CHAMBERS and ROSE ANN CHAMBERS his wife, That the marriage contract entered into by James S. Chambers and Rose Ann Chambers his wife, late ROSE ANN CRAWFORD, both late of the county of Erie, be hereby annulled and made void and the parties released from all duties and obligations as fully and effectually as if they have never been joined in marriage. 17 Jan 1833. 6. An act to incorporate a company to make a turnpike road from the Choconut creek, on the north line of Susquehanna county, to the Abington and Waterford turnpike. That NATHAN BACON, ROWLAND MILES, SAMUEL BARKLEY, ASA OLMSTEAD, JOHN B. BROWN and JOHN MANN, are hereby appointed commissioners, to make a turnpike passing Forest Lake down the out-let to the east branch of Wyalusing creek, to near the house of STIRLING WELLS, thence to the Abington and Waterford turnpike. 17 Jan 1833 7. An act for the relief of ABRAHAM SHOEMAKER and other revolutionary soldiers, and for the relief of CHRISTINA CLEMENCE, the widow of a revolutionary soldier, That the State Treasurer is hereby authorized to pay Abraham Shoemaker, of the county of Columbia, a soldier of the revolution, forty dollars immediately, as a gratuity, and an annuity of forty dollars during life, payable semi-annually, to commence on the 1 Jan 1833. The State Treasurer is hereby authorized to pay unto WILLIAM SPERA, of Lancaster county, a revolutionary soldier, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on the 1 Jan 1833. That the State Treasurer is hereby authorized to pay to PHILIP HOFFMAN, of Lancaster county, a revolutionary soldier, forty dollars immediately, as a gratuity, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1833. An act for the relief of ADAM WEAVER, a soldier of the revolutionary war, and EVE GENSIMER, the widow of a revolutionary soldier and for other purposes, The State Treasurer is hereby authorized to pay Adam Weaver, of Westmoreland county, a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on the 1 Jan 1833. The State Treasurer is hereby authorized to pay to Eve Gensimer, of Lancaster County, widow of JOHN GENSIMER, a soldier of the revolutionary war, forty dollars as a gratuity and compensation in full for the revolutionary services of her husband. The State Treasurer is hereby authorized to pay immediately, to THOMAS CONNELLY, of Washington county, the sum of forty dollars, in full for his military services. 23 Jan 1833 10. An act to incorporate the Willardsburg turnpike road company. That WILLIAM WILLARD JR., ELIJAH DEPUY and A.C. BUSH, are hereby appointed commissioners to lay down a turnpike road beginning at the village of Willardsburg, thence by Mitchells and Hammonds creek to the New York line near the store of MILES COVEL, on Seely's creek. 23 Jan 1833. 11. An act to incorporate a company for making a turnpike road from Coudersport, in the county of Potter, to the New York state line, in the direction of Olean Point. That GEORGE VAUX, TIMOTHY IVES JR., FRANCIS R. WHARTON, DENNIS HALL, JOHN KEATING and JOHN KING are hereby appointed commissioners. 28 Jan 1833 15. An act for the relief of EBENEZER KERR, present coroner of Allegheny county, and for other purposes, The commissioners of Allegheny county are authorized to draw their warrants on the county treasurer in favor of Ebenezer Kerr, the present coroner of said county for the amount of jurors, constables and witnesses fees, paid on coroners inquests held by him at the rate of one dollar per diem for each juror in each case. After the first day of June next, it shall be lawful for the coroner of the county of Allegheny to summon more then fifteen jurors upon any one inquest, and the fees shall be fifty cents each per diem. 21 Jan 1833. 17. An act for the relief of JACOB BASTIAN and others, soldiers of the revolutionary war. The State Treasurer is hereby authorized to pay Jacob Bastian of Lycoming county, ROBERT SHEPPARD of Schuylkill county, DEWALT ROBINSON of York county, MATTHEW GEORGE, CHRISTOPHER SHEFFY and JACOB JOHNSON of Montgomery county, PETER BERRY of Lebanon county, DANIEL STROHL of Northampton county, and BALZER MARTIN of Lancaster county, soldiers of the revolutionary war, forty dollars each immediately, and to each of them an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1833. The State Treasurer is hereby authorized and required to pay to EBENEZER BYERS, of Mercer county, and EDWARD HECTOR, of Montgomery county, soldiers of the revolutionary war, each forty dollars immediately, in full for their revolutionary services. 5 Feb 1833. 19. An act to incorporate the Belvidere Delaware bridge company. That ANTHONY MCCOY, ABRAHAM DEPUE, JACOB BAKER and ROBERT SIMONTON, all of the county of Northampton are hereby appointed commissioners together with the commissioners appointed by the legislature of the state of New Jersey to erect a bridge over the Delaware river, near the mouth of the Pequest river. The commissioners for the state of New Jersey are, GARRET D. WALL of the city of Burlington, and JOHN KINNEY ESQ., JEREMY MACKEY and GEORGE GREEN of the count of Warren, New Jersey. 11 Feb 1833. 20. An act to incorporate the Harrisburg water company. That JOHN FORSTER, JACOB M. HALDEMAN, ROBERT HARRIS, JOHN M. FORSTER, WILLIAM GRAYDON, FREDERICK KELKER, JAMES LESLEY, ABRAHAM BOMBAUGH, FRANCIS R. SHUNK, HENRY BUEHLER, LUTHER REILEY, HUGH HAMILTON, GEORGE GEIGER, JOSEPH B. HENZEY and ISAAC UPDEGRAFF, are hereby appointed commissioners to construct a canal solely for the conveyance of water and free for the owners of lands which the same passes for navigation, above Brushy rock, to the Pa. canal near the land of JOHN FOX, to a point above State street, to Pine St. not to exceed 60 feet in width. 14 Feb 1833. 21. An act for the relief of BENJAMIN JONES and GEORGE EYSTER, soldiers, and CATHARINE WEIKLE and MAGDALENA KUNKLE, widows of soldiers of the revolutionary war, That the State Treasurer is hereby authorized to Benjamin Jones of York County, and George Eyster of Adams County, soldiers of the revolution, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1833. An act for the relief of JOHN LEHMAN, JOHN KITTS, MATTHIAS RITZ, ROBERT WRIGHT and THOMAS ABOTT, soldiers, and CHRISTIANA WILHELM, the widow of a soldier of the revolutionary war, The State Treasurer is hereby authorized to pay to John Lehman of Dauphin County, to John Kitts of Delaware county, and Matthias Ritz of York county, soldiers, and Christiana Wilhelm of York county, widow of a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1833. An act for the relief of sundry soldiers and widows of soldiers of the revolutionary war, The State Treasurer is hereby authorized to pay PHILIP WAGGONER of York county, ANTHONY SHREADER of Berks county, MICHAEL SHINGLEDECKER of Mercer county, and JOHN ENGLISH of Lycoming county, soldiers of the revolutionary war, forty dollars each immediately, and an annuity of forty dollars each, payable half yearly during life, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to MARY SEYBERT, of Philadelphia county, and MARY HARPLE of Montgomery county, widows of revolutionary soldiers, forty dollars each immediately, and an annuity of forty dollars each, payable half yearly during life, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to JACOB EYLER of Cumberland County, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to PAUL BISHOP of Philadelphia county, a soldier of the revolution, the sum of forty dollars immediately, and an annuity of forty dollars payable half yearly during life, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to CATHARINE HAFFERNAN of Crawford county, and ELIZABETH BEARD of Wayne county, in the state of New York, widows of soldiers of the revolutionary war, the sum of forty dollars each immediately, and an annuity of forty dollars each, payable semi-annually during life to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to SARAH CROSS of Philadelphia county, a widow of a revolutionary soldier, the sum of forty dollars in full of her claim as the widow of a revolutionary war. 20 Feb 1833. 31. An act to enable THOMAS LAIRD of the borugh of Erie, to perfect his title to out-lot number four hundred and twelve, of the second section of the town of Erie, Whereas out-lot #412 of the second section of the town of Erie was sold by the commissioners of sales of the lots of said town, at the original sales of said lots, and purchased by JOHN F. JONES. The said lot in 1815 was sold to Thomas Laird of the borough of Erie, and has been in possession of said lot ever since. As title cannot be perfected the commissioner of sales is hereby empowered to issue to WILSON SMITH of the town of Waterford, Erie County a certificate of sale of out lot #412, according to the entry and sales made to the aforesaid John F. Jones is hereby directed, on the application of him and on the production of such certificate of sale to grant to Wilson Smith a patent for out lot #412 on condition that Wilson Smith pay into the treasury of the commonwealth the usual office and patenting fees, and the purchase money due upon the lot with interest, computed from the 8 Mar 1815. 27 Feb 1833. 33. An act for the relief of ZACHARIAH CLOSSON, JACOB BOOZ, HENRY BLOSS and GEORGE SWETZER soldiers, and ELIZABETH HENRY, widow of a soldier of the revolutionary war, The State Treasurer is hereby authorized to pay to George Swetzer of York County, Jacob Booz of Montgomery county, and Zachariah Closson of Montgomery county, the sum of forty dollars each immediately and an annuity of forty dollars to each, payable half yearly during life to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to Henry Bloss of Northampton county, the sum of forty dollars immediately, as a gratuity in full for his revolutionary services. The State Treasurer is hereby authorized to pay to Elizabeth Henry of Lancaster, the widow of a revolutionary soldier, the sum of forty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1833. 1 Mar 1833. 34. An act to erect Mifflintown, in the county of Juniata, into a borough and for other purposes. Boundries: beginning at the Pa. Canal, thence along land of JOHN WRIGHT and JACOB WRIGHT to a black oak, corner of _____ BIRD's land, to a corner post of lot of JAMES CURRIN's heirs, etc. That THOMAS M'CURDY ESQ., AMOS GUSTINE ESQ. and JAMES MATHERS ESQ., shall publish and superintend the first election. 6 Mar 1833. 35. An act for the relief of DENNIS CARROL and FREDERICK BRUNER, soldiers, and ANN CAROTHERS and CATHARINE KEASEY, widows of soldiers of the revolutionary war, The State Treasurer is hereby authorized to pay to Dennis Carroll of Erie county, and Frederick Bruner of Montgomery county, soldiers of the revolutionary war the sum of forty dollars immediately, and to the said Dennis Carroll an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay Ann Carothers of Chester county, and Catharine Keisey of York county, widows of revolutionary soldiers, the sum of forty dollars immediately, and an annuity of forty dollars each, during life, payable half yearly, to commence on 1 Jan 1833. 6 Mar 1833. 36. An act for the relief of JONATHAN JACOBS and JACOB ERB, soldiers, and ELIZABETH MOSER, ELIZABETH WHEELAND, CATHARINE SHEELY and MARY PARKER, the widows of soldiers of the revolutionary war, The State Treasurer is hereby authorized to pay to Jonathan Jacobs of York county, Jacob Erb of Northampton county, soldiers of the revolutionary war, forty dollars immediately, and an annuity of forty dollars payable half yearly during life, to commence on 1 Jan 1833 The State Treasurer is hereby authorized to pay to Elizabeth Moser of Berks county, Elizabeth Wheeland of Northumberland county, and Catharine Sheeley of York county, widows of soldiers of the revolutionary war, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence 1 Jan 1833. An act for removing strata of rock from the bed of the Wallenpaupaek river, in the counties of Pike and Wayne, and for other purposes. An act for the relief of GEORGE KELLER, a soldier, and LOUISA OSTEER and CATHARINE CURRY, the widows of soldiers of the revolutionary war, The State Treasurer is hereby authorized to pay George Keller of the city of Philadelphia, a soldier and to Louisa Osteer of the county of Lancaster, the widow of a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1833. An act for the relief of JAMES KIRK, BENJAMIN WATSON, JAMES CURRY, THOMAS HENDERSON, THOMAS CLARK and ADAM LEAD, soldiers, and CATHARINE REHR, the widow of a soldier of the revolutionary war, The State Treasurer is hereby authorized to pay James Kirk of Bucks county, Benjamin Watson of Montgomery county, James Curry of Deleware county, Thomas Henderson of York county, and Thomas Clark of Butler county, soldiers of the revolutionary war, the sum of forty dollars to each immediately, and an annuity of forty dollars to each during life, payable half yearly, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay Adam Lead of Lancaster county, a revolutionary soldier, forty dollars as a gratuity for his revolutionary services. An act concerning elections. An act for the relief of JOHN OVERTURFF, THOMAS BURK and GEORGE COOK, soldiers of the revolution, The State Treasurer is hereby authorized to pay John Overturff, of Fayette County, a soldier of the revolution, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to Thomas Burk of York county, a soldier of the revolution, forty years immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to George Cook, of Greene County, a soldier of the revolutionary war, forty dollars as a gratuity, for his revolutionary services and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1833. 18 Mar 1833. 47. An act to change the names of SEBASTIAN GUNDT, GEORGE HENRY GUNDT, and BENJAMIN GUNDT of the county of Northampton, and JOHN GEORGE GUNDT of the county of Bucks, They are hereby authorized to change their names from Sebastian Gundt, to Sebastian Goundie; from George Henry Gundt, to George Henry Goundie; from Benjamin Goundt, to Benjamin Goundie; from John George Gundt to John George Goundie and shall be known by these names. 18 Mar 1833. 53. An act to confer on HORATIO NELSON BEAUMONT, ANDREW JACKSON BEAUMONT, SARAH ANN BEAUMONT, LOUISA BEAUMONT, GEORGE HARRISON BEAUMONT, JOHN ADDISON BEAUMONT, and WILLIAM M. BEAUMONT, the rights and benefits of children born in lawful wedlock, Whereas, JOHN BEAUMONT, of Solebury Twp. Bucks county, previous to his marriage with ELIZABETH ARNWINE, he had by her seven children, to wit; Haratio Nelson Beaumont, Andrew Jackson Beaumont, Sarah Ann Beaumont, Louisa Beaumont, George Harrison Beaumont, John Addison Beaumont, and William M. Beaumont and he has prayed to confer on the said children, born before his said marriage, the rights and benefits belonging to legitimate issue. It is hereby enacted that the children shall respectively have and enjoy all the rights, benefits and advantages of children born in lawful wedlock, as if they had respectively been born subsequently to the intermarriage of their parents. 21 Mar 1833. 54. The State Treasurer is hereby authorized to pay to WILLIAM CLARK, of Bedford county, and JOHN GERMAN of Berks county, soldiers of the revolutionary war, respectively, the sum of forty dollars each, immediately, and an annuity of forty dollars each, during life, payable half yearly, to commence on the 1 Jan 1833. An act for the relief of ROBERT CAMPBELL, FREDERICK BAUM, JAMES M'DOWEL, MICHAEL RAGER, JOB HELMS and SAMUEL SHAW, soldiers, and JUSTINA WEISER and MARGARET DENTZLER, the widows of soldiers of the revolutionary war, The State Treasurer is hereby authorized to pay to Robert Campbell of Perry county, Frederick Baum and James M'Dowell of Mifflin county, soldiers of the revolution, forty dollars to each immediately, and an annuity of forty dollars each during life, to commence on 1 Jan 1833. The State Treasurer is hereby authorized to pay to Michael Rager of Cambria county, a soldier, and Margaret Dentzier of Lebanon county, the widow of a soldier of the revolutionary war, forty dollars immediately, and an annuity of forty dollars to each, payable half yearly during life, to commence on 1 Jan 1833. 25 Mar 1833. 58. A supplement to an act for laying out a state road from the bridge over the river Delaware at New Hope, thorough Doylestown, over the bridge at Norristown, Mongomery county, through West Chester to the state line, to Baltimore MD, and from York, through Lewisberry to the Harrisburg bridge and for other purposes. That MORDECAI DAVIS, THOMAS JONES, JOSEPH ROBERTS, WILLIAM CONRAD, WILLIAM WALLEY and ISAIAH HESTON, are hereby appointed commissioners to review the state road laid out from New Hope to the Maryland state line, commencing where the road strikes WILLIAM HICKS and JOSEPH GARRETT's land, commencing in the Sweedsford road where the road enters the land of JOSEPH B. WALKER, thence through lands of GEORGE BEAVER SEN., WILLIAM C. THOMPSON, DANIEL ABRUM, JAMES JONES, to the old Lancaster road, to the Paoli tavern. These commissioners shall meet at the house of JOSHUA EVANS (Paoli tavern) and review the road. JAMES PATTERSON of Hopewell twp., JOHN BOYD and STEPHEN WOODS are hereby appointed commissioners to review the state road leading from the Washington and Pittsburg turnpike road, near Ramsey's ford, Allegheny county, to the Virginia state line, in a direction to Wheeling. That WILLIAM V. LEET and WILLIAM WILSON of Washington county, and WILLIAM LEA, of Allegheny county, are hereby appointed commissioners to review a state road, beginning near the house of ROBERT LOVE, on the Williamport and Washington turnpike, in Washington county, to JAMES CONNER's on the road leading to Pittsburg, Allegheny county. That JOSEPH SCHALL, JOHN EMEY and JOHN STRICKLER, be commissioners to lay out a part of the state road authorized 19 Mar 1829, concerning laying out roads in Greene, York, Cumberland and Schuylkill counties, from the borough of York. That THOMAS COULSON, JAMES M'CRACKEN and ADAM CARNAHAN of Mercer county, are hereby appointed commissioners to review the road from Greenville to Franklin, which lies near Georgetown and Holloway's mill. 25 Mar 1833. 62. An act to discharge insolvent debtors from arrest, and for other purposes. Whereas, WILLAIM LASH and DOROTHEA SODER, administrators of the estate of JOHN SODER, late of Bern Twp. Berks county, that by an error in their administration account, they have been incorrectly charged with the sum of $1420.00 and are likely to suffer serious loss. The Orphans Court of Berks county is hereby authorized to open the decree confirming the settlement of the said account and directing distribution of the balance shown, and to permit a re-statement of the account and then settled in the mode pointed out by law. Whereas, SIMON B. M'GREW and ARCHIBALD B. M'GREW, executors of the last will and testament of JACOB M'GREW, of Westmoreland county dec. have represented that NATHAN M'GREW, FINDLAY M'GREW, SIMON M'GREW, and SAMUEL M'GREW, four of the sons and legatees of Jacob M'grew, dec. are deaf and dumb, and by reason of their infirmity, are incapable of managing their property, and it is represented that the first three are above the age of 21 years, and the fourth above the age of 14 years and under the age of 21. Therefore, the Orphans Court of Westmoreland county is to appoint guardians for them with the same rights, powers and privileges as guardians for minors under the age of 21. The guardianship shall continue as long as they have need of it and no longer. 30 Mar 1833. 65. An act to authorize the surviving executors of the will of HENRY DRINKER, dec. to sell certain lands therein mentioned, and for other purposes, Whereas, Henry Drinker, late of the city of Philadelphia, dec. did at the time of his death, hold in his name by patent, eight tracts of land, situated in Northampton, now Wayne county, the same having been surveyed in the names of JOHN DRINKER, GEORGE DRINKER, THOMAS P. COPE, SAMUEL SIMPSON, MARY SANDWITH, BENJAMIN WILSON, THOMAS STEWARDSON and JOHN THOMAS, which lands were held in trust by Henry for the use of a society known by the name of "The Society for promoting the manufacture of sugar from the sugar maple tree, and furthering the interest of agriculture in the state of Pennsylvania:" and whereas the members of the society have petitioned to give authority to the surviving executor of Henry Drinker, to sell the lands. Therefore, Thomas Stewardson, of the city of Philadelphia, surviving executor of Henry Drinker dec. is hereby authorized to sell the tracts of land referred to and convey same to the purchaser, free and discharged from all obligations and to pay and distribute the proceeds among the members of the association. Whereas, JOHN C. STOCKER and MARY KATHARINE STOCKER his wife, died seized of various town lots and tracts of lands, in the counties of Berks, Chester and Montgomery, and of real estate in the city and county of Philadelphia, and also of certain undivided portions of lands in the counties of Chester and Berks which they held in common with numerous heirs of the family of ______ POTTS, (by reason of dispute in the titles, it has been impossible to divide) and also undivided rights to iron, copper, or other mines, ore banks, minerals or fossils with right of digging for same and conveying them away in Berks and Chester counties. In consequence of the decease of one of the heirs of John C. Stocker and Mary Katharine his wife, the fee of one fourth of the estate have been vested in his devisees, some of whom are minors, subject to the life estate of his widow and the shares of some of heirs have been conveyed in trust. Some of the estate are in different parts of the state, and encumbered with rights for raising iron ore, a partition under the law would not be calculated to do justice. Therefore, the surviving heirs of John C. Stocker and Mary Katharine his wife, and the devisees of ANTHONY STOCKER dec. or a majority of them, at least three fourths with the consent of the guardians, husbands, and trustees of those who are minors, or married women, or have conveyed in trust are authorized to make partition in four equal parts all of the estate and allot the different heirs their respective shares. If it is the opinion of the freeholders that any or all should be sold then upon application of three fourths of them to the courts such lands will be sold and deeds conveyed. 30 Mar 1833. 66. An act appointing commissioners to settle the accounts of WILLIAM HAWLEY, a contractor for the erection of the Chester county poor house, It is hereby enacted that MORGAN J. THOMAS, WILLIAM EVANS, JESSE PAGH, JOHN TEMPLETON ESQ. and JAMES WILSON ESQ. or a majority of them, are appointed to enquire and determine whether if any amount of money is due and unpaid to William Hawley of Chester county, for work and labor done by him in the erection of the poorhouse or for extra work work done in consequence of a change of the original contract for building said house, from stone mason work to brick mason work. KEATING, his property situated in the county of Philadelphia or elsewhere, the whole to be enjoyed by her during her natural life, and after her death to be divided into equal portions between their children (if no will), and as no power was given by his will to sell and it is essential to the interests of the minor children and the widow that real estate should be sold. MORRISON and DANIEL GARBER, the present trustees are authorized to sell the following land: a tract situated in Toboyne twp., Perry County, containing 10 acres, adjoining lands of JOHN FLEICHER, JOHN ERNST and others, by actual measurement 32 acres and three perches, and to execute to the purchaser a deed. 127. An act granting compensation to the legal heirs and representatives of GEROGE FOLTZE, for a certain tract of land situate in Salem, one of the seventeen townships in the county of Luzerne, and for other purposes, That if George Foltze, or his legal heirs require it, title shall be examined to the property of a tract of land situate in Salem Twp., one of the seventeen twps in Luzerne county, surveyed on a warrant dated 17 Jul 1783 in the warrantee name of George Foltze, containing 468 acres, and if found that the land has been certified to Connecticut settlers, under the provisions of the act for adjusting the titles to lands in the seventeen townships of Luzerne county, and George Foltze was fully and fairly entitled to the tract of land, except as against the holders of the certificate granted to Connecticut settlers, then they shall ascertain the amount of the land at seventy five cents per acre and issue a certificate to George Foltze for the amount of the land, and the State Treasurer is directed to pay the amount and he shall release title to the land. That if JAMES M'CLURE and HEZEKIAH PANCOAST, or either of them, shall require it, the board of property shall examine the title of James M'Clure and Hezekiah Pancoast to a certain tract of land situate in Salem Twp. Lot to be sold entered in patent book H, volume 3, page 122 in the land office. That WILLIAM H. RICHARDS is hereby confirmed in the title of certain real estate in the city of Philadelphia, consisting of lots purchased by the Bank of North America at sheriff's sale and which the bank on 20 Feb 1810 conveyed to D.C. CLAYPOOLE, to purchase, hold or convey the real estate and that William H. Richards shall hold the real estate as if The Bank had conveyed same. An act to authorize JOHN EVERHART to erect a wing dam in Juniata river, That John Everhart, of Juniata Twp., Perry county is hereby authorized to erect a wing dam in the Juniata River on the east side at or near the Juniata falls, for the purpose of creating and using water power, providing it shall not interrupt or impede navigation thereof or injure private property. If anyone does sustain injury to his private property he shall recover double the amount of damages form John Everhart or his heirs. If he obstructs navigation he shall remove the dam in three days and will pay a fine of $20.00 per day for every day after that. 8 Apr 1833. 156. An act to incorporate a company to extend the West Chester railroad into and along the streets of the borough, and for other purposes. That WILLIAM EVERHART, EBER WORTHINGTON, THOMAS S. BELL, CAPTAIN WILLIAM APPLE and JAMES TILLUM, of the borough of West Chester, are hereby appointed commissioners to construct a railroad of a single tract. 9 Apr 1833. 173. An act authorizing the laying out of a state road from ____ M'CLEAN's mill, in Beaver county, to some point near Perrysville, in Allegheny county, and for other purposes. That WILLIAM M'CALISTER and ROBERT RENO, of Beaver county, and JAMES DUFF of Allegheny county, are hereby appointed commissioners to lay out a state road in Beaver county to Perrysville, Allegheny county. That ENOCH PHILLIPS, of Washington county, and JOSEPH E. M'CABE and ALEXANDER CARNAHAN of Allegheny county, are hereby appointed commissioners to lay out a state road, beginning at the farm of ALEXANDER MURDOCK, in Washington county, to the bridge across Sawmill run, near the Burnt Mills, in Allegheny county. That the sum of $600.00 appropriated and approved 13 Apr 1827, shall be paid to JOHN HARPER of Cumberland county, and SAMUEL LOY of Perry county, to be laid out by them in improving the state road from Gettysburg to the Conococheague hill, lying half in Cumberland and half in Perry county. That the sum of $1000.00 is hereby appropriated to be paid to SAMUEL MOORHEAD ESQ., JACOB D. MATHIOT ESQ., and JOHN BINGHAM ESQ., commissioners, for improving the state road from Johnstown in Cambria county, to New Alexandria, in Westmoreland county. That the Secretary of the Commonwealth and the clerks of the courts of Allegheny and Butler counties, are hereby authorized to receive and file the report of a state road laid out from ARTHUR MCGILL's mill, in Butler county, to MARTIN BYRN's in Allegheny county. 9 Apr 1833. 175. An act to supplement the act to enlarge the buildings of the State Penitentiary for the Eastern District and for other purposes, passed 28 Mar 1831. Whereas, it is represented that JOHN M'DONAH, formerly of Beaver, left his residence more then thirteen years since, and went down the Ohio river, and never having been heard of, is supposed to have died, that he left some property in Beaver, and an illegitimate daughter named MARGARET M'DONAH, whom he has acknowledged and educated. Therefore, all the right, title, and interest of the Commonwealth of Pa. in the estate, real or personal, by escheat, is hereby vested in his daughter Margaret M'Donah. That the recorder of deeds for the city and county of Philadelphia, is hereby authorized to acknowledge satisfaction of record of a mortgage executed by the contributors to the Pa. Hospital, to THOMAS MIFFLIN ESQ., Governor of the state of Pa. bearing the date 7 May 1793, recorded as a deed in the city and county of Philadelphia, in mortgage book #9, pg. 335. 9 Apr 1833. RESOLUTIONS 8. Resolution relative to the division line of Union and Lycoming counties. That JOSEPH F. QUAY of Centre county, and JAMES F. MURRAY and DAVID ROCKEFELLER of Northumberland county, are hereby appointed commissioners to mark the division line of Lycoming and Union counties. 21 Mar 1833. 11. Resolution relative to the payment of the costs in certain cases of supposed escheat. That the Auditor General is hereby authorized to settle and adjust the costs accrued in the case of the alleged escheat of the estates of MARK V. KENNELL, late of Union (formerly Northumberland) county, and of CHARLES M'CULLUM, JOHN WALTER and GEORGE BENDER, all of Lancaster county, and of ANN RONEY of Washington county, and to draw his warrants on the State treasurer for the amount which shall be found due in the aforesaid cases, respectively. 3 Apr 1833. 15. Resolution for the relief of ISAAC GRIFFITH, late marshal of the Eastern district of Pa., Whereas the late deputy marshal, Isaac Griffith, of the Eastern district of Pa. was exonerated from the payment of a certain judgement obtained against him in Bucks county but not from the payment of costs, he is now released from the costs of the suit and to be paid $139.14. 8 Apr 1833. 18. Resolution relative to the estate of JOHN DE PUI, The Auditor General is hereby authorized to collect from the estate of John de Pui, clerk of the Senate, dec. all money due. 8 Apr 1833. 19. Resolution relative to the disposal of water power at Milton, Northumberland county. That the canal commissioners are hereby authorized to contract with GEORGE ECKERT of Milton, Northumberland county, for the use of such supply of water of the West Branch canal, for his mills, as he may want. 8 Apr 1833. 20. Resolution relative to the Peninsula at the bay of Presque Isle, on lake Erie. Whereas, much damage has been done to the peninsula by cutting timber growing thereon, and by digging up and by setting fire tot he shrubbery growing thereon, whereby the permanency of the peninsula and the safety of the public works and of the harbor are endangered. Therefore, RUFUS S. REED, of the borough of Erie, is hereby authorized for the period of five years, to take charge of the peninsula on behalf of the commonwealth, and to prevent any person from trespassing. 8 Apr 1833. 21. Resolution for the relief of JOHN KELKER, late deputy marshal of the Eastern district of Pa., and for the relief of JACOB HECK, late brigade inspector, 2d brigade, 11th division Pa. militia, Whereas a judgement was obtained in a Circuit court of Dauphin county against John Kelker, late deputy marshal for the eastern district of Pa. for certain fines which had been collected from delinquents for non-performance of militia duty, during the late war with Great Britain and as he did not receive credits for service rendered he is hereby released from the payment of the judgement remaining unsatisfied against him and his lands and goods shall be exonerated from any execution. The State Treasurer is hereby authorized to pay to Jacob Heck, late brigade inspector of the second brigade of the eleventh division, Pa. militia, the sum of sixty dollars as compensation in full, for settling the accounts of his predecessor. 9 Apr 1833. 23. Resolution for the relief of WILLIAM B. MITCHELL, The Auditor General is authorized to settle the account of William B. Mitchell, superintendent of Philadelphia and Columbia railroad, for the moneys not exceeding ten hundred and thirty dollars, by him expended in the months of October and November, 1832 in procuring physicians, medicine and a temporary hospital to attend and accommodate the laborers employed on the Eastern Division of said railroad, during the prevalence of the Asiatic cholera, to be paid out of the funds appropriated to the said road. 9 Apr 1833.
