SUTHERLAND, Speaker of the House of Representatives THOMAS BURNSIDE, Speaker of the Senate. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act appointing commissioners to mark a line dividing the counties of Cumberland and Perry. That JOHN HARPER of Cumberland county, JOHN COX, of Franklin county, and ROBERT CLARK, of Perry county, are hereby appointed commissioners to mark a line between the two counties, for which they shall receive $1.00 per day. 23 Dec 1824. 5. An act authorizing the review of a road. That THOMAS RINGLAND, of Washington county, and WILLIAM KINCAID and THOMAS LEAZURE, of Greene county, are hereby appointed commissioners, to review a state road, commencing at Bell's Cross Roads, about 2 miles west of Jefferson, Greene county, to West Alexander in Washington county, which passed through the lands of TIMOTHY ROSS and CAREY M'CLELLAND, Greene county, to judge if that part of the road can be altered to do less injury to them and the former part of the road thenceforth vacated, if adjudged to be moved. 13 Jan 1825. 6. An act authorizing the review of a road. That THOMAS RINGLAND, WILLIAM KINCAID, and THOMAS LEAZURE, to preform the same duties as in act #5, from a post near a field owned by JOHN T. RINEHART, to terminate at a knob on the southeast corner of his place and if the road can be altered to do less injury to John T. Rinehart. 13 Jan 1825. 7. An act authorizing a review of a road. That ROBERT BOGGS, BARNET GILLELAND and STEPHEN CRAWFORD, of Butler county, are hereby appointed to review part of the old Franklin road which lies between the house of MARTIN BYRNE and that of JOHN BROWN, (of Oliver,) with power to alter the same. 13 Jan 1825. 9. An act for the relief of GREER M'ILVAIN and others. That the judges of the court of quarter sessions of Washington county, are hereby authorized on the petition of Greer M'Ilvain, DAVID HART, MARY HUFFMAN, and SOLOMON HUFFMAN, to appoint men to judge the amount of damages, if any, sustained by them in consequence of a state road leading from Mount Pleasant, Westmoreland county, to the National Road, east of the borough of Washington, having been laid out through their lands. 15 Jan 1825. 11. An act to incorporate the Presbyterian Congregation of Cross Creek, in the county of Washington. That the Presbyterian congregation of Cross Creek twp., Washington county, is hereby erected into one body politic and corporate, and the trustees are: AARON LYLE, JAMES SMITH, GEORGE MILLER, JOHN GRAHAM, JOHN JOHNSTON, EBENEZER SMITH, JOHN STEVENSON, WILLIAM M'LAIN, and ROBERT PATTERSON. 19 Jan 1825. 13. An act for the relief of JANE FORTENBAUGH, ROSANNA WEIDLEY and CATHARINE MUSKETNUSS, widows of revolutionary soldiers. That the state treasurer is hereby authorized to pay to Jane Fortenbaugh, of Dauphin county, widow of CAPTAIN HAWKINS BOON, a soldier of the revolution, the sum of sixty dollars immediately, and an annunity of sixty dollars payable half yearly during life, to commence on 1 Jan 1825. That the state treasurer is hereby authorized to pay to Rosanna Weidley of Lancaster county, and Catharine Musketnuss, of the city of Lancaster, forty dollars each, immediately, and an annunity of forty dollars each, payable half yearly, during life, to commence on 1 Jan 1825. 19 Jan 1825. 14. An act for the relief of PATRICK METLIN, WILLIAM EVANS and GEORGE CHAPMAN, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Patrick Metlin, of Union county, to William Evans of Montgomery county, and to George Chapman, of Lycoming county, forty dollars each immediately, and an annuity of forty dollars each, payable half yearly during life, to commence on 1 Jan 1825. 19 Jan 1825. 15. An act to incorporate the PA. Fire Insurance company. That the PA Fire Insurance company of Philadelphia is hereby declared one body politic and corporate, and the directors are: JONATHAN SMITH, R.A. CALDCLEUGH, WILLIAM BOYD, THOMAS KITTERA, HENRY TOLAND, DAVID CORREY, PAUL BECK JR., JOHN H. STEVENSON and JOHN R. NEFF. 25 Jan 1825. 16. An act for the relief of MARY DIXON and SARAH MILLER, widows of revolutionary soldiers. That the state treasurer is hereby authorized to pay to Mary Dixon, of Cumberland county, and Sarah Miller, of Northumberland county, forty dollars each immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1825. 31 Jan 1825. 17. An act for the relief of NICHOLAS STRAW, a soldier of the revolution. That the state treasurer is hereby authorized to pay to Nicholas Straw, of Clearfield county, a revolutionary soldier, the sum of forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1825. 8 Feb 1825. 18. An act for the relief of ISABELLA CRESWELL, widow of CHARLES CRESWELL, a soldier of the revolution. That the state treasurer is hereby authorized to pay to Isabella Creswell, of Chester county, widow of Charles Creswell, a soldier of the revolution, the sum of forty dollars immediately, and an annuity of forty dollars payable half yearly during life, to commence on 1 Jan 1825. 8 Feb 1825. 19. An act for the relief of JOHN BELL and DANIEL MILLER, revolutionary soldiers. That the state treasurer is hereby authorized to pay to John Bell, of Clearfield county, and Daniel Miller of York county, forty dollars each immediately, and an annuity of forty dollars each, payable half yearly during life, to commence on the 1 Jan 1825. 8 Feb 1825. 20. An act for the relief of ROBERT HAMILTON, and MARGARET LODGE, widow of JONATHAN LODGE. That the state treasurer is hereby authorized to pay to Robert Hamilton of Lycoming county, the sum of $200.00, in full for his services rendered during the revolutionary war, and to Margaret Lodge, of Columbia county, widow of Jonathan Lodge, dec., the sum of $200.00, in full for services of her late husband, during the revolutionary war. 8 Feb 1825. 21. An act vesting the right of the commonwealth to a certain tract of land, in the heirs of SARAH ROBESON. Whereas, WILLIAM ROBESON, late of Greene county, did acknowledge that the tract of land, adjoining lands of JOEL CLOUD, SAMUEL HOULSWORTH, and the heirs of TIMOTHY SMITH, in Cumberland twp., Greene county, on which he resided, immediately before his death, had been purchased by him, and paid for out of the proceeds of a tract of land, the property of his wife Sarah and her children, by a former husband, by the name of DAVID WRIGHT, which he sold with his wife's consent, with the intention at his death, his wife and her heirs, should inherit his whole estate, real and personal, which will was not carried into effect, by reason his real estate is supposed to have escheated to this commonwealth. Therefore, all rights and title to this tract of land, is forever relinquished and vested in the heirs of Sarah Robeson, his wife (she now being dead,) forever. 11 Feb 1825. 22. An act for the relief of ISAAC MEYER, a revolutionary soldier. That the state treasurer is hereby authorized to pay to ISAAC MEYER, of Lancaster county, forty dollars immediately, and an annuity of forty dollars payable half yearly during life, to commence on 1 Jan 1825. 11 Feb 1825. 23. An act for the relief of HENRY SIEGEL, JACOB STEHLE and DAVID KERBAUGH, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Henry Siegel, of Northumberland county, and to Jacob Stehle, of Lancaster county, forty dollars each, and an annuity of forty dollars each, payable half yearly during life, to commence on 1 Jan 1825. That the state treasurer is hereby authorized to pay to CASPER SCHLATTER, of Montgomery county, in trust, for the use of David Kerbaugh, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars payable half yearly during life, to commence on 1 Jan 1825. 12 Feb 1825. 24. An act for the relief of WILLIAM BROWN, JOHN HESSER and WILLIAM RICHE, revolutionary soldiers. That the state treasurer is hereby authorized to pay to William Brown, of Westmoreland county, to John Hesser, of Schuylkill county, and to William Riche, of Montgomery county, forty dollars each, immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on the 1 Jan 1825. 12 Feb 1825. 25. An act for the relief of PHOEBE SHRYOCK, MARGARET CLAUBAUGH, and PHOEBE ANDERSON, widows of revolutionary soldiers. That the state treasurer is hereby authorized to pay to Phoebe Shryock, of Bedford county, to Margaret Claubaugh, of Huntingdon county, and Phoebe Anderson of Philadelphia county, forty dollars each, immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1825. 12 Feb 1825. 26. An act for the relief of MARY CAIN, and ELIZABETH BILLS, widows of revolutionary soldiers. That the state treasurer is hereby authorized to pay to Mary Cain, of the city of Philadelphia, and to Elizabeth Bills of Philadelphia county, forty dollars each, immediately, and an annunity of forty dollars to each, payable half yearly, to commence on 1 Jan 1825. 15 Feb 1825. 28. An act establishing a bank in the district of Southwark, Philadelphia county. That SAMUEL HUMPHREYS, RICHARD PALMER, RICHARD REUSHAW, THOMAS D. GROVER, GEORGE M'LEOD, JOHN KEEFE, ROBERT M'MULLIN, JOSHUA RAYBOLD, GEORGE MORTON, DR. HARVEY KLAPP, JOHN FLOYD, BENJAMIN MARTIN, H.L. CORYELL, ROBERT COBURN, ANDREW MONTGOMERY and WILLIAM M'GLINSEY, are hereby appointed commissioners to establish a bank, to be called the Southwark Bank. 21 Feb 1825. 29. An act to incorporate the Atlantic Insurance Company of Philadelphia. That the first directors are: THOMAS P. COPE, LEWIS CLAPIER and SAMUEL ARCHER, who can make all kinds of marine insurance. 23 Feb 1825. 30. An act to authorize the sell of real estate. Whereas, REBECCA GRACE, late of Coventry twp., Chester county, by her last will, dated 6 Feb 1799, did order her executors to sell the remaining part of a plantation, situate in said twp., bounded by lands of THOMAS HASKINS, Warwick company, lands late of THOMAS HOCKLEY and THOMAS POTTS, dec., and wereas, letters testamentary were on 5 May 1801, granted to BENJAMIN JACOBS ESQ., one of the executors named in the will, (the other, ROBERT MAY, not being present) and whereas he did sell the plantation on 13 Oct 1801 to Robert May and convey it by deed dated 17 Mar 1802, and Robert May entered into possession, but doubts have arisen to the validity of the sale, and as the court of West Chester on 3 Nov 1824, ordered the land sold by Robert May for debts of Robert May dec. and for his minor children's education. The land was put up for sale on 1 Jan 1825 and sold to CALAB NORTH, of the city of Philadelphia; in order to remove all doubts to the title, and to enable DAVID POTTS JR., administrator to make a perfect title, therefore, in virtue of the recited public sale and deed of conveyance, David Potts Jr., is hereby authorized to execute and perfect a title to Calab North. That JACOB HAUSER and JOSEPH HAUSER, executors of the last will and testament of ULRICH HAUSER, dec., are authorized to make sale of the real estate of Ulrich Hauser, and to execute a deed in Northampton county, to the purchaser, provided nothing herein shall authorize the executor to sell and convey the two lots of land devised by the testor's last codicil to his daughter ELIZABETH HAUSER. 23 Feb 1825. 34. An act to incorporate the Conestogo Navigation Company. That ADAM REIGART, EDWARD COLEMAN, GEORGE B. PORTER, JASPER SLAYMAKER, JOHN F. STEINMAN, GEORGE LOUIS MAYER and HUGH MAXWELL, of the city of Lancaster, and JOHN LINTNER and GEORGE HAVERSTICK, of the county of Lancaster, are hereby appointed commissioners, to make a complete navigable canal for the passage up and down the river Conestogo from the mouth, to the city of Lancaster. 3 Mar 1825. 35. An act to incorporate the Huntingdon and Philipsburg turnpike road company. That for the purpose of making a turnpike road from the borough of Huntingdon, Huntingdon county, to Philipsburg, Centre county, GEORGE AUSHUTZ, GEORGE DAVIS, JOHN NEFF, HENRY P. DORSEY, and JOHN SHOENBERGER, of Huntingdon county, and HARDMAN PHILIPS, JACOB TEST and HENRY LORAIN. of Centre county, are hereby appointed commissioners. 3 Mar 1825. 36. A supplement to an act to authorize the Orphans' Court of Bucks county, to appoint trustees, under the last will and testament of JOHN CORSON, dec. That the court shall have the power to appoint a trustee. 3 Mar 1825. 37. An act for the relief of ABRAHAM ESHELMAN, JAMES HOGAN, JAMES LAUTHER, and WILLIAM STAPLETON, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Abraham Eshelman, of Lancaster county, to James Hogan, of Delaware county, to James Lauther, of Franklin county, and to William Stapleton, of Chester county, forty dollars each immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence on 1 Jan 1825. 3 Mar 1825. 41. An act authorizing the laying of a state roads. That WILLIAM SCOTT, ANDREW CHRISTY and JOHN GORDON, are hereby appointed commissioners to lay out a state road, from the borough of Mercer, through Greenville, to the state line, near WILLIAM MOSSMAN's, in a direction to Kinsman, so as to meet some leading road in the state of Ohio. 9 Mar 1825. 43. An act for the relief of ANN EDDY and ELIZABETH DOUGHERTY, widows of revolutionary soldiers. That the state treasurer is hereby authorized to pay to Ann Eddy, of Chester county, and to Elizabeth Dougherty, of Washington county, forty dollars each, immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence on 1 Jan 1825. 9 Mar 1825. 44. An act for the relief of PHILIP ROEMER, VALENTINE GUZARD and THOMAS WARD, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Philip Roemer, of Franklin county, to Valentine Guzard, now residing in the state of Ohio, and to Thomas Ward, of Columbia county, forty dollars each, immediately, and an annuity of forty dollars each, payable half yearly during life, to commence on 1 Jan 1825. 9 Mar 1825. 46. An act to incorporate the Presbyterian congregation of Cross Roads, in Washington county. That the Presbyterian congregation of Cross Roads, Washington county is hereby erected into one body politic an corporate, and the following named persons shall be trustees: MOSES JACKSON, JAMES M'FERRAN, JAMES RANKIN, WILLIAM CAROTHERS, JOHN FULLERTON, JOHN BRICELAND, JESSE CULLY, ELIJAH CRAFFORD and WILLIAM WITHROW. 21 Mar 1825. 49. An act authorizing the sale of real estate. That in case, of death, resignation etc., of trustees named in the last will and testament of GEORGE BISBING, late of Whitepain twp., Montgomery county, dec., the orphans' court on petition of the daughters shall appoint another to sell all real estate, consisting of one messuage and 235 acres of land in Whitepain twp., and about 235 acres in Penn's twp., formerly Northumberland, now Union county, for the best price and convey the right and title, to the purchasers, and the proceeds shall be put out by them in land or other securities, and interest to be paid annually to the daughters during their lifetimes, and after the death of any of them, 1/4 part of the net amount shall be distributed amongst the children of the deceased daughter. That it shall be lawful for the justices of the orphans' court of Chester county, on petition of the widow of HENRY RHODES, dec., late of Charlestown twp., or any child of the deceased, to award an inquest to make partition of the lands of the deceased. That JACOB K. GARBER, committee of the person and estate of HENRY GARBER, of Lancaster county, (a lunatic,) is hereby authorized to purchase such real estate, tenements or hereditaments, as he may think proper and have made a deed in trust for Henry Garber, and said real estate shall descend upon the death of the said lunatic, to those entitled to his personal estate. 21 Mar 1825. 51. An act authorizing the sale of real estate. That DAVID SHULTZ, administrator de bonis non with the will annexed, of JOHN WAMPLER, late of Manheim twp., York county, is hereby empowered to sell and convey all the right and title of John Wampler, dec., to a plantation and tract of land, known by the name of Wampler's Defence, and to distribute all moneys from the sale according to the will. 21 Mar 1825. 52. An act for the relief of JOHN BURNIE and THOMAS DUFFIELD, revolutionary soldiers. That the state treasurer is hereby authorized to pay to John Burnie, of Crawford county, and to Thomas Duffield, of Philadelphia county, forty dollars immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence on 1 Jan 1825. 21 Mar 1825. 55. An act to annul the marriage contract of CHARLES MORRIS and ANN MORRIS his wife. That the marriage contract entered into between Charles Morris and Ann his wife, both of York county, is hereby annulled and the parties released from all duties as fully as if they had never been joined in marriage, provided nothing herein shall render illegitimate the children of the marriage. 22 Mar 1825. 56. An act for the relief of ANDREW OTT, CASPER CAMP, and ROBERT CRAWFORD, revolutionary soldiers. That the state treasurer is hereby authorized to pay to Andrew Ott, of Philadelphia county, to Casper Camp, of Crawford county, and to Robert Crawford of Venango county, each forty dollars immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1825. 22 Mar 1825. 57. An act for the relief of JOHN JOHNSON and others. That it shall be the duty of the supervisors of Fayette twp., Allegheny county, and they are authorized to assess and collect $237.41 and pay the same, to John Johnson and JOHN ROBB, for their services and expenditures, as late supervisors of the twp. That it shall be the duty of the supervisors of Pitt and Wilkins twps., Alleghney county, are hereby authorized to assess and collect $235.00 and pay the same to WILLIAM M'CLAIN, for his services in making and repairing a part of a road in said township. That the road tax, assessed in Metal twp., Franklin county, by the supervisors it may be lawful for them, and they are hereby authorized to collect $190.00 and pay it over to JOHN CAMPBELL, being late supervisor of Metal twp., it being money expended by him, on the highways, and for costs and damages he sustained in defending a suit in behalf of the township, against JOHN PARKS, late supervisor of the township. 22 Mar 1825. 58. An act concerning state roads and a bridge. That GEORGE BIDDIS, JOHN BRINK, JAMES WALLACE and JAMES BARTON of the commonwealth of Pa. and JAMES STOLL, JOHN GUSTIN, GEORGE NELDEN and ABRAHAM BRAY of the state of New Jersey, are hereby appointed commissioners to build a bridge over the Delaware river. That the act to lay a road named The Gettysburg and Hagerstown turnpike road, is revived and JOHN HERSH, BERNHART GILBERT, ANDREW MARSHALL, JAMES M'KEESON and WILLIAM M'MILLAN all of the county of Adams, and LEWIS RIPPLE and ALEXANDER GORDEN of the county of Franklin, are hereby appointed commissioners. 22 Mar 1825. 59. An act for the relief of THOMAS WILLING's representatives, of CHARLES KUHN and wife, and of ELIZABETH LEAMY. That in all cases of devises and bequest, contained in the last will and testament of THOMAS M. WILLING, late of the city of Philadelphia, dec., or in any of the codicils, where one of the testators sons is named as a trustee, and the trusts by reason of the lunacy of George, found by inquisition , duly returned into the court of Philadelphia county, be deemed and taken to be vested, according to the vestments in the will, as if George Willing were deceased, to be completed by the trustees without the participation, consent or knowledge of George. Therefore, all estates, interests, powers and authorities devised by the last will are hereby declared to be vested in RICHARD WILLING, of the city of Philadelphia. That all lands, tenements, hereditaments, trusts, estates, moneys and effects, which might have been vested in EDWARD TILGHMAN, of the city of Philadelphia, counselor at law, and CASPER WISTAR, the younger, of the same city, physician, by virtue of a certain indenture, dated 14 Dec 1810, in deed book I.C. #18, pg 12, executed by Charles Kuhn, of the city, merchant, and ELIZABETH HESTER KUHN, now the wife of Charles Kuhn, shall be vested in Benjamin Tilghman and George Emlen. Whereas, ELIZABETH DOUGHTY, previous to her intermarriage with JOHN LEAMY, of the city of Philadelphia, executed certain deeds, for granting and securing to the separate use of Elizabeth, after her intended marriage, certain real and personal estate, and the late WILLIAM BRADFORD and JOHN COXE are both deceased, leaving no heirs to execute the trusts. Therefore, it shall be lawful for the supreme court to appoint some suitable person trustee with all the powers given by the deeds. 22 Mar 1825. 60. An act granting compensation to the heirs of FRANCIS VERPELIA, for a tract of donation land. That the state treasurer is hereby authorized to pay to JOSEPH FRY JR., of Lehigh county, in trust for the use of the children of Francis Verpelia, $300.00 in full for a tract of donation land to which he was entitled for his services in the revolutionary war. 22 Mar 1825. 62. An act for the relief of SAMUEL BLYTHE, a captain in the revolutionary war. That the state treasurer is hereby authorized to pay to Samuel Blythe of Franklin county, sixty dollars immediately, and an annuity of sixty dollars payable half yearly during life, to commence on 1 Jan 1825. 25 Mar 1825. 63. An act for the relief of L. MANLIUS SARGENT. That L. Manlius Sargent, of the city of Philadelphia, is hereby authorized in his own name and as guardian of his minor children, to sell and convey, any lots within the city, belonging to MARY SARGENT, his late wife, to the purchaser, reserving rents payable for his lifetime and thereafter to his children. 25 Mar 1825. 64. An act revising the incorporation of the Northampton Water Company. The act passed 13 Feb 1816 shall be revived and JOHN J. KRAUSE, HENRY WILSON, ABRAHAM NEWHARD, SOLOMON GANGEWEHR and HENRY SCHNEIDER JR., are hereby appointed commissioners. 25 Mar 1825. 69. An act to incorporate the town of New Castle, Mercer county, and the town of Blairsville, Indiana county. That the town of New Castle, Mercer county, is hereby erected into a borough, and elections shall be held at the house of ARTHUR CHENOWITH, and he and WILLIAM DICKSON ESQ., shall publish and superintend the elections. That the town of Blairsville, Indiana county, shal be erected into a borough, beginning at a hickory on the bank of the river Conemaugh, thence by land of SAMUEL MOORHEAD JR., thence by land of JAMES CAMPBELL, etc., and GEORGE MULHOLLAND JR., and JACOB KUHNS of the borugh, shall publish and superintend the elections. 25 Mar 1825. 74. An act authorizing the sale and conveyance of certain real estate, and for other purposes. That MATTHEW DAVIS, guardian of JOHN HIESTER and MARY ANN HIESTER, of Chester county, is hereby authorized to sell, two pieces of land, on situated in East Nantmeal twp., Chester county, containing 102 acres, bounded by land of Warwick company, ROBERT STEWART and MARTHA RUTTER, being #7, of the diagram of the partition of the estate of DAVID RUTTER, late of Berks county, also, another piece of land, #16, on the same diagram, situate in Earl twp., Berks county, bounded by lands of HENRY RHOADS, GEORGE RHOADS, FREDERICK BEIDERMAN and others, containing 28 acres and 16 perches, and to convey to the purchaser all the right and title of John Hiester and Mary Ann Hiester in this land, and to vest the proceeds in some profitable stock. The interest from the same shall be for the use of SAMUEL HIESTER during his life, and at his death, shall be equally divided between John and Mary Ann Hiester. That ANDREW BOGGS, of Westmoreland county, is hereby authorized to make and execute a deed of conveyance to JOHN POWEL, of the same county, for a plantation situate on the Conemaugh river, in Conemaugh twp., Indiana county, opposite the point, adjoining lands of ROBERT WRAY and DANIEL KEELY, containing 80 acres, with the same effect as if Andrew Boggs and his former wife, the late JANE J. An act to sell and convey real estate. Whereas, JOHN PAXSON and JONATHAN PAUL, executors of the last will and testament of ANTHONY LE BON, late of Bensalem twp., Bucks county, represented that Anthony Le Bon, being an alien, had filed in the district court at Philadelphia, his intention of becoming a citizen of the United States, but that he had died before becoming a citizen, and in his lifetime had purchased a tract of land, which he empowered his executors to sell, but they are unable to convey a title to the purchaser as Anthoney Le Bon was an alien at the time of his death. Therefore, the executors are hereby authorized to sell and convey the real estate and to make a good deed of conveyance, as Anthony Le Bon had been a citizen of the United States. MORRISON, and JOHN KEEFE, are hereby appointed commissioners to view part of the state road between the borough of Bedford and the borough of Indiana, that was made by WILLIAM SMITH, and if agreeably completed and he shall be entitled to the provisions of the act passed 29 Mar 1823. 11 Apr 1825. 84. An act authorizing the sale of real estate. Whereas, LORD BUTLER, late of the borough of Wilkesbarre, Luzerne county, died intestate, being seized of a considerable real and personal estate, a principal part of which personal estate consists of money, most of which, from the difficulties attending its collection and the distant periods fixed for the payments, cannot be obtained by his administrators, in time to discharge debts due. According to the existing laws, no real estate can be sold for the payment of his debts, except upon a deficiency of the personal estate of the intestate, and whereas he had several children, who are yet in their minority, and who cannot, therefore, consent to the sale of the real estate, therefore, it shall be lawful, for GARRICK MALLARY, JOHN L. BUTLER and CHESTER BUTLER, administrators of the estate, to sell as much of the real estate as may be necessary for the payment of the debts of the intestate, and to make and execute to the purchaser deeds of conveyance. If the administrators are unable to sell part of the estate it shall be lawful to mortgage such parts of the estate to raise money upon loan, as they find necessary. Whereas, by an act to authorize PRISCILLA DILL, widow of THOMAS DILL, dec., WILLIAM WIREMAN SEN., and WILLIAM WIREMAN JR., guardians of the minor children of Thomas Dill, and administrators of the estate of CALEB DILL, dec., to sell and convey 1/4 part of two tracts of land, in Monaghan twp,, York county, passed on 22 Feb 1808, and part of the estate yet remains unsold, and Priscilla Dill and William Wireman Sen., have deceased, and William Wireman Jr., has repreesented that through age and infirmity, he has become unable to perform the duties of the trust, and prayed to be discharged. An act to erect a bank, within the district composed of the counties of Bradford, Wayne, Luzerne and Susquehanna, to be called The Northern Bank of PA. An act for the relief of ANN MARIA STUCKY, JANE NORTON, MARY SALLIDAY, MARGARET MAGEE and BARBARA GUY, widows of revolutionary soldiers. An act for the relief of WILLIAM DOUGHERTY, FREDERICK NIPPLE and WILLIAM M'MULLIN, revolutionary soldiers. That the state treasurer is hereby authorized to pay to William Dougherty, of Mercer county, and to Frederick Nipple, of Mifflin county, forty dollars each immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1825. An act to authorize the executors of JAMES ANDERSON, deceased, to sell real estate of the testator. That WILLIAM BARBER and JANE ANDERSON, executors of the last will of James Anderson, late of the borough of York, York county, dec., be authorized to sell and convey the real estate by the orphan's court for the purpose of discharging debts of the deceased. 11 Apr 1825. 101. An act to enable STEPHEN HENDERSON and CHRISTOPHER TENANT, executors of JOHN BENNET, dec., to sell and convey real estate. Whereas, by the last will and testament of John Bennet, late of the city of Philadelphia, dec., his executors Stephen Henderson and Christopher Tenant, are directed to divide all the remainder of the testator's estate among his nephews and nieces, at the expiration of ten years, and whereas, John Bennet, on 7 Jun 1823, died, and it was his intention to confer power to his executors to sell his real estate, and the executors are desirous of fulfilling the intentions of the testator, without waiting the ten years, by immediately distributing the estate among the objects of his bounty, most of whom reside abroad, therefore, it shall be lawful for them to sell and convey any of the real estate and to make good deeds to the purchasers. 11 Apr 1825. 102. Tannehill, widow of Captain Tannelhill, of Allegheny county, sixty dollars immediately, and an annuity of sixty dollars, paid half yearly, during life, to commence on 1 Jan 1825. That the state treasurer is hereby authorized to pay to SUSANNA FULLER, of Fayette county, to SARAH BAYLOR, of Lancaster county, and CATHARINE LOVE, of Luzerne county, forty dollars each immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence 1 Jan 1825. An act to incorporate a company for making a turnpike road. That DAVID MARCHAND, JOHN B. ALEXANDER, JOSEPH MARKLE and JOHN C. An act for the relief of JOHN M'HENRY, and others, revolutionary soldiers. That the state treasurer is hereby authorized to pay to John M'Henry of Tioga county, state of New York, to LAWRENCE KUNTZ, of Mifflin county, to PETER STROHL, of Northampton county, to ROBERT GIBB, of Westmoreland county, and to ISAAC M'CAMANT, of Mercer county, forty dollars each, immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1825. An act for the relief of SAMUEL RICHARDS and MOSES M'CORMICK, and to authorize DANIEL BECKLY and others to convey a lot of ground. That all the right and title which this commonwealth may have acquired by reason of escheat, from the want of heirs or kindred of ADAM RICHARDS, formerly of Uwchlan twp., Chester county, dec., to the personal estate, shall be vested in Samuel Richards, the illegitimate son of Adam Richards, dec. That Moses, the illegitimate son of SARAH M'CORMICK, of Connelsville twp., Fayette county, one of the children and heirs of WILLIAM M'CORMICK, dec. hereafter, under the name of Moses M'Cormick, shall enjoy all rights and privileges of a child born in lawful wedlock, as if he had been the legitimate son of Sarah M'Cormick. That part of Peters and Montgomery twps., Franklin county, beginning to the Bedford county line, on the Core mountain, along the turnpike road, beyond the tavern lately belonging to ENOCH SKINNER, dec., thence to MARTIN HOOVER's house, to St. Thomas Twp. line, to Metal twp. line, to SAMUEL JONES's house, etc. is hereby erected into a separate election district, and the electors shall hold their elections at the house now occupied by THOMAS SCOTT, in the town of Loudon. 11 Apr 1825. 112. An act to authorize the administrator de bonis non, with the will annexed, of the estate of GEORGE STOUGH, dec., to sell and convey real estate of the testator. That FREDERICK STOUGH, administrator, of the estate of George Stough, dec., late of Dover twp., York county, is authorized to sell and convey real estate being contiguous to and situate on the west side of the main street, in Dovertown, bounded by lots of GEORGE LENEHART and ADAM FORST. 11 Apr 1825. 113. An act authorizing WILLIAM M'BRIDE and DANIEL PURSELL, guardians of the minor children of ELISHA BARTON JR., dec., to sell and convey a lot of land in Columbia county, and for other purposes. Whereas, that Elisha Barton Jr., dec., late of Columbia county, died intestate, leaving a widow, and four children who are minors, in the possession of 140 acres of land, and that the estate is indebted, and that ABRAHAM MILLER, the grandfather of the minors, did bequeath to the children and their mother, 54 acres, and all parties wish the land sold to pay the debts of Elisha Barton, dec. Therefore, the guardians of the minor children are hereby authorized to sell all the rights and title of the grandchildren of Abraham Miller, and the widow of Elisha Barton Jr., dec., in the 54 acres, devised in his will by Abraham Miller to his daughter and grandchildren, situate in Bloom twp., and the guardians are hereby authorized to execute a deed to the purchaser. Whereas, the first three sections of an act passed 22 Mar 1825, for the relief of THOMAS M. WILLING's representatives, of CHARLES KUHN and wife, and of ELIZABETH LEAMY, the M. was inserted by mistake, therefore, the act shall be deemed for the use of THOMAS WILLING's representatives. That ABIGAL CHERRINGTON and JEREMIAH LEE, executors of the last will and testament of WILLIAM CHERRINGTON, late of Berks county, dec., are hereby authorized to sell a house and lot of ground, situate in the town of Frankford, Philadelphia county, late the property of the deceased, and to convey to the purchaser all the rights and title by deed, and to vest the proceeds of the sale in some profitable stock. The profits or interest shall be for the use of Abigail Cherrington, during her natural life, if she shall remain unmarried, but upon the marriage or death of Abigail Cherrington, said proceeds shall be divided between the four daughters of William Cherrington, dec.: RUTH ANN CHERRINGTON, SARAH LEE CHERRRINGTON, ANN LEE CHERRINGTON and EMILY CHERRINGTON, for the use of them. 11 Apr 1825. 115. An act making appropriations to defray certain expenses of government therein mentioned. That the sum of $35.00 be appropriated for paying STEPHEN HILLS, for drawing, a plan for improving the public ground, likewise for a design for a fence and gateway, and for assisting to level and measure the public ground, and the sum of $20.00, be appropriated for paying WILLIAM WILSON ESQ., for measuring, leveling, etc. of the public ground, and the sum of $50.00 be appropriated for discharging a balance due to FREDERICK ZIMMERMAN, for painting the public offices. That ROBERT DICKEY, doorkeeper of the Senate, and THOMAS WALLACE, doorkeeper of the House of Representatives, be appointed to take charge of the Capitol, during the recess of the legislature, for which they will receive $30.00 each. 11 Apr 1825. 117. An act for the relief of ROGER NORTH, and others, soldiers of the revolution. That the state treasurer is hereby authorized to pay to Roger North, a revolutionary soldier, of Chester county, to WILLIAM BRANDON, of Butler county, THOMAS SHEARMAN, of Columbia county, and to JOHN TAGERT of Belmont county, state of Ohio, forty dollars to each, immediately, and an annuity of forty dollars to each, during life, payable half yearly, to commence on 1 Jan 1825. That the state treasurer is hereby authorized to pay to VALENTINE STAHL, in trust for JOHN PAFFENBERGER, of Schuylkill county, and to PETER SEIDLE, of Ohio state, forty dollars each immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence on 1 Jan 1825. That the state treasurer is hereby authorized to pay to CHARLES M'COY, of Perry county, to JACOB WEYANDT, of Berks county, and to ABRAHAM WILSON, of Mifflin county, forty dollars each, immediately, and an annuity of forty dollars to each, payable half yearly, during life to commence on 1 Jan 1825. That the state treasurer is hereby authorized to pay to CONRAD AUBEL, of Union county, and to WILLIAM REX, of Northampton county, forty dollars each, immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence on 1 Jan 1825. That the state treasurer is authorized to pay to CONRAD KLINE, of Washington county, in the state of Maryland, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1825. 11 Apr 1825. 118. An act for the relief of JACOB REASER, GEORGE SEES, JAMES HERRINGTON, and others. That the state treasurer is hereby authorized to pay to Jacob Reaser, the sum of $220.31, in full of a balance due to him for work done in repairing arms at the state arsenal, at Meadville. That the Auditor General is hereby authorized to draw his warrant on the state treasurer, in favor of George Sees, of the city of Philadelphia, for $51.18 1/2, being a balance due to him, under contract with the late adjutant general, for the repair of sundry arms, and for which the sum appropriated for cleaning and repairing arms is inadequate. That the Auditor General is authorized to settle the account of James Herrinton, for repairs and work done in mounting certain brass field pieces, in the state arsenal, at Meadville, by virtue of a contract with the late adjutant general, for the balance justly due, not to exceed $45.76. That the Auditor General is hereby authorized to settle and adjust the account of HUGH HAZELTON, for repairing public arms, by order of MAJOR LAMBERTON, late brigade inspector, first brigade, seventh division, Pa. Militia, in 1812, not to exceed $109, 50. 11 Apr 1825. 119. An act for the sale of the lands, late of the estate of JOHN NICHOLSON and PETER BAYNTON, on which the state has a lien. That agents of the commonwealth, shall have access to all surveys, drafts, entries, warrants and other office titles, relative to any lands of John Nicholson and Peter Baynton, both dec. That the settlers now in possion of any lands, in the townships of Fallowfield and Fairfield, Crawford county, shall be allowed whatever compensation the board appoints. 11 Apr 1825. 122. An act incorporating the Milesburg and Smethsport turnpike road company. That for the purpose of making a turnpike road, from Milesburg, in Centre county, past Karthaus, Clearfield county, and Smethsport in M'Kean county, to the New York line, near the point where the Olean and Smethsport road crosses the said line, JONATHAN COLEGROVE, PAUL E. SKULL, JOHN KING and JOSEPH OTTO, of M'Kean county, PETER A. KARTHAUS, of Clearfield county, JAMES L. GILLES, of Jefferson county, JOHN MITCHELL and ROLAND CURTIN, of Centre county, GEORGE VAUX and SIMON GRATZ, of the city of Philadelphia, are hereby appointed commissioners. 11 Apr 1825. 123. An act granting compensation to MICHAEL WARNER, a revolutionary soldier, for a tract of donation land, and for the relief of the heirs of JACOB BUTTEMORE. That the state treasurer is authorized to pay Michael Warner, of York county, $300.00, in full compensation for a tract of donation land, to which he was entitled, for services rendered by him in the revolutionary war. That the Auditor General is hereby authorized to draw his warrant, in favor of GEORGE BUTTEMORE, administrator of the estate of Jacob Buttemore, late of Fayette county, for $229.00 in lieu of a tract of donation land, to which the deceased was entitled for his services in the Pa line, in the revolutionary war. 11 Apr 1825. 125. An act granting compensation to the heirs of ARTHUR MARTIN, for a tract of donation land. That the state treasurer is hereby authorized to pay to the legal heirs of Arthur Martin, $300.00 in full compensation for a tract of donation land, to which their father, Arthur, was entitled, in consequence of services by him rendered, in the revolutionary war. 11 Apr 1825. 129. An act to confer on GEORGE BRINTON the rights and privieges of a person born in lawful wedlock. That George Brinton, of Thornbury, Chester county, is hereby invested with the surname of his reputed father, CALEB BRINTON, of the borough of Westchester, Chester county, and he may be able to inherit any estate real, personal or mixed, as fully as if he had been born in lawful wedlock. 12 Apr 1825. 133. An act to renew an act passed 29 Mar 1819, to incorporate a company to make a lock navigation on the west branch of the river Schuylkill. That JACOB W. ZEITZINGER, of the town of Reading, Berks county, JOHN BANNON, FRANCIS B. NICHOLS, JOHN SCHALL of Orwigsburg, and GEORGE SHOEMAKER, of Pottsville, Schuylkill county, and ELIAS MARSH, of the city of Philadelphia, are hereby appointed commissioners. 12 Apr 1825. 134. An act to incorporate the Codorus Navigation Company. That GENERAL JACOB SPANGLER, GEORGE SMALL, WILLIAM NES, JONATHAN JESSUP, JOHN BARNITZ, CLEMENT STILLINGER, JOHN DEMUTH, GEORGE LAUCK, (miller) CHARLES MORRIS, DANIEL D. DUNN, JACOB EICHELBERGER, MICHAEL DOUDEL, and JOHN WIRE, of York county, are hereby appointed commissioners to make a complete navigable canal up and down the river Codorus, from the mouth to the borough of York. 12 Apr 1825. RESOLUTIONS 2. Resolution relative to GENERAL LAFAYETTE. The Senate and House of Representatives of the commonwealth of PA, entertaining the most exalted opinion of the disinterested and signal services performed in our revolutionary struggle, by General Lafayette, the early and distinguished friend and benefactor of America, and the firm and consistent champion of civil liberty, and participating in those feelings of affection and esteem which have animated the people of the whole Union, on his arrival in the United States, and desirous that the gratitude of the nation should be extended to him, in a manner correspondent to the important services rendered, and generous sacrifices made by him, in securing the independence of the United States. Resolved, that any provision tendered to him by the national legislature, which shall correspond with the sentiments and be worthy of the character of the American people, will meet the cordial approbation of the legislature of PA. Resolved, that the Governor, be requested to invite General Lafayette to visit the seat of government of PA, and to express to him the high satisfaction his presence would afford to the representatives of this commonwealth. 23 Dec 1824. 4. Resolution relative to preventing damages to the third section of lots adjoining the town of Eric. That THOMAS LAIRD, of the borough of Erie, is hereby directed, to take charge of the third section of the town of Erie, and the peninsula near the town of Erie, and prevent any person from trespassing thereon, either by cutting and carrying off timber, or any other act calculated to injure that section of the town, and Thomas Laird, is hereby authorized to bring suit before the courts of Erie county, on behalf of the commonwealth, against any transgressor. 12 Apr 1825.
