Limric 1998 GOVERNOR JOSEPH RITNER December 15, 1835 to January 15,1939 Although less educated than any other governor, he is credited with preserving the School System when it was in danger of being overthrown. JOSEPH RITNER, the eighth and last governor under the constitution of 1790, was born in Berks County, PA, the 25 Mar 1780. His father was JOHN RITNER, who emigrated from Alsace, on the Rhine. In his youth Joseph worked upon his father's farm. His only schooling was six months in a primary school at age six. At the age of sixteen he moved to Cumberland County, where he worked as a laborer on the farm owned by JACOB MYERS, near Newville. In 1800 he married SUSAN ALTER, of Cumberland County. Their offspring were six sons, and three daughter. Soon after their marriage they moved to Westmoreland Coumty, and settled on a farm belonging to the wife's uncle, DAVID ALTER, in Washington County. The uncle possessed a good library, principally German works. During Joseph's leisure hours, he delved, and what was wanting in education he himself corrected. In 1820 Joseph Ritner was elected a member of the House of Representatives, from Washington County, and for six years. In 1824 he was elected speaker and was re-elected in 1825. In 1829 he was nominated for Governor. He received a large vote but was defeated by GEORGE WOLF. In 1832 he was again nominated, received an even larger vote but was defeated again. His third try in 1835 he was elected. In 1834 the law for the establishment of a common school system was passed. Unfortunately, it proved unsuited to the wants of the State. It was too perfect, so elaborately drawn, with the minutest detail provided for, that little discretion was allowed to adapt it to the wants of the diversified population of the various districts. A provision, in 1835, was brought forward in the Senate for its abolition, and for substituting the system of 1809, educating the poor gratis, which was carried. In the house it was stopped by the appeals of THADDEUS STEVENS, who was wrought up to a great pitch of excitement while delivering his speech. He took a position in the middle aisle where he had full freedom of action. The vote was taken, and the friends of common schools won. Fortunately for the cause of education, the law was preserved intact. Upon Governor Ritner's election he selected for Secretary of the Commonwealth, THOMAS A. BURROWES, a firm friend of education. With the aid of GEORGE SMITH M.D., who was chairman of the joint committee of education in the two Houses, they drew up an entirely new bill, embodying the principles of the old law, but divesting it of objectionable features. It was presented in 1836, and was carried. It went into immediate effect, providing for the child of wretchedness and poverty equally with the most favored and pampered offspring. Toward the close of Joseph Ritner's life he manifested a lively interest in the success of the common school system, attending Teachers' Institutes in the County where he lived, and acted as presiding officer when near the age of eighty. In 1861, the Normal School at Edinboro, Erie County, was recognized and adopted by the state, whereupon Joseph Ritner became an inspector, appointed by his old friend Thomas Burrowes, at the age of eighty-three. Governor Ritner always regarded his connection with the school system with singular satisfaction, and viewed the consummation of its adoption as the crowning glory of his administration. He received the nomination in 1838, for re-election, but was defeated by about five thousand votes. There were questions by many that he had been defeated by fraud. A fierce struggle ensued, with some wishing the votes of the Northern Liberties be thrown out. The struggle reached the point where Gov. Ritner ordering out the militia to keep order, and even had to call upon the United States authorities for help. Order was restored, and the two Houses were again permitted to meet. A majority of the House finally voted to recognize the election as valid and ended the contest. At the expiration of his term, Governor Ritner returned to private life, taking up residence near Mount Rock, in the county of Cumberland. Possessed of a strong constitution and a powerful frame, he rarely complained of sickness. In 1840, he was attacked by cataract in both eyes, and was for some time nearly blind. By an operation performed upon the right eye, sight was completely restored so that he was able to read with ease the finest print. So painful was the operation that no consideration could induce him to submit to one upon his left, and that remained sightless to the day of his death. In 1848, he was nominated by PRESIDENT TAYLOR, Director of the mint at Philadelphia. He served for a short time, but before his nomination was acted on by the Senate, President Taylor died, and he retired, to make room for the favorites of PRESIDENT FILLMORE. He was a delegate from PA to the National Convention which nominated JOHN C. FREMONT for president, and remained an ardent Republican to the end of his life. Governor Ritner was endowed with the faculty of memory that was almost miraculous, he never seemed to forget a name, event, or fact. He could recall occurrences in his life, and repeat debates with surprising accuracy. He never used tobacco or spirituous liquors, his convictions strong, his opinions once formed were rarely changed. He died on the 16 Oct 1869, in his ninetieth year. In General Assembly met and is hereby enacted by the Authority of the Same. 1. An act granting relief to JOHN SCHUCKER, a soldier of the revolutionary war, and for other purposes. Whereas, it appears that an act passed 15 Apr 1834 authorized to pay to JACOB SCHUCKER, of the county of Berks, forty dollars immediately, an annuity of forty dollars during life, it appears the name of the applicant to whom it was granted is John Schucker, who, by error, was deprived of the benefit of this act. Therefore, the State Treasurer is authorized to pay to John Schucker of Berks county, a soldier, the sum of eighty dollars and an annuity of forty dollars during life payable half yearly, to commence on 1 Mar 1835. So much of the act passed 15 Apr 1834 as grants an annuity and pension to Jacob Schucker of Berks county, is hereby repealed. 19 Dec 1834. 2. An act for the relief of sundry soldiers, and widows of revolutionary soldiers. An act to authorize ADAM REIGART, of the city of Lancaster, guardian of ADAM REIGART HOPKINS, EMILY W. HOPKINS and HORACE HOPKINS, minor children of GEORGE R. HOPKINS and ANN HOPKINS his wife, late of the said city, to sell and dispose of certain real estate and rent charges, and for other purposes. An act extending the time limited in the will of WILLIAM WORK, deceased, for the sale of his real estate. Whereas, the last will and testament of William Work, late of the borough of West Chester, Chester county, dec. HARRIET WORK and JOSEPH JONES, his executors, were authorized to sell all his real estate within one year after his decease, and as his executors are unable to effect a sale of a portion within the period named, they are hereby authorized to sell the said real estate, remaining unsold, and to make good title to the purchaser, as if the same had been sold within the time prescribed in the will of the deceased provided the sale shall be effected within one year from the 1 Apr 1835. 12 Jan 1835. 7. An act to vest certain real estate in the Seventh day Baptist Monastical society of Snowhill. Whereas, by deed, dated 22 Sep 1823, ANDREW SNOWBERGER conveyed to ABRAHAM ELY, JOHN SNOWBERGER, JOHN MANN, CHARLES HOUGH and ABRAHAM BURGER in trust, for use of the monastical branch of the society, then living at Snowhill, two pieces of land, one containing 106 acres, and the other 2 acres and 96 perches, in Washington tpw., Franklin county, Pa., and whereas, John Snowberger, by deed, dated 25 Aug 1829, conveyed to John Mann, Charles Hoch, Samuel Snowberger and Daniel Mann, as trustees of the Seventh day Baptish society, two other pieces of land, one containing 18 acres and 104 perches, and the other 1 acre and 68 perches. Whereas FREDERICK HESS and wife, by deed dated 3 Aug 1832 conveyed to the trustees 21 acres and 104 perches, and whereas BARBARA SNOWBERGER, by deed, dated the 27 Mar 1833 to the trustees, 98 perches of land, and whereas, John Snowberger, by deed dated the same day, conveyed to the trustees 25 acres and 91 perches of land. The same society, on the 17 Jun 18334 has been incorporated and has desired the parcels of land be vested in the society. Therefore, all tracts conveyed to the trustees are now vested in the society. 16 Jan 1835. 13. An act to confer on MARY LAVINIA LEAS the rights and benefits of a child born in lawful wedlock. That Mary Lavinia, the daughter of GEORGE W. LEAS, late of Adams county and MARGARET LEAS, (late MARGARET GROVE, of Franklin county) born some time before the marriage of George W. and Margaret Leas, shall have and enjoy all the rights, benefits and advantages of a child born in lawful wedlock, as if she had been born subsequently to the marriage of her parents. 24 Jan 1835. 15. An act for the relief of sundry soldiers and widows of soldiers of the revolutionary war. The State Treasurer is hereby authorized to pay to ANNA MARIA REHRER of Schuylkill county, a gratuity of forty dollars immediately, in full for her late husbands revolutionary services. 26 Jan 1835. 17. An act for the relief of GEORGE MILLER, DANIEL DEVENY, NICHOLAS GROH, JOHN SHAEFER, FREDERICK MARKER and HENRY WALTER, soldiers, and CATHARINE BECHGY, the widow of a revolutionary soldier. That the State Treasurer is hereby authorized to pay to George Miller of Schuylkill county, Daniel Deveny of Juniata county, Nicholas Groh of Berks county, and Frederick Marker of Delaware county, soldiers, and Catharine Bechgy of Northampton county, the widow of a revolutionary soldier, forty dollars to each immediately, and an annuity of forty dollars to each during life, payable half yearly, to commence on 1 Jan 1835. An act to authorize CHARLES ROBERTS, guardian of CALEB C. ROBERTS and HENRIETTA ROBERTS, to sell certain real estate. That Charles Roberts of the city of Philadelphia, the guardian of his two minor children, Calab C. and Henrietta Roberts, is hereby authorized to sell and convey, all or any part of the estate of the minors in a piece of ground situated on the north side of Callawhill St. and the west side of Eleventh St. in the district of Spring Garden. 19 Feb 1835. 32. An act to continue the benefit of the unexpired term of an auctioneer's commission to MATTHEW P. MITCHELL. That Matthew P. Mitchell, of the city of Philadelphia, commission merchant, late of the firm of Gillingham, Mitchell and Co. is hereby licensed as an auctioneer of the city for a period of eight months and thirteen days, and no longer, with the powers conferred heretofore paid for and granted for one year to MAHLON GILLINGHAM, but not used by him for the last eight months and thirteen days. 24 Feb 1834. 38. An act to incorporate a company to make a turnpike road from the borough of Ligonier town, in Westmoreland county, to Donegall town. That MARTIN MILLER, JOHN GRAY, JOHN CAMPBELL ESQ., COLONEL JOSEPH LLOYD, ALEXANDER CAVEN, KILLEN AMBROSE, FREDERICK MARKLE, JOHN M'FARLAND and JACOB DIVELBESS, all of Westmoreland county, are hereby appointed commissioners. 4 Mar 1835. 40. A supplement to an act relative to the Butler and Freeport turnpike road company. The act passed 14 Apr 1834, names of commissioners should be WILLIAM WALKER and NATHAN SKEER, instead of WILLIAM SKEER and NATHAN SKEER. 42. An act relative to the election in Carroll and Nottingham Twps. in Washington county, and election districts in Sewickly twp, in Westmoreland county, and Carroll township,, Perry county. The township of Sewickly, Westmoreland county, are hereby authorized to hold an election at the house of ELIZABETH CARNAHAN, to elect a constable and other officers. SAMUEL M'GREW ESQ., is hereby appointed judge. 10 Mar 1835 47. An act to incorporate a company to erect a toll bridge over the West Branch of the river Susquehanna at Walton's landing. NASH and WILLIAM ACUFF, vestrymen, are hereby erected into a separate body politic or corporate, by the name of St. Thomas's church, in Whitemarsh twp. Montgomery county. 21 Mar 1835. 60. An act authorizing the removal of a certain action of ejectment brought by JACOB HOFFMAN against JOHN G. COSTER and others, in the court of Schuylkill county, to an adjacent county for trial. For the recovery of about twenty one thousand acres of land. Whereas a great number of citizens of the county are either directly or indirectly interested in the title to the lands and in consequence of which, a fair and impartial trail cannot be had in the said county. It shall be lawful for either party, wherein Jacob Hoffman is plaintiff and John G. Coster and others are defendants, to remove the same the court of any adjacent county. 23 Mar 1835. 64. An act to vest in AMELIA MATHEWS, a certain escheated estate, and for the sale and conveyance of certain real estate. Whereas JAMES MATHEWS, late of Buckingham Twp., Bucks county, a man of color, died vested of a house and lot of ground in said county, and leaving a daughter, Amelia Mathews, which property was escheated to the Commonwealth, under the impression that there were no heirs to receive, as Amelia his daughter was a slave to JOHN MCKALEB, of Frederick county, and state of Maryland. The said McKaleb agrees to manumit and set free the said Amelia, if the Legislature will vest the right to the escheated property in the said Amelia Mathews. Therefore the estate of James Mathews is hereby granted to Amelia Mathews, the daughter of James Mathews, dec. This shall not take effect until the said John McKaleb, the master of Amelia, now a slave, shall manumit and set free Amelia. DANIEL DRUCKEMILLER, of the county of Northumberland, is hereby authorized to sell and convey the real estate of DAVID WEISER, late of Penns Twp., Union county, dec. and he shall have full power to execute a deed to the purchaser Whereas by an act passed 5 Mar 1804, BARBARA WEISER, administratrix, and BENJAMIN WEISER, administrator of CONRAD WEISER of Penns Twp. Northumberland county, were authorized to sell and convey all the town and out lots of Conrad Weiser, situated in the town of Weisersburg, adjoining the town of Selinsgrove in the Township aforesaid. And as Barbara and Benjamin are both deceased, leaving some of the lots undisposed of and JOHN BASSLER and DANIEL WEISER have been appointed administrators and now pray to pass a law conferring on them the same power was granted to Barbara and Benjamin Weiser dec. for the purpose of disposing of the unsold lots and settling the estate. They are hereby authorized on behalf of the heirs to sell and convey lots in the town of Weisersburg. Whereas, several lots of real estate in the township of Beaver, Union county, were vested by the last will and testament of DANIEL FISHER, in the German Reformed congregation of Heidelburg, in Lebanon county, and which are unproductive to the congregation in their present situation. The present elders of Heidelburg, in Lebanon county, are authorized to sell and convey these lots to the purchaser. MELCHIOR BRINDLE, guardian of MARY ANN MENICH, only child of GEORGE MENICH, dec. and WILLIAM MCKESSON, guardian of SAMUEL ZEIGLER and SOLOMON MAXWELL, guardian of SARAH CATHARINE MAXWELL, only children of SARAH MAXWELL dec. formerly SARAH ZEIGLER, are hereby authorized to convey an release on behalf of their wards, all the rights and title in 120 acres, 125 perches of land, situate Green Twp. Franklin county, and sold by the heirs of SIMON MENICH dec. (under whom his grandchildren, the minors aforesaid, in right of their parents are entitled) to JOHN SHIVELY and to convey 5 acres, lately sold to JOHN GELSINGER as if the minors were of age. Melchior Brindle, guardian of Mary Ann Menich, is authorized to convey and release on behalf of his ward, all her right and title to 36 acres and 82 perches of land, situate in said township to William McKesson in trust for Samuel Zeigler and Sarah Catharine Maxwell, after death of Solomon Maxwell, the said land having been by agreement laid off as the proportion of the plantation of which Simon Menich died seized, to which Samuel Ziegler and Sarah Catharine Maxwell would be entitled, in right of their mother Sarah Maxwell, dec. one of the daughters of said Simon, the said Sarah has a life estate as tenant by courtesy. The guardian is authorized to execute conveyance for the transfer and release to William McKesson, as if the minor were of age. DAVID L. SCOTT and HARRY MORGAN, executors of the last will and testament of GEORGE SCOTT, late of the borough of Towanda, in the county of Bradford, dec. are hereby authorized to sell several tracts of wild and uncultivated land in Bradford county and all of the town lots and buildings i the borough of Towanda, as may be necessary to erect convenient buildings and make suitable improvements for the family of the deceased and for the devisees, either upon a farm in Towanda or upon a farm in Wyson, Bradford county, of which the deceased died seized. Whereas, GEORGE SCOTT, held the legal title to a valuable lot and buildings in the borough of Tonwanda, in the possession and occupancy of DANIEL BARTLETT, and also a lot and buildings in the village of Monroe, Bradford county, in the possession and occupancy of WILLIAM HART, but it is alleged by Daniel Barlett and William Hart and the executors of the deceased are induced to believe their allegations, that the deceased held the estates in trust for Daniel Barlett and William Hart, subject to certain parol conditions to be preformed by them. These claims should be speedily settled and upon recorded evidence, the court of Bradford county shall order the evidence to be certified and recorded i the office for recording of deeds and the executors should execute the deeds. SANDERSON, and the other situate on a back street, and adjoining lots of WILLIAM H. SANDERSON and ROBERT H. HAMMOND, late the estate of JAMES HUTCHISON, dec.,(under whom his grandchild the said minor, in right of her mother, is entitled,) and the guardian if is empowered to execute the conveyance for the transfer or release in the above property, as if the minor was of age. An act to authorize the canal commissioners to settle and adjust the claim of damages of SAMUEL TALMAGE and ROBERT CRISWELL, HUGH BIGHAM and the heirs of DANIEL CAREY. That it shall be the duty of the Canal Commissioners to ascertain the amount of damages sustained by Samuel Talmage and Robert Criswell and Hugh Bigham, in the carrying away their salt, and injuries done their salt works, erected and established previous to the construction of the dams and public works on the Kiskiminetas river, by the flood in January, 1832, as the loss was occasioned by the construction of the dams. Damages will be assessed and amount paid as appears to be just and right and shall be in full of all claims not to exceed $1000.00 in the case of Talmage and Criswell, and $1000.00 in the case of Hugh Bigham. The Canal Commissioners shall ascertain the amount of damage sustained by DANIEL CAREY, of Luzerne county, in consequence of the breach in the Nanticoke dam and guard wall, at the time of the flood in the river Susquehanna, in the spring of 1833, and the amount paid, for damage to land only. 1 Apr 1835. 67. An act to change the name of JOHN HITCHCOCK, of the city of Philadelphia and others. That John Hitchcock is hereby authorized to change his name from John Hitchcock to JOHN IVES and to do all legal acts under this name. JOHN HAMER is hereby authorized to change his name from John Hamer to NELSON SOMERVILLE and to do all legal acts under this name. The name of JOHN LINDSAY FURGUSON PIZANT is hereby changed to JOHN LINDSAY FURGUSON and to do all legal acts under this name. The name of MARY ANN FLOYD is hereby changed to MARY ANN STANLEY and to do all legal acts under this name. 1 Apr 1835. 71. An act to authorize the appraisers of damages on the Pa. canal to settle and adjust the claims for damages of DAVID BRENNEMAN, WILLIAM COCHRAN and LEWIS BRENNEMAN. That is shall be the duty of appraisers of damages on the Pa. canals, to ascertain the damage done to David Brenneman, William Cochran and Lewis Brenneman, in the carrying away and destruction of their salt on the river Kiskiminetas, below the Leechburg dam, by the freshet in February 1832 and if upon full investigation the damage was caused by the construction of the dam, the sum of no more then $600.00 shall be paid. 2 Apr 1835. 72. An act to authorize the appraisers of damages on the Pa. canal to settle and adjust the claim of damages of JAMES RODGERS and JOHN M'KEOWN. That it shall be the duty of the appraisers of damages on the Pa. canal to ascertain the damage done to James Rodgers and John M'Keown, in the carrying away and destruction of their salt on the river Conemaugh, by the freshet in February 1832 and upon investigation damages for the loss caused by the dams in the river Kishiminetas shall be paid, not to exceed $2500.00. 2 Apr 1835. 74. An act to authorize the trustees of the Methodist Episcopal church in Carlisle, Cumberland county, to sell and convey certain real estate. That HUGH REED, JOHN PHILLIPS, ABEL KEENEY, ISAAC BELL, DAVID REISINGER, MICHAEL DIPPLE, THEODORE MYERS, CHARLES BELL, trustees of the Methodist Episcopal church in Carlisle, Cumberland county, are hereby authorized to sell and convey all the estate and title to the lot and church building erected thereon, situtate in the borough of Carlisle, on Church alley, and numbered 99. 3 Apr 1835. 75. An act to change a part of the line between the counties of Franklin and Cumberland, to establish the division line between the counties of Huntingdon and Mifflin and relative to the line between Perry and Juniata. FRANCIS SAMPLE of the county of Huntingdon, DAVID HAUGH of the county of Mifflin, and JOHN CAMPBELL of the county of Centre, are hereby appointed commissioners for the purpose of running and marking the division line between the counties of Huntingdon and Mifflin, from the Juniata river, Jacks narrows, to the line of Centre county. 4 Apr 1835. 81. An act to incorporate the Lumberville Delaware Bridge Company. Whereas, the inhabitants of the county of Bucks, deem the erection of a bridge over the Delaware river, near Lumberville would be a great convenience to the public. Therefore, JOSHUA Y. An act to legalize a certain marriage contract between NATHANIEL BELL and MARGARET BELL, late MARGARET MARKS of Juniata county, so far as to legitimate their offspring. That the marriage contract entered into between Nathaniel Bell and Margaret Marks, of Juniata county, on 1 Sep 1824, which in consequence of the wilful desertion, and long continued absence of the former wife of Nathaniel Bell, was at the time of its consummation erroneously supposed to be legal, and the same if hereby declared to be valid and legal, and removes all legal disabilities from the offspring of Nathaniel and Margaret, up to the time of their subsequent legal marriage on 18 Nov 1834, and the children, namely, MARY BELL, ANN BELL, ELIZABETH BELL, WILLIAM BELL, REBECCA BELL, EPHRAIM BELL and SAMUEL BELL, shall have all the rights of children born in lawful wedlock, and to all intents and purposes as if they had been born subsequently to the legal marriage of their parents. 9 Apr 1835. 86. An act to confer on AMELIA WENRICK the rights and benefits of a child born in lawful wedlock. That Amelia, the daughter of PETER WENRICK, of Dauphin county, and CATHARINE WENRICK, (late CATHARINE DICKEY, of the same county,) and born some time before the marriage of Peter and Catharine, shall have all the rights of a child born in lawful wedlock, and to all intents and purposes as if she had been born subsequently to the marriage of her parents. 9 Apr 1835. 90. An act to dissolve the marriage contract of ROBERT M. RIDDLE and MARY JANE RIDDLE his wife. That the marriage contract entered into by Robert M. An act to incorporate a company to erect a bridge over Stony creek, at Johnstown, in Cambria county. An act to incorporate the Hollidaysburg and Bedford turnpike road company, and from the borough of Blairsville, in Indiana county, to Mount Pleasant in Westmoreland county, and from the Milford and Owego turnpike, near Wilsonville, in Pike county, to the Bethany and Dingman's Choice turnpike road, near CHARLES KIMBLE's milles in Wayne county, and to incorporate the Germantown and Wissahickon turnpike road company. An act for the relief of CHARLES NICE. Whereas, Charles Nice by deed poll, dated 13 Apr 1812, he granted and conveyed certain real estate to trustees in trust, to apply the income thereof to his use during his life, and after his death to the use of his relations and next of kin, and the income arising therefrom not being sufficient for his support, the trustees were under the necessity of selling part of the land and applying the whole proceeds directly to his use, instead of investing the same and so applying the income only, and as the income is insufficient for his maintenance, he is desirous that an act be passed directing that the residue be sold and the proceeds invested in the purchase of a life annuity for him. An act for the relief of BENJAMIN SPAYD and ISAAC BECK, late overseers of the poor of the borough of Pottsville, and for other purposes. That Benjamin Spayd and Isaac Beck, late overseers of the poor of the borough of Pottsville, Schuylkill, are hereby authorized to collect such taxes as have been levied by them for the support of the poor, and are subject to the same powers and authority and the same penalties and liabilities as other overseers were prior. 10 Apr 1835. 99. An act to annul the marriage contracts of ISRAEL STEEL and MARY STEEL his wife, JACOB OILER JR. and MARY OILER his wife, ROBERT MEARS and LYDIA MEARS his wife, and HAMILTON SPALDING and JANE SPALDING his wife. That the marriage contract entered into by Israel Steel and Mary his wife, late MARY GEIGER, both of the Dauphin county, is hereby annulled and made void and the parties released and discharged from all duties as fully as if they had never been joined in marriage. The marriage contract entered into by Jacob Oiler Jr., now a convict in the Western Penitentiary and Mary his wife, is hereby annulled and made void, and the parties released from all obligations as fully as if they had never been joined in marriage, and the said Mary is hereby constituted the legal guardian of the children of the marriage. An act authorizing the laying out of a state road from Shippenville, in Vanango county, to Ridgeway, in Jefferson county. A Supplement to the act authorizing the incorporation of the Strasburg railroad etc. WILLIAM P. FARRAND and MATHEW C. Resolution relative to the claim of JAMES APPLETON and ETHRINGTON APPLETON. That the canal commissioners are hereby authorized to settle the claims of James and Ethrington Appleton, late contractors on the State works, and make allowance for work they done at the Allegheny tunnel, and on section seven of the Portage rail road as may appear just under their contract. 10 Mar 1835. R 6. Resolution relative to GEORGE W. HENRY, a contractor on the Pa. rail road. The canal commissioners are hereby authorized to settle the claims of George W. Henry, late contractor on the eastern division of the Allegheny portage rail road, and make allowance for the timber furnished by him, of the dimensions of six by eight inches square and over fifty thousand feet, as may appear just. 12 Mar 1835. R 7. Resolutions for the relief of RANKIN KNOX, and ARMSTRONG KNOX and JOHN KNOX and ROBERT KNOX, contractors on the Lycoming line, Pa. canal. The canal commissioners are hereby authorized to settle the claims of Rankin and Armstrong, contractors, for constructing aqueduct #1 on the Lycoming line, Pa. canal under their contract. That the canal commissioners are hereby authorized to adjust the claims of John and Robert Knox, contractors for building an aqueduct over Larris creek, on the Lycoming line Pa. canal, under their contract. 21 Mar 1835. R 8. Resolution relative to the claim of JAMES MACKEY. That the canal commissioners are hereby authorized to cause to be constructed such a device as in their judgement shall be most expedient for the protection of the land of James Mackey of Clinton Twp., Lycoming county, against the action of the water of the river Susquehanna upon the same, below the Muncy dam if they find said dam is the cause of the new action of the water and of washing away the bank of said land. 21 Mar 1835. R 10. Resolution relative to the pension of ISAAC VANHOOK. Whereas, the Legislature of 1833, passed an act granting Isaac Vanhook of Fayette county, a soldier of the revolutionary war, a gratuity of forty dollars immediately and forty dollars during life, payable half yearly, to commence on 1 Jan 1833. and whereas, Isaac Vanhook died without receiving the gratuity or any part of the annuity. Therefore the State Treasurer is hereby authorized to pay to SARAH VANHOOK, widow of Isaac Vanhook, late of Fayette county, dec. gratuity that was granted to her husband. 7 Apr 1835. R 12. Resolution to authorize the canal commissioners to enquire into the claims for damages of JANE REESE and others. The Canal commissioners are hereby authorized to enquire into whether the loss sustained by Jane Reese, in the burning of her property near the Columbia and Philadelphia rail road, in November, 1834 and also whether the loss sustained by JOSEPH J. DOWNING, JEREMIAH MOORE, JAMES OGDEN and JOB GRIFFITH in the burning of their property near the Columbia and Philadelphia rail road in January and February 1835, were caused by fire from any locomotive engine, and the actual loss shall be ascertained and entitled to, and paid. If it appears any portion of the property was suffered by negligence to be burned, which by reasonable and proper exertion have been saved, no dame shall be allowed for loss of property so suffered to be destroyed. 10 Apr 1835. R 14. Resolution for the relief of SAMUEL BOON, JOSHUA HAUSE and JAMES M'CLURE. That the board of canal commissioners are hereby required ot construct such drain as may be necessary to drain from the lands of Samuel Boon, Joshua Hause and James McClure, of the township of Bloom, Columbia county, all waters by which their lands are now or may be inundated in consequence of leakage from the Pa. canal. 11 Apr 1835. R 15. Resolution for the relief of GEORGE WEISER. The Canal commissioners are hereby authorized to settle and adjust the claim of George Weiser, late a contractor for building the abutment at Shamokin dam, on the east side of the Susquehanna river, and to make him allowance for work he has done, and stone for which he has been overcharged in the settlement of his accounts. The Auditor General is hereby authorized to audit the same. 11 Apr 1835. R 19. Resolution relative tot he removing of sand and gravel from the public ground, and to lay out a street from the capital to the canal. Resolved, that JAMES PEACOCK, OVID F. JOHNSON, and WILLIAM AYRES, shall survey and lay out a street from the public grounds to the state Canal. 14 Apr 1835. R 20. Resolution to provide for the payment of certain costs on suits brought by the Commonwealth, and relative to the calculation of interest in the case of the Commonwealth versus HENRY BALDWIN. The State Treasurer is hereby directed to pay to GEORGE ZEIGLER of Adams county, in trust for those entitled to it, the sum of fifty six dollars, being the costs on suits brought by the Commonwealth in the court of Adams county, #15,16,17, 18 and 19 of Jan. term, 1829. The accountant officers be authorized to liquidate and adjust the amount due by Henry Baldwin to the State, on a bond given for the purchase money of certain lands sold him by commissioners appointed to make sale of the lands of the late JOHN NICHOLSON, under the lien of the State thereon, and also to make such deduction or suspension of interest during the pendency of claims to said lands so sold adverse to the right claimed by the State. 14 Apr 1835. R 21. Resolution relative to the claim of BENJAMIN BEAR and others. The Canal Commissioners are hereby authorized to pay to Benjamin Bear, of Lycoming county, contractor for building the Muncy dam, the sum of $400.36, the balance due him for that work, to be paid, and the Auditor General is hereby authorized to audit the same. The board of appraisers of canal damages are hereby authorized to re-examine and assess the damage, if any, which has been sustained by MARTIN M'ALLISTER, JOHN KNORR, DAVID PETRIKEN and GEORGE A. FRICK of the county of Columbia, by reason of the construction of the Pa. canal, and it shall be the duty of the board to issue subpoenas for witnesses, and examine them under oath in relation to the claims of the persons named in this bill. That the canal commissioners and appraisers shall consider the case of ABRAHAM ADAMS, ANDREW VONCOMP and ANTHONY ROATH of Perry county, for canal damages. The canal commissioners are hereby required to ascertain the balance due, if any, to JAMES S. ESPY, late a contractor on the Juniata division, Pa. canal, for cast iron furnished by him for the Big Buffaloe aqueduct on said division, and pay the amount thereof. 14 Apr 1835. R 23. Resolution relative to the Gettysburg and Hagerstown turnpike road. The time for completing the road is extended for five years, and JAMES D. PAXTON and JAMES A. THOMPSON are appointed additional commissioners, to the act passed 10 Mar 1818. 14 Apr 1835 R 25. Resolution relative to the claim of JOHN KEAN and HUGH CURREN. That the Canal commissioners are hereby authorized to settle and adjust the claims of John Kean and Hugh Curren, late contractors on Portage rail road, section #6, and make them such allowance for work they have done and loss sustained in consequence of the rise of the water in the Conemaugh, and conveying timber across said stream, as may appear just. 14 Apr 1835. R 27. Resolution relative to the claim of JANE PARSONS, widow and administratix of WILLIAM PARSONS, dec. late contractor on the Juniata division Pa. canal, section #44. That the Canal Commissioners are hereby authorized to examine and re-measure the work done by William Parsons, dec. on section 44 and culvert on said section, and settle the same agreeably to contract, except as to price on culvert. It shall be the duty of the appraisers of damages on the Pa. canals to ascertain the amount of damages sustained by the heirs of JOHN SOMMER, dec. by reason of the construction of the canal basin, on property belonging to them in the borough of Bristol, in Bucks county, taking into consideration the advantages of the canals to properties aforesaid.
