon county, shall be a separate election district, 9th district, and the electors shall hold their elections at the house now occupied by CORNELIUS M'GUIRE. That the electors of the 6th district, Huntingdon county, who reside etc., thence up Big Trough creek, to PHILIP CURFMAN's saw mill, to include the house of JOSHUA CHILCOT JR., to the 8th election district, shall be part of the 1st election district. THat part of West twp., Huntingdon county, etc., up Shaver's creek until the great road leading from ALEXANDER M'CORMICK's mill to the borough of Huntingdon crosses the same, shall be annexed to the 1st election disrict. 17 Dec 1800. 9. An act altering and erecting election districts in Northumberland county. That part of the county beginning on the middle of the Shamokin hill, thence by a south line to WILLIAM WEYRICK's in Penn's twp., on Penn's creek, thence to FREDERICK STONE's, thence to JOHN DIBLER's, thence to JACOB BISHOP's, thence to GEORGE MARKLEY's, thence to PETER BURN's on Penn's creek, along the Buffalo twp., line to ABRAHAM IRELEY's, thence to TORAN O'QUIN's, thence to the top of the middle ridge of the Shamokin hills, including _____ SEABOLD's mill and farm, to the beginning, shall be a separate election district, to be called New Berlin, and the electors shall hold their elections at the house now occupied by CHRISTOPHER SEABOLD, in the town of New Berlin. That the township of Shamokin, shall be a separate election district, and the electors shall hold their elections at the house now occupied by JACOB REED, and the townships of Greenwood and Fishing Creek, shall be an election district, and the electors shall hold their elections at the house now occupied by SAMUEL SMITH in Fishing Creek twp. and the place for holding the elections for Bloom and Brier Creek twp., is hereby changed from the house of SAMUEL BOONE, to the house now occupied by DAVID FOWLER in Brier creek twp. 2 Jan 1801. 10. A supplement to the act for erecting part of the counties of Mifflin, Northumberland, Lycoming and Huntingdon into a separate county. The trustees of Centre county are authorized to erect a courthouse, prison, and buildings for keeping of the public records, on the public square in the town of Bellefonte, but it appears ineligible that a prison should be erected on the public square, therefore they are authorized to erect the prison on any of the lots conveyed to them by JAMES DUNLOP and JAMES HARRIS, and Franklin and Halfmoon twps., shall be a separate election district and the electors shall hold their elections at the house now occupied by ABRAHAM ELDER in Halfmoon twp. 7 Jan 1801. 11. An act to erect a new election district in the county of Somerset. That Stoney Creek twp., and part of Bedford twp. annexed to the county of Somerset, shall be an election district, 6th district, and the electors shall hold their elections at the house now occupied by JOHN ROADS, in Stoney Creek twp. 12. An act for the relief of ISAAC VAN HORNE. That Isaac Van Horne, a captain in the continential army, in the line, received a patent for a tract of 500 acres of donation land #51, in the 3rd district, which patent has been mislaid or lost, therefore, the governor is hereby authorized to cause a patent to be issued to Isaac Van Horne. 21 Jan 1801. 13. An act for the relief of ABRAHAM MORROW. Whereas Abraham Morrow, of the city of Philadelphia, was appointed by Governor Mifflin, to take charge and repair the public arms and he has collected, repaired and taken charge of a considerable number, therefore, the comptroller general and register general are hereby authorized to adjust and settle the accounts of Abraham Morrow. 24 Jan 1801. 14. An act to authorize the erection of a wing dam. That JAMES HULINGS, is hereby authorized to erect a wing dam on French creek, Venango county, adjoining the tract whereon he now resides, and to keep it in good repair, to lead off on his own land so much of the water as may be necessary for a grist mill and saw mill. 31 Jan 1801. 15. An act to authorize the erection of a wind dam. That ROGER ALDEN, is hereby authorized to erect a wing dam on French creek, adjoining his own land, in the county of Crawford, six miles above Meadville, and to keep it in good repair. 31 Jan 1801. 16. An act to erect the county of Adams into election districts. That Cumberland, Franklin and Mannallen twps., and part of Strabane twp., on the west of a road leading from ______ SCHRIVER's mill, to GEORGE LASHEL's and Hunterstown, etc., are hereby erected into a separate election district, 1st district. That Mountjoy and Germany twps., and part of the townships of Heidelberg and Manheim, are hereby erected into a separate election district, 2nd district, and the electors shall hold their elections at the house now occupied by JACOB WINROTT, in the town of Petersburgh, in Germany twp. That Berwick and Mount Pleasant twps., and part of Strabane twp., on th east side of the road from Schriver's mill, to George Lashel's and Hunter's town, are hereby erected into a separate election district, 3rd district, and the electors shall hold their elections at the house now occupied by WILLIAM STURGEON, in Oxford town. An act to erect an election district. That part of Londonderry twp., that lies east beginning at Dixon's ford on Swatara Creek, between the lands of ROBERT M'CALLEN and THOMAS M'CALLEN, to intersect the great road at HENRY GATES's, down the small road by MARTIN THOMAS and THOMAS M'ELWRATH's between the lnads of JOHN BOAL, and JACOB LONGNECKER, thence by a straight line between DAVID BRAND, JACOB LEHMAN and WILLIAM LOGAN's to Conewago creek, to Anvil, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by CHRISTIAN CASSEL, in Miller's town, in the county of Dauphin. 31 Jan 1801. 20. A supplement to provide for opening and improving the road from DAVID BEALE's in Mifflin county, to GEORGE M'MULLIN's in Shearman's valley in Cumberland county. Whereas no money was authorized, the commissioners are authorized to draw $350.00, from the Treasurer of Cumberland county, as part of the sum granted by the state to be paid out of taxes, and the treasurer shall be entitled to receive a credit for the same in his statement with the treasurer of the commonwealth. 31 Jan 1801. 21. A supplement to an act to convey lots of ground. Whereas THOMAS JONES and PETER FILBERT, were appointed commissioners to convey certain lots and as Thomas Jones is since deceased, and Peter Filbert has declined acting alone, therefore, that SAMUEL JONES of Philadelphia county, and DAVID JONES of Chester county, with Peter Filbert, are hereby appointed commissioners. 31 Jan 1801. 22. An act for the relief of JOHN KONKAPOT, JR. That the comptroller general and register general are hereby directed to adjust and settle the accounts of CLEMENT BIDDLE ESQ., of the money necessarily expended on the education of John Konkapot Jr., and for sending him home to his parents, the amount not to exceed $267.00. 31 Jan 1801. 25. An act to erect part of Allegheny county into a separate election district. That part of Allegheny county is hereby erected into a separate election district, 7th district, and the electors shall hold their elections at the house now occupied by ADAM PATTERSON, in Middletown. 4 Feb 1801. 27. An act to authorize trustees to complete a title. Whereas MICHAEL RUGH and ANTHONY ALTMAN, trustees of the Lutheran congregation in Hempfield twp., Westmoreland county, did on 22 Aug 1785, procure a warrant for a tract of land for the use of the congregation, and on 23 May 1789, obtained a patent for the same, and they did sell and convey unto the REV. ANTHONY ULRICH LUTGE, 106 acres, being part of the tract of land, but it appears the trustees are not vested with authority to sell and convey land, therefore, the trustees are hereby authorized to convey by deed, 106 acres to the heirs of Anthony Ulrich Lutge. 9 Feb 1801. 29. An act to erect election districts in York county. That the electors of part of Manheim and Heidelberg twps., included that part of Paradise twp. on the west of a line to begin at the house of GEORGE BEACK, thence by NICHOLAS ANDREW, GEORGE MAYER and MICHAEL FISSELL, with part of Codorus twp., on the west of a line to begin at the house of JOST RUNK, thence by HENRY STRIKEHOUSER, CHRISTIAN ROHRBACK, PETER KREPS and LUDWIG FRASHER, shall be a district, 2nd district, and the electors shall hold their elections at the house now occupied by DANIEL CLAPSADLE, in the town of Hanover. That Newbury twp., shall be a district, 3rd district, and the electors shall hold their elections at the house of ELI LEWIS, in the town of Lewisbury. That parts of Warrington, Reading, Monahan, and Huntingdon twps., shall be a district, 5th district, and the electors shall hold their elections at the house now occupied by JOHN M'CLELLAN, on the road leading from York to Carlisle. 10 Feb 1801. 30. An act to incorporate a company for making a road from the city of Philadelphia, through Germantown, to the 10 mile stone on Chestnut Hill, to New Stone bridge over Perkiomen creek, Montgomery county. That BENJAMIN CHEW JR., CASPER W. HAINS, MATTHEW HUSTON, SAMUEL BETTON, JOHN FROMBERGER and JOSEPH P. NORRIS, are hereby appointed commissions. 12 Feb 1801. 36. An act for the relief of PETER WIKOFF, JONATHAN BAYARD SMITH, and others. Whereas, PETER WICKOFF, BAYARD SMITH, and others, have received patents from this commonwealth for tracts of land, in pursuance of surveys made before the north line of this state was ascertained and that the said lands have fallen within the state of New York, therefore, Jonathan Bayard Smith and Peter Wikoff, and others, whose land fell within the state of New York, the receiver general shall issue a certificate for sum paid for the land with interest, from the time of payment and enter a credit either in taking out new warrants or in payment of arrears of former grants. 19 Feb 1801. 37. An act to incorporate a company to make a canal between the river Delaware and the Chesapeake bay, and to clear obstructions in the river Susquehanna, down to the Maryland line. Whereas Maryland passed an act on 7 Dec 1799, to make a canal between the river Delaware and Chesapeake bay, therefore, the general assembly hereby enacts the same, under the management of LEVI HOLLINGSWORTH, JOHN HUNN, JAMES C. FISHER, BENJAMIN R. MORGAN and JONATHAN BAYARD SMITH, at the city of Philadelphia, and WILLIAM MONTGOMERY and JOHN HALDIMAN at the borough of Lancaster, and ROBERT HARRIS, at the borough of Harrisburg, Dauphin county, and JESSE MOORE at the borough of Sunbury and town of Northumberland, Northumberland county, and ANDREW HENDERSON at the borough of Huntingdon, Huntingdon county, under the management of the persons appointed in the act of Maryland. 19 Feb 1801. 38. An act to erect the county of Warren, and parts of Crawford and Venango counties, into separate election districts. That the county of Warren shall be erected into a separate election district, and the electors shall hold their elections at the house now occupied by ROBERT ANDREWS. That parts of Crawford and Venango counties beginning at corner of land surveyed in the name of ANDREW CRESS, along the line of district #7 to Warren county, to the Allegheny river, to a corner of a survey in the name of ADAM FELT, to beginning, is hereby erected into a separate election district, and the electors shall hold thier elections at the house now occupied by JOEL GREENE. 21 Feb 1801. 39. An act to survey the islands in the Allegheny and Ohio rivers, and several reserved tracts of Erie, Waterford, Franklin and Warren. That the comptroller and register general are hereby authorized to settle the accounts of ALEXANDER M'DOWELL and THOMAS REES, for services in surveying the islands and to settle accounts. 21 Feb 1801. 40. An act to authorize the erection of a bridge. Whereas a number of inhabitants of the county of Huntingdon, have prayed for permission to erect a bridge across the Little Juniata, about 40 or 50 perches above GEORGE EVY's mill, therefore, it shall be lawful to erect and build a good and substantial bridge. 21 Feb 1801. 41. An act authorizing the purchase of the stone bridge. Whereas CHRISTIAN BINKLEY, on his private resources, has erected a stone bridge of ten arches across the river Conestoga, which in its design and execution, combines permanency and accommodation, therefore, the commissioners of Lancaster county, is hereby authorized to pay unto Christian Binkley, the sum of $4266.67, towards compensating him for erecting a stone bridge. 23 Feb 1801. 42. An act for extending the limits of the borough of Bristol, Bucks county. The boundaries shall be beginning at the mouth of Mill creek, to a bridge called Otter's bridge, thence by lands formerly JOSEPH BOND's, etc., thence by Waste and Milldam, up the Mill pond, on lands of PHINEAS BUCKLEY, to a stream, to the river Delaware, to beginning. 23 Feb 1801. 47. An act to sell and convey real estate. Whereas by the proceedings in the court of York county, JAMES BLACK, now in Adams county, has been adjudged a lunatic, and WILLIAM GILLILAND, ALEXANDER RUSSELL and SAMUEL COBEAN, were appointed a committee to take care of the person and estate of James Black, and as his estate is encumbered with judgements and other debts, it would be to the interest of the heirs of James Black to sell at least part of the estate to liberate the remainder, therefore, it shall be lawful for the committee to sell and convey all or part of the real estate of James Black, to pay the debts, and provide for the subsistence and clothing of the lunatic and his family. 25 Feb 1801. 48. An act empowering the trustees of the German Lutheran Congregation, city of Philadelphia, to convey the Barren Hill Church, in White Marsh twp., Montgomery county, to certain persons. About 1759 a church was built at Barren Hill, at White Marsh, then Philadelphia county, now Montgomery county, on a piece of land bought of PHILIP SHARP, and afterwards conveyed to the memorialists, and in erecting the church debts were incurred, 700 pounds, which the congregation was unable to discharge, that upon the same having been made known to a person in Germany, to whom was intrusted the distribution of a legacy, bequeathed by COUNT SOLMS, to be applied to charitable and religious purposes in PA, he had directed the debts should be discharged, in expectation the congregation at Barren Hill would be able to repay in the future. That the debts had been repaid out of the legacy, by the late REV. HENRY MUHLENBERG D.D. That upon the debt being paid Philip Sharp, yoeman, and EVA SHARP, his wife, by indenture, dated 11 Oct 1766, recorded in Deed book I, Vol. 8, page 394, granted and conveyed the tract of land, but the congregation was uninterested in the church, and on 14 Feb 1771, the memorialists executed a lease for 99 years to certain persons in England and Germany, but they had allowed it to go to ruin, therefore the persons wish the lease cancelled, and the church and land made a gift. That the congregation at Barren Hill have elected HENRY KATZ, LEONARD KOLB, and JOHN HEINS as trustees, therefore, it shall be lawful for the congregation of the German Lutheran church in Philadelphia by deed to grant, and convey as a gift, the Barren Hill church and glebe land, unto the trustees, as joint tenants. 25 Feb 1801. 49. An act altering election districts. That the electors of Lack twp., Mifflin county, shall hold their elections at the merchant mill of DR. THOMAS LAUGHLIN, in the town of Waterford. That the electors of Union twp., Mifflin county, shall hold their elections at the house now or late occupied by JOHN REED, in the town of Bellville. That Potter and Ferguson twps., Centre county, shall be an election district, 2nd district, and the electors shall hold their elections at the house now occupied by JOHN BENNER, in Potter's twp. 25 Feb 1801. 51. An act to compensate JAMES PEARSON. Whereas James Pearson in 1796, 1797 and 1798, made draughts, plans and books of reference, of the city and barrack lots, the property of this commonwealth, for which he has not been fully compensated, therefore, the state treasurer, upon adjustment is authorized to pay James Pearson the amount settled upon. 26 Feb 1801. 53. An act to extend the time for the sale of real estate. Whereas ANDREW BOYD, late treasurer of Chester county, did, on the settlement of his accounts become indebted to this commonwealth for arrearages of state taxes, 2386 pounds, 14 shillings, and 4 pence, for the security of the sum Andrew Boyd did convey a real estate, situate in Chester county, to JOHN M'DOWELL in trust, to be sold in 12 months, from March 1800, but wishes an extension of the time as many misfortunes and peculiarly distressing circumstances have attended Andrew Boyd, therefore, the time limit is hereby extended to the 10 Mar 1805. 26 Feb 1801. 54. An act for the relief of JOHN RENISON. That the state treasurer is hereby authorized to pay to John Renison the sum of $475.95, who was formerly an ensign in the 7th PA. regiment in the revolutionary war, who has since become disabled and blind. 26 Feb 1801. 55. An act to authorize WILLIAM TURNBULL, to commence a suit against the commonwealth. Whereas William Turnbull and company, agents for the royal marine of France, became entitled to a credit from the state, in the sum of 28,334 pounds, 14 shillings, continential money, therefore, William Turnbull is hereby authorized to commence an action against the commonwealth, in the supreme court, for the moneys claimed, and upon trail, the jury shall find for the plaintiff, the state treasurer shall pay out the money. 26 Feb 1801. 56. An act to enlarge election districts in the county of Lycoming. That Muncy twp., and others composing the 2nd district, shall hold their elections at the house now occupied by JACOB MIRRIL, in the town of Pennsburg in Muncy creek twp. That those parts of Baldeagle twp., shall be annexed to the 4th district, and the electors shall hold their elections at the house lately occupied by HUGH ANDREWS, in the town of Dunsburg. 59. An act to authorize the treasurer to receive certain certificates. Whereas GEORGE ROSS, formerly a judge of the court of vice admiralty, paid DAVID RITTENHOUSE, then treasurer of the commonwealth, certain continental certificates, amounting to $24,700.00, continental money, and the treasurer entered into a bond to indemnify the George Ross, against any claim made for the certificates, and the bond has been lost, therefore, the treasurer is hereby authorized to demand and receive from the heirs of David Rittenhouse, the certificates, and as soon as the treasurer receives them with the interest, he is hereby authorized to enter into a bond of indemnity to the heirs of David Rittenhouse, to secure against any claim which shall be made on them for the certificates and interest. 26 Feb 1801. 60. An act to erect the townships of Salisbury and Sadsbury, Lancaster county, into a separate election district. An act declaring the rivers Codorus and Conewago, York county, public highways. The judges of the district composed of Berks and Dauphin counties, shall meet at the house now occupied by PHILIP GREENWALT, in the borough of Lebanon, the judges of the district composed of Northampton, Wayne and Luzerne counties, shall meet at the house now occupied by PHILIP SCHUP, in the county of Northampton, the judges of the district composed of Fayette and Greene counties, shall meet at the house now occupied by THOMAS CLARE, in the county of Fayette. 27 Feb 1801. 63. An act erection two election districts in Mercer county. That Salem twp., Mercer county, is hereby erected into a separate election district, 7th district, and the electors shall hold their elections at JOHN WILLIAMSON's mill. That so much of Mercer county, lying west of the donation land, to the state line, is hereby erected into a separate election district, 8th district, and the electors shall hold their elections at the dwelling house now occupied by BENJAMIN BENTLY. That the citizens of Mercer county, who held their elections at the house of JOHN ELLIOT, and not included in the district to hold their elections at Benjamin Bently, are hereby annexed to the district which held their elections at the house now occupied by BENJAMIN STOKELY, and the inhabitants of Beaver county, who held their elections at the house of John Elliot, shall be annexed to the district which holds their elections at the town of Beaver. 27 Feb 1801.
