An act to provide for the erection of a House for the Employment and Support of the Poor in the county of Westmoreland. That BENJAMIN BYERLY, JOHN TAYLOR, CHRISTOPHER CRIBBS, ROBERT HITCHMAN, BENJAMIN STEWART, ARCHIBALD BOYD SEN., ARCHIBALD B. MEGREW, GEORGE R. HAYMAKER, JOHN REED, WM. M'LAUGHLIN SEN., JAMES MOORHEAD, WM. T. BALDRIDGE, HENRY M'BRIDE, JACOB KINTZ, JAMES HORRELL, JOHN M'GOWAN, JOSEPH LLOYD, and CHRISTIAN FOX, are hereby appointed commissioners. 26 Jan 1839. 6. An act to incorporate the Hanover Coal Company. That JOSEPH D. MURRAY, DANIEL PARRY, JOHN FOX, LEWIS S. CORYELL, JOHN C. PARRY, MATTHEW C. JENKINS, ALEXANDER M. PELTZ, MICHAEL SNYDER, JOHN H. BRIGGS, JESSE R. BURDEN, WILLIAM T. ROGERS, THOMAS O. GOLDSMITH, JOHN JONES, are hereby constituted a body corporate and politic, for the purpose of mining coal, and the transportation of the same, within the counties of Luzerne and Northampton. We do hereby certify, that the above bill was presented to the governor and was not returned within three days after the meeting of the legislature in Dec, 1838, therefore it became a law, as if he had signed it. 6 Feb 1839. 10. An act for the relief of JOHN DANFIELD, and others, soldiers and widows of soldiers of the revolutionary and Indian wars. The state treasurer is hereby authorized to pay to ELIZABETH BAUSMAN of Lancaster county, the widow of a soldier of the revolutionary war, eighty dollars immediately as a gratuity, and an annuity of forty dollars during life, to be paid half yearly, commencing on 1 Jan 1839. The part of the act dated 16 Apr 1838 as grants a gratuity and annuity to ELIZABETH BAINMAN of Lancaster county is hereby repealed. The state treasurer is hereby authorized to pay to GEORGE ALBRIGHT of Lancaster county, a soldier of the revolutionary war, an annuity of forty dollars during life, to be paid half yearly commencing on 1 Jan 1839. As much of the act passed 16 Apr 1838, as requires the state treasurer pay to ROBERT SPEAR, in trust for the use and benefit of George Albright of Lancaster county, a gratuity and annuity is hereby repealed. The state treasurer is hereby authorized to pay to CHRISTIANA GOODMAN of Columbia county, the widow of PETER GOODMAN, a soldier of the revolutionary war, forty dollars immediately as a gratuity in full for military services rendered by her husband. 18 Feb 1839. 11. An act to annul the marriage contract of WILLIAM J. DENISON and JANE M. DENISON. That the marriage contract entered into by William J. Denison and Jane M. Denison his wife, is hereby annulled and made void, and the parties released from all duties as fully as if they had never been joined in marriage. 19 Feb 1839. 13. A supplement to incorporate the Washington Insurance Company, of Philadelphia. That the following persons: JOHN M'CREA, CHARLES BLIGHT, JOHN C. DA COSTA, EDWARD GRATZ, J. PALMER, CHARLES KING, DAVID DORRANCE, BENJAMIN S. BURLING, MORGAN ASH, WADE T. SMITH, ISAAC LLOYD JR., CHARLES RUGAN and CHARLES S. RICHE, elected as directors on second monday of Jan, 1839, shall have all the rights and authority bestowed 10 Apr 1838, to insure against losses by fire. 26 Feb 1839. 14. An act to incorporate the Royer's Ford Bridge company over the river Schuylkill, at said ford. That for the purpose of erecting a bridge, FRANCIS HOBSON, JOHN DISMANT, SAMUEL CUSTER, FREDERICK BERGSTRESSER, HENRY GARBER, JOHN LONGAKER, JAMES MILLER, JOHN PATTERSON, of Montgomery county, FREDERICK HECKEL, MICHAEL TOWERS, JOHN KALB, FREDERICK YOST, JAMES ROGERS, of Chester county, are hereby appointed commissioners. 27 Feb 1839. 15. A supplement to the act passed 16 Apr 1838, incorporating the Orwigsburg Female Seminary, in the county of Schuylkill, and for other purposes. That the organization of the seminary by CHARLES FRAILY, WILLIAM B. POTTS, JACOB HAMMAR and JOHN BANNAN, the trustees named of the seminary until the election of trustees, will be considered as valid as if there were five of them. 27 Feb 1839. 16. An act authorizing the commissioners of Berks county to sell certain real estate. Whereas, JOHN PENN, of Stoke Regis, in the county of Bucks, and kingdom of Great Britain, and RICHARD PENN, of Queen Ann street west, in the parish of Saint Mary Le Bone, in the county of Middlesex, in the kingdom of Great Britain, esquires, by their attorney EDMUND PHYSICK, by deed duly executed, bearing 19 Nov 1800, and duly recorded in Berks county, Book A, vol 17, pg 302, did grant and sell unto PETER FEATHER JR., JACOB RHOADS and JACOB EPLER, commissioners of Berks county, for the use of the county of Berks county, a tract on the east of the borough of Reading, containing 55 1/2 acres. That the sale of 31 acres by the county of Berks, is hereby confirmed and are empowered to execute deeds to the purchasers. 28 Feb 1839. 19. An act to incorporate the Stroudsburgh female Seminary, in the borough of Stroudsburgh, Monroe county. The trustees are: JOHN HUSTON, JOSEPH KERR, SAMUEL STOKES, WILLIAM P. VAIL, MORRIS D. ROBESON, ROBERT BOYS, and DEPUE S. MILLER, who are declared a body politic and corporate. 4 Mar 1839. 26. An act to confirm AMOS ATKINSON and THOMAS BRANSON in the title of certain real estate in the city of Philadelphia. That Amos Atkinson and Thomas Branson, as tenants in common are hereby confirmed in the title of a lot situate on north side of Lombard St. between Willow and Bank Sts. in the city of Philadelphia, which was purchased by the Bank of North America who by deed dated 12 Apr 1810 recorded in deed book I.C. #7, pg 389, conveyed to TIMOTHY ABBOTT and HANSON WATERS, to the intent that at no time should the title be questioned on the part of the bank to convey said real estate to Amos Atkinson and Thomas Branson and may dispose as if the president, directors etc had the authority to do so,.the same as to Timothy Abbott and Hanson Waters. 8 Mar 1839. 28. An act for the relief of JAMES JORDAN, and others, soldiers and widows of soldiers of the revolutionary and Indian wars. That the State Treasurer is hereby authorized to pay to James Jordan of Allegheny county, CHRISTOPHER OZIAS, CONRAD IDEL, and ELIZABETH SCHMALTZ of Philadelphia county, ELIZABETH KELLER, of Lancaster county, JANE LINTON of Baltimore, JOHN FLEMING and KEZIAH CLAWSON of Fayette county, SUSAN WIDENER of Chester county, WILLIAM HUNTER of Mercer county, and JACOB KING, CATHARINE SNYDER and ELIZABETH DIVIDSHEISER, of Berks county, soldiers and widows of soldiers of the revolutionary and Indian wars, forty dollars each immediately, as a gratuity, and an annuity of forty dollars annually during life, payable half yearly, to commence on 1 Jan 1839. The state treasurer is hereby authorized to pay to JACOB LONG of Berks county, and JOB HELMES of Delaware county, forty dollars each immediately, as a gratuity in full for military services rendered by them during the revolutionary war. That the state treasurer is hereby authorized to pay JAMES M'KINZEY, ANANIAS WLISENER and JANE TAYLOR of Westmoreland county, JAMES WALKER and MARTHA SLOAN of Armstrong county, GEORGE FELTY of Green county, JOHN WERTZ of Northumberland county, ANNA MARIA FRYER of Montgomery county, MARGARET KLINE of Northampton county, and PHEBE KREWSON of Philadelphia county, soldiers, and widows of soldiers of the revolutionary and Indian wars, forty dollars each immediately, as a gratuity, and an annuity of forty dollars each during life, to be paid half yearly, commencing on 1 Jan 1839. That the state treasurer is hereby authorized to pay to REBECCA STEEL of Mercer county, $8.33 the proportion of an annuity, together with a gratuity of forty dollars which was due her husband, RICHARD STEEL, at the time of his death, by the act passed 1 Apr 1836. The state treasurer is hereby authorized to pay WILLIAM M'KELVY of Fayette county, forty dollars immediately, as a gratuity in full for his services in the Indian war. That the state treasurer is hereby authorized to pay to JOHN BOIES of Beaver county, a soldier, and HANNAH RISTINE and ELIZABETH SCHOTTERER, of the county of Philadelphia, ELIZABETH ERB, ELIZABETH HECKMAN, JEMIMA YOUNG and CHARLOTTE GARIS of Northampton county, CATHARINE SHOVER of Franklin county, widows of soldiers of the revolutionary and Indian wars, forty dollars immediately, as a gratuity and an annuity of forty dollars each during life, payable half yearly, to commence on 1 Jan 1839. That the state treasurer is hereby authorized to pay to JAMES DONNAHEY of Indiana county, a gratuity of forty dollars in full for his military services. That the state treasurer is hereby authorized to pay to SOLOMON FORGEL, in trust for JOHN DOLL of Lehigh county, the annuity to which he is entitled by the act of 5 Mar 1828, and that so much of the act as directed to the payment of the said annuity to JOHN FOGEL, (who is since deceased) is hereby repealed. 13 Mar 1839. 30. An act for the relief of WILLIAM LYON, and others, soldiers and widows of soldiers of the revolutionary and Indian wars. That the state treasurer is hereby authorized to pay to WILLIAM LYON of Venango county, PETER PALMER of Indiana county, DAVID SHIELDS of Armstrong county, ABRAHAM FRYER, WILLIAM COLMER, WILLIAM WILSON of Butler county, WILLIAM NICHOLS of Fayette county, WILLIAM WALTON of Luzerne county, and JOHN GEORGE HUMMEL of Northumberland county, soldiers, and CATHARINE E. WOLF of Lehigh county, SALOME MEYERS of Northampton county, MAGDALENA HOFFMAN of Lancaster county, MARY SMITH of Monroe county, widows of soldiers of revolutionary and Indian wars, forty dollars immediately, as a gratuity and an annuity of forty dollars each during life, payable half yearly, to commence on 1 Jan 1839. That the state treasurer is hereby authorized to pay to JAMES CAMPBELL of Westmoreland county, a gratuity of forty dollars in full for his military services. 13 Mar 1839. 31. An act to extend the limits of the borough of Towanda, and for other purposes. That the boundaries of the borough of Towanda, Bradford county, are declared as follows: commencingon the Susquehanna river, at the eastern line between the farms of HIRAM MIX, and FRANCIS DELPUECH, thence to the south line of the farm of ENOS TOMKINS and THOMAS ELLIOTT, thence to the river. 13 Mar 1839. 34. An act to incorporate a company in the borough of New Brighton, to be called the Jefferson Fire company. That E.K. CHAMBERLAIN, J.P. SMITH, HAMILTON HOOPS, JOSEPH B. COALE, JOHN DUKEHART JR., WM. S. BRICK, W.H.H. CHAMBERLAIN, PETER REED, JOSEPH D. HOAG, JOHN STOKES, JOHN GLASS, JOHN C. HUNTER, ROBERT TOWNSEND, TIMOTHY B. WHITE, DAVID M'CONNELL, are hereby declared one body politic, and corporate. 36. An act to incorporate the president and managers of the Elizabeth turnpike road company. That WILLIAM SHRAIDER, ISAAC WILSON, JOHN IRWIN, JAMES M'KOON, PETER WILSON, JOSEPH VAN KIRK, of Samuel, JAMES HALL SEN., URIAH APPLEGATE, JAMES SCOTT, CULBUT MEANS, SAMUEL WALKER, JOHN GAMBLE, of the county of Allegheny, are hereby appointed commissioners, to lay out a road from the borough of Elizabeth, to the tavern of JOHN TORRENCE, on the Williamsport turnpike, and to collect tolls. 13 Mar 1839. 37. An act to incorporate a company, to make a turnpike road, to connect Williamsport and Elmira railroad with the Blossburg and Painted Post railroad. That JAMES R. WILSON, CURTIS PARKHURST, JAMES FORD, AARON BLOSS, and A.C. BUSH, of Tioga county, are hereby appointed commissioners. 13 Mar 1839. 39. An act to incorporate the Manor turnpike road company. That for the purpose of making a turnpike road from Manor street, where it intersects West King street, city of Lancaster, and the public house now occupied by Abraham Peters, in the village of Millersburg, to the Little Conestoga creek, at a point called the Lake Mill, ABRAHAM PETERS, JACOB HUBER, BENJAMIN HERR, CHRISTIAN LINTNER, JOHN LINTNER, DANIEL LINTNER, JACOB PETERS, JACOB MELLINGER, GEORGE FORD JR., JOHN BRADY, JOHN BAUSMAN, JACOB SHENK, CHRISTOPHER BRENNER, JOHN LANDIS, are hereby appointed commissioners. 13 Mar 1839. 45. An act providing for the improvement of the road leading from Coudersport, Potter county, to the New York state line, about two miles west of Cerestown, M'Kean county. That ANSEL PURPLE, TIMOTHY IVES JR., and ARAD H. JOHNS, be commissioners to lay the appropriation made by the county commissioners of Potter, and that JOHN KING, and JOHN SMITH, be commissioners of the appropriation for M'Kean county. 13 Mar 1839. 46. An act to confer on MARIA ELIZABETH WITMAN, CHARLES DECATUR PRITCHETT, and MARY PRITCHETT, the rights and benefits of children born in wedlock. That MARY ELIZABETH WITTMAN of the township of Tulpahocken, in the county of Berks, shall have all the rights and benefits of a child born in lawful wedlock as if she had been born in lawful wedlock. That Charles Decatur Pritchett, REBECCA ANN PRITCHETT, ELIZABETH PRITCHETT, JOHN PRITCHETT and Mary Pritchett of Martick township, Lancaster county, shall have and enjoy all the rights and benefits of children born in wedlock, as if they had been born in lawful wedlock. 13 Mar 1839. 47. A supplement to an act to incorporate the Bradford county Mutual Insurance company. The act passed 13 Apr 1838, which provides that SETH W. PAINE, V.M. LONG, ERASTUS FITCH, THOMAS OWEN, I.N. POMEROY, G.F. REDDINGTON, JERE ADAMS, REUBEN WILBER, O.P. BALLARD, ALONZO LONG, ELIHU NEWBERRY, and EZRA LONG, shall be corporators, and the first section of the act is hereby repealed, and that NATHANIEL N. BETTS, ORRIN D. BARTLETT, JOSEPH D. MONTAYNE, JERE ADAMS, DAVID CASH, HENRY S. MERCUR, ABRAHAM GOODWIN, WILLIAM B. STORM, ORRIN P. BALLARD, ELISHA S. GOODRICH, REUBEN WILBER, ENOS TOMKIN and JOHN F. MEANS, shall be the corporators for the purposes mentioned. 13 MAR 1839. 54. An act authorizing MARY M'CORMICK to change her name to MARY TEMPLE. That Mary M'Cormick of the county of Jefferson, is authorized to change her name to Mary Temple. 16 Mar 1839. 55. An act vesting the title of a school house and burial ground in the corporation of the borough of Pottsville, Schuylkill county. Whereas, the late JOHN POTT, the proprietor of the town of Pottsville, laid out the original town plot, and annexed a lot of ground, for the erection of a school house and a burial ground for the inhabitants residing within the limits of the town. The title is hereby vested in the corporation of the borough of Pottsville and are authorized to appoint three trustees. 16 Mar 1839. 56. An act to authorize JOHN VANCE, JOHN COLMERRY and HENRY VANCE, guardians of the minor children of JOHN SCOTT dec. late of Washington county, to sell and convey certain real estate and for other purposes. That John Vance, guardian of MARY SCOTT and MARTHA SCOTT, John Colmerry, guardian of VANCE SCOTT and JANE SCOTT, and Henry Vance, guardian of ISABELLA SCOTT, minor children of Isabella Scott, late ISABELLA VANCE, are hereby authorized to convey and release on behalf of their wards, all rights and title of the heirs in 50 acres of land, situate in South Straban Twp., Washington county, to ANN VANCE, in full satisfaction of her right of dower in the estate of her late husband, ISAAC VANCE, the guardians are hereby authorized to make and execute conveyance for transfer of the property, as if the minors were of full age. That DANIEL M. SMYSER, deputy escheator of the estate of ANTHONY BOSSAGE, late of Adams county, dec. is hereby authorized to sell and convey by deed, to the purchaser, the real estate of Anthony Bossage, escheated to this commonwealth, for the best price and paying the net profit into the treasury of the commonwealth, after deducting all charges. Whereas, JENNY CAIN, late of Adams county, dec. owned a certain lot situate in Woodstock, alias, Huntertown, Adams county, and she died intestate without heirs, but leaving DINAH WHITSON, her natural daughter, and the lot has been escheated to the commonwealth. It is therefore enacted that all rights and title which this commonwealth may have acquired, by reason of escheat, from want of heirs, and the lot is hereby vested to her natural daughter Dinah Whitson. 16 Mar 1839. 57. An act to provide for the erection of a House for the employment and support of the Poor in the county of Columbia. That GEORGE KELCHNER, JOHN YAGER, MARTIN BILLMYER, JOHN LANEY, SAMUEL OAKES, THOMAS MOREHEAD, JACOB SWISHER, PETER YOHE, GEORGE KAUFMAN, JOSEPH MAUS, DANIEL SNYDER, SAMUEL YORKS, MICHAEL FORNWALDT, ISAAC WELSH, and JOHN RHOADS, are hereby appointed commissioners. 16 Mar 1839. 58. An act to lay out a state road from the borough of Allentown, Lehigh county, to Dale and Mt. Pleasant forges, to the borough of Pottstown, Montgomery county, and from thence to Boyerstown, Berks county, West Chester, in Chester county. That PHILIP BOYER, of Montgomery county, MICHAEL GEHRY and GEORGE WEILER, of Berks county, SOLOMON FOGEL and SAMUEL MARX, of Leghigh county, WALTER HIBBERD and THOMAS BISHOP, of Chester county, are hereby appointed commissioners. 16 Mar 1839. 59. A supplement to the act conveying certain real estate dated 13 Apr 1835 and for other purposes. Whereas, ARCHIBALD T. DICK, one of the trustees named, died in Aug. 1837, and JOSEPH ENGLE the surviving trustee resigned his trust in Apr. 1838, and The court of Philadelphia appointed JEREMIAH W. FLICKWIR their successor and no authority having been given to a successor to sell and convey real estate, and JOHN FLOWER one of the minors is now of age, and ARCHIBALD FLOWER, another of the minors died in Sep. 1837, leaving RICHARD FLOWER, HANNAH FLOWER, and MARY FLOWER still in their minority, and there is a portion of the real estate yet unsold that is unproductive and burdensome by reason of taxes, and the minors would be benefitted by its sale. That JEREMIAH W. FLICKER, is hereby authorized to sell the interests of Richard, Hannah and Mary, minor children of ZEDEKIAH W. FLOWER, and MARY B. FLOWER his wife, in real estate lying in the township of Moyamensing, Philadelphia county, the said Jeremiah W. Flickwir as successor to Joseph Engle and Archibald T. Dick for the use of the minors to convey and release all rights and title of the minors in the real estate, releasing the same to the purchasers as if they were of full age. That JOHN TAYLOR, EBENEZER TERRY and HUMPHREY BROWN, under the act dated 8 Apr 1829, certain lots in Bedford county, in trust as school lots for Springfield Twp. they are authorized to sell and to convey the same to the purchasers. That WILLIAM HAMILL, attorney, for HANNAH WINNARD, surviving executor of JAMES WINNARD, late of Norriton Twp. Montgomery county, dec. is hereby authorized to sell all the real estate of the dec. and convey the same to the purchaser. Immediately after the sale, William Hamill shall pay out all just debts of James Winnard dec. Provided, the first sum of $2000.00 shall be by him secured, either upon real estate and the interest from it shall be paid annually to Hannah Winnard, during her life and immediately after her decease, the principal paid according to the testor's will. If any proceeds remain after paying debts and the $2000.00, the same shall be put out to interest, on good security and interest, paid to Hannah Winnard during her life time annually, and the principal to the heirs. 16 Mar 1839. 61. An act to authorize JAMES GREGG to erect a dam in the Kiskiminetas river. That James Gregg, of Westmoreland county, is hereby authorized to erect a dam in the Kiskeminetas river, near the village of Saltzburg, which shall extend shore to shore, not exceeding 3 1/2 feet in height. 21 Mar 1839. 62. An act to incorporate the Susquehanna County Mutual Insurance company. That GEORGE WALKER, GEORGE FULLER, J.C. BINDDLE, JOSEPH WASHBURN, ALMON H. READ, JAMES W. CHAPMAN, J.W. RAYNSFORD, M.C. TYLER, A.L. POST, H.J. WEBB, HENRY DRINKER, ASA DIMOCK, C.L. WARD, DAVIS DIMOCK JR., MASON S. WILLSON, JOHN COMFORT, CHARLES DIMMON, CALVIN LEET, SPENCER HICKOX, ROWLAND T. ASHLEY, JABEZ HYDE, THOMAS P. PHINNEY, CALVIN SUMMERS, JOSEPH WARD, shall be a corporation, for the purpose of insuring their respective property against loss or damage by fire. 21 Mar 1839. 65. A supplement to an act to incorporate the Philadelphia and Trenton Railroad company. The Philadelphia and Trenton Railroad company are hereby authorized to continue along Frankford road and Maiden street, in the district of Kensington. That JAMES RONALDSON, THOMAS D. GROVER and DANIEL SMITH (carpenter) are hereby appointed commissioners to assess any damages caused by the extension of the railroad. 23 Mar 1839. 68. An act empowering the Lutheran Congregation of old Goshenhoppen church, in Upper Salford twp., in Montgomery county, to collect their outstanding debts. That JACOB H. REIF, JOHN DE TURK and SOLOMON HIGH, shall continue to as as directors of the Moravian school association in Berks county, until the next election. 25 Mar 1839. 69. An act to incorporate the president, managers, and company, of the Centerville and Donegal Clay Turnpike Road company, and for other purposes. That GEORGE HICE, (of WILLIAM HICE,) and EDWARD RILEY of Indiana county, and PAUL CLARK, WILLIAM HUSTON, JOHN MOORHEAD, JOHN CLIFFORD, NOAH MENDELL, ROBERT GRAHAM, S.P. CUMMINS, HENRY MARKER, KELIAN AMBROSE, JOHN CAMPBELL, and JOHN GAY, of Westmoreland county, are hereby appointed commissioners to locate a road beginning at the town of Centreville, Indiana county, thence by way of Ligoneer to Donegaltown, Westmoreland county. That WILLIAM S. HENRY's. 25 Mar 1839. 75. An act to authorize ISAAC KOONS, trustee, under the will of ANDREW THATCHER, late of the Northern Liberties, Philadelphia county, dec. to make sale of certain real estate. The Widow and surviving children of Andrew Thatcher, late of Northern Liberities, of the city of Philadelphia, dec. and THOMAS J. JONES, guardian of the minor children of MARY TAZEWELL dec. late MARY THATCHER, have represented that Andrew Thatcher, died seized of sundry lots and tenements in the Liberties and by his will he devised all the residue of his estate to EPHRAIM HAINS, JOHN C. BROWNE, and ROBERT WHITEHEAD, executors of his will, an directed them to make partition of the estate among his children, Mary Thatcher, MARGARET THATCHER, FLORANCE THATCHER, AMANDA THATCHER, and SAMUEL THATCHER, and directed the executors by deeds to convey to STEPHEN SIMMONS, several shares allotted his daughters in trust, for the use of his daughters during their natural lives, so that each shall receive income into their own hands free from debts or control of their husbands with full right of any of them to dispose by writing the income to any of their children. An act relative to state roads in the counties of Luzerne, Somerset, Monroe and Northampton. That BENJAMIN KIMMEL, ALEXANDER H. PHILSON ESQ., JACOB KIMMEL, (saw-miller) PETER MOWRY, PHILIP YODER, of Somerset county, are hereby appointed commissioners to lay out a state road from Stoystown, Somerset county, (in continuation of the state road, which terminates at that place) to Berlin. 26 Mar 1839. 84. An act to incorporate the Erie county Mutual Insurance Company. That JOHN A. TRACY, WILLIAM KELLY, PETER PIERCE, JULIUS W. HITCHCOCK, JAMES WILLIAMS, SMITH JACKSON, SAMUEL LOW, CONRAD BROWN JR., B.B. VINCENT, BESTER TOWN, JABEZ WIGHT, DAVID G. WEBBER and STEPHEN SKINNER shall be a corporation for the purpose of insuring their respective dwelling houses and other property against loss or damage by fire in the borough of Erie, Erie county. 26 Mar 1839. 85. An act repealing section of acts and an annulment. That the act for the laying out a state road from the borough of Orwigsburg, Schuylkill county, passing SAMUEL YOST's tavern, M'Keansburg, and DANIEL WEAVER's mill, to intersect the state road near GEORGE REAGAN's iron works, in Albany twp., Berks county, is hereby repealed. That WILLIAM BOCK, ABRAHAM ALBRIGHT, and PETER KLINE, commissioners to lay out said road be allowed to receive their respective per deim allowance and paid by said counties. That the marriage contract entered into by WILLIAM HAUSE and RACHEL G. HAUSE his wife, both of the city of Philadelphia, is hereby annulled and made void, and the parties released from all legal duties as fully as if they had never been joined in marriage. 26 Mar 1839. 88. An act changing the time of holding the August term of the courts, in the county of Wayne, and for other purposes. That the act passed 7 May 1832, making a turnpike from Honesdale, to the Delaware river, near the mouth of the Great Equinunk creek in Wayne county, is hereby revived and reenacted. HOMER BROOKS and THOMAS S. HOLMES, are hereby appointed commissioners in place of THOMAS T. HAYES and ALEXANDER CALDER, removed. The grand jury of York county, in Nov. 1834 recommended a grant of $1000.00 out of county funds, towards the erection of a bridge over the Conewago creek. A few individuals borrowed the above sum from GEORGE AUGHINBAUGH, and gave their obligation for the same, and the money was expended in the erection of the bridge and the commissioners do not feel justifiable in paying George Aughinbaugh. Therefore the commissioners of York county, are authorized if so borrowed for the use of the bridge, to pay the sum with lawful interest. 27 Mar 1839. 89. An act authorizing the sale of the real estate of ABRAHAM BARE, late of Chester county, dec. That the Register of Wills of Chester county, on 18 Apr 1837, granted the administration of Abraham Bare, Coventry Twp. dec. to ABRAHAM R. BARE and DAVID STRUNK, the same is declared valid to all intents and purposes as if Abraham Bare had died intestate. The proceedings in relation to the partition and valuation of the real estate are hereby declared valid. That Abraham R. Bare and David Strunk as per act passed 24 Feb 1834, are hereby authorized to sell the real estate as per the order of the orphans count 6 Nov 1837, and to make a good conveyance to the purchaser within 30 days of approval by court. The proceeds of all estate shall be distributed as if he had died intestate, securing shares for the widow and others entitled to distribution. That should the sale of the real estate previous to the session of the orphans court 29 Mar 1832, shall be approved if approved by one of the judges of the court. That should THOMAS BEECHLY, David Strunk, or Abraham R. Bare or MARY BEECHLY, or ANNA STRUNK in case they survive their husbands, that the portions shall be paid to the children entitled to the same after the death of their parents. If any of the parents are unable or refuse to give security, the portions of the children may be vested in trustees, but reserving to the parents the interest during their natural lives. That the whole of the shares of the proceeds of the real estate of Abraham Bare dec. to which Abraham R. Bare, Mary Beechly, and Anna Strunk, whould have been entitled had he died intestate, shall be paid to them absolutely, but the value of the portions of the minor children of them under the will of Abraham Bare dec. shall be ascertained by auditors and shall be deducted from the shares of their parents. 27 Mar 1839. 95. An act to incorporate the Bloody Run Turnpike Road Company, and for other purposes. That JAMES PIPER, THOMAS KING, CHRISTIAN SNIDER, SAMUEL H. SMITH, ALEXANDER W. KINNEY, DAVID COWEN, and HENRY FLUCK, of the county of Bedford, are hereby appointed commissioners to lay down an artificial road, from the town of Bloody Run, thence by Loysburg, Woodbury, and Maria forges, to a point near the tavern of WILLIAM LEAMERS, on the turnpike road leading from Hollidaysburg to Bedford. That ROBERT FALKNER and STEPHEN LITTLEFIELD, of Warren county, and RICHARD RENSHAW, ALONZO I. WILCOX, and WILPHALET COVILLE, of M'Kean county, are hereby appointed commissioners to locate a road from Warren, Warren county, to the mouth of West creek, M'Kean county, by way of Williamsville, and deliver a plot or draft to the commissioners of the county of M'Kean, for which they are to receive $2.00 per day. 27 Mar 1839. 99. An act to authorize the executors of LUCY SALTER, dec. to sell and convey certain real estate, and for other purposes. That JOHN SALTER, FRANCIS SALTER, of the county of Philadelphia, THOMAS L. WARTON, of the city of Philadelphia, executors of the last will and testament of Lucy Salter, late of Philadelphia county, dec. are hereby authorized to sell one undivided fourth part of the lot on Walnut st. between Delaware Fifth and Sixth St. Philadelphia, being the same property of which Lucy Salter died seized, and to execute a deed to the purchaser. An act relating to the trial of Bemus, and others in York county. That upon the voluntary surrender of NATHAN S. BEMUS, JACOB FORWOOD, EDWARD PRIGG and STEPHEN LEWIS to the court of quarter sessions of the peace, for the county of York, to answer certain bills of indictment for kidnaping, the judges are hereby authorized to take the several recognizances of them in the penalty of $1000.00 each, conditioned on his appearance and to abide by such final decision as shall be had. A written account of all the facts shall become part of the record in the form of a special verdict, including all questions touching the constitutionally of an act passed 25 Mar 1826, concerning parts of the constitution of the United States relative to fugitives from labor, and for the protection of free people of color, and to prevent kidnaping. Upon a finding the court shall if found in favor of the defendants, move to Supreme court at the next sitting, and if in favor of the commonwealth the court shall award sentence against the defendants. 22 May 1839. 102. FLEMING, JONATHAN KNEPPER, and DANIEL BAIRD, are hereby constituted a body corporate and politic, within the townships of Southampton and Greenville, Somerset county. 25 May 1839. 105. An act to incorporate the Anthracite Iron company. That HENRY HIGH, JOSEPH BAUGHMAN, JULIUS GUITEAU, FRANCIS C. LOWTHROP, and EDWARD L. TAYLOR, are hereby enacted into a body politic and corporate within the counties of Northampton, Lehigh, Luzerne, Columbia, Northumberland and Union in making iron ore from anthracite pig iron or bloom iron. 25 May 1839. 109. An act relative to estates and escheats, and to authorize the sale, conveyance and partition of sundry real estate of minor children and others. That DORSEY DAVIS and JANE DAVIS his wife, late JANE NICCOLLS of Westmoreland county, are hereby authorized to sell all the rights and title of Jane Davis, a minor, to two lots of ground in the town of Mount Pleasant, Westmoreland county, numbered in the plan, 8 & 9, with a blacksmith's shop and brick dwelling house, late the estate of her father JOHN NICCOLLS ESQ. dec. together with the right of her husband Dorsey Davis, and to execute a deed to the purchaser. That HENRY MYERS and WILLIAM L. GILLESPIE, guardians of the minor children of JOHN P. GILLESPIE, dec. late of Washington county, are hereby authorized to sell a lot of ground in the town of West Brownsville, and to make and execute a deed to the purchaser, as if the minors were of full age. Whereas, JOSEPH BALL, died intestate, in 1821, leaving a very large number (many thousand) of heirs at law, (some of whom take less than two dollars in ten thousand in his estate) residing in various parts of the commonwealth and in other states, many of whom are minors. At the time of his death, he was seized in different counties and as estates are rapidly depreciating and sinking by value by means of taxes and depredation, it is to the benefit of all to sell the lands Therefore, is shall be lawful for SAMUEL RICHARDS administrator, by public sale at Merchant's Exchange in the city of Philadelphia, to sell all the rights and title the deceased had in lands and other real estate, and conveyance to the purchasers. That in where the real estate may have been sold for taxes, or holds disputed title it shall be his duty to settle by law if necessary, to recover possession. The Orphans court shall appoint an auditor, whose duty shall be to ascertain and report the number and names of heirs and the proportion to which they are entitled. Before him the heirs may appear in person or by their attorneys, and make proof of their identity and then the administrator shall pay the heirs the amount awarded to them in the report. He is also to pay all agents or attorneys as may be needful for the care of the real estate, payment of taxes, investigating titles etc. and the administrator and auditor shall be allowed in the settlement of accounts such compensation as the circumstances may require. That LANE SCHOFIELD of the city of Philadelphia shall occupy for the term of seven years, free of rent, a house and lot, situate on Warren street, #8, lately the property of REBECCA SWAIM which has escheated to the commonwealth, information of which was given by Lane Schofield, and he shall keep the house in good repair at his own expense and shall also pay all taxes on the property. That the rights, and title which the commonwealth may have acquired as stated in act passed 31 Mar 1836, is hereby declared to be in the real estate of SARAH DESILVER dec. That the court of Philadelphia shall direct an issue wherein ABEDNEGO shall be plantiff and the legal representatives of REV. THOMAS J. KITTS defendant and try and determine the amount and value of real estate of Sarah Desilver, the amounts of the rents since her death to the 16 Apr 1838, deducting the moneys expended in repairs and costs, fees and charges and shall enter judgement in favor of the plaintiff for 1/5 part of the balance as the informers interest. Whereas JOHN PATTON ESQ. late Sheriff of Huntingdon county, dec. by virtue of a writ Aug. 1819 at the suit of the Huntingdon Bank, Indorsee of THOMAS JACKSON and DAVID STEWART against JOHN CANAN sold as the property of John Canan to ALEXANDER MCCONNELL ESQ. now dec. two tracts of land situate on Tussey's Mountain, in Porter Twp., one in the name of SUSANNAH LOWRISH, containing 300 acres, for the sum of fifty dollars, and the other in the name of RUDOLPH LOWRISH containing 50 acres for fifty seven dollars, for which John Patton made deeds to Alexander McConnell, but were not delivered, as Alexander McConnell refused to pay the purchase money and shortly afterwards died, and it is alleged that John Patton paid the purchase money to the plaintiff and for a number of years has paid the taxes on the lands. It is enacted that on satisfactory evidence the present sheriff of Huntingdon county is to execute and deliver a deed for the two tracts of land to the administrator of John Patton dec. That JOHN G. CONSER, JOHN WISE, and JONATHAN SPANGLER, are hereby authorized to grant, sell and convey a lot of ground purchased by the members of the Evangelical Church of Miles twp., Centre county, for the residence of the traveling preacher upon the Centre circuit, containing 5 acres, adjoining land of JOHN YOUNG, ADAM MARK, and others, where there is a house erected. The proceeds from the sale shall be re-invested and applied to the purchase of a house and lot of ground at a more suitable and convenient place on said circuit, for the residence of the traveling preacher. 4 Jun 1839. 110. That the trustees under the will of George Frey, late of Middletown, Dauphin county, dec., and the principal of the Orphan House, established by said will are hereby constituted a body politic and corporate, by the title of The Principal and Trustees of the Emaus Orphan House. An act to incorporate SAMUEL DALE for services rendered as an Associate Judge of Lancaster county, and for other purposes. While the court of common pleas, orphans court, of Lancaster county, was without a president judge, the duties were discharged by Samuel Dale, therefore, the sum of $500.00 si hereby granted to Samuel Dale as compensation for all extra services. That the state treasurer is hereby authorized to pay to GEORGE MICHAEL BLINTZINGER of York county, forty dollars immediately, as a gratuity, in full for his military services rendered during the revolutionary war. Whereas, mistakes occurred in the place of residence of JACOB KRICK, an old soldier. Therefore, the state treasurer is directed to pay to Jacob Krick, of Washington county, in the state of Maryland, the gratuity and annuity granted to him at this session, in the same manner as if no mistake had occurred. An act to authorize the administrators of HENRY MINEUM, late of Crawford county, dec. to sell and convey certain real estate, and for other purposes. That ISRAEL BERLIN and HENRY MINEUM, administrators of the estate of Henry Mineum, late of Woodcock Twp., Crawford Twp. dec. are hereby authorized to sell and convey all the real estate in Hayfield Twp., Crawford county, and to make and covey deeds to the purchasers. The administrators are hereby authorized to make and execute a deed of conveyance to SAMUEL KEIFER of Crawford county, for a lot situate in the town of Rockville, which deed shall have the same effect as executed by Henry Mineum, and the balance of the purchase shall be paid to the administrators. That JAMES SANGSTON, executor of the last will and testament of ISAAC SANGSTON, late of German township, Fayette county, dec. is hereby authorized to sell all the rights and title of the deceased in a tract of land situate in German twp. containing 104 acres and convey deed to the purchaser. That DAVID POTTS JR. of Warwick Furnace, Chester county, is authorized to sell as much of the lands held by the heirs of SAMUEL POTTS and JOANNA POTTS, attached to the furnace or exchange them for other lands, and to covey the same to the purchaser, and to pay over after the payment of debts unpaid, proportions to the several persons legally entitled to receive the proportion of the moneys to be invested, for the benefit of the minors. That is shall be lawful for the present or any future trustee of the real estate mentioned in the last will of DANIEL BICKLEY, late of Philadelphia, dec. wherein the beneficial interest for the separate use of his daughter ABBY ATKINSON TALLMAN, wife of JOSEPH V. TALLMAN, during the term of her natural life, to sell and convey real estate as directed by them. If Abby directs money from the sale is to be invested in trust for her separate use, during her life, in the purchase of a suitable dwelling house for the residence of herself and her family. Whereas JOHN CANWELL and GEORGE CANWELL, were the owners of two tracts of land as tenants in common, in the township of Luzerne in the county of Fayette, Pa., one tract of 80 acres, conveyed to them by PRETTIMAN CANWELL and wife, by deed dated 9 May 1827, one other tract of 62 acres and 15 perches, conveyed to them by the executors of WILLIAM CANWELL dec. by deed dated 9 May 1827. Whereas, JEHU CANWELL, the father of John and George, did by will, devise unto John his homestead farm, upon conditions that he, John should convey unto the heirs of George his undivided interest in the two tracts of land specified, that John accepted and took possession of the devise, but died without having executed the deed of conveyance to the heirs of George, as required under the provisions of the will. An act to provide for the repairs of several lines of canal and railroad, and to continue the improvements of the state. The canal commissioners are hereby directed to re-measure and re-estimate made by WILLIAM B. FOSTER and JAMES D. HARRIS, as engineers, of all work done on the North Branch extension of the Pa. canal, and by WILLIAM E. MORRIS and BENJAMIN AYERIGG, as engineers of all the work on the Sinnemahoning extension of the West Branch, and by JOHN P. BAILY and A.B. WARFORD, as engineers, all the work done on the Wisconisco feeder, where the contractors are dissatisfied. The amount of the estimates as returned by the engineers is to be paid immediately. 19 Jul 1839. 203. An act to incorporate the Mount Carmel Cemetery Company, in the county of Philadelphia. That JOHN RICHARDSON, JAMES S. PRINGLE, ROBERT BELL, WILLIAM L. NEWBOLD, EBENEZER MUSTIN, SANSOM W. TROTTER and WILLIAM A. BUDD are hereby declared a body corporate. This corporation shall be authorized to purchase the lot of ground on the north side of the Columbia railroad, bounded by the railroad, by Landing St., by Poplar St., by Minor St., and by Manor St. not exceeding 30 acres. 11 Oct 1839. 204. An act to incorporate the Mutual Insurance Association of Philadelphia. That JONATHAN PALMER, GEORGE MERRILL, JAMES T. FURNESS, GEORGE W. LORD, ABEL WYMAN, ISAAC R. SMITH, SOLOMON ALTER are hereby erected a body corporate and politic. The object of the corporation shall be to make insurance on dwelling houses, shops and other buildings, household furniture, merchandise and other property, against loss or damage by fire. An act for the improvement of the navigation of the Big Bushkill creek. That the sum of $5000.00 is hereby appropriated to the improvement of the navigation of the Big Bushkill creek, in the counties of Monroe and Pike, and GEORGE NYCE of Pike county, BARNEY DECKER and JEFFRY WELLS of Monroe county, are hereby appointed commissioners to expend the money on improvement, and shall account before the court of common pleas of Monroe county, for the moneys expended by them. 11 Oct 1839. 207. An act to incorporate the Penn Twp. Cemetery Association. Whereas, the practice of burying in the populous cities is deemed unhealthy to the inhabitants, and is becoming more objectionable, and more burdensome and expensive to the community, it is though expedient to make provision for the decent respect due the dead, that it may be free from the inconveniences mentioned, which are particularly onerous to the poor, and those in moderate circumstances. Several citizens have associated for the purpose of establishing a cemetery in Penn Twp., Philadelphia county, intending about 20 acres of land, lying on Turner's lane, now belonging to WILLIAM LLOYD, about 1/4 mile west from the Ridge turnpike. An act authorizing the laying out a state road from Centreville, a point in Greene county, near the Virginia State Line to the town of Amity, in Washington county, and for other purposes. JONES of the county of Greene, and DANIEL DARRAGH, of Washington county, are hereby appointed commissioners to view and lay out a state road from Centreville, a point in Greene county, near the Virginia state line, and thence to the town of Amity, in Washington county. That WILLIAM M'ALLISTER, WILLIAM ADAIR and JOHN FERGUSON, of Beaver county, are hereby appointed commissioners to review and lay out part of the Beaver and Mercer state road, lying between SAMUEL SMILEY's, in Beaver county, and the intersection with the Scrubgrass raod in Mercer county. That JOHN SNOW, CHESTER ANDREWS, HARRY ELLIS, ZALMON ROBINSON and SETH TAGGART are hereby appointed commissioners to view and locate a state road from Coudersport, in Potter county, to the New York state line near where it intersects the Genesse river. That JOHN MONTGOMERY, THOMAS WOOD, DANIEL BUCK of Lycoming county and MICHAEL READER, PHILIP DIMM of Northumberland county are hereby appointed commissioners to view, lay out and mark a state road from ABSALOM LEWIS', in Lycoming county, to LEONARD ROUB's, in Northumberland county. That JOHN GOOD and JOHN M. COLEMAN are hereby appointed additional commissioners to assist those already appointed, to lay out a continuation of the state road from Stoystown in Berlin, in Somerset county, leading from Ebensburg, Cambria county, to Stoystown in Somerset county. 6 Jan 1840. 212. An act to incorporate the Juniata Navigation Company. That JOSEPH MILLIKEN and E.L. BENEDICT of Mifflin county; JAMES ENTRIKEN, JOHN HENDERSON, ANDREW P. WILSON, THOMAS FISHER, JNO. G. MILES, JAMES GWINN and JONATHAN DORSEY, of Huntingdon county; and GEORGE M'KINNEY, GEORGE ROADS, THOMAS C. PIPER, GEORGE B. KAY, JOHN F. LOY and JOHN IRWIN of Bedford county are hereby appointed commissioners, for the purpose of making a canal and slack water navigation, from the mouth of the Raystown branch of the Juniata river, in Huntingdon county, to the bituminous coal region, near the mouth of Yellow creek in Bedford county. 18 Jan 1840. RESOLUTIONS R 5. Resolution authorizing MARY DONALD to change her name to MARY CONNELLY. That Mary Donald of the county of Westmoreland, is authorized to change her name to Mary Connelly. 9 Feb 1839. R 7. Resolution relative to the estate of the late JOHN NICHOLSON and PETER BAYNTON. That the secretary of the commonwealth is prohibited form making any deeds, releasing any of the estate of John Nicholson and Peter Baynton, which have been purchased and are now held by the commonwealth. All proceedings are suspended until otherwise ordered. 18 Feb 1839. R 10. Resolution relative to claims and for other purposes. Whereas SAMUEL CULBERTSON, JOHN DEVINNEY and DAVID WATSON, on the 10 Sep 1836, entered into a contract for building dam #5, on the Erie extension of the Pa. canal, that they progressed with the work and procured materials sufficient for the construction of the whole of the same. About 1 Jul 1837 they were directed to stop, without being paid the retained per centage or the loss sustained by them for material which they were compelled to leave upon the ground. Therefore, the canal commissioners are hereby authorized to settle with and pay Culbertson, Devinney and Watson the amount of retained per centage and any damages they may have sustained in consequence of the work having been discontinued. That THOMAS MAYBEN of the county of Westmoreland is hereby authorized to construct a dam over the Conemaugh river below the aqueduct at Lockport, of such height as he may find necessary to have a sufficient supply of water to his mill. 1 Mar 1839. R 11. Resolution to authorize the canal commissioners to inquire into and adjust the claim of PETER STEHMAN. That the canal commissioners are hereby authorized to inquire into the claim for damages sustained by Peter Stehman, transporter of merchandize on the Philadelphia and Columbia railroad, in consequence of the breaking of the rope on the inclined plane near Philadelphia, by which accident it is alleged his cars were broken and destroyed and to report the amount of damages, if any, and pay the same. 8 Mar 1839 R 16. Resolution for the relief of JOHN M'CARTY. That the auditor general is hereby empowered to audit and allow certain orders now held by John M'Carty, late brigade inspector of the second brigade, twelfth division of the Pa. Militia, issued in the years 1818, 19, 20, and 21, by Colonels MICHAEL DIVELY and PETER WILL, on JOHN PATTON, paymaster of the 13th regiment of Pa. militia. The same shall not exceed $280.25 with interest for 1 Jan 1822 and the same be paid. 16 Mar 1839. R 18. Resolution relative to the use of Anthracite Coal in Locomotive Steam Engines. Whereas, LEWIS TEESE has invented the model of a boiler for the purpose of burning anthracite coal in locomotive engines, the canal commissioners are hereby authorized to prepare an engine, for the purpose of testing the utility of his boiler, and if expedient to contract with PHILIP GARRETT, for the alteration and management of a portion of the power on the Philadelphia and Columbia railroad, provided the same can be done at a less cost than at present. 25 Mar 1839. R 19. Resolution authorizing the auditor general to settle and adjust the account of HUGH H. HENRY. That the auditor general is hereby authorized to settle the amount of costs legally due to HUGH H. HENRY, deputy escheater general for Bucks county, in the case of the alleged escheat of the estate of PENNBROKE S. STACKHOUSE late of said county, dec. 25 Mar 1839. R 20. Resolution authorizing the surveyor general to accept the survey of JONATHAN MILLER, in Somerset county. That the surveyor general is hereby authorized to accept the survey of Jonathan Miller, in Elklick Twp. Somerset county, in pursuance of a warrant dated 24 Mar 1836. 25 Mar 1839. R 21. Resolution authorizing the state treasurer to refund a certain sum of money to JOHN MILLS of Luzerne county. That the treasurer is hereby authorized to repay John Mills of Hanover, in the county of Luzerne the sum of $264.18 overpaid by him on a patent dated 10 Nov 1812 to enable him to apply the same to pay off liens, purchase money and fees due on lot #24 in first division patented 31 Jan 1812 and on part of a lot #25, certified to ESTHER THREADAWAY, now the property of John Mills. 25 Mar 1839. R 25. Resolution for the appointment of a commissioner to take charge of the Peninsula at the bay of Presque Isle. The period for which RUFUS S. REED was appointed commissioner of the Peninsula at the Bay of Presque Isle, on Lake Erie, by the resolution of the 8 Apr 1833 has expired, and whereas, the necessity of preventing trespass on said peninsula still exists, therefore, Rufus S. Reed, of the borough of Erie, Erie county, is hereby appointed as commissioner for five years. Whereas, JAMES BARTON, of Milford twp., Pike county, did introduce water into the town of Milford, at his own expense, and years later he is in bad health, has made a deed of trust of said property for the benefit of his wife and grandchildren, in the case of his death, and having recovered his health, is desirous of being reinstated in his rights as they existed before the deed of trust, and the water works are getting out of repair, and soon become useless, therefore, the deed is invalid, and James Barton, shall be considered owner and proprietor and have control over the same. 27 Mar 1839. R 26. Resolution to provide for the removal of the trial of an indictment pending in Court of Oyer and Terminer, Bucks county. That a certain indictment found in the court of oyer and terminer, of Bucks county, against THOMAS MITCHELL, STEPHEN H. TYNG, JACOB LEX, and ANDREW D. CASH, for a conspiracy & c. is hereby removed to the court of Montgomery for trial. 27 Mar 1839. R 29. Resolutions relative to sundry claims for damages. That the canal commissioners are hereby authorized to examine the claim of _____ SILL and ______ MATHERS, contractors on lock #16, on the Erie extension of the Pa. canal, for losses sustained by them in th construction of the work. Resolved that the canal commissioners are hereby authorised to settle the claim of SAMUEL COOPER for construction lock #11 and of A. WHITNEY and G. FIFIELD, contractors on lock #22 on Erie extension. That the canal commissioners are hereby authorized to enquire into the claim of damages sustained by JANE GASH, transporter of passengers on the Philadelphia and Columbia railroad, from Broad St. in the city of Philadelphia to the foot of the inclined plane, near the river Schuylkill, by the destruction of two horses and injury done to the car, caused by one of the engineers on 24 Oct 1838 and to report and pay damages. That the administrator of the estate of DAVID RAWHOUSER, late of Chanceford Twp., York county, dec. is empowered to settle and adjust with the Susquehanna canal company the claim of David Rawhouser against them by reason of the construction of the canal through and upon his property and if not able to settle to sue for said damages. The canal commissioners are hereby authorized to estimate all the work actually done by DIXON DAVIDSON and LEECH, on lock #15 on the Erie extension of the Pa. canal and if a mistake made to settle and adjust they find due the contractors. The Canal commissioners are hereby authorized to inquire into the claim for damages sustained by JAMES HERRINGTON, transporter of merchandize on the railroad, in consequence of the breaking of the rope on the inclined plane near Philadelphia, by which his car was injured and to report and pay said damages. The Canal commissioners are hereby authorized to examine the claim of JAMES STAMP, a contractor on the Portage railroad for losses alleged to have been sustained by him in the construction of said work, and to pay same. That the Canal commissioners are hereby authorized to settle and adjust the claim of CHARLES DE HASS, for services rendered as a civil engineer in the examination, remeasurement, and estimate of the work done by ISAAC KLECKNER and JAMES M'GEE, late contractors on the West Branch division of the Pa. canal in the erection of a dam across Bald Eagle creek, and the amount not exceed $150.00. That the canal commissioners are hereby required to examine into the claim of JOSEPH HOWETT, of the city of Lancaster, a transporter on the Philadelphia and Columbia railroad for damages sustained by him in consequence of the loss of a hogshead of whiskey, over the Valley creek, immediately after the destruction of the bridge over said stream, in the month of Apr 1838 and to pay the same. That the Engineer on the Coneaut, of the Erie extension of the Pa. canal is hereby authorized to estimate the item of hard pan wherever the same may have occurred or may occur on the 35th section of the line and allow to JOHN LAFFERTY and JAMES LAFFERTY the contractors whatever may be reasonably worth. It shall be the duty of the canal commissioners to re-examine the claim of the legal representatives of THOMAS M'QUOID, dec for damages sustained by the opening of Fourth St. in the borough of Harrisburg and if they he sustained damages over and beyond the appraisement already had for the appropriation of a lot of ground in Susquehanna Twp. Dauphin County, the same shall be paid out. 7 May 1839. R 35. Resolution authorizing the state treasurer to refund certain money to STEPHEN SHORES. Whereas, Stephen Shores, on 8 Apr 1835, paid the sum of ten dollars patent fees on a tract of land situate in Bradford county. And the same sum of ten dollars as patent fees on the same tract of land, was again paid by him and received through mistake on the 11 Jan 1837. Therefore, the treasurer is hereby authorized to pay to Stephen Shores the sum of ten dollars, with interest. 12 Jun 1839. R 36. Resolutions relative to the claims of PHILIP REITZEL and others. That the canal commissioners are hereby authorized to examine the accounts and claims of Philip Reitzel of Lancaster city, for wood delivered by him at Leaman's place, Lancaster county, per contract with the Philadelphia and Columbia railroad and used in the summer of 1838. That the canal commissioners are hereby authorized to examine into the claim of ROBERT MODERWELL of the city of Lancaster, a transporter on the Philadelphia and Columbia railroad, for damages sustained by him in consequence of the loss of a hogshead of molasses, whilst the same was being transported over the Valley creek, immediately after the destruction of the bridge over the stream, to pay damages, if any. That the canal commissioners are hereby required to examine the claim of JOSEPH HARNISH, of the county of Lancaster, for damages sustained by him in consequence of an accident happening on the inclined plane at Philadelphia, on the Columbia railroad, by which the cars laden with property belonging to the said Joseph Harnish, consisting of three hogsheads of whiskey, one barrel of Holland gin, and 68 barrels of flour, was precipitated down the inclined plane to the injury of the same, as well as the cars itself of which Joseph Harnish was also owner, and to pay the same. That the canal commissioners are hereby authorized to examine into and settle the claim of ABRAHAM BRUNNER JR. for any damage he may have sustained by the location of the West Branch canal through his lots in the town of Port Penn, in the county of Lycoming. That the auditor general is hereby authorized to settle the accounts of N.W. SAMPLE, late inspector of the second brigade, fourth division, Pa. militia, and to admit credits and allowances as deem just and proper. R 37. Resolution relative to the claims of HENRY HOOPS and others. That the canal commissioners are hereby authorized to examine the claim of Henry Hoops for 500 perches of stone taken from his quarry, and used in the construction of bridge #14 on section #50, on the Columbia and Philadelphia railroad and pay him. Also settle the claim of JOSHUA PUGH for stone and materials furnished by him for the Nanticoke dam. That the canal commissioners are hereby authorized to examine the claims of ______ CHAMBERLAIN, ________ MORRIMAN, and _______ LINTON, contractors on lock #24 and dam #4, on the Erie extension of the Pa. canal, and _____ LUSK, ______ MAYNARD, and ________ BROWN, contractors on locks #14 and #25, and HENRY N. LOWRY, contractor on section #37 and ____ LUSK and ______ CLOW, contracors on the aqueduct #2, and JAMES M'KEAN, contractor on section #30, and aqueduct #3, and WILLIAM SOWASH, contractor on section #6, for losses sustained. That the canal commissioners are hereby authorized to settle the claim of DANIEL BEMUS of Crawford county for damages which he sustained by the breaking of the French creek feeder dam and embankment, constructed on the east side of the pool of the dam. 14 Jun 1839. R 39. Resolution authorizing the clerk of the Orphan Court of Berks county to record certain papers in his office. That it shall be the duty of the judges of the court of common pleas of the county of Philadelphia, to ascertain what sum of money, would be a fair and equitable compensation to JOHN GEST, late register of wills, for his care, trouble and expense for having brought up neglected records, files, papers. 17 Jun 1839 R 40. Resolution relative to the claim of ALEXANDER JOHNSTON, and others. That the canal commissioners are hereby authorized to examine the claim of Alexander Johnston and allow him compensation as they think just. That the canal commissioners are hereby authorized to examine and adjust the claim of GEORGE KING, contractor of section 8, of the Erie extension of the Pa canal, so as to indemnify the contractor. That the canal commissioners are hereby authorized to examine and adjust the claim of DAVID HUTCHINSON and JAMES HUTCHINSON, contractors for the delivery of stone at lock #3, Ligonier line, Western division, Pa. canal, and pay them any balance due, for cutting, quarrying, delivering, and so forth. That it shall be the duty of the canal commissioners to examine what amount of damages have been sustained by JAMESON HARVEY, CALEB INMAN, JONAS HARTZELL, GEORGE SIVELLY, and GEORGE LAZARUS of Luzerne county, inthe overflow or injury of certain lands in Plymouth and Hanover townships, in said county, caused by the erection of the Nanticoke dam, on the North Branch of the Susquehanna river, and paid. 20 Jun 1839. R 46. Resolution relative to the payment of E.P. HUGHES for materials furnished for painting hall of house of representatives. That the state treasurer is hereby authorized to pay to E.P. HUGHES the sum of $110.26 for white lead, oil, turpentine and varnish, furnished for the use of the hall of the house of representatives the spring and summer of 1838. 24 Jun 1839. R 48. Resolution for the relief of the children of JOHN AUGUSTIN BOUSQUET, dec. Whereas, on the 11 Jan 1804, John Augustin Bousquet, of the city of Philadephia, merchant, did present his memorial setting forth that he was born in the village of St. Andre, in the department of St. Herautt, in France; came to the United States in Sep 1793, and being naturalized according to law, he had thereafter resided in the city of Philadelphia, and carried on business as a merchant. That soon after his arrival in America, he formed a connection upon principles of affection and confidence with REINE MARIA EUGENIA RENAUT, who was also a native of France, under an assurance that as soon as the approbation of his parents could be obtained, the marriage ceremony should sancitify their union. That a variety of circumstances occurred to postpone the accomplishment of this object, during which time the memorialist permitted Reine Maria Eugenia Renaut to bear his name. He treated her publicly in all respects as his wife, and became the father of three children, the last of whom prove fatal in its birth to the life of the unfortunate mother. That by the laws which prevailed in France, and which the memorialist imagined were on this subject in force in the United States, a natural child is rendered legitimate by the subsequent intermarriage of the parents, and thence arose the procrastination which he then deplored; but addressing himself to the authority he yet hoped to obtain for his offspring a legitimate character in society. That with such view he prayed that a law might be passed, declaring that for the reasons before stated his three children: LOUISA ADELE JOSEPHINA BOUSQUET, JOHN MARIA BOUSQUET, and JANE MARIA EUGENIA BOUSQUET should be entitled to all the rights and benefits of children born in lawful wedlock. A committee of the senate did report a bill to confer on the natural children of John Augustin Bousquet, the rights and benefits of children born in lawful wedlock on 20 Jan 1804 was passed and presented to the house of representatives where it was not passed. On 10 Sep 1837 John Augustin Bousquet died at Bordeaux in France and the said three children surviving him are residing in Philadelphia. Whereas the rejection of the bill concerning the three children is prejudicial to the said children, that nothing was intended to be affirmed or denied of the legitimacy or illigitimacy of the children, but their legal rights remained the same after as before the rejection of the law, and according to the laws of this commonwealth, reputation and co-habitation are sufficient evidence to establish a marriage and therefore to render legislative action nugatory. 25 Jun 1839. R 49. Resolution authorizing the erection of a building and other purposes. That the lien, right, title and claim of the commonwealth of Pa. to certain lots of ground in the borough of Huntingdon, Huntingdon county, in pursuance of a certain mortgage given by JOHN CADWALADER to the commissioners for the use of the commonwealth, dated 6 Aug 1793, recorded Book C, pg 253, of a certain mortgage given by STEPHEN DURRY dated 31 Aug 1793, Book C, pg 258, is hereby transferred and vested in the county of Huntingdon, for the use and purpose of building of a court house, and other necessary buildings. 25 Jun 1839. R 50. Resolution relative to the Election of County Treasurer in Fayette county. That all acts and things done by HUGH FELL, as register and recorder of Luzerne county, between the time of the death of MERITT SLOCUM, late register and recorder of the county, and the appointment and qualification of his successor, shall be deemed as legal and valid. 27 Jun 1839. R 55. Resolution relative to the claim of WILLIAM A. LLOYD, for services rendered as the commonwealth's agent, in discovering the lands late the estate of JOHN NICHOLSON and PETER BAYNTON, in which the commonwealth has a lien. That the State Treasurer is authorized to pay William A. Lloyd, $2500.00 on account of services rendered. That before such payment shall be made, William A. Lloyd shall deliver to the Secretary of the Land office, all papers and documents in his possession in relation to the estate. 4 Oct 1839. R 57. Resolution authorizing the settlement and payments of certificates or scrip, issued by JOHN FORSEMAN, late supervisor of the Delaware Division of the Pa. canal. That the canal commissioners are hereby authorized and required to settle and adjust the claims of all persons who hold certificates or scrip, issued by John Forseman. The sum required to be paid must not exceed $4500.00 and if that sum does not cover all the claims, the same shall be divided pro rata among them. 6 Jan 1840 FRS. R.
