DINGMAN are hereby constituted a body corporate and politic, for the purpose of mining coal and transporting and selling same, within the Lackawanna valley, Luzerne county. That JAMES W. JOHNSON, RICHARD D. LATHROP, CHARLES T. PIERSON, LEWIS S. WATERS, MARTIN CURTIS and CHARLES FULLER, are hereby constituted a body corporate and politic by the name of Pennsylvania Coal company, for the purpose of mining coal and transporting and selling of the same, within the township of Pittston, Luzerne county. That JOB ENGLAND, BENJAMIN HARTSHORN, JOSEPH BREDIN, WILLIAM IRVIN, JAMES RAY, CHRISTIAN EREHART, JOSIAH W. SMITH are hereby appointed commissioners to erect a bridge over the Susquehanna, at the village of Curvensville, Clearfield county, and to collect tolls. That ABRAHAM KLINE, ABRAHAM MORBORGER, JOHN RENSHLER, CHRISTIAN KNAUS, GEORGE SAYMAN, GEORGE RICK, JOHN HUMMEL, JOHN BOND, GEORGE MOSER, ISAAC MEYERS, SAMUEL DE PUI, GABRIEL MATZ and DANIEL SHOLLENBERGER, are hereby appointed commissioners to erect a bridge over the river Schuylkill, above the forks of the two rivers, in the county of Schuylkill, called the Port Clinton Bridge. 16 Apr 1838. 81. An act authorizing the laying out of a state road from the borough of Greensburg, Westmoreland county, cross Brush run, at ______ LAUFFER's saw mill, to intersect with the Greensburg and Pittsburg Turnpike, near the house of HENRY CHALFANT, on Turtle Creek, Allegheny county. That THOMAS ARMSTRONG and ABRAHAM WEAVER of Westmoreland county, and ROBERT CAROTHERS of Allegheny county, are hereby appointed commissioners. 16 Apr 1838. 82. An act for the relief of JOHN VANSANT, and other soldiers, and widows of soldiers of the Revolutionary and Indian wars. That the State Tresurer is hereby authorized to pay to John Vansant and SUSANNAH GALLENTINE of Fayette county, SAMUEL FOREMAN of Armstrong county, EMANUEL ZEIGLER of Adams county, LETITIA M'CARTY and CATHARINE CORRELL of Columbia county, GEORGE M'CORD of Mercer county, HANNAH LONG and JANE GOODEN of Greene county, and JOSEPH ELLENDER of Lehigh county, soldiers and widows of soldiers of the Revolutionary and Indian wars, forty dollars each immediately as a gratuity, and an annuity of forty dollars each during life, to be paid half yearly, commencing on 1 Jan 1838. That the State Treasurer is hereby authorized to pay to JACOB LABAR of Monroe county, a gratuity of forty dollars in full for his military services. The State Treasurer is hereby authorized to pay to ROBERT SPEAR, in trust for the use and benefit of GEORGE ALBRIGHT of Lancaster county, a soldier, and to ELIZABETH SCOTT of Butler county, EDITH NUNEMAKER of Philadelphia county, ADDA COLEMAN of Columbia county, CATHARINE HUFFNAGLE of Westmoreland county, MARGARET HETRICH of Jefferson county, CHARLOTTE LAIN of Allegheny county, and ELIZABETH BAINMAN of Lancaster county, widows of soldiers of the Revolutionary and Indian wars, forty dollars each immediately, as a gratuity, and an annuity of forty dollars each during life, payable half yearly, to commence on 1 Jan 1838. The State Treasurer is hereby authorized to pay to PHILIP RHULE of Union county, in trust for the use and benefit of JACOB ROSS of Union county, a soldier of the Revolutionary war, forty dollars as a gratuity for military services rendered by Jacob Ross. The act dated 23 Jan 1811, granting an annuity to WILLIAM KERNICHON, of Bucks county, a soldier of the revolutionary war, for life, and appointed JOHN HOUGH, his attorney, for the purpose of receiving his pension is hereby repealed, the foregoing gratuities and annuities to be paid in conformity to the existing laws. That the State Treasurer is hereby authorized to pay to CATHARINE FUNK of York county, and CHRISTIANA CROMLEY, widows of soldiers of the Revolutionary war, forty dollars each immediately, as a gratuity, and an annuity of forty dollars each during life, to be paid half yearly, commencing on 1 Jan 1838, and the act passed 20 Mar 1838 is hereby repealed as relates to CHRISTIAN CROMLEY. 16 Apr 1838. 83. An act to annul the marriage contract of ABRAHAM GARNER and ELIZABETH GARNER his wife, ELIAS WALTON and SOPHIA WALTON his wife, CHARLES D. EICHKOFF and ROSANNA EICHKOFF his wife. That the marriage contract entered into by Abraham Garner and Elizabeth his wife, is hereby made void, and the parties released from the contract, and from all duties as fully as if they had never been joined in marriage. That the marriage contract entered into by Ellis Walton and Sophia his wife, late SOPHIA GERHART, is hereby annulled and made void, and the parties released from the contract as fully as if they had never been joined in marriage. That the marriage contract entered into by Charles L. Eickhoff and Rosanna his wife, is hereby declared void, and the parties released from the contract and all duties as fully as if they had never been joined in marriage. 16 Apr 1838. 84. An act to incorporate the Clearfield and Curvensville Turnpike road company. That ABRAHAM K. RIGHT, JOHN R. BLOOM, RICHARD SHAW, CHRISTOPHER KRATZER, JOSEPH BOON JR., THOMAS BROWN, WILLIAM L. An act to authorize the committee of the estate of MICHAEL FOX, a lunatic, to sell and convey certain real estate, and for other purposes. That JOHN R. It is further enacted, on the application of the widow or any lineal descendant of Nathan, if of full age, or his or her guardian to award an inquest to make and return an appraisement of the share which was his at the time of his death. The court shall proceed to make allotment, or on refusal to order a sale with the same effects. That the citizens of Pine Grove twp., Schuylkill county, beginning in the middle of the river Swatara, on a line of lands of PETER FILBER, late _____ LEY and _____ HOCH, thence through Church land, through land of JOHN KEYSER, thence through land of now or late JACOB HUBLER, _____ LEHMAN and _____ GRATZ, and JOHN ZIMMERMAN, to beginning, shall form a separate school district. That the Secretary of the Commonwealth, Land office, and Surveyor General, are hereby constituted a board to settle and adjust the claim of the executors of CAPT. WILLIAM POWER, dec. for services rendered in his lifetime, as agent of the commonwealth, for the sale of lands, late the estate of JOHN NICHOLSON and PETER BAYNTON, and to make allowance for the services proved to have been actually rendered. An act to confer on children the rights of children born in wedlock, and other purposes. That the accountant officers be authorized to credit JOHN P. RUTHERFORD, late superintendent, with the sum of $500.00, damages awarded to the widow of THOMAS M'QUOIDE, dec. by the board of Appraisers, in consequence of the opening of State road from the Capital to the Canal, which Rutherford paid to the widow. That JAMES RONALDSON, FRANCIS LYON, ANDREW HOOTEN, JAMES ENUE JR., THOMAS E. GRISWOLD, THOMAS BARNETT, SAMUEL F. REED, ROBERT L. LONGHEAD, JAMES MURPHY, JAMES A. CAMPBELL, are hereby incorporated under the name Moyamensing Library and Literary Association. That the sale made to GEORGE W. HARRIS, of any portion of the estate of CHRISTIAN LEY, late of the county of Lebanon, dec., by JOHN LEY and CHRISTIAN LEY, surviving administrators of the dec. since the death of PETER BATDORFF, one of the administrators of the dec., shall be valid, and AUGUSTUS HOLMES, administrator de bonis non of Christian Ley, dec. is hereby authorized to sell, upon thirty days notice in the newspapers of Berks, Dauphin, Lebanon and Clearfield counties, the remaining parts of real estate of Christian Ley dec. and vest in the purchasers a good deed. Whereas, the sum of $53.00 was paid by AMBROSE GAYLORD JR., of Braintrim twp., Luzerne county, to the commissiones, to erect a bridge over the Susquehanna river, at the borough of Wilkesbarre, Luzerne county, and through mistake applied to lot #17 instead of lot #15 as was intended, as appears on receipt, that money shall be applied towards the purchase of lot #15, in the same division of lands. That THOMAS MURTHA, JOHN MURTHA, DAVID MURTHA, and MARY MURTHA, children of Thomas Murtha, of the Northern Liberties, of the county of Philadelphia, shall have all the rights and benefits of children born in lawful wedlock as if they had been born in lawful wedlock. 16 Apr 1838. 97. An act relative to the laying out of a state roads, and for other purposes. That ALEXANDER PATTERSON, of Indiana county, GEORGE M'COMBS, of Allegheny county, WILLIAM M'CUTCHEN, of Westmoreland county, and MOSES BOGGS of Clearfield county, are hereby appointed commissioners to lay out a state road, leading from Curvinsville, Clearfield county, through the towns of Indiana and Saltsburg, Indiana county, and through the county of Westmoreland, to East Liberty, in Allegheny county. JOHN HUSTON, JOSEPH KELLER, and WILLIAM OVERFIELD of Monroe county, JAMES M. PORTER, M. ROBERT BUTZ of Northampton county, and ALBERT G. The citizens of the borough, qualified to vote, shall meet at the public house of OLIVER CADWALLADER, to elect officials. The following boundaries are hereby extended to the borough of Newhope, beginning on the borough line, at the head of a small island in the river Delaware, by land formerly JOHN SMITH's, by land of late B. PARRY, dec. to borough line. 16 Apr 1838. RESOLUTIONS R 1. Resolution for the relief of DOROTHEA BENEDICT. Whereas, by an act approved 27 Mar 1837, the State Treasurer was directed to pay SOPHIA BENEDICT, of Lancaster county, the widow of a soldier of the revolutionary war, the sum of forty dollars immediately as a gratuity, and an annuity of forty dollars payable half yearly during life. The person intended to be pensioned by the act was erroneously called Sophia instead of Dorothea, her real name, by reason thereof she has been precluded from receiving and enjoying the benefits intended, for remedy whereof the State Treasurer is hereby directed to pay to Dorothea Benedict of Lancaster county, the widow of a revolutionary war soldier the sum of eighty dollars, as a gratuity, and pension for the year 1837, and an annuity of forty dollars during life payable half yearly, to commence on 1 Jan 1838, and the part of the act as relates to the gratuity and pension of Sophia Benedict of Lancaster county, is hereby repealed. 12 Jan 1838. R 4. Resolution for the relief of JOSEPH SERENA. Whereas, an act approved 7 Mar 1837, the State Treasurer was directed to pay to JOSEPH LERENO, of Westmoreland county, a soldier of the Indian war, a gratuity of forty dollars, and an annuity of forty dollars to be paid half yearly during life. As an error was committed by designating the individual intended to be relieved by the name of Joseph Lereno, instead of Joseph Serena his real name. Therefore, the State Treasurer is hereby directed to pay to Joseph Serena of Westmoreland county, a soldier of the Indian war, the sum of eighty dollars as a gratuity and pension for the year 1837, and an annuity of forty dollars during life, to be paid half yearly, and to commence on the 1 Jan 1838. That the act passed as relates to the granting of a gratuity and an annuity to Joseph Lereno, of Westmoreland county is hereby repealed. 23 Jan 1838. R 6. Resolution authorizing the Governor to present a sword to GENERAL HUGH BRADY, for his distinguished services during the late war with Great Britain. Whereas, General Hugh Brady of the United States army has been highly distinguished for soldier like conduct, at Bridgewater and many other places, during the late war with Great Britain, and whereas, his services are well known in former wars, and being a native of Pennsylvania and well worthy of her esteem and regard. Therefore, The Governor is hereby authorized to present to General Hugh Brady, a sword suitable for the occasion, as a memento of the esteem of his native state for his services. R 7. Resolution for the postponement of the SubTreasury Bill, expressing confidence in Martin Van Buren, and in favor of a separation of the Banks from the General Government. That a vote be postponed until the next session of Congress, on an act introduced by the Honorable SILAS WRIGHT, of New York, to vote for such a mode of receiving, keeping and disbursing the public monies, as separate, as far as practicable, the banks from the Government. 16 Feb 1838. R 8. Resolution relating to the alleged claims of damage. That the Canal Commissioners are hereby authorized to examine into and settle the claim of DAVID EASTON and SIDNEY S. EASTON of Cambria county, for alleged errors in the measurement of the excavation and embankment on section #34, of the Allegheny Portage Railroad, as if they had appealed within the time limit and in all other respects had complied with the provisions. That no such adjustment fo the claim has been made, or appeal lawfully entered. The Canal commissioners are hereby authorized to examine and enquire into the amount of damages that have been sustained by JOHN JUSTICE MARTIN of the city of Lancaster, by reason of the location and construction of the Philadelphia and Columbia Railroad, which passes through his property, and the same shall be allowed provided the claimant has not received any compensation for the damages. 1 Mar 1838. R 10. Resolutions relative to the payment of scrip issued by the late superintendent upon the Columbia Railway. The sum of $20000.00 was appropriated for the payment of certain debts due person holding certificates issued by WILLIAM B. MITCHELL, late superintendent of the Philadelphia and Columbia Railroad, and whereas the sum is pledged to other purposes, the money is to come out of any monies not otherwise appropriated. 13 Mar 1838. R 14. Resolution relative to the gratuity and annuity of JAMES PRATT, a soldier. That the State Treasurer is hereby directed to comply with the prerequisitions of the section of law passed 3 Apr 1837 in relation to a gratuity and annuity to James Pratt, a soldier of Columbia county. 13 Apr 1838. R 15. Resolutions relative to the canal damages and claims of JOHN SNYDER and WILLIAM STALL, and others. That the board of Appraisers of canal damages are hereby authorized to re-examine and assess the damage, if any, which may have been sustained by John Snyder and William Stall and others, of Columbia county by reason of the construction of the Pa. canal. That in assessing the damages they shall take into consideration the benefit which the petitioners derive from the construction of the canal and pay damages due. That is shall be the duty of the board of Appraisers to re-examine, if any, the amount of damages sustained by EDWARD INMAN of Luzerne county, in the overflow of his land situated in Hanover Twp. caused by the erection of the Nanticoke dam, on the North branch of the Susquehanna river, report the sum and pay same. That the Board of Appraisers are hereby authorized to examine and settle the claim of REUBEN WINSLOW of Chester county, for damages incurred by the variation of the facilities afforded him in complying with the terms of his contract on the Columbia and Philadelphia railroad, provided that no adjustment of the claim has been made. That is shall be the duty of the Appraisers of Damages to aascertain if any damage was done to JAMES CLAWSON, in the carrying away and destruction of his salt works, on the river Kiskiminitas, immediately below dam #2 in the county of Westmoreland, by the freshet in the month of February 1832, and if damage was sustained by the construction or breaking of the dam without default or negligence on the part of the owner, to report the amount and pay the same. That the Canal Commissioners are hereby authorized to re-examine the claims of GEORGE D. FOREMAN, contractor for lock #1 on the Erie extension of the Pa. canal, for injuries sustained in consequence of the flowing of water back on the lock, caused by the erection of the Shenango feeder dam, and if sustained then to make just allowance. That the Canal Commissioners are hereby authorized to ascertain if any damage has been sustained by JOHN WAGONER of York county, caused by quarrying of stone on his property and applied to the construction of the Eastern division of the Pa. canal, and if so report the amount and paid. That the Canal Commissioners are hereby authorized to inquire into the claim of additional damages sustained by JAMES HERRINGTON of Crawford county, from the construction of the French creek division of the Pa. canal, and to ascertain the actual damage and to pay the same. That the Board of Appraisers of canal damages are hereby authorized to re-examine and assess the damage if any, which may have been sustained by PATRICK GWIN of Huntingdon county, by reason of the construction of the Pa. canal. That the Board of Appraisers are hereby authorized to inquire into the claim of damages sustained by JOHN DAVIS of Crawford county, from the construction of the French Creek division of the Pa. canal and to ascertain the actual damage done to be paid. That the Canal Commissioners are hereby authorized to examine the claim of the heirs of JAMES M'NAMEE, dec. late a contractor on section #37 of the Juniata division of the Pa. canal, for stone and materials prepared and delivered by said deceased, while a contractor and if any found due him to direct the amount to be paid. That the Appraisers of Canal Damages are hereby authorized to re-examine the claim of THOMAS T. CROMWELL, for damages sustained by hon on #162 on the Juniata division of the Pa. canal, and ascertain the amount if any, and paid. That the Canal Commissioners are hereby authorized to examine the claim of JACKSON MCFADDEN for damages sustained by him in the construction of lock #2, on the Lycoming division of the Pa. canal, and allow him such compensation as shall be just having reference toa change of a part of the work from rough to cut stone, and also to what others were paid for constructing similar locks on the same division, and to direct the amount, if any, to be paid. That the Canal Commissioners are hereby authorized to examine the claim of DAVID EASTON, JAMES COLLINS and EMERY EASTON contractors for locks #5, 6, and 7, on the Erie extension of the Pa. canal, for retained per centage, and if they should be paid such per centage, then to ascertain the amount and paid. 13 Apr 1838. R 18. Resolution granting a premium to ROYAL FREEMAN, for a device for propelling boats. Whereas, Royal Freeman has exhibited the model of a device for propelling boats by means of a slide, with setting poles, to operate by steam power, therefore, to give encouragement towards making a sufficient practical test of the device, the sum of $2000.00 as a premium, is hereby granted to Royal Freeman, as soon as the board of Commissioners shall certify to the Governor that the device for propelling boats has been put into useful practical operation, particularly in ascending the Allegheny river, and that the device is preferable to any other power previously used in propelling boats up the river and that Royal Freeman shall satisfy the commissioners that the device was first invented by him. 16 Apr 1838. R 22. Resolution relative to damages on the railroads. That the Canal Commissioners are hereby authorized to examine, what amount of damages was sustained by WILLIAM C. HULL, of Lancaster county, a transporter on the Philadelphia and Columbia Railroad, in having his car run down and the freight destroyed by one of the State locomotive engines in 1835. Provided the same was done through the negligence of the engineer, they should report the amount which shall be paid out of the damage fund. 17 Apr 1838. THO. H.
