Governor WILLIAM DAVIDSON, Speaker of the House of Representatives ISAAC WEAVER, Speaker of the Senate. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act to provide for filling the vacancy in the Office of State Treasurer. Whereas the state treasurer shall be appointed annually by the members of both houses, and by the resignation of WILLIAM FINDLAY, late state treasurer, that office has become vacant the members of both houses shall meet and appoint a state treasurer. 6 Dec 1817 2. An act for the relief of MICHAEL DEARMOND, an old soldier. That the state treasurer is hereby directed to pay to Michael Dearmond of Columbia county, the sum of forty dollars immediately and an annuity of forty dollars during life, payable half yearly to commence on 1 Jan 1818. 22 Dec 1817. 3. An act for the appointment of constables in the borough of Greencastle, Franklin county. That the electors of Greencastle, shall annually, at the house now occupied by JOHN BESORE, elect two citizens to the next court of quarter sessions, and the court shall appoint a constable. 22 Dec 1817. 4. An act for the benefit of JOHN M. READ, HENRY M. READ, and MARGARET M. READ. Whereas, by petition of JOHN READ, as guardian for his children John M. Read, Henry M. Read and Margaret M. Read, by the decease of their mother MARTHA READ, late the wife of John Read, and daughter of SAMUEL MEREDITH of Wayne county, dec., became entitled to unimproved lands, that the lands consist of a number of tracts situate a distance from each other, and held in common with other heirs and devisees of Samuel Meredith, and they desire the lands be sold, but a sale cannot be made because of the infancy of the children, therefore, John Read is hereby authorized to sell and convey all the real estate to which his late wife was entitled, and whereas, John Read is now seized of an estate for the term of his life as tenant by courtesy with remainder of his children, and receipts for purchase money shall be valid, provided the heirs, executors etc. of John Read shall pay his children, or if any should die, to persons entitled to the estate the full amount, with consent of the court of Philadelphia. 22 Dec 1817. 5. An act for the relief of ISAAC RAYMOND, an old soldier. That the state treasurer is hereby directed to pay to Isaac Raymond, late of Montgomery county, forty dollars immediately and an annuity of forty dollars during life, to be paid half yearly, to commence on 1 Jan 1818. 9 Jan 1818. 6. An act confirming the titles of JOHN JACOB SMITH, to certain real estate. That the title of John Jacob Smith, of Bethlehem twp., Northampton, late an alien, to a tract of land situate in Hanover twp., Lehigh county, containing 119 acres, conveyed to him by NICHOLAS KREAMER and wife, in indenture dated 30 Sep 1816, also two smaller tracts of land, one containing 6 acres in Forks twp., the other containing 2 acres in the town of Altona, Bethlehem twp., both of Northampton county, is hereby confirmed, as the same may be deficient due to John Jacob Smith being an alien at the time of the purchase and the conveyances shall be good as if he had been a citizen of the United States at the time he purchased the premises. 12 Jan 1818. 7. A supplement to an act to confirm the charter of incorporation of the United Swedish Lutheran Churches of Wicaco, Kingsessing and Upper Merion, called Gloria Dei, St. James's and Christ Church. Whereas the present rector, church wardens and vestrymen, The REV. NICHOLAS COLLIN, rector, HUGH DE HAVEN, PAUL BECK JR., wardens, and WILLIAM JONES, GEORGE SHEED, ANDREW KEER, SAMUEL RAMBO, CHARLES WHEELER, WILLIAM COX, JOHN M. JUSTIS, SEVAN BOON, MATTHIAS HOLSTEIN, vestrymen, by their petition have presented ground rents are small, and troublesome to collect, wish to sell ground rents and invest in other ground rents, therefore the corporation are hereby enabled to sell and convey the ground rents and the proceeds invested in other ground rents. 12 Jan 1818. 8. An act to vest in MARY COOK the right of the commonwealth to the estate of her husband JOHN COOK, formerly of Chester county, dec. That all the right and title which the commonwealth may have acquired, by recheat, from the want of heirs or known kindred of John Cook, formerly of East Fallowfield twp., Chester county, dec., to the estate, shall be vested in Mary Cook, widow and relict of John Cook, dec. 12 Jan 1818. 9. An act to vest in ANN GIBSON the right of the commonwealth to the estate of her son, RANDOLPH M'DONALD, formerly of the city of Philadelphia, dec. That all the right and title which this commonwealth may have acquired by reason of escheat, from want of heirs or known kindred of Randolph M'Donald, formerly of the city of Philadelphia, dec. to the estate, is hereby vested in Ann Gibson, the mother of Randolph M'Donald, dec. 12 Jan 1818. 10. An act to vest in CATHARINE HERMAN the right of the commonwealth to the estate of SAMUEL HERMAN, dec. That all the right and title which this commonwealth may have acquired, by reason of escheat, from the want of heirs or known kindred of Samuel Herman, late of the borough of York, York county, dec. to the estate is hereby vested in Catharine Herman, his widow. 12 Jan 1818. 11. An act authorizing JOHN SHREVE, SAMUEL COOPE and JESSE TOWNSEND, administrators of the estate of JONAH CADWALADER, to grant and convey certain real estate. That John Shreve, Samuel Coope and Jesse Townsend, administrators of the estate of Jonah Cadwalader, late of the borough of Bridgport, Fayette county, dec., who died intestate, and they are hereby authorized to make and execute a deed of conveyance to JOHN MALCOMSON, of said borough, for a certain lot of ground situate in the borough, #135, adjoining Prospect street, #134, and a lot in Tyne alley belonging to ROBERT TOWNSEND, and a deed of conveyance made to the administrators. 12 Jan 1818. 12. An act to enable the administrators of the estate of JOHN LAMB, late of Cumberland county, dec., to convey certain real estate. Whereas John Lamb, dec., bargained and sold to MICHAEL HOOVER a part of a tract of land in Allen twp. which at the time of the sale was not patented. And as Michael Hoover contributed his share of the purchase money and interest to John Lamb, who took out a patent in his own name, without having released to Michael, and without making any provision by will for the execution of such release, therefore, the administrators are hereby authorized to execute a deed to Michael Hoover, for 115 acres, being a part of the land patented to John Lamb. 12 Jan 1818. 13. An act to vest in SOPHIA BARGMAN, the right of the commonwealth to the estate of her husband JOHN C. BARGMAN, of Huntingdon county. That all the right and title which this commonwealth may have acquired by reason of escheat of Doctor John C. Bargman, late of the borough of Huntingdon, Huntingdon county, dec., to the estate is hereby vested in Sophia Bargman, widow and relict. 12 Jan 1818. 14. An act to authorized the executors of PETER SHELLY, Cumberland county, dec., to convey a piece of ground. That ANDREW EMMINGER, executor, and BARBARA SHELLY, executrix, of the last will and testament of Peter Shelly, last of East Pennsboro twp., Cumberland county, dec., are hereby authorized to make and execute to PETER PHILIPS a good deed of conveyance, for a piece of ground containing 5 acres, situate in East Pennsboro. 12 Jan 1818. 16. An act to incorporate the Milford and Montrose Turnpike road company. That ALMOND H. READ, BELA JONES, PHILANDER STEPHENS, JOSEPH WILLIAMS, SETH MITCHELL, NICHOLAS M'CARTY, DAVID POST, JOHN SNOW, HEZEKIAH LEECH JR., and JOHN BENNET, of Susquehanna county, are hereby appointed commissioners to lay down a road commencing at the house of Nicholas M'Carty in New Milford, to Montrose in Susquehanna county. 12 Jan 1818. 17. An act to enable CHRISTIAN CLINE and JOHN DITMAN, administrators of HENRY DITMAN, dec. to convey real estate. Whereas Henry Ditman in his lifetime, sold 2 acres in Hempfield twp., Westmoreland county, to EMICK ROYER, who paid the purchase money in full and got possession of the property. That Emick Royer died intestate and the land was sold by an order of the orphans' court of Westmoreland to JONAS KIMMEL, upon the petition of HENRY ALSHOUSE and JAMES IRWEN, administrators of Emick Royer, who are unable to confirm the title to the purchaser as no title was ever made from Ditman to Royer. And as Henry Ditman, sold about 2 acres, part of the same tract ADAM BRINEY, who became insolvent and left the county, and the piece of land was sold at sheriff's sale as the property of Adam Briney to Emick Royer, and the land was sold to Jonas Kimmel, but no deed can be found conveying title from Henry Ditman to Adam Briney, thus the title cannot be perfected in Jonas Kimmel, therefore, Christian Cline and John Ditman, administrators of Henry Ditman, are hereby authorized to execute a deed to Henry Allshouse and James Irwen, administrators of Emick Royer, for a piece of land, adjoining Adamsburg on one side, and other lands of the heirs of Henry Ditman, dec., containing 2 acres, to enable Henry Allshouse and James Irwen to confirm title to Jonas Kimmel, and adminstrators of Emick Royer are to confirm title to Jonas Kimmel, agreeably to a purchase by him. 12 Jan 1818. 18. An act to authorize JOHN EISENHARD, one of the administrators of the estate of ANDREW EISENHARD, late of Lehigh county, dec. to complete the title of real estate mentioned. That John Eisenhard, one of the administrators of Andrew Eisenhard, late of Maccungie twp., Lehigh county, dec., is hereby authorized to convey by deeds to JACOB EISENHARD, 31 acres, 43 perches, and to GEORGE EISENHARD 35 acres, and 7 perches, bounded by lands of John Eisenhard and others. 14 Jan 1818. 20. An act to enable the committee of the estate of JOSEPH WHARTON, a lunatic, to sell and convey the real estate of Joseph Wharton. Whereas in the county of Philadelphia, Joseph Wharton has been adjudged a lunatic, and THOMAS J. WHARTON was appointed a committee of the estate of Joseph Wharton, and the income from the real estate is insufficient to maintain to Joseph, therefore, the real estate of Joseph Wharton, is hereby vested in Thomas J. Wharton in trust, and to appropriate the same to the maintance of Joseph during the continuance of his mental infirmity, with power to sell and convey real estate. 27 Jan 1818. 21. An act for the relief of AGNES CRAWFORD, the widow of an old soldier. That the state treasurer is hereby directed to pay to Agnes Crawford, of Lycoming county, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1818. 27 Jan 1818. 22. An act to enable JAMES IRWIN and WILLIAM PARKS, administrators of the estate of JOHN CHRISTY, late of Allegheny county, dec., to convey real estate. Whereas, James Irwin and William Parks, administrators of the estate of John Christy, dec., state John Christy, did enter into an agreement with ROBERT AKINS dated 9 Jun 1789, to assign to him, Robert Akins, all his right and title of 100 acres, held by warrant taken out for lands situate partly in Westmoreland and partly in Allegheny county, both contracting parties to be subject to the land office for the expense of patenting the same in proportion to the quantity held by each of them. Whereas, both John Christy and Robert Akins are deceased, without having carried into effect the agreement, and the administrators of the estate of John Christy having since completed the title to the land, therefore, James Irwin and William Parks, administrators of John Christy, late Versailes twp., Allegheny county, dec., are hereby authorized to execute a deed to William Akins for 100 acres in North Huntingdon twp., Westmoreland county. 27 Jan 1818. 23. An act authorizing the orpahan' court of Greene county to decree a sale of the real estate of JACOB WOLMER, dec. Whereas Jacob Wolmer, late of Montgomery county, did in his life purchase of JAMES HOOK a certain tract of land then in the county of Washington, now in Greene county, containing 100 acres, being unimproved and afterwards died intestate, possessed of the title to the land, leaving a minor son, HENRY WOLMER, to whom James Hook executed a deed, and Henry Wolmer shortly afterward died, not having obtained his lawful age, and it is further represented by DANIEL THOMPSON, administrator of the estate of Jacob Wolmer, that there are not personal assets sufficient to pay and discharge the debts of Jacob Wolmer, part of which is the balance paid by him to James Hook for the land. And as the trust does not appear on the face of the deed executed to Henry Wolmer the son, it is doubted whether the court can decree a sale of the land, therefore, the orphans' court of the county of Greene, is hereby authorized that there are not personal assets sufficient to discharge debts authorize Daniel Thompson to sell the real estate of Jacob Wolmer. 27 Jan 1818. 24. An act authorizing the Orphans' court of Northampton county to order the executors of DEWALT ALBRECHT to sell lands. That the orphans' court of Northampton county is hereby authorized to order a sale by SUSANNA ALBRECHT, JOHN ALBRECHT and JACOB STEFFEN, exectors of Dewalt Albrecht, formerly of Northampton county, dec., of a tract of land situate in William twp., Northampton county, which Dewalt purchased from STEPHEN KRUMREIN, also dec., to satisfy the balance appearing due, including the charge of the executors for a compromise and determination of a dispute respecting the land. 27 Jan 1818. 25. An act to enable MARY BENEZET to dispose of real estate. Whereas, Mary Benezet of Montgomery county, is represented to be seized of an undivided moiety of real estate in the city of Philadelphia, the other moiety is stated to belong to her brother JAMES ENGLE, and they are desirous to let the same on ground rent forever, in order to render it more productive, which by reason of the derangement of mind with which her husband has been visited they are unable to dispose of it by so letting the same, therefore, Mary wife of ANTHONY BENEZET of Montgomery county, and James Engle her brother, of Philadelphia county, are hereby authorized to let on ground rent forever, a certain frame building and the lot where erected, situate on the south side of Lombard st. in the city of Philadelphia and execute all conveyances as if her husband were of sound mind. 27 Jan 1818. 26. An act to release to APPOLLONIA HITNER the claim of the commonwealth to a lot and building in the city of Philadelphia. Whereas Appollonia Hitner, widow of FREDERICK HITNER, of the city of Philadelphia, states her husband died intestate, in the year 1784, without issue or known kindred, and was seized of a lot of ground and small brick tenement in the city, and the lot and tenement (subject only to the dower of Appollonia, who is old infirm and poor,) are liable to escheat of the commonwealth, therefore, all right and title of the commonwealth by reason of escheat, are hereby vested in Appollonia Hitner. 27 Jan 1818. 28. An act to incorporate the Berwick Water Company. That JOHN BROWN, JOHN VENET, SAMUEL HEADLEY and SHERMAN CLARK, are hereby appointed commissioners to convey water into the town of Berwick, by means of pipes, or aqueducts. 27 Jan 1818. 31. An act to authorize the orphans' court of Chester county, to appoint trustees under the will of CALEB PEIRCE, dec. Whereas Caleb Peirce, late of East Marlborough twp., Chester county, dec. by a codicil to his last will and testament, dated 15 Aug 1809, did nominate and appoint JOHN MARSHALL, AMOS HARVEY, ISAAC BENNET, JAMES PYLE and CALEB PENNOCK, trustees for the purpose of equalizing his estate among his children, and as the trustees have not executed the trusts and decline to do so, therefore, the orphans' court of Chester county, shall appoint five persons in their stead. 29 Jan 1818. 32. An act to suspend the collection of the debt due the commonwealth by the late JOHN CADWALLADER, of Huntingdon county dec. Whereas John Cadwallader, dec. was indebted on mortgage to the commonwealth in the sum of $400.00 with interest, which yet remains unpaid, and if payment was at present enforced by a sale of the premises mortgaged, his widow and children, who are in indigent circumstances, would be greatly distressed. Therefore, all proceedings to enforce the payment are hereby suspended for five years. 29 Jan 1818. 37. An act to incorporate the Armstrong, Indiana and Cambria turnpike road company. That for the purpose of making a road commencing near the town of Ebensburg, Cambria county, thence through the borough of Indiana, Indiana county, to intersect the Allegheny river, at the town of Kittaning, Armstrong county, DAVID STEWART and JOHN BLAIR, of Huntingdon county, GEORGE ROBERTS, PHILIP NOON and DAVID TODD of Cambria county, JOHN DENNISTON, DANIEL STANARD, THOMAS SHARP, JOSEPH MOORHEAD and WILLIAM CUMMINS of Indiana county, and THOMAS HAMILTON, DAVID REYNOLDS, PHILIP TEMPLETON, ROBERT NELSON and MICHAEL MACKLIN, of Armstrong county, JOHN NEGLEY, JOHN PARKER and WALTER LOWRIE, of Butler county, are hereby appointed commissioners. 7 Feb 1818. 41. An act to authorize the executors of DAVID SMITH, late of Westmoreland county, dec., to convey a part of a tract of land in Fayette county. Whereas JOSEPH DARLINGTON, bound himself by articles of agreement dated 1 Oct 1794, to convey a part of a tract of land in Fayette county, to ISAAC M'DONALD, dec., before the conveyance was executed, Darlington sold the residue of the tract to Rev. David Smith, under an express stipulation that Smith patent in his own name the whole of the tract and convey part to M'Donald, that Smith always expressed a willingness to do so but was prevented by death, that the heirs of M'Donald have since enjoyed the peaceable possession of the land, and have lately sold the same to NOBLE M'CORMICK who declines paying them until a conveyance is executed, therefore, the executors of the Rev. David Smith, late of Westmoreland county, dec. are hereby authorized to make and execute to ABNER M'DONALD a good deed for part of the tract of land situate in Fayette county, lately sold by the heirs of Isaac M'Donald dec., to Noble M'Cormick, containing 18 acres and 26 perches, according to the agreement between Isaac M'Donald and Joseph Darlington, dated 1 Oct 1794. 7 Feb 1818. 42. An act for the relief of WILLIAM M'CLEAN. That the accountant officers are hereby authorized to settle and adjust the accounts and claims of William M'Clean for six days service of the team, and allow him equal pay as the pay and rations of an ensign during the time he served as a forage master in COL. REES HILL's regiment of Pa. militia, and the state treasurer is hereby required to pay the amount due. 7 Feb 1818. 43. An act incorporating the Presbyterian Congregation of Salem in Derry twp., Westmoreland county. That the trustees are hereby erected into one body politic and corporate. The trustees are: HUGH CULBERTSON, ROBERT M'MILLAN, THOMAS GALLAGHER, JAMES GUTHRIE and WILLIAM STERLING. 7 Feb 1818. 47. An act to enable the Lutheran congregation of St. Paul's Church in Manheim twp., Schuylkill county, to convey real estate. Whereas, a tract of land called Devotion, was granted by the commonwealth of Pa. by patent dated 11 Dec 1817, unto CONRAD KIRSHNER, JACOB PHILIPS, JOHN STAUDT, and JACOB SCHWENK, in trust for the congregation, situate in Manheim twp., containing 205 acres and 52 perches. Whereas, the congregation sold 81 acres of the tract to CHRISTIAN LUKENBILL, who transferred it to his son ABRAHAM LUCKENBILL, who is now in possession of, but the congregation has no conveyance was executed to either Christian or Abraham Luckenbill, therefore, the trustees are hereby authorized to make and execute to Abraham Luckenbill, for the tract containing 81 acres. 17 Feb 1818. 49. An act to erect the town of Chester in the county of Delaware, into a borough. That the town of Chester, beginning on the river Delaware at the mouth of Lemokin run, to the mouth of Ridley creek, to the line dividing the lands of JEREMIAH M'ILVAIN and HUGH ROBERTS, to the line dividing the lands of JOSEPH ENGLE and the heirs of JOSEPH NEIDE, dec., to the public road leading to Middletown, to Ship creek, to Chester creek, to Lemokin run at the line dividing the lands of WILLIAM GRAHAM and RICHARD FLOWER, to beginning, is hereby erected into a borough. 17 Feb 1818. 50. An act to authorize JOHN ERNST and SAMUEL SHERER to erect a toll bridge over Swatara creek. That it shall be lawful for John Ernst, and Samuel Sherer, to erect, and maintain a substantial bridge over the Swatara creek, where the Downingtown, Ephrata and Harrisburg turnpike road is to cross the same, being near the place called Ernst's or Sherer's Ferry, in Dauphin county. 17 Feb 1818. 51. An act granting part of a lot to THOMAS HENRY and JOHN R. SHANON. That part of a lot situate in the borough of Beaver, the property of the commonwealth, is hereby granted to Thomas Henry and John R. Shanon, for the purpose of erecting suitable buildings for the manufactory of glass and a ware house. That they shall pay the whole amount of the value of the lot into the treasurer of this commonwealth, with interest in one year, and it shall be the duty of the Land Office to issue a patent to them. 17 Feb 1818. 54. An act to enable WILLIAM FORSTER, guardian of WILLIAM KRATZER, the minor child of JOHN KRATZER, to sell and convey two lots. That William Forster, is hereby authorized to sell, either for cash or credit, two lots with the appurtenances, situate in the town of Mifflinsburg, Union county, numbered 81 and 89, proceeds to be used for William Kratzer. 25 Feb 1818. 56. An act to annul the marriage of JOHN MERRILLS and MARINDA MERRILLS his wife. Whereas Marinda Merrills, late MARINDA BENNET, of Hanover twp., Luzerne county, in November 1815, was lawfully married to John Merrills, and whereas at a court held at Wilkesbarre, Luzerne county, on the first monday of Aug 1816, he was duly convicted of larceny and horse stealing, and sentenced to undergo an imprisonment at hard labor in the penitentiary house of the city and county of Philadelphia, where he is now in confinement. Therefore, the marriage contract by them is hereby annulled and the parties released from all duties as if they had never been joined in marriage, but nothing herein contained shall be construed to render illegitimate any child born of the body of Marinda during her coverture, and Marinda is hereby constituted the legal guardian of the children of this marriage. 25 Feb 1818. 58. An act for the relief of the widow and heirs of JAMES CARSON, dec., late recorder of deeds for the city and county of Philadelphia. Whereas James Carson, late recorder of deeds for the city and county of Philadelphia, died indebted to the commonwealth for tax on the proceeds of his office, leaving a small and encumbered estate inadequate to the support of his widow and minor children during their minority, and the payment of debt, and that an action has been instituted in the supreme court for the recovery of the same. Therefore, all proceedings to enforce the payment of the balance due to the commonwealth by James Carson, dec., are hereby suspended for five years. 25 Feb 1818. 61. An act to vest in LYDIA BOWDERY the right of the commonwealth to the estate fo her husband GEORGE BOWDERY, late of the county of Northumberland, dec., to the real estate and the same is hereby vested in Lydia Bowdery, the widow. 25 Feb 1818. 63. An act vesting in the corporation of the city of Philadelphia a certain lot of ground. Whereas the original charter of incorporation from WILLIAM PENN to the city of Philadelphia, dated 25 Oct 1701, a piece of ground described as a swamp between _____ BUDD's buildings and Society Hill, and lying at the southern extremity of Dock Street was granted to the city to be left open for use of the same, and whereas the right to grant the swamp to the city at the date of the charter, appears to be doubtful, it being covered previously by the survey of JOHN MARSH, one of the first purchasers from the proprietary, and about 60 years since THOMAS PENN then proprietor of PA, having purchased the title of John Marsh by a patent reciting the previous grant by charter to the city, and setting forth his desire to comply with the intention of his dec. ancestor, granted and confirmed the premises to the corporation of the city. And as in process of time the swamp hath become fast land, and is encompassed on all sides by buildings and separated from the Delaware by Front and Water streets, and is now entirely vacant lot, useless to the city, therefore, that lot is hereby vested in the corporation of Philadelphia, freed from the use stated in the original charter. 25 Feb 1818. 64. An act to aid in erecting a bridge over Limestone run in the borough of Milton, in Northumberland county. Whereas on the 9 Aug 1817, the bridge in the borough of Milton, in Northumberland county, by an unusual and sudden rise of Limestone run passing through the borough, was entirely swept off by the force of the current, therefore, the sum of $5000.00 is hereby appropriated to aid in the erection of a bridge over Limestone run, to be paid by a warrant in favor of DOCTOR JAMES DOUGAL, BETHUEL VINCENT and JOHN CHESNUT, are hereby by appointed commissioners. 25 Feb 1818. 68. An act authorizing the sale of the real estate of RICHARD CHESTER, dec. That JACOB ERNST, administrator de bonis non with the will annexed, of Richard Chester, late of York county, dec., is hereby authorized to sell all the rights and estate which belonged to the deceased, or was vested in him, and the proceeds to be applied to discharge the deceased's debts. 3 Mar 1818. 70. An act granting a review on a part of a state road laid out from JOHN G. PARKE's to M'Call's Ferry. An act to enable MARY REED, administratrix, and JACOB REED, administrator of the estate of THOMAS REED, dec., and JOHN LACKEY, surviving administrators of the estate of CHARLES CLARK, dec., to convey tracts of land. Whereas PETER YARNELL by articles of agreement conveyed to JACOB KUNKEL, a tract of land situate in Norwegian twp., Schuylkill county, and in Feb 1792, the terms of the original agreements were varied by a new agreement between the parties, and on 17 Feb 1812 Jacob Kunkel assigned the articles of agreement unto Thomas Reed, since then Thomas Reed and Peter Yarnell, died intestate and the land was sold by the administrators of Thomas Reed, dec., to ISAAC REED, therefore, Mary Reed and Jacob Reed, administrators, are hereby authorized to make and execute to Isaac Reed a good deed for the land containing 83 acres, adjoining lands of Isaac Yarnell and others, to be taken off the east end of the tract on which Peter Yarnell then resided, according to the terms agreed upon. Whereas, Charles Clark by articles of agreement covenanted to convey to JOHN HUNTER and JOHN CLARKE, executors of WALTER CLARKE, dec., in trust for two minor grandchildren of the deceased, a tract of land situate in North Beaver twp., Beaver county, since then Charles Clarke died intestate, and a deed cannot be obtained. MARKS, ANDREW M'CURDY, JAMES BEATTY, ALEXANDER M'FARLAND of the county of Allegheny, JAMES CHRISTY, JAMES BRICELAND, JOHN DUNCAN, JOHN BUCHANAN and JAMES PROUDFOOT of the county of Washington, are hereby appointed commissioners to lay out a road by way of Monteur's meeting house in Allegheny county, Briceland's cross roads in Washington county, thence to the state line towards Steubenville. 3 Mar 1818. 77. An act for the relief of certain devisees of MARY ANDREWS. Whereas by reason of the decease of the executors of Mary Andrews, formerly of the city of Philadelphia, certain benevolent provisions contained in her last will and testament cannot be carried into effect, therefore, RICHARD PETERS ESQ., one of the trustees of the estate of WILLIAM PETERS, dec., are hereby authorized to make over and convey unto relations of Mary Andrews, a ground rent of 21 pounds per annum, and the arrearages issuing out of a certain lot of ground and tenement situate on the west side of Third street in the city, which Mary in her will dated 10 Jun 1757, devised for the purposes aforesaid, but which cannot be collected and distributed in the manner intended by reason of the decease of all her executors, and the uncertainty of the numerous heirs of the executors, some of whom reside in England and some in America, the powers given by the testatrix are vested. 3 Mar 1818. 79. An act to charge the Branch bank of Philadelphia at Washington, into an original institution. Whereas PARKER CAMPBELL and DANIEL MOORE for themselves and on behalf of THOMAS PATTERSON, THOMAS H. BAIRD, DAVID SHIELDS, THOMAS M'GIFFIN, THOMAS HOGE and ALEXANDER MURDOCK, all of Washington county, PA., have entered into an agreement with the Philadelphia Bank for the sale and transfer by the bank of the debts and real property due and claimed at their office of Discount and Deposit at Washington, Pa., to the persons named, therefore instead of the branch bank, a bank shall be established in Washington PA. 7 Mar 1818. 80. An act incorporating the First Presbyterian Congregation, in the borough of Easton, Northampton county. An act authorizing the incorporation of the Gettysburg and Hagerstown Turnpike road company. That ALEXANDER COBEAN, JOHN MURPHY, RALPH LASHELLS, BERNARD GILBERT, JAMES GILLILAND, WALTER SMITH, WILLIAM MILLER, AMOS MAGINLEY, ANDREW MARSHAL and JOHN ROBINSON, all of Adams county, and DANIEL ROYER, MICHAEL STONER and WILLIAM BLAKELY of Franklin county, are hereby appointed commissioners to lay out a road from the borough of Gettysburg to the state line towards Hagerstown. 10 Mar 1818. 85. An act authorizing the trustees of the incorporated Presbyterian Congregation of Middle Octorara in Lancaster county, to sell real estate. Whereas, on the 12 Feb 1740, JOHN PENN, THOMAS PENN and RICHARD PENN did sell and convey to certain trustees a tract of land containing 100 acres and 80 perches for the purpose of erecting a house of worship, school house and burying place for the use of the Presbyterian congregation of Octorara in Lancaster county, and a small part will be sufficient for all the uses in the deed, and the remainder might be sold for the benefit of the congregation, therefore, JAMES STEELE, JAMES BAXTER, WILLIAM HERD, WILLIAM BROWN, THOMAS MORGAN, JOHN PATTERSON, ALEXANDER MORRISON and ROBERT ANDERSON, the present trustees, are hereby authorized to sell and convey, after setting aside 10 acres for the use of the congregation all the residue of the tract of land, above warranted and patented to HENRY WORK, ALEXANDER GRAIGHEAD, ROBERT MATHEWS and HUGH BARKLEY in trust. 10 Mar 1818. 86. An act to incorporate the trustees of the Newtown Common in Bucks county. Whereas the inhabitants of Newtown twp., Bucks county, by writing dated 1 Apr 1796, recorded in deeds office in book #28, page 600, did nominate trustees to procure a patent for a piece of vacant land situate in the town of Newtown, containing 40 acres and 97 perches, by the name of Newtown Common, and as the trustees obtained the patent, paid the purchase money, and sold and leased on ground rent the greater part of the 40 acres and recorded title. Whereas many of the lessees and alienees never possessed themselves of the lots conveyed, thereof abandoned their possessions without have made improvements or paid any rent, and all the patentees except one are since dead, or resigned, therefore, ENOS MORRIS, THOMAS G. An act authorizing SARAH W. FISHER, COLEMAN FISHER, and S. RHOADS FISHER, administrators of the estate of SAMUEL W. FISHER, dec., to sell lands mentioned. Whereas, Samuel W. Fisher, late of the city of Philadelphia, died on the 10 Feb 1817, intestate, seized in tracts of land situate in the counties of Luzerne, Lycoming, Tioga, Huntingdon, Cambria, Clearfield, Indiana and Bradford, containing 28,000 acres and for the most part unimproved, therefore, Sarah W. Fisher, Coleman Fisher and S. An act granting relief to JAMES ENGLISH, a sergeant in the revolutionary army. An act releasing to CATHARINE KNOLL in trust for the heirs or devisees of her husband GEORGE KNOLL, the right of this commonwealth to escheated estate. Whereas PETER BROWN alias PETER BRADY, of Lower Paxton twp., Dauphin county, died intestate, without heirs or kindred, and as Peter left a widow named ELIZABETH BROWN, who entered into possession of the land, and sold it to George Knoll for the sum of 125 pounds, who paid to Elizabeth 40 pounds, and whereas George Knoll has died, leaving Catharine his widow and several children, and in the year 1797 Elizabeth Brown died, having made a will, devising the residue of her estate to FRANCIS SWEENY of Northumberland county, and as Catharine Knoll is willing to pay the balance of the money and interest to Francis Sweeny on receiving a release of the title of this commonwealth to the estate, therefore, all the right and title of this commonwealth to the tract of land containing 68 1/4 acres is hereby realeased to Catharine Knoll, in trust, and that she shall pay within one year, to Francis Sweeny, the balance of the money. 10 Mar 1818. 92. An act incorporating the Roman Catholic Congregation of Christ's Church, in the borough of Chamberburg, in Franklin county. An act to incorporate the Philadelphia and Pittsburg transporting company. An act to compensate THOMAS STOKELY, a captain of rangers serving on the frontiers during the revolutionary war. Whereas, acts passed 1 Mar 1780 and 1 Oct 1781, do not embrace the case of Thomas Stokely, who from a change of and continuance in service or captivity during the whole war, could be deemed a supernumerary or deranged officer, and it is unjust that by the continuance of his service or captivity he should be deprived of equal pay and emoluments to those enjoyed by other officers, who neither served or suffered to the extent he has done. Therefore, the state treasurer is hereby authorized to pay to captain Thomas Stokely, the sum of $2400.00 in full of his commutation of pay for services rendered during the revolutionary war. 23 Mar 1818. 118. An act to authorize the administrators of RICHARD MARIS, late of the city of Philadelphia, merchant, dec., to sell and convey real estate. Whereas, Richard Maris died intestate, leaving a widow RACHAEL ROSS MARIS, and issue, THOMAS ROSS MARIS, RICHARD MARIS, GEORGE GUEST MARIS and WILLIAM MARIS, the eldest of whom is about 12 years, and the youngest not 4 years, and at the time of his death was seized of several tracts of land in the counties of Luzerne and Susquehanna, and they are annually sinking by reason of taxes and depredations, therefore should be sold, so it shall be lawful for THOMAS ROSS and CALEB NEWBOLD JR., administrators to sell to any purchaser the lands. 23 Mar 1818. 120. An act to confirm to JOHN EWING PORTER the name of JOHN EWING PARKER, and to confirm to SAMUEL TATE the name of SAMUEL TATE SWANSY. That the name of John Ewing Parker is hereby confirmed to John Ewinng Porter, and by that name shall perform all legal acts. That Samuel Tate, a justice of the peace of Franklin county, shall hereafter be known by the name of SAMUEL TATE SWANSY, and by that name perform all legal acts. 23 Mar 1818. 123. An act to enable WILLIAM TILGHMAN to sell and convey real estate. Whereas, the petition of William Tilghman and BENJAMIN CHEW JR., both of the city of Philadelphia, that William is seized for life as tenant of land within the borough of Northampton, Leghigh county, of 400 acres, all of which is vested in his infant grandson, WILLIAM TILGHMAN CHEW, the only child of Benjamin Chew Jr., and his late wife ELIZABETH MARGARET CHEW, dec., who was the only child of William Tilghman, and for the benefit of all William Tilghman should be authorized, during the infancy of his grandson, to sell and make conveyance of the lots, therefore, William Tilghman is hereby authorized to sell and convey any or all the lots, and proceeds are to be paid after his death to those entitled to the land. That the governor is hereby authorized to appoint three disinterest commissioners, to lay out a road from the meeting house at MR. An act authorizing PATTON ROSS to erect wharves. That Patton Ross, of Lancaster county, is hereby authorized to erect wharves and docks on the river Susquehanna, opposite the town of Washington, Lancaster county, on his own property for the accommodation of arks, rafts and boats navigating the river. 24 Mar 1818. 160. An act relating to the will of ELLIS PASSMORE, dec. That the register of wills of Chester county is hereby authorized to receive and file a copy of the last will and testament of Ellis Passmore, dated 6 Oct 1817, duly authenticated by Loudon county, VA., and issue letters testamentary to SAMUEL IRWIN and JOSIAH KIRK, the executors, which shall have the same effect as if the will had been proved and filed in the office of the register of wills of Chester county, and letters issued to the executors. 24 Mar 1818. 165. An act to authorize the sale of part of the real estate of ROGER DAVIS ESQ., dec. Whereas, Roger Davis Esq., late of Charlestown twp., Chester county, by his last will and testament duly proven, devised to his two sons ISAAC DAVIS and ROGER DAVIS, all his real estate, but if either should die before he attained the age of 21 years, the one half to be equally divided among all his children, share and share alike, and further directed his sons should pay out of the estate certain legacies within one year after his wife's death. Whereas, the widow of Roger Davis has been some time dec., and it is the wish of all parties that a house, plantation and tract of land bounded by lands of PETER YOUNG, WILLIAM LLEWELLYN and Isaac Davis, containing 68 acres with the appurtenances, should be sold as the property is very decayed and unproductive, and whereas Roger Davis, one of the sons, as well as THOMAS DAVIS, another son are minors, therefore, it shall be lawful for JACOB NEILOR, guardian of Roger Davis, a minor, to sell and convey all property of Roger Davis, which was devised to him by his father Roger Davis Esq., and to make a deed to the purchaser, and it shall be lawful for JONAS DAVIS, guardian of Thomas Davis, a minor, to release and convey to the purchaser all the right and title of the minor to the tract of land. 24 Mar 1818. 168. An act for the relief of sundry soldiers. That the state treasurer is hereby directed to pay to CHRISTIAN PEMBERTON of the city of Philadelphia, to CHARLES KEAN of Washington county, to ADAM ANDERSON of Westmoreland county, JOHN CAREY of Northampton county, WILLIAM M'GREDY of Crawford county, and JOHN JEMISON of Butler county, forty dollars immediately and forty dollars annually during life, to be paid half yearly to commence on 1 Jan 1818. That the state treasurer is hereby authorized to pay to the heirs of CAPTAIN JOHN BRADY, late of Northumberland county, dec., the sum of $750.00 in lieu of a donation tract of land #182, situate within the triangular tract of land on Lake Erie, formerly supposed to be in the 10th donation district, containing 500 acres, provided the heirs of the dec. release to the commonwealth all the right and title they had to the land. That part of the act passed 10 Mar 1812, as authorizies the payment of an annuity (therein granted to JOHN HASKINS to THOMAS BAIRD of Allegheny county, is hereby repealed, and the annuity shall hereafter be paid to John Haskins. That the state treasurer is hereby directed to pay to CAPTAIN JOHN BRISBEN of Dauphin county, seventy-five dollars immediately and an annuity of seventy-five dollars during life to be paid half yearly, to commence on 1 Jan 1818. That the accountant officers are required to settle and adjust the accounts of WILLIAM ROSS, for arrearages of pay and rations due to him for services in performing a tour of military duty during the late war, and the treasurer is authorized to pay the amount found due. 24 Mar 1818.
