Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 2. An act for the relief of CASPER LEOB, a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to Casper Leob, of Lebanon county, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1823. 4 Jan 1823. 3. An act for the relief of MARGARET PATTERSON, widow of ALEXANDER PATTERSON, a captain of the revolutionary war. That the state treasurer is hereby authorized to pay to Margaret Patterson, of Easton, Northampton county, widow of Alexander Patterson, a captain of the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1823. 4 Jan 1823. 4. An act granting a patent for a lot of land, in Huntington Township, Luzerne county. That, if SIMON TUBBS shall make it appear to the board of property, that he is entitled to two undivided third parts of lot #38, in the third division of lands in Huntingdon twp., containing in the whole, 135 acres and 128 perches, and pays the purchase money to the treasury, with interest, the Secretary of the Land Office is hereby authorized to grant a patent to Simon Tubbs, for the whole land. 4 Jan 1823. 5. An act for the relief of HENRY STOUFFER, a revolutionary soldier. That the state treasurer is hereby authorized to pay to Henry Stouffer, of Somerset county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1823. 4 Jan 1823. 6. An act for the relief of PETER ALLEN, a revolutionary soldier. That the state treasurer is hereby authorized to pay to Peter Allen, as a gratuity, forty dollars immediately. 10 Jan 1823. 9. An act for the relief of HENRY MILLER and DAVID BOWER, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Henry Miller, of Franklin county, a revolutionary soldier, the sum of forty dollars, to be paid half yearly, during life, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to David Bower, of Lancaster county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, to be paid half yearly, during life, to commence on 1 Jan 1823. 14 Jan 1823. 10. An act granting compensation for a tract of donation land. That the state treasurer is hereby authorized to pay to ADAM KOCH, (of Somerset county,) $300.00, as a compensation for a tract of donation land, to which he was entitled for services rendered in the revolutionary war. 14 Jan 1823. 11. An act for the relief of JOSEPH FOX, a revolutionary soldier. That the state treasurer is hereby authorized to pay to Joseph Fox, of Greene county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, to be paid half yearly, during life, to commence on 1 Jan 1823. 14 Jan 1823. 12. An act for the relief of DENNIS DAILLY, ANDREW REED, REUBEN COOK and PETER VINCENT, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Dennis Dailly, of Washington county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars during life, to be paid half yearly, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay immediately, to Andrew Reed, of Chester county, a revolutionary soldier, a gratuity of forty dollars. That the state treasurer is hereby authorized to pay to Reuben Cook, of Tioga county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars during life, to be paid half yearly, to commence the 1 Jan 1823. That the state treasurer is hereby authorized to pay to Peter Vincent, of Lycoming county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars during life, to be paid half yearly, to commence on 1 Jan 1823. 16 Jan 1823. 14. An act authorizing a sale of real estate. That ABRAHAM OVES, administrator of JACOB MILLER, late of the borough of Harrisburg, Dauphin county, dec., is hereby authorized to sell and dispose of all or part of the real estate that Jacob Miller died seized, and by deed to convey to the purchaser, provided that ABRAHAM ADDAMS, the father and guardian of ANN ELIZABETH ADDAMS, and LYDIA ADDAMS, minor daughters, under the age of fourteen years, shall previous to receiving the money, from the sale, enter recognizance before the orphan's court of Perry county, conditioned for the faithful application of money coming into his hands for the sole use of the minor children. 21 Jan 1823. 15. An act for the relief of MARY M'CURDY, widow of WILLIAM M'CURDY, a captain of the revolutionary war. That the state treasurer is hereby authorized to pay to Mary M'Curdy, of the city of Lancaster, widow of William M'Curdy, a captain in the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1823. 21 Jan 1823. 16. A supplement to an act declaring Wysox creek, a public stream or highway. That Wysox creek, Bradford county, from JACOB MYER's mill dam, to _____ BARNE's mill, a distance of 4 miles, is hereby declared a public highway, provided this act shall not be construed to extend to any dam or dams already erected, nor more injurious to navigation than those already erected. (Note: Heading states Luzerne county) 21 Jan 1823. 17. An act for the relief of ANDREW M'KEE. That the state treasurer is hereby authorized to pay to Andrew M'Kee, the sum of $750.00, in full, for a tract of donation land, which was granted him as a reward for his services as a revolutionary soldier, situate in what is commonly called the Struck Donation, in the second district, #301, containing 200 acres, a part of which was recovered by actual settlement, provided the right of any person to any part of the tract, claimed under the title granted by the state to M'Kee, shall revert to the commonwealth. 21 Jan 1823. 18. An act to empower the executors to sell a tract of land. That WILLIAM BOAL and ROBERT GEDDIS, executors of the last will and testament of THOMAS M'ALLEN, who died in 1821, are authorized to sell a certain tract of land, and the improvements, situate in Londonderry twp., Dauphin and Lebanon counties, adjoining lands of JACOB EARLY, Robert Geddis and others, and convey by deed, to the purchaser, and the proceeds from the sale, shall be applied in the manner directed by the last wills and testaments of Thomas M'Allen and MARY M'ALLEN. 29 Jan 1823. 22. An act to incorporate the Gettysburg Water company. That the present members of the Gettysburg water company, JOHN M'CONAUGHY, JOHN HERSH, J.B. M'PHERSON, ALEXANDER COBEAN, BERNARD GILBERT, GEORGE SMYSER, WALTER SMITH, SAMUEL H. BUEHLER, JOHN HERBEST, DAVID M'CONAUGHY, JAMES DOBBEN, ROBERT G. HARPER, SAMPSON S. KING, MICHAEL C. CLARKSON, JAMES A. THOMPSON, ADAM WALTER, JACOB WINTERODE, JOHN ERMON, THADDEUS STEVENS, WILLIAM M'CLELLAN JR., CHARLES S. DITERLINE, JAMES SCANDLING, GEORGE ZIGLER, DAVID ZIGLER, ROBERT HUNTER, JACOB EYSTER, EPHRAIM MARTIN, JOHN GARVIN, ANN GIFFIN, MICHAEL BOBST, JAMES GETTYS, GEORGE ARNOLD, ROBERT GOLDER, THOMAS J. COOPER, JOHN ARENDT and JOHN LISLE, are hereby constituted a body politic and corporate, for the purpose of supplying the inhabitants of the town of Gettysburg with water, and to complete the bringing of a stream of water from land purchased of DANIEL HECK, within the borough of Gettysburg by means of pipes etc. 29 Jan 1823. 23. An act to incorporate a company, to make an artificial road. That PUTNAM CATLIN, JONAS BRUSH, SAMUEL BISSELL and NOAH PRATT, of Susquehanna county, JOHN MILLER, WILLIAM CLARK, NATHAN BACON, and HENRY W. DRINKER, of Luzerne county, and LILLIBRIDGE MUMFORD, of Wayne county, are hereby appointed commissioners to make a road from the Phladelphia and Great Bend turnpike, Abington twp., to intersect the Milford and Owego turnpike, east of Montrose, from the Philadelphia and Great Bend turnpike, to Nathan Bacon's, to the outlet of North Pond, etc. 1 Feb 1823. 25. An act authorizing WALTER OLIVER to sell lands in Mercer county, the property of ELEANOR JUNKIN, a minor. That Walter Oliver, of Mercer county, is hereby authorized to sell all or part of tracts or lots of donation land in Mercer county, as he and JOHN JUNKIN, in his life time, may have purchased at sale for taxes, in partnership, and in which Eleanor Junkin, a minor, daughter and heir of John Junkin, dec., holds an equal and undivided interest, and to make a deed for the same, and to pay proceeds to her guardian. 13 Feb 1823. 26. An act to review a state road. That JOHN SHOEMAKER, of Roxbury, SAMUEL T. SWANSEY and FRANCIS G. PATTERSON, are hereby authorized to meet at Roxbury, Franklin county, and proceed to review that part of the state road laid out from Carlisle, through Newville and Roxbury, to the Burnt Cabins, which lies between the town of Roxbury and the line of Fannet twp., Franklin county. 13 Feb 1823. 29. An act authorizing a review of a road. That ROBERT HILANDS, of Allegheny county, ABRAHAM ZEIGLER, of Butler county, and HUGH BINGHAM, of Mercer county, are hereby appointed commissioners to review the road leading from the city of Pittsburg to the borough of Mercer, through Zelienople, Harmanie and Harlensburg, with power to alter the location. 13 Feb 1823. 30. An act to incorporate the Strasburg Academy, in the borough of Strasburg, Lancaster county. That the trustees of Strasburg Academy, are: SAMUEL MILLER, JOHN SEITZ, HUGH M'CLUNG, ARCHIBALD M'ALISTER and GEORGE MILLER. 13 Feb 1823. 31. An act for the relief of REUBEN WINDSLOW. That the state treasurer is hereby authorized to pay the balance of the three per centum appropriated for the building of a bridge over the river Susquehanna, near the mouth of Anderson's creek, to Reuben Windslow, contractor for building the bridge. 18 Feb 1823. 32. An act incorporating a company for the making of a turnpike. That WILLIAM M'CANDLESS and WILLIAM LECKY, of the city of Pittsburg, and JAMES PATTERSON, JOSEPH WILSON, NOBLE CALHOUN, HENRY BELTSHOOVER and JOSEPH CURRY, of the county of Allegheny, are hereby appointed commissioners, to lay out a road from the south end of the Monongahela bridge, to the top of the Coal Hill, so as to intersect the road from Birmingham towards Brownsville. 19 Feb 1823. 33. An act for the relief of PETER BETZ, JAMES M'CUNE and GEORGE ROGERS, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Peter Betz, of Dauphin county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to James M'Cune, of Northumberland county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence 1 Jan 1823. That the state treasurer is hereby authorized to pay to George Rogers, of Lancaster county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence the 1 Jan 1823. 19 Feb 1823. 36. An act to incorporate the Musical Fund Society, of Philadelphia. That WILLIAM P. DEWEES, ROBERT M. PATTERSON and JOHN K. KANE, are hereby declared a body politic and corporate, for the relief of decayed musicians and their families, and the cultivation of skill and diffusion of taste in music. 22 Feb 1823. 37. An act for the relief of JACOB SIGLER, a revolutionary soldier. That the state treasurer is hereby authorized to pay to DAVID GOOD, of Lancaster county, for the use of Jacob Sigler, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars during life, to be paid half yearly, to commence on 1 Jan 1823. 22 Feb 1823. 44. An act granting compensation to JAMES BARRETT, for a tract of donation land. That the state treasurer is hereby authorized to pay to JAMES BARRETT, of Columbia county, immediately, $300.00 in full, for compensation for a tract of donation land to which he was entitled for services rendered in the revolutionary war. 24 Feb 1823. 45. An act to annul the marriage of FRANCIS D. CUMMINS, and ESTHER CUMMINS, his wife. That the marriage contract entered into by Francis D. Cummins, and Esther his wife, of Dauphin county, late of Baltimore, is hereby declared null and void, and they are hereby discharged from the contract, and all duties as if they had never been joined in marriage. 27 Feb 1823. 48. An act authorizing a review of the state road. That DAVID LAWSON, of Armstrong county, and JOHN PARKER, of Butler county, and JAMES GILKEY, of Mercer county, are hereby appointed commissioners to review that part of the state road laid out from a point near the county line between Armstrong and Jefferson, where the state road from Milesburg to Erie crosses, through the borough of Mercer to the Ohio state line, in a direction to Warren, east of the borough of Mercer, so that the road commences on the Susquehanna and Waterford turnpike road, west of Powers. That SAMUEL BELL and MEEK KELLY, of Indiana county, and DAVID FERGUSON, of Clearfield county, are hereby appointed commissioners to review the road leading from the borough of Indiana to the northern turnpike road, near the mouth of Anderson's creek, Clearfield county. 27 Feb 1823. 58. An act authorizing the court of Common Pleas of Franklin county, to do certain things. That upon the application of WILLIAM M'KEAN, of Franklin county, it shall be the duty of the court of Common pleas to grant a rule on the administrators of the estate of ALEXANDER SCOTT, late of the borough of Chambersburg, Franklin county, dec., requiring them to appear and show cause, why some suitable person should not be appointed as trustee to superintend a judgement entered on the records of the court: Jan term, 1821, #325, in favor of THOMAS G. M'CULLOH, for the use of Alexander Scott, against William M'Kean, and said trustee shall be vested with all the rights and authorities of Alexander Scott dec. 10 Mar 1823. 59. An act appointing commissioners to lay out a state road. That JOHN BENNET and SIMON TUBBS, of Luzerne county, and EZEKIEL COLE of Columbia county, are hereby appointed commissioners to view and lay out and mark a state road from the west end of the bridge over the Susquehanna river, at the borough of Wilkesbarre, Luzerne county, through Huntingdon twp., to the town of Washington, Columbia county. 13 Mar 1823. 60. An act authorizing a review of the state road. That JOHN NEGLEY, JACOB MECHLING SEN., and BENJAMIN WALLACE, are hereby appointed to review that part of the state road between the borough of Butler and Mercer, which lies between Butler and the farm of ALEXANDER W. GALBRAITH, and to intersect the road between the farm of ROBERT WALLACE and Alexander W. Galbraith, Butler county. 13 Mar 1823. 61. An act to improve the navigation of the river Lackawaxen. That it shall be lawful for MAURICE WURTS, of the city of Philadelphia, to enter upon the river Lackawaxen, most suitable for improving the same, to make a good and safe descending navigation, from Wagner's Gap, Luzerne county, to Rix Gap, Wayne county, to the mouth of the river Lackawaxen. 13 Mar 1823. 62. An act appointing commissioners to lay out a state road. That ALEXANDER MOORE, of Northumberland county, THOMAS WOODSIDE, of Columbia county, and JONATHAN WESTOVER, of Luzerne county, are hereby appointed commissioners to lay out a state road commencing at the town of Catawissa, through Bloomsburg, crossing the bridge at Nob mountain, to the Susquehanna and Tioga turnpike, near the house of GAD SEAWARD, in Huntingdon twp., Luzerne county. That 1/3 of the moneys appropriated by the act passed 26 Mar 1821, for the improvement of the road from the foot of the north side of the little mountain on the branch of Catawissa and Centre road, ton Mahonoy gap, as remains, is hereby appropriated for the purpose of opening the Catawissa and Centre road from the Catawissa bridge to JOHN YEAGER's tavern, and improving the road leading from the Catawissa to the Tioga turnpike road. 13 Mar 1823. 64. An act to enable the guardians and trustees of SAMUEL THOMPSON, to dispose of his real estate. That HUGH BROTHERTON and JACOB GROVE, guardians and trustees of Samuel Thompson, an habitual drunkard, of St. Thomas Twp., Franklin county, are authorized to sell and convey all the real estate as may appear just and reasonable, and to vest the proceeds of the sale in the purchase of other real estate, for the use of Samuel Thompson and his family. 13 Mar 1823. 66. An act for the relief of PETER STORM. That the act passed 6 Mar 1814, is hereby extended to the case of Peter Storm, late of the borough of Hanover, York county, as if he had continued to reside in the borough of Hanover. 15 Mar 1823. 68. An act to lay out a state road. That ISAAC A. CHAPMAN and STEPHEN BALLIOT, of Luzerne county, and JAMES SHAFER, of Northampton county, are hereby appointed commissioners to lay out a state road beginning at the town of Conyngham, Luzerne county, up the head waters of Little Nescopeck, by Swamp creed to strike the Lehigh near the mouth of Sandy Island run, thence across the Lehigh to intersect the Easton and Wilkesbarre turnpike road, in Northampton. 18 Mar 1823. 69. An act for the relief of CONRAD HAHNLEN. Whereas, Conrad Hahnlen, an alien, residing since 1805, in the county of Lancaster, purchased real estate previous to the 23 Mar 1818, and as Conrad Hahnlen, did on 9 Feb 1823, file a declaration of his intention to become a citizen of the United States. Therefore, the title of Conrad Hahnlen to a house and two lots situated in the village of Bainbridge, Donegal twp., Lancaster county, are hereby confirmed and made valid as if he had filed his intention of becoming a citizen previous to the purchase of them. 18 Mar 1823. 70. An act for the relief of LYDIA LORAIN and her children. That JAMES WILMER, surviving trustee, named in a deed of trust, between JOHN LORAIN, and LYDIA LORAIN, his wife, James Wilmer and J.A. M'CUTCHEON, dated 11 Jul 1810, is hereby authorized to sell and convey all the real estate held by James Wilmer, in trust, and to make to the purchaser good title for the same, and to invest the proceeds in stock or mortgages of at least double the amount of the money, Philadelphia county. That if any of the children of John and Lydia, become of full age, it shall be lawful for the trustee to pay over to each child their share of the proceeds of the sale. 18 Mar 1823. 71. For the relief of the widow of WILLIAM M'KUOWN, dec. That so soon as the widows and children of age, and guardians of the minor children of William M'kuown, late of Lancaster county, dec., shall execute a release to the commonwealth of all their right and title to two certain tracts of land, #3759 & 3773, situated partly in Jefferson and partly in M'Kean counties, sold on 12 Mar 1808, to William M'kuown, as the property of JOHN NICHOLSON, dec., and deliver the same to the attorney employed by the commonwealth, to bring suit against William M'Kuown, now dec., in Lancaster county, Aug term, 1812, #88, the judgement shall be released, on payment of the costs due, by the executors of William M'Kuown, dec., and the attorney of the commonwealth is hereby required to release the same. 18 Mar 1823. 72. An act to incorporate the Juniata Bridge Company, Huntingdon county. That JOHN BLAIR, CHRISTIAN GARBER, MAXWELL KINKEAD, JOHN SCOTT, JACOB GROVE, WILLIAM KERR JR., WILLIAM JACKSON, ROBERT ALLISON, DAVID NEWINGHAM, JOHN M'CAHAN, WILLIAM STEEL, DOCTOR JOHN HENDERSON and JOHN M'CONNELL, all of the county of Huntingdon, are hereby appointed commissioners to complete two bridges over the Juniata river, where the Huntingdon, Cambria and Indiana turnpike road crosses, between Huntingdon and Alexandria, in Huntingdon county. 25 Mar 1823. 76. An act to incorporate a company for making a canal and lock navigation on the river Susquehanna, near the borough of Harrisburg. That JOHN ZINN, JOHN FORSTER, JACOB M. HALDEMAN, OBED FAHNESTOCK, JOHN CAPP, SAMUEL POOL, PETER KELLER, ROBERT HARRIS, JOHN B. COX, ABRAHAM OVES, CHRISTIAN GLEIM, JOHN S. WIESTLING, WILLIAM LE BARRON, JACOB BUCHER and JOHN GINGERICH, are hereby appointed commissioners for making a canal on the waters of the river Susquehanna, to supply the borough of Harrisburg with water, and to insure against fire. 27 Mar 1823. 77. An act for the better employment, relief and support of the poor of the township of Bristol, Philadelphia county. That ALGERNON S. LOGAN, JOHN L. WILLIAMS, ISAAC MICHENER, and SILAS WILSON, are hereby appointed guardians for the relief and employment of the the poor of the township, and shall be one body politic and corporate. 27 Mar 1823. 80. An act to erect the town of West Middletown, Washington county, into a borough. The borough shall be bounded: beginning at a post south of Wellsburg road, between GALBREATH STEWART and JACOB WALTER's land, thence to a white oak in DAVID CRAIG's land, to a red oak of EZEKIEL DAVIS' lot, thence to a black oak of HENRY COTTON's, and the Washington road, to the corner of WILLIAM VASBINDER's lot, to a stone in Galbreath Stewart's orchard, to beginning. The electors shall vote at the house of DANIEL M'GUGIN. 27 Mar 1823. 82. An act vacating a part of the old state road, leading from the borough of Washington, Washington county, towards Wheeling in Virginia. That so much of the state road, leading from the borough of Washington, toward Wheeling, lying between the bridge at the lower end of Wheeling street, to where the same intersects the road leading from JACOB WEIRICK's to the national turnpike, is hereby vacated. 27 Mar 1823. 86. An act to authorize the sale of the interest of minor children in real estate. That SAMUEL COCHRAN, guardian of WILLIAM DUNLAP, and of PETER SMITH, ELIZA SMITH, and JANE SMITH, minors and grandchildren of JAMES DUNLAP, formerly of Chester county, dec., is hereby authorized to sell and convey all right, and property of the minor children, to the real estate of their grandfather, and to make a good title. 29 Mar 1823. 87. An act to authorize and empower DOROTHEA SMITH, administratrix of JACOB SMITH, dec. to convey real estate. That Dorothea Smith, widow and sole administratrix of Jacob Smith, dec., formerly of Germantown, Philadelphia county, is hereby authorized to sign, seal, and deliver a good and sufficient deed, to JOHN KNORR, of Germantown, cedar cooper, for a messuage or tenement, and lot, situate on the west side of main street, in Germantown, by land of ANTHONY JOHNSON, by ground of PETER DIDIER, by land of MICHAEL KEYSER, and ground of PETER DIDIER, (being the same premises devised to Jacob Smith, by the last will and testament of his father, GEORGE SMITH, who died, seized thereof,). 29 Mar 1823. 89. An act to authorize the executors of the last will and testament of ROBERT ANNAN, dec., to mortgage his real estate. That Robert Annan and DOCTOR SAMUEL ANNAN, executors of REVEREND ROBERT ANNAN, late of Lancaster county, dec. is authorized to borrow on mortgage of the real estate of the testator, situated within the city of Philadelphia, such sum as necessary, for the purpose of paying the debts of the estate, and the legacies. 29 Mar 1823. 93. An act to incorporate the Columbia Water Company. That CHRISTIAN BRENNEMAN, JACOB FORREY, JACOB MATHIOT, JAMES CLYDE, and JAMES SWEENEY, are hereby appointed commissioners for the purpose of supplying the inhabitants of the borough of Columbia with water, by means of pipes, trunks, or aqueducts. 29 Mar 1823. 95. An act allowing the compensation to CHARLES WIDNEY, JAMES ADDAMS and JOHN HARMAN, for their services, as commissioners, for completing public roads. That the commissioners of Franklin county are hereby authorized to draw an order in favor of Charles Widney, for the amount found due, for services rendered as commissioner. That the commissioners of Perry county, are hereby authorized to draw an order in favor of James Addams, for the amount found due, for services rendered as commissioner. POTTER, of the town of Bellefonte, are hereby appointed commissioners for erecting a bridge over the Allegheny river, at the place where the turnpike road crosses the same, in Venango county. An act for the relief of CATHARINE CADWALLADER, widow of JOHN CADWALLADER, dec. Whereas, John Cadwallader, late of Huntingdon county, dec., was indebted to the commonwealth for the sum of $400.00 with interest until paid, to secure the payment for two mortgages on a house and eight lots in the town of Huntingdon, which is about to come due, and if payment be enforced by a sale of the mortgaged premises, his widow and children would be overwhelmed in ruin and distress. And whereas, John Cadwallader has since conveyed one of the lots being lot #205 in the plan of the town, to MICHAEL AFRICA, an innocent purchaser, and the remaining lots being amply sufficient for securing the payment. Therefore, all proceedings are hereby suspended for seven years, and lot #205 is hereby forever released from the payment of the debt and interest. 29 Mar 1823. 108. An act authorizing a review of part of a state road. That JAMES FILSON, of Metal twp,, ANDREW BARKLEY, of Fannet twp., and JOHN SHOEMAKER, innkeeper, of Roxbury, Franklin county, are hereby authorized before the 1 Jul next, to review that part of the state road which lies between the foot of the mountain, east of MARY TEMMON's house, in Fannet twp., Franklin county, and the foot of the Tuscarora mountain, in Metal twp., Franklin county, and if able to open and keep in repair the road they shall proceed to lay it out as a public road. That the court of quarter sessions of Berks county, are hereby authorized to grant a review of the state road from Berrysburg, Dauphin county, to the borough of Reading, Berks county, from the house of JOHN BELLEMAN, in Tulpehocken twp., through the lands of JACOB MILLER, dec. to the house of DANIEL HESS, in Bethel twp., Berks county, and to inquire and vacate any part of the road as laid out between the house of John Belleman and Daniel Hess, which they judge to be useless and inconvenient. 29 Mar 1823. 112. An act suspending the opening of a state road. That the opening of the part of the state road, laid out from the borough of Bedford, thorough the borough of Indiana, to the town of Franklin, which passes through the farm of WILLIAM SMITH, in the township and county of Bedford, is hereby suspended, and the township shall pay William Smith $30.00, which shall be a full amount said township shall be liable to pay for opening the road. 29 Mar 1823. 113. An act for the relief of WILLIAM WILLINK, HENDRICK VOLLANHOVEN and RUTGER JAN SCHIMMELPENNINCK. That William Willink, Hendrick Vollanhoven and Rutger Jan Schimmelpenninck, of the kingdom of Holland, who survived NICHOLAS VAN STAPHORST, CHRISTIAN VAN EAGHEN and PETER STADNITSKE, are hereby authorized to grant and convey all their lands in this commonwealth, and all title and interest in any lands in this commonwealth, to any person whatsoever, though such person should be aliens, in trust, or absolutely, upon such terms as seem fit. That JOHN MUMFORD, JIRAH MUMFORD JR., SAMUEL ROGERS JR., JOHN WRIGHTER, SQUIRE SAMPSON, THOMAS MEREDITH, RUFUS GRINELL, and LUTHER STARK, are hereby appointed commissioners to lay out a road which shall commence near Sugar Loaf mountain, in Susquehanna county, on the Belmont and Ochquaga turnpike, and thence to Hale's eddy, on the Delaware river. 31 Mar 1823. 117. An act to cede and vest in the United State of America, certain premises in the county of Philadelphia, whereon the arsenal is erected. An act for the relief of the heirs of PHILIP WAGER, late of the city of Philadelphia, dec. Whereas, by patent dated 26 Feb 1787, there was granted to GEORGE BATES, a private in the revolutionary army, as a donation, a tract of 200 acres in the 8th district, #1658, and George Bates on 13 Apr 1787, for the consideration of $100.00 did sell the tract to Philip Wager, of Philadelphia. and whereas the heirs of Philip Wager have made frequent inquiries about tax on the land and found that it was paid by some other person, but never knew by whom, until 1819, when they discovered the #1658 was drawn and patented to another person, and that #1558 was the tract drawn for Bates, and the mistake was made in the patent to him, in consequence of which the heirs of Philip Wager have been deprived of their just dues. Therefore, the Secretary of the Land Office is hereby directed to issue, free of expense, to ADAM REIGART ESQ., of the city of Lancaster, one of the executors of the last will and testament of Philip Wager, late of the city of Philadelphia, dec., in trust for the uses and purposes in the will, a patent for the tract of donation land in the 8th district, #1558, containing 200 acres, which was intended to be granted to George Bates, for his services as a private in the revolutionary war. 31 Mar 1823. 124. An act authorizing compensation for damages done by state roads. That JACOB MILLER, HENRY LORE ESQ., and JACOB ALTER, are hereby appointed viewers to adjudge the damages, if any, sustained by JAMES FERRIL, in consequence of the state road, leading from the White Horse tavern on the top of the Allegheny mountain through Berlin to Connelsville, laid out through two lots, #12 & 13, in the town of Berlin, making return to the court of Somerset county. That the judges of the court of quarter sessions, of Mercer county, are hereby authorized to appoint a view, to judge the amount of damage, if any, sustained by JOSEPH ALEXANDER and FRANCIS HUEY, in consequence of a state road, leading from the borough of Mercer to the town of Franklin, having been laid out and carried through their improved land. 31 Mar 1823. 126. An act to authorize the laying out a state road. That ABRAHAM MORRISON, of Somerset county, WILLIAM DAVIDSON, of Fayette county, and CHARLES FULWOOD, of Westmoreland county, are hereby appointed viewers to lay out a state road from near WILLIAM STEEN's tavern, on the turnpike between Bedford and Washington, to intersect the state road passing from the White Horse tavern, at the top of the Allegheny, to Connelsville. 31 Mar 1823. 127. An act to incorporate the Columbia, Chiques, and Marietta Road and Bridge company. An act directing the survey of a route for a canal between Lake Erie and French creek. An act to convey two small parcels of land. Whereas, THOMAS WM. HARPER and SARAH HARPER, his wife, contracted for the sale of two parcels of land, in Clearfield county, the title for which was in the said wife, and as the purchasers have paid a considerable portion of the purchase money, and no deeds have been made in the lifetime of Sarah, therefore, Thomas Wm. An act to remove the obstructions at the entrance of the harbor of Presque Isle. An act to incorporate a company to erect a railroad. An act authorizing the orphans' court of Adams county, to appoint trustees under the last will and testament of CHARLES STEWART. Whereas, Charles Stewart, of the borough of Gettysburg, Adams county, by his last will and testament, devised certain real estate to several persons and their heirs in trust, without designating any mode by which, others might be appointed in their stead, therefore, in case the trustees shall die, resign, refuse to act, or remove from the state, then the orphans' court of Adams county, shall nominate some suitable person trustees. 1 Apr 1823. 150. An act for the relief of JAMES DUFFY, a contractor for making the Hanover and Carlisle turnpike road. That the treasurer of the Hanover and Carlisle turnpike road company, at least four time per year, shall pay to the court of common pleas of Adams county, the amount of tolls on the first fifteen miles, and the court, upon application by James Duffy of Lancaster county, who contracted and finished the road, and is a judgement creditor of the company, make provision to comply with court order, until the amount of debt and interest on two judgements for the sum of $875.20 and $3000.00 entered at the Adams county court dated Apr term 1819, #78 & 79, are fully paid. 1 Apr 1823. 151. An act for various purposes. That MAXWELL KENNEDY is hereby authorized to make sufficient deed of conveyance for a lot, the property of JAMES KENNEDY, who is non compos mentis, containing one acre, situate on the west side of Newport turnpike road, and adjoining lands of AMOS SLAYMAKER, unto the trustees of the Presbyterian congregation of Belleview church, in Salsbury twp., Lancaster county, for the sole purpose of erecting a house for religious worship. That JOSIAH WRIGHT, who survived ZEBULON BUTLER, (as trustees) and ROBERT LEWIS and SARAH LEWIS his wife, are hereby authorized to sell and convey to a purchaser, a certain tract of land, situate in Wilkesbarre twp., Luzerne county, containing 112 acres, which said tract is held by deed of trust to Zebulon Butler, since deceased, and Josiah Wright, for the use of Sarah Lewis, and her heirs. That FRANCIS SCOTT, grandson of FRANCIS ARMSTRONG, dec. is hereby authorized to sell and convey a plantation and tract of land in York county, called "Garter's Hill" not far from "Peach Bottom Ferry" of which Francis Armstrong died seized, and apply the monies to the use set forth in the will of the deceased. That ANDREW MARKLEY, BENJAMIN MARKLEY and ABRAHAM MARKLEY, executors of the last will and testament of JOHN MARKLEY, late of New Hanover Twp., Montgomery county, dec., are hereby authorized to convey unto JOHN KURTZ, of Montgomery county, all right, title and interest of John Markley dec., to a messuage and lot of ground, containing 12 acres, with appurtenanees, situate in Lower Providence twp. 1 Apr 1823. 152. An act for the relief of TACY COATES. That all the right, title and claim of this commonwealth, to the estate of SALLY ANN COATES, alias SALLY ANN ROSITER, the illegitimate daughter of ANN COATES, late of Charlestown twp., Chester county, dec., who died without heirs, is hereby vested in Tacy Coates. 1 Apr 1823. 153. A supplement for the improvement of the state. That JOHN SHALL, JACOB SHELLY and JOHN KRATER, are appointed commissioners to preform the duties of the act passed 26 Mar 1821, and to improve the road laid out from Orwigsburg to the falls of Nescopeck etc. and they are to pay $400.00 to DAVID ZEHNER, GEORGE BACHER and CHRISTIAN KLINGEMAN, of Schuylkill county, to improve the navigation of the little Schuylkill, from the mouth as far as practicable, in Rush twp. 1 Apr 1823. 155. An act for the relief of sundry soldiers of the revolutionary war. That the state treasurer is hereby authorized to pay to GEORGE CLARK, of Cumberland county, WILLIAM MACHEMER, of Berks county, ADAM HERBOLD, of Bedford county, JOHN SMITH, of Lebanon county, CASPER SHIRTZER, of Washington county, Maryland state, JOHN WEBER of Lehigh, and CHRISTOPHER ROHN of Philadelphia county, each forty dollars immediately, and an annuity of forty dollars each, payable half yearly, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to THOMAS FULLERTON, of Crawford county, forty dollars immediately and an annuity of forty dollars, payable half yearly, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to JOEL BAILEY, the remaining arrears of the pension of FRANCIS STACKHOUSE, dec. and Joel Bailey is hereby authorized to divide the same amongst the persons who furnished necessaries for the funeral and burial of Francis Stackhouse. 1 Apr 1823. 156. An act authorizing JOHN M'MEENS and EDWARD RITCHEY, to sell and convey lands in Centre county. Whereas, ROBERT RITCHEY, of Lycoming county, PA. has been for a number of years past in a deranged state of mind, so as to be unfit to transact any business, and being possessed of a tract of unseated land in Nitney valley, Centre county, altogether unproductive and yielding nothing to contribute to the support of Robert Ritchey, and it being considered by the children of Robert Ritchey, that if the tract was sold and proceeds vested in productive fund, that would assist in the support of Robert Ritchey, therefore, John M'Meens, of Lycoming county, and Edward Ritchey, of Centre county, are hereby authorized to make sale ofthe tract of unseated land in Nitney valley, Bald Eagle twp., Centre county, containing 318 acres and 116 perches, and to make and convey to the purchaser a deed, and proceeds vested in a productive fund. 1 Apr 1823. 159. An act for the relief of SAMUEL GAMBLE, supervisor of Fannett twp., Franklin county, and JOHN JOHNSON, of Fayette twp., Allegheny county. That the next road tax assessed in Fannett twp., Franklin county, of which $127.50 shall be paid over to Samuel Gamble, supervisor of the year 1820, to indemnify him for money advanced in that year. That the next road tax assessed in Fayette twp., Allegheny county, of which $125.00 be paid over to John Johnson, to indemnify him for his services as a supervisor of the township. 1 Apr 1823. 161. An act appointing trustees to close the concerns of the Silver Lake Bank. That SAMUEL WARNER, BENJAMIN LOTHROP, WILLIAM JESSUP, of Susquehanna county, SAMUEL BOSWORTH and HIRAM MIX, of Bradford county are hereby appointed trustees of the Silver Lake bank, for the purpose of closing the affairs thereof. 1 Apr 1823. 162. An act to exonerate the estate of the late JAMES HANNA ESQ., dec. from the payment of certain monies. Whereas, the late James Hanna Esq., dec. in his lifetime, viz: In the year 1817, as brigade inspector of the 2nd brigade, composed of the counties of Somerset and Cambria, in the 12th division of the militia of this state, put into the hands of JACOB MASON, then the constable of Somerset twp., Somerset county, a warrant for the collection of fines against delinquent militia men, amounting to $717.00, of which James Hanna received $5.00 only, by reason of the constable having, shortly after, his house and papers burnt, and in consequence of his losses, becoming insolvent, and his bail having paid the amount of their bond to other creditors of the constable, therefore, the executors of James Hanna, are hereby exempted from the payment, to this commonwealth, of the uncollected part of the warrant. 1 Apr 1823. 163. An act for the relief of JOHN FORD. That the state treasurer is hereby directed to pay to John Ford, the sum of $20.66, the balance of his expenses advanced in keeping in repair the tents, knapsacks etc. at the Arsenal at Harrisburg. 1 Apr 1823. 167. An act authorizing a review of state roads. That the court of Berks county, is hereby authorized to appoint six persons, to view the part of the state road, from Berrysburg to the borough of Reading, from SAMUEL JONES's line through land of GEORGE GASHES and ISAAC ADAMS, to a road leading to Sinking Springs, in Heidleberg twp. 1 Apr 1823. 168. An act granting compensation to JOSEPH REED. That the state treasurer is hereby authorized to pay to Joseph Reed, the sum of $1680.00 for superintending the publication of the sixth and seventh volumes of the laws, preparing the indices and abstracts, agreeable to the act and supplement passed in 1821 and 1822 to contract with JOHN BIOREN, for printing, and to allow him compensation at the rate of $2.25 for 600 pages. 1 Apr 1823. 170. An act for the relief of JACOB MECHLING. That the state treasurer is hereby authorized to pay to Jacob Mechling, the sum of $600.00, in full for a tract of donation land, which was granted to ADAM HERBOLD as a reward for his services as a revolutionary soldier, whose right became legally vested in Jacob Mechling, situate in what is called the Stuck Donation, in the 2nd district, #304, containing 200 acres, from which Jacob Mechling has been evicted. 1 Apr 1823. 171. That the state treasurer is hereby authorized to pay to ADAM RAHN, for the use of PHILIP REISER, of Berks county, a revolutionary soldier, forty dollars immediatley, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to MARY YOUNG, of Lebanon county, (widow of CHRISTIAN YOUNG, a revolutionary soldier) forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to SAMUEL M'CLELLAND, of Lancaster county, a lieutenant in the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to JOHN M'CAMMON, of Middletown, Dauphin county, in trust and to be applied to the use of JOHN BELL, of Dauphin county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1823. That the state treasurer is hereby authorized to pay to MICAJAH POSEY, of Chester county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on the 1 Jan 1823. That the state treasurer is hereby authorized to pay to PETER HOLSTEIN, of Philadelphia county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence the 1 Jan 1823. That the state treasurer is hereby authorized to pay to DORCAS HOLLIDAY, of Huntingdon county, widow of JOHN HOLLIDAY, a captain in the revolutionary war, sixty dollars immediately, and an annuity of sixty dollars, payable half yearly during life, to commence the 1 Jan 1823. That the state treasurer is hereby authorized to pay WILLIAM HOLGATE, of Montgomery county, forty dollars immediately, and an annuity of forty dollars during life, to commence 1 Jan 1823. 1 Apr 1823. 176. A supplement to an act concerning the formation of a map of Pa. passed 19 Mar 1816. That the secretary of the commonwealth and the surveyor general are hereby authorized to take possession of all the plates, prints and other property of this commonwealth, which was in the possession of the late JOHN MELISH, and now in the possession of his legal representatives. 1 Apr 1823. RESOLUTIONS 1. Resolved that WILLIAM R. SMITH, of the Senate, and JACOB HOLGATE of the House of Representatives, by a committee to correspond GEORGE M. DALLAS, of the city of Philadelphia, who is hereby authorized to take charge of the copper plates of the state map, and all copies, belonging to the commonwealth, now in the hands of the representatives of JOHN MELISH, dec., and to deposit the same in some proper place. 16 Jan 1823. 5. Resolved that the secretary of the commonwealth and surveyor general may permit HENRY S. TANNER, of the city of Philadelphia, to have the use of the surveys of the different counties, which were furnished to the late JOHN MELISH, also the use of the state map, to enable Henry S.
