A CRABB, Speaker of the House of Representatives JN. H. EWING, Speaker of the Senate 1. An act erecting a new township in Clinton County. That all that part of Limestone township (formerly in Lycoming county) which now, by the erection of Clinton county, is made part of Clinton County, and the same is hereby erected in a separate Twp. to be called Crawford, and also into a separate election district; and the general elections of the district shall be held at the house of PHILIP SHOWERS. 14 Jan 1841. 4. An act relating to the estates of FREDERICK HOLMAN and CHARLES WHARTON. Whereas, Frederick Holman of the township of Pikeland, (now West Pikeland) in the county of Chester, by his last will and testament, dated 9 May 1820, proved 13 Apr 1821, devised his real estate to his wife MARGARET HOLMAN during her widowhood or natural life in case she remained a widow, but if remarried or death the real estate was to be sold by his executors and the proceeds divided among his widow (if remarried), and children. Whereas, the parties in interest have contracted to make a sale of the real estate, but because Margarert Holman yet remains alive and unmarried, no authority exists to make a good deed of conveyance. Therefore, Margaret Holman and Frederick Holman, surviving executors of Frederick Holman, late of the township of Pikeland, Chester county, dec. are hereby authorized to sell and convey, and make a good deed to the purchaser to all intents and purposes as if Margaret Holman was deceased, or remarried. That the trustee of that part of the real estate of CHARLES WHARTON late of the city of Philadelphia, dec. which was devised by him in trust for his daughter HANNAH HOLLINGSWORTH, her husband and children, shall have power during the lives of Hannah and her present husband and of the survivor, to grant and convey all or any lots of ground, devised to any person, reserving a perpetual annual rent payable half-yearly, and redeemable within any number of years, not less then ten years after the conveyance, to be devised in trust for the use of Hannah Hollingsworth, her husband and children. 20 Jan 1841 5. An act to incorporate the Philadelphia and Havre-de-Grace Steam Tow Boat Company. That GIDEON SCULL, SAMUEL C. MORTON, JOHN M. KENNEDY, WILLIAM REYNOLDS, JAMES M. BOLTON, WILLIAM V. ANDERSON, JAMES S. NEWBOLD, ROBERT ALLEN, i. WATERMAN, ALLEN R. REEVES, WM. B. HART, NEWBERRY A. SMITH, PHILIP KELLY, SOLOMON ALTER, CALEB NEWBOLD, BENJAMIN M. BUNKER, JAMES BARRATT, HENRY BUDD, WILLIAM B. POTTS, DANIEL HADDOCK JR., WILLIAM S. SMITH, ARCHIBALD WRIGHT, ROBERT HOWELL, FRANCIS N. BUCK, JOSEPH HAND, N.B. THOMPSON, JOHN BROCK, and WATSON JENKS, and their associates, are hereby incorporated into a body politic and corporate, in deed and in law, by the name of "Philadelphia and Havre-de-Grace steam tow boat company," and as such to conduct a line or lines of barges and canal boats and steam boats, between the port of Philadelphia and any point on the Cheasapeake bay, in the state of Maryland and to purchase such estate as may be necessary. The capital stock $40,000.00 in shares of fifty dollars each. 1 Feb 1841. 11. An act to enable the heirs and representatives of OLIVER ORMSBY, late of Saint Clair Twp., Allegheny county, dec. to make partition of their estate. That the orphans' court of the county of Allegheny, is hereby authorized to make partition among the heirs of Oliver Ormsby, late of St. Clair Twp. of that portion only which is clear of dispute. They are also hereby authorized to make partition of all the portion is now in litigation which shall be adjudged to belong to the heirs. 10 Feb 1841. 12. An act for the relief of JOHN STEWART and others, soldiers and SARAH SEBRING and others, widows of soldiers of the revolutionary and Indian wars. That the state treasurer is hereby authorized to pay to John Stewart of Erie county, forty dollars as a gratuity in full for his services rendered during the Indian war. That the state treasurer is hereby authorized to pay to SARAH SEBRING, of Luzerne county, SARAH EARLE of Alleghey county, and MARIANNA SMITH of Northampton county, widows of soldiers of the revolutionary war, forty dollars each immediately, and an annuity of forty dollars each during life, payable half-yearly, to commence on the 1 Jan 1841. That the state treasurer is hereby authorized to pay unto ALEXANDER LONG of Beaver county, forty dollars immediately as a gratuity and in full for military services rendered during the Indian war. That the state treasurer is hereby authorized to pay to MARTHA HINTON and MARY KOKEN of Centre County, SUSANNAH MILLER of Montgomery county, JULIANNA REAM of Lancaster county and to RACHEL FELTON of Luzerne county, widows of soldiers of the revolutionary and Indian wars, forty dollars each immediately, and an annuity of forty dollars each during life, payable half yearly to commence on the 1 Jan 1841. That the state treasurer is hereby authorized to pay unto DAVID RANKIN of Jefferson county, forty dollars immediately, and an annuity of forty dollars during life, payable half yearly to commence on the 1 Jan 1841. That the state treasurer is hereby authorized to pay unto SUSANNAH WAND of Harford county, in the state of Maryland, forty dollars immediately, and an annuity of forty dollars during her life, paid half yearly to commence on 1 Jan 1841. 10 Feb 1841. 13. An act authorizing the rector and others of Trinity Church in the district of Southwark to sell certain real estate. The rector, church wardens and vestry men of Trinity church in the district of Southwark, are hereby authorized to sell a certain lot and building thereon erected between Washington and Carpenter sts. at the corner of the Presbyterian burial ground, bordered by JAMES PAUL, and to convey a good deed to the purchaser, subject to a ground rent of thirty six dollars per annum payable to THOMAS MITCHELL for the use of the female Sunday school society and the proceeds of the sale be used to defray the cost of building and furnishing the new school house in the rear of Trinity church. 10 Feb 1841. 16. An act relative to the claim of JOHN SLAYMAKER. That the canal commissioners are hereby authorized to examine the situation and condition of the barn of John Slaymaker situate in Lancaster county, and within a few feet of the railroad, and if in danger of being destroyed by fire from the locomotives, and if it cannot be prevented they shall cause the barn to be moved as will secure it from the danger of being burned, or pay the proprietor such sum of money as will be adequate compensation to him for removing or securing the same. 15 Feb 1841. 20. An act to incorporate the Fourth Mountain Coal and Railroad Company. That THOMAS BAIRD, GEORGE RICHARDS, SAMUEL F. HEADLEY, THOMAS M. O'BRIEN and MARK RICHARDS are hereby constituted a body politic and corporate by the name, style and title of the Fourth mountain coal and railroad company for the transaction of business in the mining, of coal, transporting and selling the same, construction of railroads and shall have all the rights and privileges of the Bradford railroad and coal company subject to restrictions imposed by act passed 28 May 1840. Located in Schuylkill county, Pines Grove and Williams Valley twps. 20 Feb 1841. 21. An act authorizing the canal commissioners to contract with MILO ADAMS and SAMUEL P. ADAMS for water privileges. That the canal commissioners are hereby authorized to contract with Milo Adams of the city of Pittsburg, and Samuel P. Adams of the county of Beaver, to construct a substantial race-way and gate on the western side of dam #4 on the Beaver division of the Pa. canal for he purpose of drawing off and using the surplus water at the dam. That Milo Adams and Samuel P. Adams shall in consideration of the privilege of using the surplus water release to the commonwealth all claim for damages sustained by them in the construction of dam #4 and pay such further consideration semi-annully to the commissioners as shall be agreed upon for use of the surplus water. 20 Feb 1841. 22. An act relating to the real estates of DAVID WOELPER and MARY PENTLAND dec. That in all cases where the executors of the last will and testament of David Woelper, late of the district of Spring Garden, in the county of Philadelphia, victualler, dec. have purchased real estate against which they had claims, in order to prevent greater loss to the estate, the same are hereby confirmed and made good and valid. And it shall be lawful for the executors whenever in their sound judgement they believe it to be for the benefit of the estate to purchase other real estate, but always for the same use and purposes. They are hereby authorized to sell and dispose of all real estate and to make and execute deeds of conveyance to the purchasers. Whereas, WILLIAM PENTLAND of the city of Pittsburg, by his intermarriage with MARY WATSON, became seized in right of the Mary of a certain real estate, consisting in the most part of unimproved lots in and about the city. William, did with full knowledge and assent of his wife, incur a large debt in the erection of certain buildings on a portion of the property lying within the city. Mary hath since died, leaving issue one child, ANDREW W. PENTLAND, a minor and without any provision made for the payment of the debt. Therefore, William Portland is hereby authorized to sell and dispose of as much of the unimproved property real estate of the minor as may be required to discharge the debts, provided the same not exceed the sum of $8500.00. 23 Feb 1841. 23. An act to authorize CHARLES S. BRADFORD trustee of MARY M. BRACKENRIDGE of the city of Allegheny, to sell and convey a certain ground rent. That Charles S. Bradford of the city of Pittsburg, trustee for Mary M. Brackenridge, wife of ALEXANDER BRACKENRIDGE, of the city of Allegheny, and for the children of Alexander and Mary is hereby authorized to sell and convey, with the consent of Mary, a certain annual ground rent of $150.00 charged on a part of lot #408 in Wood's plan of Pittsburg and invest the proceeds in real estate or securities for the same uses as the ground rent was held. 25 Feb 1841. 25. An act to authorize the auditor general to issue certificates of State stock to SAMUEL CORRIE and JAMES CORRIE. That it shall be lawful for the auditor general to issue new certificates of debt of this commonwealth, to Samuel Corrie and James Corrie, for their share of a certificate formerly issued and numbered 2086 of the state five per cent stock, redeemable in 1853 in lieu of said certificate #2086, on satisfactory proof being made that such certificate is of record in the court of the Island of Trinidad and they have an interest in the same and are entitled to a share. 26 Feb 1841. 26. A supplement to an act for the regulation of the Militia. That the enrolled militia attached to the 39th and 113th regiments, first brigade, eleventh division, Pa. militia residing within the following bounds, shall hereafter compose a separate battalion, to be called the third battalion of the 113th regiment, commencing at Gibson's mill, thence along the Sherman's Creek to Billows bridge, thence to the Methodist church near Albright's, thence across Dick's hill, to the state road near WILLIAM CAMPBELL's, thence across Mochanoy to Caroline furnace, thence up the Juniata river to the mouth of the Big Buffalo creek, thence up the creek to the house of JOHN SMITH JR., near Milford, thence to the raod leading from Milford to Racoon, thence along the road to Donnelly's saw mill, thence up Racoon hill to the Saville township line, thence along the township line to JACOB BURD's land on Middle ridge, thence to the Centre township line to ABRAHAM KISTLER's, thence along said line to M'Cord's saw mill, thence down the run to the place of beginning, and that said Battalion shall meet in the borough of Bloomfield in Perry county. 26 Feb 1841. 29. An act to provide for the erection of a house for the employment and support of the Poor, in the county of Lycoming. That JOSEPH GRAFIUS (tinner), CHARLES LLOYD, EDWARD G. LYON, NICHOLAS FUNSTON, JOHN BENNETT JR., WILLIAM PIATT JR., GEORGE CRANE, SAMUEL STEWART, BENJAMIN TOMB, WILLIAM COX ELLIS, JOHN THOMAS, WILLIAM A. PETRIKIN, JOHN H. COWDEN and ABRAHAM UPDEGRAFF, are hereby appointed commissioners, whose duty shall be on or before the 1 Aug 1843 to determine upon and purchase such real estate as they shall deem necessary for the accommodation of the poor of Lycoming county. etc. 27 Feb 1841. 31. An act to enable WILLIAM PRICE and HENRY MCLAUGHLIN, JR., to sell certain real estate. That JOHN MCLAUGHLIN and CATHARINE MCLAUGHLIN, both now deceased, were seized of a farm situate partly in Franklin county, Pa. and partly in Washington County, Maryland, one portion being the estate of John and the other portion the estate of Catharine. And whereas, the farm is now vested in their children, John's by descent, and Catharine's by devise. By a decree of Washington Co. Md. William Price and Henry McLaughlin Jr. have been appointed trustees to sell and convey that part of the farm which lies in the state of Md. Therefore, William Price and Henry McLaughlin Jr. are hereby empowered to sell and convey the portion of estate which lies in Franklin Co. Pa. 3 Mar 1841. 36. An act regulating election districts, and for other purposes. That the township of Upper Providence in the county of Delaware, shall hereafter be a separate election district and the qualified voters thereof shall hold their general elections at the public house of GEORGE CUMMINS in said township. That the qualified voters of the township of Richhill, in the county of Greene, shall hereafter hold their general elections at the house of JOHN LANEY, in the town of Jacksonville, in said township. That the qualified voters of Lower Towamenaing Twp. in the county of Northampton, shall hereafter hosd their general and township elections at the house now occupied by JOHN A. ZEIGENFUSS. That the qualified voters of the township of York, in the county of York, shall hereafter hold their general elections in the house of SUSAN INNERST. That the qualified voters of the township of Madison, in the county of Armstrong, shall hereafter hold their general election at the house of SAMUEL BALLSECKERS. That the townships of Byberry and Mooreland, in the county of Philadelphia, shall hereafter be a separate election district, and the qualified voters shall hold their general elections at the public house now occupied by ABNER WORTHINGTON in Somerton. That the borough of South Easton in the county of Northampton, shall hereafter be a separate election district, and the qualified voters thereof shall hold their borough and general elections at the public house of DAVID MAYOR. That the qualified voters of Ridgebury township in the county of Bardford, shall hereafter hold their general elections at the house of LEONARD PIERCE. That such of the qualified electors of the township of Bethlehem in the county of Northampton, who are now authorized to vote at the public house of GEORGE ATHERTON, in the town of Bethlehem, are hereby authorized to vote at the public house JACOB FREEMAN, in said town. The judges of each township election for township officers shall meet within 24 hours after each election at the public house of PETER LAWALL, and add up the votes given. That the qualified voters of the Pleasant Unity general election district, in the county of Westmoreland shall hold their general elections in the brick mansion house of WILLIAM FISHER, in the village of Pleasant Unity. The township of Union, in the county of Adams, the Seventeenth district, qualified voters shall hold their general election at the house of ENOCH LEFEVER. That the qualified voters in the township of Buck, in the county of Luzerne, shall hold their general elections at the public house of CHARLES L. TERWILLIGEN. That the qualified voters of the township of Doylestown, in the county of Bucks, shall hold their general elections at the public house of THOMAS STEVENS. That the 59th section of an act dated 14 Apr 1840 is hereby repealed. Somuch of West township, in the county of Huntingdon, bounded by TOBIAS COFFMAN's farm, farm of MACHAEL MAGUIRE, is hereby annexed to Porter Twp. The qualified electors of Southampton Twp. Bedford county, shall hold their general and township elections at the house of ABEL JOHNSTON. The qualified electors of Liberty Twp. Columbia county, shall hold their general and township elections at the house of HUGH MCELRATH in Moorsesburg. That part of the townships of Napier and Londonderry, in the county of Bedford, as is bounded by JOHN KINTON's, JOHN MOURY's farm, JOHN KELLY's farm, ADAM SMITH's farm, JOHN KILLERMAN's house, excluding JACOB G. DEVORE, and all general elections shall be held at the school house west of JOHN METZGERS. The township of Milford, in the county of Juniata is hereby erected into two election districts bounded by GEORGE ROBERTSON with general elections held at the school house near P. M'KENNAN. The other part, West Milford, will hold general elections at the school hose near JACOB BUSHEY. The township of Carrol, in the county of Cambria, will hold their general and township elections at the house of JACOB SHABACKER SR. That the qualified voters of the township of Susquehanna in Cambria county, shall hold their general and township elections at the house of MATTHEW CONRAD. The qualified electors of the township of Union, in the county of Schuylkill, shall hold their general and township elections elections at the new house now occupied by JOHN EISENHOWER. That the electors of the north ward, in the borough of Pottsville, Schuylkill county, and that part of Norwegian twp. connected shall hold their general election at the house of NATHANIEL I. MILES. The qualified electors of Porter township, in Clinton county, shall hold their elections at the house of ARNOLD CUSTARD. And qualified electors of the township of Lamar, shall hold their elections at the house of THOMAS PROCKTER. That the qualified electors of Fannet township, Franklin county will hold their elections in the same place as last year, and the judges shall meet withing 24 hours at the house of THOMAS TAYLOR and add up the votes. That general and special elections be held at the house occupied by CHARLES SMITH in the township of Lenox, in the county of Susquehanna. 5 Mar 1841. 38. An act relative to the estates of THOMAS PALMER and JAMES CORNISH, dec. and for other purposes. Whereas, JACOB KERN, administrator of the good and chattles of GEORGE PALMER, late of the county of Northampton, dec. did under color of an act passed 6 Apr 1833, sell and convey unto ABRAHAM IREDELL, since also deceased, a certain tract of land situate in the township of Horsham in the county of Montgomery, containing 190 acres. Whereas, the tract of land was not unimproved and therefore not subject to the control and disposition of Jacob Kern and all the heirs of George Palmer with the exception of the children of Thomas Palmer, dec. who are yet minors. Therefore, the guardian of the estates of the minor children of Thomas Palmer, who was one of the heirs of George Palmer, are hereby authorized to execute to the administrators of Abraham Iredell, dec. a release of interests of the minors, in the tract of land aforesaid sold and conveyed by Jacob Kern, unto Abraham Iredell in his lifetime, provided the heirs of George Palmer who are of full age, shall execute like releases on their part. Whereas, James Cornish, late of the city of Philadelphia dec. did by his last will and testament, dated 19 Jun 1829, devise unto his son HENRY CORNISH, in trust, for the sole and separate use of his daughter SARAH BROOKS, for and during the term of her natural life, with remainder over to the children of Sarah, surviving, and to the issue of children as may be dead, a certain ground rent of 34 dollars per annum, payable half yearly, issued out of a certain lot of ground situate on west side of Baron St. In consequence of non payment of ground rent, and the lot being unimproved and unproductive, and support of Sarah and her children will be frustrated unless means are provided for the improvement of the same. Therefore, the trustee of Sarah Brooks and her children, is hereby authorized, with the assent of Sarah, in writing, to raise, by way of mortgage upon the said premises, a sum not exceeding $2000.00 That ROBERT H. LAIRD, JACOB GUNDY, WILLIAM PERRY, SAMUEL ZELLER, PHILIP FREDERICK and SAMUEL H. LAIRD, school directors of East Buffalo Twp. in the county of Union, are hereby authorized to execute a deed of conveyance to THOMAS PENNY of all that certain piece of land with the appurtenances, bounded by MATTHIAS MCPHERSON, JAMES JENKIN, PETER EPLER, allowed to be 35 rods being the premises conveyed to JOHN SNOOK and ELIZA SNOOK his wife, by deed dated 25 Oct 1813 unto certain persons in trust for a school or meeting house and afterwards sold at public auction, on 22 Feb 1840 to Thomas Penny, for the sum of $840.00. That MALLACHIA SUTTON, the surviving trustee of MARTHA SUTTON and her children, is hereby authorized to sell and convey a certain inlot, together with the appurtenances, situated in the borough of Indiana, in the county of Indiana, it being the same premises which PETER SUTTON dec. by his last will and testament devised to THOMAS SUTTON, now deceased, and Mallachia Sutton, in trust for the sole use and benefit of Martha Sutton, wife of Peter Sutton, for and during her natural life, and after her death to her children, and to re-invest the proceeds in real estate, upon the same uses and trusts as the premises are now held. 12 Mar 1841. 39. An act authorizing the Governor to incorporate the Holidaysburg Water Company. That C. GARBER, G.L. LLOYD, M.C. GARBER, JAMES COFFEE, J.C. MCCLANAHAN, GEORGE R. MCFARLANE, WILLIAM WILLIAMS, JOHN WALKER, HENRY KING, THOMAS B. MOORE, JEREMIAH CUNNINGHAM, N. HEWET, A. MCCORMICK and JAMES GARDNER, are hereby appointed commissioners, who any five of them are hereby authorized to and perform the several matters and things hereinafter mentioned, etc. 12 Mar 1841. 44. An act to incorporate the Diamond Coal Company, and for other purposes. That WILLIAM A. BUDD, THOMAS A. BUDD, THOMAS BELL, ADAM SHOEMAKER, EDWARD L. TAYLOR, GEORGE WARDER associates, successors and assigns, are hereby constituted a body politic and corporate, by the name of Diamond Coal Company. etc. 19 Mar 1841. 48. An act to incorporate the Lancaster County Mutual Ins. Co. That THOMAS G. HENDERSON, SAMUEL DUFFIELD, WILLIAM NOBLE, HENRY F. SLAYMAKER, FERREE BRINTON, HENRY ECKERT, CHRISTIAN UMBLE, JAMES G. HENDERSON and WILLIAM HENDERSON, shall be and are hereby constituted and declared a body politic and corporate, by the name, style, and title of Lancaster County Mutual Ins. Co. etc. 19 Mar 1841. 51. An act granting compensation to JOHN KOONS for certain lands situate in the townships of Huntington and Salem, two of the seventeen townships certified to Connecticut claimants, in the county of Luzerne. That if John Koons require it, the board of property shall examine into his title to a tract of land, situated, partly in Huntiondon Twp., one of the seventeen twps. in the county of Luzerne surveyed to JESSE SCOTT on 17 Aug 1793 in pursuance of his warrant dated 7 Jun 1793 and patented the 19 Feb 1794, the other surveyed to LEWIS RICHARDS on his warrant granted 7 Jun 1793 and patented the 18 Feb 1794, and if the board shall find the lands have been certified, or are contained within the boundaries of the lands certified to Connencicut settlers under the provisions of the act and that John Koons was fully entitled to the tracts of land except as against the certificate granted to Connecticut settlers, they shall ascertain the amount of the purchase money and the state treasurer shall pay the amount, provided John Koons shall release all right, title he has in the land aforesaid, except parts included in two certificates for lots #5 & #6, third division, of Huntingdon Twp, containing together 184 acres and 79 perches. 23 Mar 1841 55. An act laying out and locating a State Road from Hollidaysburg, in Huntingdon county, to the Cherry Tree on the Susquehanna river in Indiana county, and for other purposes. That PETER HEWIT and ELIAS BAKER of Huntingdon county, HENRY J. MAGUIRE, ROBERT CRESSWELL and JAMES ROSS of Cambria county, and HETH F. CAMP of Indiana county, or any three of them are hereby appointed commissioners to view and lay out a state road, from Hollidaysburg, to Cherry Tree, being a corner of the counties of Cambria, Clearfield, and Indiana. etc. 27 Mar 1841. 56. An act relating to certain Public Roads, Bridges and other purposes. That WILLIAM LAIRD and MICHAEL R. HAYMAKER, of Westmoreland county and GEORGE GRAY of Allegheny county, are hereby appointed commissioners to review and relocate a state road authorized 16 Apr 1838. That ADAM BOWMAN and JOHN REED, of Westmoreland county, and WILLIAM MAJUNKIN of Allegheny county, are hereby appointed commissioners to view, lay out and mark a state road, beginning at Saltsburg, in Indiana county, thence by way of North Washington, to intersect the state road leading from Kittanning to East Liberty, at or near the late residence of JAMES LOGAN, in Allegheny county. That WILLIAM CHAMBERS SR. and JESSE CLEMMENTS of Westmoreland county, and WILLIAM COWAN of Allegheny county, are hereby appointed commissioners to view, lay out, and mark a state road from the town of Warren, in Armstrong county, by way of North Washington, to Plum Creek meeting house in Allegheny county. 27 Mar 1841. 60. An act authorizing GATES WILCOX, WILLIAM PERRY, and others, to erect a wing dam in the West Branch of the Susquehanna River. That Gates Wilcox, William Perry, RICHARD COCHRAN, ANDREW COCHRAN and JOHN D. BEERS, and their associates are hereby authorized to erect a dam across the west branch of the Susquehanna river in Loyalsock and Clinton Twp. Lycoming county, extending from the upper end of Hepburn's Island to the southern shore of the river, not exceeding 2 feet in height, for the purpose of supplying their mills with an additional quantity of water, it construction is not to obstruct or impede navigation of the river. 29 Mar 1841. 62. An act to annul the marriage contract of ELIPHALET THOMPSON with PHEBE THOMPSON his wife. An act relative to the claims of Royer and Schmucker, for damages sustained on the Frankstown branch of the Juniata river, by the construction of the Pa. Canal and for other purposes. That the canal commissioners are hereby authorized to examine the claim of JOHN ROYER and GEORGE SCHMUCKER, doing business under the firm of Royer and Schmucker, for damages done to Cove Forge and other property belonging to them on the Frankstown branch of the Juniata river, by reason of construction of the Pa. canal, taking into consideration advantages derived by them from the same, and the damages sustained by the freshet in June 1838 and to award the sum they are entitled to. That the canal commissioners are hereby authorized to settle the claim of GEORGE D. FOREMAN, for compensation for building locks #1 and #10 of the Erie Extension of the Pa. canal. That the injury shall not extend beyond the claim for stone quarried, and alleged to have been suitable for the purpose which he was not permitted to use, and which afterwards were used by the Commonwealth, and for alteration in his contract. That there shall be established in the borough of Bedford, in the county of Bedford, an academy or public school for the education of youth in the English and other languages, and in the useful arts, sciences and literature. An act concerning a dam in the river Susquehanna and other purposes. That HENRY ETTER of York county, is hereby authorized to construct or erect a wing dam in the river Susquehanna, from the property owned by Etter on Hill Island, at the Swatara Ripples in the county of Dauphin, to use the water for manufacturing purposes, provided, no impediment or obstruction to the navigation of the river Susquehanna, shall be created. That HENRY ALTER of Allegheny county and J.M. LAIRD and WILLIAM GRIER of Westmoreland county are hereby authorized to view and lay out a state road, commencing Logan's ferry, in the county of Allegheny, thence to the German meeting house, on the farm of JOHN BEEMER, thence by Murraysville to intersect the new graded road from Greensburg, Westmoreland county to Chalfants on Turtle creek, at or near the farm of MR. REMERY, five miles west of Gennsburg. That the time for completing the location and survey of a state road from Ebensburg to Punxatawny authorized by the act dated 12 Jun 1840 is hereby extended for one year and STEPHEN LLOYD, JOHN B. An act for the relief of JOHN FISSLER, of Chester county, and for other purposes. That the canal commissioners are hereby authorized to inquire into the claim of John Fissler, for damages and loss of his cars, occasioned by the breaking of a rope on the Schuylkill Inclined Plane, and if they find damages to pay the same. Whereas WILLIAM M. HART, sometime in the fall of the year 1836, had a horse belonging to him killed, by falling through a farm bridge over the North Branch Division of the Pa. canal, the planks over which had been removed therefrom by order of the superintendent of that line of canal, to be used in repairing a breach in the public works, and the said bridge temporarily covered, so slighty and imperfectly that by reason thereof the horse in crossing broke through, fell into the canal and was killed, causing loss in the actual value of the horse and by loss of employment occasioned by this loss. Therefore, the canal commissioners are hereby authorized to draw their warrant in favor of William M. Hart for the sum of $90.00 in full of all claims upon the Commonwealth. 21 Apr 1841. 99. CONYUGHAM, executor of the last will and testament of ELEANOR M'CALL, late of the city of Philadephia, dec. and JOSEPH SWIFT, executor of the last will and testament of MARY M'CALL, late of the same city, dec. We do hereby certify that the above bill was presented to the Governor on the 16 Apr 1841 and was not returned within ten days after it had been presented to him, wherefore, it has become a law in like manner as if he had signed it. An act authorizing the erection of an Academy for the use of the Sumneytown Society for the advancement of Literature, in Montgomery County. Whereas, an act passed 10 Feb 1817 provided that PHILIP REED and HENRY SNYDER, shall have full power to recover from the commissioners of Sumneytown school house lottery, the surplus money and appropriate it to the erection of a dwelling house for a teacher, on the same lot which GENERAL DANIEL HIESTER granted to the citizens for school purposes. Whereas, the school house on the premises is in such a state of dilapidation and decay as to reder it unfit for school purposes, therefore, teh unexpended surplus shall be expended for the uses and trusts under the direction of a building committee, consisting of three corporators: NATHANIEL JACOBY, SOLOMON ARDMAN and JOHN D. An act to confer on ELIZABETH MCGUIRE, JOHN MCGUIRE, and HENRY MCGUIRE, AUGUSTUS BOYLE and MARIA MAYBERRY, the rights and benefits of children born in lawful wedlock, and for other purposes. That MARY JONES, late of the township of West Brunswick, in the county of Schuylkill, lately died intestate, leaving a small estate and five illegitimate children, named Elizabeth McGuire, John Mcquire, Henry McGuire, Augustus Boyle and Maria Mayberry, some of whom are still in their minority and may become chargabel to the county of Schuylkill. Whereas, it is just and proper that whatever estate was left by the mother, should be appropriated to the support and education of the children. Therefore, the said children, shall be entitled to inherit all the estate of Mary Jones, dec. as fully as though they were born of her body in lawful wedlock. Whereas CHRISTOPHER FORD and JANE FORD his wife, executed a deed to JAMES M'NAMARA JR., a certain tract of land called "arcadia" situated in Woodbury twp. Bedford County, but now in Greenwood Twp. containing 172 1/2 acres for which a patent was granted to Christopher Ford dated 1 Dec 1796, which said deed was acknowledged by the said grantees before AMOS KELLOGG, a justice of the peace of Ashtabula county, in the state of Ohio on 7 Jun 1817, but by the laws of Pa. then in force, Amos Kellogg had no authority to receive the acknowledgment of said deed, and the subscribing witnesses to the deed cannot be found. TAYLOR, and JAMES MILLENGAR, of Allegheny county are hereby authorized to open books at the house of JAMES CRESSAN for the subscription of the capital stock of said company. 31 May 1841. 145. An act for the relief of WILLIAM STEWART, late a contractor on the Erie extension of the Pa. canal, and for other purposes. That the canal commissioners shall examine the claim of William Stewart, contractor for dam #1 and lock #10, on the Erie extension of the Pa. canal, and allow him for any loss he may have sustained in the erection of the dam, by reason of a change in the original contract. The commissioners are also required to examine the claims of JOHN EMERY and sons, contractors for Section #2, on the Erie extension, and allow them for any loss they may have sustained by reason of any change made by the engineer in the location. That JOHN GILPIN, JAMES E. BROWN, WILLIAM F. An act to incorporate a company for making a road from the Mongongahela and Coal Hill turnpike, near the top of Coal Hill, in the county of Allegheny, towards Canansburg, in the county of Washington, and for other purposes. That JOHN GILFILLAN, JAMES ESPY, THOMAS BLACKMORE, JOHN MURRY, JOHN PATTERSON, and CHARLES KING, of the county of Allegheny, JOHN BOWERS, ALEXANDER M'CONNELL, JAMES POLLOCK and ENOCH WRIGHT of the county of Washington, are hereby appointed commissioners. Whereas, ABEL HALL and GEORGE COSNER of the county of Luzerne, were severally convicted many years ago, of petty larceny, and Abel Hall was sentenced by the court of quarter sessions of the said county, to undergo an imprisonment of ten days in the county jail; and George Cosner was sentenced by the same court to pay a fine of fifty cents to the Commonwealth. And whereas, Abel and George since then, have been orderly and well disposed persons. Therefore, after the passage of this act Abel Hall and George Cosner are restored to citizenship, and shall enjoy all the privileges and immunities of any citizen of this Commonwealth. That the time prescribed prescribed by the fourth section of an act dated 22 May 1839, for the issuing of a writ of error from the supreme court of the United States, the same is hereby extended until 1 Feb 1841. 9 Jan 1841. 2. Resolution relative to the claim of JOHN WHITE and company, and others. That the state treasurer pay out unto John White and company, and unto Bingham & Brothers, and unto Craig, Bellas and company the amount awarded 28 Mar 1840. 21 Jan 1841. 7. Resolution relative to the claim of PHILIP SULLIVAN, DAVID H. LOCHARD and FRANKLN STRATTON. Whereas, Philip Sullivan, late a contractor for section 62, on the Tunkhannock line of the North Branch canal, has suffered great loss in consequence of coming in contact with an item of work not embraced in his article of agreement, to wit: a solid cemented gravel, usually called hardpan, as difficult to excavate as rock itself, and could only be removed at great labor and expense, nearly or quite double that for which common earth could be removed, therefore, the canal commissioners are hereby authorized and allow his such sum as shall appear just and equitable with regards to the terms of his original contract. That the canal commissioners are hereby authorized to examine the claim of David H. Lochart, a contractor on the French Creek division, and to ascertain whether Lochart sustained any damages in his contract for the construction of lock number 7, in consequence of the closing of the gates of lock #8 on said division, against the consent of Lochart, and to make a fair adjudication. Whereas, a resolution passed 1 Apr 1836, authorized the canal commissioners to adjust and settle the claim of Franklin Straton, a contractor on the French Creek division of the Pa. canal. A balance of $1075.00 was found justly due Stratton, therefore, the state treasurer is hereby required to pay the amount found due Franklin Stratton. 5 Mar 1841. 11. Resolution relative to the account of JOSEPH MOSHER. That the auditor general is hereby authorized in the settlement of the account of Joseph Mosher, superintendent of the road to avoid the inclined plane at Columbia, to allow him a credit for interest paid by him on a contract made with A.G. RALSTON and company, on 25 Sep 1838, for the purchase of railroad iron, spikes and chairs. 13 Apr 1841. 15. Resolution for the relief of JOHN DOLL, of Lehigh county. That the state treasurer is hereby authorized to pay to JOHN LICHTENWALTER, of Upper Macungie, Lehigh county, in trust for John Doll the annuity to which he is entitled in the act of 5 Mar 1828, and so much of the act directed the payment to JOHN FOGEL or SOLOMON FOGEL is hereby repealed.
