Governor REES HILL, Speaker of the House of Representatives ISAAC WEAVER, Speaker of the Senate. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act to vest in GEORGE ELY, the estate of his mother ESTHER ELY, late of Delaware county, deceased. That all the right, title and claim of this commonwealth to the estate, real and personal of Esther Ely, late of Delaware county, dec., who died without heirs, or any kindred, is hereby vested in her illegitimate son George Ely. 21 Dec 1818. 2. An act vesting in VIOLET KEYS and GEORGE PALMER, a certain escheated estate. Whereas, EPHRAIM KEYS, of Fayette county, died intestate, without issue or any kindred, real and personal property escheated to this commonwealth, and whereas, Violet Keys, a widow of the intestate, and George Palmer, nephew of Violet, reared in the family of the intestate, petitioned the legislature to vest the petitioners the estate. Therefore, all the right, title and interest of this commonwealth by reason of the death of Ephraim Keys, and in a lot situate in Menallin twp., Fayette county, containing 40 acres and 66 perches, with the appurtenances, adjoining lands of WILLIAM DIXON and others, is hereby released to Violet Keys and George Palmer, as tenants in common, and also all right and title of this commonwealth in the personal estate in the hands of the administrators. 21 Dec 1818. 4. An act dissolving the marriage contract between DAVID WELLS and MARY WELLS his wife. Whereas, on the 14 Apr 1818, David Wells of Fayette county, was intermarried with MARY DELANY of Harrison county, Ohio, and it appears from documents that Mary previous to her marriage had criminal connection with some person unknown to David, and on 30 Jul 1818, was delivered of a child which she subsequently acknowledged not to have been Davids, and this unfortunate circumstance having destroyed his confidence and affection, the parties mutually agreed to separate. Therefore, the marriage contract entered into by David Wells, of Fayette county, and Mary his wife, late Mary Delany, is hereby dissolved and the parties set free from all duties, as fully as if they had never been joined in marriage. 21 Dec 1818. 6. An act for the relief of ROSINA PRICE, the widow of a soldier of the revolutionary war. That the state treasurer is hereby directed to pay to Rosina Price, of Union county, the widow of THOMAS PRICE, forty dollars immediately, and an annuity of thirty dollars during life to be paid half yearly, commencing on 1 Jan 1819. 21 Dec 1818. 7. An act for the relief of CHARLES BOWMAN, a soldier of the revolutionary war. That the state treasurer is hereby directed to pay to Charles Bowman, of Philadelphia county, $100.00 immediately and an annuity of forty dollars during life to be paid half yearly, commencing on 1 Jan 1819. 21 Dec 1818. 10. An act empowering JAMES CAMPBELL and M'FARLAND CAMPBELL, executer of the last will of JAMES CAMPBELL, dec., to execute a deed of release. Whereas, James Campbell and Charles Campbell, two of the sons of WILLIAM CAMPBELL, late of Franklin county, dec., were jointly seized of a tract of land by virtue of their father's last will and testament, and a deed of conveyance from William Campbell the younger, and Charles with the consent of James, surveyed and set off to JOHN WILSON, his moiety of said land, and John now holds the same, but James having since died without executing any deed of partition or release of his title, byl reason whereof no patent can be issued to John Wilson, who therefore declines paying that part of the purchase money yet remaining due, and the executors of James Campbell have by their petition prayed to be authorized to release to John Wilson that part of tract surveyed and set off to him as aforesaid. Therefore, James Campbell and M'Farland Campbell, executors are hereby authorized to execute and deliver to John Wilson, a deed of release for a tract of land in Franklin county, which was sold and conveyed to Wilson by Charles Campbell, which release shall be valid. 21 Jan 1819. 13. An act to erect the town of Shippensburg, Cumberland county, into a borough, and for other purposes. That the town of Shippensburg, beginning at a post in the centre of the road leading from Adams street, to Middle Spring, thence to a line dividing lands of PATRICK COCHRAN and JAMES CHESTER, thence crossing lands of DOCTOR SIMPSON and others, to a post in the meadow of DAVID MAHON's heirs, thence by a line dividing lands of WILLIAM BARR and town lot of ISAAC MILLER, to a post in lands of WILLIAM BARR, to a post of WILLIAM BEARD, to a post near the tail race of BENJAMIN REYNOLDS' mill, thence to a post in David Mahon's land, to the division line of Cumberland and Franklin counties, to a post in lands of JOHN RAHM, to the dwelling house of said Rahm twenty perches from the middle of Washington street, by the dividing line between SAMUEL STURGEON and Patrick Cochran, to the beginning, is hereby erected into a borough. 21 Jan 1819. 14. An act vesting in JOHN SHRUM and ADAM BAUGHMAN, real estate in trust for the use of German Lutheran and Calvinist congregations in Hempfield twp., Westmoreland county. Whereas, a patent was issued by the commonwealth to DAVID MARCHANT, dated 14 Nov 1792, for a tract of land containing 347 1/2 acres and situate in Hempfield twp., Westmoreland county, 182 acres was held in trust by David Marchant, for the use of the congregations, but not so expressed in the patent, and whereas, David Marchant, executed a conveyance to the trustees for the land dated 20 Jul 1797, recorded at Greensburg in book #4, page 439, which is defective and does not pass the legal estate in said lands according to the intention of the parties, and David Marchant having since died. Therefore, all the estate, and title of a tract, adjoining lands late of HENRY DITTMAN and others, containing 182 acres is hereby vested in John Shrum and Adam Baughman, in trust for the use of the congregations and the members of the congregations are hereby authorized to elect a successor to John Shrum and Adam Baughman, who are authorized to sell and to convey 82 1/2 acres and to apply the proceeds to the finishing of a brick meeting house, lately erected on the premises. 21 Jan 1819. 15. An act authorizing the sale of real estate and investment of the proceeds. Whereas, a house and lot in Germantown, Philadelphia county, were purchased by JOHN LORAIN, late of the city of Philadelphia, merchant, with his wife, LYDIA LORAIN's share of the proceeds of the sale of her father, STEPHEN SHEWELL's real estate, and conveyed by John and Lydia to trustees, for the benefit of themselves and their children, with a power reserved to John and Lydia, jointly to revoke, alter or change the trusts, but no such power was reserved to Lydia Lorain, after the death of her husband, who is since deceased, and it would be advantageous to sell the real estate and apply part of the proceeds as may be found sufficient for the payment of the debts necessarily incurred for the immediate support of Lydia and her children, and invest the remainder in some safe fund, productive of an annual interest for their future maintance. Therefore, JOHN MORREL the elder, and JOHN A. M'CUTCHEON, are hereby authorized to sell and convey the house and lot and pay all debts and invest the balance in a safe productive fund. 21 Jan 1819. 16. An act authorizing JAMES COULTER to execute a release on behalf of his minor children. Whereas, in the year 1794, GEORGE M'CARTNEY the elder, of Westmoreland county, died leaving issue seven children, ANDREW M'CARTNEY, GEORGE M'CARTNEY JR., SAMUEL M'CARTNEY, JANE M'CARTNEY, MARTHA M'CARTNEY, ELIZABETH M'CARTNEY, and MARY M'CARTNEY, (who is since intermarried with MATHEW DILL JR.) having made his last will and testament, by which his estate was directed to be appraised and the proceeds to be divided among his children. That Jane was afterwards intermarried with JAMES COULTER of Indiana county, and had by him two children, MARY B. COULTER and ELIZABETH W. COULTER, who are both in their minority, and Jane is lately deceased. That during her lifetime, when all the parties were of full age, an arrangement was made for the appraisement of the real estate by George M'Cartney which was done, and by consent assigned to his three sons Andrew, Samuel and George upon their paying the other heirs their proportions of the amount. That releases had been made and executed to them, by all the heirs except the children of James Coulter, by reason of their minority will not be removed for fifteen years, and until that release is executed the proportional part of Mary and Elizabeth, in right of their mother, cannot be obtained. Therefore, James Coulter of Indiana county, is hereby authorized to make, execute and deliver on behalf of his minor children Mary and Elizabeth, a release of their right and title in the estate of George M'Cartney of Westmoreland county, dec., in right of their mother JANE COULTER, dec., to Andrew, Samuel and George M'Cartney. 21 Jan 1819. 17. An act for the relief of JACOB KREIDER, a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to Jacob Kreider of Northampton county, forty dollars immediately, and an annuity of forty dollars to be paid half yearly, commencing on 1 Jan 1819. 21 Jan 1819. 18. An act relative to escheated estates. That any person who hath died or shall die intestate, leaving a wife or husband and no heirs or other known kindred, the estate shall vest in and be enjoyed by such surviving wife or husband, and he or she shall hold the estate the same as the decedent. 21 Jan 1819. 20. An act to incorporate the Strasburg and Fannetsburg turnpike road company. That WILLIAM RIPPY, JOHN CREMER, SAMUEL BROTHERTON, GEORGE M'CLELAND, JOHN M'ALLEN, JOHN CAMPBELL, JOHN WALKER, JOHN PATTERSON and JOHN SKINNER, of Franklin county, WILLIAM PYMN, JOHN WILDS, MICHAEL WILLET, GEORGE D. RITTENHOUSE and JOHN KERR of Bedford county, are hereby appointed commissioners to make a road from Harrisburg and Chambersburg turnpike road near the west end of Shippensburg, through Strasburg to the stone bridge on the Conodoguinet creek in Horse Valley, thence to a stone bridge on the Conococheaque creek at the east end of Fannetsburg, to the Chambersburg and Bedford turnpike road near the house of HUGH MALOY on the Sideling Hill. 21 Jan 1819. 21. An act for the relief of ELIZABETH CARMINE. That the state treasurer is hereby authorized to pay to Elizabeth Carmine, of Bucks county, widow of WILLIAM CARMINE, a volunteer soldier in the late war, forty dollars immediately and forty dollars annually, to commence on 1 Jan 1819 and to continue during the term of five years, provided that upon the death or marriage of Elizabeth Carmine, the annuity shall be paid to the guardian of the minor children of William Carmine, dec. 27 Jan 1819. 26. A supplement to an act providing for the erection of a State Capitol. That the governor, the auditor general, the state treasurer, JOHN B. GIBSON and WILLIAM GRAYDON, are hereby appointed commissioners to superintend the erection of a state capitol. 27 Jan 1819. 27. An act to incorporate the Beaver Canal Company. That DAVID TOWNSEND, EVAN PUGH, JOHN DICKEY, FREDERICK HAYMAKER, ROBERT DARRAGH, THOMAS HENRY, MILO ADAMS, CHARLES S. RENO, JAMES ALLISON, and JOSEPH M'FERRON, of Beaver county, ARTHUR SHENOWITH, JACOB HERRINGTON and BEVAN PEARSON, of Mercer county, and MATHIAS EVANS and HUGH DAVIS, of Allegheny county, are hereby appointed commissioners, to enter upon the Big Beaver river near the falls in Beaver county, to open, enlarge, or deepen the river to improve the canal to make complete slack water navigation. 27 Jan 1819. 28. An act to purchase Purdon's Digest of the Laws of Pa. That the Secretary of the commonwealth is hereby authorized to purchase from PHILIP H. NICKLIN, 800 copies, price not to exceed $5.00 per copy. 27 Jan 1819 31. An act relating to the lien of the commonwealth on the estate of WILLIAM NICHOLS, dec. That the governor is hereby authorized to employ counsel on behalf of WILLIAM NICHOLS, on a writ of error depending in the supreme court of the United States, at the suit of HENRY MILLER, and to defend the claims of the commonwealth against the claim of the United States. 8 Feb 1819. 35. An act to confirm the title to real estate within this commonwealth to BENJAMIN SHAW, an alien. That the title to all real estate which Benjamin Shaw, an alien, now holds by purchase, which is held in trust by others for Benjamin, whereof the right remains with him, and the same is hereby confirmed to him, as fully as if he had been a citizen of the United States at the time of purchase or trust accrued. 8 Feb 1819. 36. An act divorcing JAMES KITE and ELIZA KITE, his wife from the bonds of matrimony. Whereas, in the year 1813, James Kite, then of the city of Philadelphia, and ELIZA DONNELLY, of the same place, were joined in matrimony at the same city, and lived and cohabited together until 1815, at which time James Kite abandoned his wife leaving her without any means of support, and has ever since continued to absent himself from her society, and has neglected to provide in any manner for her sustenance, and as it is further represented and verified that shortly after the marriage he contracted habits of dissipation and vice and to the time of his desertion he treated her in an unfeeling and barbarous manner, and that Eliza cannot be divorced by the existing laws, as she has not resided a sufficient time in the commonwealth. Therefore, the marriage contract entered into between James Kite and Eliza his wife is hereby dissolved and the parties free from all duties as fully as if they had never been joined in marriage, provided nothing shall be taken to render illegitimate any issue of the marriage. 11 Feb 1819. 37. An act divorcing VACHEL STEPHENS and RACHEL STEPHENS his wife from the bonds of matrimony. That the marriage contract entered into between Vachel Stephens and Rachel his wife, late RACHEL PEAIRS, of Fayette county, is hereby dissolved and the parties free from all duties as fully as if they had never been joined in marriage. 11 Feb 1819. 38. An act incorporating the Western University of PA. Whereas, by the petition of the inhabitants of the western parts of the commonwealth, desire an university near the town of Alleghney, Allegheny county, for the instruction of the rising generation, would promote the best interests of the state, therefore it shall be erected, and the trustees are: JAMES ROSS, GEORGE STEVENSON, FRANCIS HERRON, JOSEPH STOCKTON, ROBERT BRUCE, JOHN BLACK, JOHN SCULL, JOHN M. SNOWDEN, WILLIAM WILKINS, GEORGE EVANS, MORGAN NEVILLE, HENRY BALDWIN, GEORGE POE JR., WALTER FORWARD, JOHN DARRAH, SAMUEL ROBERTS, EBENEZER DENNY, PETER MOWRY, of the city of Pittsburg, WILLIAM ROBERTSON JR., of the town of Allegheny, JOHN M'PHERRIN, JOHN GILMORE, of Butler county, JOHN YOUNG, JAMES POSTLEWAITH, JOHN REED, of Westmoreland county, ROBERT MOORE and JAMES ALLISON of Beaver county. 18 Feb 1819. 39. An act authorizing the guardians of the minor children of WILLIAM HUTCHISON, dec., to execute a conveyance to JAMES TODD. Whereas, ROBERT HUTCHISON, did sell unto James Todd, 102 acres of land, situate in Centre twp., Indiana county, adjoining lands of JAMES KELLY, JAMES M'LAIN, and others, surveyed on a warrant in the name of JOHN HUTCHISON, and that William Hutchison, immediately before is decease, was seized of an equal undivided moiety or half part of said land, and that William died intestate, leaving several children who are now in their minority, to whom the land descended in equal parts, that the sale is deemed fair to the parties concerned, and their wish to have the sale confirmed. Therefore, the guardians of the minor children of William Hutchison, dec. are hereby authorized to execute a good title to James Todd, for the share to which the minor children are entitled. 18 Feb 1819. 40. An act for the relief of MATTHIAS ARMBRUSTER of Philadelphia. That the state treasurer is hereby authorized to pay to Matthias Armbruster, of the city of Philadelphia, the sum of $300.00 in full of his claim of a tract of donation land which he was entitled to for his services as a soldier in the Pa. line during the revolutionary war. 18 Feb 1819. 41. An act to vest CYNTHIA BENNET and RICHARD DENNY, an escheated estate. Whereas, JAMES LANG, late of the borough of Brownsville, Fayette county, died intestate without issue or any kindred, and whereas from declarations made a few hours previous to the death of James Lang, as well as often times before, that it was his full determination to give at his death all he had, and what he should acquired, to Cynthia Bennet and her brother Richard Denny, children of the wife of James Lang by a former husband, whose mother is also dead, and by whom it appears James Lang got the greater part of said estate, and whereas Richard left the state of PA. a number of years since, and it is uncertain at this time whether he is dead or living. Therefore, all right, and title of this commonwealth to the estate of James Lang, together with the rents, issues and profits due, is hereby vested in Cynthia Bennet and her brother Richard Denny, as tenants in common. 18 Feb 1819. 43. An act for the relief of the widow and heirs of JAMES CARSON, dec. late recorder of deeds for the city and county of Philadelphia. Whereas, James Carson, late recorder of deeds died indebted to the commonwealth for the sum of $1250.00 for tax on the proceeds of his office, leaving a small much encumbered estate, inadequate to the support of his widow and minor children during their minority and an action has been instituted in the supreme court of the eastern district. Therefore, the estate is hereby exonerated and discharged from the payment of the balance due, and the suit instituted is hereby discontinued on payment of costs by the estate. 18 Feb 1819. 44. An act to incorporate the Conestogoe Manufacturing company of Lancaster. The same rights, powers, etc., which were granted by an act passed 16 Jan 1815, are hereby vested in JOHN SWAR, WILLIAM DICKSON, JOHN HERR, JAMES HUMES, JACOB MILLER, HENRY BEAR, JOSEPH OGILBY, JAMES HOUSTON, CHRISTIAN HERR, (Pequea) CHRISTIAN ROHRER, of an association for the purpose of weaving, dying and bleaching cotton goods. 18 Feb 1819. 45. An act for the relief of LIEUTENANT JOHN PAINTER, and others. Whereas, Lieutenant John Painter, LIEUTENANT RICHARD MARTIN, THOMAS MARTIN and WILLIAM HOFFMAN, of Norhtumberland county, did perform considerable military services during the revolutionary war in aiding to protect the then frontier settlements, having assurances from COLONEL THOMAS HARTLEY commandant of that district of country, of being compensated, and they having never received any pay for said services, nor any person for them. Therefore, the state treasurer is hereby required to pay to them, the sum of $200.00 each, in full for services rendered during the revolutionary war. 20 Feb 1819. 47. An act for the relief of ISAAC REES. Whereas, Isaac Rees has sold and entered into a written contract with sundry persons to convey two adjoinig tracts of land situated in Brandywine twp., Chester county, bounded by lands of WILLIAM MOORE, JOB WINDEL, WILLIAM JACKSON, GEORGE PIERCE JR., and others, containing about 318 acres, which he is unable to comply with, in consequence of the situation of his wife who is non compos mentis, and whereas Isaac Rees has purchased other real estate in Chester county, which will be liable to his wife's right of dower, more valuable than the tract he has sold, which he cannot hold unless he is authorized to convey first tracts discharged of his wife's claim of dower. Therefore, Isaac Rees, is hereby empowered to convey the two adjoining tracts of land, discharged of all claim which his wife has in the lands by virtue of her right of dower. 25 Feb 1819. 50. An act to enable the executors of ELIZABETH BOYES, to sell and convey real estate. Whereas, Elizabeth Boyes, of the village of Maytown, in Donegal twp., Lancaster county, died seized of a certain lot having a will, dated 2 Dec 1815, directed the distribution of her estate and appointed JOSEPH VANCE and JOHN CLARK executors of said will, but omitted to authorized the executors to sell and convey the lot, therefore, Joseph Vance and John Clark, executors are hereby authorized to sell a lot situate in Maytown, and to convey it by deed to the purchaser. 25 Feb 1819. 51. An act for the relief of JOSHUA WILLIAMS, an officer of the revolution. That the state treasurer is hereby authorized to pay to Joshua Williams, of Centre county, the sum of eighty dollars immediately, and the sum of eighty dollars yearly during life, to be paid half yearly, to commence on 1 Jan 1819. 25 Feb 1819. 52. A supplement to an act to incorporate two companies for making a road. That for the purpose of making a turnpike road, commencing at the nort end of the bridge (about to be built) over the Allegheny river, opposite the city of Pittsburg, through the borough of Butler to Mercer, two companies are incorporated, The Pittsburg and Butler Turnpike Road Company, and the other The Butler and Mercer Turnpike Road Company, and HENRY BALDWIN, WILLIAM ROBINSON, ROBERT CAMPBELL and HUGH DAVIS of Allegheny county, DUNNING M'NAIR, JOHN DAVID, WILLIAM CAMPBELL and JOHN GILMORE, of Butler county, are hereby appointed commissioners for the Pittsburg and Butler turnpike road, and JACOB MECHLING, JOHN BREDIN, DAVID M'JUNKIN and JOHN BROWN, of Butler county, and JAMES MILLAR, BEVAN PEARSON and JOHN FINDLAY, of Mercer county, are hereby appointed commissioners for the Butler and Mercer turnpike company. 25 Feb 1819. 54. An act incorporating the Philadelphia Saving Fund Society. Whereas, a voluntary association of citizens of Philadelphia, titled The Philadelphia Saving Fund Society, has for some time existed, and been established for the sole purpose of receiving and investing in public stock or substantial security on real estate, small sums from tradesmen, mechanics, laborers, servants and others, and offering security and interest. Therefore, ANDREW BAYARD, SAMUEL ARCHER, RICHARD BACHE, CHARLES N. BANCKER, CLEMENT C. BIDDLE, SAMUEL BRECK, TURNER CAMAC, REUBEN HAINES, THOMAS HALE, ADAM KOENIGMACHER, LUDWIG KRUMBHAAR, JOHN M'CREA, SAMUEL B. MORRIS, ISAAC W. NORRIS, RICHARD PETERS JR., CONDY RAGUET, JOSEPH ROTCH, WILLIAM SCHLATTER, SAMUEL SPACKMAN, JOHN C. STOCKER, JOHN STRAWBRIDGE, ROBERTS VAUX, JOHN VAUGHAN, DANIEL B. SMITH and MATTHEW C. RALSTON, are hereby erected and made one body politic and corporate. 25 Feb 1819. 56. An act for the relief of ALEXANDER BURNS, a soldier of the revolutionary war. That the state treasurer is hereby directed to pay to Alexander Burns, of Washington county, forty dollars immediately, and an annuity of forty dollars paid half yearly, commencing on 1 Jan 1819. 5 Mar 1819. 57. An act to annul the marriage of ABRAHAM ARMSTRONG and MARIA ARMSTRONG his wife. That the marriage contract between Abraham Armstrong and Maria his wife, late MARIA ABERCROMBIE, both of the city of Philadelphia, is hereby annulled and the parties released from all duties as fully as if they had never been joined in marriage. 5 Mar 1819. 64. An act to authorize the Orphans' Court of Northampton county to appoint trustees. Whereas, JOHN ARNDT ESQ., late of the borough of Easton, in Northampton county, dec., by his last will and testament and codicil, dated 12 Mar 1913 and 14 Ajpr 1814, did nominate and appoint GEORGE WASHINGTON ARNDT and CHARLES LOMBAERT, trustees, on behalf of his daughter ELIZABETH INNIS, the wife of WILLIAM INNIS, and her children, and whereas the trustees have not executed and performed the trusts and still decline to carry the same into effect, so that the same remains unexecuted, to the injury of Elizabeth, therefore, It shall be the duty of the orphans' court of Northampton to appoint one or more in the room of the trustees who shall have full power to perform and execute all the trusts by the last will and testament of John Arndt, dec. 5 Mar 1819. 65. An act authorizing the administrators of ZACHARIAH CONNELL, dec. to sell his estate. That MARGARET CONNELL and JOHN B. TREVOR, administrators of the estate of Zachariah Connell, late of Fayette county, dec., are hereby authorized to obtain on loan the sum of $2500.00, for the purchasing for the use of the estate, from the members of the Connellsville bridge company, the stock which they hold in the bridge, lately erected over the Youghiogene river at the town of Connelsville. That the administrators are hereby authorized to sell and convy the real estate of Zachariah Connell, dec., they think necessary to discharge the debts and judgements against the estate, and the load, and which the guardians deem to the best interest of the minors. 5 Mar 1819. 67. An act to annul the marriage of JACOB FOLTZ and POLLY FOLTZ his wife. Whereas, Jacob Foltz, of Union county, intermarried with POLLY SWINEFORD, of the same county, with whom he lived and cohabited for a number of years, during which time they had several children, and Jacob, regardless of the laws and his matrimonial vows, and his duty as a husband, did desert and abandon his wife and children, and since been convicted of felony in Adams county, and sentenced to hard labor in the penitentiary, but was pardoned by the governor and has since been convicted of burglary in Cumberland county and sentenced to hard labor in the penitentiary. Therefore, the marriage contract between Jacob Foltz and Polly his wife, are hereby discharged from the marriage contract, and all duties as fully as if they had never been joined in marriage, but nothing shall be construed to render illegitimate any children born of the body of Polly during her coverture, and Polly is hereby constituted the legal guardian of the children of the marriage. 5 Mar 1819. 68. An act relative to the claim of the commonwealth against PETER BAYNTON, and against the estate of JOHN NICHOLSON, dec. That the attorney general with the advice and consent of the officers of the accountant department, be authorized to prosecute the claim of the commonwealth against Peter Baynton, formerly state treasurer, best calculated to recover the amount due. Upon the payment of the debt and interest due the commonwealth, to release the lien upon the lands of Peter Baynton, and if it shall be necessary to have the lands sold for payment. 16 Mar 1819. 70. An act establishing a ferry over the North Branch of Susquehanna opposite Danville, Columbia county. Whereas, DANIEL MONTGOMERY and JOHN GEARHART, have represented that they are the owners of the ferry across from Danville and are desirous that the ferry be established by law. Therefore, it shall be lawful for them to make at their own expense landings on their own land, on both sides. 16 Mar 1819. 71. An act to authorize DAVID MARCHAND, DANIEL SCHAEFFER and JACOB KUHNS, to use a salt-well in the Conemaugh river. That David Marchard, Daniel Schaeffer, and Jacob Kuhns, of the county of Westmoreland, are hereby authorized to dig for salt water in the bed of the river Conemaugh, adjoining their land in Derry twp, for the purpose of manufacturing salt. 16 Mar 1819. 74. An act to vest to JOHN BOYLES, the right of the commonwealth to an escheated estate. That all the estate derived by virtue of an escheat, for want of heirs or kindred, of the estate of THOMAS LAUGHLIN, late of Franklin county, dec., is hereby vested in John Boyles and AGNES BOYLES his wife. 16 Mar 1819. 75. An act to incorporate the Philadelphia and Great Bend turnpike road company. That BENJAMIN R. MORGAN, CONDY RAGUET, JOHN READ, THOMAS STEWARDSON, THOMAS P. COPE, ROBERT VANX and JOHN STEDDARD, of the city of Philadelphia, ISAAC RYNEERSON, ITHAMER MOTT, WILLIAM WARD, THOMAS MEREDITH, and BENJAMIN T. CASE, of Susquehanna county, and HENRY W. DRINKER and WILLIAM CLARK, of Luzerne county, are hereby appointed commissioners to lay out a road beginning near the thirtieth mile stone, on the Eastern and Wilkesbarre turnpike road, through Legget's gap in Lackawannock mountain and terminate on the Coshecton and the Great bend turnpike road, near the tavern of Ithamer Mott, in Susquehanna county. 16 Mar 1819. 76. An act to incorporate a company for making a road, from the borough of Washington, Washington county, through West Middletown, to the Virginia state line, near the farm of FRANCIS M'GUIRE. An act to reannex part of Mifflin county to the county of Union. That part of Decatur twp., in Mifflin county, lying east of a line beginning near the southeast corner of Centre county, on the top of Jacks mountain, nearly opposite JOHN EBERHART's still-house, so that same remains in Mifflin county, thence south to the original division line between Union and Mifflin counties, shall be annexed to the county of Union. 16 Mar 1819. 80. An act for the relief of JOHN MARSHALL, a captain of the revolutionary war. That the state treasurer is hereby authorized to pay to John Marshall, of Washington county, a captain in the revolutionary war, $120.00 and an annuity of $120.00 during life, payable half yearly, to commence from 1 Jan 1819. 81. An act to vest the right of the commonwealth to an estate. That all the right, and title which the commonwealth may have acquired by reason of any escheat for want of heirs or kindred of PATRICK M'GOWAN, late of Fayette county, dec., to his estate, shall be vested in PATRICK MILLER, late of Huntingdon county, now of Butler county, brother-in-law of the deceased. 16 Mar 1819. 82. An act to incorporate the Reading Water Company. That JOHN SPAYD, FREDERICK HELLER, JOHN ADDAMS, GEORGE D.B. KEIM and JOHN BERKENBINE, are hereby appointed commissioners to convey into the borough of Reading, by means of pipes, trunks, or aqueducts, some spring or stream of water in the county of Berks. 16 Mar 1819. 87. An act granting an annuity to HUGH CAMPBELL, a soldier of the revolutionary war. That the state treasurer is hereby directed to pay to Hugh Campbell, of Chester county, forty dollars immediately, and an annuity of forty dollars, to be paid half yearly, commencing on the 1 Jan 1819. 89. An act authorizing the executors of IGNATIUS LEITNER, dec., to sell real estate. That GEORGE LEITNER and GEORGE SKELTON, executors of the last will and testament of Ignatius Leitner, late of the borough of York, dec., are hereby authorized to sell a house and half lot of ground situate in the borough, on the east side of George street, bounded by lots of BENJAMIN WEISER and DANIEL WEAVER, being part of the real estate devised by the decedent, and to execute a deed to the purchaser, and with the proceeds to purchase a suitable house and ground in the borough, in trust, for the use of ELIZABETH SHAEFFER, a daughter of the deceased, during her life, and upon her death to be sold and the money divided between her children. 16 Mar 1819. 95. An act to authorize JOHN RIDDLE and DAVID LAIRD, guardians of the minor children of GEORGE HOFFMAN, late of Washington county, dec. to sell real estate in Chester county. Whereas, George Hoffman, died seized of a piece of ground, containing 13 acres and 27 perches, situate in Chester county, LUchland twp., which is chiefly woodland, that its value is decreasing, by reason of persons cutting and carrying off the timber, there being no person convenient to or willing to take it under care, and it would be to the benefit of his minor children, who are three in number, the eldest thirteen and the youngest eight, and the property sold and proceeds vested in a more productive fund. Therefore, it shall be lawful for John Riddle and David Laird, of Allegheny county, guardians to sell and convey all the right and title of the minor children, and to execute a deed to the purchaser. 23 Mar 1819. 96. An act to authorize the guardians of the minor children of JACOB BUCK, dec. to sell and convey real estate. Whereas, JACOB BUCK JR., died leaving a widow and two children, who are now in their minority, and was seized of a tract of land, in Buffaloe twp., Cumberland county, containing 100 acres, adjoining lands of JOHN M'GINNIS and PHILIP RODEPOUCH, on the west, PHILIP DECKERT, on the north, BENJAMIN STROW, on the east, and RICHARD BEARD, on the south, with a small improvement thereon, and Jacob Buck, the father of the deceased, died intestate, previous to the death of his son, leaving a real estate of considerable value, the right to accept of said estate is vested in the guardians of the minors. An act confirming the title of THOMAS SILVERWOOD, an alien, to two islands in the river Susquehanna, Northumberland county, and also for the relief of WILLIAM MILNE, an alien. That the titles of Thomas Siverwood, of the town of Mifflinburg, Union county, (an alien) to two islands, the one containing 10 acres and 23 perches, called in the patent Cherry Island, and the other containing 2 acres, called in the patent Round Island, both situtated in the river Susquehanna, opposite to lands surveyed to JAMES SILVERWOOD, of Augusta twp., Northumberland county, are hereby confirmed to him, so far as the same may be defective, on account of Thomas being an alien, and as good as if Thomas had been a citizen of the United States, at the time he purchased the same. An act to enable the trustees of four congregations of Presbyterian or Reformed churches, in Cacalico, Earle and Warwick twps., Lancaster county, to sell and convey real estate. An act to authorize JOHN CHESNUT and DR. JAMES S. DOUGAL to sell and convey a lot of ground. Whereas a lot situtate in the borough of Milton, Northumberland county, was conveyed by deed dated 3 Mar 1808, by the executors of ANDREW STRAUB, dec., agreeably to direction of the deceased last will and testament to John Chesnut in trust for the use of the Presbyterian congregation of the borough, and as the deed does not invest in the trustees a power to sell and convey the lot in case of necessity, and the congregation are in want of funds to defray the expense of erecting a new building for the purpose of divine worship. An act to incorporate the town of Stoystown, Somerset county. That the town of Stoystown, is hereby erected into a borough, bounded, beginning at a black oak south of GEORGE HARTZEL's tan yard, and a corner of JOHN LEHMER's land near a spring run, etc., to a corner of GEORGE KIMMEL's and Lehmer's land, on the west of the Connemaugh road, to north corner of the old burying ground on the west of Stoystown, to the lower part of the hollow in PETER KIMMEL's field, to beginning, and the electors are to vote at the house now occupied by JOHN KENNEDY. That GEORGE GRAHAM and John Lehmar and the constable of Quinnamahoning twp., shall publish and superintend the elections. 29 Mar 1819. 135. An act to incorporate a company for a road from Meansville, Bradford county, to the borough of Wilkesbarre, Luzerne county. That SAMUEL HODGDON, BENJAMIN TILGHMAN and RICHARD PETERS JR., of the city of Philadelphia, GEORGE CALHOON, BENJAMIN DORRANCE and JOSEPH BURGESS of Luzerne county, and WILLIAM MEANS, REUBEN HALE and JACOB BOWMAN, of Bedford county, are hereby appointed commissioners. 29 Mar 1819. 137. An act authorizing ABRAHAM WISMER and JOHN MICHENER, administrators of the estate of JOHN FUNK, to convey real estate. Whereas, John Funk of Hilltown twp., Bucks county, did in his lifetime enter into a contract with certain inhabitants of the townships of Hilltown, Bedminster, Plumstead, and New Britain, to convey to them in trust for the use of a school, a lot containing 1/4 acre, situated on the southeast corner of his plantation, adjoining the road leading from Newtown to Quakertown, Hilltown twp., to erect a school house. The school house has been erected but before it was completed the title executed agreeably to the terms of the contract, John Funk died intestate. Therefore, Abraham Wismer and John Michener, administrators are hereby authorized to grant and convey to JACOB LANDIS, HENRY ANGLEMOYER and ANDREW WILSON, in trust for the use of a school, 1/4 acre of land. 29 Mar 1819. 140. An act authorizing the trustees of the Lutheran Congregation of Springfield, Bucks county, to sell and convey real estate. Whereas, the Lutheran congregation of Springfield twp., by virtue of an indenture duly executed by ELIAS BIDDLEMAN and ANNA MARIA BIDDLEMAN, his wife, dated 1 Aug 1768, a lot containing 1 acre and 136 perches, and being desirous to sell for the benefit of the congregation. Therefore, PAUL APPLE and MICHAEL BARNET, trustees of the congregation are hereby authorized to sell and convey the lot bounded by ELIAS BIDDLEMAN, CASPER HEITER and others, and the proceeds applied to the benefit of the congregation. 29 Mar 1819. 145. An act to incorporate the Pittsburg and Beaver turnpike road company. That THOMAS CROMWELL, DAVID EVANS, WILLIAM ROBINSON JR., JOHN WAY, WILLIAM COURTNEY, HUGH DAVIS and ROBERT CAMPBELL of Allegheney county, DAVID SHIELDS of Washington county, ABNER LACOCK, JOSEPH HEMPHILL and ROBERT DARRAGH of Beaver county, are hereby appointed commissioners to lay down a road from the west end of the Alleghney bridge now building opposite the city of Pittsburg, to the Beaver bridge opposite the town of Beaver. 29 Mar 1819. 147. An act to incorporate a company to make a lock navigation on the west branch of the river Schuylkill. That SAMUEL WETHERILL JR., JOHN K. HELMUTH, ABRAHAM BARKER, JACOB HOLGATE, JAMES ASH, GEORGE W. MORGAN and CHARLES GRAFF, of the city and county of Philadelphia, GEORGE D.B. KEIM, JACOB K. BOYER, CURTIS LEWIS, WILLIAM WITMAN, JOHN M'KNIGHT and GEORGE BOON of Berks county, CHARLES SNOWDEN, DANIEL GRAEFF, PHILIP FRAILEY, GEORGE RAUSCH and ABRAHAM REIFSCHNEIDER of Schuylkill county, are hereby appointed commissioners to make a complete slack water navigation from the mouth of the west branch of Schuylkill, at its junction with the east branch, on the farm of DANIEL DREIBELBIS, situtated on the centre turnpike, about five miles from the town of Orwigsburg. 29 Mar 1819. 149. An act to authorize the settlement of the the accounts of DANIEL BUSSIER, late paymaster of Pa Militia. That the accountant officers of this commonwealth, are hereby authorized to adjust and settle the accounts of Daniel Bussier, late a paymaster of Pa militia, for monies expended by him under the act of 27 Feb 1813, on their receiving muster and unathenticated muster and pay rolls, and to admit to the credit of Daniel Bussier, such sums as shall be proper paid to the commissioned officers or substitutes for the use of a private of the company. 29 Mar 1819. 151. An act to enable the heirs of DAVID RUTTER, RUTH ANNA LINDLEY, JOHN CLEMENT STOCKER and MARY CATHARINE STOCKER, his wife, to make partition of lands held by them as tenents in common. Whereas, the above died seized as tenants in common, of various town lots and tracts of improved and unimproved land in the counties of Berks, Chester, Montgomery and Wayne, in the state of Pa., and of certain town lots in the borough of Pottsgrove and county of Montgomery, and whereas it is thought for the interest of the heirs, in whom the property is now vested, that partition of the same should be made, but as the heirs are numerous and generally either minors or married women, and the lands are situated in different parts of the state, and are incumbered with rights for raising of iron ore and other reservations, a partition would not do justice., therefore the heirs, not to consist of less then four fifths of a majority, with the consent of their guardians and husbands are to choose seven men to make partition and once approved shall be firm and stable. 29 Mar 1819. 153. JAMES M'GRAW, SAMUEL CLENDENNIN, THOMAS RICHARDS, JONAS PRESTON, of Cecil county, state of Maryland, are hereby appointed commissioners to improve the creek. 29 Mar 1819. 154. An act to enable JOSEPH TURNER, THOMAS RYERSON and others, to sell and convey lots in the city of Philadelphia. Whereas by a certain indenture tripartite, dated 10 Dec 1796, made between MOSES LEVY ESQ., of the city of Philadelphia, counselor at law, and MARY LEVY, his wife of the first part, Thomas Ryerson of the city, merchant, and MARY RYERSON his wife, of the second part, and the reverend Joseph Turner, of the district of Southwark in the county of Philadelphia, Pa., clerk, of the third part, there was granted by Moses Levy and wife to Joseph Turner, a certain piece of ground situated on the west side of Broad Street, between Vine and Sassafras streets, to Joseph Turner and his heirs in trust, for the sole use of Thomas Ryerson and Mary his wife, during the natural life of Mary Ryerson, upon trust only, for their use. Immediately after the death of Mary Ryerson, to the use of any children of them as tenents in common. If no heirs at the time of her death then to Joseph Turner, and his heirs forever. Whereas by another indenture, dated 8 Jan 1798, made between all the same parties, there was granted by Moses Levy and wife, to Joseph Turner a lot adjoining the last mentioned lot, to Joseph Turner and heirs in trust, and in case of death of Mary Ryerson, to vest in Thomas Ryerson and his heirs forever. And whereas Thomas Ryerson and Mary his wife are still alive, and have six children living, GEORGE ORMESBY RYERSON, MARRIELL RYERSON, THOMAS RYERSON JR., are of full age but ANN CATHARINE RYERSON, ESTHER TURNER RYERSON and JOSEPH TURNER RYERSON are in their minority. The trustee and three oldest children have petitioned for the benefit of all to grant the lots altogether, reserving ground rent annually, to the use of the same persons for the same estates. Therefore, it shall be lawful for Joseph Turner, the trustee, with the consent of Thomas Ryerson and Mary his wife, to grant, as often as necessary the two lots the best annual rent they are able to obtain, payable to the same persons, and all grants and leases shall be valid. 29 Mar 1819. 155. An act authorizing the sale of real estate, late of SAMUEL SELLERS, dec. That the administrators of Samuel Sellers, late of Bucks county, dec., are hereby authorized to sell all right and estate fo the deceased, in a certain tract of land situate in East Penn twp., Northampton county, on the Mahoney creek, adjoining lands of PHILIP SENDEL and others, containing about 300 acres and to execute a deed to the purchaser, in recongnizance in the orphan's court of Bucks county. 29 Mar 1819. 156. An act to prevent the continuance or establishment of obstructions to the navigation of the river Delaware. Whereas a compact was entered into on 26 Apr 1783, by ABRAHAM CLARK, JOSEPH COOPER and THOMAS HENDERSON, commissioners on behalf of the state of New Jersey, and GEORGE BRYAN, GEORGE GRAY and WILLIAM BINGHAM, commissioners for PA., that the river Delaware shall remain a common highway, therefore, no bridge, or other device shall be erected between New Jersey and Pa. Therefore, the commissioners are to view the dam from Yard's island to the Jersey shore and to insist on its removal. 29 Mar 1819. 160. A supplement to an act to incorporate the Union Canal company of PA. A further supplement for making a roads. That for making a road from Northumberland, to the west branch of the Susquehanna, near the mouth of Anderson's creek, five companies shall be incorporated. DE GRUCHY and JACOB DENTLER, of the county of Northumberland, GEORGE KREAMER, JACOB MUSSER, HUGH WILSON, (ridge) of the county of Union, are hereby appointed commissioners for the first section of the road between Northumberland and Youngmanstown, and GEORGE LATIMER of the city of Philadelphia, WILLIAM WHITMAN of the county of Berks, JOHN DRIESBOUGH, JOHN WILSON, (Hartleton) and HENRY ROUSH, of the county of Union, and JAMES DUNCAN of the county of Centre, are hereby appointed commissioners for the second section of the road between Youngmanstown and Aaronsburg, and RICHARD WISTAR, of the city of Philadelphia, JACOB K. BOYER, of the county of Berks, MICHAEL BOLLINGER, JOHN KEEN, WILLIAM IRWIN, JOHN FURY and JOHN MITCHEL of the county of Centre, are hereby appointed commissioners for the third section of the road between Aaronsburg and Bellefonte, and SIMON GRATZ, of the city of Philadelphia, THOMAS BURNSIDE, JOSEPH M.
