SHULZE, Governor NER MIDDLEWARTH, Speaker of the House of Representatives DANIEL STURGEON, Speaker of the Senate Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act authorizing the court of common pleas, of Philadelphia county, to direct the acknowledgment of a certain deed. Whereas, a judgment rendered in Philadelphia county, term of June 1810, at the suit of NATHANIEL R. SNOWDEN, executor of ISAAC SNOWDEN, to the use of REED WILLIAMS against JOHN WILLIAMSON, a writ of fieri facias issued, directed the sheriff, WILLIAM T. DONALDSON, be levied on certain lands and tenements, and afterwards a writ of venditioni exponas issued, returnable before the judges on the first Monday in Dec., 1810, and the sheriff did on the 12 Oct 1810, expose the lands and tenements to sale, and sold them to Reed William, which deed was on 22 Oct 1810, acknowledged by William T. Donaldson, sheriff, before the court, and as acknowledgment of the deed being made before the return day is defective, therefore, it shall be lawful for the judges of the court to have the sheriff acknowledge a certain deed poll, executed by William T. Donaldson, former sheriff, dated 16 Oct 1810 and entered among the records of Sheriff's deeds, in book F, pg 158. and said deed shall have full force and effect as if properly acknowledged after the return date. 20 Dec 1827. 3. An act incorporating the Pittsburg Gas Light and Coke company. Whereas, WILLIAM R. GRIFFITH, has obtained from the mayor, adlermen, and citizens of Pittsburg, the exclusive privilege of supplying the city with gas for a term of years, agreement dated 10 Aug 1827, and is agreeable to transferring the agreement to the company formed for this purpose. Therefore, BENJAMIN PAGE, BENJAMIN BAKEWELL, JAMES S. CRAFT, HENRY HOLDSHIP and HARMAR DENNY, are hereby declared a body politic and corporate. 21 Dec 1827. 4. An act authorizing the laying out of a state road from Williamsburg, in Washington county, to the city of Pittsburg. That ROBERT PATTERSON and MOSES LYLE, of Washington county, and JOHN TAYLOR, of Allegheny county, are hereby appointed commissioners to lay out a state road. 21 Dec 1827. 5. An act for the relief of ELIZABETH BARNARD, widow of a revolutionary soldier. Whereas, the act passed 15 Mar 1826, granted JOHN BARNARD, of the county of Philadelphia, an annuity of forty dollars, payable half yearly, during life, and whereas, John Bernard died on 2 Mar, a few days prior to the passage of said law, in consequence of which the widow could not receive any part of the annuity. Therefore, it is just that the state treasurer is hereby authorized to pay to Elizabeth Barnard, of the county of Philadelphia, $48.00, the amount which would have been due her late husband had he lived until the passage of the act. 21 Dec 1827. 6. An act for the relief of NICHOLAS SWOYER, a soldier, and CHRISTIANA HOUSE, the widow of a soldier. That the state treasurer is authorized to pay to Nicholas Swoyer, of the borough of Harrisburg, a revolutionary soldier, forty dollars, immediately, and an annuity of forty dollars payable half yearly during life, to commence on 1 Jan 1828. That the pension drawn by MICHAEL HOUSE, late of Washington county, in the state of Maryland, who died last winter, is hereby continued to his widow, Christiana House, and the the state treasurer is authorized to pay to Christiana House, forty dollars annually, during life, payable half yearly, to commence 1 Jan 1828, together with the arrearage from the time of the decease of her husband until the commencement of Christiana's pension. 21 Dec 1827. 7. An act to vest in MARY LUBOLD, the right to the real and personal estate of her illegitimate son, JONAS RICHARDS, late of Douglass twp., Berks county. That all the right, claim and interest which the commonwealth may have acquired by reason of escheat, from the want of heirs of JONAS RICHARD, formerly of Douglas twp., Berks county, dec., the same is hereby granted to Mary Lubold, mother of the deceased. 21 Dec 1829. 8. An act authorizing the laying out a state road from the Washington and Pittsburgh turnpike road, to the Virginia state line in a direction to Wheeling. That WALTER CRAIG and THOMAS SMITH of Washington county, and WILLIAM LEE of Allegheny county, are hereby appointed commissioners to lay out a state road. 11 Jan 1828. 11. An act for the relief of ROBERT GLENDENNING. That the title of Robert Glendenning to a tract of land, situate in Coolspring twp., Mercer county, containing 200 acres, warranted in the names of HUGH KNOX, GEORGE HESS, JOHN HESS, and others, and part of a tract of land granted to JOHN HOGE by patent, dated 17 Apr 1804, is hereby confirmed and made valid in law, as if Robert Glendening had been naturalized, to the laws of the U.S. previous to the purchase of the same. 11 Jan 1829. 12. An act to incorporate the company of the Lackawaxen turnpike road. That RUFUS GRENELL, FISHER CASE, THOMAS MEREDITH, LEVI CARROLL JUDSON, BENJAMIN JENKINS, MOSES HAYDON and VIRGIL GRENELL, of the county of Wayne, and are hereby appointed commissioners to lay down a road to commence near the town plot of the village of Bellmont, Wayne county, to the west branch of the Lackawaxen creek, to the basin at the head of the Delaware and Hudson canal. 17 Jan 1828. 14. An act granting all the right, title, and interest of the commonwealth of Pa. in the estate of JOHN JOHNSON, dec. and also in the estate of CHARLES JOHNSON, dec., to SAMUEL JOHNSON, the natural brother of John and Charles Johnson. Whereas, Charles Johnson, John Johnson and Samuel Johnson, were entitled to a certain personal estate in the hands of the executors of the last will and testament of a person who died in England in 1798, they being the natural sons of the testor, that Charles, John and Samuel were born in Calcutta, in the East Indies, but came to reside in the United States, in 1795, that in July 1821, Charles, being a citizen of the state of Delaware, died unmarried, and without lawful heirs, that in Feb. 1822, John being a citizen of the state of Pennsylvania, died leaving a widow, but no children, and on the 21 Jan 1826, the state of Delaware granted to Samuel all the right, title and interest of the state in the personal estate of Charles dec., that Samuel has found it impracticable to recover the money aforesaid, from the executor of the will in London, because of the supposed right of the state of Pa. may have in the same. Therefore, all right, title and claim of the commonwealth of Pa. may have acquired, by reason of escheat, from the want of heirs of Charles and John Johnson, dec. is hereby vested in Samuel Johnson, natural brother of Charles and John. 17 Jan 1828. 15. An act to incorporate the Bethany Water Company. ABISHA WOODWARD, JACOB S. DAVIS, JASON TORRY, ISAAC ROASA, JOSEPH MILLER, THOMAS SPANGLEBERG, JOHN RAYMOND, EPHRAIM HAMLIN, GORTON GROVES, NATHANIEL B. EDLRED, AMZI FULLER, shall hereby be a body politic an corporate in the borough of Bethany, Wayne county. 21 Jan 1828. 16. An act incorporating the Presbyterian congregation of the borough of Columbia, Lancaster county. The presbyterian congregation is hereby erected into one body politic and corporate whose trustees are: JACOB MATHIOT, JOHN M'KISSICK, WILLIAM BEATTY, JAMES CLYDE, CHRISTIAN BRENEMAN, DOCTOR RICHARD E. COCHRAN, JOHN M'KISSICK JR., DOCTOR HUGH M'CORKLE and JOHN BARBER. 21 Jan 1828. 17. An act appointing a trustee to the estate late of ABEL JAMES, dec. Whereas, Abel James, late of the city of Philadelphia, merchant, and REBECCA JAMES, his wife, by indenture, dated 29 Jul 1784, conveyed certain real and personal estate to HENRY DRINKER, JOSEPH SWIFT, JOHN FIELD AND CADWALADER EVANS, and limited the same upon certain trusts, and whereas all the named trustees are now dead, and heirs of John Field, who last died, have declined to take upon the execution of the trust, therefore, that all lands, etc. vested in the trustees, are hereby vested in THOMAS C. JAMES, of the city, doctor of medicine, with all the powers and authority granted the original trustees. 21 Jan 1828. 18. An act for the relief of THOMAS ELTON and BENJAMIN HUNTER, soldiers of the revolutionary war. That the state treasurer is hereby authorized to pay to Thomas Elton, of Bucks county, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to ABRAHAM MILLER, of the city of Philadelphia, for the use of Benjamin Hunter, of the county of Philadelphia, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1828, to be paid by Abraham Miller as he may deem best calculated to answer the necessities of Benjamin Hunter. 21 Jan 1828. 19. An act to legitimate MARIA EVE SNYDER, daughter of DANIEL UDREE. That Maria Eve Snyder, wife of JACOB U. SNYDER, of Berks county, be considered as the legitimate child of Daniel Udree, and at the death of Daniel Udree she and her heirs shall inherit all lands, etc .to all intents and purposes as if she had been born in wedlock. 21 Jan 1829. 21. An act incorporating the Theological Seminary of the Associate Reformed Synod of the West. That the Theological Seminary located in Pittsburg, is hereby erected into a body politic and corporate, and the trustees are: REV. MATHEW HENDERSON, REV. ALEXANDER PORTER, REV. DAVID PROUDFIT, REV. ISAIAH NIBLOCK and REV. WILLIAM RAINEY. 21 Jan 1828. 23. An act authorizing the committee of MICHAEL HANCHMAN, a lunatic, to sell and convey a part of the real estate of the said lunatic. Whereas, that by proceedings of the court of the common pleas in the city and county of Philadelphia, Michael hanchman, of said city, was adjudged a lunatic, and JOHN HANCHMAN and ADAM HANCHMAN, were appointed to take care of and manage the estate of said lunatic, and whereas, Michael Hanchman is inter alia seized of a moiety in a lot situate in the district of Spring Garden, containing 7 acres and 33 perches, and also of an undivided one-third part of another lot situate in the Northern Liberties, containing 2 acres, 112 perches, and the lots are unproductive, and it would be t the benefit of the estate of Michael Hanchman to be sold, therefore, the committee are authorized to sell all the estate, title and interest of Michael Hanchman, a lunatic, and to make a good deed and convey the same to the purchasers. 25 Jan 1828. An act to view and lay out a state road from the farm of ZEPHENIAH BEALL, in Washington county, to Little Whiteley creek, in Green county. That HENRY SHRIVER and ROBERT MILLIKEN of Greene county, and ABRAHAM VAN VOHRES, of Washington county, are hereby appointed commissioners to lay a road. 25 Jan 1828. 25. An act granting a sum of money to aid in the erection of a bridge over Dunlap's creek, where the state road leading from the White Horse, on the Allegheny mounntain, towards the flats of Grave creek, crosses the same, at Merrettstown, in Fayette county. That the sum of $418.00, with interest due, of the paper of the Union Bank of Pa., now in the treasury of the commonwealth, is hereby appropriated for the purpose of erecting a bridge, to DAVID PORTER, ELIJAH COLEMAN and HUGH GILMORE. 25 Jan 1828. 27. An act for the relief of IRWIN ELLIOT, constable of Fairfield twp., Westmoreland county, in pursuance of a warrant to him directed, arrested JOHN DECKER, charged with the murder of JOHN GARDNER, and whereas, John Decker rescued himself from the custody of Irwin Elliot and made his escape, and Irwin Elliot paid the sum of $74.00 for the apprehension and conveyance John Decker to the jail. Therefore, the commissioners of Westmoreland are hereby authorized to draw their warrant on the treasurer in favor of Irwin Elliot, for the sum of $74.00 in full for expenses incurred in apprehending and conveying John Decker to the jail. 25 Jan 1828. 28. An act authorizing the laying out of a state road from the borough of Greensburg, in Westmoreland county, to the Allegheny river, opposite the town of Freeport, in Armstrong county. That MATHEW JACK JR., SAMUEL L. CARPENTER and GEORGE T. CRAWFORD, are hereby appointed commissioners to lay out a state road. 25 Jan 1828. 29. An act granting a gratuity to RICHARD NAGLE, a revolutionary soldier. That the state treasurer si hereby authorized to pay to Richard Nagle, of Cambria county, forty dollars, as a gratuity for his revolutionary services. 25 Jan 1828. 30. An act granting a sum of money to make a state road. That the sum of $500.00 is hereby appropriated for the purpose of making a road from DAVID HUNTER's mill, Bedford county, to intersect the Waynesburg, Green Castle and Mercerburg turnpike road, on the North Mountain, near SAMUEL TOM's in Franklin county. 2 Feb 1828. 33. A supplement to an act to enable DAVID MAHON, JOHN SIMPSON, and others, to restore a stream of water in the neighborhood of Shippensburg, Cumberland county, to its ancient course. Whereas, David Mahon, and John Simpson, two of the commissioners named in the act are dead, and the survivors have become superannuated and unable to attend to the duties required of them, therefore, JOSHUA KENNEGE, GEORGE HAMMEL, DAVID MAHON, JOHN NIVEN, JOHN BRETTON SEN., and JAMES WALLACE of Cumberland county, are hereby substituted in the room and stead of the commissioners named in the act, and are vested with the same power and authority to enter into and upon all lands, lying between ____ CLEVER's saw mill, in Southhampton twp., Cumberland county, and SAMUEL COLWELL's dwelling house, for the purpose of conducting the stream of water mentioned. 2 Feb 1828. 34. An act to incorporate the Bank of Penn twp., Philadelphia county. That JACOB FRICK, CHARLES SOUDER, JOHN L. WOLF, WILLIAM S. FREDERICK, RUDOLPH H. BARTLE, PETER F. FRITEZ, LEWIS LOWRY, THOMAS LEWELLEN, HENRY FREDERICKSON, JOSPEH TAYLOR, LAWRENCE SHUSTER, GIDEON SCULL, JAMES S. SPENCER, NATHAN DAVIDSON, JOHN KEEFE, MICHAEL RITER, FREDERICK KLETT, and THOMAS SMITH, are hereby appointed commissioners to establish a bank. 2 Feb 1828. 39. An act for the relief of SAMUEL LOCKHART and JOHN LIGHT, soldiers of the revolutionary war. That the state treasurer is hereby authorized to pay to Samuel Lockhart, of Lancaster county, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1828. 7 Feb 1828. 41. An act to incorporate a company for making a road. That WILLIAM WILKINS, HENRY HOLDSHIP, WILLIAM B. FORSTER, DOCTOR P. MOWRY, WILLIAM PORTER, WILLIAM ARTHURS and JAMES BROWN are hereby appointed commissioners to make an artificial road from the city of Pittsburg to a point near the house of WILLIAM FARROW in the county of Allegheny. 7 Feb 1828. 42. An act for the relief of JOHN MARTIN, late supervisor of Mifflin twp., Lycoming county. That it is the duty of the supervisors elected 1828, for the township of Mifflin, Lycoming county, to assess and collect, and pay over to John Martin such sums of money as may appear due him on the books of the township. This shall include the borough of Jersey Shore, formerly a part of Mifflin twp. 7 Feb 1828. 43. An act to improve the state road from Franklin to Butler. That the sum of $2000.00 is hereby appropriated for the purpose of improving the state road from the town of Franklin, Venango county, to the town of Butler, Butler county, and to draw a warrant in favor of ARTHUR ROBESON JR., of Venango county, and JOHN NEYMAN, of Butler county, for the sum of $2000.00, to be expended by them in improving the road. 7 Feb 1828. 41. An act to incorporate the Miners Bank of Pottsville, in Schuylkill county. That LEVI ELLMAKER and ROBERT EARP, of Philadelphia, EDWARD B. HUBLEY and JACOB W. SEITSINGER, of Reading, BENJAMIN POTT, F.B. NICHOLS and CHARLES A. BRADFORD of Schuylkill county, JOSEPH PAXTON and DAVID CLEVER, GENERAL DANIEL MONTGOMERY and WILLIAM DONALDSON of Columbia county, are hereby appointed commissioners to establish a bank. 7 Feb 1828. 45. An act to incorporating the Mill Creek and Mine Hill Navigation Railroad company. That GEORGE C. TROUTMAN and GEORGE M. KEIM of Berks county, and GEORGE RAHN and JOHN SCHALL, of Schuylkill county, are hereby appointed commissioners to make a complete canal or slack water navigation or railroad, from a point near the mouth of Mill creek, on the river Schuylkill, to a point on the Centre turnpike, near the foot of Broad mountain. 7 Feb 1828. 47. A supplement to an act incorporating the Pa. and Ohio Canal company. That as soon as the legislature of the state of Ohio assents to the provisions of this act, JOSEPH T. BOYD, JOHN FISHER, BENJAMIN CHEW JR., THOMAS BIDDLE, WILLIAM BOYD, STEPHEN STONE and JOHN DICKEY, are hereby constituted a body politic and corporate in addition to those constituted by the state of Ohio act passed 10 Jan 1827 and assented by Pa. 14 Apr 1827. 7 Feb 1828. 48. An act to incorporate a company for making an artificial road. That JOHN WOODS, HENRY ESHELMAN, COLONEL WILLIAM COCHRAN, SAMUEL MILLER, GENERAL JOHN FORSTER and JAMES BUCHANAN, are hereby appointed commissioners to make a road from the north end of the bridge over Clark's creek, on the road leading from Harrisburg to Sunbury, across Peters mountain, to the south end of the bridge over Powell's creek, in Dauphin county. 16 Feb 1828. 50. An act to extend the boundries of the borough of Jersey Shore, Lycoming county. That the property of JOHN BAILEY, known by the name of "Long Island" opposite the borough is hereby attached to the borough. 16 Feb 1828. 51. An act to incorporate the borough of Williamsburg, Huntingdon county. Boundries: Beginning at a post on the lands of WILLIAM FEAY and JOSEPH FEAY, standing on the south side of the Frankstown branch of the river Juniata, etc. That all persons entitled to vote, shall do so at the house of CHRISTIAN HEWIT, in the borough. 19 Feb 1828. 52. An act erecting Middletown, Dauphin county, into a borough. That it shall be lawful for all voters to hold their elections at the public house now owned and kept by DAVID KISSACKER, in the borough. 19 Feb 1828. 55. An act authorizing the Seventh Day Baptists of Ephrata, Lancaster county, to sell certain real estate. That GEORGE FAHNESTOCK, OBED FAHNESTOCK, and SAMUEL FAHNESTOCK, members of the corporation of Seventh Day Baptists, and trustees, appointed by the society, are hereby authorized to sell a paper mill and about 3 acres attached on Cocalico creek, being part of a larger tract of land, adjoining the village of Ephrata, and also 80 acres and 10 perches of unimproved mountain land, situated on said creek, the title to which is in the said corporation, and to execute a deed conveying the premises to the purchasers. 19 Feb 1828. 58. An act to enable the acting executor of LEWIS REITZ, dec., to convey certain real estate. That BALTZER KRAMER, acting executor of Lewis Reitz, late of Greene county, dec., is hereby authorized to execute a deed of conveyance to ARTHUR PALMER, for the undivided interest of Reitz in four lots of ground, situate in the town of Greensburg, containing 4 acres, bound by Monongahela river on the east, Walnut street on the south, and lots #15 & 16 on the west, and Clair street on the north. 19 Feb 1828. 59. An act for the relief of soldiers and widows of soldiers of the revolutionary war. That the state treasurer is hereby authorized to pay to WILLIAM STITT, of Armstrong county, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to WILLIAM M'CRUM, of Bucks county, a soldier of the revolution, forty dollars as a gratuity for his revolutionary services. That the state treasurer is hereby authorized to pay to MARY EICHELBERGER, of Washington county, Maryland, widow of JOHN EICHELBERGER, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to MASSEY HARBISON, of Butler county, widow of JOHN HARBISON, a soldier, $100.00, as compensation in full for the services of her late husband, and as a gratuity. 19 Feb 1828. 62. An act granting a gratuity to ROBERT MAXWELL for his revolutionary services. That the state treasurer is hereby authorized to pay to DAVID R. PORTER ESQ., for the use of Robert Maxwell of Huntingdon county, forty dollars as a gratuity for the revolutionary services of Robert Maxwell. 19 Feb 1828. 64. An act authorizing NATHANIEL B. BOILEAU to sell and convey certain real estate, the property of MARY JENKINS. Whereas, by the petition of Nathaniel B. Boileau, concurred by HARRIET LEECH and THOMAS L. BOILEAU, that Nathaniel B. Boileau, Harriet Leech, Thomas L. Boileau and Mary Jenkins, a lunatic, are each entitled to one undivided fourth part of a house and lot in the city of Philadelphia, and also of an unimproved lot in the Northern Liberties of the city, and would benefit Mary Jenkins that her interest be sold. Therefore, Nathaniel B. Boileau is hereby authorized to sell all the right, title and interest which Mary Jenkins hath in the part of a brick messuage and lot, situate on Front near Market Street, bounded on the north by ground of THOMAS CLIFFORD, and a lot in the Northern Liberties, bounded on the west by ground late of THOMAS LEECH, dec. and to make and execute deeds to the purchaser. 27 Feb 1828. 65. A supplement to incorporate a company for erecting a bridge over the river Susquehanna, near the north line of Pa., in Harmony twp., Susquehanna county. That JESSE LANE and JOSEPH M KUNE JR., of the county of Susquehanna and THOMAS MUNFORD and JOHN MUNFORD of Wayne county, are hereby appointed commissioners to perform all duties enjoined on the commissioners of the act. 27 Feb 1828. 68. An act to incorporate the Baltimore and Ohio railroad company. By the General Assembly of Maryland, ISAAC M'KIM, THOMAS ELLICOTT, JOSEPH W. PATTERSON, JOHN M'KIM JR., WILLIAM STEUART, TALBOT JONES, ROSWELL L. COLT, GEORGE BROWN, and EVAN THOMAS, are hereby appointed commissioners for Maryland. That the full right of any of the citizens of Pa. may hereafter connect or intersect with part of the Baltimore and Ohio railroad. 27 Feb 1828. 69. An act for the relief of sundry soldiers and widows of soldiers of the revolutionary war. That the state treasurer is hereby authorized to pay to WILLIAM SHUMAN of Chester county, and JAMES BURNSIDE, of Butler county, the sum of forty dollars each immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to JOSEPH JUNKIN, of Mercer county, forty dollars as a gratuity for his revolutionary services. That the state treasurer is hereby authorized to pay to THOMAS MONTGOMERY, of Washington county, in the state of Kentucky, three hundred dollars in full compensation for a tract of donation land to which he was entitled for services rendered during the revolutionary war. That the state treasurer is hereby authorized to pay to THOMAS STEWART, of Franklin county, CHRISTOPHER SCHLOKERMAN and CATHARINE SHRAYER, widow of GEORGE SHRAYER, of Berks county, the sum of forty dollars each immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to JOHN FOGEL, in trust for JOHN DOLL, of Lehigh county, the sum of forty dollars immediately, and an annuity of forty dollars, payable half yearly, during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to SARAH MOON, widow of HENRY MOON, of Allegheny county, and to SARAH SPRINGER, widow of URIAH SPRINGER, of Fayette county, forty dollars to each immediately, and an annuity of forty dollars to each, payable half yearly, during life, to commence on 1 Jan 1828. That the associate reformed congregation of Mercer, Mercer county, is hereby erected into one body politic, and corporate in deed and law. Trustees are: WM. S. RANKIN, JAMES T. An act to erect the town of Dundaff, Susquehanna county, into a borough, and the village of Towanda, Bradford county, and authorizing the constable of the borough of New Castle, Mercer county, to execute civil process. The borough of Dandaff shall be bounded: Beginning on lands of PETER GRAHAM, etc., agreeable to a draft or survey made by MATTHEW JACKSON, 8 Dec 1827. That JAMES WARNER and ARCHIPPUS PARRISH shall publish and superintend the elections. The town of Towanda is bounded: From the old bridge near the house of late COLONEL HARRY SPALDING, and bounded by the original survey of the town plot is erected into the borough of Towanda. 5 Mar 1828. 75. An act to incorporate a company to erect a bridge over the Juniata river, at the town of Mifflin, Mifflin county. That JACOB WRIGHT, BENJAMIN LAW, JOSEPH CUMMINS ESQ., DANIEL CHRISTY, BENJAMIN KEPNER, STEWART TURBETT and JOHN BEAL, of the county of Mifflin, are hereby appointed commissioners for erecting a bridge. 5 Mar 1828. 78. An act to vest in NANCY DUNN, the right of this commonwealth to the real and personal estate of CHARLES DOUGHERTY, of Warren county. That all the right, title and claim which the commonwealth may have acquired by reason of escheat, from the want of heirs of Charles Dougherty, late of Warren county, dec., is hereby vested in Nancy Dunn of Warren county. 5 Mar 1828. 81. An act to annul the marriage of JABEZ SHERWOOD and ELIZABETH SHERWOOD, and confirming the marriage of ELIJAH PECK, and the said Elizabeth. Whereas, in Jul 1806, a marriage ceremony was performed by HENRY PATMORE, between Jabez Sherwood and ELIZABETH HORTON, of Sullivan county, in the state of New York, to which the parties did not feel themselves bound, neither was it their intention to be, that they never lived together as man and wife, and soon after Jabez married MARGARET OGDEN, with whom he now lives, and by whom he has had eight children; that on 5 Sep 1813, Elizabeth considering herself an unmarried woman, contracted herself in marriage with Elijah Peck, of Mount Pleasant, Wayne County, with whom she has lived and cohabited ever since, and has issue by him, (now living) two children, namely; DAVID HORTON PECK, and HIRAM PECK; that doubts have arisen whether the marriage between Jabez Sherwood and Elizabeth is not good and binding on the parties, and Elijah and Elizabeth having petitioned for a law annulling the marriage between Jabez Sherwood and Elizabeth, and rendering valid the marriage celebrated between Elijah Peck and Elizabeth, and also conferring their children the rights and privileges of children born in lawful wedlock. Therefore, The marriage contract between Jabez Sherwood and Elizabeth Horton is hereby annulled and made void, and the marriage contract entered into 5 Sep 1813, between Elijah Peck and Elizabeth Horton, both of Mount Pleasant twp., Wayne county, is declared valid. That the minor children of Elizabeth are hereby vested with the surname of their reputed father Elijah Peck, and shall have all the rights and advantages of children born in lawful wedlock. 8 Mar 1828. 84. An act authorizing the state treasurer to refund money. Whereas, PHILIP LENHERE, by his agent, has paid by mistake, to the treasurer, the sum of $73.69. Therefore, the treasurer is hereby authorized to pay Philip Lenhere, of Elizabeth twp., Lancaster county, the sum of $73.69 with lawful interest, from 1 Jun 1813. 8 Mar 1828. 89. An act for the relief of MARGARET CLARK, widow of a revolutionary soldier. That the state treasurer is hereby authorized to pay to CHARLES A. BARNITZ, of the borough of York, for the use of Margaret Clark, of York borough, widow of JOHN CLARK, an officer of the revolutionary war, sixty dollars immediately, and an annuity of sixty dollars, payable half yearly during the life of Margaret Clark, to commence on 1 Jan 1828,to be applied by Barnitz, to promote the comfort and answer the necessities of Margaret Clark. 19 Mar 1828. 91. An act for the relief of sundry soldiers and widows of soldiers of the revolutionary war, and granting to SARAH WITHIRS, compensation for a tract of donation land. That the state treasurer is hereby authorized to pay to GODFREY SCHLATER, of the county of Philadelphia, forty dollars, immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to MIRIAM DICKSON, of Perry county, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to ANN M'CULLY, of Allegheny county, twenty dollars immediately, and an annuity of twenty dollars, in addition to the pension which she now receives, during life. That the state treasuer is hereby authorized to pay to JACOB LINDY, of Lancaster county, forty dollars immediately, and an annuity of forty dollars payable half yearly during life, to commence on the 1 Jan 1828. That the state treasurer is hereby authorized to pay to ANDREW SHUSTER, of the county of Philadelphia, and to JOHN LONG, of the same county, each forty dollars as a gratuity for their revolutionary services. That the state treasurer is hereby authorized to pay to Sarah Withirs, daughter of THOMAS BOYLE, dec, of the county of Bullet, in the state of Kentucky, three hundred dollars in full compensation for a tract of donation land, to which her late father was entitled for revolutionary services. That the state treasurer is hereby authorized to pay to CHRISTIAN SCHMICK, of Berks county, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on the 1 Jan 1828. That the state treasurer is hereby authorized to pay to WILLIAM ELLIOTT, of Butler county, JACOB EYLER and ROBERT WRIGHT, of Cumberland county, each forty dollars, as a gratuity for their revolutionary services. 24 Mar 1828. 93. An act to enable the guardian of ELLEN T. WILCOX and CAROLINE WILCOX, and JOHN KUHNS, guardian of the minor children of ABRAHAM RINGLE, to convey certain real estate. That it shall be lawful for ROLPH C. MARSH, the guardian of Ellen T. Wilcox and Caroline Wilcox, minors, under the age of fourteen years, to make sale of the undivided interest in a tract of land, containing 100 acres, situate in Providence twp., Montgomery county, Pa. and to make a good conveyance to the purchaser. That John Kuhns of the borough of Greensburg, in Westmoreland county, is hereby authorized to sell the interest of the minor children of Abraham Ringle, of said county, under the will of MATHIAS RINGLE, dec., to a certain tract of land, situate in Washington twp., said county, adjoining lands of SIMON HINE, JOHN BASH, and PETER DRUM and JACOB DRUM, containing 225 acres, and to make and execute a deed to the purchaser 24 Mar 1828. 95. A supplement to an act for the relief of JOHN JOHNSON, and others. Whereas, the third section, for the relief of John Johnson, passed 22 Mar 1825, the supervisors of Metal twp., Franklin county, are required to pay over to JOHN CAMPBELL, $190.00, for money expended by him on the highways in the township, and for costs and damages sustained in defending a suit in behalf of the township, as supervisor, against JOHN PARKS, late supervisor, and whereas, it has been doubted whether evidence can be given, showing was not expended by John Campbell on the highways for costs and damages sustained in defending a suit in behalf of the township. Therefore, That on the trial of any suit now pending which may be brought by John Campbell against the supervisors of Metal twp., Franklin county, it shall be lawful for the court, to admit evidence on the part of the supervisors to contradict the fact of expenditure, etc. 24 Mar 1828. 96. An act to incorporate the Mine Hill and Schuylkill Haven railroad company. That SAMUEL WETHERILL and CHARLES SHIPPEN, of the city of Philadelphia, GEORGE D.B. KEIM and JOHN M'KNIGHT, of the county of Berks, RICHARD RICKERT, JOHN C. OFFERMAN and JACOB HUTZINGER, of the county of Schuylkill, are hereby appointed commissioners, to lay down a railroad beginning near Schuylkill Haven, Schuylkill county, to the Mine Hill. 24 Mar 1828. 97. An act to authorized the sale and conveyance of certain real estate. Whereas, FREDERICK W. SPERRY and MARIA SPERRY his wife, by indenture, dated 7 Aug 1819, granted and conveyed inter alia, unto JOHN SPERRY, a tract of land situate formerly in Allegheny county, now of Mercer, Pa. in the second district of donation land, #169, containing 500 acres, in trust, in case Frederick W. Sperry, should not pay certain promissory notes, to sell an dispose of the land and apply the proceeds to the payment of the notes. And whereas, Frederick afterwards departed this life, and the notes were paid by John who lately departed this life intestate, leaving a widow and three children, of tender years, as the heirs of John, but are unable to convey the land by reason of their minority. Therefore, it shall be lawful, JACOB SPERRY, administrator, to grant, and sell the tract of land and make a good deed of conveyance for the same to the purchaser. Whereas, WILHEM WILLINK and others, aliens, being lawfully seized of lands in this commonwealth, did sell and convey large parcels on credit, and take for security, mortgages and other securities and which were liens upon the premises so sold, and the purchasers represent that they are unable to pay the moneys, but are desirous to give as much of their lands as may be requisite for the satisfaction thereof, but it is represented, the act passed 31 Mar 1823, all their lands and all their interest became vested in Wilhem Willink, HENDRICK VOLLENHOVEN, WALRAVE VAN HEUKELON, JAN VAN EEGHEN, WILHEM WILLINK JR., and GERRIT SCHIMMELPENNICK, RUTGER JAN's son, also aliens, being deemed uncertain, whether land so sold could be considered part of the lands vested and if person vested of the land shall have full right to take and hold the same, by any lawful transfers from the purchaser. Therefore all rights will be convey to the new trustees afore mentioned and may hold grants and sell and convey the same to any person as if they were not aliens. That the commissioners of Susquehanna county, are hereby authorized to sell and convey a parcel of land situate in Silver Lake twp., containing 125 acres, being the same parcel of land convey by the sheriff to the commissioners by deed dated 30 Apr 1821, as the estate of CHAPMAN CARR, before that time a collector of county rates and levies for the township of Bridgewater. Whereas, HUGH M'MAHON of Elizabeth twp. Allegheny county, purchased a tract of land prior to 1818, and it appears Hugh M'Mahon has entered into an agreement with GARRET WALL ESQ., for the sale of the tract of land and Hugh M'Mahon being an alien, therefore, the title of Hugh M'Mahon to a tract of land situate in Elizabeth twp., Allegheny county, adjoining lands of JAMES APPLEGATE, WILLIAM STOCKDALE, JOHN MENOWN, WILLIAM MENOWN, LEWIS PEARCE and Garret Wall, containing 100 acres, is hereby confirmed as valid in law, as if Hugh M'Mahon had been naturalized agreeably to the laws of the United States before the purchase of the same and the agreement of sale is good and binding. Whereas NATHANIEL M'DOWELL, late of Buffalo twp., Washington county, by his last will and testament dated 4 Jul 1823, did bequeath and devise to his daughter LETITIA BROWNLEE, wife of HAMILTON BROWNLEE, of the same twp. and county, one undivided third tract of land situtate in Morris twp., adjoining lands of THOMAS CHAMBERS, and others, containing 154 acres, and wereas Letitia has since died leaving issue, six children: THOMAS BROWNLEE, NATHANIEL BROWNLEE, ELIZA JANE BROWNLEE, DAVID BROWNLEE, SARAH MARTHA BROWNLEE, and FRENCH BROWNLEE, all of whom are in their minority and Hamilton Brownlee, the father of the children was duly appointed guardian of the minor chldren in Sept. last. Therefore, Hamilton Brownlee, of Buffalo twp., Washington county, guardian of his minor children, has full authority to sell and dispose of the interest of his children. 24 Mar 1828. 99. An act authorizing WILLIAM VANSANT to convey lands mentioned and also to authorize LUDWIG NEFF and MICHAEL EVERETT, guardians of the minor children of HENRY CREUTZ, late of Lehigh county, dec., to sell and convey real estate, and authorizing LEWIS TAYLOR of Philadelphia, to sell and convey real estate. Whereas ISAAC VAN PELT, of Wrightstown twp., Bucks county, lately died intestate, seized of a messuage, tenement and lot, containing 12 acres, leaving a widow and six children. Whereas, ELEANOR VANSANT, one of the children, intermarried with WILLIAM VANSANT, lately died leaving issue two children, JANE VANSANT, age nine, and ELIZA VANSANT, aged seven years, in whom the right of their mother is now vested. Therefore William Vansant, of Warminister twp., Bucks county, father of Jane and Eliza Vansant, minor children, is hereby authorized to convey all rights and title of the estate of the minor children. Whereas, Henry Crentz, late of Lynn twp., Lihigh county, died intestate, seized of certain real estate, leaving several children and one grandchild as heirs, three of which children and the grandchild are still in their minority, and a sale of the real estate can now be made to HENRY BRAUCHER, which will greatly benefit the minors. Therefore, Ludwig Neff, as guardian of ISAAC GREUTZ, JUDITH GREUTZ, and JONATHAN GREUTZ, minor children of Henry Creutz,is hereby authorized to sell and convey all rights and title of the minors to Henry Braucher, of a plantation containing 240 acres bounded by JACOB KOENIG, DANIEL WANNEMACHER, PETER NEFF and others, and that Michael Everett as guardian of REBECCA EVERETT, a minor, and grandchild of Henry Creutz, dec., is hereby authorized to sell and convey to Henry Braucher, the rights and title of the minor in the plantation. Whereby, an indenture dated 8 Apr 1826, recorded in Philadelphia in deed book GWR, page 244, made between GEORGE W. ODENHEIMER, CATHARINE ODENHEIMER and BARBARA ODENHEIMER, of the one part, and Lewis Taylor of Philadelphia, of the other part, a certain messuage and lot, situate on the south side of Sassafrass street, was conveyed by Lewis Taylor who paid for the same out of proper funds, and by way of providing for his daughter SOPHIA B. TAYLOR, a minor, took the conveyance in trust for her during her life, and her heirs, an opportunity has occurred for selling and vesting the proceeds more productively. Therefore, it shall be lawful for Lewis Taylor, to sell and grant by deed and convey same to the purchaser. 5 Mar 1828. 100. An act to incorporate the stockholders of the Philadelphia arcade. That the stockholders are declared a body politic and corporate, capable of holding a lot situate on the north side of Chestnut street, and the south side of Carpenter street, between sixth and seventh streets in the city of Philadelphia, purchased by them from WILLIAM TILGHMAN ESQ. The present managers are: EDWARD S. BURD, LEVI ELLMAKER, THOMAS CADWALLADER, WILLIAM BOYD, THOMAS SPARKS, CORNELIUS STEVENSON, THOMAS P. JONES, JAMES M'INTYRE, JOSIAH RANDALL, JAMES BURK, TIMOTHY CALDWED and HENRY HORN, until an election be held, to engage in mining, manufacturing, banking etc. 31 Mar 1828. 102. An act authoring the sale of the real estate of ANDREW HAMILTON, dec. That ELIZA HAMILTON, executrix of the last will of Andrew Hamilton, formerly of the city of Philadelphia, dec. is hereby authorized by herself, or by an attorney she appoints, to sell and convey parts of the estate and convey to the purchaser, reserving rent charged upon the estate sold, payable to Eliza and her heirs. 31 Mar 1828. 103. An act for the relief of MARTIN RANNEY. Were as, Martin Ranney is now in confinement in the goal of Allegheny county, charged with being accessary before the fact to the crime of murder, and whereas, process of outlawry has been issued pursuant to the laws of this commonwealth for the apprehension of DANIEL HICKS, charged with being the principal in the crime of murder, and whereas the indictment against Hicks and Ranney has been removed by certiorari from the court of oyer, and terminer of Allegheny count, to the supreme court of this commonwealth, sitting for the western district of Pa. in that process of outlawry might be issued for the apprehension of Daniel Hicks. Whereas, Martin Ranney cannot be tried until the said outlawry against Daniel Hicks is completed, and Martin Ranney is desirous of having his trial for the charge against him, and is willing to waive his privilege of being tried after the principal in the charge of murder, and he should not be kept in confinement until the outlawry is completed, therefore, the judges of Allegheny county, are hereby authorized to try Martin Ranney, charged with being accessary before the fact to the murder of LEVI SMITH. 31 Mar 1828. 105. An act for the relief of sundry soldiers and the widow of a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to CAPT. SAMUEL BLYTHE, of Franklin county, $375.00 as compensation in full for a tract of donation land, to which he was entitled, for services rendered during the revolutionary war. That the state treasurer is hereby authorized to pay to FREDERICK BAUGHER, for the use of ANDREW YOUNG, of Adams county, a soldier of the revolutionary war, forty dollars, immediately and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to ABRAHAM FISCUS, of Armstrong county, forty dollars, as a gratuity for his revolutionary services. That the state treasurer is hereby authorized to pay to MARGARET GALASPIE, of Lycoming county, widow of CHARLES GALASPIE, $200.00, as compensation in full, for the revolutionary services of her late husband. 7 Apr 1828. 106. An act for the relief of MOSES VAN CAMPEN, an officer of the revolutionary war. That the state treasurer is hereby authorized to pay to Moses Van Campen, of Allegheny county, in the state of New York, an officer of the revolutionary war, twenty dollars, in addition to the annuity already granted, additional sum to commence on 1 Jan 1828. 9 Apr 1828. 108. An act authorizing the executors of the last will and testament of AARON HACKNEY, dec., to sell and convey real estate. Whereas, Aaron Hackney died leaving considerable real and personal estate, and it is suggested that the sale of some part is necessary for the payment of debts, and the support and education of his minor children, and it appears that the disposition of a portion of the real estate would be more to the advantage of all concerned, than the sale of the personal estate. Therefore, it shall be lawful for WILLIAM S. RANKIN and OLIVER STEVENS, executors, of Aaron Hackney, late of Mercer county, dec., to sell from time to time, as much of the real estate within the commonwealth as may be necessary for the payment of the debts of the decedent, and for the education and maintence of the minor children, and to make and execute a deed to the purchaser. 9 Apr 1828. 109. An act for the relief of SUSANNA SCHREIBER, the widow of a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to Susanna Schreiber, of Lancaster county, widow of FREDERICK SCHREIBER, a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1828. 9 Apr 1828. 113. An act authorizing RUDOLPH WISLER, to improve an island in the river Susquehanna, called "Sandy Island." That Rudolph Wisler, of Lancaster county, is hereby authorized to improve an island in the river Susquehanna, called Sandy Island, for the benefit of himself, provided in making the said improvements he does not obstruct the navigation of the river, nor extend the wharf or battery for the protection of the island, more than 100 feet beyond the limits set forth in the patent for the island, granted by the commonwealth to ISRAEL NESTLEROTH, under whom Rudolph Wisler holds the same. 9 Apr 1828. 117. An act authorizing ISAAC STROUB to erect a dam and wing-dam at Vincent's Islands, in the West branch of the Susquehanna. That it is lawful for Isaac Stroub to construct, erect, support and maintain forever, a dam across a small water course dividing Vincent's Islands, and also to extend a wing-dam from the head of the island nearest the borough of Milton, for the distance of 15 rods in a direction to Comly's Island. 9 Apr 1828. 119. An act confirming the name of GEORGE M. STROUD. Whereas, MACDOWEL STROUD, formerly of Stroudsburg, Northampton county, now a resident of the city of Philadelphia, son of DANIEL STROUD, of the first named place, did during his minority assume the name of George, and has been known as George M. Stroud, therefore, all business under the name of George M. Stroud shall be valid, and hereafter the name of George shall be regarded as part of the name of Macdowel Stroud. 9 Apr 1828. 120. An act to pay JOHN M'ELROY a reward. That the commissioners of Bucks county, are hereby authorized to pay to John M'Elroy, such reward and expenses as seem just for pursuing a certain horse thief, by the name of HENRY ELLIOT, who was afterwards convicted in the state of New Jersey. 9 Apr 1828. 121. An act for the relief of SAMUEL WOLF. That at any time withing one year, the judges of the court of quarter sessions of Washington county, are hereby authorized on the petition of Samuel Wolf, of Morris twp., to adjudge the amount of damages, if any, sustained in consequence of a state road leading from Bell's cross roads in Greene county, to West Alexandria in Washington county, having been laid through his land, and the amount paid by the treasurer of Washington county. 9 Apr 1828. 122. An act to incorporate the Lycoming Navigation railroad and coal company. That DANIEL GRAFFIUS and ROBERT ALLEN of Lycoming county, and ROBERT PATTERSON and LEVI ELLMAKER of the city of Philadelphia are hereby appointed commissioners to construct a railroad to improve the navigation of Lycoming creek, and to carry on the business of mining and transporting coal. 9 Apr 1828. 123. A supplement for erecting a bridge over the North-east branch of the river Susquehanna between the town of Cattawissa and the mouth of Fishing creek, passed 15 Mar 1816. An act to incorporate the Dundaff and Tunkhannock, and other turnpike road companies, and for other purposes. That CYRUS AVERY and JOHN MARCY of Luzerne county, and ARCHIPPUS PARRISH and WILLIAM TERBELL, of Susquehanna county, are hereby appointed commissioners, to construct a road form Dundaff, to the house of JOHN MARCY, in Nicholson twp., Luzerne county, down the Tunkhannock creek, to the mouth thereof. An act for the relief of STEPHEN KINGSTON. Whereas, Stephen Kingston of the city of Philadelphia, is the owner of certain real estate in that city, an undivided interest wherein formerly belonged to ANN M'INTOSH, of the Island of Barbadoes, now dec., and whereas, the deed which conveyed the interest appears to be defective in form, although good in substance, therefore, the title of Stephen Kingston, to the real estate conveyed by Ann M'Intosh, is hereby confirmed. 10 Apr 1828. 131. An act authorizing the surviving trustees of WILLIAM YOUNG's burial ground, to exchange certain parts thereof. Whereas, WILLIAM YOUNG, late of Kingsessing twp., Philadelphia county, died seized of certain real estate, and his last will and testament duly proved 1 May 1785, granting letters of administration, devised a lot situate in the township and county aforesaid, unto WILLIAM LEECH, JOHN LEECH, MAXIMILIAN LEECH, ELIZABETH (now by intermarriage ELIZABETH FURLONG) and JACOB HOFFMAN, in trust for a family burying ground, for William Young's heirs and family, forever, containing 2 1/2 acres. An act for the relief of FREDERICK NAVEL and other soldiers, and the widow of a soldier of the revolutionary. That the state treasurer is hereby authorized to pay to Frederick Navel, of Franklin county, a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to BARBARA WHITE of York county, widow of HECTOR WHITE, a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly, to commence on 1 Jan 1828. That the state treasurer is hereby authorized to pay to VINCENT IMFELT, of York county, a soldier of the revolutionary war, forty dollars as a gratuity for his revolutionary services. That the state treasurer is hereby authorized to pay to ABRAHAM JOHNSTON, of Bucks county, forty dollars, as a compensation for his services in the revolutionary war and as a gratuity. That PETER TRAXEL SEN., of South Whitehall, Lehigh county, is hereby appointed to receive in person by order of the state treasurer for the use of JOHN RABENOLD, a soldier of the revolution, the annuity granted by this commonwealth to John Rabenold for his revolutionary services, the said annuity to be expended by Peter Traxel, for the support and maintenance of John Rabenold. 10 Apr 1828. 133. An act to enable GEORGE D.B. KEIM, of the borough of Reading, to sell and convey certain real estate. Whereas, JAMES MAY, late of the borough of Reading, Berks county, dec., by his last will and testament did devise two dwelling houses and three lots to his daughter SARAH MAY, intermarried with SAMUEL D. FRANKS, during her natural life and after her death his executors should sell the houses and lots and proceeds of sale to be divided among the children of Sarah, but it is of interest to all persons concerned for an immediate sale of the real estate. Therefore, it is lawful for George D.B. Keim, executor of James May, to sell and convey the houses and lots devised to Sarah his daughter, and to make a good deed to the purchaser. That the money from the sale be loaned on good security, the interest thereof to be annually paid to SARAH M. An act to incorporate a company to make a turnpike road from the northern termination of the Cheltenham and Willow Grove turnpike road, to Doylestown. That JOSIAH Y. An act granting compensation to BENJAMIN TANNER for his services in the engraving of the state map. That the state treasurer is hereby directed to pay to Benjamin Taner, of the city of Philadelphia, the sum of $1269.88 for compensation, in full, for his services in engraving the state map, being the amount deducted from the account of the representatives of JOHN MELISH, dec, adjusted agreeably to the provisions of the act passed 19 Mar 1824. 11 Apr 1828. 136. An act to incorporate a company for opening a canal and lock navigation between the rivers Delaware and Schuylkill, through the southern section of Philadelphia county. That W.W. FISHER, T.W. An act to incorporate the Tioga Railroad and coal company. That AARON BLOSS, JOHN H. KNAPP, of Tioga county, and ROBERT E. GRIFFITH, of the city of Philadelphia, are hereby appointed commissioners and a body politic and corporate for the construction of a railroad from Peter's camp, in Tioga county, to the New York state line at Lawrenceville. 12 Apr 1828. 142. An act incorporating Union church of M'Keansburg, Schuylkill County. That the elders and church wardens of the United German Lutheran and Reformed congregations, of Christ church, in M'Keansburg are hereby erected one body politic and corporate. The elders and church wardens are: WILLIAM KOCH, (the younger) JONATHAN YOST, and ANDREW BOCK, and GEORGE MEDLER, and BARNARD K. KEPNER, and WILLIAM MAYER. 12 Apr 1828. 143. An act to incorporate the Presbyterian congregation of Montrose in Susquehanna county. That the presbyterian congregation is hereby erected into one body politic and corporate. A supplement to aid in improving and repairing the state road between the Allegheny bridge and Beaver bridge. An act to authorize the trustees of WILLIAM MATEER, of Cumberland county, to execute a deed of release to SAMUEL BLACK. That JOHN MATEER and JAMES DUNLOP, trustees of William Mateer, of Cumberland county, (an habitual drunkard) are hereby authorized, as soon as REBECCA MATEER, the wife of William Mateer, will join them in such deed, to execute a deed of release to Samuel Black, of Juniata twp., Perry county, of the title and interest which William Mateer and Rebecca his wife, in the right of Rebecca, are entitled to under interstate laws, in the estate of her father, JOHN BLACK, late of Juniata county, Perry county, dec. 12 Apr 1828. 148. An act appointing a trustee of certain trust estates and property of ANN PENN GREENLEAF, wife of JAMES GREENLEAF. Whereas, ANN PENN ALLEN, since intermarried with James Greenleaf, previous to her marriage, did with the consent of James Greenleaf, by a deed of trust and marriage settlement, dated 4 Apr 1800, convey to WILLIAM TILGHMAN and JOHN LAWRENCE, in trust for the sole separate use of Ann Penn, certain estates and property, that John Lawrence died, leaving William Tilghman sole trustee, and he now has also died, without any disposition of the trusts, either by deed or will, in consequence the same descended to his heir, which heir is a minor, and not a citizen or resident of Pa, which renders him incapable of discharging the duties of the trusts, to the great injury of Ann Penn Greenleaf. Therefore, all trusts vested in William Tilghman of the city of Philadelphia, and John Lawrence of the state of New York, by a deed of Ann Penn Allen, a spinster, of the city of Philadelphia, since intermarried with James Greenleaf, then of the city of Washington, shall be vested in WALTER C. LIVINGSTON, of the borough of Northampton, Lehigh county. 12 Apr 1828. 149. An act authorizing the orphans' count of the county of Philadelphia to empower JOHN WILLIS, the trustee of JOHN LOCKHART and ELIZABETH LOCKHART, to dispose of real estate in the county of Philadelphia. Whereas, John Lockhart, mariner, being seized of a house and lot, in Southwark district, Philadelphia county, did with his wife Elizabeth, make a deed to John Willis, in trust for thier benefit during their joint lives, and the life of the survivor, and after the decease of the survivor, for the benefit of their children, some of whom are now minors. That John Lockhart and wife Elizabeth, petition the court for an order to sell a brick messuage and lot of ground, by a lot now or late of WILLIAM BRANSON, by John Willis trustee and to execute to the purchaser a good and valid deed, and reinvest proceeds in another real estate. 12 Apr 1828. 151. An act to authorize the trustees under the last will of JAMES LYLE, deceased, to make investments of his estate. That JOHN B. NEWMAN, HARTMAN KUHN and HENRY BECKETT, executors and trustees, named in the will of James Lyle, dec., are hereby authorized to invest the personal estate, and the proceeds of his real estate in the purchase of any kind of real estate, or in the purchase of stock, and the investments shall be for the accounts of the cestui que trusts of that moiety of the estate. 12 Apr 1828. 154. An act to empower JAMES CUMMINS, guardian of the minor children of THOMAS ACHESON, to execute a deed. Whereas, Thomas Acheson, late of Washington county, dec. and DAVID ACHESON, now of the town of Washington, Washington county, entered into partnership, and as partners became indebted to HANNAH ACHESON, and in the settlement and division of their joint funds they agreed between themselves to set apart a tract of land, situate in Canton twp., for the payment of said debt, and in pursuance of the understanding between them, James Cunnins, guardian of the minor children of Thomas, in conjunction with David, entered into a contract for the sale and conveyance of the tract of land to satisfy the debt, but James is unable to convey the undivided interest of the heirs of Thomas Acheson. Therefore, James Cummins is hereby authorized to make, execute and deliver a deed to JAMES M'ELREE, for the tract of land in Canton twp., adjoining lands of DANIEL FEET, Thomas Acheson and others, containing 115 acres. 12 Apr 1828. 155. An act for the relief of the lineal heirs of DAVID BELL, a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to the lineal heirs of David Bell, a soldier of the revolutionary war, $300.00, as full compensation for a tract of donation land to which David Bell was entitled for his revolutionary services. 12 Apr 1828. 158. An act to incorporate the Faulkner swamp and Berks county turnpike road company. That for the purpose of making a turnpike road from the Reading and Perkiomen turnpike, on the bed of the present public road, near JACOB GILBERT's tavern, in Limerick twp., Montgomery county, through Faulkner Swamp, to Boyer's church, in Colebrookdale twp., Berks county, DANIEL BOYER, CHRISTIAN SCHANER, JOHN STAUFFER and HENRY BOYER of Berks county, and GEORGE RICHARDS, PETER BASTRESS JR., JOHN BRENDLINGER, HENRY SCHNEIDER, GEORGE MOUCH and PETER SCHAFFER of Montgomery county, are hereby appointed commissioners. 12 Apr 1828. 161. An act appropriating a sum of money for opening and improving that part of the state road from Smethport, in M'Kean county, in a western direction to the state line, which lies in the county of Crawford and appropriating depreciated money in aid of the improvement of Sinking creek. The sum of $186.00 in notes of the North Western bank of Pa. at Meadville, in the hands of the Pa. treasury and $300.00 in the hands of the Erie and Waterford turnpike road company are to be used by JEDUTHAN GRAY, of Erie county, WILLIAM BATES and MOSES HIGGINS, of Crawford county to improve the road. 12 Apr 1828. 162. An act authorizing PETER KAFROTH, and CHRISIAN CARPENTER, executors of the last will and testament of JACOB KAFROTH, dec., and Peter Kafroth as trustee under the last will and testament of CATHARINE GREIDER, dec., to purchase real estate. That Peter Kafroth and Christian Carpenter, executors of the last will and testament of Jacob Kafroth, late of Lancaster county, dec., are hereby authorized to purchase with the money bequeathed by the will for the use of for the use of SALOME MELHORN, and her children, a daughter of the testor, best adapted to carry into effect the intentions of the testator, such land and tenements within the commonwealth, and make and execute deeds to Peter Kafroth, in trust, for Salome Melhorn, and her children. That the guardian of Samuel Dickson M'Cloy, a minor of Lancaster county, is hereby appointed to purchase such real estate, tenements or hereditaments as he thinks proper, and have made a deed to him as the purchaser in trust, for Samuel Dickson M'Cloy. That Rose twp., Jefferson county, shall be a separate election district, and the electors shall hold their elections at the house now occupied by JOHN LUCAS. 14 Apr 1828. 168. An act authorizing the sale and conveyance of certain real estate. Whereas, JOHN POTT SEN., late of Norwegian twp., Schuylkill county, dec., died intestate, having previous to his death, made several dispositions of parts of his real estate, without perfecting the titles to the purchasers, and the purchasers are anxious to receive deeds legally exceeded for the same. Therefore, it shall be lawful for BENJAMIN POTT, administrator of John Pott Sen., to make and execute deeds to all the purchasers. Whereas, by proceedings had in the orphans' court of Chester county, on the real estate of WILLIAM PATTON, who died intestate, which estate was sold by order of the court to JAMES PATTON, by LEVI M'CORMICK, administrator of the estate, but was never conveyed unto the purchaser, and a certain GEORGE HOUSE, was security for the amount of sale, and has since paid the amount in full. Therefore, Levi M'Cormick, administrator, is hereby authorized to convey to George House, assignee of James Patton. That George House of Lower Oxford twp., Chester county, is hereby authorized to convey a tract of 78 acres, lying in said twp., bounded by lands late the property of ANDREW WALKER, WILLIAM EDMANSON and Octoraro creek, as fully as if James Patton, had conveyed the premises to George House. Whereas, a patent was issued to DAVID SHAFF and RICHARD PINKERTON, for a tract of land situate in Turkey foot twp., Somerset county, on 15 Feb 1813. A division line was agreed upon, and David Shaff died before deeds were executed according to the division. Therefore, JACOB KNABLE and HENRY SHAFF, administrators of the estate of David Shaff, dec., are hereby authorized so soon as Richard Pinkerton, or his assignee shall convey to the administrations in trust for the heirs of David Shaff, the undivided interest which Richard Pinkerton held of land as was set apart ot David Shaff, by the division, to make and execute to Richard Pinkerton, a deed. That JAMES PORTER, administrator, of all the goods and chattels of WILLIAM HAMILTON, late of Lampeter twp., Lancaster county, miller, dec., is hereby authorized to sell a two story brick house and lot, in the borough of Columbia, adjoining lots of JOHN ARMS and MATHEW WILSON, purchased at sheriff's sale, as the property of DENNIS M'MAKIN, to make and execute to the purchaser a good conveyance of deed. That THOMAS M'CALMONT and WILLIAM M'CALMONT, guardians of the persons and estates of WILLIAM M'KEE, JAMES S. M'KEE, and JANE M. M'KEE, children of THOMAS M'KEE, dec., residents of Wayne county, in the territory of Michigan, are hereby directed ot sell all the right and title of the minors in a tract of land, situate in Walker county, Centre county, containing 80 acres, and to execute a deed to the purchaser, and to use the money for maintenance and education of the minor children. That JANE S. REYNOLD, executix, and HENRY BALDWIN and JOHN REYNOLDS, exectors of the last will and testament of THOMAS R. KENNEDY, late of Meadville, Crawford county, are hereby authorized to sell and convey a plantation in the county of Chester, and such tracts, or lots, as necessary, in the counties of Crawford and Warren. Whereas, JOHN TOMLINSON, late of Berks county, dec., by his last will and testament, did devise a tract of land, and lot of ground to his daughter ESTHER PENROSE, intermarried with ENOCH PENROSE, during the natural life of Esther, and after her death sell the same and the proceeds of the sale to be equally divided among her children. Whereas the interest of all persons concerned would be promoted by an immediate sale, therefore, it shall be lawful for JEREMIAH STAAR, surviving executor of John Tomlinson, for the executors of Jeremiah Staar, to sell and convey the tract and lot. That JOHN FULLMER, of Northumberland county, is hereby authorized to sell and convey a tract of land, situate in Turbutt twp., Northumberland county, patented to him on 1 Apr 1812, in trust for the Lutheran church of Turbutt twp. Whereas, by the petition of DAVID KLINE and ISAAC MESSINGER, committee of the estate of PETER KEIFER, a lunatic, concurred in by JOSEPH KEIFER, PETER KEIFER JR., ANDREW KEIFER, SAMUEL KEIFER, ELIZABETH KEIFER intermarried with Isaac Messinger, MARY KEIFER, intermarried with JACOB MESSINGER, CATHARINE KEIFER intermarried with JOHN MACK, the children of Peter Keiter, each having obtained the age of 21 years, that it would conduce to the interest of Peter Keifer, that his real estate be sold, the wife of Peter Keifer having died, the property consisting of 270 acres, situate in Lower Mount Bethel twp., Northampton county, therefore, the above named committee to sell and convey all title and estate of Peter Keifer, of a tract of land consisting of 270 acres, and 1/2 of the purchase money to remain in secured by mortgage upon the premises sold, and the interest thereof, applied to the support and maintance of Peter Keifer. Whereas, JACOB AKE and wife, by deed dated 7 May 1821, recorded in the county of Huntingdon, in book R, page 155, did sell and convey unto the trustees of the Presbyterian congregation of the town of Williamsburg, a piece of ground in Woodbury twp., in trust for the congregation, for the purpose of erecting a meeting house, retiring house and the residue of the ground for a yard, and for no other purpose. Whereas Jacob Ake and wife conveyed to the trustees another lot of ground in lieu of the first, in consideration of the trustees re-conveying to him the first lot, the trustees are hereby authorized to re-convey to Jacob Ake and wife by deed the first lot of ground. That JACOB BERGER, surviving executor of CONRAD ZIMMERMAN, late of Newbury twp., York county, dec., is hereby authorized to make and execute a seed of conveyance, conveying to JOHN E. BERGER and MARTIN CRALL, as tenents in common, a certain island in the Susquehanna river, lying in Dauphin county, between Shelly's island and Muddy Point, on the York shore, containing six acres and 59 perches. John E. Berger and Martin Crall, first paying to the heirs of JOHN BRUNK, dec., their shares in the valuation made in pursuance of an order of the orphans' court of Dauphin county, and confirmed on 13 Dec 1819. That JOHN HARSHE ESQ., and HEZEKIAH WALLACE, guardians of the minor children of ROBERT WALKER, dec., and also HUGH M'CULLOGH, and NANCY M'CULLOGH his wife, of the county of Beaver, are hereby authorized to sell and convey all the right, and title which Robert Walker, had at the time of his death to two small tracts of land, containing together about 75 acres, and 132 perches of land, with a grist and saw mill thereon, situate in Hopewell twp., for the hightest price. Whereas, WILLIAM HALE, late of Washington county, dec., by will dated 19 Dec 1792, devised a tract of land situate in Cumberland twp., Greene county, should be rented and the profits arising therefrom, be put to proper use for the support of the Presbyterian church at Muddy Creek. The said church incorporated on 27 Jan 1806 by the name of Congregation of New Providence and a patent issued to them on 2 Dec 1818, for the lands, but some doubts being entertained as to the validity of the devise, because of not being incorporated at the time it was made, therefore, the devise shall be as valid in law to vest, as if the congregation had been incorporated at the date of the devise. That there are hereby granted unto SARAH WOODS, two lots of ground in the reserved tract opposite Pittsburg, numbered 209, and 210, upon which a settlement and improvements were made by her husband. Three persons shall be appointed by the common pleas of Allegheny county, to make a valuation of the lots, and the value shall be paid to the commonwealth in three yearly, installments, with interests, and the land office shall issue a patent to Sarah Woods, in her name. An act to authorize JOHN TOWERS, to erect a bridge over the canal and river Schuylkill, at a town called Manayunk, Philadelphia county. That it shall be lawful for John Towers, to erect and maintain a permanent bridge opposite a road called Green Lane, running from Roxborough to the canal near the town of Manayunk. 14 Apr 1828. 174. An act for the relief of sundry soldiers and widows of soldiers of the revolutionary war. That the state treasurer is hereby authorized to pay to ELIZABETH MURPHY of Perry county, widow of WILLIAM MURPHY, a soldier of the revolutionary war, forty dollars, as compensation for the revolutionary service of her late husband, and as a gratuity. That the pension payable to MIRIAM DICKSON, of Juniata twp., Perry county, shall be paid to JOHN KOCH, in trust for Miriam to be applied by him to her use, and in case of his death or refusal to serve, the orphans' court of Perry county, shall appoint some suitable person. That the state treasurer is hereby authorized to pay to WILLIAM RICE, for the use of JOHN RICE, of Lancaster county, a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars payable half yearly during life, to commence on the 1 Jan 1828. 14 Apr 1828. 175. An act authorizing the stockholders of the Schuylkill Falls bridge company to sell and convey the property of the company, and for other purposes. Whereas, the Schuylkill Falls bridge in Feb 1822, was carried away by an extraordinary flood, excepting the abutments and piers, which remain in good and sound condition, to the value of $10,000.00, and in consequence of the death of some, and insolvency of others, of the stockholders, the present company that they cannot rebuild it, and petition that SAMUEL HARVEY, ISAAC WARNER ROBERTS, NICHOLAS RITTENHOUSE, ENOCH WHEELER, and ROBERT WATKINS, may be empowered by law as commissioners to sell and make a good deed by the county commissioners of the county of Philadelphia, to re-construct a toll bridge. The above named commissioners are hereby authorized to sell and convey the Schuylkill Falls bridge company and settle all accounts of the present company, and to distribute balance among the stockholders. 14 Apr 1828. 177. An act authorizing the executors of PETER DREHER, of Schuylkill county, dec., to sell certain real estate. Whereas, Peter Dreher, late of the county of Schuylkill, dec., by a codicil attached to his last will, did devise unto his grandson, PHILIP DREHER JR., son of PHILIP DREHER, a plantation situate in Brunswig twp., containing 93 acres, upon condition Philip Dreher Jr., should pay the sum of 300 pounds, to be divided amongst JOHN DREHER, DANIEL DREHER, MATHIAS DREHER, (since deceased) and HANNAH DREHER, (since intermarried with GEORGE KERSHNER) and Philip Dreher Jr., should keep and maintain his father and mother during their natural lives, and after the decease of his father and mother, the tract should be sold, and the moneys arising form the sale, should be divided amongst the brothers and sisters of Philip Dreher Jr. Whereas, Philip Dreher Jr., has refused to accept the devise, upon the conditions by which the object of the testator is completely frustrated, and the life estate in the plantation during the lives of Philip Dreher and his wife, would become vested under the intestate laws of this commonwealth, and whereas the estate cannot be divided amongst the heirs, it is believed that the sum of $300.00 ought to be a lien thereon, and no more then an interest during the lifes of Philip Dreher sen., and his wife, (the children having an interest after his death) can be disposed of during their lives, subject to the lien of $300.00. Whereas, the object of the Testator was to secure to his four children $300.00 to provide for the maintenance of Philip Dreher sen., and his wife during their lives, the money arising from the sale of the plantation, after deducting the $300.00 to the children of Philip Dreher Sen. Therefore, Philip Dreher and Daniel Dreher, executors, are hereby authorized to sell and convey the plantation, bounded by lands of PETER DREHER JR., GEORGE MOYER and others. From the sale the executors are to pay $300.00 to the four children of Peter Dreher Sr., and with the residue of the purchase money, to purchase real estate and convey it to Philip Dreher sen, and his wife, during lifetime of both, and after decease, the title to become vested in all the children of Philip Dreher Sen. 14 Apr 1828 179. A supplement enabling certain trustees to sell and convey the real estate of HENRY STRATER, a lunatic, passed 29 Mar 1809. Whereas MOSES WILSON, one of the trustees is since dead, therefore, MORDECAI MOORE, of Tioga county, is hereby appointed trustee in the room and stead of Moses Wilson, dec., and Mordecai Moore and ISRAEL MERRICK, are hereby vested with all powers vested by the act, provided that the proceedings directed by the court of common pleas of Lycoming county, shall be done and performed in the court of common pleas of Tioga county. 14 Apr 1828. 181. An act to vest in ISAAC ANGNEY JR., and JANE ANGNEY, his wife, formerly JANE HUSTON, the right of this commonwealth to the estate of JONATHAN HUSTON, of Cumberland county. Whereas, by the last will and testament of JOHN HUSTON, dec., of Cumberland county, the testator bequeathed unto Jonathan Huston, and Jane Huston, two of his illegitimate children, full brother and sister, $600.00 each, and Jonathan Huston has been absent about 10 or 11 years, and supposed dead, in consequence of which said estate has become escheated to the commonwealth. Therefore, all right, title and claim which the commonwealth may have acquired by reason of escheat, for the want of heirs of Jonathan Huston, to the estate he was entitled be vested in Isaac Augney and Jane Augney his wife. 14 Apr 1828. 182. An act to annul the marriage contract of HENRY HEIHL and ROSA HEIHL, his wife. That the marriage contract entered into between Henry Heihl and Rosa his wife, of the county of Lebanon, is hereby annulled and made void, and the parties released from the contract and all duties as fully, as if they had never been joined in marriage. 14 Apr 1828. 189. An act declaring Little Toby's creek, Black Lick creek, Little Oil creek, and Clark's creek, public highways. Little Toby's creek, in the counties of Clearfield and Jefferson, from the mouth of JOHN SHEAFFER's mill run, on the main branch of Toby's creek, to the Clarion river, and Black Lick creek, from CHARLES CAMPBELL's mill dam, up the mouth of Two Lick creek, up the creek to the mill now occupied by ALEXANDER T. MOOREHEAD, in Crawford county, to Clark's creek, in Dauphin county, up to ____ WHITTELL's mill, is hereby declared public highways for the passage of rafts, boats and other craft. 14 Apr 1828. 194. An act making appropriation to defray certain expenses of government. That the state treasurer is hereby authorized to pay to DARIUS BULLOCK, of Bradford county, thirty dollars. An act to enable the Hebrew congregation known by the name and style of Kaal Kadosh Mickve Isreal, of the city of Philadelphia, PA, to lease on ground rent a lot of ground in the city of Philadelphia belonging to the congregation, and the relief of the Loganian Library. That SAMUEL HAYS, SIMON GRATZ, ZALEGMAN PHILIPS and ABRAHAM MYERS COHEN, trustees of the Hebrew congregation, are hereby authorized to sell and convey a lot situate at the corner of Spruce and Ninth streets. That if the library company of Philadelphia should feel aggrieved by the assessment of taxes of two tracts of land in Solebury twp., Bucks county, made by JAMES LOGAN, the first to JONATHAN INGHAM, on 1 May 1747, and the last to JACOB DEAN, on 26 May 1747, the library company may appeal and have the county books produced. 14 Apr 1828. 196. An act to enable the controllers of the public schools for the city and county of Philadelphia, and the commissioners to sell and convey certain real estate. That the controllers are hereby authorized to sell a lot situate on the north side of Lombard street, between sixth and seventh streets, bounded on the east by ground late of JOHN HAZLEHURST, and on the west by ground now or late of HENRY PRATT, which BLOOMFIELD M'ILVAINE, by deeds dated 12 Mar 1819, and 20 May 1819, conveyed to the commissioners of the county, subject to a rent of $50.00 per annum, and the commissioners are authorized to execute the proper conveyance, to carry into full effect the contract of sale. 14 Apr 1828. 199. A supplement to an act for the relief of the creditors of the Harrisburg, Carlisle and Chambersburg turnpike road, and for other purposes. Whereas, MATTHEW IRWIN has become liable to the Carlisle bank for the sum of $7000.00, which was borrowed by Matthew Irwin and others, while managers of the turnpike road, and was applied to carry out the works of the company, the tolls and net profits of the road being pledged for the repayment of the loan. By an act dated 1 Apr 1823, the tolls and profits of the road which was pledged for the bank payment was directed to be otherwise paid, and the bank has now brought suit against Matthew Irwin, for the amount, and Matthew Irwin has just reason to believe, that his whole property will be sacrificed, the other managers who joined in borrowing the money, being insolvent and two of them dead. Therefore, all money paid into the bank in pursuance of the provisions of the act be used to pay the certificates of debt in their possession, that payable JOHN CAROTHERS, late of Cumberland county, dec., is to be used for the debt due by Matthew Irwin and the former act is repealed. That the act to improve the roads in M'Kean and Jefferson counties, passed 10 Apr 1826, is hereby repealed. The commissioners, CHARLES C. CASKILL and JAMES L. GILLIS, shall be bound to account for and the bonds given by Charles C. Caskill and James L. Gillis, shall be of the same legal effect as though the act remained in force. That all the right, and interest which this commonwealth may have acquired by reason of escheat for want of heirs of JOHN CUNNINGHAM, late of the city of Pittsburg, dec., to the estate and the same is hereby relinquished for the benefit of RUEY CUNNINGHAM, child of SARAH HUFF and of John Cunningham, dec., and that the guardian of the child, who shall be appointed by the court of Allegheny, is hereby authorized to receive the estate, and to apply the fund for the maintanence and education of the child, and to pay over the balance to investment. All right, and interest which the commonwealth may have acquired by reason of escheat in a tract of land situate in Redstone twp., Fayette county, containing 80 acres, late the property of SARAH MILLER, dec., the same is hereby vested in ROBERT MILLER. 14 Apr 1828. 200. An act for the relief of JAMES SAWYER, a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to James Sawyer, of Dauphin county, forty dollars as a gratuity for his revolutionary services, and the state treasurer is hereby authorized to pay to HENRY KUNTZ, of the borough of York, to be applied by him to the use of CATHARINE NEWEN. 14 Apr 1828. 201. An act to authorize the Sandy and Beaver canal company, to extend a canal into Pa. That the assent of this commonwealth is hereby given to continue canal to Pittsburg. 14 Apr 1828 That BENJAMIN HANNA, DAVID BEGGES, HORACE POTTER, GEORGE M'COOK, JAMES ROBERTSON, JOSEPH RICHARDSON, and EDLERKIN POTTER, of Columbiana county, CHRISTIAN DEARDOFF, and HENRY LAFFER, of Tuscarawas county, WILLIAM CHRISTMUS, WILLIAM HENRY, WILLIAM REYNOLDS and JACOB HOSTETTER, of Stark county, of the state of Ohio, are herby made a body politic and corporate, by the name of The Sandy and Beaver canal company. 11 Jan 1828. 205. An act for the relief of GEORGE HARMAN, a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to George Harman, of Northampton county, a soldier of the revolution, forty dollars as a compensation in full for his revolutionary services and as a gratuity. 14 Apr 1828. 206. An act for the relief of WILLIAN KINSEY and THOMAS BODLEY, soldiers, and CATHARINE ROBERTS, widow of a soldier of the revolutionary war. That the state treasurer is hereby authorized to pay to William Kinsey, of Bucks county, a soldier of the revolution, forty dollars, as a gratuity for his revolutionary services. That the state treasurer is hereby authorized to pay to Thomas Bodley, of Chester county, a soldier of the revolution, forty dollars, as a gratuity for his revolutionary services. An act authorizing the laying out of certain state roads therein mentioned. That ROBERT ROBINSON and DAVID REYNOLDS, of Mifflin county, and JAMES ENNIS, of Huntingdon county, are hereby appointed commissioners to review the state road from ______ CAMPBELL's mill, in Huntingdon county, to the upper toll house, on the Lewistown and Kishacoquillas turnpike road, Mifflin county. That PHILIP SCHNEE of Union county, FREDERICK RINEHART, of Perry county, and JOHN JAMESON, of Mifflin county, are hereby appointed commissioners to lay out a state road from ADAM LIGHT's in Union county, to Liverpool, in Perry county. 15 Apr 1828. RESOLUTIONS 1. Resolution relative to the employment of counsel by the auditor general, in the case of the heirs of JOHN NICHOLSON, dec. Whereas, the circuit court of the United States, for the district of Pa., on the part of the heirs of John Nicholson, dec., alleged to be in the possession of DAVID MANN. Therefore, the auditor general is hereby authorized to employ council and to make out and certify, such records, and papers remaining in his office, relating to the estate of John Nicholson. The attorney general shall reside over case. 5 Dec 1827. 9. Resolution relative to the compensation of the commissioners appointed to revise the Penal code. That the state treasurer is hereby authorized to pay to the order of CHARLES SHALER ESQ., EDWARD KING ESQ., and THOMAS J. WHARTON ESQ., commissioners appointed 1828, to revise the penal code, the sum of $500.00 each. 9 Apr 1828. 10. Resolution relative to the settlement of the accounts of the sureties of WILLIAM HAMILTON, former treasurer of Lancaster county. Whereas, an act passed 13 Apr 1827, the whole amount of interest on the bonds given by GEORGE MUSSER, WILLIAM COOPER and HENRY BEAR, to the commonwealth as sureties of William Hamilton, dec. late treasurer of Lancaster county, was remitted on condition that the principal of the bonds be paid into the treasury the sum of $835.74 before the 1 June, but doubts are raised if this will discharge debt to the commonwealth. etc. 12 Apr 1828. 12. Resolution providing a settlement for repair of the arsenal in Harrisburg. Whereas, by a storm in June, 1824, much damage was done to the arsenal at Harrisburg, and the tents, knapsacks and other public property therein were wet with rain, and would have been materially injured had not much labor and attention been paid to them by JOEL BAILEY, keeper of the arsenal, and as no means have been provided to compensate him in having the necessary repairs made to the building, and pay the laborers employed in attending to the removed and drying of the tents etc. Therefore, the auditor general is hereby authorized to settle and adjust the account of Joel Bailey. 14 Apr 1828.
