Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act to raise by lottery, a sum of money to extinguish the debts due on the erecting a house of worship, for the use of the Second Baptist Church of Philadelphia, of the Northern Liberties, Philadelphia county. That SAMUEL BOWER, ISAAC WHITE, JACOB KEEN, ISAAC JOHNSON, THOMAS TIMINGS, CORNELIUS TRIMNUL, JOHN COLLARD, are hereby appointed commissioners to raise $7000.00. 14 Dec 1805. 2. An act to raise by lottery, a sum not exceeding $6000.00 to defray the expenses of erecting a building for English worship and for an English school house in the borough of Reading, Berks county. That FREDERICK SMITH, MATTHIAS RICHARDS, NICHOLAS DICK, GEORGE D.B. KEIM, WILLIAM WITMAN JR., and JOHN R. MESSERSMITH, are hereby appointed commissioners. 21 Dec 1805. 3. An act to raise by lottery, a sum of money to defray the expence of finishing a church in the town of Anville, Dauphin county. That ANTHONY CARMONY, HENRY BERRY, DAVID MARSHALL, DANIEL HENNING, ABRAHAM RAIGUEL and JOHN SHERTZER, are hereby appointed commissioners to raise $1500.00. 21 Dec 1805. 4. An act for the relief of ARTHUR ST. CLAIR. Whereas Arthur St. Clair, was duly appointed an auctioneer for the city of Philadelphia, and he paid all the duties due by law, on the sales by him conducted, nevertheless, by an erroneous statement of his account, made some years afterwards by JOHN NICHOLSON, he was made a debtor when in truth he was a creditor, he did at two different times after the expiration of his office, pay to John Nicholson, as comptroller, the sum of 529 pounds, 16 shillings and 11 pence, for which sum on the revision of his accounts by the comptroller general, no credit was allowed, therefore, the state tresurer is authorized to pay $2719.74 to Arthur St. Clair, being in full the sum overpaid with interest since 1 Aug 1790. 9 Jan 1806. 5. An act vesting title for 10 acres in Centre Twp., Northumberland county for the use of a congregation composed of Lutherans and Presbyterians. Whereas a building erected by a congregation composed of Lutherans and Presbyterians in Beaver and Centre twps., and occupied as a house of worship and school house, on 10 acres, adjoining lands of SEBASTIAN ROYER, MICHAEL MYER and ABRAHAM HASSINGER, therefore, the land office is hereby authorized to issue a warrant and complete a title to Sebastian Royer and Michael Myer, in trust for the congregation. 9 Jan 1806. 8. An act authorizing JOHN BIDDIS to vend his patent rights for manufactoring potatoe starch, sago and hair powder, and for opening or reducing offcast woolen clothen to wool. Whereas John Biddis has made a discovery or important improvement in the art of manufacturing potatoe starch, fago, and hair power, and has invented a machine for opening or reducing again to wool offcast wollen clothing, the former being so simple in the rocess, that the sale of a single right would make such disclosure as to defeat all the benefits which he has a right to expect, therefore, it shall be lawful for John Biddis to vend his patent rights for 18 months giving the necessary sureties, and for complete disclosure and exemplification of his patent rights, at the end of the term of 18 months. 20 Jan 1806. 9. An act altering the place of meeting of the return judges of the district composed of Fayette and Greene counties. That electors of Fayette and Greene counties shall hold their elections at the house now occupied by HENRY JENNINGS, in German twp., Fayette county, and so much of the law as directs the judges to meet at the house of THOMAS CLARE, in Fayette county is hereby repealed. 20 Jan 1806. 12. An act to make partition of real estate. Whereas JACOB JOHN of Bedford county, farmer, by his last will and testament duly executed, dated 14 Jul 1786, did devise his lands (two acres only excepted), with all improvements, after his widow's decease, or marrying again, unto his seven children, to be equally divided, namely, DAVID JOHN, MARGARET JOHN, JACOB JOHN, DANIEL JOHN, SAMUEL JOHN, JOSEPH JOHN, and BENJAMIN JOHN, only allowing a double share to his eldest son David, and Jacob John died seized of land then in Bedford, now in Franklin county, containing 340 acres, and after his death Margaret John intermarried with OWEN DAVID, and died leaving 4 children in their minority, and Samuel John died without issue, and Benjamin John is still a minor, therefore, JAMES M'FARLANE, DAVID BOWEN JR., and DAVID BOWEN of Samuel, of Montgomery twp., Franklin county are hereby appointed trustees for Benjamin John, a minor, son of Jacob John of Bedford county, dec., and the four minor children of MARGARET DAVID, dec., who was a daughter of Jacob John, as no division is possible, to allot the property to one of the heirs of age, and he paying the others a proportion sum of money, and to make deeds and convey ownership. 27 Jan 1806. 13. An act enabling trustees to sell and convey real estate. Whereas the court of common pleas of the county of Chester, that ENOCH GRIFFETH, has been adjudged a lunatic, and JOHN HAMBLETON and JOSEPH SHARP, were appointed trustees, that his real estate is in want of repairs, and unproductive, and if repaired would not rent for a sum sufficient to maintain him or repay the interest of the monies necessary to make the repairs, therefore, it shall be lawful for the trustees to sell and convey the real estate of Enoch Griffeth, a lunatic, and to apply the money for the maintence of the lunatic. 27 Jan 1806. 14. An act to sell and convey a tract of land. Whereas JOHN DEAN and MARY DEAN, administrators of the estate of JOSEPH DEAN, dec., and JAMES M'MCOMB, guardian of WILLIAM DEAN, the minor child of Joseph Dean, all of Armstrong twp., Indiana county, that Joseph died intestate, seized of one undivided moiety of a tract of land, containing 240 acres, John Dean being the owner of the other moiety, that the situation of the land is such, that it will not permit a division to advantage, and not being productive in its present situation, therefore, James M'Comb, guardian of William Dean, minor, is hereby authorized to sell and convey the undivided moiety of messuage and tract of land, adjoining lands of RANDAL LAUGHLIN, and others, and the money is to be applied to purchase other property for the minor, to be approved by the court of Westmoreland. 27 Jan 1806. 15. An act for raising by lottery the sum of $20000.00 for the purpose of discharging the debts of Bustleton and Smithfield Turnpike Company. That HENRY PRATT, STEPHEN GERARD, MOORE WHARTON, ISAAC WORRELL, FRANCIS MURRAY, JACOB SOMMER, JOSEPH HART, AUGUSTINE WILLETT, RICHARD LEEDOM, JONATHAN s24 LYNKOOP, JOSHUA JONES and THOMAS BIDDLE, are hereby appointed commissioners. 3 Feb 1806. 16. An act for the relief of CATHARINE TOEY. Whereas SIMON TOEY, formerly an inhabitant in that part of Lancaster county, which now composes Dauphin county, served a tour of duty in the militia, in 1776, that he was afterwards drafted into the Flying Camp, and served as a non commissioned officer, and while in the service of his country was taken prisoner by the British at Fort Washington, and forced on board a prison ship, where he soon fell a victim with many others, to the rigorous and cruel treatment generally experienced at that time by American captives, and leaving behind him a widow and nine helpless children in indigent circumstances, and whereas the existing laws make provision for the widows and orphans of deceased soldiers, who died in the service of their country, do not embrace that description of the army called the Flying Camp, therefore, Catharine Toey, is hereby allowed an annuity of forty dollars per year, during her natural life, to commence from 1 Jan 1805, payable half yearly. 3 Feb 1806. 18. An act dissolving the marriage of JACOB SELL and EVE SELL his wife. Whereas Jacob Sell of Adams county, when a young man, in 1777, married a woman named EVE HELMAN, who five months after her marriage was delivered of a female child, and both being conscious that the child was not the said Sell's, and firmly impressed with a belief that under these circumstances happiness was not to be expected, mutually agreed to separate, Eve having acknowledged the fact, agreed in consideration of 10 pounds paid by Sell, the receipt of which Eve has also acknowledged and by a written instrument duly executed in which she has disclaimed any pretensions to further demands, and whereas Sell having considered himself entirely freed from any obligations to Eve, did in 1780 marry another wife by whom he now has six children, and whereas the united efforts of himself and his present wife have acquired considerable property, some of which he transferred, but was unable to complete title by reason of a claim which Eve may be supposed to possess, and whereas Sell now being old and in a declining state of health, he desires to distribute the property to the use and benefit of his present wife and family, to the exclusion of a woman who has in no way contributed, therefore, the marriage contract of Jacob Sell and Eve Helman, to whom he was married is declared null and void, and the parties set free and discharged from the marriage contract, as if they had never been joined together in marriage, and the children of Jacob Sell by the woman whom he last married, shall be declared legitimate as fully and effectually as if Jacob and Eve had never been married. 8 Feb 1806. 19. An act to authorize the raising of money by lottery. That SAMUEL MEEKER, JACOB SPERRY, SAMUEL HAYS, MOSES NATHANS and BENJAMIN NONES, are hereby declared commissioners, to raise by lottery in behalf of the president adjuntas and members of the Hebrew congregation of the city of Philadelphia, a sum of money not exceeding $4000.00 for repairs of their Synagogue and burial ground. 8 Feb 1806. 20. An act to empower a guardian to sell and convey real estate. Whereas MATTHIAS RICHARDS SAYRES, and EDWARD SMITH SAYRES, are equally entitled to the following real estate, subject to their mother's thirds, or right of dower, two undivided third parts and three fifths of a third part of messuage, and tract or parcel of land, situate in Lower Chichester twp., Delaware county, beginning at low water mark on Delaware river, and extending to BENJAMIN MOULDER's lot, by WILLIAM CRABB's land, etc., and whereas WILLIAM PENNELL is guardian of the minors, therefore, it shall be lawful for the guardian to sell and convey all the right and title of the minors to the real estate to the purchasers. 8 Feb 1806. 21. An act for the relief of EDMUND MILNE. Whereas JOHN VANDERIN JR., lately deceased, and Edmund Milne through the agency of JOHN HAZLEWOOD, (city purchaser for the army during the late revolutionary war) became flour contractors for this commonwealth and did on 25 Nov 1780 to the use of the fame, deliver 185 barrels of flour, which in the settlement of their accounts were never passed to their credit, or in any wise compensated for, therefore, the comptroller general is hereby required to settle and account to Edmun Milne, for the 185 barrels of flour, as had been allowed to John Vanderin and Edmund Milne for flour and cask under contract and to pay the fame. 17 Feb 1806. 23. An act to incorporate a company for making a road from the bank of the river Susquehanna, opposite the borough of Harrisburgh to Pittsburgh. That SAMUEL MEEKER, GODFREY HAGA, GEORGE CLYMER, WILLIAM GUYER, GEORGE BICKHAM and THOMAS ALLIBONE of Philadelphia, ADAM REIGART JR., ABRAHAM WITMER, SAMUEL HUMES, and WILLIAM MONTGOMERY, of Lancaster, ROBERT COLEMAN and ROBERT JENKINS, Lancaster county, MOSES GILMORE, CHRISTIAN KUNCKLE, ROBERT HARRIS, HENRY BADER, ADAM BOYD, and GEORGE WEINMAN of Harrisburgh, JOHN BAUMAN, JOHN CAROTHERS, CHRISTOPHER QUIGLEY, JAMES DUNCAN, JOSEPH PIERCE, ALEXANDER SHARP, JOHN M'KEE, JACOB RAUM, and JOHN SIMPSON of Cumberland county, ANDREW in DUNLAP, JACOB HEIFER, JOHN GILMORE and CHRISTIAN KEEVER of Franklin county, GEORGE BAIRD, JOHN GRIER and JACOB HAY, of York county, JOHN DAVIS JACOB BONNETT, JOHN ANDERSON, and HENRY WERTZ JR., of Bedford county, GEORGE KIMMEL, MICHAEL REAM, ABRAHAM MORRISON, PETER KIMMEL, JOHN FLETCHER, JOHN SCHULL, and ALEXANDER OGLE of Somerset county, WILLIAM JACK, JAMES GUTHRIE, JOHN IRVIN, HUGH MARTIN, JOSEPH BALDRIGE, JOHN BONNETT, ROBERT DICKEY, and THOMAS JONES of Westmoreland county, NATHANIEL IRISH, THOMAS BEARD, JAMES O'HARRA, SAMUEL EWALT, and ADAMSON TANNEHILL, of Allegheny county, ROGER ALDAN, DAVID MEADE, THOMAS R. KENNEDY and WILLIAM CLARK of Crawford county, are hereby appointed commissioners. 24 Feb 1806. 24. An act to repeal an act declaring Chartiers's Creek, in the counties of Washington and Allegheny a public highway. The Chartier's creek, from the mouth to DAVID BRADFORD's mills is hereby repealed as a public highway. 24 Feb 1806. 25. An act establishing an academy in the town of Griersburgh, Beaver county. That the first trustees are, REV. JOHN M'FARREN, REV. GEORGE M. SCOTT, REV. THOMAS E. HUGHES, REV. WILLIAM WICK, REV. JAMES SUTTERFIELD, REV. NICHOLAS PITTINGER, ALEXANDER WRIGHT ESQ., DAVID POTTER ESQ., DR. SAMUEL ADAMS, JOHN BEER, GEORGE DILWORTH, WILLIAM SCOTT, JOSEPH POLLOCK, HUGH HAGGERTY, and CALDWELL SEMPLE, are hereby declared one body politic and corporate. 24 Feb 1806. 26. An act for the relief of the heirs of JOHN JACOB HIRLEMAN, deceased. Whereas John Jacob Hirleman died in the city of Philadelphia, in 1793 intestate, leaving some property, which for want of heirs or kindred was escheated to the commonwealth, and in consequence the sum of 106 pounds, 8 shillings, and 2 pence was paid into the state treasury on 28 Dec 1795, and it now appears he had five brothers and two sisters, JOHN MICHAEL HIRLEMAN, JOHN HENRY HIRLEMAN, EVE DOROTHEA GREISS, CATHARINE SALOME BICKLER, JOHN HIRLEMAN, JOHN PHILIP HIRLEMAN, and JOHN STEPHEN HIRLEMAN, who are still living and resident in Alsace, in the Lower Rhine, in the Republic of France, who by their attorney PETER ULRICH, have prayed for restitution of the money, therefore, the state treasury is authorized to pay Peter Ulrich, attorney for the heirs of John Jacob Hirleman, dec., for the sum of $283.75 with interest. 24 Feb 1806. 28. An act for the relief of JAMES ASH ESQ., formerly sheriff of the city and county of Philadelphia. Whereas JOHN NICHOLSON, then comptroller general of this commonwealth, on 15 Sep 1791, delivered to James Ash Esq., then sheriff a suit of the commonwealth against DANIEL BRODHEAD, commanding him to seize and distain, so that he would be compelled to pay the of 893 pounds, 16 shillings, and 9 pence, in obedience of said writ, James Ash levied and recovered the sum of money ,and on the 17 Feb 1792, John Nicholson called upon James Ash for the amount recovered, and Ash thinking he was the proper officer to demand and receive the money, paid the amount to John Nicholson and took his receipt, as no impropriety of such payment was given to James Ash unto some time in Dec 1800, when all possibility of recovering the money was gone, due to insolvency of John Nicholson, therefore, James Ash is hereby acquited from all claim by this commonwealth, for any money levied and collected as fully and effectually as if he had paid the proper officer. 24 Feb 1806. 29. An act for the relief of JOHN LEWIS. Whereas John Lewis late a sergeant in the 11th PA regiment, commanded by COL. RICHARD HUMPTON, was enlisted on 7 Jun 1777, and it appears that Lewis hath not received his pay from 1 Jun 1778 to 1 Nov next following, therefore, the accounting officers are hereby directed to settle up the arrearage of pay due to Sergeant John Lewis, with interest. 24 Feb 1806. 31. An act to establish a public ferry over Swatara creek, near its junction with the river Susquehanna, Dauphin county. That it shall be lawful for JOHN GREGG, at his own cost to cause to be made convenient landings upon both of Swatara Creek, on the main road from Middletown, Dauphin county, to Yorktown, York county. 5 Mar 1806. 36. An act to erect the town of Williamsport, in Lycoming county, into a borough. That the town of Williamsport, Lycoming county, shall be a borough, boundaries include a post on MICHAEL ROSS's land, to a post on JAMES HEPBURN's land, etc. 1 Mar 1806. 42. An act to incorporate the town of Gettysburg, Adams county. That the town of Gettysburg, Adams county, is hereby erected into a borough, boundaries to include, THOMAS BRADON's out lot, to lot #20 of REV. ALEXANDER DOBBIN's small lots, across Emmitsburg road to to Rev. Alexander Dobbin's spring lots, to WILLIAM BUCHANAN's tanyard lot, to _____ NEWCOMER's and ________ HUTCHINSON's out lot, being #2 in the plan of ALEXANDER COBEAN's out lots, between Rev. Alexander Dobbin's land and to JAMES SCOTT's land , thence by land of ALEXANDER s24 BOYD and to the mouth of HENRY WEAVER's spring run. 10 Mar 1806. 43. An act for the relief of JOSEPH ROBERT EUSTACHE BUNEL. Whereas Joseph Robert Eustache Bunel, a native of Ponteaudemer, in the late province of Normandy in France, having arrived in this state in 1792, with an intention of residing therein, in May 1804, purchased of JACOB VOGDES, a plantation and tract of land in Bristol twp., Bucks county, bounded by land late of SAMUEL ALLEN, by land late of RICHAD NOBELL, by land of THOMAS CLIFFORD, and by Neshaminy creek, containing 230 acres, and Bunel hath since mortgaged the estate, (which mortgage with other liens is nearly equal to the whole value thereof), under a persuasion of his possessing all the legal rights and privileges of a citizen, having sworn and subscribed the oath of allegiance, in consequence of which he obtained a passport and certificate of citizenship, signed by the mayor of Philadelphia, but the act of Congress passed 21 Mar 1790, and the adopting of the State constitution having superceded the act , Bunel's oath taken aforesaid, did not confer upon him the rights of citizenship, and consequently his title to the property is invalid, therefore, the title to the real estate with appurtenances acquired by Joseph Robert Eustache Bunel, by deed of indenture made to him by Jacob Vogdes and ELIZABETH VOGDES his wife, dated 21 May 1804, recorded in Deed book 35, pg. 305, shall be deemed firm and valid and any mortgage granted to him shall remain as firm and valid as if he had been a citizen of the United States at the time of purchase. 10 Mar 1806. 47. An act to incorporate a company for the purpose of erecting a permanent bridge over the river Schuylkill, near Gray's Ferry. That THOMAS LEIPER, JAMES KNOWLES, farmer, EVAN W. THOMAS, farmer, GEORGE MORTON, farmer, and DELL PENNELL, farmer, are hereby appointed commissioners, and the shares are to be divided as follows, 200 shares are hereby vested in the heirs of GEORGE GRAY, dec., free and clear, Thomas Leiper, city of Philadelphia, 25 shares, James Knowles, Delaware county, farmer, 25 shares, Evan W. Thomas, Philadelphia county, farmer, 25 shares, George Morton, Philadelphia county, farmer, 25 shares, ANN GRAY, daughter of George Gray, dec., 25 shares, CURTIS GRUBB, GEORGE G. GRUBB, and MARTHA G. GRUBB, children of MARY GRUBB, 8 shares each, and 1 additional share to be vested in Curtis, George G. and Martha Grubb, jointly as tenants in common and not as joint tenants, GEORGE W. GRAY and MARY B. GRAY, jointly as tenants in common, MARTHA GRAY and WILLIAM \pard v GRAY children of WILLIAM GRAY SR., 12 shares each, and one additional share to be vested in William, Martha Gray, children, as tenants in common, are hereby given and granted unto the heirs of George Gray dec. 10 Mar 1806. 48. An act to authorize the sale of real estate. Whereas the court of Lancaster county, in Feb. term, 1793, declared ANDREW MOORE was then, and for some time before, a lunatic or non compos mentis, and whereas his relations have stated that the real estate consisting of 270 acres of land situate in Donegal twp., is in great want of repair, and not only unproductive but decreasing in value, therefore, HENRY SLAYMAKER, JEREMIAH MOSHER, and CHRISTIAN NEISLEY, of Donegal twp., are hereby authorized to sell and convey all the real estate of Andrew Moore, and to make deeds to the purchasers, and all monies arising from the sale shall after paying the debts of the lunatic to use for his benefit. 17 Mar 1806. 49. An act to incorporate a company for making the river Conestogo navigable. That GEORGE MOORE, JACOB KRUG, CASPER SHAFFNER JR., WILLIAM BAUSMAN, HENRY DEHUFF, of the borough of Lancaster, and JOHN FUNK, of the village of Strasburgh, are hereby appointed commissioners to make the river navigable from its confluence with the river Susquehanna to ABRAHAM HOSTETTER's mill. 17 Mar 1806. 50. An act for the relief of JOHN WELCH. Whereas John Welch now an inhabitant of Butler county, entered the service of this country as a private soldier for three years, during the war in CAPTAIN JOHN M'DOWELL's company in the 7th regiment of the PA line, commanded by LIEUTENANT COLONEL JOHN GREER, and at the battle of Germantown he received a severe wound in his left shoulder, by reason of which and his advanced age he is now incapable of maintaining himself and family, therefore, the officers of the land office are hereby authorized to issue a patent to John Welch of Butler county, for such quantity of donation land as he would have been entitle to had he served to the end of the war. 17 Mar 1806. 54. An act to authorize LEWIS REESE and THOMAS MILLS, to erect a wing dam on the river Schuylkill in Berks county. That Lewis Reese and Thomas Mills, are hereby authorized to erect and maintain a wing dam, at the upper end of the dam, adjoining their own land, about a mile above the borough of Reading, and 100 rods above the confluence of Tulpehocken creek, with the river Schuylkill, on the east side of the river, necessary for the use of two water wheels. 17 Mar 1806. 60. An act for the relief of DANIEL WELKER. Whereas Daniel Welker, now an inhabitant of Franklin county, enlisted in COLONEL JOHN PATTON's regiment, in 1777, was wounded at Ash Swamp in New Jersey, and discharged in 1781, in consequence of said wound, which has since become so troublesome as to render him incapable of earning his subsistence by labour, therefore, the proper officers shall place Daniel Welker on the list of soldiers entitled to donation lands, and on his application shall draw and patent to him such donation lands as he would have been entitled to if had served to the conclusion of the war. 17 Mar 1806. 64. An act to invest two and half lots in the minister, church wardens and vestry men, of Trinity church in Pittsburg. Whereas the honourable JOHN PENN JR., and JOHN PENN ESQ. by indenture dated 24 Sep 1787, did grant and convey two continuous lots in the town of Pittsburg, #435 and 436, and 1/2 lot adjoining #437, bounded by JOHN GIBSON ESQ., JOHN ORMSBY, merchant, DEVEREAUX SMITH, gentleman, and DR. NATHANIEL BEDFORD, in trust for a site for a house of religious worship and burial ground, for the Protestant Episcopal Church and the congregation is now incorporated, therefore, the title to the lots named (recorded in the office of deeds 27 Mar 1788, in the county of Westmoreland), is hereby invest the minister, church wardens and vestry men of the Trinity church. 21 Mar 1806. 65. An act for the relief of DANIEL SHARP. Whereas BARBARA CONOWAY, died in the city of Philadelphia, in 1802 leaving property, which for want of heirs or kindred, was escheated to the commonwealth, and it appears the property consisting of a lot in the city, subject to an annual ground rent of 50 shillings, and a sum of money amounting to 22 pounds, 5 shillings and 7 pence, was intended to have been conveyed by will to Daniel Sharp, of the city as her heir, but Barbara being seized with a fit of apoplexy, died before the will could be executed, therefore, Daniel Sharp, is hereby entitled to the estate as if the conveyance had been executed. 21 Mar 1806. 66. An act for the relief of ADAM KOCH. Whereas Adam Koch, now an inhabitant of Berks county, entered into the late revolutionary war at its commencement, under the command of CAPTAIN M'CLELLAN, in 9th PA regiment, commanded by COLONEL NAGLE, that he was dangerously wounded in the head, at the battle of Brandywine by a musquet ball, which entered below his right eye and passed out below his right ear, that he was afterwards hurt at the building of West Point Fort, and that the former injury periodically affecting his intellects, together with the latter increasing the infirmities of age, he is unable to support himself, therefore, Adam Koch, is hereby entitled to receive an annuity of forty dollars during his natural life, commencing on 1 Jul 1805, and payable half yearly, for the life of Adam Koch. 21 Mar 1806. 70. An act for establishing the seat of justice, in the county district of Tioga. That JOHN FLEMING, WILLIAM HILL WELLS, and WILLIAM ELLIS, trustees appointed for Tioga county, are hereby authorized to survey 150 acres of land beginning at the intersection of Delmar and state roads and extending northeast to land of SAMUEL W. FISHER & CO., to include the town of Wellsborough, agreeably ot the description contained in the proposals made by BENJAMIN W. MORRIS, and trustees and to enlarge the plan of Wellsborough and laying out 2 acres for public building therein, and the trustees shall demand and receive from Benjamin W. Morris deeds for lots in trust for the use of Tioga county, to be filed in Lycoming or Tioga county. 21 Mar 1806. 71. An act to enable guardians to make partition of land. Whereas ISAAC WHARTON, DAVID LEWIS, JEFFE WALN, ROBERT WALN, WILLIAM RALN and ALEXANDER FULLERTON, of the city of Philadelphia, THOMAS FITZIMMONS, JOHN MILLER JR., and ROBERT BIRD, assignees of JOHN VAUGHAN of the same place, and JANE HUMPHREYS, a minor daughter of JOHN HUMPHREYS, late of Northumberland, PA. dec., are seized as tenants in common, in a large body or tract of land, composed of 197 lots, containing 195,053 acres, situate in Lycoming county, and one or more adjacent counties, in districts 2,3, and 4, surveyed in pursuance of warrants issued by this commonwealth and patented, wish to make partition, but Jane Humphreys is but 6 years old, and as the others named are of full age and JOHN PHILIP DE GRUCHY and JOHN BOYD, guardians of Jane, wish to do so, therefore, the guardians of Jane are hereby authorized to make partition of the lands on her behalf, and to receive, releases and conveyances to he use for parts alloted to her, and to execute to the other tenants in common, releases or conveyances to perfect their titles. 21 Mar 1806. 73. An act to empower the selling and conveyance of real estate. Whereas JOHN FLINTHAM, a minor, is entitled to the undivided third part of the following estate, subject to his father's life estate, as tenant by the courtesy, a certain small tenement and lot of ground, situate on the east side of Fourth street, in the city of Philadelphia, subject to a ground rent of four dollars per annum, and whereas it is the interest of the minor, that all right and title to be sold, therefore, it shall be lawful for WILLIAM FLINTHAM, father of John Flitham, a minor, to sell and convey all the right and title of the minor to the real estate, and to convey to the purchaser all the right and title which the minor has in the premises. 21 Mar 1806. 78. An act to incorporate a company for the purpose of making a road, from the Village of Maytown, in the county of Lancaster, to Nicholas's Tavern, or Cross roads, intersecting the Lancaster and Middletown turnpike. That JOHN HALDEMAN, JACOB BRENEMAN, FREDERICK GILBAUGH, JAMES HEGAN, ALEXANDER BOGGS, HENRY SHARE, and BRICE CLARK, of Lancaster county, are hereby appointed commissioners. 79. An act to incorporate a company for making a road, from _____ TRIEWIG's tavern, in Bucks county, by way of SAMUEL SELLER's tavern, Quakertown Meeting house, and Cooper's tavern, in Northamptontown, in Northampton county. That WILLIAM TILGHMAN and JAMES GREENLEAF, of the city of Philadelphia, GEORGE WEAVER of Montgomery county, SAMUEL SELLERS, WILLIAM GREEN, JAMES CHAPMAN and ANDREAS TRIEWIG of Bucks county, STEPHEN BALLIOT, DANIEL COOPER, PETER KNIPLEY, JOHN KEEPER and GEORGE SAVITZ, of Northampton county, are hereby appointed commissioners. 28 Mar 1806. 81. An act to sell and convey one moiety of a messuage and lot of ground. Whereas BENJAMIN BROWN, late of Boston, in the state of Massachusetts, dec., was in his lifetime seized of a merssuage or tenement with a lot of ground, situate on the Lancaster turnpike in Blockley twp., Philadelphia county, which was devised to his widow MARY FRANCES BROWN, and his daughter HANNAH FISHER BROWN, a minor, under the age of 14, is absent in Europe, and the property is unproductive and going to decay for want of repairs, and her guardian JAMES LLOYD JR., of Boston, be permitted to sell and convey the moiety belonging to the minor, therefore, it shall be lawful for James Lloyd Jr., to sell and convey the undivided moiety of the messuage and lot, belonging to the minor. 28 Mar 1806. 82. An act to incorporate the Pennsylvania Academy of Fine Arts. Whereas a number of persons desirous of promoting the cultivation of the fine arts in this country have associated themselves, procured a lot of ground in the city of Philadelphia, and begun erecting a building, and they are declared a body politic and corporate, and the first officers are, GEORGE CLYMER, president, WILLIAM TILGHMAN, WILLIAM RAWLE, MOSES LEVY, JOSEPH HOPKINSON, JOSEPH B. M'KEAN, WILLIAM MEREDITH, WILLIAM RUSH, JOHN R. COXE, JOHN DORFEY, WILLIAM POYNTELL, THOMAS C. JAMES, and CHARLES WILSON PEALE, directors. 28 Mar 1806. 83. An act to incorporate a company for making a road, from Berwick, on the northeast branch of the Susquehanna, from the mouth of the Lower Wopehawley to the north line of the state, nearest to Newtown, on the river Tioga, in the state of New York. That LEVI HOLLINGSWORTH, WILLIAM TURNBULL, ANTHONY MORRIS, BENJAMIN R. MORGAN, SAMUEL M. FOX, and SAMUEL MIFFLIN, of Philadelphia city, NATHAN BEACH, ABEL FELLOWS of Luzerne county, THOMAS BOWMAN of Northumberland county, and JOHN FRANKLIN, STEPHEN TUTTLE, and REUBEN HALE, of Lycoming county, are hereby appointed commissioners. 28 Mar 1806. 84. An act to erect the town of Bellefonte, in Centre county, into a borough. That the town of Bellefonte, is hereby erected into a borough, bounded by lands of JOHN DUNLOP, and NATHANIEL SIMPSON, on the south and east by land of JAMES DUNLOP, on the north, by Spring creek and land of JAMES HARRIS. 28 Mar 1806. 85. An act for the relief of JOHN CUMMINS and WILLIAM COOPER. Whereas JOHN GILL and William Cooper, obtained patents for the following tracts of donation land, situate in the 6th district, #1265, granted to John Gill for services rendered during the revolutionary war, and #57, granted to Cooper for like services, and whereas it appears that John Cummins is now the owner by purchase of the tract granted to John Gill, and the two tracts are in part covered by surveys, made in the 5th district, whereby Cummins and Cooper are deprived of a great part of the lands granted to them, for remedy, John Cummins and William Cooper, shall within one year release to the commonwealth the lands held by them, by their patents, it shall be the duty of the officers of the land office to draw donation land equal in quantity to the lands which his former patent called for, and complete a title clear of expense. That John Cummins shall be entitled to part of the lands, now held by him under his patent, as found to be in the 6th district, he paying into the recievers office at the rate of $1.00 per acre, to be paid in 12 months. 28 Mar 1806. 86. An act to revive and amend an act to incorporate a company, for erecting a bridge over the river Lehigh, near the town of Northampton. Whereas by an act passed 22 Mar 1797, for erecting a bridge over the river Lehigh, has not been accomplished as some of the commissioners appointed are deceased and others have removed, therefore, JAMES GREENLEAF, JACOB CLAYDER, GEORGE ROADS, JOHN KEIPER, GEORGE BUTTS and JEREMIAH TREXLER, are hereby appointed commissioners. 28 Mar 1806. 87. An act for the relief of JOHN RYAN. Whereas John Ryan, of Philadelphia county, served as a soldier in the revolutionary war, in the first PA regiment, commanded by COLONEL HAND, and afterwards by COLONEL CHAMBERS, having been wounded at Miles Square, in the state of New York, being now advanced in years, weak and infirm of body, and in very low circumstances in life, therefore, John Ryan, of Philadelphia county, is hereby allowed an annuity of forty dollars, from 1 Jul 1805, in half yearly payments. 28 Mar 1806. 88. An act to enable executors to convey a house and lot. Whereas JOHN JOURDAN, of Greenwood twp., Cumberland county, did on 26 Nov 1804, verbally sell to MICHAEL M'GARRY of the same town, a house and lot with appurtenances in Millerstown, #33, for the sum of 200 pounds, and that the first payment was then made and notes given for the residue of the money, and M'Garry put in possession of the premises, but no written agreement was made or witnesses called, except those who were called to witness the notes, the parties placing entire confidence in each other, but no deed of conveyance was made for the property, then John Jourdan unexpectedly died, making no provision for the transfer of the house and lot in his last will, therefore, AMOS JOURDAN and SOPHIA JOURDAN (nee SOPHIA NORTH,) executors named in the will of John Jourdan, dec., are hereby authorized to convey unto Michael M'Garry, the house and lot #33, as soon as M'Garry the consideration agreed upon. 28 Mar 1806. 89. An act to provide for the erection of a house for the employment and support of the poor, in Dauphin county. That CHRISTIAN KUNCKLE, ISAAC FERREE JR., THOMAS STUBBS, GEORGE LOWER, VALENTINE SHOUFFLER, MARTIN MEILY, ABRAHAM DOEBLER, RUDOLPH KINTZEL, and HENRY MAYER, of Dauphin county, are hereby authorized as directors. 28 Mar 1806. 90. An act for the relief of GEORGE VANCE. Whereas George Vance of Mifflin county, served a tour and also as a volunteer scout in the militia against the Indians, in the year 1781, in the company of CAPTAIN WALTER M'KINNEY, under the command of COLONEL ALEXANDER BROWN, for which he received for the first tour a certificate #7179, for he sum of 9 pounds, and for the second tour, a certificate #7162, for the sum of 1 pound, 4 shillings, both of which were destroyed by fire, together with his other papers and books on which no interest hath been paid, and the certificates have not been redeemed, therefore, the state treasurer is authorized to pay to George Vance, the sum of 10 pounds, 4 shillings and 6 pence, with interest. 28 Mar 1806. 91. An act to grant SAMUEL PLUMMER, the pre-emption rights to a lot in the town of Franklin. Whereas at the time of town of Franklin (now the seat of justice) in the county of Venango, was laid out, an in lot, including a house then occupied by officers of the army of the United States, was not numbered with the other lots, and also when the troops evacuated the old garrison, the house was sold by the quarter master general to JOHN ANDREWS, since time sundry additions have been made to the original building and by several conveyances the right has become vested in Samuel Plummer, the present occupant, with no means of obtaining title, therefore, the commissioners for the sale of lots in the town of Franklin, GEORGE FOWLER, GEORGE POWER and JAMES G. HERON, are hereby authorized to appraise the lot, and on that value being paid to the receiver general accompanied with the commissioners certificate of valuation, a patent shall be issued to Samuel Plummer. 28 Mar 1806. 93. An act making appropriation for improving the road near Bald Eagle's Nest, Centre county, to the river Allegheny, in Venango county, and a road to Greene county. The sum of $500.00 is to be paid to the commissioners of Centre county, to improve the road which lies between DAVID EUAN's mill, Centre county, and JOSEPH BARNETT's mill, on Sandy Lick creek, plus $300.00 to improve the road between Barnett's mill and the dwelling of ELIAS HOLMAN on the Allegheny river. 28 Mar 1806. 94. An act for the relief of HENRY DOUGHERTY JR. Whereas Henry Dougherty Jr., now an inhabitant of Lycoming county, when on a tour of duty as a private soldier in COLONEL POTTER's regiment of Northumberland militia, in the service of the United States, in an action with the enemy at Piscatawy, in the state of New Jersey, in Feb 1777, received a wound through the right shoulder, which dislocated the joint and otherwise fractured the bones, whereby he is rendered in a great measure unable to support himself or family by labor, and it appears in consequence of the wounds he has been placed on the pension list, and now received from the United States, an annuity of sixteen dollars only, which appears far short of being adequate compensation for an old soldier labouring to support himself and a large family, under infirmities occasioned by wounds he received when bravely fighting in defense of his country, therefore, the land office is hereby directed to grant a patent to Henry Dougherty Jr., for such portion of donation lands as he would have been entitled to from this state if he had served during the war. 28 Mar 1806. 96. An act to extinguish the lien of the commonwealth on parts of the estate of the late JOHN NICHOLSON, in favor of THOMAS RYERSON. That the treasurer is hereby authorized to receive from Thomas Ryerson, for the use of the commonwealth, the sum of $500.00 in full satisfaction for the relinquishment of land and town lots in Fayette county, which were supposed to be part of the estate of the late John Nicholson, and the lien removed on the following, 120.5 acres including the grist and saw mills at Haydensburg, lately occupied by JEFFE EVANS, 86.5 acres on the waters of Georges creek in Georges twp., surveyed on a warrant dated 26 Jan 1791, known by the name of MAGNUS TATE's place adjoining THOMAS HEADY and others, and 196 acres on the waters of Georges creek, Georges twp., surveyed for THOMAS HEADY JR., on application #3599, and adjoins Magus Tate's tract, also 2 lots in Haydensburg, one having a log house thereon, in which Jeffe Evans a few years ago resided. 28 Mar 1806. 98. A supplement to an act for raising by lottery $20,000.00 for removing obstructions and improving the navigation of the river Susquehanna. Whereas THOMAS BOUDE, SAMUEL BETHEL, JACOB STRICKLER, WILLIAM P. BEATTY, JOHN EVANS and CHRISTIAN BRENNEMAN, managers named under the act passed 18 Feb 1805, state that ADAM REIGART JR., PHILIP DIFFENDERFER, and MICHAEL GUNDACKER, have declined the duty enjoined on them, they request three others be appointed, therefore, EMANUEL REIGART, HUGH WILSON, and MICHAEL RINE are hereby appointed in their room, and ABRAHAM WITMER, CHRISTIAN STONER, ANDREW KAUFFMAN, GEORGE PRETZLER, NATHANIEL BARBER, PHILIP GOSLER, and GEORGE SNYDER of Lancaster county, THOMAS GRANT of the town of Northumberland, in Northumberland county, JAMES DUNCAN of Aaronsburg, Centre county, JOHN BLAIR and ROBERT ALLISON of the town of Huntingdon, Huntingdon county, and GEORGE M'CLELLAND of Lewistown, Mifflin county, are hereby appointed additional managers. 31 Mar 1806. 99. An act for the relief of RUDOLPH SPANGLER. Whereas SIMON FORD a servant of Rudolph Spangler of York county, in 1777, enlisted in COLONEL THOMAS HARTLY's regiment, in the PA line, at the time of his enlistment had one year and eleven months to serve, agreeable to the terms of his indenture, which his master never received any satisfaction for, and as the services of Simon Ford were rendered for his country, during the late revolutionary struggle for its liberty and independence, therefore, Rudolph Spangler, is hereby allowed the sum of $53.33 with interest. 31 Mar 1806. 100. An act to appropriate a sum of money for the purpose of opening and improving a public road between Somerset and Washington, on the Laurel Hill. Whereas THOMAS JONES, of Westmoreland county, and WILLIAM BACKHOUSE, of Somerset county, have at their own expense, begun to improve the road by altering the course for a distance of four miles and three quarters, shortening the distance, therefore, the sum of $300.00 is hereby appointed for completing the road. 31 Mar 1806. 103. An act erecting election districts and making alterations to others. That Hopewell twp., York county, is hereby erected into an election district, and the electors shall hold their elections at the house of JOHN BORDNER. That Fawn twp., York county, shall be a separate election district and the electors shall hold their elections at the house now occupied by WIDOW CUNNINGHAM. That the electors of Chansford twp., York county, shall be a separate election district and the electors shall hold their elections at the house now occupied by CHARLES WILLIAM POTTER. That the electors of the third election district, Berks county, shall hold their elections at the house of ABRAHAM BAILEY, in the town of Hamburgh. That the electors in the second election district, Northampton county, shall hold their elections at the house now occupied by GEORGE SEVITZ, inn keeper in the town of Northampton. That Moore twp., and part of Allen twp., lying north of the road leading from Easton by MICHAEL MYERS to FREDERICK NAGLE's a direct line to HENRY BEIL's mill, near the river Leghigh, Northampton county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by ABRAHAM MENSH, in Allen twp. That part of Morris, Amwell and West Bethleham twps. in Washington county, bounded, Washington to Muddy creek to road from ______ GANTZ's mill, to Amwell twp., to DEMAS LINDSLEY's mill, on the middle fork of Ten Mile creek, to CALAB LINDSLEY's, to JACOB BOBBITT's, near the west line of Morris twp., shall be the 11th election district, and the electors shall hold their elections at the dwelling house lately occupied by ZIBA COOK ESQ., in the town of Amity. That Jefferson county shall be a separate election district, and the electors shall hold their elections at the house now occupied by JOSEPH BARNET, on Sandy lick. That Southampton twp., Bedford county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by JACOB ADAMS. That Lower Merion twp., Montgomery county, is hereby erected into a separate election district, and the citizens shall hold their elections at the house now occupied by TITUS YERKES. That Franconia twp., Montgomery county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by JOHN HUGHES in Towamensing twp. That part of Willingsborough and Tunkhannock election districts, Luzerne county, is hereby erected into a separate election district and the electors shall hold their elections at the house now occupied by EBENEZER STEVENS. That the electors of Tunkhannock district, Luzerne county, shall hold their elections at the house now occupied by JOHN M'CORD. That part of the third and fourth election districts in Huntingdon county, including JOHN GLASSGOWE's farm, shall be a separate election district, and the electors shall hold their elections at the house now occupied by THOMAS RICKETS. That the electors beginning on the Ohio, opposite Grape Island, to JAMES INGLES, thence to GEORGE BRUCE's etc., are hereby annexed to the Beaver town election district, and the electors shall hold their elections at the house now occupied by SAMUEL JOHNSTON JR., in Beaver town, in the county of Beaver. That the electors residing in the 5th district, in Butler county, shall hereafter hold their elections at the house now occupied by ADAM FUNK. That Buffaloe twp., Butler county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by BENJAMIN SERVER. That Middlesex twp., Butler county, shall be a separate election district, and the electors shall hold their elections at ALEXANDER M'BRIDES mill. That Conequenessing and Muddy creek twp., Butler county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by MATTHEW WHITE, in Conequenessing twp. That Armagh twp., Mifflin twp., shall be an election district and the electors shall hold their elections at the house now occupied by GEORGE M'CANDLESS. That the electors of Elklick twp., Somerset county, shall hold their elections at the house ow occupied by MARTIN WEYMER JR., in the village of Salsbury. That the electors of the district of Burlington, Lycoming county, shall hold their elections at the house now occupied by NATHANIEL ALLEN. That part of Greene county, beginning at the house of JOHN MEREDITH, etc., shall be the 6th district, and the electors shall hold their elections at the house of JOHN M'KEE. That the electors of the second election district, composed of Potters and Forguson twps., in Centre county, shall hold their elections at the house now occupied by JOHN IRWIN. That part of Crawford county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by SHADLOCK NEGUS. That part of Sadsbury twp., in Crawford county, is annexed to Mead election district, beginning at corner of land on which MATTHEW WILSON formerly lived, to corner of land originally surveyed under a warrant in the name of ISRAEL ISRAEL, to land on which ABNER EVANS now lives, etc. shall hold elections at the court house in the town of Meadville. That part of Mead twp., Crawford county, is hereby annexed to Hennington's election district and the electors shall hold their elections at the house now occupied by JAMES HENNINGTON, in Fairfield twp. 31 MAR 1806. 107. An act to raise by lottery, the sum of $7000.00 to enable the company, for the purpose of promoting the cultivation of vines to pay their debts, and $2000.00 for erecting a school house near Summonytown in Montgomery county. That RICHARD SMITH, MAJOR ANTHONY SIMMONS, JOHN GOODWIN, PETER CHRISTIAN, ROBERT BETHEL, BENJAMIN S. BARTON M.D., and JAMES VANNUXEM, are hereby appointed commissioners to raise by way of lottery, $7000.00 for the purpose of promoting the cultivation of vines. That PHILIP GABLE JR., GEORGE HERTZIL, LAWRENCE JACOBY, PHILIP ZEFF, DANIEL SMITH and PHILIP HAHN JR., are hereby appointed commissiners for the erection of a school house near Summonytown in Montgomery county, on a lot given by GENERAL DANIEL HEISTER, dec. 31 Mar 1806. 108. An act for collection of debts due the commonwealth. That CADWALLADER EVANS of Montgomery county, JOHN STEELE, of Lancaster county, and JOHN LYON of Union town in Fayette county, are hereby appointed commissioners to procure from the recorders of the respective counties, copies of deeds relating to real estate of JOHN NICHOLSON, dec. and all transcripts of mortgage and judgment. 31 Mar 1806. RESOLUTIONS 5. Resolved JAMES ROSS of Pittsburugh and JAMES HOPKINS, are hereby employed as counsel, for the sum of $500.00 each, to appear in behalf of the inhabitants within the supposed manor of Springetsbury, and defend their rights until a final decision shall be had in some one of the suits now pending in the courts of the United States, and in case either of the gentlemen should neglect or refuse to serve as counsel aforesaid, the other shall select another person as an assistant in his stead. 31 Mar 1806. 7. Resolved that the Secretary of the commonwealth, as soon as he shall have received the report by WILLIAM HAMILTON, of the trial of three of the judges of the supreme court, shall deliver, on application to him for that purpose, one copy to each of the members of the Senate and House of Representatives. 31 Mar 1806.
