Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 2. An act for the relief of EDMUND MILNE. Whereas Edward Milne hath paid JOHN NICHOLSON, then comptroller general, the balance of a judgement obtained against him, which still continues a lien on his property and from which it cannot be relieved, therefore, the attorney general cause satisfaction to be entered on record, in the suit instituted in the name of JOHN HAZLEWOOD in behalf of the commonwealth, against Edmund Milne and JOHN VANDEEREN. 19 Dec 1801 4. An act for the establishment of a college at Canonsburg, Washington county. That the trustees are REV. JOHN M'MILLAN, JOSEPH PATTERSON, THOMAS MARQUIS, SAMUEL RALSTON, JOHN BLACK, JAMES POWERS, JAMES DUNLAP, and JOHN M'PHARRIN, JAMES EDGAR, JOHN M'DOWELL, JAMES ALLISON, WILLIAM FINDLEY, CRAIG RITCHIE, JOHN HAMILTON, JOSEPH VANCE, ROBERT MAHON, JAMES KERR, and AARON LYLE, Esqs., ALEXANDER COOKE, JOHN MERCER and WILLIAM HUGHES. 15 Jan 1802. 5. An act to erect a new election district. That Penn twp., Northampton county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by GEORGE SIMON WEHR. 15 Jan 1802. 6. An act to erect a new election district. That Southampton twp., Somerset county, shall be an election district, and the electors shall hold their elections at the house now occupied by ANDREW EMRICK. 15 Jan 1802. 7. An act to erect a new election district. That Half Moon and Patton twps., in Centre county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by ABRAHAM ELDER, in Half moon twp. 19 Jan 1802. 8. An act for erecting two election districts, in Montgomery county. That Limerick, Skippack and Perkiomen, and part of Providence twps., which lies west of Skippack and Perkiomen creeks, shall be a separate election district, and the electors shall hold thier elections at the house now occupied by DAVID DEWEES in Providence twp. That Upper Hanover, Marlborough, Upper Salford and Franconia twps., shall be a separate election district, and the electors shall hold their elections at the house now occupied by JOHN SCHEID, in Summeny town, in Marlborough twp. 19 Jan 1802. 10. A supplement to an act to erect part of Washington county into a separate county. The following alteration shall take place in the line between the counties of Washington and Greene, beginning at the present line, on the ridge that divides the waters of Ten mile and Whelen creeks, near JACOB BOBBETTS, etc., 22 Jan 1802. 15. An act for the relief of PETER WILLIAMS. Whereas, Peter Williams, formerly a drummer in the 3rd PA regiment, that he has lost a certificate, #471, for the sum of 88 pounds, 1 shilling, and 9 pence, granted him for the depreciation of his pay, and on which one year's interest hath been paid, therefore, the governor is hereby authorized to draw his warrant upon the state treasurer in favor of Peter Williams for the above sum, with interest, from 1 Jul 1784, until 1 Aug 1792. 2 Feb 1802. 17. An act to authorize the sale of an estate. Whereas, it appears by an inquisition taken at the alms house, in Philadelphia county, on 21 Sep 1795, by the virtue of a commission of lunacy, under the court of common pleas, that CATHARINE ERRINGER, was a lunatic, and by petition of FREDERICK ERRINGER, of the city of Philadelphia, and of the guardians of the poor, that Catharine, sister of Frederick, for several years past, hath been, and still is a charge to the city and she is seized of one undivided sixth part of a three story brick house, and lot, situate on Third street, late the estate of her father JACOB ERRINGER, dec., which ought to be applied for her support, therefore, PETER BROWNE, of Northern Liberties twp., Philadelphia county, is hereby authorized to sell and convey the share and estate of Catharine Erringer, and the monies shall be applied to the maintenance and support of Catharine Erringer, to be paid over to the guardians of the poor. 2 Feb 1802. 20. An act for the relief of WILLIAM HILL. Whereas William Hill, now resident in the state of Massachusetts, and ESTHER HILL his wife, at the time of their intermarriage, Esther was under the last will of her late father the REV. JACOB DUCHE, dec., seized of a moiety of a messuage and lot situate in Chestnut street, in the city of Philadelphia, and possessed of a moiety of personal estate consisting of 46 shares in the capital stock of the Bank of PA, 1 share of the Bank of North America, and a mortgage executed by JOHN BERNARD GILPIN, to her father, for the sum of 461 pounds, 1 shilling and 4 pence, by an indenture made 7 Aug 1798, between her father and REV. WILLIAM WHITE, doctor of divinity, and bishop of the protestant episcopal church of PA., and MIERS FISHER, of the city of Philadelphia, gentleman, and William Hill of the third part, were conveyed to William White and Miers Fisher, to pay profits of estate to Esther and upon her decease her children, the other moiety of the real estate being the property of SOPHIA HENRY, wife of JOHN HENRY, now in the state of Massachusetts, and only sister of Esther, have determined to dispose of their interest in the same, and wish to join in a sale by deed dated 8 Aug 1801, of the messuage and lot to BURTON WALLACE, gentleman, of city of Philadelphia, therefore the title is hereby confirmed to Burton Wallace, and trustees of Esther, are hereby authorized to confirm said sale. 3 Feb 1802. 23. An act to erect a separate election district. That Mahantango twp., Berks county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by MICHAEL ARTZ. 24. An act for the relief of JOHN BERRELL. Whereas JOHN TYSON, late of Abington twp., Montgomery county, dec., being seized of a lot of land containing 16 acres, did by parole contract agree to sell and convey the same to John Berrell, of Abington twp., which has been paid for, but John Tyson died before a deed of conveyance was executed, and ISAAC TYSON and THOMAS TYSON executors, are willing to do so, therefore, the executors are authorized to convey 16 acres, beginning at a white oak stump, in the line of SAMUEL SHOEMAKER's land, thence by DAVID KRIER's land, thence by JOHN THAW's land, thence by JOHN HOBENSACK's land, to beginning. 10 Feb 1802. 25. An act altering a place for holding elections. That the electors of the 5th district in the county of Bedford, shall hold their elections at the house now occupied by JACOB FOUR, in M'Connelsburgh. 13 Feb 1802. 27. An act erecting a separate election district. That Conemaugh twp., Somerset county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by JOHN HORNER JR., in the town of Conemaugh. 13 Feb 1802. 28. An act erecting election districts in York county. That Warrington, Reading and Huntington twps., shall be a separate election district, 5th district, and the electors shall hold their elections at the house of JAMES M'MILLEN in Rosstown. That Manahan twp., shall be a separate election district, 6th district, and the electors shall hold their elections at the house now occupied by LEONARD EICHELBERGER. That Shrewsbury twp., shall be a separate election district, 7th district, and the electors shall hold their elections at the house of late THOMAS EHRHART, dec. That Codorus twp., shall be a separate election district, 8th district, and the electors shall hold their elections at the house now occupied by ADAM ZIGLER. That Dover twp., shall be a separate election district, 9th district, and the electors shall hold their elections at the house now occupied by PATRICK M'FARLIN, in Dovertown. 13 Feb 1802. 29. An act for the relief of MICHAEL COX. Whereas JOSEPH TERRANCE, purchased from the agents of forfeited estates, 156.5 acres of land, with appurtenances, situate in German twp., Fayette county, which had been confiscated to this commonwealth, as the estate of ANTHONY YALDALL, which by deed poll, dated 23 Feb 1793, was under the hand of THOMAS MIFFLIN, then governor, conveyed to Joseph Terrance, who with his wife, conveyed the same to WILLIAM OLIPHANT, who together with his wife, conveyed the same to Michael Cox, who on the 13 Dec 1800, was evicted from the tract of land, by a title paramount in EDWARD GREEN, therefore, the court of Fayette county, is hereby authorized to award a writ of appraisement, directing the sheriff to ascertain the value of the tract of land, containing 156.5 acres, and also the value of the profits of the tract and the state treasurer is authorized to pay the amount as full compensation for all costs and damages. 19 Feb 1802. 30. An act to convey a piece of land. Whereas JAMES WICKERSHAM, SAMUEL GARRETSON, and EZEKIEL KIRK, trustees of the people called Quakers, held at Warrington meeting house in Warrington twp., York county, have represented that a tract of land was granted by JOHN GARRETSON, and JOSEPH HUTTON, (now deceased) by patent, dated 20 May 1796, in trust for the use of the society, in Newberry twp., as a meeting and burying ground, and the society directed that 13 acres and 2 perches be sold to pay the costs of a patent and also for exenses incurred for poor persons, and they did so to CORNELIUS GARRETSON, for 64 pounds, 1 shilling, and 3 pence, therefore, the trustees are hereby empowered to convey by deed to Cornelius Garretson, the 13 acres and 2 perches of land. 19 Feb 1802. 31. An act to erect the town of Canonsburg, Washington county, into a borough. Boundaries beginning at the mouth of Bush run, thence up the run to the division line between CRAIG RITCHIE's land and SAMUEL WITHERSPOON's lot, thence to THOMAS BRICELAND's land, to the corner of NATHAN ANDREWS' lot, to the lot attached to the old brewhouse, etc., to a white oak marked G, at the southwest end of _____ MILLER's improvement on ______ DARR and ______ OGLE's lnad thence to Chartier's creek, to beginning. 22 Feb 1802. 32. An act declaring Ten mile creek a public highway. That Ten mile creek from the mouth at the Monongahela river, up to the main fork, and thence up the south branch as far as JACOB ADAMS' mill, near Waynesburgh, Green county, is declared a public highway. 22 Feb 1802. 35. An act altering the place of holding elections. That the electors of the 4th election district, Northampton county, shall hold their elections at the house now occupied by ULRICH HOUSER, in Lower Smithfield twp. 1 Mar 1802. 36. An act altering the place of holding elections. That the electors in Juniata, Greenwood and part of Buffaloe twps., lying above the Falls hill, Cumberland county, shall hold their elections at the house now or lately occupied by WILLIAM WOODS at Millerstown. 8 Mar 1802. 37. An act to authorized the erection of a wing dam. That JOHN SHERER, is hereby authorized to erect a wing dam at low water mark on Monongahela river, adjoining his own land in the county of Alleghny, about one mile below M'Keesport, on the northeast side of the river, at that place known by the name of Braddock's upper fording. 12 Mar 1802. 38. An act to erect a separate election district. That Deer twp., shall be a separate election district and the electors shall hold their elections at the house now occupied by THOMAS M'CONNELL. 12 Mar 1802. 39. An act altering the place of holding elections. That the electors residing in the 2nd district, composed of Washington and part of Franklin twps., Westmoreland county, shall hold their elections at the house now occupied by JOHN KING, in Washington twp. 12 Mar 1802. 40. An act altering the place of hold elections. That the electors of Wheatfield and part of Fairfield twps., Westmoreland county, shall hold their elections at the house now occupied by RICHARD DIMFEY, in the town of Armaugh. 12 Mar 1802. 42. An act for the erection of election districts in Mercer county. That Wolfcreek twp., is hereby declared a separate election district, and the electors shall hold their elections at the house now occupied by CHARLES BLAIR. That Coolspring twp., shall be a separate election district, and th electors shall hold their elections at the house now occupied by PETER WILSON. That Sandy creek twp., shall be a separate election district, and the electors shall hold their elections at the house now occupied by DAVID CONDIT. That Salem twp., shall be a separate election district, and the electors shall hold thier elections at the house now occupied by JOHN WILLIAMSON. That Pymatuning and part of Neshanock twps., are a separate election district and the electors shall hold their elections at the house now occupied by VINCENT ROBBINS, in Pymatuning tpw. That Neshanock twp., except that part already annexed to Pymatuning tpw., is a separate district, and the electors shall hold their elections at the house now occupied by JAMES HUSTON. 12 Mar 1802. 44. An act altering the place of holding elections. The electors of Wyalusing district, Luzerne county, shall hold their elections at the house now occupied by JUSTUS GAYLORD JR. 17 Mar 1802. 45. An act altering the place of holding the elections. That the electors of the 4th district, composed of Bald Eagle twp., Centre county, shall hold their elections at the house now occupied by CASPER RICHARDS. 17 Mar 1802. 46. An act for the relief of LEWIS GARANGER. Whereas the commonwealth of PA received on loan from Lewis Garanger, a certificate of registered debt granted to him by the United States for his services in the revolutionary war, for which the treasurer on 1 Apr 1786, issued two new certificates, #7455 and #7456, in favor of Lewis Garanger, for the sum of 737 pounds, 12 shillings and 6 pence, bearing interest from 29 Sep 1781 and 4 years interest have been paid, therefore, the state treasurer is to pay amount of the adjusted sum to Lewis Garanger. 17 Mar 1802. 47. An act to enable trustees to convey land. HENRY MEYER, Mountjoy twp., Lancaster county, being seized of a tract of land adjoining the glebe land belonging to the religious society of people called Moravians or United Brethren, did agree with the trustees to exchange 2 acres, of his land for like quantity of glebe land, which he did convey by deed to the trustees, therefore, it shall be lawful for JACOB RIXECKER and JOHN RIXECKER, the trustees of the religious society to convey 2 acres of land to Henry Meyer. 17 Mar 1802. 48. An act granting an island and bar. That the land office is hereby authorized to issue a patent unto THOMAS SMITH and JOHN SMITH (sons and devisees of THOMAS SMITH, of Solebury twp., Bucks county, yeoman, dec.) for an island and bar in the river Delaware, annexed to an act passed 25 Sep 1786, to the township of Solebury, containing 10 acres, as by a survey made by order of THOMAS MIFFLIN, late governor, in consideration of their paying the sum of 8 dollars per acre. 23 Mar 1802. 50. An act to empower trustees to convey land. Whereas, the trustees of the English Presbyterian church, in Allen twp., Northampton county, state SAMUEL WILSON and SARAH WILSON his wife, by indenture dated 2 Mar 1761, did grant, sell and convey unto THOMAS ARMSTRONG ESQ., late of Allen twp., and JAMES RALSTON, yeoman, a tract situate in Allen twp., beginning at a stone, a corner of JAMES HORNER's land, by HUGH WILSON's land, continuing by Hugh Wilson's land to a hickory tree, and by deed the then trustees by deed dated 16 Feb 1767, recorded in Book F, vol 1, page 355, did declare that held the land in trust, and in deed Book F, vol 2, pg 636, did testify that the land was for the sole use and benefit of the English Presbyterian church, and it now has been sold by them to JACOB BEAR, therefore, it shall be lawful for the trustees to grant, convey and assure to Jacob Bear the above described tract of land. 23 Mar 1802. 52. An act to continue suits in Westmoreland county. Whereas three suits have been brought in the court to March term, 1797, one of them, THOMAS MIFFLIN ESQ, governor of PA, against JACOB JENNINGS CLERK, and HANNAH CLERK, his wife, late HANNAH CARNAHAN, and JOHN MILLEGAN, administrators of JAMES CARNAHAN, dec., and another entitled Thomas Mifflin Esq., governor of PA, against CHARLES FOREMAN and DAVID VANCE, surviving obligors in a bond with WILLIAM PERRY, dec., and the third, entitled JOHN NICHOLSON ESQ., comptroller general of PA, against JOSEPH THOMPSON and JOHN PROBST, surviving obligors in a bond with William Perry, dec., and in each judgement has been rendered for such sums as found due, therefore, it shall be lawful for the persons interested in the suits, to prosecute the same to final judgement, in the names of the plantiffs, and to abide by the judgement of the court. 23 Mar 1802. 53. An act to convey a tract of land. That GENERAL JOHN STEELE and WILLIAM CALHOUN, are hereby authorized to sell and convey for the inhabitants of Drumore twp., Lancaster county, all of a tract of land, containing 100 acres which was conveyed by BRYAN QUIN, dated 26 Dec 1767, to ROBERT LONG and SAMUEL M'CONNEL, then overseers of the poor of Drumore twp., and the monies from the sale shall be applied towards reimbursing the township for the expense incurred by them in supporting Bryan Quin and his children. 23 Mar 1802. 54. An act incorporating the Magdalen Society, in the city of Philadelphia. An act to erect an election district. That the electors of Allegheny twp., in Armstrong county, shall hold their elections at the house of GEORGE PAINTER, miller, near the mouth of Cherry run. 29 Mar 1802. 56. An act authorizing the comptroller to receive evidences of State debts due to individuals. Whereas by the representatives of DAVID JACKSON and BARNABAS BINNEY, dec., that certain certificates being evidences of state debt, due to individuals, were obtained by David Jackson from JOHN NICHOLSON, the former comptroller general, whole sureties for the performance of his official duties, they David Jackson and Barnabas Binney had been, therefore, the comptroller is hereby authorized to receive from the representatives of David Jackson and Barnabas Binney, dec., certain certificates of state debt, due to individuals, amounting to $37,714.61, and the surieties shall be cancelled. 29 Mar 1802. 57. An act for the relief of SARAH CALDWELL. Whereas by an act passed 4 Oct 1788, it appeared that she was the holder of certificates issued from the office of comptroller of PA, and that she lost the certificates, and whereas THOMAS LEIPER, the administrator of Sarah Caldwell's estate, states there are debts due which cannot be paid, therefore, the state treasurer, shall transfer the capital amount of the United States certificates held by him, in trust, for the use of the estate, and Thomas Leiper indemnifying the commonwealth against reproduction of the certificates, said to be lost by Sarah Caldwell. 29 Mar 1802 58. An act to erect the town of Beaver, Beaver county, into a borough. That it shall be lawful for all persons entitled to vote to meet at the house now occupied by JONATHAN COULTER, until a court house can be erected. 29 Mar 1802. 59. A supplement to an act declaring the river Susquehanna public highways. Whereas, on 21 Mar 1783, repealed the act but preserving the first part, declaring Raystown branch of Juniata, from the lower end of JOHN WILT's plantation to the town of Bedford, Bedford county, to be a public highway, for the purpose of enabling John Wilt to erect a water works, which now belong to PETER ARNOLT, therefore, it shall be lawful for Peter Arnolt to erect and maintain a mill dam, in the township of Colerain, Bedford county. 29 Mar 1802. 60. An act for the relief of ISAAC WILEY and JAMES CALBOUN. Whereas Isaac Wiley, of Cumberland county, was wounded on 2 May, 1782, while serving as a militia man, under the command of CAPTAIN SAMUEL LEAMAN, in COLONEL SAMUEL HUNTER's battalion, defending the frontier inhabitants of Northumberland county against the Indians, and whereas it appears James Calhoun, now resident in Westmoreland county, was in May 1778 wounded and taken prisoner by the British, at the Crooked Billet, while serving as a militia man under CAPTAIN ROBERT M'COY, in COLONEL WATT's regiment, and whereas it appears that Isaac Wiley and James Calhoun, in consequence of the wounds received in defence of this state, are unable to get a livelihood, and now in very indigent circumstances, and that neither of them have ever received any pension from this state, therefore, Isaac Wiley and James Calhoun are hereby allowed an annuity of forty dollars each, during the remainder of their lives, to be paid half yearly. 29 Mar 1802. 61. An act to erect a separate election district. That parts of Versailles, Elizabeth and Mifflin twps., including the south branch of Pine run, Mifflin twp., to MATTHEW CALHOUN's mill, shall be a separate election district, called M'Keesport district, shall hold their elections at the house now occupied by ADAM JOHNSTON ESQ., in M'Keesport. 29 Mar 1802. 63. An act dissolving a marriage. Whereas DAVID M'KISSICK was duly convicted at a court of oyer and terminer held in the county of Westmoreland, of having committed a rape, and was therefore sentenced to undergo a confinement in the jail and penitentiary house in the city of Philadelphia, for the space of 15 years, and MARGARET M'KISSICK, his wife, has prayed for a divorce from David, who escaped on the way to confinement and hath not since been retaken or surrendered himself, and whereas the commission of a crime, so wicked, by a married man, justly entitles his injured partner to a divorce, therefore, the marriage of David M'Kissick and Margaret M'Kissick, is hereby declared annulled, and are hereby set free from all duties as fully as if they had never been joined in matrimony, provided nothing contained shall be construed to render illegitimate any child born of the body of Margaret during her coverture. 2 Apr 1802. 64. An act erecting election districts. That Lower Saucon twp., Northampton county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by FREDERICK KING. An act to dissolve a marriage contract. Whereas JOHN KUNIUS of Germantown, Philadelphia county, hath represented that on 25 Jul 1800 he was lawfully joined in marriage, with BATHSHEBA TROTH, his present wife, that it hath since appeared that she previously to any connection with John got with child and was pregnant at the time of the marriage, of which child she was delivered on 22 Sep in the same year, and now stands charged by grand inquest with having on 22 Sep, killed and murdered the infant, and on the 27 Sep, she (probably to avoid punishment due to the enormity of her crime) deserted the house of John, nor hath he since seen her, neither does he know precisely where she is, but believes her to be secreted somewhere in her native state of New Jersey, and whereas it is just that John should be released from all legal ties, with a person of such depravity of mind, and so abandoned and destitute of all the sympathetic feelings of human nature, therefore, the marriage of John Kunius and Bathsheba Kunius is hereby declared void and annulled, and are hereby set free from all duties as fully as if they had never been joined in matrimony. 2 Apr 1802. 71. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 2. An act altering the place of holding elections. That the electors of Plumb twp., and part of Versailles twp., in Allegheny county, shall hold their elections at the house now occupied by JOHN LITTLE, on the Frankstown state road in Plumb twp. 11 Jan 1803. 3. An act altering the place of holding elections. That the electors of East Pennsboro and Allen twps., Cumberland county, shall hold their elections at the dwelling house now occupied by NICHOLAS KRITZER, in East Pennsboro twp. 13 Jan 1803. 4. An act to erect part of Beaver county into separate election districts. That so much of Beaver county in the boundaries from Little Beaver creek, eastwardly to Big Lick at WILLIAM ANDERSON's etc., shall be a separate election district and the electors shall hold their elections at the dwelling house now occupied by ROBERT JOHNSTON on Beaver Run. That a separate election district beginning at the house of HENRY LAWRENCE on Big Beaver creek, etc., shall hold their elections at the dwelling house now occupied by ANANIAS ALLEN. That part of Beaver county shall be annexed to the Beavertown election district and hold their elections at the house now occupied by SAMUEL JOHNSTON in Beavertown, that is beginning on the Ohio river at the mouth of Raccoon creek, to MICHAEL BAKER's, thence to JACOB MYER's on the Ohio river. That part of Beaver county, be annexed to the Georgetown election district, and hold their elections at the house formerly occupied by SAMUEL LYONS, in Goergetown, etc., east of the line between Washington and Beaver counties, to _______ WHITE's mill, on Raccoon creek, thence along the big road westwardly to ______ ANDERSON's, to the beginning. 13 Jan 1803. 5. An act to erect Milford Twp., in Somerset county, into a separate election district. That Milford twp., Somerset county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by JOHN GEPHART in Milford twp. 17 Jan 1803. 8. An act to erect a separate election district. That part of Greenfield twp., Erie county, shall be a separate election district, beginning at Lake Erie, to an ash tree at corner of tract of land surveyed for ROBERT SMITH, etc., and the electors shall hold their elections at the house now occupied by ANDREW LOWRY. 22 Jan 1803. 9. An act altering the place of elections. That the electors of Noblesburgh district, in the county of Allegheny, shall hold their elections at the dwelling house now occupied by GEORGE WILLIAMS, in the town of Noblesburgh. 20 Jan 1003. 10. An act to authorize ABRAHAM LANDIS to erect a mill dam. That it shall be lawful for Abraham Landis to erect and maintain a mill dam across Swatara Creek, on his own land, with the consent of the owner of the land opposite the creek adjoining the dam, provided it shall not injure the crossing of the creek at the place called Pineford, on the road leading from Middletown to Elizabethtown and Lancaster. 22 Jan 1803. 11. An act authorizing an administrator to convey lots. Whereas HUGH BEATY, acting administrator of JAMES BEATY, late of Northumberland county, dec., hath set forth that James Beaty and ALEXANDER BEATY, in the year 1792, did lay out and sell lots, adjoining the town of New Berlin, Buffaloe twp., Northumberland county, and James and Alexander at the time of selling were tenents in common, that the greater part of the purchase money hath been paid, but no deeds were executed and the purchasers are anxious to have titles, but the heirs of James are minors, therefore, Hugh Beaty, is hereby authorized on the part of the heirs, to convey to the purchasers all the lots sold by James Beaty. 22 Jan 1803. 12. An act to grant a part of reserved land. Whereas JAMES MOORE hath made an actual settlement at an early period, on a fractional part of the reserved tract of land, at the mouth of Big Beaver creek, therefore, the part of the reserved tract in Beaver county, not exceeding 220 acres, is hereby granted to James Moore, at the price of $1.50 per acre, to be paid in four equal installments, and the land office is directed to issue a patent to James Moore. 22 Jan 1803. 13. An act to dissolve a marriage contract. Whereas, CATHARINE DICK, of the borough of Lancaster, Lancaster county, hath represented that Apr 1801, she was lawfully married to ALEXANDER DICK, who without her knowledge, before their marriage, had been guilty of larceny, whereof he had been convicted at a court of Oyer and Terminer, and for general goal delivery, held at Lancaster, on 2nd Monday of May, in 1801, and the court adjudged he should pay a fine of $3476.67, and undergo a servitude for 18 months in the goal of Lancaster, to be kept at hard labour or in solitude, pay the costs of prosecution and stand committed till the whole sentence is complied with, and Alexander has been removed to the goal and penitentiary house in Philadelphia, where he now remains and will probably remain for life, for there is little chance of his being able to comply with the sentence, and if he should be released it would be in vain for Catharine to expect any thing but misery in the extreme, by being obliged again to live with and be subject to a person so infamous and depraved, therefore, the marriage of Alexander Dick and Catharine his wife, late CATHARINE WOLF, is hereby declared annulled and totally discharged from all duties as fully, as if they had never been joined in matrimony. 7 Feb 1803. 15. An act to alter the place of holding elections. That the electors of Buffaloe twp., Armstrong county, shall hold their elections at the house now occupied by JOHN M'DOWELL. 7 Feb 1803. 16. An act to incorporate a company for opening the navigation of Conecocheague creek, from the mouth of the Falling Spring, in the town of Chambersburgh, to the Maryland line. That JOHN CALHOUN, BENJAMIN CHAMBERS, DR. ROBERT JOHNSTON, JOHN BROWN, JACOB ZANCK, GEORGE CLARK, DAVID KENNEDY, COL. WILLIAM ALEXANDER, JAMES M'CALMONT, JACOB CASSEL ESQ., JAMES RAMSEY, ARCHIBALD IRVIN, WILLIAM M. BROWN, SAMUEL COLHOON, JOSIAH CRAWFORD and ARCHIBALD BAIRD ESQ., are hereby appointed commissioners. 7 Feb 1803. 17. An act erecting a separate election district. That all of Pine twp., Allegheny county, excepting the part in the 7th district, shall hold their elections the house now occupied by BALTZAR GOOD. 7 Feb 1803. 18. An act to raise by lottery, money to defray the expense of rebuilding a church in the borough of York. That GODFREY LENHART, ANDREW ROBINSON, JOHN ERNST, PETER SMALL, DANIEL SPANGLER, JOHN ROTHROCK, GEORGE BARNITZ and CHRISTOPHER LOWMAN, are hereby appointed commissioners to raise money for the German Presbyterian congregation rebuilding their house of worship which was lately destroyed by accidental fire. 7 Feb 1803. 19. An act to erect and maintain a wing dam in the river Juniata. That it shall be lawful for CHARLES SMITH, of the borough of Lancaster, to erect a wing dam in the Frankstown branch of the river Juniata, to extend from the southwest shore of a large island immediately above the borough of Huntingdon. 7 Feb 1803. 21. An act to erect a new election district. That Rockdale twp., Crawford county, shall be an election district, and the electors shall hold their elections at the house now occupied by WILLIAM GREENLEE. 11 Feb 1803. 22. An act to incorporate a company for making a road from the borough of Easton, Northampton county, to the town of Wilkesbarre, Luzerne county. That HENRY DRINKER, BENJAMIN R. MORGAN, and THOMAS ALLIBONE, of the city of Philadelphia, SAMUEL SITGREAVES, JOHN HERSTER and DANIEL WAGENER, of the borough of Easton, and LORD BUTLER, LAWRENCE MYERS and THOMAS WRIGHT of the county of Luzerne, are hereby appointed commissioners. 11 Feb 1803. 23. An act to lead off and use part of the waters of the Susquehanna. Whereas WILLIAM WRIGHT is proprietor of the land adjoining Chiquis falls, on the west side of the Susquehanna river, in Hellam twp., York county, and asks permission to lead off on his own land, part of the waters to supply water works as he may erect thereon, therefore, William Wright, shall have liberty to lead off the river, for the supply of water works, and to build a dam as shall be necessary. 11 Feb 1803. 24. An act to erect mill dams. That it shall be lawful for SAMUEL BELL, to erect, and maintain a mill dam across Swatara creek, adjoining his land and with the consent of the owner opposite side of the creek. That it shall be lawful for NICHOLAS GERST, to erect and maintain a mill dam across Swatara Creek, opposite to his own land, with the consent of the owner of the land on the opposite side of the creek. 11 Feb 1803. 26. An act to vest parts of a forfeited estate. Whereas small portions of the estates of JOHN BIDDLE, forfeited by his attainder, have never been sold and SOPHIA BIDDLE, widow of the John Biddle, has prayed the same might be vested in her for use of herself and children, therefore, all right, title, and claim which this commonwealth, hath in parts of the estate forfeited by his attainder are hereby granted and vested in Sophia Biddle, for the use of herself and her children, as if John Biddle had never been attainted and had died after the act passed 19 Apr 1794. 21 Feb 1803. 27. An act appointing trustees. Whereas an act passed 12 Mar 1800 was granted for the use of an academy in Beavertown, 500 acres of land, and three persons were appointed in trust and no provision was made to farm let, lease or dispose of the land, therefore, JOHN LAWRENCE ESQ., GUION GRIER, JAMES ARMSTRONG and SAMUEL JOHNSTON are hereby appointed trustees and shall have power to farm let, lease or dispose of the land, and to erect a building on one of the public squares for an academy. 21 Feb 1803. 29. An act to fill the vacancy of the State Treasurer, occasioned by the death of JACOB CARPENTER ESQ. Whereas by the death of Jacob Carpenter Esq., state treasurer, that office has become vacant, therefore, the members of both houses shall meet and appoint a state treasurer. 25 Feb 1803. 31. An act to erect an election district in Wayne county. That Buckingham, Demascus and part of Lackawaxen twps., are to be called Saint Tammany district, and the electors shall hold their elections at the house now occupied by REUBEN SKINNER. 25 Feb 1803. 32. An act dissolving a marriage. Whereas JOHN ALEXANDER, of Springfield twp., Delaware county, on the 23 Oct 1800, he was lawfully joined in marriage, with HANNAH WELLS, and afterwards on 4 Dec 1800, she was delivered of a mulatto child, from which circumstance, it is evident that John Alexander was grossly deceived by Hannah and prays for a divorce, therefore, the marriage of John Alexander and Hannah Alexander is hereby declared to be annulled and are hereby declared totally discharged from all duties as if they had never been joined in matrimony. 25 Feb 1803. 33. An act to change the place of election. The electors of the 6th election district, Huntingdon county, shall hold their elections at the house now occupied by JAMES ENTREKEN, at the mouth of Coffee run, on Raystown branch of Juniata river, in Hopewell twp. 25 Feb 1803. 36. An act confirming the place for holding the courts of justice, and erecting public buildings for the county of Butler. Whereas an act passed 6 Apr 1802, ISAAC WEAVER, JOHN HAMILTON, THOMAS MORTON, JAMES BRADY and PRESLY CAR LANE ESQ., were appointed commissioners who performed their duties, therefore, JOHN M'BRIDE ESQ., WILLIAM ELLIOTT ESQ., and JOHN DAVID are hereby appointed trustees to survey 300 acres, on the north side of Conequinesing creek, near SAMUEL CUNNINGHAM's mill, thereof expressed in the grant of Samuel Cunningham, JOHN CUNNINGHAM and ROBERT GRAHAM, made by them to the governor for the use of the county of Butler, to lay out lots not exceeding 5 acres for public buildings. 8 Mar 1803. 37. An act to raise by lottery, a sum not exceeding $5000.00 for the purpose of completing the building of the Bustleton academy, Philadelphia county. That SAMUEL SWIFT, STRICKLAND FOSTER, JACOB SHEARER, JOHN HOLMES JR., JOHN THOMPSON, ELISHA GORDON, EDWARD SWIFT, JACOB HALL, BERNARD J. MALFESON and WILLIAM DUNCAN, are hereby appointed commissioners. 16 Mar 1803. 38. An act to erect a new election district. Beginning at west side of Susquehanna river, opposite Peter's mountain, across the river, and along the mountain ot Berks county, to top of Wisconesco or Berry's mountain, shall compose an election district, and the electors shall hold their elections at the house now occupied by JOHN EVIG, in the town of Halifax, Dauphin county. That the electors of Middle Paxton twp., to Peter's mountain shall hold their elections at the house now occupied by JOHN FILSON, and the electors of Upper Paxton twp., northward of Wisconesco or Berry's mountain, shall hold their election at the house now occupied by GEORGE BUFFINGTON. 16 Mar 1803. 39. An act erecting new election districts, in Northumberland county. That Mahoning and Hemlock twps., shall be a separate election district, and the electors shall hold their elections at the house of WILLIAM SHERRIFF, in the town of Danville, Mahoning twp., and the voting place for the 6th district, is changed from the house of ALBRIGHT SWINEFORD, to the house of JOHN SWINEFORD, in the town of Middleburgh, in Penns twp., and the lines of New Berlin district, are hereby altered, beginning at the house of TORAN O'QUIN, to the top of the middle ridge of Shamokin hills, opposite the corner of HUGH WILSON's land, between the same and the tract on which JOSHUA DAVIS resides to the Limestone ridge, thence to JOHN STEELE's and thence to CHRISTOPHER SEABOLD's mill, and the electors shall elect at the town of New Berlin. 16 Mar 1803. 40. An act to sell and convey real estate. Whereas SAMUEL MILES and REBECCA MILES, have presented that WILLIAM WISTER, late of the city of Philadelphia, died intestate, with respect to real estate situate in the city, and in the county of Northumberland, that CATHARINE MILES, SAMUEL MILES JR., WILLIAM MILES, and JAMES MILES JR., being minors and grandchildren of the first named Samuel Miles, and lawful children of JAMES MILES, dec., and Rebecca his wife, by reason of William Wister having died intestate, have through their father become heirs, as tenents in common to one eighteenth part of the real estate, and the uncles and aunts have sold and conveyed their shares of a house and lot on Third st. Philadelphia, to JOHN WISTER of the city, for the sum of $800.00 each, and whereas Samuel Miles hath also represented, that one other eighteenth part of the real estate hath descended to his son CHARLES MILES, a minor, therefore, Samuel Miles is hereby authorized during the minority of the 4 minor children of his son James, dec., to sell and convey their share. An act to erect the town of Chambersburgh, in Franklin county, into a borough. The boundaries begin at a corner of JAMES WELSH and JOHN KERR's land, near the brick meeting house, etc., thence to FREDERICK REAMER's land, thence to lots of D. That Teboyne twp., Cumberland county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by HENRY SIMMERMAN. 21 Mar 1803. 46. An act to erect a separate election district. That Pennsbury, Kennett, East Marborough and Newlin twps., Chester county, shall be a separate election district, the 9th district, and the electors shall hold their elections at the house now occupied by JOSEPH PIERCE, in East Marlborough, known by the name of Red Lion tavern. 21 Mar 1803. 48. An act establishing the place for holding the courts of justice, and for erecting public buildings, Mercer county. Whereas an act passed 6 Apr 1802, appointed ISAAC WEAVER, JOHN HAMILTON, THOMAS MORTON, JAMES BRADY and PRESLY CARR LANE, commissioners who completed their task, therefore, WILLIAM M'MULLEN, JOHN FINDLY nd WILLIAM MORTIMORE, are hereby appointed trustees for the county of Mercer, to survey 200 acres, being the tract which JOHN GARVER and a part of the tract on which JOHN PUE/PUGH has been settled by JOHN HOGE, in trust, to lay out public buildings. 24 Mar 1803. 49. An act to incorporate a company to make a road from the intersection of Front street and the Germantown road, in the Northern Liberties of the city of Philadelphia, through Frankford and Bristol, to the ferry at Morrisville, on the river Delaware. An act to incorporate a company for making a road beginning at Downingstown, Chester county, to Cornwall furnace, Dauphin county, thence to the borough of Harrisburgh. That RICHARD THOMAS, MATTHEW STANLY and JAMES M'CONNEL of Chester county, CYRUS JACOBS, JACOB KELLER and JOHN ERB of Lancaster county, MOSES GILMORE, JOHN ELDER and GOTLIEB ORTH, of Dauphin county, are hereby appointed commissioners. 24 Mar 1803 55. An act for the relief of DR. ROBERT JOHNSON. Whereas by an act passed 24 Mar 1785, all officers or soldiers of the PA regiments or independent corps, and PA officers not attached to the line of any state who served until the end of the war with Great Britain, and all officers who have been deranged by the regulations of the army, shall be entitled to land, and whereas Robert Johnson states he was regiment surgeon to the 6th regiment of the PA line, form the commencement of the war, and continued as a physician until 1781, when by orders of GENERAL GREENE, the commander in chief, he was obliged to leave to assist the wounded officers and soldier of the American army, then prisoners in the British hospital in Charleston, therefore, the board of property are hereby authorized to examine the claims of Robert Johnson, and to grant hism a patent for land as a surgeon in the PA line. 25 Mar 1803. 56. A supplement to an act to empower JOHN AGNEW and WILLIAM M'CLEAN, administrators for AMOS M'GINLEY dec., to convey lands in Hamilton's bann and Cumberland twp., in York county, to persons to whom Amos M'Ginley was a trustee. Whereas by an act passed 21 Sep 1786, ANN M'FARREN, JOHN AGNEW and WILLIAM M'CLEAN were authorized to convey by deeds to DAVID BLYTH, MOSES M'CLEAN, WILLIAM WAUGH, JAMES BRICE, JOHN M'GINLEY and JAMES STEPHENSON, lots of land, but by reason of the death of some of the grantees before the deeds were executed, therefore, the authorities vested in Ann M'Farren, John Agnew and William M'Clean, to convey deeds are hereby extended so as to enable them to convey to the heirs. 25 Mar 1803. 61. An act to enable MARTIN HOCKER, obtain a title to a lot. Whereas, Martin Hocker, did purchase of his brother JOHN HOCKER, a lot of land containing 10 acres, situate in Paxton twp., Dauphin county, and hath actually paid in full according to the terms of the agreement, with John Hocker, dec., and no written contract was made, therefore, the administrators of John Hocker dec., are hereby authorized to convey to Martin Hocker, the lot of land. 28 Mar 1803. 65. A supplement to an act for the relief of the estate of SARAH CALDWELL. Whereas by an act passed 29 Mar 1802, did authorize the state treasurer to transfer the capitol amount of certain certificates, held by the state, in trust, for the representatives of Sarah Caldwell, to THOMAS LEIPER, administrator of the estate, therefore, the state treasurer is required to pay Thomas Leiper, all installments of principal as have been received by the state, from the United States, upon the stock subscribed and held in trust. 29 Mar 1803. 66. An act enabling trustees to sell and dispose of real estate. Whereas the court of common pleas of Chester county, that DAVID HAYES, has been adjudged a lunatic, and CALEB SWAYNE, SAMUEL SWAYNE JR., and THOMAS CHALFANT, were appointed trustees to take care of the person and estate of David Hayes, and whereas his real estate is in want of repairs, and unproductive, that if repaired it would not rent for a sum sufficient to maintain the lunatic, and repay the interest of the monies necessary to borrow to make the repairs, therefore, it shall be lawful for the trustees to sell and convey all the real estate of David Hayes, and all money arising from the sales shall pay the debts, and used for the interest of David Hayes and his heirs. 30 Mar 1803. 68. An act to erect parts of Westmoreland and Lycoming counties, into a separate county. Included in the following boundaries, beginning at the corner of Armstrong county on the Kiskiminetas river etc., is hereby erected into a separate county, called Indiana, and WILLIAM JACK, JAMES PARR and JOHN POMROY, of Westmoreland county, are hereby appointed trustees for the county of Indiana. 30 Mar 1803. 69. An act granting donation land. Whereas NICHOLAS UNGERMAN, late a sergeant in CAPTAIN JOHN MEARSE's company, belonging to the 4th PA regiment, commanded by COLONEL WILLIAM BUTLER, in Sep 1779 was killed by the Indians in the expedition commanded by GENERAL SULLIVAN, and that Nicholas Ungerman had no relatives in this country other than his now aged mother ELIZABETH SMITH, who during the infancy of the deceased, intermarried with PETER SMITH, now of Northumberland county, with whom Nicholas lived until the time of his enlistment in the company, and whereas Peter Smith, hath requested that the donation land to which his step son Nicholas was entitled, may be granted to him and Elizabeth his wife, therefore, the donation land that Nicholas Ungerman was entitled by virtue of law, is hereby granted to Peter Smith and Elizabeth his wife, and the proper officers of the land office are hereby directed to issue a patent for the same. 1 Apr 1803. 70. An act to authorize the commissioners of Northumberland county to sell and convey a lot in the borough of Sunbury. That FLAVEL ROAN, SOLMON MARKLEY and DAVID TAGGART, commissioners are hereby authorized by public auction to sell and convey lot #13, in the town of Sunbury, and the old jail, courthouse, and all other buildings erected together with all appurtenances, and to apply the proceeds to the use of the county. 1 Apr 1803. 71. An act offording compensation for ascertaining the centre of Mercer coounty. Whereas by an act to erect parts of Allegheny, Westmoreland, Washington and Lycoming counties, passed 12 Mar 1800, a certain part of Allegheny county was erected into a county district, called Mercer county, with the courts of justice to be within 5 miles of the centre of the county, therefore, the county commissioners of Crawford county, are hereby authorized to adjust and settle the accounts of BENJAMIN ALEXANDER, THOMAS M'MILLAN and others, employed in ascertaining the centre of Mercer county. 1 Apr 1803. 72. An act declaring the western branches of Schuylkill, in the county of Berks, public highway. That the west branch of Schuylkill from its junction with the north branch up the same to THOMAS REED's saw mill, etc. are declared a public highway. 1 Apr 1803. 76. An act for altering the place of holding elections in the 5th district, in Lancaster county. That the citizens of the 5th district, shall hold their elections at the house now occupied by NATHANIEL LIGHTNER, in the township of Cocalico. That the citizens of part of Warwick twp., down Forge creek to CHRISTIAN STAUFFER's mill, to JOHN PFAUTS' mill, etc., shall hold their elections at the house now occupied by NATHANIEL LIGHTNER, in Cocalico twp. That the citizens of the 5th district, beginning at _______ MILLER's tavern, etc. shall hold their elections at the house now occupied by JACOB STAHLEY, in Reamstown, Cocalico twp. 1 Apr 1803. 81. An act to vest in devisees parts of forfeited estate. Whereas a small portion of the estate of JOHN PARROCK, dec., forfeited by his attainder hath never been sold on behalf of the commonwealth, and RICHARD SMALLWOOD, and others, pray the same be vested in them, therefore, all right and title which the commonwealth hath in parts of the estate of John Parrock, is hereby granted and conveyed unto Richard Smallwood, the devisees of JAMES PARROCK, father of John Parrock. 2 Apr 1803. 84. An act releasing a claim of the commonwealth. Whereas by an act of congress to erect a tribunal, competent to determine the propriety of captures during the late war with Great Britain passed 25 Nov 1775, that trials in the court of appeals should be according to the law of nations and not by jury, and whereas the British sloop Active, having been captured as prize on the high seas, in Sep 1778, and brought into the port of Philadelphia, and there libelled in the court of admiralty, held before GEORGE ROSS ESQ., then judge, on the 18 Sep., and the libellants against the sloop Active, were GIDEON URMSTEAD/OLMSTEAD, ARTIMUS WHITE, AQUILA RUMSDALE and DAVID CLARKE, who claimed the whole vessel and cargo as their exclusive prize, THOMAS HUSTON, master of the brig Convention, a vessel of war belonging to PA, who claimed a moiety of the prize for the state of PA, himself and crew, and JAMES JOSIAH, master of the sloop Girard/Gerard, private vessel of war, who claimed 1/4 part for himself and owners and crew, and a jury returned a verdict that Gideon Olmstead, Artimus White, Aquila Rumsdale and David Clarke were entitled ot 1/4 of the prize, Thomas Huston, and others 1/4, state of Pa. 1/4, and James Josiah 1/4, and those unsatisfied appealed, thus George Ross did direct MATTHEW CLARKSON, then marshal, to pay part of the proceeds for the use of the state, whereof DAVID RITTENHOUSE was then treasurer, and as it appears David Rittenhouse. etc. therefore the governor is hereby authorized to direct the attorney general to apply without delay to ELIZABETH SERGEANT and ESTHER WATERS, executrixes of David Rittenhouse, and require them to pay the monies received. 2 Apr 1803. 86. An act to erect part of South Irwin twp., Venango county into a separate election district. That beginning on the west verge of Allegheny river near the house now occupied by DANIEL FRY, etc., and the electors shall hold their elections at the house now occupied by PATRICK DAVIDSON, called the South Irwin district. 2 Apr 1803. 87. An act erecting election districts in the county of Crawford. That Beaver and Cussewago twps., shall be a separate election district, and the electors shall hold their elections at the house now occupied by ROBERT NELSON. That Conneaut and Sadsbury twps., except south of Pymatuning swamp., shall be a separate election district, and the electors shall hold their elections at the house now occupied by JOSEPH GARWOOD. That Shenango and Followfield twps., and part of Conneaut twp. south of Shenango swamp, shall be a separate election district, and the electors shall hold their elections at the house now occupied by THOMAS M'MICHAEL. That Fairfield twp., shall hold their elections at the house now occupeid by JAMES HERRINGTON. 4 Apr 1803. 88. An act to establish the place for holding the courts of justice, and provide for erection of public buildings of Armstrong county. Whereas by an act passed 6 Apr 1802, the governor appointed ISAAC WEAVER, JOHN HAMILTON, THOMAS MORTON, JAMES BRADY and PRESLY CARR LANE ESQ., commissioners, and having completed their duties, JAMES SLOAN, JAMES MATTHEWS and ALEXANDER WALKER, are hereby appointed as trustees to survey 150 acres near the place where GENERAL \ ARMSTRONG defeated the Indians on the east side of the Allegheny river, above Sloan's ferry, being part of a tract of land called Kittanning, the property of JAMES ARMSTRONG and JOHN ARMSTRONG, given and granted by James Armstrong in behalf of himself and his brother John Armstrong, in trust, to use for the county, and public building are to be erected. 4 Apr 1803.
