An act authorizing ISRAEL WALTON, trustee, under a certain deed of trust executed by SAMUEL ROLAND FISHER, dec. late of the city of Philadelphia, to sell and convey certain real estate. That Israel Walton, is hereby empowered to sell a certain plantation situated in the townships of Mooreland and Byberry, Philadelphia county, containing 77 acres, 69 perches, which Israel Walton now holds in trust for the benefit of MARTHA E. DAWES, widow and relict of SAMUEL F. DAWES, and her children, under a deed of trust executed by Samuel Roland Fisher, late of the city of Philadelphia, dec. and convey to the purchaser a deed, provided the written consent of Martha E. Dawes is obtained and filed in the Orphans court. 19 Dec 1836. 10. An act for the relief of WILLIAM RUFF, late a Commissioner of the county of Philadelphia. The commissioners of Philadelphia county are hereby empowered to draw on the treasurer in favor of William Ruff, late a commissioner of said county, for the amount of his daily pay from 19 Oct 1835 to 31 Dec 1835. 27 Jan 1837. 11. An act for the relief of PETER HAMMER and others, soldiers and widows of soldiers of the Revolutionary war. That the State Treasurer is hereby authorized to pay to Peter Hammer of Fayette county, JOHN FOUST of Columbia county, MARY BROOKHOUSER of Crawford county, ELIZABETH LUDWICK of Philadelphia county, soldiers and widows of soldiers of the revolutionary war, forty dollars to each immediately, and an annuity of forty dollars to each during life, payable half yearly, to commence on 1 Jan 1837. The State Treasurer is hereby authorized to pay to CONRAD HERBST of Berks county, BENJAMIN LESHER of Armstrong county, HANNAH HETRICH of Crawford county, a gratuity of forty dollars to each immediately, in full for their revolutionary services. The State Treasurer is hereby authorized to pay to THOMAS DEEDS of Montgomery county, a gratuity of forty dollars immediately, and an annuity of forty dollars during life, payable half yearly, to commence on 1 Jan 1837. By an act passed 16 Jun 1836, a pension was granted to EVAN RUSSEL of Centre county, but owing to an error having been committed affixing Chester county instead of Centre, he has been deprived of the relief intended. Therefore, the State Treasurer is hereby authorized to pay to Evan Russel of Centre county, the gratuity and annuity provided for in said act, agreeably to the provisions thereof. By an act passed 15 Jun 1836, a gratuity and annuity was granted to JOSEPH BURKHER of Fayette county, which proves to be a mistake, in consequence of which mistake, GEORGE BURKHER, the petitioner has been deprived of receiving aid, by the passage of said act of relief. Therefore, The State Treasurer is hereby authorized to pay George Burkher of Fayette county, the said gratuity and annuity, in the same way as though no mistake had been made. 27 Jan 1837. 12. An act to authorize the Appraisers of Damages on the Pa. canal to settle and adjust the claim of damages of JACOB HILL and company. That it shall be the duty of the Appraisers of damages on the Pa. canal, to ascertain if any damage was done to Jacob Hill, ELI HILL, and LEVI HILL, co-partners in trade, under the firm of Jacob Hill and Company, in the carrying away and destruction of their salt on the river Kiskiminetas, below the Leechburg dam, by the freshet in Feb 1832 and if damage was sustained and caused by the construction or breaking of the dams, without negligence on the part of the owners, then report the amount of damages and paid. 3 Feb 1837. 13. An act authorizing the sale of part of the real estate of DANIEL GREGORY, late of Susquehanna county, dec. Whereas, Daniel Gregory, late of Susquehanna county, died seized of certain timber lands, with a small saw mill thereon, situate partly in each of the counties of Susquehanna, Bradford and Luzerne, containing 163 acres and 116 perches which the Orphans Court of Susquehanna has directed to be sold for payment of debts, therefore the administrators are authorized to sell this land and convey a good deed in Susquehanna county, notwithstanding said lands lie partly in three counties. 8 Feb 1837. 15. An act for the relief of WILLIAM HALL and others, soldiers of the Revolutionary war. That the State Treasurer is hereby authorized to pay to William Hall and BENJAMIN GARISON of Washington county, JOHN SHIELDS of Indiana county, JACOB DEILCORD of Lehigh county, SAMUEL REED of Perry county, PETER SCHLOSSER of Adams county, MICHAEL WAUGH of Westmoreland county, MICHAEL M'GIRK of York county, PHILIP KREINER of Schuylkill county, JACOB BLACKFORD of Fayette county, BARNABAS HART of Lancaster county, soldiers of the revolutionary war, forty dollars to each immediately, and an annuity of forty dollars to each during life, payable half yearly to commence on 1 Jan 1837, provided that COL. GEORGE MILLER be appointed a trustee to take charge of the pension hereby granted to Jacob Deilcord, and to make disposition as his comfort and welfare may require. That the State Treasurer is hereby authorized to pay to PETER WITMYER of Lebanon county, and JOHN UNANGST of Northampton county, forty dollars to each immediately, as a gratuity in full for their revolutionary services. 9 Feb 1837. 16. An act to incorporate the Laurel Hill Cemetery company, in Penn twp. Philadelphia county. Whereas, the practice of burying in populous cities is becoming more objectionable, and more burdensome and expensive to the community, therefore, NATHAN DUNN, BENJAMIN W. RICHARDS, JOHN J. SMITH JR., FREDERICK BROWN, WILLIAM M. MEREDITH, EDWARD COLEMAN, GEORGE N. BAKER, HENRY TOLAND and NICHOLAS BIDDLE, are hereby made a body politic and corporate. The first four named shall be managers. 9 Feb 1837. 19. An act to enable CHARLES WHARTON JR., to connect League Island, in the county of Philadelphia, with the main land. That Charles Wharton Jr., is hereby authorized to connect League Island in the river Delaware, with the main land by a causeway, in a line with Broad Street. 23 Feb 1837. 21. An act to vest in EDWARD H. BRIEN and SARAH B. ROGERS, wife of HENRY ROGERS, the title to certain real estate in the county of Lancaster. Whereas, HENRY CASSEL, to secure payment of a debt of $8500.00 due him by Edward Brien, late of the county of Lancaster, dec. executed a mortgage to him on 5 Apr 1816 of real estate situate in Donegal twp. Lancaster county, and after the decease of Edward Brien, his executors, JOHN BRIEN, HENRY BRIEN, ADAM REIGART and JAMES WRIGHT, Esquires, issued a scire facias upon the mortgage, in Nov term, 1819 and on 22 Nov 1819 judgement was obtained. When the property was put up for sale it was bought by the said executors for the use and benefit of the heirs of Edward Brien, dec. and deed made for same, but the said sheriff's deed contains no declaration of trust, and the grantee John Brien has since died, without having made any conveyance to the heirs of Edward Brien. Therefore, the title of the property is vested in Edward H. Brien and Sarah B. Rogers, (formerly SARAH B. BRIEN, now married to Henry Rogers) surviving children of Edward Brien, dec. as if the deed had been made to them. 24 Feb 1837. 23. An act to incorporate a coal company. That BENJAMIN A. BIDLACK, EDWARD L. TAYLOR, I.Y. JEANES, GEORGE WARDER, JOHN R. DEAN, JOHN PARKER, HENRY COLT and ISAAC BARTON, are hereby constituted a body politic and corporate, by the name of Mountain Coal company, within the counties of Luzerne and Northampton with the power to construct a railroad with one or more tracts. 28 Feb 1837. 26. An act for the relief of PHILIP GRAVER and others, soldiers and widows of soldiers of the revolutionary war. That the State Treasurer is hereby authorized to pay to Philip Graver of Lancaster county, WILLIAM FLUE of Philadelphia county, WILLIAM SHEHEN of Beaver county, RICHARD LEE of Northampton county, PETER LENHART of Perry county, soldiers, LEAH CRAWFORD of Montgomery county, and ELIZABETH MUNINGER of Franklin county, widows of soldiers of the revolutionary war, forty dollars to each immediately, and an annuity of forty dollars to each during life payable half yearly, to commence on 1 Jan 1837. The State Treasurer is authorized to pay to JOHN GONTER of Berks county, a gratuity of forty dollars immediately, in full for his revolutionary services. The State Treasurer is hereby authorized to pay to WILLIAM MULLEN of Montgomery county, a soldier of the revolutionary war, eighty dollars immediately, as a gratuity, and an annuity of forty dollars during life, to be paid half yearly, to commence on 1 Jan 1837, and so much of the act passed 1 Apr 1836, as granted a pension to William Mullen of Philadelphia county, is hereby repealed. The State Treasurer is hereby authorized to pay to MARGARET MILLER a widow, and a daughter of BENJAMIN SILL of Montgomery county, a soldier of the revolutionary war, who had made application for a pension but has since deceased, the sum of forty dollars as a gratuity in consideration of the services of Benjamin Sill. 3 Mar 1837. 27. A supplement to the act for the regulation of the Militia of this Commonwealth. That the enrolled militia attached to the first and forty-fourth regiments, first and second brigades, sixth division, Pa. militia, residing in the following bounds, shall compose a separate battalion, to be called the third battalion of the forty-fourth regiment, commencing at the Blue mountain at Deglar's gap, thence to JOHN MILLER's mill, in upper Tulpehocken Twp., thence to a cross road on JOHN DERR's land, thence along a public road leading to JACOB SEYFERT's mill, in Heidleberg twp. to Seyfert's mill, along a road leading to Reading, to a creek called Brunenkill, thence leading from _____ HEISTER's mill to Bern church, thence to the farm of JOHN ALLWINE, dec. thence along a public road to MR. BLATT's farm, including SAMUEL MOGEL and Mr. Blatt, thence to a house formerly occupied by JAMES SILLYMAN ESQ., thence to Blue mountain to the beginning, and the battalion to be held in Bernville, Berks county. 3 Mar 1837. 28. An act for the relief of ROBERT COCHRAN and others, soldiers and widows of soldiers of the Revolutionary war. That the State Treasurer is hereby authorized to pay to Robert Cochran of Butler county, PATRICK BURK of Washington county, PETER HERBST of Lancaster county, FREDERICK KELLER of Juniata county, THOMAS CARTER of Vanango county, soldiers, and MARGARET HECKMAN of Northampton county, MAGDALENA PEIFFER of Crawford county, ELIZABETH DERR of Lancaster county, MARY SHIRES of Lycoming county, ANN MARIA HERRING of Venango county, ANN MARIA WENNER of Luzerne county, widows of soldiers of the revolutionary war, forty dollars to each immediately, and an annuity of forty dollars to each during life, payable half yearly, to commence on 1 Jan 1837. And also a gratuity of forty dollars to be paid to the legal representative of MARY YENTZER, dec. the widow of JOHN YENTZER of Lancaster county, a soldier of the revolutionary war. 3 Mar 1837. 29. An act to authorized THOMAS PASCHALL, guardian of JOSEPH PASCHALL, to sell and convey certain real estate. That Thomas Paschall, gurardian of Joseph Paschall, is hereby authorized to sell and convey unto the purchaser all of a certain tract of land devised by DOCTOR HENRY PASCHALL, dec. to his son, the said Joseph Paschall, situate in the township of Kingsessing, in the county of Philadelphia which lies between LEVIS PASSMORE's mill race and Cobb's creek. 7 Mar 1837. 30. An act to amend the charter of the corporation for the relief of the widows and children of clergymen, in the communion of the Protestant Episcopal church in the Commonwealth of Pa. That HORACE BINNEY, JAMES S. SMITH, and JOSEPH R. INGERSOLL, who are trustees of a donation of $1000.00 by MARGARET YEATES of the city of Lancaster, and James S. Smith and Joseph R. Ingersoll, who are trustees of a donation of $1000.00 by CATHARINE YEATES of the city of Lancaster are hereby authorized to transfer them to the corporation for the above purposes. 7 Mar 1837. 31. An act to authorize the Canal Commissioners to inquire into the claims for damages of HENRY EBY. That the Canal Commissioners are hereby authorized to inquire into and ascertain whether the loss sustained by Henry Eby, in the burning of his property near the Columbia and Philadelphia railroad, in Oct. 1836, was caused by fire from any locomotive engine and if thus found the actual costs ascertained and paid. If any part of the property was suffered by negligence to be burned, no damages will be allowed. 7 Mar 1837. 32. An act for the relief of the heirs of JOHN M'DANIEL dec. That the State Treasurer is hereby authorized to pay to the heirs of John M'Daniel, late of Warren county, in the state of Ohio, dec. $200.00 in full for a tract of donation land, situate in the 10th district of donation lands, #2142, containing 200 acres, which was granted PATRICK MURRAY, in the consideration of the services rendered by him in the army of the United States, and whose right and interest became legally vested in John M'Daniel, dec. and which tract of land fell within the state of New York, upon the line being run between that state and the state of Pa., provided that the heirs of John M'Daniel dec. shall first deposit in the Land Office their title papers, and a release thereof. 7 Mar 1837. 33. An act for the relief of the heirs of ALEXANDER WHITE. That the State Treasurer is hereby authorized to pay to the heirs of Alexander White, late of the county of Cumberland, a soldier of the revolutionary war, $200.00 in lieu of a tract of donation land, due to him for his revolutionary services, upon due proof being made, of their being the legitimate and legal heirs. 7 Mar 1837. 34. An act to authorize the Trustees of the University of Pa. to sell and convey certain real estate, and for other purposes. By deed dated 1 Feb 1749, a lot on the west side of Delaware Fourth Street, between High and Mulberry streets, in the city of Philadelphia, was conveyed by EDMUND WOOLLEY and others, to WILLIAM LAWRENCE and others, for uses and trusts. The trustees of the University of Pa. are hereby authorized to apply the fund to the general purposes for which they are incorporated. That WILLIAM GRAY M.D., of the borough of Chester, Delaware county, guardian of WILLIAM G. PALMER, and MOSES G. PALMER, minor children of MARTHA G. PALMER, (late MARTHA GRAY,) dec., and LEWIS CLARK of Passyunk twp., guardian of REBECCA M. CLARK, ANNE G. CLARK, ELIZABETH L. CLARK, SARAH L.M. CLARK, GEORGE M. CLARK and HARRIET M. CLARK, minor children of SARAH L. CLARK, (late SARAH L. MORTON,) dec. and ROBERT TAYLOR of the city of Philadelphia, guardian of JAMES TAYLOR, GEORGE L. TAYLOR, WILLIAM J.L. TAYLOR, JOHN TAYLOR, HENRY J. TAYLOR, and SAMUEL L. TAYLOR, minor children of ELIZABETH C. TAYLOR, (late ELIZABETH C. LEIPER,) dec, are hereby authorized to sell, to the Philadelphia, Wilmington and Baltimore Railroad company, all the shares and estates, of the minor children, by them the guardians to the Gray's Ferry, across the river Schulylkill, in Philadephia county, and a part of the lands and tenements, in the townships of Passyunk and Kingsessing, being part of the estate formerly belonging to GEORGE GREY, dec. and now held by the minor children in common, with others, and to make and execute deeds to the purchasers. 7 Mar 1837. 35. An act to authorize JOHN B. M'PHERSON and MOSES M'CLEAN to convey certain real estate and other property, and for other purposes. That John B. M'Pherson and Moses M'Clean of the borough of Gettysburg, Adams county, trustees of ADAM LIVINGSTON, are hereby authorized to re-convey to the said Adam all right and title conveyed to them by Adam of a tract of land, situate in Cumberland Twp., Adams county, containing 13 acres, together with other property conveyed to them under the trust. The Surveyor General, is hereby authorized to accept the survey on the following warrants, dated 21 Apr 1794, in the names of WILLIAM DORMAR and JAMES HENRY, and the Land office is hereby authorized to issue patents for the lands on payment of the necessary fees, provided the Land office inserts that the patents are issued in virtue of this act. 9 Mar 1837. 38. An act to provide for the erection of a house for the employment and support fo the poor in the county of Northampton, and for other purposes. That BARNABAS DAVIS, GEORGE BARNET (Miller), JACOB VOGEL, JACOB WAGENER of Saucon, JACOB HOWER, JACOB YOUNG, JOHN D. BAUMAN, DAVID KAMERER, and CONRAD SHEINER, are hereby appointed commissioners, to purchase accommodation for the poor. That it shall be lawful for the managers to put out and bind as apprentices to learn some art, trade, or mystery, any poor child or children who shall become chargeable to the township. The term of service of a female shall not extend beyond the age of eighteen years, nor the term of service of a male beyond that of twenty-one years. 11 Mar 1837. 41. An act to empower the Orphans' court for the city and county of Philadelphia to make partition of certain real estate among the devisees of FRANCIS GURNEY, and for the sale of certain other real estate, and for other purposes. Whereas, the widow and devisees of Francis Gurney, late of the city of Philadelphia, dec. died seized of real estate situate in the township of Moyamensing, Philadelphia county, which was devised to his widow for life, and after her decease to be equally divided among his children and their heirs, and the said estate is now unproductive, not yielding a rent sufficient to pay the taxes, that considerable expense has already been incurred for curbing and paving, and a large sum will yet be required to pay for curbing and paving, which soon will have to be done, the widow and devisees seek the authority to partition the property. Therefore the Orphans Court of Philadelphia is hereby authorized to make partition of the real estate among his devisees in the same manner as if his widow, MARY GURNEY, were now deceased. That CHARLES A. POULSON is hereby authorized to sell, from time to time, such parts of the the real estate as may be allotted to Charles A. Poulson for life, and to his son Charles A. Poulson, the younger, after the death of his father, or to grant and convey the estate on ground rent, reserving the rent to Charles A. Poulson for life, and after his death to his son. Provided the principal, except what will be necessary to pay for curbing, paving and other necessary expenses, shall be invested and secured to Charles A. Poulson the younger. That HOSEA J. LEVIS, trustee of SOPHIA H.E. ASH, under a deed of trust, duly appointed by the county of Philadelphia, is hereby authorized to sell a certain three story brick house and lot of ground, situate on the east side of Delaware Fourth St., which EDMUND SHOTWELL and wife, by indenture conveyed to Hosea J. Levis, in trust for Sophia H.E. Ash, and convey to a purchaser. That WILLIAM VONDERAU and JOHN RADEBAUGH, guardians and trustees of JACOB VONDERAU of Franklin county, are hereby authorized to invest in real estate moneys arising from the sale of the plantation of Jacob Vonderau, as shall be deemed expedient for the interest of Jacob Vonderau and his family. HENRY LEECH, trustee of CHARLES SUPPLEE and ELIZABETH SUPPLEE, is hereby authorized to sell a lot of land in Roxborough Twp., Philadelphia county, containing 4 acres, 2 quarters, and 15 perches, described in an indenture from JAMES KERSHAW to ISRAEL SUPPLEE, dated 17 Apr 1824, and to make good and sufficient deed, provided the proceeds of the sale shall be invested in other real estate, and the investment held by the trustee, and that the consent of Charles Supplee and Elizabeth Supplee, cestue que trusts, be given to such sale, in writing, to be acknowledged as deeds of feme converts. ROSANNA MARLEY and MARY ANN MILLMAN, late MARY ANN MARLEY, being the surviving daughters and executrixes of the will of RICHARD J. MARLEY, dec. are hereby authorized to sell a piece of ground, situate on the west side of Broad St. in the city of Philadelphia, (being part of a lot, which JOHN H. BRINTON, dated 31 Aug 1803, recorded in Deed Book E.F. #31, page 340, granted to Richard J. Marley in fee, reserving a yearly rent charge of $73.33.) and to make and execute to the purchaser a good and sufficient deed. Whereas, HUGH BROTHERTON and JACOB GROVE, guardians and trustees of SAMUEL THOMPSON of St. Thomas Twp., Franklin county, were authorized by an act dated 13 Mar 1823 and afterwards by another act, dated 8 Apr 1833, Jacob Grove as surviving guardian was authorized to sell real estate. And as Brotherton and Grove are now both dead, and no disposition of said real estate was made. Therefore, JOHN RADEBAUGH and JOHN THOMPSON, guardians and trustees of Samuel Thompson are hereby authorized to sell and convey all real estate of Samuel Thompson, wheresoever situated, as may appear just and reasonable, and invest as much of the proceeds in other real estate, for the use of Samuel Thompson and his family. HENRY ATTICK is hereby authorized to sell and convey a certain lot situate in the town of New Cumberland, Cumberland county, designated in the town plan as #68, late the property of GEORGE ATTICK, dec. Whereas, JAMES IRVINE, late of the city of Philadelphia, dec. by his last will and testament, proved 1 and 3 May 1819, devised certain real estate and personal estate to trustees named, for the use and benefit of FRANCES IRVINE BROWNE and her heirs and whereas, the trustees were, on 3 Jan 1829, dismissed, and HOPEWELL HEPBURN of the borough of Easton appointed sole trustee in their stead. Therefore, all estate devised to trustees for the use of Frances Irvine Browne, and all other estates belonging to said trust are hereby invested in Hopewell Hepburn, subject ot trusts, powers and duties mentioned in the last will and testament of James Irvine, dec. and Hepburn is hereby authorized to sell and convey real estate, and to invest trust moneys, etc. It shall be lawful for JOSEPH M. TRUMAN, trustee of CATHARINE TRUMAN, GEORGE TRUMAN, and the children of GEORGE TRUMAN, under the will of JAMES TRUMAN, late of the city Philadelphia, dated 1820, of a lot #102, North Seventh St. to execute a good mortgage on premises, for a sufficient amount of money to build a substantial three story brick house thereon, for the use and benefit of parties under the will, and trustee may convey premises reserving a rent change or rent, redeemable after the decease of both George and Catharine Truman, by paying purchase to their children. If the heirs of JOHN KNEPPER and ROBERT STEBLETON, and the heirs of CATHARINE FREES, shall require it, the title shall be examined of the tract situate in Huntingdon Twp. Luzerne county, surveyed on a warrant dated 7 Jun 1793, in the name of WILLIAM LEWIS, containing 440 acres, 20 perches and if they find the land has been certified to Connecticut settlers, and the said heirs were fully and fairly entitled to the tract of land, except as against the holders of the certificate granted to Connecticut settlers, then they shall issue a certificate to the heirs for the amount of purchase, interest etc. and the State Treasurer is directed to pay the amount and the heirs shall release unto the commonwealth all right, title etc. they have in the land. Whereas, GEORGE FOCHT, late of Berks county, dec. devised to the executors named in his last will, certain real estate, in trust for the use of his son JACOB FOCHT. And whereas, Jacob Focht, is since deceased, and no power given in his will to sell the real estate in trust for the use of Jacob. Therefore, JOHN FOCHT of Berks county, is hereby authorized to sell the following real estate, a lot of ground in Earl Twp., Berks county, containing 10 acres and a lot in Hereford Twp., Berks county, containing 3 acres and 146 perches. The Surveyor General is hereby authorized to accept surveys of land lying in Cambria county, made on the following warrants, dated 7 Mar 1794, for which the purchase money was paid to the commonwealth by JOHN BROWN, late of Allegheny county, dec., in the names of RICHARD ROOP, ROBERT ROOP, THOMAS ROOP, ISAAC ROOP, JOHN ROOP, SIMEON ROOP, JACOB ROOP, WILLIAM ROOP, JOSEPH ROOP, WILLIAM BURN, JACOB BURN, ROBERT BURN, JOHN BURN, JAMES BURN, ADAM BURN, JAMES M'GUIRE, JOHN IRVIN and PHILIP WEST. The Secretary of the Land office shall insert in the patents, that the same are issued in virtue of this act. Whereas, a number of actual settlers have purchased from HENRY BALDWIN, and STEPHEN BARLOW, warrants for certains tracts of land, of 400 acres each, lying northwest of the rivers Ohio and Allegheny, and Connewango creek, which warrants originally belonged to the North American Land Co., and by divers mesne conveyances became the property of Henry Baldwin and Stephen Barlow. Whereas, the commonwealth has been fully paid, both, original purchase price and under a lien of the state against JOHN NICHOLSON, one of the shareholders of the company, and conveyed to Henry Baldwin and Stephen Barlow, and warrants located and surveys made, but the surveys not accepted for want of conformity between warrant and survey. An act to confirm the partition of the real estate of DANIEL SHEETZ, dec. That the decree of the Orphans court of Philadelphia, made 21 Apr 1820, confirming the partition of the estate of Daniel Sheetz are declared to be valid, as if Daniel Sheetz had been intestate. That all person holding shares of the estate were allotted partition whether as purchasers or otherwise, are hereby confirmed in their titles and the same are declared to be good. 48. An act authorizing WILLIAM ADAMS and MICHAEL HAAK of the county of Berks, committee of JOHN HAAK of said county, a lunatic, and ELIZABETH HAAK, wife of John Haak, to sell and convey certain real estate, in a tract of land situate in the county of Mercer, (late Westmoreland,) in the third district of donation lands, containing 250 acres, granted by the commonwealth by patent dated 12 Mar 1787, to SAMUEL WOODS, and also a tract of land situate in the county of Crawford, (late Westmoreland,) in the sixth district of donation lands, containing 200 acres #1286, and granted by patent dated 8 Oct 1786 to PHILIP KLILNGER and to make and execute all deeds necessary for completing sales and will be acknowledged in the same manner as if Elizabeth Haak were sole owner and unmarried, and it shall be lawful for any guardian for WILLIAM HAAK, a minor son of John and Elizabeth Haak, to sell and convey the estate of the minor in the tracts of land mentioned. Whereas, THOMAS WILLING, late of the city of Philadelphia, did by indenture, grant to THOMAS W. WILLING nine annuities or rent charges, from lots in the city of Philadelphia, in trust for MARY WILLING, now MARY CLYMER, during her natural life, and after her decease to such child or children of Mary as may be living as they arrive at age 21, if no children then in trust for others. Whereas, Thomas M. Willing died after the execution and delivery of the deed in trust, and THOMAS W. CLYMER was duly appointed trustee in the room of CHARLES WILLING, upon whom the trust devolved as the heir of Thomas Willing, As it is deemed in the best interest of all, that annuities should be sold, and the proceeds invested. MITCHELL GILMORE of Allen Twp., Cumberland county, is hereby authorized to sell a lot of ground situate in Allen Twp. which JAMES GILMORE granted and conveyed by deed dated 14 Feb 1831, for Mitchell Gilmore in trust for the education and support of JOHN GILMORE, SAMUEL J. GILMORE, JAMES WILLIAM GILMORE, NANCY GILMORE, ELIZA GILMORE, and SARAH GILMORE, children of Mitchell Gilmore, and to make a good conveyance for the same to the purchaser, provided Mitchell Gilmore shall apply the proceeds of the sale to the support and education of the minor children. Whereas, MICHAEL MEISNER and THEODOSIA MEISNER, his wife, by deed dated 6 Jun 1822, did convey unto WILLIAM STROUD, together with other estates, a tract of 38 acres, situated in Hamilton Twp., Northampton county, (now Monroe) in trust for the benefit of his creditors, which said tract was not disposed of by the trustee, the residue of the property proving sufficient to pay and discharge all the debts, and whereas the deed contained no provision authorizing the trustee upon payment of the debts to recover the property undisposed of and the trustee is now deceased. STROUD, acting administrator of William Stroud, deceased, is hereby authorized to make, execute and deliver a deed conveying unto Michael Meisner and his heirs, the said tract of 38 acres of land, to have and to hold the same as he held and enjoyed immediately preceeding the date of the deed of assignment. Whereas, REBECCA HARLAN, the present wife of LEWIS HARLAN, in consequence of the want of mental capacity, is disqualified from joining with her husband in the sale and conveyance of real estate, Therefore, it shall be the duty of the court of Cumberland county, to appoint a trustee to act for Rebecca Harlan, the wife of Lewis Harlan, and whenever Lewis Harlan shall contract for the sale of real estate, it shall be the duty of the trustee, to examine and no design to prejudice the interests of Rebecca Harlan, and signify his assent in writing upon any deed, which shall be vested in the purchaser as fully as if Rebecca Harlan were competent. COLEMAN, late of Cornwall Furnace, Lebanon county, dec. and JOHN REYNOLDS, the guardian over the persons and estates of ANN C. COLEMAN, MARGARET C. COLEMAN, SARAH H. COLEMAN, ISABELLA COLEMAN, ROBERT W COLEMAN and WILLIAM COLEMAN, his minor children and heirs, are hereby authorized to sell such parts of the real estate as they may deem proper, excepting only the whole of his Cornwall, Speedwell, and Colebrook estates, unless it part of the Colebrook estate as may without injury to the establishment be separated from it, and convey to the purchaser a good conveyances for such estate. It shall be lawful for John Reynolds, the guardian of the minor children of Thomas B. PETER DREHER of Schuylkill county is hereby appointed guardian of ELIZABETH DREHER, and is hereby authorized to make sale and convey all the rights and title of Elizabeth Dreher, in a certain tract of land in Lower Mahantongo Twp. in Schuylkill count, and in Lykens Twp., in Dauphin county, and the proceeds of the sale shall be invested for the benefit of Elizabeth Dreher as directed in the act brought upon the official bond of WILLIAM B. MITCHELL, late superintendent, passed 16 Jun 1836. Whereas, DANIEL MARKLEY, HENRY MARKLEY, and DAVID MARKLEY, have been appointed trustees of JOHN E. PFAUTZ and ANNA PFAUTZ, his wife, and have invested their legacy in a tract of land containing 15 acres and 117 perches, adjoining the Cocalico creek. Whereas, the parties interested believe an advantageous exchange of property can be made. Therefore, the trustees are hereby authorized to sell a tract of land situated in Cocalico Twp., Lancaster county, containing 15 acres, 117 perches, which they purchased for $1071.75 and now hold by deed from JUSTICE GRAY and BARBARA GRAY his wife, dated 27 Jan 1835, and to make and execute a deed of conveyance to purchaser and to invest proceeds in other real estate. Whereas, the administrators of the estate of HENRY B. GRUBB of Mounthope, Lancaster county, dec. found it necessary to purchase a tract of land to get timber for the use of his furnace, for the benefit of the heirs generally. Whereas, the land deprived of timber could not be of much use to there, therefore the administrators sold it. That HARRIET A. GRUBB, of Mounthope, Lancaster county, guardian of MARY S. Grubb, dec. is hereby authorized to sell and convey all individual shares, and interests of the minors in a tract of land sold by the administrators to CHRISTIAN STAUFFER, situate in Raphoe Twp., Lancaster county, containing 203 acres, adjoining land of ABRAHAM HERSHEY, GEORGE LONG etc. and release title to Christian Stauffer as if minors were of full age. Whereas, the trustees of HARVEY ELLIOTT, under the last will and testament of JOHN ELLIOTT, dec. did purchase real estate in the district of Southwark, Philadelphia county, for the use of Harvey Elliott and he has ceased to occupy the same, it would be advantageous to sell the real estate and vest the proceeds in good securities. CHRISTIAN MILLER, surviving executor of the last will and testament of PHILIP HOFFMAN, dec. is hereby authorized to sell and convey a tract of land, situate in Shade Twp., Somerset county, late the residence of the deceased, and to make and execute a deed conveying to the purchaser the right and title of the widow and heirs in the tract of land. WILLIAM COULSON and JOHN BENHAM of Warren county, Ohio, administrators of the estate of DANIEL M'FARLAND JR. dec. and trustees for the heirs of a tract of land situate on the waters of Wheeling creek, in Greene county, Pa. bounded by land of JAMES DUNKIN, containing 400 acres, are hereby authorized to execute and deliver a deed to JOHN SUPLER and CHARLES ALLUM. An act to confirm and render valid the proceedings of the District court for the city and county of Philadelphia, and for other purposes. Whereas, THOMAS WILLING, late of the city of Philadelphia, by indenture, on the 10 Jun 1796, recorded in deed book E.F., page 244, did grant and convey to GEORGE WILLING, twelve ground rents in the city, in trust for ABIGAIL WILLING, now ABIGAIL WILLING PETERS, wife of RICHARD PETERS, during her natural life, and after her decease, to her children, or if no issue to others as stated in the deed, and whereas, George Willing died, then CLEMENT C. CRAIG has been constituted the committee of the person and estate of the lunatic, and he and the children, all being above the age of 21, wish the sale and investment of the proceeds of the estate, being in the interest of all concerned. An act authorizing JAMES WORTH, a surviving executor of the last will and testament of ISAAC KNIGHT, and trustee to cut and sell certain wood upon the estate, and to authorize the sale of the estate of JOHN BROWN, dec. That it shall be lawful for James Worth, sole surviving executor of the last will and testament of Isaac Knight, late of Abington Twp. Montgomery county, dec. and devise in trust a plantation of 200 acres for MARY ELIZABETH WORTH and her children, to cut down and sell so much of the standing wood and timber as may be cut without injury to the land, and the moneys invested in securities and the income and interest paid to Mary Elizabeth Worth for her sole and separate use and upon her decease paid to the person to whom the estate shall go to, according to the provisions of the will. An act to incorporate the Litiz Academy, in the village of Litiz, Lancaster county, and the Pottsville Institute, Schuylkill, and relative to the Washington and Dickinson Colleges. That the academy for the education of boys, in the village of Litiz, Lancaster county, under the direction of JOHN BECK, as principal, is hereby erected into one body corporate. An act to authorize JOHN L. RADCLIFF, executor of the last will and testament of RICHARD DALE, dec. to sell and convey certain real estate, and for other purposes. Whereas, Richard Dale, did on 21 Feb 1833, convey to ANTHONY TRIPPLE, of the city of Philadelphia, a brick tenement and lot situated on the west side of Garden St., in Penn Twp. Philadelphia county, and as Anthony Tripple not being able to pay the purchase money for the lot, has conveyed the same to John L. Radcliff, the acting executor of the last will and testament of Richard Dale, dec., therefore John L. Radcliff is hereby authorized to sell the lot and execute a deed of conveyance for the same to the purchaser. Whereas, SAMUEL SMITH, of Ohio Twp., Beaver county, was intermarried with NARCISSA BEVER, to whom JOHN BEVER, dec. and LYDIA BEVER is wife, on his lifetime, by indenture, bearing the date 15 Jun 1831, did grant and sell unto Narcissa, wife of Samuel Smith, 75 acres of land, called Belgrove, situated on the waters of Racoon creek, formerly in Washington county, now Beaver county, said tract was granted to John Bever, by patent, bearing date 12 Feb 1791, the residue of the tract having been sold and conveyed to THOMAS ADAMS and LAVINA BEVER, (sister of Narcissa,) who held as tenants in common with Narcissa, and afterwards on 3 Sep 1832, Samuel Smith, in right of his wife, and the said Lavina, in her own right, by articles of agreement between them and Thomas Adams, did agree with Thomas Adams to convey and sell to him all the rights and title of Narcissa and Lavina in the land, and since the agreement, Narcissa has deceased, leaving three children, in their minority, all under the age of fourteen, JOHN B. SMITH, SUSAN SMITH, and MATILDA JANE SMITH, for whom HAMILTON SMITH has been appointed guardian. That the greatest portion of purchase money has been paid by Thomas Adams to Samuel Smith, but as the death of Narcissa has rendered him unable to execute a deed to Thomas Adams, in fulfilment of the contract, he cannot collect the balance of the money yet due. Therefore, Hamilton Smith, guardian of the minor children, is hereby authorized to carry the agreement into effect, and to make and execute a deed of conveyance upon the payment of the payment of the balance of the purchase money. Whereas, ABRAHAM DAWSON, dec., by his last will and testament, bequeathed to the inhabitants of West Caln twp., Chester county, a tract of land, containing 32 and 1/2 acres, for the use of the poor, on condition of their paying to his executors the price of patenting the same, and whereas, this condition has been complied with, and a county poor house established. Whereas, an act passed 7 Apr 1807, authorizing JAMES M'CLELLAN ESQ., and HUGH THOMPSON, ESQ., to sell and dispose of the tract of land and to pay over the money to the supervisors of the highways, and invested and interest to be applied to the repair of the roads and highways. The citizens desire the money to be applied to the common school. Therefore, the supervisors are authorized to pay over to the directors of the common schools all money to be applied to the building or repair of school houses. That the Auditor General is hereby authorized to settle and adjust the amount of costs and charges which may come due in the case of the alleged escheat of the estate of ROBERT MANNERS, dec. and to draw on the State Treasurer for the amount due among the persons entitled to the same. That HENRY FAGELY, of Berks county, guardian of WILLIAM LAUER and HARRY LAUER, minor heirs of JACOB LAUER, dec. is hereby authorized to sell and convey a tract of land in Longswamp Twp., Berks county, containing 3 acres, and the proceeds invested for the minors, and the title conveyed to the purchaser. Whereas, CHRISIAN MICKSH, of Upper Nazareth Twp., Northampton county, owned a tract of 400 acres situated on the waters of Black creek, in the county of Luzerne and also the equal undivided half part of another tract of 408 acres, situated on the head waters of the Nescopeck creek, in the county of Luzerne, and leaving issue three children: JACOB MICKSH, JOSEPH MICKSH and ROSANNA MICKSH, since intermarried with HENRY C. BEITEL, one of whom, Joseph is deceased, leaving a widow and two children, who are in their minority and have for their guardian JOHN BEITEL. Therefore, Jacob Micksh and Henry C. Beitel, the surviving administrators are hereby authorized to sell and make and execute a deed of conveyance to the purchaser. That the Orphans court of Mifflin county, are hereby empowered to authorize JOHN PEACHY, guardian of JOHN PLANK, SUSANNA PLANK, MICHAEL L.
