THOMAS M'KEAN, Governor SIMON SNYDER, Speaker of the House of Representatives P.C. LANE, Speaker of the Senate. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 2. An act to enable executors to execute a deed of conveyance. Whereas ABRAHAM RAMBO did sell a lot situate in Upper Merrion twp., Montgomery county, containing 3 acres and 87 perches, to WILLIAM BAILEY, who is in possession of, and has improved the lot, and paid the consideration thereof, and he never did execute a deed of conveyance, therefore, ANN RAMBO, executrix, and JACOB SHAINLINE, executor of the last will and testament of Abraham Rambo, dec., are hereby authorized to execute a deed. 18 Dec 1807. 4. An act to incorporate the trustees of the Second Baptist Church and Congregation in Philadelphia. Whereas a number of individuals in a religious society called the Second Baptist Church, and wish a charter of incorporation, therefore, SAMUEL BOWER, ISAAC WHITE, JACOB KEEN, ISAAC JOHNSON, THOMAS TIMINGS, JOHN COLLARD and CORNELIUS TRIMNUL are hereby constituted a corporation and body politic. 18 Jan 1808. 5. An act vesting a title in trustees for the benefit of the congregation composed of Presbyterians and Lutherans. Whereas the congregation have erected a school house on a tract of land containing 60 acres, situate in Somerset twp., Somerset county, property of the commonwealth, and in Republican governments it ought to be pursued to aid less wealthy citizens, therefore, the officers of the land office are hereby authorized to issue a warrant and complete a title, clear of purchase money and office fees, for 60 acres, adjoining lands of JOHN NEEL, FREDERICK MORSTOLLER, NICHOLAS SCHNIDER and others, unto ANDREW WEY, JACOB SWANK and HENRY SHARER, in trust, for the use of the congregation. 18 Jan 1808. 6. An act to empower the German Reformed Congregation, in Germantown, in Philadelphia county, to sell and convey a messuage and lot of ground. Whereas the congregation purchased from JACOB ROHRER and MARY ROHRER his wife, who was the administratrix to the estate of HENRY KEYSER, late of Cheltenham twp., Montgomery county, powder maker, dec., a messuage or tenement, and lot, situate on the great road in Germantown, containing 2.25 acres, and that had lately purchased from the administrators of JOHN FROMBERGER, dec., a messuage and lot of ground in Germantown immediately adjoining their church and burying ground for a parsonage, and funds are inadequate to pay off the whole of the purchase money purchased from the administrators of John Fromberger dec., without selling the messuage and lot purchased of the administrix of Henry Keyser dec., therefore, it shall be lawful for the society to sell a messuage or tenement and lot of ground situate on the great road which was conveyed to them 10 May 1794, recorded Deed book #61, pg 392 containing 2.25 acres. 18 Jan 1808. 7. An act to raise by lottery, for the purpose of completing a meeting house in Shamoken twp., Northumberland county. That ALEXANDER MOORE, WILLIAM KASE, JOHN KELLY, SILVANUS BIRD, SAMUEL MOORE, are hereby appointed commissioners to raise $800.00 to finish and complete the Presbyterian meeting house. 18 Jan 1808. 8. An act to establish a public ferry on the east side of the river Susquehanna, Dauphin county. That WILLIAM MOORHEAD, shall have the right at this own cost, to make a good landing on the east side of the river Susquehanna, on the estate of William Moorhead, situate on the great road leading from Harrisburg through Selins Grove to Sunbury, Northumberland county. 18 Jan 1808. 9. An act to change a name. Whereas JOHN HARE POWEL, son of ROBERT HARE of the city of Philadelphia, at the request of a near relation has deemed to change his name from JOHN POWEL HARE, to John Hare Powel, therefore, John Powell Hare shall henceforth be called John Hare Powell, and to do all legal acts under this name as under his former name. 18 Jan 1808. 10. A supplement to an act for establishing the seat of justice in Tioga county. That JAMES DIXON of Delmar twp., and SAMUEL W. MORRIS of Wellsborough in Tioga county, are hereby appointed trustees for the county of Tioga, in the room and stead of WILLIAM ELLIS, dec., and of WILLIAM H. WELLS who has resigned, and Dixon and Morris, together with JOHN FLEMING the other trustee, are vested with all rights and duties. 1 Feb 1808. 13. An act granting SAMUEL KOOCKOOYAEI a tract of donation land. Whereas Samuel Koockooyaei served as a musician in the PA regiment of Artillery, commanded by COLONEL THOMAS FORREST, until honorably discharged in consequence of inability to continue longer in the service, occasioned by an epileptic disease, and was discharged very near the close of the war, with a constitution debilitated by the services rendered his county, therefore, the officers of the land office are hereby authorized to grant to Samuel Koockooyaei, a patent for a tract of donation land. 1 Feb 1808. 14. An act to confirm title to an island in the river Delaware. Whereas doubts have arisen as to whether the present possessors of Biles Island in the river Delaware, situate in Falls twp., Bucks county, one mile below the lower falls, have a legal title, as the island was purchased from the indians in 1680 by WILLIAM BILES, the ancestor of the present possessor, that purchase was confirmed by a deed dated 19 Mar 1727, therefore to remove all doubts, the present possessors of Biles Island, are hereby confirmed in the possession and right to the same. 1 Feb 1808. 16. An act to incorporate the Evangelical Lutheran Congregation of St. John's church, in the city of Philadelphia. That MARTIN HARTLEY, ADAM ECKFELT, JOHN LESHER, JOHN GRAFF, CHRISTIEB BARTLING, DANIEL BREUTIGAM, ISAAC WAMPOLE, JOHN SINGER, JOHN GOODMAN JR., CONRAD HAAS, JOHN RUGAN, GEORGE REES, CHARLES SCHAFFER, JACOB BENNINGHOVE, SAMUEL LEHMAN, BALTES EMRICH, GEORGE BANTLEON, MICHAEL FOX, JOHN HAY, DANIEL BICKLEY and JOHN GREINER, are hereby constituted a corporation and a body politic, as trustees. 1 Feb 1808. 17. An act granting a tract of donation land. Whereas JAMES NORRIS, now an inhabitant of the county of Philadelphia, entered very early in the late revolutionary army, and in consequence of merit he was advanced to a lieutenancy, under CAPTAIN VAN HEER, and continued to render essential services to his county, until the month of Nov. 1780, when (owning to extreme hardship) a severe fit of illness reduced him to the necessity of resigning his commission, his life being in imminent danger, that he never recovered his health, and is now advanced in years, and unable from his infirmities, to maintain himself and a numerous family, that it appears that he should be placed on a footing with those who served to the end of the war, therefore, the officers of the land office are hereby directed to grant a patent to JAMES NORRIS, for a share of donation land as a lieutenant who served to the end of the late revolutionary war. 1 Feb 1808. 19. An act to enable the trustees of the German Lutheran Congregation of the townships of Albany and Linn in Berks and Northampton counties, to convey to the trustees of the German Reformed Congregation, an equal right to a church and tract of land. Whereas REV. HENRY MELCHIOR MUHLENBERG by deed poll, dated 10 Jul 1770, conveyed a church and tract of 50 acres to PHILIP STAMBACH, JACOB GORTNER, VALENTINE BROBST, MATTHIAS BROBST and GEORGE KESTLER, trustees of the German Lutheran Congregation, and this church is very much out of repair, and must be rebuilt and the members are willing to give equal right to a German reformed congregation and both to rebuild the church, therefore, the trustees of the German Lutheran Congregation are hereby authorized to convey to the trustees of the German reformed congregation, an equal right in the church and 50 acres of land. 4 Feb 1808. 20. An act for the relief of CHARLES THOMPSON. That the Governor is hereby authorized to draw a warrant in favor of Charles Thompson of Montgomery county, for the sum of $3195.00 being the residue in full for all costs and damages sustained by him, in consequence of being evicted from a tract of land, containing 58 acres and 35 perches, situate in Northern Liberties twp., Philadelphia county, held by him under a title derived from the sale of confiscated estates. 4 Feb 1808. 21. An act for the relief of THOMAS COX. Whereas Thomas Cox of Bucks county, enlisted in the service of his country in the beginning of the year 1777, and he received a wound in the thigh at the battle of Germantown, by which he has been rendered unable to support himself, it further appears he continued in the service until 1781, when he was discharged, therefore, the sum of forty dollars, is hereby granted Thomas Cox, to be paid immediately, and an annuity of forty dollars is granted for the use of Thomas Cox, during his natural life, to be paid to SAMUEL JOHNSON ESQ., of Buckingham twp., Bucks county, to provide clothing, diet and other necessaries for Thomas Cox. 4 Feb 1808. 22. An act to raise by lottery, money to purchase burial ground for the Society of Universalists in the city of Philadelphia, and to pay a debt contracted in building a house of public worship. That ISRAEL ISRAEL, ELISHA GORDON, THOMAS AMIES, JACOB THOMAS, JOHN MURRAY, THOMAS KINGSTON, THOMAS TOMKINS and THOMAS F. GORDON, are hereby appointed commissioners. 4 Feb 1808. 23. An act establishing an academy in the borough of Uniontown, in Fayette county. The first trustees are JAMES GUTHRIE, THOMAS HADDEN, PRESLEY CAR LANE, JAMES W. NICHOLSON, CHRISTIAN TARR, CHARLES PORTER, THOMAS MEASON, JOHN KENNEDY, ZADOC WALKER, JAMES ALLEN, MAURICE FREEMAN, JESSE PENNEL and JAMES FINDLAY. 4 Feb 1808. 25. An act for the relief of NATHANIEL COULTER. Whereas Nathanial Coulter of Washington county, on the years 1781, 1782 and 1783, performed several tours of militia duty in defence of the Western frontier of this state, against the hostile attacks of the Indians, for which he neither received pay nor rations. And it is just and reasonable that the services which were rendered in defence of the commonwealth, during the period of our revolutionary contest, should be amply compensated, therefore, sixty dollars are hereby granted to Nathaniel Coulter, for his military services in full. 15 Feb 1808. 27. An act to raise by lottery a sum exceeding $2000.00 for building a house for religious worship in Limerick twp., Montgomery county. That OWEN EVANS, JAMES B. HARRIS, MATTHEW BROOKE, JAMES EVANS JR., ISAAC MARCKLEY, JOHN BARLOW, JACOB KEELEY and JOHN BROOKE, are hereby appointed commissions. 15 Feb 1808. 28. An act for the relief of DILLAPLAIN RIDGWAY. Whereas Dillaplain Ridgway of the city of Philadelphia, bricklayer, on the 17 Oct last, became bound into a bond in the sum of $60,000.00 together with WILLIAM T. DONALDSON and sixteen others, as sureties for William T. Donaldson's faithful execution of the office of sheriff, for the city and county of Philadelphia, and he has been in the practice of purchasing lots and erecting houses for sale, that he now has several houses for sale, and finds it necessary to borrow money, and that he was not aware of the legal consequences of his entering into the recognizance, which prevents him from selling any of his real estate, or obtaining money upon loan to prosecute his trade, and if not released from the bond his utter ruin must be the consequence, and he offers to substitute in his place sufficient security, therefore, it shall be lawful for Dillaplain Ridgway, to procure a person to enter into a recognizance and become bound in a bond as surety for William T. Donaldson, provided he is approved by the governor and the court, and he is to be released from his obligation and the lien annulled. 15 Feb 1808. 29. An act to raise by lottery, money to finish the meeting house in Wilkesbarre, and for protecting the bank of the river opposite the borough, from the encroachments of the river. That EBENEZER BOWMAN, LORD BUTLER, WILLIAM ROSS, ROSEWELL WELLES, MATTHIAS HOLLENBACK, MATTHEW COVELL, EBENEZER LOCUM, THOMAS WRIGHT, ARNOLD COLT, CORNELIUS COURTRIGHT, NATHAN PALMER, NATHAN WALLER and JOHN ROBINSON are hereby appointed commissioners. 15 Feb 1808. 30. An act to sell and convey real estate. Whereas ANDREW MARSHALL, of Hamilton Twp., Franklin county, dec., seized of lands and tenements and by his last will and testament bequeath all his lands and tenements unto his 5 sons, JOSEPH MARSHALL, WILLIAM MARSHALL, SAMUEL MARSHALL, JOHN MARSHALL, and ANDREW MARSHALL JR., and if a majority of his sons agree that shall have power to sell and convey his lands after his decease, but doubts have arisen as to his true intentions, and Samuel Marshall his son, has since died intestate and without issue, and likewise John Marshall, another son died intestate, leaving lawful issue, three sons and one daughter, all of whom are minors, and Joseph, William and Andrew Marshall, the three surviving sons wish to sell, therefore, it shall be lawful for Joseph and William Marshall, two of the executors and surviving sons of Andrew Marshall dec., to sell and convey all the right and title of Andrew Marshall, dec., 15 Feb 1808. 32. An act to raise by lottery, money for erecting a school house for the Lutheran and Reformed congregations at the Union Church in Whitehall twp., Northampton county, and to defray the expenses of the church. That DANIEL SNYDER, FREDERICK HOUSMAN, PETER KERN, MICHAEL DEIBER, STEPHEN BALLIOT SEN., and PETER BUTZ, of Northampton county, are hereby appointed commissioners. 15 Feb 1808. 33. An act granting relief to a soldier. Whereas JOSEPH GWYNE now residing in Greene county, was enlisted as a soldier in the 8th PA regiment for three years, which time he served faithfully, and was discharged without receiving depreciation of his pay, therefore, Joseph Gwyne is hereby allowed $156.00 in full, for his depreciation of pay for services as a soldier in the late revolutionary war. 15 Feb 1808. 34. An act to raise by lottery a sum not exceeding four thousand dollars, for purchasing a lot, building a school house and house for religious worship, in the borough of Bedford. That TERENCE CAMPBELL, WILLIAM PROCTOR JR., JOHN ANDERSON, GEORGE HENRY, WILLIAM GRIFFITH, SAMUEL TATE, MARTIN REILY, SAMUEL DAVIDSON and HENRY WERTZ JR., are hereby appointed commissioners to raise the money. That JOHN LYON, JACOB FLETCHER, CHARLES M'DOWELL, WILLIAM REYNOLDS and ANTHONY NAWGEL are hereby appointed trustees for the inhabitants of the town of Bedford. 15 Feb 1808. 35. An act to incorporate a company to make a road, from the town of Hanover, York county, to the Maryland line, near the place the turnpike from Baltimore to the state line, towards Hanover, will strike the same. That CONRAD LAWMOT, HENRY WELSH, PETER STORM, FREDERICK WENTZ, FRANCIS LAWMOT, JACOB METZGER and PETER ECKARD, are hereby appointed commissioners. 22 Feb 1808. 36. An act for the relief of the inhabitants of the village of Palmyra, in Londonderry twp., Dauphin county. That JOHN ELDER, MATTHEW IRWIN, DANIEL WONDERLICH, JOHN ERNST, JOHN DOWNY and LEVI G. HOLLINGSWORTH, are hereby appointed commissioners, to raise by lottery a sum not exceeding $3000.00 for the purpose of bringing into the village a supply of water for their use. Levi G. Hollingsworth, Daniel Wonderlich, HENRY LONGENECKER, JOHN KEAN and JOSEPH CARMONY are hereby appointed trustees to receive from the commissioners the monies raised, and to devise and plan and cause to be laid works to supply water. 22 Feb 1808. 38. An act to authorize to sell and convey tract of land in Monaham twp., York county. Whereas THOMAS DILL, late of Monahan twp., York county, died intestate, seized and entitled to one equal fourth part of two plantations or tracts lying in Monahan twp., York county, leaving a widow, named PRISCILLA DILL, by whom he had issue, CALAB DILL, JOHN DILL, PRISCILLA DILL JR, JAMES DILL, and ELIZABETH DILL, all minors except Caleb Dill eldest son, who had one of the tracts laid off into town lots with the consent of the widow, and WILLIAM WIREMAN, guardian of the minor children with a view of taking the same at the next orphans count, but before that he died, and as the land is unproductive in its present state, and one of the tracts being situate on the intersection of the sundry public roads and being small is so cut up by them as to render it unfit for farming, the other tract being also small, but little unproven, therefore desire one or both tracts, therefore, Priscilla Dill, widow and administratrix of Thomas Dill, William Wireman Sen., guardian of the minors, and William Wireman administrators of the estate, are hereby authorized to sell and convey, the tract containing 170 acres 59 perches, by the name of Elizabeth Dillstown, the other containing 150 acres. 22 Feb 1808. 39. An act granting a tract of donation land. Whereas WILLIAM MCCORMICK, now residing in Mercer county, did faithfully serve four years in the 1st PA regiment in the late revolutionary war, and also in the militia of Lancaster county, that he was taken prisoner at Paole and detained for eight months in captivity, during which time, he suffered much, which laid the foundation of the pains and ills he now in old age experiences, therefore, the officers shall place William McCormick, on the list of soldiers entitled to donation land, and on his application shall draw and patent such donation land as he would have been entitled to had he served to the end of the war, and the donation land shall be unalienable during the lifetime of William M'Cormick. 22 Feb 1808. 40. An act to raise by lottery, money to defray the expenses incurred by the trustees of the German Presbyterian and German Lutheran Congregations, in the borough of Carlisle, Cumberland county. That JACOB HENDEL, JOSEPH SHROM, JACOB WEAVER, JACOB MATTER, PHILIP REISINGER and PETER FISHBURN of Cumberland county, are hereby appointed commissioners. 22 Feb 1808. 41. An act to change a name. Whereas, CHRISIAN CARSON FEBIGER, of the city of Philadelphia, in compliance with the directions contained in the last will and testament of his uncle the late COLONEL CHRISTIAN FEBIGER, by whom he was adopted, has changed his name and has prayed it be confirmed, herefore, Christian Carson Febiger, formerly CHRISTIAN FEBIGER CARSON, shall be known by Christian Carson Febiger, and capable in law as if no change had been made. 22 Feb 1808. 42. An act to enable the Lutheran and Presbyterian congregations, in Robinson twp., Berks county, to raise by lottery a sum of money for the purpose of building a meeting house and school house. That WILLIAM WITMAN, CHRISTIAN TREAT, JACOB GEIGER, CHRISTIAN DANNEHOWER, JOHN WESLEY and JOHN ZEIMER, are hereby appointed commissioners. 22 Feb 1808. 43. An act granting a tract of donation land. Whereas JOHN MORRIS, now residing in Lancaster county, was an enlisted soldier in CAPTAIN MARES' company, 4th PA regiment, commanded by COLONEL WILLIAM BUTLER, and served as such until the year 1780, when he was honorably discharged, that he enlisted again in CAPTAIN VAN HEER's troop of horse, and continued until the close of the war, that owing to his change from Captain Mare's company to Captain Van Heer's troop of horse, he did not receive any donation land and to which he is in equity entitled, therefore, the proper officers shall place John Morris on the list of soldiers entitled to donation lands and on his application shall draw and patent to him such donation land as he would have been entitled to, had he served in the foot to the end of the war, and the patent of the donation land shall be unalienable during the life time of John Morris. 22 Feb 1808. 44. An act to raise by way of lottery, money not exceeding $2500.00, for finishing a church in the town of Hanover, York county. That HENRY SLAGLE, LIDWIG OVERDUR, FREDERICK SHULTZ, JACOB EICHELBERGER JR., JACOB METZGER and HENRY MARTER are hereby appointed commissioners. 22 Feb 1808. 45. An act to raise by lottery, money for erecting a school house in Shippensburg, Cumberland county. That DAVID M'KNIGHT, JOHN SIMPSON, JACOB RAHM, SAMUEL M'CLURE, ALEXANDER STEWART and JAMES LOWREY, of Cumberland county, are hereby appointed commissioners. 22 Feb 1808. 47. An act for the relief of SAMUEL ASHTON. Whereas on the 10 Sep 1804, Samuel Ashton, of Philadelphia county, purchased from WILLIAM PLAYFORD, an alien, a plantation or piece of land, in Ridley twp., Delaware county, containing 219 acres and 125 perches, and at the time of the purchase Samuel Ashton was not informed that William Playford was an alien, therefore incapable of holding real estate, thus the title is in doubt, therefore, the title of Samuel Ashton, Philadelphia county, to the plantation or tract of land purchased from William Playford, an alien, is hereby declared valid the same as if he had been before, and at the time of purchase a citizen of the state of PA. 22 Feb 1808. 48. An act to convey lots in the town of Fanetsburg, Franklin county. Whereas WILLIAM M'ENTIRE, late of Metal twp., Franklin county, dec., died, seized of a tract of land, upon which he in his lifetime had laid out the town of Fanetsburg, and had constructed for the sale of several lots, for which he had not made deeds of conveyance, and several purchasers have made valuable improvements on their lots, and the sale of the lots are not recognized in the last will of M'Entire and one of his sons and devisees has long since left the country, and one other son is in his minority, therefore, ARCHIBALD S. M'CUNE of the town of Fanetsburg, Franklin county, JAMES M'CURDY and JOHN WALKER, of Metal twp., are hereby appointed commissioners, are hereby authorized to procure one or more patents in their own names, and in trust for the sons and devisees of William M'Entire, dec., for such part unpatented, and to execute deeds of conveyance for those lots to the purchasers who can produce a receipt signed by William M'Entire. 22 Feb. 1808. 49. An act for establishing and building a bridge across the river Schuylkill, near the falls. Whereas a number of the inhabitants of the city of Philadelphia, and of the counties of Montgomery, Delaware and Chester, state a bridge across the river Schuylkill would be beneficial to trade and the community, and as ROBERT KENNEDY and CONRAD CARPENTER, owners of the ground on both sides of the river are desirous to erect a bridge, at their cost and to receive tolls, therefore it shall be lawful for Robert Kennedy and Conrad Carpenter to erect and maintain a bridge across the river. 22 Feb 1808. 51. An act to complete the Powder Magazine of the state, in Philadelphia county. Whereas by an act passed 4 Apr 1807, commissioners were appointed to make sale of the powder magazine in the city of Philadelphia, and to erect two or more magazines for the deposit and keeping of gunpowder, and whereas they made sale and purchased a lot in the county of Philadelphia and proceeded to erect a building but have been arrested in the completion of the work for want of means, the proceeds of the sale in the city of Philadelphia, and not having yielded an adequate sum, therefore, the sum of$5000.00 is hereby appropriated to complete the magazine mentioned, and a warrant drawn in favor of THOMAS LEIPER, JOHN DUNLAP, MATTHEW SHAW, STEPHEN DECATUR and JOHN SINGER, commissioners. 52. An act to raise by lottery, money, for the purpose of building a meeting house in the borough of Chambersburg, Franklin county. That CHRISTIAN WOLFF, EDWARD CRAWFORD, DANIEL SMITH, JOHN HOLLADY, JACOB SNIDER, JOHN CALHOUN, FREDERICK RHEMOR and ANDREW DUNLOP, are hereby appointed commissioners, to raise $5000.00 towards building a German Reformed Calvanist Church in the borough of Chambersburg, Franklin county. 25 Feb 1808. 53. An act to enable guardians of minor children to sell and convey real estate. Whereas SETH PANCOAST, late of Marple twp., Delaware county, died intestate, seized of a messuage plantation and tract of land, leaving a widow and four children, that there are not sufficient assets to pay his debts and provide for the education of his children, therefore, ISRAEL ROBERTS, JOHN OGDEN and WILLIAM LEVIS JR., guardians of the minor children of Seth Pancoast, are hereby empowered to sell and convey the messuage and tract of land, bounded by lands of SAMUEL PANCOAST, ELISHA WORREL, ELIZABETH MARIS and JOSEPH RHOADS, containing 95 acres, and make a deed to the purchaser, and the money arising from the sale to pay all legal demands against the estate and the residue shall be placed out at interest for the benefit of the heirs. 14 Mar 1808. 55. An act to enable persons to sell and convey a messuage and lot. Whereas the late JOHN KEBLE, by his last will and testament, devised St. Paul's church, in the city of Philadelphia, a messuage and lot of ground, for the use of aged widows, of the church, and as the house is remote from the church, and not adapted for the use it is intended, therefore, RICHARD NORTH, LEVI HOLLINGSWORTH, PLUNKET F. GLENTWORTH, JOHN MATHEWS and JOHN VALANCE, members of St. Paul's church, in the city of Philadelphia, are hereby authorized to sell and convey to a purchaser the messuage and lot, situated on North Pearson's court, and invest the money in other real estate for the same use. 21 Mar 1808. 56. An act to enable administrators convey lots of ground. Whereas PETER ANKENY, late of Somerset county, dec., owner and proprietor of part of the town of Somerset, did sell and contract to convey to sundry persons, several lots situate in the borough, of which there is no written evidences and it appears all or part of the purchase money has been paid to Peter Ankeny, therefore, ROSINA ANKENY, MICHAEL HUGUS and ABRAHAM MILLER, administrators of the estate of Peter Ankeny, dec., are hereby authorized by deed to convey and release to the purchasers of the lots in Somerset town deeds upon proof of the purchase money paid. 21 Mar 1808. 57. An act to authorize the raising by lottery, a sum of money to finish a church in the town of Columbia, and to debts contracted in building the same. That PHILIP SNYDER, ADAM FANDERALL, JACOB KLINE, JACOB COMFORT, GEORGE SCHNEIDER, JOHN HOUTZ, JOHN BARBER, JOHN MATHIOTT, ADAM OTSTOT, CASPER SCHNEIDER and JOHN EERLIEN, are hereby appointed commissioners to raise by lottery $4000.00 for the Lutheran and Calvinist church, Columbia twp., Lancaster county. 21 Mar 1808. 60. An act to authorize administrators to convey land. Whereas GEORGE KERL, late of Manheim twp., York county, dec., sell unto WILLIAM YOUNG, a lot of land being part of the plantation on which the deceased lived containing 6 acres and 1.5 perch, for the sum of 121 pounds, seven shillings and six pence, but there is no written evidence of the agreement, nor receipt for the payment, yet part of the payment has been paid, therefore, JACOB RUDISELL and George Kerl, administrators of George Kerl, dec., are hereby authorized to make and execute a deed of conveyance to William Young, for the right and title to the lot of land, in Manheim twp., York county. 21 Mar 1808. 61. An act granting a annuity to THOMAS SNOWDEN. Whereas Thomas Snowden, now a citizen of Montgomery county, and late a sergeant in the 9th PA. regiment, enlisted early in the year 1776, in the army of the United States for one year, in CAPTAIN SAMUEL BENNEZETT's company 5th regiment of PA troops commanded by COLONEL M'GAW, that at the expiration of that term he enlisted in CAPTAIN THOMAS B. BOWEN's company, 9th PA regiment commanded by COLONEL RICHARD BUTLER, and continued in the service to the conclusion of the war, that on 28 Jun 1778 at the battle of Monmouth in New Jersey, he was wounded by a musket ball in his ancle which has disabled him from procuring a livihood for himself and his family, therefore, the sum of forty dollars is hereby granted to Thomas Snowden, and an annuity of forty dollars for his use, to be paid to HIRAM M'NEILL of Montgomery county, to commence the 1 Jan 1808, to be expended on clothing and diet for Thomas Snowden. 21 Mar 1808. 62. An act for relief to JAMES WATERS, a soldier during the Revolutionary war. Whereas James Waters, a soldier in the PA line received three wounds, of the effect of which, combined with age, have rendered him unable to maintain himself by labor, therefore, the state treasurer is required to pay to WILLIAM BOYD ESQ,, of Lancaster county, the sum of forty dollars, and an annuity of forty dollars for the use of James Waters, to commence from 1 Jan 1808, and to be paid half yearly to provide clothing, diet and lodging for James Waters. 21 Mar 1808. 65. An act to raise by lottery, a sum for the purpose of erecting a schoolhouse, in Mayerstown, in Dauphin county. That GODLIEB KINTZLY, JOHN BATDORF, HENRY HOEKLY, PETER SHULZE, PETER SPANGLER, PHILIP BREIDENBACH, HENRY HILGER and HENRY KOPPENHAFER, are hereby appointed commissioners to raise $2000.00. 21 Mar 1808. 66. An act for discharging sureties. Whereas the commonwealth have had a lien on the estate of JONATHAN PENROSE, dec., late sheriff of the city and county of Philadelphia, of $3100.00 for court fines, which sum has been since discharged by his sureties, but there is still due a balance of interest amounting to $311.00, and as it appears that ANN PENROSE, widow of the deceased, did with him convey her own estate as the interest she had in that of her late husband's to his sureties, for the discharge of all demands had against him, and in consequence is in a very reduced situation, therefore, the sureties of Jonathan Penrose, dec., late sheriff are hereby discharged from the payment of $311.00. 24 Mar 1808. 69. An act to exonerate the real estate of ADAM NEES, dec., from a lien which the commonwealth is supposed to have on the same. Whereas it appears an action was brought by ANNE HENRY treasurer of Lancaster county, for the use of the commonwealth against JOSEPH GEHR, a delinquent collector of Cocalico twp., and that Gehr was arrested and Adam Nees became his bail, that judgement was obtained against Gehr, that a capias ad satisfacendum was issued, and Gehr arrested and put to prison, whereby Adam Nees became exonerated, by mistake Adam Nees paid to the treasurer 604 pounds, eleven shillings and nine pence, and on a settlement had a credit for the balance as an insolvent debt due from Joseph Gehr, by some means or other the judgement remains on the docket as unsatisfied against the real estate of Adam Nees, dec., therefore, the real estate of Adam Nees dec., is hereby exonerated from the lien of the judgment in the court of common pleas of Lancaster county, wherein Anne Henry, treasurer of Lancaster county, is plaintiff, and Joseph Gehr and Adam Nees, are defendants of the Feb. term, 1788. 24 Mar 1808. 70. An act granting an annuity to CHRISTIAN SHOCKEY. Whereas Christian Shockey, now an inhabitant of Southampton twp., Somerset county, enlisted as a soldier during the war, in CAPTAIN SAMUEL HEARLY's company, and was attached and drafted into CAPTAIN GEORGE CLAYPOOLE's company, in the 11th PA regiment commanded by LIEUTENANT-COLONEL HUBLEY, and from thence was transferred to the third PA regiment, commanded by COLONEL THOMAS CRAIG, and thence from said company to CAPTAIN WILLIAM HENDERSON's company, and from thence to CAPTAIN JOHN DOYLE's company, and continued to the end of the war in the latter company, that he received a wound in his left arm at the siege of Yorktown, VA, in defence of his country, that he is advanced in age, and from the effects of the wound not able to maintain himself and family, therefore, the state treasurer is hereby authorized to pay to ALEXANDER OGLE, forty dollars, to be applied to the use of Christian Shockey, and an annuity of forty dollars be granted to Christain Shockey, to be paid half yearly, to Alexander Ogle of Somerset county, to commence from 1 Jan 1808, to provide clothing, lodging and diet for Christian Shockey. 24 Mar 1808. 71. An act incorporating the Roman Catholic congregation of Christ church, in the borough of Westchester, Chester county. Whereas JOHN HANNUM late of the borough, and ALICE HANNUM his wife, by their indenture bearing date 28 Mar 1793, did convey to STEPHEN MOYLAN, ANTHONY HEARN, MARK WILCOX, DANIEL FITZPATRICK, PETER M'GURK, EDWARD M'CLOSKEY, LEWIS JENKINS and JACOB WISINBURG, a lot of land situate in the borough of West Chester, late Goshen twp., Chester county, containing 40 perches, in trust for the use of the congregation of the Roman Catholic church, and in consequence of the death of some of the trustees, therefore, REV. PATRICK KENNY, clergyman of the church, ANTHONY HEARN, Mark Wilcox, CHARLES KENNY, and JOHN M'LAUGHLIN, present trustees, are hereby constituted a corporation and body politic. 24 Mar 1808. 72. An act to authorize the commissioners of Northampton county to affirm a contract made with JACOB STROUD. Whereas in the year 1798, the commissioners made a contract with JOHN STROUD, to build a stone bridge over Jones' creek, in Lower Smithfield twp., the first payment was received by John Stroud, the bridge was built and fell as soon as completed, owing to bad quality of stone, though the best the county for some miles afforded, that two of the commissioners for 1805 convinced, that materials for erecting a durable stone bridge could not be had in the neighbourhood, made a parol agreement with Jacob Stroud, (to whom John Stroud had assigned his contract) for the erection of a wooden bridge, with stone abutments, and to pay the amount the bridge should cost, after deducting the sum paid to Jacob Stroud, but the subsequent commissioners have declined to recognize the contract of 1805, that Jacob Stroud is since deceased, and the materials collected, are in the hands of his executors JOHN STARBIRD, JAMES HOLLINSHEAD and PETER HOLLINSHEAD, in a perishing condition, and application was made to the court in November 1807, for relief in the premises, but without effect, therefore, the commissioners of the county of Northampton are hereby authorized to recognize and affirm the parol contract with Jacob Stroud, as assignee of John Stroud. 24 Mar 1808. 73. An act to incorporate a company for making a road from the city of Philadelphia, by Chad's ford on Brandywine to the line of the state towards Baltimore. That EDWARD TILGHMAN, WILLIAM LEVIS and JOSEPH LOWNES, of the city of Philadelphia, MARK WILLCOX, WILLIAM TIMBLE, and CALEB LOWNES, of the county of Delaware, AMOS HARVEY, JAMES KELTON and JOHN in MENOUGH, of the county of Chester, are hereby appointed commissioners. 24 Mar 1808. 78. An act to establish a public ferry on the north side of the West Branch of the Susquehanna river, in Lycoming county. That MARTIN UPDEGRAFF, shall have the right at his own costs to make a convenient landing on the estate of Martin Updegraff, situate on the great road leading from the town of Dunnsburg, (laid out on the land of Updegraff,) above the head of the great Island, to JOHN MYER's in Lycoming county. 26 Mar 1808. 81. An act granting a sum of money to ELIABETH BUCH, otherwise (ELIZABETH) PUGH, for services rendered by her late husband in the Revolutionary war. Whereas JOHN BUCH, otherwise JOHN PUGH, late of Lancaster county, dec., served his county for several years in the late revolutionary contest, and that for five months which he served in CAPTAIN JACOB LIVEGUTH's rifle company, in the winter of 1781, and 1782, neither the deceased nor his family have ever received any compensation, therefore, the state treasurer is authorized to pay to Elizabeth Buch, otherwise Pugh, widow of John Buch, otherwise Pugh, dec., the sum of forty dollars. 26 Mar 1808. 87. An act authorizing administrators to convey a lot of land. Whereas, by the petition of ELIZABETH HEVERSTRITE and THOMAS SHOEMAKER, administrators to the estate of JONAS HAVERSTRITE, dec., that the deceased sold to GEORGE WUNDER, a lot of land in Abington twp., Montgomery county, of about 7 acres, with appurtenances on which George Wunder made considerable improvements, but Jonas Haverstrite, died intestate, before executing a deed of conveyance to the purchaser, and no article of agreement being signed by the parties, therefore, the administrators are hereby authorized to make and execute a good and sufficient title to George Wunder. 26 Mar 1808. 88. An act declaring a marriage null and void. Whereas SAMUEL HAMM, of York county, was by duress and intimidation, under the semblance and colour of legal authority, and without his free and voluntary consent induced to enter into a marriage contract with MARY BEERBROWER, with whom Samuel Hamm, utterly refused to live after marriage, therefore, the marriage of Samuel Hamm and MARY HAMM, is hereby declared void and annulled and the parties declared to be separate and free from the matrimonial contract, and all duties as fully as if they had never been joined in matrimony. 26 Mar 1808. 90. An act declaring the Little Juniata river, in Huntingdon county, a public highway. That the Little Juniata river from Logan's Narrows, to the mills of EDWARD BELL, in Allegheny twp., Huntingdon county, are declared a public highway. 26 Mar 1808. 92. An act to empower executors to purchase a tract of land in trust. Whereas, PAUL WILT late of Dover twp., York county, by his last will devised and bequeathed the fifth part of real and personal estate to his daughter MARIA WELDY, intermarried with PHILIP WELDY, and declared if Philip Weldy should die before his wife, then she should have the share, but if she should die before him, then her children should have their father's share, thereby the executors are impowered to retain the share of personal estate, amounting to 280 pounds without paying interest, until the contingency, upon which the legacy is to be paid, shall happen by the death of Philip or Maria, and it is wished that the executors purchase lands, in trust, therefore, JOHN WILT and GEORGE SHETTLE, executors are hereby impowered to invest the money involved, in the purchase of land, to be held in trust. 26 Mar 1808. 95. An act to dissolve a marriage contract. Whereas RUTH KERR, of Washington county, in the year 1785 she married ALEXANDER KERR, with whom she lived in a miserable situation (being often beaten and her life frequently threatened) until the year 1803, when Alexander Kerr deserted her, with four small children, and has not afforded her any subsistence, and though Ruth might possibly obtain a divorce by application to the court, yet she is unable, by reason of poverty, to pay the expences and therefore, the marriage of Alexander Kerr and Ruth Kerr is hereby annulled and are hereby set free from all duties as fully as if they had never been joined in matrimony. 26 Mar 1808. 98. An act confirming the title of JAMES ROBESON to lands. Whereas James Robeson of Washington county, is a native of Ireland, and that he arrived in this state 14 Aug 1791, with an intention of residing therein, and in Sep 1798, he purchased 171 acres of land of DAVID BRADFORD ESQ., situate on the Head waters of Wheeling creek in Finly twp., Washington county, bounded by land of JAMES STEVENSON and other lands of David Brdford Esq., now of LEWIS MORRIS, land of ______ SHAW, and lands of ROBERT ROBESON, and received a deed of conveyance dated 4 Sep, and on the 22 Nove 1805 purchased and received a deed of conveyance from James Stevenson, for 86 acres, adjoining the first tract of land, and lands of JAMES COOPER, MANNING MARTIN and DAVID GIBSON, and has been in possession, and resided on the first tract, since the purchase, and as he was unacquainted with the laws relative to aliens purchasing and holding lands and has since become a citizen of the United States according to the laws, therefore, the above tracts with appurtenances acquired by James Robeson, shall remain as firm and valid in law to all intents as if he had previously taken an oath and declared his intention to become a citizen. 26 Mar 1808. 100. An act for the establishment and regulation of election districts. That Belfast twp., Bedford county is hereby elected into a separate election district, and the electors shall hold their elections at the house now occupied by AARON CLEVINGER. That Harford twp., Luzerne county, is hereby erected into a separate election district and the electors shall hold their elections at the house now occupied by HOSEA TIFFENY ESQ. That part of Dublin twp., Bedford county, that lies within the Great Cove, beginning at the division line near the narrows south of CHRISTIAN WAGONER's, to the Scrup Ridge Mountain to include MATHIAS AMBROSURE's farm, is hereby re-annexed to M'Connelstown election district, and the electors shall hold their elections at the house now occupied by JACOB FORE in M'Connelstown. That Abington twp., Luzerne county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by ROBERT STONE in Abington. That Mountpleasant twp., Washington county, is hereby erected into a separate election district and the electors shall hold their elections at the house now occupied by SAMUAL MILLER, innkeeper in the town of Mountpleasant. That Bridgewater twp., Luzerne county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by EDWARD FULLER on the post road leading through the township. That the inhabitants of the 7th election district in Northumberland county, composed of Bloom and Brier creek twps., shall hold their elections at the house now occupied by DAVID WHITMIRE in Brier creek twp. That Canaan twp., Wayne county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by JOHN SHAFFER. That the electors of Brookenstraw and Union twps., district #10, Erie county, shall hold their elections at the house now occupied by WILLIAM CARSON. That the electors of Fairview twp., district #3, Erie county, shall hold their elections at the house now occupied by JONATHAN BARKER. That the electors residing in Willingsborough district, Luzerne county, shall hold their elections at the house now occupied by JOSIAH STUART at the Great Bend Ferry. That St. Clair twp., Bedford county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by THOMAS VICKROY. That Bart twp., Lancaster county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by NATHAN THOMPSON innkeeper. That the whole of Elk lands twp., and part of Shrewsbury twp., north of the Allegheny mountain, Lycoming county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by WILLIAM MOLYNEUX, at the forks of Loyalsock creek. That part of Lycoming county, to be called Cliftsburgh district, and the electors shall hold their elections at the house now occupied by JOHN CUMMINGS. That Venango twp., Erie county, is hereby erected into a separate election district and the electors shall hold their elections at the house now occupied by JOHN YOST. That Washington twp., Fayette county, is hereby erected into a separate election district, and the elections shall hold their elections at a stone school house on JOHN SHREVE's land. That Solebury twp., Bucks county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by JOHN RUCKMAN. That Indiana twp., Allegheny county, is hereby erected into a separate election district, and the electors shall hold elections at the house now occupied by HENRY STROME. That Armstrong twp., Indiana county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by DAVID M'COLLOUGH. That Allegheny twp., Somerset county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by HENRY IMHOFF at the foot of Allegheny mountain. That the place of holding the elections in Conemough district, Cambria county, is hereby removed from the house of JOHN HORNER JR., and now shall hold their elections at the house now occupied by JOHN GROSENICKEL. That Beccaria and Bradford twps., Clearfield county, all part of Halfmoon twp. which lyeth west of Allegheny Mountain, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied byl JOHN GYERHART. That Upper Paxton twp., Dauphin county, shall be divided, etc.,thence to the house of JOHN HAPPLE ESQ., on Mahantango Mountain, the electors shall hold their elections at the house now occupied by HENRY MACK, and the electors of the upper district shall hold their elections at the house now occupied by JACOB SNYDER. That part of Bethel twp., Dauphin county, east of the road leading from Union Forge, etc., shall hold their elections at the house, now occupied by JACOB RUTY in Stumpstown, Bethel twp. That Versailles twp., Allegheny county, is hereby erected into a separate election district, and electors shall hold their elections at the house now occupied by WILLIAM SHAW SEN. That Potter twp., Centre county, is hereby erected into a separate election district, and shall hold their elections at the house now occupied by JOHN BENNER. That Feerguson twp., Centre county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by DAVID NICHOLSON. That Conewango twp., Warren county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by DANIEL JACKSON in the town of Warren. That Richland twp., Venango county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by ALEXANDER M'DONALD. That New London and London Britton twps., Chester county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by JOHN MENOUGH at New London, Cross Roads. That the town of Wysox, Luzerne county, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by AMOS MIX. That Buckingham twp., Wayne county, is hereby erected into a separate election district and the electors shall hold their elections at the house now occupied by SAMUEL PRESTON ESQ. That Bensalem twp., Bucks county, shall form an election district, and the electors shall hold their elections at the house now occupied by JOHN JOHNSTON, in Bensalem twp. That the act annexing part of Northumberland county to the county of Luzerne county, that Nescopeck mountain is the boundary line, is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by JAMES CAMPBELL. That Pymatuning twp., Mercer county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by GODFREY KAERNS. 28 Mar 1808. 102. An act granting ROBERT HUNTER an annuity for life. Whereas ROBERT HUNTER of Huntingdon twp., Westmoreland county, served as a private soldier in CAPTAIN JOHN FINDLEY's company, in COLONEL M'COY's regiment, and at the skirmish of Boundbrook, he received a slight wound in one of his legs, which became incurable, and it further appears that he met with a severe accident at the Paole, in crossing a fence in a retreat from the enemy, which occasioned a rupture, which has so much increased, that he cannot enjoy the benefit of a truss in this situation, therefore, the sum of forty dollars is hereby granted to ROBERT HUNTER of Westmoreland county, and Huntingdon twp., to be paid immediately, and an annuity of forty dollars for life to be granted for the use of Robert Hunter, from the 1 Jan 1808, half yearly, to provide clothing, diet or other necessaries. 28 Mar 1808. 103. An act to authorize the sale of real estate. Whereas JAMES COSTILLOE, late of the city of Philadelphia, dec., by his last will and testament, devised all his real estate consisting of two lots of meadow ground, containing 20 acres, situate on Boon's island, in Philadelphia county, in trust to his executors, REDMOND BYRNE and JOHN CARRELL, of Philadelphia city, and directed them to lease the lots to persons approved by the church of St. Mary's in Philadelphia, and pay over rents to the trustees, but the property is not productive, therefore, the executors are hereby authorized to sell and convey the real estate devised, and make a good deed to the purchasers, and to purchase other real estate in the city, more productive. 28 Mar 1808. 104. An act annexing part of Northumberland county to the county of Luzerne. An act for the relief of JOHN M'CONAHEY. That John M'Conahey, is hereby allowed the sum of sixty-four dollars. 28 Mar 1808. 107. An act for the relief of MARY BACKHOUSE. Whereas RICHARD BACKHOUSE, late of Bucks county, purchased in 1779 and 1780, several tracts of land in Bucks county, of GEORGE WALL, the commissioner of confiscated estates, for the natural life of JOSEPH GALLOWAY, and whereas Mary Backhousse, widow and relict of Richard Backhouse, was evicted from the tracts by a judgemnet of the supreme court, and in the lifetime of Galloway, that after the judgement an action was commenced against Mary Backhouse for mesne profits, and a verdict given for the same together with costs of suit, therefore, the governor is hereby authorized to draw a warrant in favour of Mary Backhouse, for $415.00. 28l Mar 1808 108. An act to afford relief to ALBRIGHT WEAVER, a soldier, during the Revolutionary war, and to grant him an annuity. Whereas Albright Weaver, a soldier in the PA line, received a wound in the right hand at the battle of Brunswick, which had rendered him unable to maintain himself by labour, therefore, the state treasurer is authorized to pay JOHN DORSEY of the city of Philadelphia, for the sum of forty dollars, and an annuity of forty dollars for the use of Albright Weaver, to commence from 1 Jan 1808, to be paid yearly. 28 Mar 1808. 110. An act to afford relief to MICHAEL DRURY, a soldier in the revolutionary war, and to grant him an annuity. Whereas Michael Drury, now an inhabitant of Turkey-foot twp., Somerset county, enlisted as a soldier in CAPTAIN JOHN CHRISTY'S company, for the war, and continued until he was rendered unfit for service by a hurt in his head, which occasioned a deafness that still continues, and he is now very old and unable to maintain himself by manual labour, therefore, the state treasurer is hereby to pay Michael Drury, forty dollars, and an annuity of forty dollars for the use of Michael Drury, to be paid to THOMAS WILSON, of the county of Somerset, to commence on 1 Jan 1808. 28 Mar 1808. 114. An act to dissolve the marriage of JACOB MAYER and CATHARINE MAYER his wife. Whereas immediately after the marriage of Jacob Mayer of Leacock twp., Lancaster county, and Catharine his wife, and before consummation, an unaccountable antipathy and dislike on her part took place to her husband, which led her to separate from him, and her father to overcome her aversion and to reconcile her to her husband, there remains no prospect of reconciliation, therefore, the marriage of Jacob Mayer and Catharine his wife, is hereby annulled and are set free from all duties as fully as if they had never been joined in matrimony. 28 Mar 1808. 117. An act to prohibit the sale of lands for taxes upon which the state has a lien. That it shall be lawful for the commissioners of any county to sell for taxes, within two years any land late the property of JOHN NICHOLSON, purchased for the use of the commonwealth, or lands of PETER BAYNTON, upon which the state has a lien. 28 Mar 1808. 118. Whereas Edward Cavanough enlisted in CAPTAIN MATHEW SMITH's company of Riflemen, for one year, and marched to Boston in 1775, and from thence to Quebec, and after that severe tour of duty, he continued in the first regiment commanded by COLONEL EDWARD HAND, for two years, at the expiration of which time he was discharged on account of his ill health, and being afflicted with rheumatic pains, owing to old age and hard service he is not able to obtain subsistence by manual labour, therefore, the sum of forty dollars is hereby granted to Edward Cavanough, immediately, and an annuity of forty dollars to be granted for the use of Edward Cavanough, to THOMAS CAMPBELL, to provide clothing and diet. 28 Mar 1808. 120. An act to approve the report of commissioners appointed to explore and mark a road from where the Coshecton and Great Bend turnpike passes through the Moosic Mountain, to the west line of the state. That the report made by HENRY DONNEL, GEORGE HAINES, and JOHN FOSTER, and the report made by SAMUEL DALE, JOHN BOYD and FRANCIS KING, commissioners are hereby declared to be approved. 28 Mar 1808. 123. An act granting an annuity to JONATHAN GUY. Whereas Jonathan Guy was a sergeant in CAPTAIN VAN ZANT's company, 5th PA Battallion, commanded by COLONEL M'GAW, and he received a wound or wounds in the service of the United States, on the night preceding the capture of Fort Washington, in November 1776, and after being cured of his wounds, he enlisted in COLONEL WALTER STEWART's regiment, on 29 Apr 1778, and continued in the service until the expiration of the term of his enlistment, on 16 Jan 1781, and that from old age and an affection of the palsy, he is now unable to provide for himself a subsistance, therefore, the sum of forty dollars is hereby granted to Jonathan Guy, immediately, and an annuity of forty dollars for the use of Jonathan Guy, to be paid to JOHN WEBER, to commence from 1 Jan 1808, to be paid half yearly. 28 Mar 1808. 126. An act granting an annuity for the use of JOHN MALONEY. Whereas John Maloney of the borough of Lancaster, served as a soldier in the American army during the Revolutionary war with Great Britain, from June 1775 until Jan. 1781, and at the battle of Brandywine was wounded in the pubic service, by which together, with other injuries and hardships incident to military service, he has become incapable of bodily labour, and hath applied for relief, therefore the sum of forty dollars is hereby granted to be paid to John Maloney, immediately, and an annuity of forty dollars is granted for the use of John Maloney, to commence on 1 Jan 1808, to be paid half yearly to SAMUEL WHITE of the borough of Lancaster. 28 Mar 1808. 127. An act for the relief of the heirs of CHRISTOPHER WALTHOUR SEN., dec. Whereas it hath been represented by JOHN BRANDON, DOLLY WALTHOUR and MARTIN ASHBAUGH, administrators of the estate of CHRISTOPHER WALTHOUR JR., dec., and by John Brandon, CASPER WALTHOUR and JAMES IRWIN, who were appointed a committee to take care of the person and estate of CATHARINE WALTHOUR a lunatic, that Christopher Walthour Sen., of Westmoreland county, died intestate, leaving lawful issue six children, MICHAEL WALTHOUR, JOSEPH WALTHOUR, Catharine Walthour, Casper Wathour, BARBARA WALTHOUR, (intermarried with JOHN FITCHMAN), and Christopher Walthour Jr., seized in his demesne, to the following real estate in the county of Westmoreland, one tract of land containing 250 acres with a grist mill erected thereon, situate on Brush creek adjoining lands of JOHN IRWIN and others, also a tract of land containing 300 acres adjoining the other tract, also in Allegheny county, one other tract containing 334 acres, situate on the Allegheny river, called the lower tract, and also another tract of land containing 292.5 acres, called the upper tract adjoining the other tract. which five tracts being valued and divided into six shares, but previous to the execution of releases between the heirs of Christopher Walthour Sen., dec., Christopher Walthour Jr., died intestate, and Catharine Walthour became a lunatic, therefore, the administrators in behalf of the heirs and the representatives of Christopher Walthour Jr., and the committee for Catharine Walthour, are hereby authorized to execute releases. 28 Mar 1808. 129. An act for the relief of JOHN CAVENOUGH. Whereas John Cavenough enlisted early as a soldier in the revolutionary war, and faithfully served the term of his enlistment, and at the end thereof was honorably discharged, that at the battle of Brandywine, he received a wound in his left shoulder by a musket ball, in consequence of which he finds himself unable to support himself, therefore, an annuity of forty dollars is granted for the use of John Cavenough to be paid half yearly to THOMAS CAMPBELL of York county, to commence from 1 Jan 1808. 28 Mar 1808.
