LANE, Speaker of the Senate. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 2. An act for altering part of the state road, in Bedford county. That a state road beginning at the first run, crossing the state road in Bedford county, on the west side of BENJAMIN BURDS, thence west by the house now occupied by GEORGE DANSDILL, thence by the house of JOHN BURDS, to the house now occupied by MICHAEL WALLET, the distance of one and half miles is hereby laid out. 21 Dec 1812. 6. A supplement to an act to extend the powers of the Gettysburg and Petersburg turnpike company. That as soon as the road is laid from the court house in the borough of Gettysburg, to the German church on the lands of JACOB MIDDLEKAUFF, the governor shall appoint three persons to view it and report its workmanship, and once approved the company may erect a gate across the road. 22 Dec 1812. 8. An act for the relief of the heirs of MATTHEW SHAW, dec. Whereas by the act passed 1807, were to dispose of the powder magazine and lot in the city of Philadelphia, and with the proceeds purchase a more convenient site to erect a new magazine, and they did sell it and purchase a new lot, but finding the funds not sufficient and applied for more which were granted, but on the settlement of the accounts of Matthew Shaw, dec., one of the commissioners, it appeared a balance of $646.94 was due him, therefore, the keeper of the powder magazine, shall be required to demand and receive from the private owner all gunpower deposited in the magazine, in addition to sums now paid six cents for every cast of powder, and the keeper is to discharge the balance due Matthew Shaw dec., paid quartly. 22 Dec 1812. 9. An act authorizing MICHAEL FOX and SAMUEL FOX, administrators with the will annexed, of JOHN FOX, late of the city of Philadelphia, brickmaker, dec., to grant and convey real estate. That it shall be lawful for the administrators to grant and convey the real estate, of John Fox dec., as if they had been nominated and appointed executors of the will. 22 Dec 1812. 10. An act confirming the title of OLOF STROMBERG, an alien, to a messuage and lot in the borough of West Chester, Chester county. That the title of Olof Stromberg to a messuage and lot containing 25 perches, is hereby confirmed, so far as may be deficient on account of his being an alien at the time of the purchase of the lot. 22 Dec 1812. 12. An act to incorporate a company for making a road from the Spring House tavern, in Montgomery county, to the borough of Northampton, Lehigh county, and to the town of Bethlehem, Northampton county. That WILLIAM TILGHMAN, and PETER KNEPLAY, of the city of Philadelphia, JOHN ROBERTS, EVAN JONES, SILAS HOUGH, and JOHN WEAVER, of the township and county of Montgomery, SAMUEL SELLERS, ANDREW SLICHLER, and WILLIAM GREEN, of Bucks county, JAMES GREENLEAF, ABRAHAM RINKER, JACOB HARTZEL, and PHILIP WINT, of Lehigh county, GEORGE HUBER, and OWEN RISE, of Northampton county, are hereby appointed commissioners. 16 Jan 1813. 13. An act to annul the marriage of JESSE HOPKINS and SARAH HOPKINS. Whereas, Sarah Hopkins, late SARAH MEWHORTER, was lawfully married on 31 Mar 1806, to Jesse Hopkins, who has since the marriage, willfully deserted his wife, and is at present undergoing imprisonment at hard labor in the state prison at New York, for feloniously passing counterfeit bank notes, in pursuance of the judgement of a court held for Washington county, June last, therefore, the marriage contract entered into by Jesse Hopkins and Sarah his wife, both late of Northampton county, is hereby annulled and the parties set free from all duties as fully as if they had never been joined in marriage, provided that nothing shall be construed to render illegitimate any children born of the body of Sarah during her coverture. 16 Jan 1813. 14. An act for the relief of JOHN M'GILL, an old and wounded soldier of the revolutionary war. That the state treasurer pay unto John M'Gill, the sum of forty dollars, and an annuity of thirty dollars, to be paid half yearly during life. 16 Jan 1813. 15. An act declaring part of Marsh creek, Centre county, a public highway. That March creek from its confluence with Bald Eagle creek to JACOB BOONE's saw mill, being about 5 miles, is hereby declared a public highway. 16 Jan 1813. 16. An act to incorporate a company for making a road from the narrows at Big Eddey by Bethany, to the intersection of the Milford and Owago turnpike, with Clifford and Wilkesbarre turnpike, in Luzerne county. That MOSES THOMAS, ISAAC DIMMICK, JONATHAN JINNINGS, LEWIS COLLINS, NATHAN SCHINNER, EPHRAIM TORRY, of Wayne county, are hereby appointed commissioners. 21 Jan 1813. 17. An act to incorporate a company, to make a road from the Centre turnpike road, near the Bear Gap, to the northeast branch of Susquehanna, at the end of the Blue Hill, near Danville, Northumberland county. That LEWIS REESE and JAMES MAY, of Reading, DANIEL MONTGOMERY JR., and WILLIAM MONTGOMERY JR., of Danville, JACOB GEARHART, and JOHN JONES of Shamokin, BETHUEL VINCENT, and SETH IREDALE, of Milton, JOHN FUNSTON and JOHN FRUIT, of Derry, JACOB SHOEMAKER, and GEORGE WEBB, of Pennsborogh, and JOSEPH EVES, and RICHARD DEMOT, of Fishing creek, Northumberland county, are hereby appointed commissioners. 21 Jan 1813. 20. An act to enable the executors of WILLIAM BALL, dec., to release lots from the payment of rent charges. Whereas William Ball, late of the city of Philadelphia, died seized of divers yearly rents charge, issuing out of lots in the county of Philadelphia, extinguishable by the payment of sums of money mentioned in the deeds of conveyance of the lots, and the tenants are desirous to extinguish the same, therefore, JOSEPH BALL, JOHN HEWSTON, and JOSEPH L. INGLES, executors of the last will and testament of Willam Ball, dec., are authorized to execute releases of the rent charges to holders of lots, on the payment of the monies. 21 Jan 1813. 22. An ct granting to JOHN M'GOWAN a tract of land. Whereas, John M'Gowan, in 1776, entered the flying camp, and after serving an active tour of duty, was a volunteer in several engagements with the British, in one of which he lost his servant, and John M'Gowan settled on a tract of donation land by mistake, believing that it was vacant, and whereas it would be unjust and unreasonable to take the advantage of an old soldier, and deprive his of his land, therefore, the land office is hereby directed to issue a patent to John M'Gowan for a tract of donation land, whereon he now resides, #3, first district, containing 250 acres, surveyed at the expense of the state, upon his paying at the rate of 20 dollars per hundred acres, with interest from the date of his improvement, together with the fees of office. 21 Jan 1813. 23. An act enabling WILLIAM SHARPLESS, one of a committee appointed by the court of Chester county, to sell and convey a part of the real estate of WILLIAM SMITH, a lunatic. Whereas, in the court of common pleas, Chester county, William Sharpless was duly appointed one of a committee to that care of the person and estate of William Smith, a lunatic, and the incomes of his real estate are insufficient to pay the debts due and to provide for the future maintenance of himself, his wife and family, therefore, William Sharpless is hereby authorized to sell 35 acres of the real estate of William Smith, to be laid off at the north easterly corner of the tract, and make the purchaser a deed as will assure and convey to the purchaser all right and title, and the money from the sale is to be applied to debts and the maintenance of William Smith and his family. 21 Jan 1813. 26. An act for the relief of WILLIAM GILL, an old soldier. That the state treasurer pay unto William Gill, of Mercer county, the sum of forty dollars immediately, and an annuity of forty dollars, to commence 1 Jan 1813, to be paid half yearly during his life. 28 Jan 1813. 27. An act establishing an academy in the town of Franklin, in Venango county. The trustees of the Venango academy, WILLIAM MOORE, ALEXANDER M'DOWELL, JOHN M'DONALD, WILLIAM CONNELLY, GEORGE POWER, and ALEXANDER M'CALMONT, are declared one body politic and incorporate. 28 Jan 1813. 28. An act to incorporate a company, to make a road from the Anderson's ferry, Waterford and New Haven turnpike road, along Elbow lane or Pleasant alley, past HENRY SHARES' mill, thence through CHRISTIAN LEIB's lane, to the north end of two branches, to intersect the Lancaster, Elizabethtown and Middletown turnpike road, at the towns of Richland and Mount Joy. That HENRY SHARE, HENRY CASSEL, JACOB ROHRER, CHRISTIAN LEIB, JAMES MAHAFFEY, JAMES PATTERSON, GEORGE SNYDER, and JACOB GRAYBILL, are hereby appointed commissioners. 28 Jan 1813. 29. A supplement to an act raising, by lottery, a sum of $20,000.00 to be applied to the expenses of paving the streets in the borough of Lancaster, Lancaster county. Whereas, the act passed 9 Mar 1797, to raise money for the expense of paving the streets of Lancaster, by way of three lotteries has been drawn, and the funds expended, but some of the managers are now dead, and new ones are needed to complete the objects of the lottery, and to discharge sundry debts and expenses, therefore, JAMES HUMES, WILLIAM MONTGOMERY, EMANUEL REIGART, JOHN GUNDACKER, JOHN HOFF, SAMUEL WHITE, JONAS METZGAR, JOHN SWAR, CHRISTIAN HOOVER, JOHN BOMBERGER, BENJAMIN SHAUM, and ABRAHAM WITMER, are hereby added to the surviving managers, and they and the surviving managers are to devise a fourth class of lottery, for the sum of $5000.00 to complete the act of 1797. 28 Jan 1813. 31. An act to enable WILLIAM M'EWEN and DAVID WATSON, administrators of JOHN WATSON, dec., to convey real estate. Whereas WILLIAM LAMB, of the county of Centre, purchased from his step-son, John Watson, a tract of 100 acres, situate in Bald Eagle twp., Centre county, which was part of a larger tract, surveyed in pursuance of an application on the 3 Apr 1769 to PHILIP SMITH, and John Watson before his death, delivered the possession and acknowledged the receipt of purchase money, but the contract was not put in writing, therefore, William M'Ewen and David Watson, administrators are hereby authorized to carry the contract for the sale into full and complete effect, to grant and assure a good deed of conveyance of all right and title to the 100 acres. 28 Jan 1813. 35. An act enabling a committee appointed by the court of Westmoreland county, to sell and convey real estate of WILLIAM GUTHRIE, a lunatic. Whereas, William Guthrie of Westmoreland county, has been adjudged a lunatic and URIAH MATSON and THOMAS CULBERTSON were appointed a committee to take care of the person and estate, and the income of his estate is insufficient to pay the debts due and provide for his future maintance, therefore, the committee are hereby authorized to sell one seventh part of the real estate of William Guthrie, late of Derry twp., Westmoreland county, who died intestate, and to make and convey a deed to the purchaser. 4 Feb 1813. 36. An act to enable MARGARET ALLEN to hold real estate by her purchased in the county of Philadelphia. That Margaret Allen, is hereby enabled to have and hold as estate in the village of Holmesburg, Philadelphia county, which she has purchased, and all claims of the commonwealth to the estate by reason of her arrival in the United States since the revolution are hereby released. 4 Feb 1813. 37. An act to validate the official acts of JOHN CHRISTY, late a justice of the peace in Mercer county, and of GEORGE FOWLER and ALEXANDER M'DOWELL, justices of the peace of Venango county. That all the official acts of John Christy, late a justice of the peace for Allegheny county, preformed in and for Mercer county, are hereby confirmed and made valid as if he had been commissioned a justice of the peace for Mercer county. That all the official acts of George Fowler and Alexander M'Dowell, justices of the peace, for Crawford county performed in Venango county, are hereby confirmed and made valid as if they had been commissioned justices of the peace for Venango county. 4 Feb 1813. 38. An act to alter part of the state road laid out from the town of Butler to the town of Mercer. That part of the state road laid out from the town of Butler, to the town of Mercer, which lies between the 15 mile tree in Butler county, and WILLIAM M'MELLIN's farm in Mercer county, is vacated, and that part of the county road leading from the town of Butler to the town of Mercer, is hereby a part of the state road. 4 Mar 1813. 39. An act for the relief of CHARLES CAPPLE, and FRANCIS STACKHOUSE, of Bucks county, soldiers of the revolution. That the state treasurer is hereby directed to pay to Charles Capple and Francis Stackhouse of Bucks county, the sum of forty dollars each, immediately, and an annuity of forty dollars each, to be paid half yearly, during his lives, to commence the 1 Jan 1813. 4 Feb 1813. 40. An act for the relief of ARTHUR ST. CLAIR. That the state treasurer is hereby required to pay unto Arthur St. Clair, late a major general in the revolutionary war, the sum of $200.00 immediately, and an annuity of $200.00, to commence the 1 Jan 1813, to be paid half yearly during his life. 4 Feb 1813. 42. An act for the relief of GEORGE NAGLE. Whereas JOHN M'NAIR of Allen twp., Northampton county, PA., on 24 Sep 1779, purchased at public sale, of the agents appointed for the sale of confiscated estates, a tract of 189 acres and 99 perches, situate in Allen twp., which has since been vested in George Nagle, and George Nagle in Oct 1809, was evicted from the premises, by a title paramount in MARGARET DELANCY of the Kingdom of Great Britain, therefore, the state treasurer is hereby required to pay to George Nagle, $2313.09, as full compensation for all costs and damages sustained by being evicted from the tract of land, provided that any money that might be due the commonwealth by Negle, for M'Nair on mortgage granted to the commonwealth. 4 Feb 1813. 45. An act for the relief of JOHN BIOREN. Whereas by acts passed 28 Feb 1810, and 17 Jan 1812, the governor contracted with John Bioren, for the printing of Smith's edition of the laws, at the rate of $2.50 for each volume of 600 pages, and whereas the 5th volume contains 275 pages more then the contract required, therefore, he is to be compensated for the difference. 5 Feb 1813. 46. An act granting to JOHN VOGAN, a tract of land. That the land office is hereby authorized to issue a warrant and patent to John Vogan, for a tract of land #147, in the first district of donation land on which he now resides, upon his paying the rate of $1.00 per acre plus interest, together with fees and the officers of the land office are hereby required to take the number out of the wheel. 9 Feb 1813. 47. An to compensate CORNELIUS VANHORN, a PA claimant of lands in Luzerne county. Whereas Cornelius Vanhorn, a PA claimant of lot #20, in the manor of Sunbury, Luzerne county, has prosecuted his claim by ejectment in the circuit court and supreme court of the United States, and thereby established the title of this state to the lands in that county in opposition to what is called the Connecticut title or claim, therefore, the state treasurer is hereby directed to pay Cornelius Vanhorn, the sum of $2225.83, in full for lot #25. 9 Feb 1813. 48. An act to adjust and settle accounts of services for the militia. That the accountant officers are hereby authorized to settle and adjust the accounts of WILSON SMITH, quarter master general of this state, including the pay and rations, and all expenses of the militia employed in the defence of Erie, who had previously entered on service at the request of brigadier GENERAL JOHN KELSO, etc., 9 Feb 1813. 49. An act for the relief of old soldiers. That the state treasurer is hereby directed to pay unto CHARLES BISSON, of Montgomery county, the sum of forty dollars immediately, and an annuity of forty dollars, to be paid half yearly, during life, to commence to 1 Jan 1813. That the state treasurer is hereby directed to pay to JOHN COLMAN of Indiana county, the sum of forty dollars immediately and an annuity of forty dollars, to be paid half yearly, during life, to commence the 1 Jan 1813. 16 Feb 1813. 52. An act erecting parts of Dauphin and Lancaster counties into a separate county, called Lebanon. That beginning at the southeast corner of Dauphin where it intersects the Berks county line, about 4 miles from Newmanstown, through Lancaster county, to a sand stone house, formerly occupied by GEORGE WYMAN, on the great road leading from Shaefferstown to Elizabeth Furnace, thence to a house formerly occupied by _______ SHROYER, dec., on the great road leading from Lebanon to Manheim, thence to ______ SNYDER's mill on Conewago creek, thence to house of ______ HENRY, at the cross roads leading from Harrisburg to Reading, thence to Racoon creek on Blue or Kittatinny Mountain, to the Berks county line, to beginning is erected into a county, called Lebanon. 16 Feb 1813. 54. An act granting to JOHN RANKIN a tract of donation land. That the land office is hereby authorized to issue a warrant and patent to John Rankin, of Mercer county, for a tract of land on which he now resides, containing 200 acres, situate in the fourth donation district, and #706 in the plot of the district, for which he is to pay $1.00 per acre, with interest and the land officers shall take the number out of the wheel. 16 Feb 1813. 55. An act to incorporate The Society of Artists of the United States, by the name of the Columbian Society of Artists. Whereas a number of artists and other persons desirous of promoting the exercise of our own genius and industry, in the production of works of art, and of establishing schools for instruction, and also of creating a fund for the aid of decayed artists, and of the widows and orphans of deceased artists, wish to make a body corporate, therefore, THOMAS JEFFERSON, PAUL HAMILTON, GIDEON GRANGER, JOEL BARLOW, ROBERT FULTON, BENJAMIN H. An act authorizing ANDREW BOZORTH, and DOCTOR PHINEAS JENKS, executors of the last will and testament of HANNAH DYER, dec., to sell and convey a tract of land. Whereas Hannah Dyer, late of Northampton twp., Bucks county, dec., was seized of a tract of land, which by last will and testament did bequeath and devise, to Andrew Bozorth, SARAH DYER, and Doctor Phineas Jenks, to hold to them and their heirs, and whereas, the executors wish to sell and convey the share or interest SARAH DYER BOZORTH has in the land, therefore, the executors are hereby authorized to all the rights and title which Sarah Dyer Bozorth hath in the estate and convey a deed to the purchaser. 16 Feb 1813. 58. An act to appoint commissioners to lay out roads. That the road beginning at the Strasburg road near the house of JOHN G. PARKE, Chester county, leading over M'Call's ferry to the Maryland line, to the city of Washington, is hereby directed to be opened to the width of fifty feet. 18 Feb 1813. 61. An act granting an annuity to an old soldier. That the state treasurer is hereby directed to pay to JOHN SMITH, forty dollars immediately, and an annuity of forty dollars, to be paid half yearly, during life, to commence on 1 Jan last. 25 Feb 1813. 62. An act to incorporate the trustees of Hughesian Free School, in Buckingham twp., Bucks county. Whereas, AMOS AUSTIN HUGHES, late of Buckingham twp., Bucks county, in his last will and testament did give and devise to trustees a plantation with a considerable sum of money, and the residue of his personal estate, for erecting a school, therefore JOHN ELY, NICHOLAS AUSTIN, JOHN WATSON JR., WILLIAM ELY, THOMAS BYE, JOHN WILSON M.D., SAMUEL JOHNSON, JOSEPH SHAW, ISAIAH JONES, JOSHUA ANDERSON, JOSEPH WATSON, and STEPHEN WILSON, all of Buckingham twp., being trustees, are declared one body politic and corporate. 25 Feb 1813. 63. An act enabling RALPH EWART and ARCHIBALD EWART, of Greene county, aliens, to convey a tract of land to GEORGE REYNOLDS. That Ralph Ewart and Archibald Ewart, of Greene county, aliens, are hereby authorized by deed, to make and convey to George Reynolds a plantation called "Mountjoy" situate in Cumberland twp., containing 186 acres, adjoining lands of JAMES SEATON, THOMAS WRIGHT, PAUL DOWLAN and ROBERT WHITEHILL JR., which when conveyed, and the purchase money paid and recorded in law will vest to George Reynolds the land as fully as if Ralph and Archibald Ewart at the time of purchase and selling had been naturalized citizens of the United States. 25 Feb 1813. 64. An act for the relief of JOSHUA WILLIAMS, late a captain in the fourth PA. regiment. Whereas Johua Williams, late a captain in the fourth PA regiment, entered the service of his county, early in the year 1776, in the flying camp, and in 1778, and 1779, rendered essential service to GENERAL WAYNE, for which he never received any compensation, and whereas Joshua Williams is now old and infirm, and in indigent circumstances, therefore, The state treasurer is hereby directed to pay unto Joshua Williams, the sum of $100.00. 25 Feb 1813. 66. An act to incorporate a company to make a road from the court house in the borough of Lewistown, to ALEXANDER REED's in Kishacoquillas valley. That WILLIAM P. An act to enable JONATHAN BOWEN and THOMAS BLACKBURN, executors of THOMAS BOWEN, dec., to sell and convey tracts of land. That Jonathan Bowen and Thomas Blackburn, executors, are hereby authorized to sell and convey to the purchasers the following tracts, one containing 142 acres and 18 perches, bounded by lands of THOMAS PENROSE, THOMAS GRIFFITH, ANDREW ALLISON and JOHN GRIFFITH, and situate in St. Clair twp., Bedford county, also a tract containing 11 acres which both were purchased by the testor of ABRAHAM MOORE, and the proceeds for payment to the devisees. 25 Feb 1813. 68. An act establishing an academy in the borough of Beaver, Beaver county. That there shall be established an academy called the Beaver Academy, and the trustees are JAMES ALLISON JR., ROBERT MOORE, SAMUEL LAWRENCE, SAMUEL POWER, JAMES LYON, and JAMES DENNIS, in addition to JONATHAN COULTER, JOSEPH HEMPHILL, JAMES ALEXANDER, GUION GREER, and JOHN LAWRENCE. 25 Feb 1813. 69. An act to authorize the guardians of PHEBE WADHAMS and LYDIA WADHAMS, minors, and heirs of MOSES WADHAMS, late of Luzerne county, dec., to convey land. That as soon as FREEMAN THOMAS shall convey by deed, to ELLEN WRIGHT and NOAH WADHAMS, guardians of Phebe Wadhams and Lydia Wadhams, minors, and heirs of Moses Wadhams, in trust for the minors, 15 acres of the northwest corner of lot #52, in the first tier and fourth division lots, in Plymouth twp., and to convey to Freeman Thomas, the 15 acres. 25 Feb 1813. 70. An act to grant compensation for extra services. That if any militia now under the command of GENERAL WILLIAM HENRY HARRISON, shall agree to serve for a term of not more than two months from 1 Apr next, and provided they volunteer under the orders of the commander in chief of the north western army, a bounty of $12.00 per month shall be paid to each commissioned and staff officer, and also to each private, non commissioned officer and musician. 27 Feb 1813. 71. An act for the relief of PHILIP GLEIM, a sergeant in the revolutionary war. That the state treasurer is hereby authorized to pay unto Philip Gleim, of Dauphin county, the sum of forty eight dollars immmediately, and an annuity of forty eight dollars payable half yearly, during his life, to commence from 1 Jan 1813. 4 Mar 1813. 72. An act granting a tract of donation land to the legal heirs of FRANCIS MILLER, dec., a sergeant in the PA line. That the officers of the land office, are hereby directed to draw and patent to the legal heirs of Francis Miller, dec., a sergeant in the PA line, a tract of 250 acres of donation land, clear of the patenting fees. 4 Mar 1813. 74. An act vesting in the guardians and overseers of the poor for the city and county of Philadelphia, a burial ground on the west side of the Schuylkill near the upper ferry, for the use of the poor of the county. Whereas, a piece of ground on the west side of the Schuylkill, has been recognized as a burial ground from the earliest settlement of PA, and which appears to be the property of this commonwealth, and as the guardians of the poor have no place for the interment of poor persons as may die under their care, therefore, the right and title of the commonwealth to the tract of land mentioned, bounded by lands of ELIZABETH POWELL, and others, beginning at a corner of Elizabeth Powell's, or ______ BINGHAM's land, containing about 2 acres and 22 perches, is hereby vested in the guardians and overseers of the poor, in trust, as a burial ground. 4 Mar 1813. 75. An act to incorporate a company for making a road from the town of Manheim to the town of Richland, to meet New Haven street, at the point where the same intersects the Lancaster and Middletown turnpike in Lancaster county. That JOHN ROHRER, GEORGE MYERS, CHRISTIAN LIPE, JACOB ERISMAN, HENRY STICKLER, CHRISTIAN METZ, DAVID CASSEL, SAMUEL ENSMINGER, and CHRISTIAN METZ JR., of Abraham, of Lancaster county, are hereby appointed commissioners. 4 Mar 1813. 76. An act establishing two public schools in the county of Wayne. The Delaware academy, JOHN COOLBAUGH, GEORGE W. NICE, and DAN DIMMICK, and for the Beach woods Academy, SAMUEL STANTEN, ABISHA WOODWARD, and SETH GOODRICH, are commissioners and the trustees of the Delaware academy are JOHN NICE, DANIEL JAYNE, JOHN WESTBROOK, JOHN LATTIMORE and MATTHEW RIDGWAY, and for the Beach woods Academy, JOSEPH TANNER, SILAS KELLOG, ISAAC DIMMICK, JOSEPH WOODBRIDGE and JASON TORREY. 4 Mar 1813. 77. An act to refund any monies received from the estate of THOMAS GALLAGHER, dec. That the sum of money paid into the state treasury on account of the loan office, of $1793.00 by the treasurers of Mifflin county, which was received from the estate of Thomas Gallagher, dec., which was intended by the act of 6 Mar 1812, to be relinquished to the estate, is hereby refunded to LYDIA GALLAGHER, administratrix, of the late Thomas Gallagher, dec., for the use of herself. 4 Mar 1813. 79. An act granting to MATTHEW KNOX two tracts of donation land. That the land officers are hereby directed to draw and patent two tracts of donation land, containing 200 acres each, to Matthew Knox, of Montgomery county, formerly a lieutenant in the army of the United States, in the revolutionary war. 12 Mar 1813. 80. An act to erect the town of Orwigsburg, Schuylkill county, into a borough. The borough of Orwigsburg shall be bounded, beginning on a corner of the land of JACOB ORWIG, through lands of DANIEL STROHECKER, to a white pine stump on lands of PHILIP HEY, GEORGE KIMMEL, and company, to land of PETER FRAILEY, extending through lands of GEORGE HILLEGAS, through lands of Daniel Strohecker, ABRAHAM LANTZER, Jacob Orwig, WENDEL SEIP, George Kimmel, and JOHN KELLY, to beginning. 12 Mar 1813. 82. An act for the relief of JOSEPH HOLLAR. That the commissioners of Bedford county, are hereby authorized to settle the accounts of Joseph Hollar, for repairing the bridge over the Raystown branch of Juniata, on the state road west of the town of Bedford. 12 Mar 1813. 83. An act to confer on JAMES FLEMINGS, the younger, the rights and benefits of a child born in lawful wedlock. That James Fleming, the younger, a son of JAMES FLEMING SEN., and REBECCA FLEMING, late REBECCA OGLESBY, of Chester county, and born some time before the marriage of James and Rebecca Fleming, shall have all the rights and benefits of a child born in lawful wedlock, as fully as if he had been born subsequent to the intermarriage of his parents. 12 Mar 1813. 85. An act authorizing ANDREW SWEARINGEN, guardian of ELIZABETH TAYLOR, a minor, to sell a lot of ground. Whereas, an order of the orphans' court of Washington county, directing a partition of the real estate of GENERAL HENRY TAYLOR, dec. among the legatees, that the share which has fallen to Elizabeth Taylor, a minor, is in two parts, and at a distance from each other, one containing 22 acres, is unproductive, therefore, Andrew Swearingen, guardian of Elizabeth a daughter of HENRY TAYLOR, is hereby authorized to sell and convey the lot in Strabane twp., containing 22 acres, adjoining lands of JAMES MARTIN, JAMES LINN, and others, and apply the monies for the benefit and advantage of the minor by the purchase of other lands. 12 Mar 1813. 86. An act for the relief of JAMES SHIELDS, of Indiana county, an old soldier. That the state treasurer pay unto James Shields of Indiana county, the sum of forty dollars immediately, and an annuity of forty dollars to commence on 1 Jan 1813, to be paid half yearly during his life. 12 Mar 1813. 87. An act to confirm the title of ABRAHAM WALKER, to a tract of land in Bedford county. Whereas, Abraham Walker, on the 8th of Mar, 1811, not being at that time a citizen of the United States, nor having declared his intention of becoming a citizen. obtained a patent from the commonwealth, for 344 acres, and 154 perches of land situate in Belfast twp., Bedford county, adjoining land of ISAAC GRAY, HENRY DAVIS, and others, and whereas he has since declared his intention of becoming a citizen, therefore, the right and title of Abraham Walker to the tract of land is hereby confirmed and made valid, as if he had been a citizen at the time of purchase. 12 Mar 1813. 88. An act for the relief of ELIZABETH CURRENS, Chester county. Whereas, TIMOTHY CURRENS, late of East Nottingham twp., Chester county, died intestate and without issue or kindred, leaving a lot in the possession of Elizabeth Currens, his widow, and as the profits of the lot are insufficient for her support during her natural life, and one moiety thereof would escheat to the commonwealth at her decease, therefore, all right and title into any ways appertaining to the messuage, plantation or lot of 22 1/4 acres of land which Timothy Currens held in his life time is hereby vested in Elizabeth Currens. 12 Mar 1813. 89. An act enabling a committee appointed by the court of Westmoreland county, to sell and convey the real estate of CATHARINE WALDBOUOR, a lunatic. Whereas, Catharine Casper Waldhaur has been adjudged a lunatic, and CASPER WALDHAUR and JAMES IRWIN were appointed a committee to take care of the person and estate of Catharine Waldhaur, a lunatic, and as the income of her real estate is insufficient to pay the debts due, therefore, the committee are hereby authorized to sell the real estate of Catharine, lying in Allegheny county, containing 334 acres, and make to the purchaser a deed to convey to the purchaser all the right and title of the lunatic has in the real estate, and to apply the surplus in a productive fund for her support. 12 Mar 1813. 90. An act confirming the title of JOHN WILLIAMS, to lands. That the brick dwelling house, or tenement and lot or piece of ground, at the corner of Lombard and Delaware Eight street in the city of Philadelphia, which was conveyed 10 Sep 1810 by BENJAMIN POWELL and wife, to John Williams, of the city, a man of color, is hereby confirmed and the title shall remain as firm and valid as if he had been a citizen of the United States at the time of conveyance. 12 Mar 1813. 91. An act granting to JACOB WARNER, a soldier of the revolutionary war a tract of donation land. That the officers of the land office are hereby authorized and required to draw and patent, in the usual manner to Jacob Warner, a tract of donation land containing 200 acres, without fees. 12 Mar 1813. 94. An act granting a tract of donation land and a gratuity to HENRY YOUNG. That the officers of the land office, are hereby directed to draw and patent to Henry Young, of Washington county, MD., a tract of donation land, containing 200 acres, and the state treasurer is directed to pay to Henry Young forty dollars immediately. 12 Mar 1813. 96. An act to enable ALEXANDER MACK, guardian for the minor children of AGNESS MACK, dec., to sell and convey two tracts of land. Whereas, Alexander Mack, the elder, by his last will and testament devised 1/5 part of his real estate, 30 acres, situtated partly in Germantown twp., and partly in Springfield twp., in the counties of Philadelphia and Montgomery, unto Agness Mack, as tenants in common, and as Agness lately died intestate, leaving 9 children, three under the age of 21, and as by the records of the counties of Adams and Bedford, Alexander Mack was legally appointed guardian of the persons and estates of the three minor children, and it would be beneficial to the minors that the right and title should be sold with their brothers and sisters' parts, therefore, the guardian is hereby authorized to sell the two lots, and convey to the purchaser all rights and deeds and the proceeds be made good on real security for the benefit of the minors. 12 Mar 1813. 98. An act authorizing THOMAS FORSTER to convey a tract of land. That Thomas Forster, is hereby authorized to carry in full the contract made between JAMES M'CLURE, for the purchase of 75 acres in Mifflin twp., Lycoming county, with SAMUEL FIELDS and LOVIA FIELDS his wife, late LOVIA FORSTER, to grant to James M'Clure by deed all the right and title that Samuel and his wife Lovia, his wife, and their children DORCAS FIELDS, FORSTER FIELDS, SARAH FIELDS, SAMUEL FIELDS JR., JOHN FIELDS, DANIEL FIELDS, LOVIA FIELDS JR., RACHEL FIELDS, STEPHEN FIELDS, WILLIAM FIELDS, and FREEBORN FIELDS, shall have in the tract under the will of JAMES FORSTER, dec. 12 Mar 1813. 100. An act for the relief of ENOCH MORGAN, late a pay master in the revolutionary war. That the state treasurer is hereby directed to pay to Enoch Morgan, eighty dollars immediately, in full for services rendered in the revolutionary war. 12 Mar 1813. 102. An act for the further relief of JAMES PURDY. That the state treasurer is hereby directed to pay to WILLIAM CURRIN SEN., of Mifflin county, to be by him expended in providing clothes, diet and other necessaries for James Purdy, sixty dollars immediately. 22 Mar 1813. 103. An act authorizing the administrators of the estate of CASPER WIGHT, to convey a tract of land in Antis twp., Huntingdon county. Whereas, by the petition of JOHN BARLET that he purchased in partnership with Casper Wight, a tract of land called Rich Land, containing 312 acres, on the waters of little Juniata, in Antis twp., Huntingdon county, and whereas it appears the title by purchase was conveyed to Casper Wight, who since died intestate, and appears that the land was divided between the parties before the death of the intestate, and that Barlet has paid his full share of the purchase money, and it was the intention of the deceased to make him a title for the one half of the land, therefore, THOMAS WILSON and JACOB WIGHT, administrators of Casper Wight, dec., are hereby authorized to make and execute a good title to John Barlet, for the tract of land. 22 Mar 1813. 104. An act to incorporate a company for making a road beginning near JOHN GUTHRIE's on the Downingstown, Ephrata and Harrisburgh turnpike road, thence by GEORGE LIGGET's mill, thence by BARLEY SHEAF, thence near the Compass to NATHANIEL LIGHTNER's on the old PA. road, in Lancaster county. That JAMES HAMILTON, JACOB C. ELLMAKER, JOSEPH DICKESON, NATHANIAL F. LIGHTNER, BARTON HENDERSON and SAMUEL MARTIN, of Lancaster county, and ALEXANDER MAITLAND, BENJAMIN VASTINE, BARNARD VANLIER, JOHN UMSTEAD, JAMES GREEN and ISAAC REESE, of Chester county, are hereby appointed commissioners. 22 Mar 1813. 107. An act to incorporate a company to make a road from the town of Manchester, in the county of York, to intersect the York, Conewago, and Canal turnpike road, between the fifth and seventh mile stones. That GEORGE SMALL and ANDREW CRAMER, of York county, FREDERICK NAGLE, JAMES MEHAFFEY, MATTHIAS RANK, LEWIS LEADER, ABRAHAM ZUBLIN and HENRY CASSEL of Lancaster county, are hereby appointed commissioners. 22 Mar 1813. 111. An act confirming the title of a tract of land in Chester county to TACY FREEMAN. Whereas, JOSEPH FREEMAN, late of Chester county, dec., died possessed of a tract of land in Willistown twp., Chester county, bounded by land of JESSE MARIS, JOSHUA ASHBRIDGE, and DANIEL SINQUEST, containing 20 acres, and by the last will and testament of Joseph Freeman, he devised the tract to Tacy Freeman his wife, and it has been presented that he was not a native of the United States, and it cannot be ascertained that he ever was naturalized, therefore, Tacy Freeman is hereby enabled to hold to herself, a tract of land purchased by her late husband from DANIEL SINQUEST, as fully as if Joseph had been at the time of purchase, a citizen of the United States. 22 Mar 1813. 112. An act for the relief of SAMUEL LUCUS of Indiana county, and SAMUEL BURNS of Montgomery county, soldiers of the revolutionary war. That the state treasurer is hereby directed to pay to Samuel Lucus, of Indiana county, and Samuel Burns of Montgomery county, the sum of forty dollars each, immediately. 22 Mar 1813. 113. An act releasing to MARGARET DUNCAN the right of this commonwealth to an escheated estate. Whereas, ROBERT DUNCAN, late of the city of Philadelphia, dec., died intestate without issue or kindred, seized of real estate which is supposed to have escheated to the commonwealth, and whereas Robert left a widow, named Margaret, to whom the title should be released, therefore, all the right and title by escheat to the commonwealth, by reason of the death of Robert Duncan, to a messuage or tenement and piece of ground on Third Street and also a tract of land called Hope, situate in Upper Paxton twp., Dauphin county, beginning at corner of PETER WILLIS' land, by Machantango mountain, to corner post of MATHIAS DEIBLER's land, by PHILIP ROUSCULP's land, to beginning, containing 305 acres, is hereby released to Margaret Duncan, widow. 22 Mar 1813. 114. An act to authorize LEWIS RUSH to sell and convey a tract of land. Whereas, by the last will and testament of GEORGE MARSHALL, dec., dated 5 Nov 1798, he devised to the children of Lewis Rush of the city of Philadelphia, a tract of land situate in Roxborough twp., Philadelphia county, containing 110 acres, that the children are minors and the land unproductive, therefore, Lewis Rush of the city of Philadelphia is hereby authorized to sell and convey a piece of land which was by George Marshall, late of Montgomery county, devised to the children of Lewis Rush, to be sold and conveyed by him and invest the proceeds in some productive fund. 22 Mar 1813. 115. An act incorporating the trustees of Franklin school. That the trustees of Franklin school, Franklin twp, Greene county, are hereby erected into one body politic and corporate, and WILLIAM CRAWFORD, WILLIAM T. HAYS, ROBERT ADAMS, JACOB BALTZEL, ASA M'CLELLAND, NATHANIEL JENNINGS, BARNET REINHART JR., WILLIAM SEALS and ANDREW BUCHAN shall be the first trustees. 22 Mar 1813. 118. An act establishing an academy in the town of Athens, in Bradford county. The trustees to the Athens Academy are CLEMENT PAINE, GEORGE WELLES, JOHN FRANKLIN, JULIUS TOZER, STEPHEN HOPKINS, DAVID PAINE, JOHN SALTMARSH, JOHN SHEPARD, and ABNER MURRAY and are one body politic and corporate. 22 Mar 1813. 119. An act granting a tract of donation land to THOMAS LITTLE, a soldier in the revolutionary war. That the officers of the land office are hereby authorized to draw and patent a tract of donation land unto Thomas Little, of Franklin twp., Fayette county, containing 200 acres. 22 Mar 1813. 121. An act vesting the title of a piece of land in Conamaugh twp., Indiana county, in certain trustees, for the use of a school. That the officers of the land office are hereby authorized to issue a warrant, and title clear of purchase money and fees, for a piece of land containing 10 acres, adjoining lands of THOMAS SMITH, JAMES SMITH, NATHAN DOWTHAT, and JOHN HENERY, and John Henery, James Smith, and DAVID HUTCHESON, of Indiana county, in trust, for the erection of a school. 22 Mar 1813. 122. An act to enable JOHN CARLILE and GEORGE BRATTON, administrators of John Carlile, late of Mifflin coumty, dec., to convey a half lot of ground to WILLIAM CHRISWELL. Whereas, John Carlile in his lifetime, did sell unto William Chriswell, a house and half lot of ground, in the borough of Lewistown, for the sum of $800.00, and did receive a part of the purchase money, and William Chriswell is willing to pay the balance on receiving a deed of conveyance for the half lot and it also appears that John Carlile died intestate, leaving some of his children in their minority, therefore, the administrators are hereby authorized to execute a deed of conveyance to William Chriswell, according to the parole agreement. 22 Mar 1813. 125. An act enabling a committee appointed by the court of Bucks county, to sell and convey the real estate of ELIZABETH MARTIN, a lunatic. That JOHN BROWN and JOSEPH BROWN, are hereby authorized to sell the real and person estate of Elizabeth Martin, a lunatic, and make and execute to the purchaser a deed of conveyance and use the proceeds of the sale to pay her debts and provide for her support. 25 Mar 1813. 129. An act authorizing the trustees of the Christian church, in Centre twp., Northumberland county, and DANIEL HASSINGER, executor of JACOB HASSINGER, dec., to make conveyances. That it shall be lawful for Daniel Hassinger, surviving executor of Jacob Hassinger, late of Beaver now Centre Twp., to convey to the trustees of the United Lutheran and Calvinist Church, now Christian Church, a lot of land, containing 1 acre and 156 perches, for the trustees to convey to GEORGE HASSINGER, which they and Jacob Hassinger exchanged by verbal contract. 25 Mar 1813. 132. An act granting a tract of donation land to THOMAS VAUGHAN, an old soldier. That the officers of the land office are hereby directed to draw and patent a tract of donation land unto Thomas Vaughan, containing 200 acres. 25 Mar 1813. 133. An act for the relief of WILLIAM CAMPBELL. That the account department be authorized to settle the accounts of William Campbell, who acted as quarter master to a detachment of volunteer militia that marched to the frontier of this state, on an alarm that the Indians and British had in large numbers landed at Cleveland, immediately after the surrender of GENERAL HULL, and allow him what they think reasonable and just for supplying them with provisions, baggage waggons, forage and other necessary articles, furnished by him to the militia, which amount shall be paid by the state treasurer. 25 Mar 1813. 135. An act to dissolve the marriage contract of WILLIAM WASON, and JEMIMA WASON his wife. Whereas, William Wason, of Franklin county, and JEMIMA WILKINSON, were joined in marriage on 14 Feb 1811, and that at a court of quarter sessions for Franklin county, last Nov., she was convicted on two indictments for larceny, and is at present confined in the jail, therefore, the marriage contract between William Wason and Jemima Wilkinson is hereby dissolved, annulled and made void, and they are set free from all duties as if they had never been married, but nothing herein shall be construed to render illegitimate any child born of the body of Jemima during her coverture. 25 Mar 1813. 137. An act authorizing the trustees of New Providence congregation in Green county, to convey a certain tract of land to TIMOTHY SMITH. That ELIAS FLENNIKEN, JAMES FLENNIKEN, SAMUEL HARPER, SAMUEL HUSTON, ROBERT MORRISON, and ANDREW M'CLELLAND JR., trustees, are hereby authorized to convey a deed of conveyance a tract of land containing 133 acres, bequeathed to the congregation by the last will and testament of WILLIAM HALE, dec., situated in Cumberland twp., Greene county, bounded by lands of SAMUEL WRIGHT, REV. MOSES ALLEN, James Flenniken, and others, to Timothy Smith, and to place the purchase money at interest. 25 Mar 1813. 138. An act to encourage the introduction of steam boats upon the Susquehanna river. That the exclusive right of navigation the east branch of the Susquehanna, from Wilkesbarre to Tioga point, by the aid of fire or steam, is hereby granted unto JAMES BARNES of the borough of Wilkesbarre, for the term of fifteen years, provided Barnes shall have a steam boat of not less then 10 tons burthen in operation within 3 years. 26 Mar 1813. 139. An act authorizing a loan of money to CALEB JOHNSON, of the borough of Harrisburg. Whereas, Caleb Johnson has established a furnace in the borough of Harrisburg, for the purpose of casting hinges, weights, etc., which if properly prosecuted would be of great advantage to the citizens of the state, which for want of capitol, he is unable to do, therefore, the sum of $600.00 be loaded to Caleb Johnson, first giving bond with security for the repayment, with interest in 3 years. 26 Mar 1813. 140. An act granting donation lands to the widow and children of WILLIAM NOBLE, late a sergeant in the revolutionary war, and to ROBERT HAMILTON, an old soldier. That the officers of the land office are hereby required to draw and patent, to the widow and children of William Noble, late a sergeant in the revolutionary war, a tract of donation land containing 200 acres. That the land officers are hereby directed to draw and patent a tract of donation land, containing 200 acres, unto Robert Hamilton, an old soldier of the revolutionary war. 26 Mar 1813. 141. An act to enable WILLIAM BOOR and LEWIS ZERING, administrators of ADAM GREIGHER, late of Allen Twp., Cumberland county, dec. to convey a tract of land to PHILIP PIZEL. Whereas, Adam Greigher in his lifetime, did sell unto Philip Pizel, a tract of land in Monaghon twp., York county, containing 56 acres, that Philip Pizel is willing to pay on receiving a deed of conveyance, and as Adam Greigher died intestate, leaving some of his children in their minority, therefore, the administrators are hereby authorized to make and execute a deed of conveyance to Philip Pizel. 26 Mar 1813. 143. An act authorizing the guardians of the persons and estates of the minor children of THOMAS M'CREARY, dec., to convey and receive conveyance of land. That the guardians of the persons and estates of the minor children of Thomas M'Creary, late of Mercer county, dec., are authorized to execute a release to SAMUEL M'CREARY, for half of lot #1895, in the second district of donation lands on which Samuel improved and now lives, in Mercer county, and to receive on behalf of the heirs a release from Samuel, for the other half of the tract. 26 Mar 1813. 151. An act to authorize the guardian of the persons and estate of the minor children of JOHN JACOBS, dec. to convey a plantation. Whereas, John Jacobs, otherwise called JOHN YOUGHY, of Washington twp., Franklin county, dec., did purchase from CHRISTOPHER DULL, in behalf of DAVID JACOBS, the brother of John, as well as John, a plantation containing 222 acres and 115 perches, bounded by lands of FREDERICK HOWARD and ULRICH FREIDLY, and others, and did receive a deed of conveyance, and John and David did partition and divide the same between themselves, and possessed and occupied their respective parts, and that John and wife were always ready and willing to release to David the part possessed by him containing 100 acres and 15 perches, that John suddenly died intestate leaving issue, who are still in their minority, and the administration of John's estate was committed to David and the wife of John, and there is no written agreement between John and David, therefore, GEORGE COOK, guardian of the persons and estate of the minor children of John Jacobs, is hereby authorized by deed to convey to David Jacobs, a plantation containing 100 acres, 15 perches. 26 Mar 1813. 152. An act for the relief of old soldiers. That the state treasurer is hereby directed to pay to DENNIS DALEY, of Washington county, the sum of forty dollars. That the state treasurer is hereby directed to pay to JOHN M'MURDY of Washington county, the sum of forty dollars immediately, and an annuity of forty dollars, to commence 1 Jan last, to be paid half yearly during life. That the state treasurer is hereby directed to pay to JOHN HARRIS, of Lancaster county, forty dollars immediately, and an annuity of forty dollars during his life. 26 Mar 1813. 153. An act to enable MICHAEL CROW, administrator with the will annexed, of JOHN HUHN, dec., to sell and convey a tract of land. Whereas, John Huhn, late of Springhill twp., Fayette county, on 20 Oct, 1803, duly made and published his last will and testament, and therein did order his mills and plantation to be sold, but if he should die leaving a widow, then the mills and plantation were not to be sold during her lifetime, that he did die leaving no widow, and not naming an executor, thus Michael Crow was appointed, therefore Michael Crow is hereby authorized to sell and convey the mills and plantation and the money appropriated according to the directions of the will of John Huhn. 26 Mar 1813. 154. An act dissolving the marriage of MICHAEL MILLER and CATHARINE MILLER. Whereas, Michael Miller, of Guildford twp., Franklin county, was on 8 Nov 1803 joined in matrimony with CATHARINE ROCK of the same county, with whom he lived and cohabited until 8 Jul 1811, and during that time had 3 children, and that Catharine, regardless of the laws of her matrimonial vows did conduct herself in a manner irregular and unbecoming a wife, and on 8 Jul did elope in company with a married man from her husband and three small children, and has not since lived with her husband, and it appears that Michael did demean himself as a good and kind husband, is reputed a man of good morals and truth, and is desirous that the marriage be dissolved, therefore, the marriage contract entered into by Michael and Catharine Miller is hereby declared null and void, and they are free from all duties as fully as if they had never been joined in marriage, but nothing herein contained shall be construed to render illegitimate and children born of the body of Catharine during her coverture. 26 Mar 1813. 155. An act for the relief of old soldiers and the widow of an old soldier. That the state treasurer is hereby directed to pay unto JOHN BLAIN, of Venango county, MARY BELL of York county, widow of DAVID BELL, and DAVID RITCHEY, of Washington county, the sum of forty dollars each, immediately, and an annuity of forty dollars each, to commence 1 Jan 1813, to be paid half yearly during life. 26 Mar 1813. 156. A act to enable SAMUEL MASON, of the city of Philadelphia, to execute a deed of conveyance to a lot of ground. Whereas, ELIZABETH GILL, of the city of Philadelphia, is and for some time past been a lunatic, or non compos mentis, and she is indebted in various sums of money, and is destitute of immediate means of support, therefore real estate of Elizabeth Gill should be sold in order that her debts may be paid, therefore, Samuel Mason is hereby authorized to sell an dispose of and execute a deed of conveyance for a lot situate in Key's alley, between Front and Second streets. 26 Mar 1813. 157. An act granting a sum of money to aid in removing obstructions out of the Mushannon creek. Whereas, the navigation of the Mushannon creek is obstructed by large rocks and sunken timber, and inhabitants of Centre and Clearfield counties have proposed to expend $750.00 in removing the obstructions, therefore, a matching sum of $750.00 is hereby appropriated for the purpose of removing obstructions between Philipsburg in Centre county, and the confluence of the creek with the Susquehanna, and as soon as WILLIAM P. DEWEES and HARDMAN PHILIPS give satisfactory evidence the sum of $750.00 has been expended, a warrant for the same amount shall be drawn from the state treasury. 29 Mar 1813. 158. An act to authorize the acting executors of James Bringburst, dec., to make a title to AUGUSTINE BOSQUET for real estate. Whereas, JAMES BRINGHURST, late of the city of Philadelphia, dec., on the 13 Apr 1807 under the direction of JOHN CONNELLY one of the auctioneers of the city, did sell a frame messuage and lot of land belonging, situated in Passyunk twp., Philadelphia county, on the great road from Philadelphia to Gray's Ferry, unto Augustine Bosquet, of the city of Philadephia, merchant, for the sum of $2025.00 but James Bringhurst died without having made a conveyance, or leaving any written evidence of contract, of which the purchase money still remains unpaid, and the purchaser is in possession of the premises, therefore, JOHN C. EVANS of the city of Philadelphia, and JOSEPH BRINGHURST of the borough of Wilmington, DE., acting exectors of James Bringhurst, are hereby authorized to make and deliver a good deed conveying to Augustine Bosquet the right and title of James Bringhurst, to the lot of ground, adjoining the lot of GEORGE MORTON. 29 Mar 1813. 159. An act to establish an academy in the borough of Orwigsburg, Schuylkill county. The first trustees are: DANIEL GRAEFF, WILLIAM GREEN JR., JAMES M'FARLAND, JACOB KREBS, BARNET KEPNER, JEREMIAH REED, ABRAHAM REIFFSNYDER, and PHILIP HEY, are declared one body politic. 29 Mar 1813. 161. An act authorizing JAMES WRIGHT and JAMES WRIGHT JR., administrators of the estate of SAMUEL WRIGHT, late of the town of Columbia, dec. to execute deeds. Whereas Samuel Wright contracted to sell lots of land in and near the town of Columbia, Lancaster county, to sundry persons who hold and possess the same, but have not fully paid the purchase money, and there is no written evidence of the contracts, but are well known to the administrators, therefore, the administrators of Samuel Wright, are hereby authorized to convey and transfer by deeds to all persons who contracted for the lots, upon payment in full for the same. 29 Mar 1813. 162. A supplement to an act to incorporate a company for making a road from the Philadelphia and Lancaster road, between the 23 mile stone and Admiral Warren tavern, to a point where it intersects the Morgantown road to the west of Jones tavern in Berks county. To keep in repair and receive tolls as a branch, beginning near the house now occupied by JAMES BONES, at the yellow springs in Pikeland twp., Chester county, till it intersects the turnpike road, about 6 miles from the Admiral Warren tavern, Chester county. 29 Mar 1813. 163. An act to render valid the title of SAMUEL WINPENNY, an alien, to real estate. Whereas, Samuel Winpenny, hath purchased certain real estate in the county of Philadelphia, who has resided about 4 years in this state, and had made the declaration of his intention to become a citizen of the United States, therefore, the title of Samuel Winpenny to stone buildings and 50 acres, situate at the falls of Schuylkill, Blockley twp., Philadelphia county, late the property of JOHN THOBURN, is hereby confirmed and made valid as if he had been a citizen at the time of the purchase. 29 Mar 1813. 165. An act establishing a public ferry on the south side of the west branch of the Susquehanna river, Lycoming county. That JOHN MYERS, shall have the right at his own cost, to make agod and convenient landing on his estate, where the post road from Williamsport to Bellefonte crosses the river above the head of the Great Island opposite Dunnstown. 29 Mar 1813. 168. An act compensating JARED INGERSOLL for his report on the penal code. That the state treasurer is hereby directed to pay Jared Ingersoll the sum of $500.00, in full for his report on the penal code, and the further sum of $200.00 for attending to the trial of the case of the commonwealth against JOHN COCHRAN, secretary of the land office, at the last term of the supreme court for the Lancaster district. 29 Mar 1813. 170. An act concerning the borough of Reading. Whereas an act was passed on 12 Sep 1783, erecting the town of Reading, Berks county, into a borough and the boundries are now, beginning on the westerly bank of the rive Schuylkill opposite Lardner's lane, to a post in line of land of ADAM WITMAN, dec., thence in line with PHILIP SAYLOR's to a corner of land late of JONATHAN POTTS, along _____ BRIGHT, to a corner of MICHAEL BRIGHT's land, to a corner of ISAAC LEVAN's land, and MICHAEL CROWSE's land to the beginning. 29 Mar 1813. 173. An act for the relief of old soldiers. That the state treasurer is hereby directed to pay to GEORGE SMITH, of Bedford county, forty dollars immediately, and an annuity of forty dollars half yearly during life, to commence 1 Jan 1813. That the state treasurer is hereby directed to pay to BARTHOLOMEW MELOY, of Washington county, the sum of forty dollars immediately and an annuity of forty dollars, to commence 1 Jan last, to be paid half yearly, during life. 29 Mar 1813. 177. An act for the sale of two tracts of land to Ebenezer and Benjamin Slocum. That the secretary of the commonwealth is hereby authorized to make a deed, conveying to EBENEZER SLOCUM and BENJAMIN SLOCUM the title of the commonwealth for two adjoining tracts of land in Luzerne county, one taken up in the name of GEORGE FULLERTON, the other taken up in the name of ANDREW CALDWELL, which were sold by the state as the property of JOHN NICHOLSON, and they are to pay to the treasurer one dollar per acre for the land. 29 Mar 1813. 178. An act to incorporate a company to make a road from Millerstown through M'Kessonsburg, and thence by DANIEL SPRENKLE's to the Franklin county line. An act to establish and regulate election districts. That the electors of Centre twp., Indiana county, shall hold their elections at the house now occupied by MICHAEL M'ANULTY. That part of Warwick twp., Lancaster county, shall be a separate election district and the electors shall hold their elections at the house now occupied by CHRISTIAN HALL, in the village of Litiz, beginning at the twp. line at MARTIN GROSS's lane, to the house of ABRAHAM REIST SEN., and including the houses of SAMUEL HERSHEY, SEBASTIAN HOFFMAN and JACOB WOLF, thence between the plantations of DAVID WISSLER and CHRISTIAN HURSLY to the road from Manheim to _____ BRICKER's tavern, at JACOB BENDER's smith shop, all west of that line shall hold their elections at the village of Manheim. An act for the relief of JAMES CRAWFORD. That the state treasurer is hereby directed to pay to James Crawford, a major of the late 12th PA regiment, the sum of sixty dollars immediately, and an annuity of sixty dollars, to commence on 1 Jan 1813, to be paid half yearly during life. 29 Mar 1813. 187. An act to authorize the sale of part of the real estate of HENRY MUSSER, a lunatic. That TOBIAS KRIDER and MARTIN MELLINGER, the committee of Henry Musser, found by the common pleas of Lancaster county to be of insane mind, and they are hereby authorized to sell the undivided moiety of the messuage and lot holden in common with JOHN MILLER, in the borough of Marietta, Lancaster county, and to convey it to the purchaser and the proceeds to be applied to the comfortable support of Henry Musser. 29 Mar 1813. 190. That the state treasurer is hereby directed to pay to CASPER TARR, of Westmoreland county, the sum of forty dollars, immediately, to be applied by him to the use of GEORGE BAUMGARTNER of Westmoreland county, and the sum of forty dollars to JOHN DOWNS of Huntingdon county. That the state treasurer is hereby directed to pay to ROBERT LYON of Northumberland county, the sum of forty dollars annually during life, to commence 1 Jan 1813. That the officers of the land office are hereby required to draw and patent to JAMES SWEENY, in trust for the legal heirs of ISAAC SWEENY, late a captain in the revolutionary war, a tract of donation land containing 500 acres. 29 Mar 1813. 192. An act to annul the marriage of SAMUEL ROBB and LOUISA ROBB his wife. Whereas Louisa Robb, late LOUISA ST. CLAIR, in the year 1796, intermarried with Samuel Robb of Westmoreland county, and upwards of two years ago he did totally abandon his wife, with six small children, entirely destitute of means of support, therefore, the marriage contract entered into by Samuel Robb and Louisa his wife, is hereby declared null and void, and the parties set free from all duties as fully as if they had never been joined in marriage, but nothing herein shall be construed to render illegitimate and children born of the body of Louisa during her coverture. 29 Mar 1813. 193. An act to incorporate a company for opening a canal and lock navigation on the eastern side of the Susquehanna, opposite the Conewago falls. An act for the relief of DANIEL WELKER an old soldier. That the state treasurer is hereby directed to pay to Daniel Welker, of Franklin county, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence 1 Jan last. 29 Mar 1813. 196. A supplement to an act to raise by lottery, a sum exceeding $8000.00 for the use and benefit of the African Episcopal church of Saint Thomas, in the city of Philadelphia. An act for the relief of the heirs of JOHN SMITH, an old soldier. That the state treasurer pay unto ROBERT GILMORE of Mercer county, attorney in fact for the heirs of John Smith, the sum of $65.00 for arrearages of pay. 29 Mar 1813. RESOLUTIONS 1. Viewing the present state of our foreign relations, we with astonishment and regret behold the emperor of the French withholding from our county those indemnifications which ought to have been rendered with liberality and promptness. After the aggressions of Great Britain, had by long continued practice been regarded by her government as right - after the forbearance of the American government had assumed the appearance of cowardice, war is reluctantly, unavoidably, but decisively declared. Animated by the most sincere love of peace, the president of the United States in the same dispatch, announces to the British government the existence of war, and the equitable easy and honourable means by which its progress might be arrested, and its calamities permanently prevented, but this extraordinary proof of a humane and pacific disposition is treated with contempt, familiarized with the slaughter of man around the globe, the British government prefers the effusion of human blood, to a suspension of the inhuman practice of impressment even during the short space of an armistice agreed on for the purpose of negotiating a just and honourable peace, nay, notwithstanding the offer made by the government of the United States to exclude British subjects from our merchantment and navy, but what attrocities are too enormous to be found in that government, whose characteristical features are cruelty and perfidy ? which stimulates the savage to drench his tomahawk and scalping knife in the blood of our frontier men, women and infants, which, making the most solemn professions of friendship and peace, arrives by the malignant breath of its secret emissaries to kindle in our nation dissatisfaction, discord, rebellion and civil war, with all their sanguinary and horrible consequences. Thus is extinguished in the American government, and in every American bosom, the last hope of finding in the conduct of Great Britain toward the United States a single voluntary act of justice or humanity, - Impressed with these considerations, and with others of a collateral and subordinate nature, WE the senate and house of representatives of the commonwealth of Pennsylvania in general assembly met, do adopt the following resolutions. 1. Resolved, that the declaration of war against the United Kingdom of Great Britain and Ireland, issued by the general government on 18 Jun last, was the result of solemn deliberation, sound wisdom and imperious necessity. 2. Resolved, that the sword being drawn should never be sheathed till our wrongs are redressed, our commerce unfettered, and our citizens freed from the danger of British impressment, of imprisonment in the floating dungeons of the British navy, and the painful necessity of fighting the battles of an inveterate enemy, against their fathers, their brethren, their native country, and their friends. 3. Resolved, that to exert all the energies of his body and of his mind and to devote his property, to bring the existing war to a speedy just and honourable issue and to teach our insolent foe that the Americans are as free from timidity and weakness in battle, as from covert and disguise in negotiating, is a duty which every citizen of the Union owes to himself, to his country, and to his God. 4. Resolved, that with painful regret we contemplate the refusal by the executive authorities of some of the states in the Union, to furnish, on the president's demand, their quota of militia for the defence of the sea coast, and that with confidence we expect from the national legislature, a prompt attention to this alarming and unprecedented occurrence. 5. Resolved, that the promptness and the zeal with which the governor of this commonwealth executed the military orders of the president since the commencement of hostilities, entitle him to the gratitude of this general assembly of Pennsylvania, and of the nation. 6. Resolved, that the governor of this commonwealth be instructed to transmit a copy of these resolutions to the president of the United States, with a request that he communicate them to congress. Whereas the interference of the legislature of PA in causing an inquiry to be made, relative to the perfection of newly invented machinery, is not without precedent, and as CHARLES READHEFER, of Philadelphia county, has invented a machine declared to possess the power of self motion, the legislature reposes confidence in the integrity and qualifications of HENRY VOIGHT, ROBERT PATTERSON, NATHAN SELLERS and OLIVER EVANS, of the city of Philadelphia, ARCHIBALD BINNY, LEWIS WERMWAG and JOSIAH WHITE, of Philadelphia county, and SAMUEL D. INGHAM, of Bucks county, therefore they are hereby requested to make strict examination of the machine and make a specific representation of its alleged importance. 17 Dec 1812. 4. Whereas the commonwealth of PA entertains a high sense of the distinguished skill and gallantry displayed by the officers and crews of the ships United States and Wasp, in their late victories over a powerful enemy, and looks with peculiar pride on the share which her native sons have had in these illustrious events. To express these sentiments to the world, and at the same time to bestow on them the most greatful reward of valour, the public approbation of their fellow citizens, therefore, the governor is hereby requested to present the thanks of this commonwealth to COMMODORE STEPHEN DECATUR, of the frigate United States, and LIEUTENANT JAMES BIDDLE, of the ship Wasp, for their distinguished gallantry and skill in their late engagements and likewise to procure for and present to each of them, in the name of the commonwealth, an appropriate sword, the expense of which shall not exceed $400.00. 16 Feb 1813.
