The Canal Commissioners shall proceed to examine and adjust the claims of Hugh Keys, on principles of justice and equity, only having regard to the provisions of the contract, so far as the same may assist them in a just and proper settlement. 20 Dec 1837. 5. An act for the relief of JAMES THOMAS and others, soldiers of the Revolutionary and Indian wars. That the State Treasurer is hereby authorized to pay to James Thomas of Chester county, JACOB CONRAD of Bucks county, WILLIAM MOORE of Lancaster county, JOSEPH MOOREHEAD, JOHN LEASURE, THOMAS NEEL, JOHN BRADY, SAMUEL HENDERSON, and JOHN EWING of Indiana county, KILLIAN BRINEY, GEORGE M'WILLIAMS and JACOB FREEMAN of Westmoreland county, JOHN KIRKER of Jefferson county, and JOHN M'CULLOUGH of Butler county, soldiers of the Revolutionary and Indian wars, forty dollars to each immediately, and an annuity of forty dollars to each during life, payable half yearly, to commence on 1 Jan 1838. 18 Jan 1838. 9. An act authorizing the sale of certain real estate late of ANDREW BAYARD, dec. That JAMES BAYARD and CHARLES P. BAYARD, executors of the last will and testament of Andrew Bayard, late of the city of Philadelphia, dec. are hereby authorized to sell and convey all the estate of Andrew Bayard, in in-lots and out-lots in and near the town of Erie, the property of the Harrisburg and Presque Isle Co. as Andrew Bayard was a member of the company. 30 Jan 1838. 10. An act to authorize the sale of certain real estate of BENJAMIN JOHNSON and CHARLES AUGUSTUS KESSLER, dec. Whereas, the heirs of Benjamin Johnson, dec. late of the township of Lower Dublin, Philadelphia county, who are of full age, and the guardians of the minors, and the heirs of MARTHA RAMBO of the same place, have agreed to compromise an action of ejectment, pending in the Supreme Court for the Eastern District of Pa., wherein the heirs of Martha Rambo are plaintiffs and seek to recover a tract of land and buildings situate on the eastern side of the Bristol Turnpike road, containing 36 acres and 133 perches, by exposing the same to sale, and dividing the proceeds. And as the tract has been sold, but some of the heirs of Benjamin Johnson being minors, cannot execute a good conveyance. That the guardian of the minors, are hereby authorized to make and execute, joining with the other heirs of Benjamin Johnson, in making a good conveyance of all rights and title of the minor children and the deed shall be as if the minors were of full age. CATHARINE KESSLER, guardian of HENRY KESSLER, CATHARINE KESSLER JR., and FREDERICKA KESSLER, minor children of Charles Augustus Kessler, late of the borough of Reading, Berks county, dec. and she is hereby authorized to sell and convey all the rights and title of the minors in a tract known by the name of the Mineral Spring, situate in Alsace Twp. Berks county, containing 10 acres. 30 Jan 1838. 11. A supplement to an act authorizing the supervisors of East Huntingdon twp., Westmoreland county, to assess and collect certain taxes, passed 2 Apr 1830. The supervisors are hereby authorized to levy and assess an amount of tax on the twp. sufficient to pay the award and costs in a case in the Common Pleas #53, Nov. term, 1830, PETER POOL vs. JOHN VANCE and DAVID KELGORE, supervisors. 5 Feb 1838. 13. An act remunerating LEWIS WILLIAMS and others, for expenses incurred in pursuing and arresting certain fugitives from justice. That the State Treasurer is hereby directed to pay Lewis Williams, of the borough of Harrisburg, the sum of $80.00, and to WILLIAM MARKWARD and NATHANIEL HENRIE of the same place, the sum of $50.00 each, in full for the expenses incurred by them respectively, in arresting and bring to trail certain fugitives from justice. The State Treasurer is hereby directed to pay to G.W. RUSS, of Huntingdon county, the expenses actually incurred by him, in arresting or assisting to arrest JOHN LUPTON and GEORGE MORTON, certain fugitives from justice, upon the presentation of his account. 14 Feb 1838. 15. An act authorizing the Directors of the Poor and the House of Employment of the county of York and concerning the estate of JOHN MULLOWNY. That the directors of the poor are hereby authorized to sell and convey a certain tract of land, situate in York twp., York county, bounded by lands of JONATHAN JESSUP, F. EICHELBERGER, PETER PETERS, SAMUEL FRY, and others containing nine acres and 60 perches, being the same tract which BARBARA MORRIS, CHARLES A. MORRIS, CASSANDRA MORRIS, GEORGE S. MORRIS, JOHN G. MORRIS, and ELIZA H. MORRIS, by their indenture dated 19 Mar 1836, conveyed to the directors of the poor, and after the sale the directors are to use the proceeds in payment of any debts due. That DAVID M. FORT and GLORVINA FORT his wife, late GLORVINA MULLOWNY, administratrix of the estate of John Mullowny, late of the county of Montgomery, dec. is hereby authorized to sell, upon notice in one newspaper in Philadelphia, and one in Montgomery county, all four lots in the city of Philadelphia, north side of Locust St., commonly called Mullowny Court, and to convey good deeds to the purchaser. 14 Feb 1838. 17. An act to incorporate a company to erect a bridge over the Lackawaxen river, near its mouth, in the county of Pike, and for other purposes. That BENJAMIN HALBERT, JACOB BONNELL, ABRAHAM SHIMER, CHARLES B. RIDGWAY, MOSES BRINK, SAMUEL DARLING, JONATHAN ROSENCRANS, WILLIAM R. HALBERT, JOSEPH ATKINSON, OTTO KIMBLE, and RODOLPHUS BINGHAM, are hereby appointed commissioners for erectiong a bridge. That an act to incorporate a company to make a turnpike road from Bethany, to intersect the Clarksville and Honesdale Turnpike road, near BENJAMIN JENKINS, in Canaan twp., approved 1 Feb 1834, is hereby revived. 20 Feb 1838. 18. An act for the relief of SAMUEL BITTLE, and others, soldiers and widows of soldiers of the Revolutionary and Indian wars. That the State Treasurer is hereby authorized to pay to Samuel Bittle of Montgomery county, JOHN LINDSAY of Delaware county, soldiers of the revolutionary war, JAMES EWING of Indiana county, a soldier of the Indian war, and to MARIA MELL of Berks county, the widow of a soldier of the revolutionary war, forty dollars each immediately, as a gratuity, and an annuity of forty dollars each during life, payable half yearly, to commence on 1 Jan 1838. That the State Treasurer is required to pay to JACOB ULRICH of Berks county, in trust for the use of the benefit of JOHN KELLER of Berks county, a soldier of the revolutionary war, forty dollars immediately as a gratuity, and an annuity of forty dollars annually, during life of John Keller, payable half yearly to commence on 1 Jan 1838, and should Jacob Ulrich decline to accept the trust or die before John Keller, then the court of Berks county is authorized to appoint some other person to receive the pension, and apply the same to the maintenance and support of John Keller. That the State Treasurer is hereby authorized to pay to JAMES CRAWFORD of Mercer county, JOSEPH M'KINZEY of Beaver county, MARY SAVELL and ELIZABETH BARNARD of Philadelphia county, SARAH GETTEMY and ELEANOR HAGERMAN of Westmoreland county, WILLIAM MARSHALL of Washington county, JAMES HAWK of Fayette county, JANE LITTLE and GEORGE RIHN of Allegheny county, and JOHN GLANTZ of Centre county, soldiers and widows of soldiers of the revolutionary and Indian wars, forty dollars each immediately, as a gratuity, and an annuity of forty dollars each during life, to be paid half yearly, to commence on 1 Jan 1838. The State Treasurer is hereby authorized to pay to JONATHAN AYRES of the borough of Indiana, in trust for the use and benefit of JOHN M'GARA of Indiana county, a soldier of the Indian war, forty dollars immediately as a gratuity, and forty dollars annually, during the life of John M'Gara, payable half yearly to commence on 1 Jan 1838, and should Johathan Ayres decline to accept the trust, or die before John M'Gara, then the court of Indiana county is authorized to appoint some other person to receive the pension and apply the same to the maintenance and support of John M'Gara. The State Treasurer is hereby authorized to pay to JACOB UNANGST of Northampton county, a soldier of the revolutionary war, forty dollars immediately, as a gratuity, in full for his military services. That so much of the act passed 9 Feb 1837 as relates to the granting of a gratuity of forty dollars to JOHN UNANGST of Northampton county, is hereby repealed. The State Treasurer is hereby authorized to pay to HENRY STETZER of Mifflin county, a soldier of the revolutionary war, eighty dollars immediately, and an annuity of forty dollars, payable half yearly during life, to commence on 1 Jan 1838, and as much of Act dated 4 Apr 1837, as authorizes the payment of any money to GEORGE STETZER, shall be repealed. An act to incorporate a company to erect a bridge over the Conemaugh river, near Centreville, in the county of Indiana, and for other purposes. HAMBLY, are hereby empowered to elect a president and five directors.. 27 Feb 1838. 23. An act to incorporate the Stafford Coal company. That GEORGE BRINTON, WALTER C. LIVINGSTON, CHARLES S. COXE, EDWARD D. INGRAHAM, WILLIAM SHIPPEN, EDMUND S. COXE, RICHARD L. HOWELL, are hereby constituted a body politic and corporate, by the name of "The Stafford Coal company," within the counties of Luzerne and Northampton, and to construct a railroad. We do certify, that the above bill was presented to the Governor on 19 Feb 1838, and was not returned within 10 days, wherefore, it has become a law, in the like manner as if he had signed it. FR. R. That the full and entire assent is hereby given to all the provisions contained in an act of the legislature of New Jersey, passed 10 Feb 1838, and the act is hereby adopted and enacted into a law of this commonwealth as fully as if the same were enacted by this state. The commissioners shall transmit copies of the partition of the real estate of Anthony Taylor to the clerk of the Orphans courts of the county of Philadelphia and Bucks county. 26. An act to incorporate a company to erect a Bridge over the Juniata river, at M'veytown, Mifflin county, and for other purposes. An act concerning contracts. That all leases, sales, and contracts, made by the committees of the proprietors of the twps. of Newport and Pittston, Luzerne county, or by JONATHAN SMITH and JONATHAN KELLOGG, original agents of Newport twp., are hereby confirmed. That until the election of officers HENRY STYER, ADAM BELLAS and PETER FITZGERALD, present committee of the township of Newport, and PETER WINTER, NATHANIEL GIDDINGS and NATHANIEL TUTTLE, present committee of the township of Pittston, shall be vested with the corporate powers of the townships. 13 Mar 1838. 29. An act authorizing the laying out a state road, from a point near Mexico, Juniata county, through Tuscarora Valley, by way of East Waterford and the Burnt Cabins, to intersect the Southern Turnpike road, near Licking Creek Bridge, in Bedford county. That JAMES FORD and JAMES HUDSON of Huntingdon county, JESSE BEAL and STEWART TURBETT of Juniata county, and JOSEPH B. NOBLE, DAVID FORE and THOMAS SPEAR of Bedford county, are hereby appointed commissioners to lay out a road. That GEORGE W. KERNS, CHRISTIAN GOOD SEN., of Cambria county, and SAMUEL KIMMELL and ISAAC KAUFFMAN of Somerset county, are hereby appointed commissioners to lay out a state road from a point within nine miles of Ebensburg, on the Huntingdon, Cambria and Indiana Turnpike road, in Cambria county, through Johnstown and Davidsville to Stoystown in Somerset county. JAMES HULING and RICHARD IRWIN of Venango county, are hereby appointed commissioners to lay out a state road from a point on the Susquehanna and Waterford turnpike, near Brookville, in Jefferson county, to Tionista, on the Allegheny river, Venango county. 15 Mar 1838. 30. An act for the relief of GEORGE SERENA and others, soldiers and widows of soldiers of the Revolutionary and Indian wars. An act authorizing the Canal Commissioners to settle and adjust claims and for other purposes. That it shall be the duty of the Appraisers of Damages on the Pa. canal, to ascertain the amount of damage done to WILLIAM BARKER in the carrying away and destroying his salt on the Conemaugh river by the freshet in Feb 1832 and caused by the narrowing of the river in constructing the canal, then to report damages and pay amount of damages not to exceed the sum of $700.00. That it shall be the duty of the Canal commissioners to ascertain the amount of damages sustained by CATHARINE ROBINSON, in the burning of her barn, hay, and the grain therein, destroyed by fire communicated from the burning of logs and brush in clearing the ground on the line of canal near Meadville, in 1833, then report the sum and pay if caused by the construction of the Pa. canal, not to exceed the sum of $400.00. That it shall be the duty of the Appraisers of Canal Damages to ascertain if any what damages have been sustained by JOHN NEWBOLD, by the construction of the Pa. canal through his farm near Bristol, Bucks county, by the destruction of his crops by the water from the same, and the value of the ground taken by the commonwealth for a lock house and garden, which sum so reported, shall be paid. That the Appraisers of Damages are hereby directed to examine if any amount of damages have been sustained by JOHN WILSON and DAVID LYNCH, in the destruction of salt and other property by the breaking of dam #1, on the Western Division of the Pa. BIGHAM of Armstrong county, by reason of the location and construction of dam #1 on the Western Division of the Pa. canal, which shall be paid, provided claimant has not received any compensation aforesaid. The Appraisers of Damages are hereby authorized to examine if any what damages have been sustained by DANIEL KISTLER and SAMUEL KISTLER, salt manufacturers on the Kiskiminetas river, on the Western Division of the Pa. canal, in the destruction of salt and other property by the breaking of dam #1 on said canal on the morning of 9 Feb 1832, report the amount and pay the same. The Canal Commissioners are hereby authorized to examine and settle the claim of DAVID KELLY of Butler county, for alleged grievances in the estimate made on his contract for the erecting of the abutments of the bridge at New Castle, Mercer county. The said settlement to be as effectual in law as if David Kelly had appealed within the time mentioned and in all other respects have complied with the provisions of the act passed 6 Apr 1830. The Canal Commissioners are hereby authorized to examine into and settle the claim of DAVID EASTON, SIDNEY S. EASTON, and HENRY H. EASTON, of Cambria county, for alleged grivances in the estimate of the extra work done and materials furnished on and for sections from #31 to #35, of the Allegheny Portage Railroad and also for extra work done and materials furnished for engine house and road sheds at inclined plane #5 of said road, as effectual in law as if they had appealed within the time mentioned. It shall be the duty of the Appraisers of Damages on the Pa. canal, to ascertain the amount of damage done to and sustained by JOHN ROYER in the carrying away and destroying of the salt on the Conemaugh river by the freshet of the month of Feb 1832, and if was occasioned by the narrowing of the river in constructing the canal, then the amount of damages shall be paid. The Canal Commissioners are hereby authorized to examine and settle the claim of JOSEPH ADAMS of Huntingdon county, for retained per centage kept off him when settling for the building of lock #32 on the Frankstown line of the Juniata Canal. The board of Canal Commissioners are hereby authorized to investigate the claims of JOSEPHINE C.B. NOURSE of the county of Northumberland, for work done by JOSEPH NOURSE, her late husband, as a contractor on the North Branch Division of the Pa. Canal, and by her as his administratrix, in completion of the contracts, to remeasure the work done on the contracts, also for damages sustained in the construction through her land, and for property taken by the agents of the commonwealth for use of the canal and the said damages if any shall be paid. The Appraisers of Damages are hereby required to examine if any and what amount of damages have been sustained by BENJAMIN REYNOLDS of the county of Luzerne, by the overflow of his lands caused by the erection of the Nanticoke Dam, on the North Branch Division of the Susquehanna river, and report and pay the amount. It shall be the duty of the Appraisers of Damages to ascertain the amount of damages sustained by DAVID WHITE in the construction of the Beaver Division of the Pa. Canal, thereby depriving him of water privileges on the Neshanock creek, in Beaver county, and then to report and pay the amount. It shall be the duty of the Canal Commissioners to ascertain if any what amount of damage has been sustained by SARAH PERKINS, of Crawford county, caused by the construction of the French Creek Feeder, and report and pay the amount. Stine and Amanda Stine, now or late of the county of Dauphin, is hereby dissolved, and the above restored to the rights, liberties and privileges they individually possessed as if no such marriage contract had ever been formed. Whereas, an action of ejectment, instituted as of July Term, 1835, in the court of Common Pleas of Schuylkill county, by ANTHONY F. MILLER, plaintiff, against SAMUEL BROOKE, JOHN SCHALL, JOHN DREHER, JAMES CRESSON, JOHN H. CRESSON and others, defendants, was removed to the county of Lehigh, and that a great excitement prevails in the county Lehigh in relation to the cause, and that a fair and impartial trial cannot be had in that county.
