Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act to incorporate the Pa. Infirmary for diseases of the eye and ear. That JAMES GIBSON, WILLIAM MEREDITH, C.N. BANCKER, MANUEL EYRE, RICHARD C. WOOD, GEORGE B. WOOD, JOHN K. KANE, ISAAC HAYS, JOHN BELL, R.E. GRIFFITH, WILLIAM DARTACH, PHILIP S. PHYSIC, WILLIAM GIBSON, are hereby constituted a body politic and corporate, for the ministration of gratuitous relief to indigent persons afflicted with diseases of the eye and ear. 11 Jan 1826 2. An act to authorize the committee of JONAS POTTS, a lunatic, to sell and convey real estate. That DAVID BRUCE, JAMES KERR and BENJAMIN BUBBIT, of Washington county, committee on the person and estate of Jonas Potts, a lunatic, are hereby authorized to sell all the rights, title and interest to a tract of land situate in Hanover twp., Washington county, adjoining lands of GEORGE JACKSON, JOHN TUCKER, and others, and to make and execute a deed to the purchaser. 16 Jan 1826. 4. An act authorizing WILLIAM SCOTT to sell and convey several tracts of land of which FRANCIS ARMSTRONG died seized. That William Scott, grandson of Francis Armstrong, dec. is hereby authorized to sell and convey a certain plantation and tract of land in York county, called "Garter's Hill," near Peachbottom ferry, and also a tract of land in Chester county, containing about 300 acres, adjoining lands of SAMUEL HAINES, JAMES MULLIN and others, and apply the moneys as set forth in the will of the deceased. 1 Feb 1826. 5. An act to improve a public road crossing the Blue Mountain at the place commonly called the Little Gap, in Northampton county. That the sum of $2000.00 is appropriated for the purpose of improving a road crossing the Blue Mountain, in favor of JACOB HOUER, of Lehigh county, GEORGE ZEIGENFUS, of Towamensing twp., and GEORGE WEBER of Allen twp., for improving the road. 1 Feb 1826. 10. An act to incorporate the Tioga Navigation Company. That ASA MANN, WILLIAM WILLIARD JR., IRA KILBURNE, HIRAM BEEBE, CURTIS PARKHURST, ROBERT TUBBS, JOHN KNOX, URIAH SPENCER, THOMAS DYER, ELIJAH WELSH, SAMUEL W. MORRIS, JOSEPH M'CORMICK and THOMAS PUTNAM, are hereby appointed commissioners to make a complete navigable canal or slack-water navigation, up and down the river Tioga from the State line of New York, near Lawrenceville to the coal beds near Peter's Camp, and by Crooked creek to Pine creek. 20 Feb 1826. 6. An act to incorporate a company to make a lock navigation on the East branch of the river Schuylkill called Little Schuylkill. That CHARLES GRAFF, THOMAS HART, JOHN NAGLEE, CASPER W. MORRIS, BENJAMIN R. MORGAN, ANDREW GEYER, MARK RICHARDS, and CLEMENT C. BIDDLE, of the city and county of Philadelphia, SAMUEL GROSS, and PHILIP S. MARKLEY, of Montgomery county, WILLIAM WITMAN, GEORGE KEIM, JOHN ADDAMS, LEWIS JACOBY, SAMUEL BEARD, and JOSEPH HEISTER JR., of the borough of Reading, GEORGE KEMP JR., PETER KNAPP, of Berks county, JACOB MILLER, LEWIS AUDENRIED, BERNARD KEPNER, DANIEL YOST, WILLIAM BOCK, and JAMES L. DUNN, of Schuylkill county, JOSEPH BROBST, and GEORGE WILLETTS, of Columbia county, are hereby appointed commissioners to make a complete navigable canal, and a slack-water navigation to make the Little Schuylkill navigable, from its intersection with the Big Schuylkill, to where the Wilkesbarre state road crosses the river to the foot of Broad Mountain. 20 Feb 1826. 15. An act for the relief of the surviving children of COLONEL GEORGE WILSON, dec., an officer of the revolution. That the state treasurer is authorized to pay to the surviving children of Col. George Wilson, dec., of the 8th regiment, PA line, $1125.00 in full compensation for a tract of donation land, which George Wilson was entitled for services rendered by him in the revolutionary war. That such surviving children as shall be feme coverts, shall hold their proportion of the money for their separate use, and the same shall not be subject to the control of their husbands. 20 Feb 1826. 21. An act for the relief of JUSTUS STERIGERE, a soldier of the revolution. That the state treasurer is authorized to pay to Justus Sterigere, of the county of Philadelphia, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1826. 3 Mar 1826. 22. An act granting compensation to JOHN TEEL and the lineal heirs of FRANCIS MILLS, for donation tracts, to which they are entitled. That the state treasurer is authorized to pay to John Teel, of Beaver county, $375.00 in full compensation for a tract of donation land, to which he was entitled for his revolutionary services in the PA line. That the state treasurer is authorized to pay to the lineal heirs of Francis Mills, $300.00 in lieu of a tract of donation land, to which Francis Mills was entitled for his services in the revolution. 3 Mar 1826. 26. An act for the relief of WILLIAM LINTON and JOHN BAIN, soldiers of the revolution. That the state treasurer is hereby authorized to pay to William Linton, of Franklin county, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1826. That the state treasurer is hereby authorized to pay to John Bain, of Lancaster county, a soldier of the revolution, forty dollars immediately, and an annunity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1826. 9 Mar 1826. 29. A supplement to an act incorporating the Western University of Pa. That the state treasurer is authorized to pay to the trustees of the Western University of Pa. the sum of $2400.00 a year, for five years, provided the board of trustees relinquishes to the commonwealth, the grant of land, adjoining the town of Allegheny, made by the act passed 18 Feb 1819. Whereas, several of the trustees do not reside convenient to the place of meeting, and other have removed from the state without resigning their seats, the board is rendered too small. GILLELAND and JOHN BROWN, of the county of Allegheny. 9 Mar 1826. 30. An act for the establishment of a college at Easton, Northampton county. In memory and out of respect for the signal services rendered by GENERAL LA FAYETTE, in the great cause of freedom, the said college shall be called La Fayette college. An act to incorporate the Lackawana and Susquehanna Railroad Company. That WILLIAM JESSUP, DAVIS DIMOCK, and WILLIAM THOMPSON of Susquehanna county, DAVID SCOTT, JOHN M. CUNNINGHAM, and ANDREW BEUMONT, of Luzerne county, THOMAS MEREDITH, JOHN MUMFORD and AMSI FULLER, of Wayne county, are hereby appointed commissioners, to construct railways, build boats, and erect steam engines, and to lay down tract, beginning at the Susquehanna river, in Harmony twp., and extending to the Bellmont coal mines, near the head waters of the Lackawana Coal Valley. 11 Mar 1826. 32. An act to incorporate a company to make a road, and for other purposes. That HARDMAN PHILLIPS, MOSES CANAN, JOSEPH TURNER, JAMES M'GIRK, RICHARD J. PROUDFOOT JR., MATTHEW M'CONNEL, JOHN G. MILES and OWEN M'DONALD, are hereby appointed commissioners to make a turnpike road from Phillipsburg, Centre county, to Ebensburg, Cambria county. That THOMAS SUTTON, DANIEL STANARD, ALEXANDER PATTERSON, ROBERT NIXON, and JOSEPH HENDERSON, of Indiana county, and NEAL BOYLE, THOMAS M'QUADE, ANDREW BOGGS and JAMES M'CULLOUGH, of Westmoreland county, and MICHAEL ANDERSON, JAMES JACKSON, JAMES GUTHRIE, and SOLOMON SHOEMAKER, of Armstrong county, CHARLES JOHNSTON, THOMAS CHALFANT, and DAVID GILLILAND, of Allegheny county, are hereby appointed commissioners of the Indiana and Pittsburg Turnpike Road Company, from the borugh of Indiana, to the city of Pittsburg. 11 Mar 1826. 33. An act to empower HENRY CONWELL, Catholic Bishop of Philadelphia, to sell and convey a lot. That Henry Conwell, Catholic Bishop of Philadelphia, is hereby empowered to sell and convey by deed, a lot situate in Swatara twp., Dauphin county, the property of the Catholic society of Harrisburg, containing 4 acres, 3 roods, and 35 perches, adjoining lands of WILLIAM ALLISON, and the Ephrata and Harrisburg turnpike road, and to vest in the purchaser, legal title. That when the trustees appointed by the orphans' court of Montgomery county, agreeably to the act authorizing the sale of the real estate of GEORGE BISBING, dec., and for the relief of the heirs of HENRY RHODES, dec. and to enable the committee of HENRY GARBER, to purchase real estate, passed 21 Mar 1825, sold the real estate of George Bishing, dec., such persons shall make a settlement of accounts. Whereas, THOMAS EDENTON, of Middletown twp., Delaware county, was seized in his demesne of a piece of land containing 1 acre, bounded by the Edgmont road, and road leading to the Seven Stars, and land now of JAMES STEWART, died intestate, leaving a widow and one son, both of whom are since dead, leaving neither issue or known kindred, and whereas, debts and funeral expenses, both his and his son and widow remain charitable on the piece of land, therefore, OBED RUSSEL, of Edgmont twp., Delaware county, is hereby authorized to sell and convey this piece of land for the purpose of paying all taxes, and funeral expenses, and any money remaining shall be applied to the poor of Delaware county. Whereas, JAMES MILLIGAN, (late of Peach Bottom twp., York county dec.) died intestate, possessed of real estate, not having issue, which real estate descended to his brother and sisters, of which JANE ALEXANDER, wife of ANDREW ALEXANDER, was one, and whereas, the heirs petitoned York county in 1808, for partition of the real estate which was done, and whereas, Jane, in the same year died, leaving issue, ELIZABETH ALEXANDER, MARGARET ALEXANDER, JAMES ALEXANDER, JOHN ALEXANDER, THOMAS ALEXANDER, ANDREW ALEXANDER, MARTHA ALEXANDER, and JANE ALEXANDER, and whereas, Andrew Alexander, guardian of the children of Jane, his wife, did take one moiety of the real estate at the appraisement, in trust for the heirs, and whereas, in 1812, four of the heirs being of full age, did entreat Andrew to sell said moiety, and he did contract and sell it to MICHAEL SNYDER, and before the perfecting of the title to Michael Snyder, Elizabeth and Thomas died leaving issue, one in the state of Missouri, and the other in the state of Ohio. Therefore, Andrew Alexander is hereby authorized to make and deliver a conveyance of the title of Jane Alexander to Michael Snyder, on receiving full payment. That MATTHEW WOODS, is hereby authorized to sell and convey, by deed, all rights and title of his son GEORGE WOODS, a minor, to a tract of land devised to him, by his grandfather, GEORGE WOODS SR., in his last will and testament, late of Potter twp., Centre county, dec., and proceeds are to be vested in some productive fund for the benefit of the minor. 11 Mar 1826. 34. An act for the partition of certain lands, in Armstrong and Jefferson counties. Whereas, BENJAMIN B. COOPER, of Glouscester County, New Jersey, is seized of the following tracts of land, surveyed as lottery warrants, now in the counties of Armstrong and Jefferson, #446, 506, 481, 341, 322, 407, and 254, containing about 5152 acres and Benjamin B. Cooper holds the lands in trust for the heirs of ROBERT MILNER, late of the island of St. Thomas, merchant, dec., and Benjamin B. Cooper desires to have partition of the lands, and the heirs of Robert Milner, are not known, or to be found, therefore, ROBERT ORR JR., DAVID LAWSON, and JOSEPH RANKIN, of Armstrong county, are hereby authorized to examine the lands and make equal partition of two parts, and Benjamin B. Cooper shall hold 1/2 in trust and the heirs shall hold their 1/2 in trust. 11 Mar 1826. 38. A supplement to various acts. That the village of Pennsborough in Lycoming county, and the territory included within the following boundaries, beginning at an out-lot of JOHN BEIBSAM, east, thence south by the lot of M. Neil, to the middle of the great road leading to Muncy Mills, to out-lot of JOHN BRINDLE, dec., thence to the out-lot of JAMES WHITE, by a line to a lot surveyed for DR. T. WOOD JR., to an out-lot of JOHN HOLLER, to the corner of a lot owned by MRS. G. WOOD on Shuttle Hill, to a lot of ABEL EDWARDS, to lots of J. TURNER, A. HAYCOCK, lot late of H. PEPPER, and lot of JOHN UHL, to the corner of lot of EZEKIEL WALTON, thence to beginning, is hereby erected into a borough. 15 Mar 1826. 40. An act to build a bridge, and for other purposes. That it shall be lawful for GEORGE LILLY, to make, at his own cost, a landing on his land, opposite Espytown, no the north branch of the Susquehanna, in Bloom twp., and also of making a landing on the opposite shore where the public highway intersects the river on the Hawks furnace road, in Cattawissa twp., Columbia county, for the purpose of a ferry. That JAMES BELL and EVAN THOMAS, of Northampton county, are hereby authorized to erect a bridge over Smithfield creek, near the mill of Bell and Thomas where the great road leading from Stroudsburg, to Houser's crosses the creek. 15 Mar 1826. 41. An act to enable the executors of LEWIS REITZ, dec., to sell and convey real estate. That ADOLPH EBERHARD, BALTZER KRAMER, and MARGARET REITZ, executors of LEWIS REITZ, late of Greene county, dec., are hereby authorized to execute a deed of conveyance of an undivided seventh part of part or the whole of a tract of land situtate in Monongahela twp., whereon the glass works known as the New Geneva Glass works, are erected, as if special authority were given in the will of Lewis Reitz. Whereas, HENRY ARMSTRONG, late of Washington county, died intestate, in 1817, leaving widow and five minor children, and whereas the real estate of the intestate was sold in 1822 for $1500.00, and after payment of the debts of the dec., $788.42 1/2 remain, it is believed advantageous to purchase a small tract of land for the residence and maintenance of the widow and children. Therefore, it shall be lawful for ROBERT COLMERY and JOHN MORGAN, guardians of the minor children, of Henry Armstrong, dec. having obtained the approbation of ELIZABETH ARMSTRONG, widow of Henry, to expend the sum of $400.00, in the purchase of a tract of land, and the title of the tract shall be made to Elizabeth Armstrong, Robert Colmery and John Morgan, as trustees of the minor children. That JACOB GERMAN and PHILIP FILBERT, committee of JACOB DEPPEN, of Berks county, a lunatic, are hereby authorized to sell and convey to the Union Canal company, a tract of land situate in Berks county, the property of Jacob Deppen, and the proceeds for the use of Jacob Deppen, a lunatic. Whereas, by the last will and testament of GEORGE MICHAEL PETER, late of York county, dec., dated 20 Nov 1822, did nominate and appoint his son, GEORGE PETER, his sole executor, did order his executor to sell his person effects, with 5 acres of land, in York twp., York county, for the discharge of his debts, which was sold to JOHN MILLER, but no provision was given in the will to make and execute a deed to the purchaser. Therefore, George Peter is hereby authorized to convey a lot of ground, containing 5 acres, by deed to John Miller, and apply the proceeds to outstanding debts. 15 Mar 1826. 43. An act for the relief of sundry soldiers and heirs of soldiers, of the revolutionary war. That the state treasurer is hereby authorized to pay to GEORGE SNYDER, of Philadelphia county, VALENTINE RYNSEL, of Butler county, PETER FOREMAN, of Franklin county, JOHN NUNEMAKER of Philadelphia county, JOHN SCHLOTTER of Lehigh county, JACOB JUSTICE, of Beaver county, GEORGE KLINK of Cumberland county, JOHN ENGLEHAUPT, of Crawford county, HENRY EGOLF, of Perry county, MICHAEL SECHLER, of Lycoming county, JACOB BROWN, of Lancaster county, JOHN BERNARD of Philadelphia county, JOHN GROSTCROST, of Beaver county, ROBERT KING, of Erie county, JOHN REED of Schuylkill county, ADAM TATE, of Lancaster county, PETER JUSTICE, of Indiana county, MICHAEL ALTIGH, of Washington county, Maryland, JOHN SHAVER, of Huntingdon county, and to JOHN LIND, of Northampton county, forty dollars each, immediately, and an annuity of forty dollars each, payable half yearly, during life, to commence on 1 Jan 1826. That the state treasurer is hereby authorized to pay to ROBERT SCOTT of Northumberland county, an officer of the revolution, fifty dollars immediately, and an annuity of fifty dollars, payable half yearly, during life, to commence on 1 Jan 1826. That the state treasurer is hereby authorized to pay to JOHN HAMILTON, now or late of Crawford county, the sum of $200.00 in full for services rendered during the revolutionary war. That the state treasurer is hereby authorized to pay to JOHN BAYLEY, of Washington county, forty dollars immediately, and an annuity of forty dollars, payable half yearly, for the use of JOHN WALKER, a revolutionary soldier, during life, to commence on 1 Jan 1826. That the state treasurer is hereby authorized to pay to the heirs of FRANCIS O'HARRA, the sum of $300.00, in full for a tract of donation land, which was granted to Francis O'Harra, as a reward for his services as a revolutionary soldier, situate in what is commonly called the Struck donation, in the second district, #266, containing 200 acres, which tract appears to have been settled by another person, previous to the issuing of patents to Francis O'Harra. That the state treasurer is hereby authorized to pay to the lineal heirs of CHARLES KELLY, late of Cumberland county, $300.00 in full compensation for a tract of donation land, to which Charles Kelly was entitled for services rendered in the revolutionary war. 15 Mar 1826. 44. An act for the relief of HENRY M'HENRY and JAMES HADLEY, soldiers of the revolution. That the state treasurer is hereby authorized to pay to Henry M'Henry, of Allegheny county, and to James Hadley, of Stueben county, both of the state of New York, the sum of $200.00 each, in full compensation for services rendered during the revolutionary war. 15 Mar 1826. 45. An act to incorporate a company for erecting a bridge. That DANIEL SAEGER, DAVID DESHLER and PETER MARKS, of Lehigh county, and JACOB MACK, JOHN APP, GEORGE WENTS and ROBERT STEWART, of Northampton, are hereby appointed commissioners for erecting a bridge over the river Lehigh, at Kuntz's Ford, in the counties of Lehigh and Northampton. Whereas, WALTER C. LIVINGSTON, JACOB BLUMER, DANIEL KRAMER, JAMES JAMESON, WILLIAM TILGHMAN and others, have built and erected a bridge the river Lehigh, in the counties of Lehigh and Northampton, near JOHN D. BOWMAN's mill, in Northampton county, at Lehigh Water Gap, a chain bridge. Therefore, WILLIAM C. SCOTT, JOSIAH WHITE and JOHN HAGENBUCK, of Northampton county, and JOSEPH FREY JR., GEORGE SHEIRER and CASPER HUNTZICKER, of Lehigh county, are hereby appointed commissioners who shall go upon the bridge and examine the workmanship and construction, and if, the bridge is well built, and proper for public use, the governor shall declare the persons involved a body politic and corporate, called the Lehigh Water Gap Bridge company. 18 Mar 1826. 48. An act authorizing the exectors of ROBERT BROOKE, and others, to sell and convey real estate. That CHARLLOTTE P. BROOKE, executrix and GEORGE B. PORTER, executor, of the last will and testament of Robert Brooke, late of the city of Philadelphia, Esquire, dec., and they are hereby authorized to sell a three story brick dwelling house and lot of ground, situate on the west side of third street, between St. Tammany and Green streets, in the Northern Liberties, bounded by a lot of JOSEPH INNES, on the north, and by a lot of JACOB KINDERDINE, on the south, and to execute to the purchaser conveyance by deed. That THOMAS WILSON and PHILIP ROLLER, guardians of JOHN MEREDITH and WILLIAM MEREDITH, of Huntingdon county, are hereby authorized to sell and dispose of the real estate of John and William Meredith, consisting of a tract of 160 acres of land, situate in Antes twp., Huntingdon county, and the proceeds of the sale shall be for the sole use of the minor children. That WILLIAM RAMSEY and THOMPSON RAMSEY, grandsons of WILLIAM THOMPSON, dec., are hereby authorized to sell and convey a certain plantation and tract of land, in New London twp., Chester county, containing 150 acres, adjoining lands of GEORGE DUFFIELD, ROBERT RONEY and others, and apply the money to the use set forth in the will. That HIRAM M'NEAL, executor of the last will and testament of MARGARET MILLER, dec. is hereby authorized to sell and convey real estate being one equal undivided moiety, of a messuage and tract of 114 acres and 82 perches of land, situate in Warminster twp., Bucks county. That in case the estate has escheated to the commonwealth, by the illegitimacy of Margaret Miller dec., then Hiram M'neal is hereby authorized to apply the proceeds to the legatees of Margaret Miller. That JOHN WISER and JOHN CLENDENNING, of Cumberland county, committee, of PETER WISER, a lunatic, they are authorized to sell and convey all the rights and title to a small tract or messuage of land, situate in Greene twp., Franklin county, adjoining lands of PETER BONEBROOK, CONRAD HAMIL and HUGH FERGUSON, containing 4 acres and 7 perches, strict measure, and to make and execute a deed to the purchaser. Whereas, it appears that ISSAC LEMLY, late of the county of Greene, dec., did in his life time sell to his brother SAMUEL LEMLY, a tract of land in Greene county, adjoining lands of Samuel Lemly, land late of DAVID FRAKES, the state line, and others, containing 40 acres, and Isaac received full payment, of which sale there is no written evidence to enable the executors to make and execute a deed to the purchaser. Whereas, WILLIAM ALLEN, in the autumn of 1813, married CATHARINE ANN SPEIGEL, both of the city of Philadelphia, that shortly after the marriage William deserted his wife, and departed from this commonwealth, that in the year 1814 there was a false rumour, in appearance well founded, of the death of William Allen, and in consequence, Catharine Ann believing herself to be a widow, on the 18 August, 1818, contracted herself in marriage with EDWARD LARKINS, of the county of Philadelphia, with whom she has lived and cohabited ever since, and she has issue by him, (now living) two children, namely, Sarah Ann Camp and Edward, and it has since been ascertained that William Allen was at the time of her marriage and still is in full life, and that William Allen is married to another woman, and Edward and Catharine having petitioned the legislature to annul the marriage between William Allen and Catharine Ann, and rendering valid the marriage between Edward and Catharine Ann, and also conferring on Sarah Ann Camp Larkins and Edward Larkins the rights and privileges of children born in lawful wedlock, therefore, the marriage contract entered into between William Allen and Catharine Ann Speigel is hereby annulled and made void, as fully as if they had never been joined in marriage. That the name of John Keith Slack be changed to JOHN SLACK KEITH, and shall perform all act, matters etc. as he might by the name of John Keith Slack. Whereas James Dunn, of Montgomery county, by his last will and testament appointed WILLIAM MULLEN, DAVID DOWLIN and RICHARD ROBERTS, referees to hear and determine all disputes, concerning any gift, bequest, and whereas, David Dowlin is since dec., and Richard Roberts has become non compos mentis, and it has been presented that disputes have arisen, whereby great injury is likely to accue, in consequence of the death and lunacy, therefore, the court of Montgomery county, is hereby authorized to appoint competent persons to supply the vacancies, who sha in conjunction with William Mullen exercise all authority to settle all disputes. 10 Apr 1826. 108. An act to convey real estate and for other purposes. The directors of the poor and of the house of employment for the county of York, are hereby authorized to make a good deed of conveyance unto SAMUEL FREY and JOHN SLEEGER, as tenants in common, to a lot of ground and southwestern moiety, part of the lot marked on the plan of Freystown lots #20, now situated in Spring Garden twp., (formerly York) on the great road leading from the borough of York to Lancaster, called King street, formerly belonging to NED PAUL, subject to the payment of the yearly ground rent due, unto the heirs of GODFREY FREY. Whereas, GEORGE REBMAN, of Conewago twp., in York county, dec., died intestate, having previous to his decease sold a messuage or tenement and lot situate in the town of Mount Pleasant, known as #17 to PETER REBMAN, and in his life time received the consideration money in full as appeared by a certificate signed by ELIZABETH REBMAN, widow and relect of George Rebman, dec., and no deed of conveyance was executed to the purchaser, as the decease of George Rebman was sudden. Therefore, PETER MATHIAS, administrator of George Rebman, is hereby authorized to convey by lawful deed. 10 Apr 1826. 111. An act to authorize ANTHONY KNISELY, administrator de bonis non of the estate of PHILIP TAYLOR, late of York county, dec., is hereby authorized to sell and convey the real estate directed by the last will and testament of Philip Taylor, with the same authority as JOHN WINARD, executor named in the will. That JEREMIAH DEGRASS, of the district of Southwark, of Philadelphia county, is hereby authorized to make sale of the real estate conveyed to him by MARY PERRY, in trust for his daughter ELIZA ANN DEGRASS, and all moneys from the sale to be for the benefit of his daughter Eliza Ann. 10 Apr 1826. 113. An act relating to certain trusts. Whereas, PETER SAURMAN, of Montgomery county, became bound by deed, dated 31 Mar 1812 to GEORGE SHELMIRE, of Montgomery county, in the penal sum of $2000.00, conditioned, inter alia, for the payment to George, of an annuity of sixty dollors, during the life of MARGERY SAURMAN, wife of Peter, in trust for the use of Margery (prout said bond,) and whereas, George Shelmire, represents that deafness and other infirmities of old age, have rendered him incapable of executing the trust, therefore, the court discharges George Shelmire from his trust, and appoints a trustee in his stead, who shall be vested with all the powers and authorities he possessed. Whereas, JOHN CORSON, of Bucks county, by his last will and testament, inter alia, gave and devised his real estate to a trustee and directed him to divide it into four equal parts, but gave no express authority to sell the same, and as doubts have arisen in the mind of a purchaser as to the validity of the title, therefore, it shall be lawful for AMOS MORRIS, the trustee, appointed by the court, is hereby authorized to make a good and sufficient deed to the purchaser. That the orphans' count of Washington county, shall have power to appoint a trustee to take charge of a legacy of $1000.00 bequeathed by WILLIAM WILSON to his daughter MARGARET WILSON, under provisions in the will and codicil annexed, dated 25 Apr 1812, and registered in the county of York, and apply the same according to the will. 10 Apr 1826. 116. An act for the relief of SARAH WILSON, widow of ROBERT WILSON, a soldier of revolution. That the state treasurer is hereby authorized to pay to Sarah Wilson, of Beaver county, widow of Robert Wilson, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars said Sarah's lifetime, payable half yearly, to commence on 1 Jan 1826. 10 Apr 1826. 117. An act authorizing the exchange of tracts of land between JOSEPH L. INGLIS and the administrators of JACOB REASER, dec. Whereas, JOSEPH BALL, late of the city of Philadelphia, dec., seized of two tracts of land adjoining to each other, and sold one called "Mount Pleasant" to Jacob Reaser, late of Bucks county, and intending to convey it to him, did, together with his wife ESTHER BALL, by indenture dated 3 Dec 1810, by mistake convey the tract known as "Williams' Addition", and on 7 Aug 1821 did convy to Joseph L. Inglis "Mount Pleasant", and whereas, both Joseph Ball and Jacob Reaser both died intestate, leaving children,and grandchildren, therefore, it shall be lawful for Joseph L. Inglis to sell unto WILLIAM REASER and JACOB REASER, (in trust for themselves and the other heirs of Jacob Reaser, dec.) the tract called Mounty Pleasant, situate on the waters of the Shamokin creek, below and adjoining land surveyed for ____ BIDDLE and _____ STARR, in Augusta twp., Northumberland county, by land warranted by ANDREW SHUBER, to a line of GEORGE COLDRAIN's land, containing 440 acres. That immediately after William Reaser and Jacob Reaser are authorized to sell to Joseph L. Inglis, the tract called Williams' Addition, situate on the waters of the Shamokin creek, adjoining land surveyed for GEORGE SCHEETZ, containing 440 acres. 10 Apr 1826. 119. An act for the relief of sundry supervisors mentioned and for other purposes. That it shall be the duty of the supervisors of Mahoning twp., Indiana county, to assess, collect and pay over to JOHN LEASURE, late supervisor, such sums due on the books as settled by the autitors for the services and expenses of John Leasure. That is shall be the duty of the supervisors of Robinson twp., Allegheny county, are hereby authorized to assess and collect $171.32 and pay it to WILLIAM BROWN, for his services as late supervisor. That the commissioners of Perry county, are hereby authorized to issue a warrant to THOMAS WHITE, to collect the taxes remaining unpaid on a duplicate issued by the commissioners of Cumberland county, to JAMES WHITE, in 1820 for the township of Rye, and Thomas White has full authority to proceed and collect the same, and to pay over to the treasurer of Perry county, for the use of the executors of the estate of James White. 10 Apr 1826. 120. An act authorizing the erection of dams in navigable streams, for erecting a bridge, and for other purposes. That HENRY H. BURR, of Mifflin county, are hereby authorized to erect and keep up a dam opposite to Miffintown, not exceeding three feet in height across that part of the Juniata river which flows between the island commonly called Bell's Island and the Fermanaugh twp., shore in Mifflin county, and also a mill to be propelled by water taken for said dam, fit for grinding wheat and manufacturing superfine wheat flour. CROFT, for the city of Pittsburg, for the Susquehanna and Juniata Bridge company, to erect a bridge over the river Susquehanna where the northern turnpike crosses the same. That it shall be lawful for DAVID HEIMBACH, to erect and maintain a dam across Poco Poco or Big creek, above or below where the road leading from the Wilkesbarre turnpike to Orwigsburg crosses said creek, in Northampton county. 10 Apr 1826. 122. An act for the relief of sundry widows of revolutionary soldiers. That the state treasurer is hereby authorized to pay to MARY GEYER, of Franklin county, widow of PETER GEYER, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1826. That the state treasurer is hereby authorized to pay to MARGARET SHELMAN, of York county, widow of HENRY SHELMAN, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1826. That the state treasurer is hereby authorized to pay to ELIZABETH EBERMAN, of the city of Lancaster, to MARY SHEA, of Allegheny county, and to ELIZABETH SPANGENBERGER of Northampton county, forty dollars each, immediately, and an annuity of forty dollars each, payable half yearly during life, to commence on 1 Jan 1826. 10 Apr 1826. 125. A supplement to the act to incorporate the Milesburg and Smethsport turnport road company. That for the purpose of making a turnpike road from Milesburg, in Centre county, in a direction to Karthaus to Snow Shoe, WILLIAM A. THOMAS, EVAN MILES, JOHN RANKIN of Centre county, are hereby appointed commissioners. 10 Apr 1826. 126. An act directing the sale of certain out lots in the reserve tract of land at the mouth of Big Beaver creek, and for other purposes. Whereas, by an act for the sale of the residue of the reserve tract of land at the mouth of Big Beaver creek, passed 14 Mar 1814, WILLIAM LEET, JOHN WOLF, and JAMES DENNIS, were authorized to lay out in lots and sell all the reserve of the reserve tract, and after payment patents were to be issued to the purchasers, and as conditions have not been met by the purchasers, the land reverted to the commonwealth, therefore, THOMAS HENRY, JOSEPH HEMPHILL, and ROBERT MOORE, are hereby directed to sell in the borough of Beaver, on 16 Oct next, and continue till the whole be sold. One fourth of purchase money to be paid at time of sale, and the residue in three equal annual installments. That BENJAMIN ADAMS, ROBERT DARRAGH, MILO ADAMS, JOSEPH VERA and JOHN T. MILLER, trustees of the Methodist Episcopal church in the borough of Beaver, in the county of Beaver, are hereby authorized to erect a church on the south east section of the public square in the town of Beaver, between the academy and the south eastern boundary of said public square. That all money received by the treasurer of Potter county, on account of road tax assessed and levied on unseated lands, belonging to the estate of WILLIAM BINGHAM, within the townships of Eulala, Harrison an Rowlet is subject of the following commissioners. That JAMES ROSE, DANIEL ROOKS and THOMAS CALVIN, are hereby constituted and appointed commissioners to make a state road leading from Newtown to the Allegheny river, as to the part passing through Potter county. An act relative to roads. After the president and managers have completed the Carlisle and Hanover turnpike the funds from the tolls shall be appropriated to the payment of the judgements by the Cumberland county court, due to JAMES DUFFY. CROMWELL, WALTER B. HUDSON, JOHN COOPER, WILLIAM POSTLETHWAITE, ROBERT ALLISON and WILLIAM JACKSON, of Huntingdon county, are hereby appointed commissioners. That CHARLES C. GASKILL, DOCTOR W. An act to erect Birmingham into a borough, and for other purposes. That the electors in Richmond twp., Tioga county, shall hold their elections at the house of BARRET CLARK, in the town of Richmond. Whereas, during the late war, two of the most brilliant exploits of our naval forces were displayed in the actions fought between the United State Sloop of war Hornet and his Brittanic Majesty's ship Peacock and sloop of war Penquin, and which terminated in the conquest and capture of the enemy in each case, and whereas, DAVID CONNER, a native and citizen of the state of PA, and now a master commandant in the naval service of the United State, was acting lieutenant in the first action and firs lieutenant in the second, and was eminently conspicuous in both for good conduct and intrepidity, maintaining his post in the last battle until exhausted by loss of blood form a desperate wound, received whilst victory was yet unsecured, and whereas, the state of Pennsylvania has never been backward on any proper occasion to acknowledge the pride she takes in bestowing on her native sons the noblest reward of heroic deeds, the honorable distinction of their country's approbation: Therefore, the governor is to procure for and present to him, in the name of the commonwealth, an appropriate sword, the expense of which shall not exceed the sum of $400.00. 25 Feb 1826 7.
