PORTER, GOVERNOR JAMES ROSS SNOWDEN, Speaker of the House of Representatives JOHN STROHM, Speaker of the Senate. 1. An act to quiet the title to certain lands granted for the use of WILLIAM R. SMITH, in tail male general, and for other purposes. Whereas, WILLIAM SMITH, D.D., dec. by his deed dated 1 Mar 1803, recorded Huntingdon county, Book L, pg 45, granted and conveyed four tracts of land situate in said county, unto the honorable THOMAS SMITH ESQ., and BENJAMIN R. MORGAN ESQ., in trust for the use of his grandchild, William R. Smith, the eldest male heir, of his body lawfully begotten, and William R. Smith and ELIZA SMITH his wife, by their deed dated 4 Jan 1817, recorded Book P, pg 164, with the intent of barring estate tail, in pursuance of an act to facilitate the barring of entails, conveyed the same tracts of land unto THOMAS MONTGOMERY, which deed was duly acknowledged in open court and recorded, but by inadvertence the Prothonotary neglected to enter it in the records. Therefore, as the prothonotary of Huntingdon county, failed to make entry, in conformity to act dated 16 Jan 1793, to facilitate the barring of entails, he is hereby ordered to make the entry and it shall be as effectual as if the entry had been made at the time the deed was acknowledged. That THOMAS H.R. TRACY, BENJAMIN H. THROOP, CHARLES FULLER, are hereby constituted a body politic and corporate by the name of Phoenix Iron and Coal company, for manufacturing iron with anthracite coal, and the mining of coal. That the Canal Commissioner are hereby authorized to assess and adjust any damages sustained by JOHN WEBSTER, of Downingtown, Chester county, by the removal of his barn to an inconvenient distance from his dwelling house, conforming to the act passed 13 Jun 1840, if canal commissioners do not agree with him, they are hereby authorized to cancel and annul the contract. 7 Jan 1842. 2. An act to authorize TOBIAS MYERS, guardian of SAMUEL H. KELLER, minor child of PETER KELLER and HETTY KELLER, to convey certain real estate and for other purposes. Whereas, SAMUEL EWALT, late of Allegheny county, dec. by his last will and testament, dated 20 May 1841, did grant and devise unto Samuel H. Keller, son of Peter and Hetty Keller of said county, 20 acres of land, with the building on same, on a proviso, that he, Samuel H. will relinquish all right and title to a certain house in the city of Pittsburg, known by the name of Cowen's warehouse, and if Samuel H., his heirs, or executors continue to claim the house, then the bequest is null and void. The said Samuel H. Keller, being a minor, under the age of 14, on 16 Nov 1841 did make choice of Tobias Myers as guardian of his person and estate, who is authorized to make and convey a valid deed to the executors named in the will of Samuel Ewalt. JOSEPH WAINRIGHT, PETER KELLER and GEORGE W. IRWIN, executors, are authorized to make and convey a deed for the warehouse situate on the corner of Water and Market Streets in the city of Pittsburg, which shall be as good and effectual to all intents as if Samuel H. Keller was of age. 3 Feb 1842. 4. An act for the relief of ELIZABETH STUCK, a widow and others, soldiers and widows of soldiers of the revolutionary and Indian wars. That the State Treasurer is hereby authorized to pay to Elizabeth Stuck, of Fayette county, widow of an old soldier of the revolutionary war, forty dollars as a gratuity, and an annuity of forty dollars during her natural life, to be paid half yearly commencing on 1 Jan 1842. The State Treasurer is hereby authorized to pay to JOHN MCFERSON, of Tuscarora county, Ohio, JOHN DOWNS and HENRY CASSELMAN of Carrol county, Ohio, and JOSEPH MCMANUS of Stark county, Ohio, soldiers of the revolutionary and Indian wars, and to MARGARET COE of Allegheny county, widow of a soldier of the revolutionary and Indian wars, forty dollars immediately as a gratuity and an annuity of forty dollars each during life, payable half yearly to commence on 1 Jan 1842. The State Treasurer is hereby required to pay to HENRY SERING, of Fayette county, forty dollars immediately as a gratuity in full for military services rendered by him during the Indian war. That the State Treasurer is hereby authorized to pay unto SAMUEL BARNES of the city of Philadelphia, JOHN WOLF of York county, JANE ROBISON of Mercer county, ELIZABETH STEFF of Berks county, MARTIN MILLER of Franklin county, CATHARINE POTT of Berks county, and ELIZABETH MATHERS of Perry county, soldiers and widows of soldiers of the revolutionary and Indian wars, forty dollars each immediately as a gratuity, and an annuity of forty dollars each, during life, payable half yearly, to commence on 1 Jan 1842. 8 Feb 1842. 5, An act to confer on SAMUEL TYSON, and others, the rights and benefits of children born in lawful wedlock. That Samuel Tyson, son of Samuel Tyson and TRACY LEONARD, late of the county of Chester, Pa. dec. and JOSEPH W. SHEPLER, HANNAH SHEPLER, RACHEL SHEPLER and MARGARET SHEPLER, children of JACOB SHEPLER of Rostraver township, Westmoreland county, HENRY COLT JR. of the county of Luzerne, and JESSE RENNINGER LAVERTY, of the county of Cumberland, all of Pa., shall have and enjoy all the rights, benefits and advantages of children born in lawful wedlock, as fully af if they had been born in lawful wedlock. 8 Feb 1842. 6. An act authorizing the commissioners of Westmoreland and Allegheny counties to settle the accounts of HENRY ALTER, WILLIAM GREER and JOHN M. LAIRD, for services rendered in locating a state road, and for other purposes. That the commissioners of Westmoreland and Allegheny counties are hereby authorized to settle the accounts of HENRY ALTER, WILLIAM GREER, and JOHN M. LAIRD, to allow them a reasonable compensation for the payment of a target man and an axe man by them employed in locating a state road from Logan's ferry in Allegheny county, to intersect the road from Greensburg, Westmoreland county, to Chaffants on Turtle creek, near the farm of MR. REMERY, five miles west of Greensburg, and all other necessary expenses incurred by them. 8 Feb 1842. 8. An act to authorize the canal commissioners to settle the accounts of the late firm of Mitchell and M'Farland. A petition presented by GEORGE R. M'FARLAND, stated he had not been justly dealt with by MARK GRAHAM, late supervisor of the Allegheny Portage Railroad, and in consequence of a reduction made by Graham in an account of the late firm of Mitchell and M'Farland has been deprived of a fair compensation for labor done, and materials furnished in 1837. Therefore, the board are hereby authorized to settle the account, provided the amount shall not exceed $678.54. 8 Feb 1842. 9. A supplement to an act passed 16 Jun 1836, concerning a suit brought on the official bond of WILLIAM B. MITCHELL, state superintendent. That a certain alley in the city of Pittsburg, 20 feet wide, extending from Wayne to Washington Sts. between Penn and Liberty street, the same alley authorized by the will of the late JOHN WOODS, dec. is hereby exempted from the act passed 10 Jun 1836. 8 Feb 1842. 12. An act confirming the title to certain real estate in the city of Philadelphia, in the heirs of ABRAHAM K. PRITCHETTE. That a certain conveyance dated 30 Feb 1801, between JAMES PEMBERTON, CALEB CRESSON, HENRY DUHER, JOSEPH BRINGHURST, and THOMAS FISHER, trustees for the monthly meeting of the Friends in the city of Philadelphia, the first part, and Abraham Kentzing Pritchette of the second part, conveying a lot in the city of Philadelphia situate on the north side of Spruce St., shall be deemed and construed to vest in the heirs of Abraham K. Pritchette all the right, title and interest. 11 Feb 1842. 17. An act for the relief of JAMES HENDERSON. That the canal commissioners be authorized to examine the claim of JAMES HENDERSON, late a contractor for lock #31, of the Shenango Line Erie Extension, and make allowances for extra work and materials and to pay if just and equitable. 19 Feb 1842. 18. An act relating to the claim of DAVID RENNO and DANIEL BENTZ for apprehending two fugitives in the state of Ohio, and bring them to this state. That the state treasurer is hereby authorized to pay to David Renno and Daniel Bentz the sum of $200.00. 19 Feb 1842. 25. An act to authorize CHRISTIAN SHRACK, trustee under the will of WILLIAM HYNEMAN, dec. to sell and convey certain real estate. Whereas, William Hyneman, formerly of the Northern Liberties, Philadelphia county, dec. did by his last will and testament, dated 17 Sep 1822, devise to trustees, a certain brick tenement and lot situate in Water street, Philadelphia, in trust, for the sole and separate use of his three sisters, MARY YOUNG, ELIZABETH SWENEY, and SARAH MILLIS, for life, with remainder after their deaths, to the children of all of them, born and to be born, share and share alike, and the trustees having declined, Christian Schrack was appointed trustee. and whereas, the property is in a ruinous and decaying condition, yielding barely sufficient rent to pay the annual taxes and make repairs, and it is for the benefit of all the parties, that the same be sold and the proceeds securely invested for the same uses. Christian Schrack, is hereby authorized to sell and convey the brick tenement and lot, being the same premises which ROBERT WHITEHEAD by indenture, dated 15 Nov 1808 granted to William Hyneman. 23 Feb 1842. 26. An act authorizing JOSEPH KONIGMACHER, WILLIAM KONIGMACHER and WILLIAM R. GORGAS to sell certain real estate, the property of the society of Seventh Day Baptists, of Ephrata, Lancaster county. That Joseph Konigmacher, William Konigmacher, and William R. Gorgas are hereby authorized to sell, after giving public notice in one german and two english newspapers, in the city of Lancaster, a tract of land, 20 acres, in Ephrata Twp., Lancaster county, adjoining the Cocalico Creek, with a stone grist and merchants' mill, a saw mill, and the rights to a stone barn and other improvements. Also, a lot adjoining lands of William Konigmacher and MARY BAUMAN, containing about 1 acre, and to execute deed for the same to the purchasers. Money shall be applied to the liquidation of all debts due, and to the repair and erection of buildings as may be necessary and to invest any balance. 23 Feb 1842. 27. A supplement to an act incorporating the Penn Insurance company of the city of Pittsburg, passed 31 May 1841. That in the place of the persons named in the act are the following: REUBEN MILLER JR., R.M. POINDEXTER, WILLIAM B. HOLMES, WILLIAM BLACKSTOCK, WILLIAM LIPPINCOTT, GEORGE R. TAYLOR, CHARLES F. SPANG, and JAMES MILLIGAN are hereby appointed to perform the duties authorized by the commissioners named in the act. 2 Mar 1842. 28. An act authorizing certain trustees under the will of JOSEPH PARKER NORRIS, to let, on ground rent, certain parts of his real estate. That the trustees named in the will of Joseph Parker Norris, to whom he devised his "Fairhill" and "Sepviva" estates, and a piece of marsh land on Gunner's creek, in the county of Philadelphia, are hereby authorized to sell, reserving a perpetual rent charge, and to convey to the purchaser a good and valid an estate as if done prior to his death. 2 Mar 1842. 29. An act authorizing JACOB FRANTZ and JOHN HERSHEY, or the survivor of them, to sell and convey certain real estate, and for other purposes. That Jacob Frantz and John Hershey, of the committee of JOHN FRANTZ of Lampeter Twp., Lancaster county, are authorized to sell the plantation of John Frantz, adjoining land of ISAAC EVENS, ABRAHAM WITMER, CHRISTIAN SIEGRIST and others, containing 150 acres. Eight thousand dollars of the purchase money to remain charged on the plantation, the interest to be paid annually for John Frantz, during his life, and to his wife during her life if she survives him, and at the death of both, the $8000.00 to be paid in equal shares to his children. That WILLIAM CONRAD of Lampeter Twp., Lancaster county, is hereby authorized to sell and convey about 1 acre and 22 perches of land adjoining the Philadelphia and Lancaster road, which was conveyed to ABRAHAM CONRAD, father of William, by JOHN WEIDLER and CATHARINE WEIDLER his wife, and WILLIAM TOMBO and MARY TOMBO, his wife, by deed dated 7 Sep 1825 in trust for SARAH GRIFFITH. That BENJAMIN REIFF, and HENRY LOUCKS of Montgomery county, and WILLIAM A. CRABB, of the city of Philadelphia are hereby authorized to sell and convey a certain house and lot, situate on second street, opposite the new market, it being the same premises which JOHN PAWLING by his last will and testament, devised to his daughter REBECCA LYNCH for life, and if she has no issue, which is now so, according to the terms of the will is to revert to the estate and to all the other daughters of John Pawling. Therefore, the above named men shall execute a deed for the premises to a purchaser and distribute all money from the sale to all the parties entitled to receive it. That BERNARD WALTER, CHARLES HARTMAN and SAMUEL SNIVELY, trustees of the German school in the borough of Greencastle, Franklin county, are hereby authorized to sell and convey a house and lot, situate on the east side of East St., lot #80, and the proceeds distributed among the congregation. That ABRAHAM HARTMAN, of Alsace township, Berks county, of the legatees under the last will and testament of VALENTINE HARTMAN, dec. and he is hereby authorized to sell and convey all real estate devised to him. That JOSEPH MIFFLIN and JULIA ANN MIFFLIN his wife, late JULIA ANN STEWART, daughter of DOCTOR ALEXANDER STEWART, late of the borough of Shippensburg, Cumberland county, Pa. are hereby authorized to sell the real estate devised by Doctor Alexander Stewart, dec. to Julia Ann and her children, and to execute a deed of conveyance to the purchaser, and the proceeds of the sale invested in other landed property, for the benefit and use of Julia Ann Mifflin and after her death, her children. That SAMUEL LEVENGOOD, committee of the person and estate of JOHN HOY, an habitual drunkard of Tulpehocken township, Berks county, is authorized to invest the sum of $500.00 of the money of John Hoy, in trust for him, in real estate by purchase. That WILLIAM M. GRAY, and JOHN BLOOM, as trustees to the German Lutheran Church, in the borough of Sunbury, Norhtumberland county, are hereby authorized to sell and convey a certain lot of ground situate on Whortleberry St. #267, and a good and sufficient deed be made to the purchaser. 3 Apr 1842. 30. An act to incorporate the Lancaster City Gas Company. Whereas a company is being formed in the city of Lancaster, for the purpose of introducing gas light into the city. Therefore, GEORGE M. STEINMAN, JOHN MATHIOT, WASHINGTON L. ATLEE, REAH FRAZER, PHILIP REITZEL, C. HAGER, FREDERICK HAMBRIGHT, GEO. W. HAMERSLY, ROBERT MODERWELL, ANTHONY E. ROBERTS, JAMES CAMERON, WILLIAM COOPER, JOHN MICHAEL, JACOB KREIDER, GEORGE B. KERFOOT, JACOB DEMUTH, WILLIAM W. PENNELL, PHILIP METZGER and JOHN GETZ of the city of Lancaster, are hereby appointed commissioners. 3 Mar 1842. 31. An act regulating Election districts and for other purposes. That the qualified voters of Crawford township, in the county of Clinton, shall hold their elections at the house of GEORGE GEBHART. That the qualified voters of Shrewsbury township, Lycoming county, shall hold their elections at the house now occupied by JOEL BENNETT. That the qualified voters of Mifflin Twp. Lycoming county, shall hold their elections at the house of JACOB SOLADAY JR. That the township of Muncy, Lycoming county, shall be a separate election district, and the qualified voters shall hold elections at the house of BRITTON MARGARGEL. That the qualified voters of Logan township, Clinton county, shall hold their elections at the house of CHRISTIAN GRIEB. That the qualified voters of Herford township, Berks county, shall hold their elections at the house of MICHAEL GEHRY. That the qualified voters of Orange twp. Columbia county, shall hold their elections at the house of GEORGE SEIPLE. That the township of Oakland, Venango county, shall form a separate election district, and the qualified voters shall hold their elections at the house of JAMES R. MCCLINTOCK. That the township of Clara, Potter county, shall hereafter form a separate election district, and the qualified voters shall hold their elections at the house of JOSEPH C. ALLEN. That Sharon twp., Potter county, shall form a separate election district, and the qualified voters shall hold their elections at the house of OLIVER C. WARNER. That after the next election the qualified voters of the township of Vanango, Crawford county, shall hold their elections at the house of JOHN STOKE, but removal from the present location will be directed by a majority of the qualified voters. That the qualified voters of Lower Smithfield Twp., Monroe county, shall hold their elections at the house of GEORGE BUSH, innkeeper. That the township of Gennessee, Potter county, shall form a separate election district, and the qualified voters shall hold their elections at the house of HENRY SEALZ. That the township of Perry, Green county, shall form a separate election district, and the qualified voters shall hold their elections at the house of JOHN B. MINOR. That the township of Banks, Northampton county, shall form a separate election district, and the qualified voters shall hold their elections at the house occupied by PETER G. GENSEL. That the qualified voters of the thirty-third election district of Lancaster county, being a portion of Strasburg Twp., shall hold their elections at the house of ROBERT EVANS, in the borough of Strasburg. That the qualified voters of the township of Morris, Clearfield county, shall hold their elections at the house of JOSIAH HUNTER at Morrisdale. That the township of Penn, Berks county, shall form a separate election district, and the qualified voters shall hold their elections at the house now occupied by DANIEL POTTEIGER. That the citizens residing north of the Susquehanna Ave., Penn Twp., Philadelphia county, shall hold their elections at the public house of ENOCH KEIZEL, sign of the wagon and horses, at the corner of the township line road and Nicetown lane. That the qualified voters of the township of Lower Salford, Montgomery county, shall hold their elections at the house of JONAS BOORSE, innkeeper. That the elections of the township of Manallin, Fayette county, shall be held at the house of ROBERT HUNTER. That the township of Covington, Clearfield county, is hereby erected into a separate election district, and the qualified voters shall hold their elections at the house of JACOB MAURER. That the qualified voters of Franklin Twp., Susquehanna county, shall hold their elections at the Centre School House, near the house of JACOB ALLARD. That the elections for the district composed of the township of Grove, Clinton county, shall be held at the house of WILLIAM FLOYD JR., at the first Fork of the Sinnemahoning. That the qualified voters of Harrison Twp., Bedford county, shall hold their election at the house of JOHN METZGAR. That the borough of Sharpsburg, in Allegheny county, shall be a separate election district, and the qualified voters shall hold their elections at the Temperance House, now occupied by JAMES SHARP. That the electors of Summit Twp., Somerset county, shall hold their elections at the School House near Myer's Mills, and ELIAS K. BEEGHLEY, JACOB P. WALKER and SAMUEL MILLER are appointed and authorized to hold elections. That the township of West Hanover, Dauphin county, shall form three separate townships and school districts. South District shall be called South Hanover and the elections shall be held at the house of PHILIP WOLFERSBERGER, the east district, East Hanover and the west district, West Hanover. That the qualified voters of the township of Minorsville, Schuylkill county, shall hold their elections at the house of JOHN MOON. That the qualified voters of that part of East Earl twp., Lancaster county, composing the 37th election district, shall hold their elections at the public house of HENRY YUNDT and the judges of the elections shall count the votes at the public house now occupied by GEORGE HARKEY, in the village of New Holland. That the township of East Lampeter, Lancaster county, shall be a separate election district, and the qualified voters shall hold their elections at the house now occupied by PHILIP FERREE. That the qualified voters of West Lampeter Twp., Lancaster county, shall hold their elections at the public house now occupied by HENRY MILLER, in the village of Lampeter Square. That the township of Penn Forest, Monroe county, shall form a separate election district and the qualified voters shall hold their elections at the house now occupied by JOSIAH M. PRATT. The qualified electors of Antis township, Huntingdon county, shall hold their elections at the public school house, on the land owned by JOHN BELL. That the qualified voters of Union Twp., Berks county, shall hold their elections at the house of HERMAN UMSTEAD. That the qualified voters of township Conewago, York county, shall hold elections at the house of FREDERICK HAKE, innkeeper. That the qualified voters of Smithfield Twp., Bradford county, shall hold their elections at the house of ABEL J. GEROULD. That the qualified voters of the township of Lower Mahanoy, Northumberland county, shall hold their elections at the house of JACOB SPOTZ. 4 Mar 1842. 33. An act to perfect the title to certain ground rents. That certain deeds and assignments made and executed by BENJAMIN DARLINGTON, trustee of JOHN D. MAHAN and AGNES MAHAN his wife, to JOHN SNYDER, dated 5 Jul 1841, granting and conveying certain ground rents to John Snyder. And another deed dated 23 Dec 1841, made and executed by Benjamin, trustee to AGNES IRWIN, granting and conveying unto Agnes, a lot of ground as described, as by reference to the deed, shall be deemed and taken to convey to John Snyder and to Agnes Irwin the full and absolute right and title and as a bar to any interest which might arise out of articles of agreement, entered into between John M. Mahan and Agnes his wife, previous to their marriage. 5 Mar 1842. 34. A supplement to enabling HARDMAN PHILIPS to receive certain conveyances and grant and convey certain lands. Whereas, Hardman Philips, since the passing of the act, has received from SOPHIA PHILIPS the widow of his late brother HENRY PHILIPS dec. her interest in the lands originally owned by his father and brother, which remain unsold, in the state of Pa. and Hardman Philips desires to sell and dispose of the lands. That the title of Sophia Philips, now Hardman Philips is hereby confirmed as fully and effectually as if he had been a citizen of the United States, and it shall be lawful for Hardman Philips to grant, and sell the estate in the county of Centre, and elsewhere in Pa., as if he was a citizen of the United States and all disability arising from his want of citizenship is hereby removed. 5 Mar 1842. 41. An act concerning the laying out of a state road. That EPHRAIM L. BLAIN of Washington county, and JAMES H. PATTERSON and JOHN GADD of Fayette county, are hereby appointed commissioners to view, lay out and mark a state road from Bentleysville, Washington county, by way of Greenfield, to Connellsville in Fayette county. 14 Mar 1842. 42. An act concerning the laying out of a state road. That WILLIAM OLDHAM, JACOB REEL of Somerset county, and J.W. POTTS, JAMES MOORE and WILLIAM PENROSE of Bedford county, are hereby appointed commissioners to view, and lay out a state road, from Birdsfield, in Bedford county, via Blackburn's Mill, in Bedford county, Harman's Gap on the Allegheny mountain, WILLIAM OLDHAM's mill and the new furnace in Somerset county, to Stoystown. 14 Mar 1842. 44. An act for the relief of DAVID GRING, and others, soldiers and widows of soldiers of the revolutionary and Indian wars. That the State Treasurer is hereby authorized to pay unto David Gring of Berks county, SARAH JEFFERIES of the city of Baltimore, CHAMBERS GAW of Lancaster county, ANN CATHARINE WANN of Lebanon county, ALEXANDER SCOTT of Westmoreland county, and HELEN ELIZABETH HIBLER, and CATHARINE NUNNEMACHER of Northampton county, and JAMES GALLAHER of Clearfield county, soldiers and widows of soldiers of the revolutionary and Indian wars, forty dollars each, immediately as a gratuity and an annuity of forty dollars each during life, payable half yearly, to commence on 1 Jan 1842. The State Treasurer is hereby authorized to pay to JOHN S. JENNINGS of Berks county, one of the heirs of JOHN JENNINGS, a soldier of the revolutionary war, dec. two hundred dollars in full for donation land, in trust, for the legal heirs of the deceased. That the State Treasurer is hereby authorized to pay unto JOHN KNICELY and JOHN MOORE of Greene county, SABASTINE MILLER of Monroe county, ELIZABETH STILLWAGGONER of Lancaster county, ELIZABETH CUPPS of Allegheny county, ELIZABETH BOYER of York county, and MARY TRENSUE of Monroe county, soldiers and widows of soldiers of the revolutionary and Indian wars forty dollars each immediately, as a gratuity and an annuity of forty dollars each during life, payable half yearly, to commence on the 1 Jan 1842. That the State Treasurer is hereby authorized to pay unto JACOB CARLE of Berks county and JOSEPH RHER of Schuylkill county, and HENRY SELING of Fayette county, forty dollars each immediately, as a gratuity in full for military services rendered by them, during the revolutionary and Indian wars. An act authorizing JACOB ERB, one of the trustees of CHRISTIAN ERB and MARY ERB his wife, to sell and convey certain real estate. That Jacob Erb, one of the trustees of Christian Erb and Mary his wife, and their children, under a deed of assignment dated 4 Apr 1821, and recorded in Lancaster, Book 20, pg 335, of Manheim Twp., Lancaster county, is hereby authorized for the sum of $1311.00 to be paid 1 Apr 1842, to grant, bargain, sell and convey unto JOHN RUDY by deed, a certain tract of land, adjoining lands of NICHOLAS HUHN and JOHN RUDY, containing 7 acres and 6 perches. That Jacob Erb and JOHN SHRANTZ the other trustee, are hereby authorized to buy real estate from the money received and held in trust. 14 Mar 1842. 46. An act to incorporate a company for making a road from the city of Pittsburg, by way of Braddocks field to Turtle creed, at or near the farm of ALLEN BROWN and for other purposes. That ANDREW WATSON, SAMUEL THOMPSON, JOHN ARTHURS and CHARLES CONLEFF, of Pitt Twp., GEORGE W. IRWIN, of Peebles twp., JOHN ADAMS, ROBERT MILLIGAN, GEORGE WALLACE and WILLIAM G. HAWKINS of Wilkens twp., Allegheny county, are hereby appointed commissioners. That JOHN HARPER, JOHN MCKEEHAN of Cumberland, and JOHN ORR of Franklin county, are hereby appointed commissioners to view, lay out and mark, a state road, from Carlisle to the Burnt Cabins, near the house of MRS. KENNEDY in Newton Twp., Cumberland county, to a point leading from Shippensburg to Strasburg, near the bridge across the stream called Herron's branch, in the county of Franklin. 14 Mar 1842. 48. An act relative to the estate of JAMES O'HARA. Whereas, James O'Hara, late of Pittsburg, by his last will dated 15 Sep 1819, devised certain property to trustees, for the benefit of his daughter MARY O'HARA, who after the death of the testator, intermarried with WILLIAM CROGHAN, and is since dead intestate, leaving an only child and daughter MARY CROGHAN, who being under the age of 15 years, was recently married, while at a boarding school, without the consent or knowledge of her father to EDWARD W.H. SHENLEY, an alien, who has taken her to Europe. It appears that the will contained a power which would have devolved upon William Croghan, on the death of his wife, also doubts may arise how far the lapse of time, since the date of the will, may have impaired the efficacy of its provisions for protecting and securing the estate. Therefore, the trustees are hereby empowered to convey to William Croghan, a life estate in all the property devised to his wife by whom he had issue. The trust created by the will to Mary O'Hara and her heirs is hereby prolonged to the heirs of Mary Croghan, otherwise MARY SHENLEY with an ultimate settlement upon the heirs of her body. 16 Mar 1842. 49. An act concerning estates. Whereas, per an act passed 21 Apr 1840, ANDREW BRUNNER was directed, by Bucks county orphans' court to execute a mortgage for the use of his children, upon his real estate, and now having sold the same and purchased other real estate, the orphans's court is hereby authorized to direct a new mortgage to be given on the property purchased by him, for the same uses, and in a like sum. That WILLIAM ECKERT, guardian of the person and estate of MARIA LOUISA PRETZ, a minor daughter of GODFREY PRETZ, late of the borough of Allentown, Lehigh county, dec. is hereby authorized to convey to FREDERICK NICELY, all the right and title of the minor in certain lots of land situate in the town of Berwick, Columbia county, adjoining lots of SAMUEL F. HEADLEY on the west, and NANCY SLOAN on the east and numbered #23, containing 2 acres, and also to convey to JOHN SNYDER all the right and title of the minor, in a certain lot #23, adjoining a lot of John Snyder, by deeds with the same effect as if Maria Louisa Pretz were of full age. 17 Mar 1842. 50. An act to change the venue of a certain action now pending in the court of Common Pleas, of Clarion county, and for other purposes. The action wherein JONATHAN FRAMPTON and JAMES M. CRAIG are plaintiffs and the commissioners of Clarion county are defendants, is hereby removed and transferred to the court of common pleas, of Armstrong county. The transfer expense shall be bore by the plaintiffs. That FREDERICK SORBER and THOMAS THOMAS, trustees of the Blockley school house, are hereby authorized to convey to the commissioners of the county of Philadelphia, in trust for public school purposes, a lot situate in Blockley township adjoining a private lane belonging to THOMAS HUNTER, with the building and appurtenances. That the boundaries of the borough of M'Connellsburg, Bedford county, be extended. Water street, running a north course with the line of GEORGE HOKE, then Water street south to include lot and improvements of DANIAL HUMBERT. That it shall be lawful for SIMON CAMERON, CHARLES H. CAMERON and WILLIAM DUCK, executors of the will of JOHN CAMERON ESQ., late of the city of Lancaster, dec. to grand and convey to THEOPHILUS FENN, or other owners of lands all the rights and title of John Cameron, at the time of his death, to certain lands he owned jointly with GEORGE MISH, SAMUEL SHOCH, JACOB DUCK and others, situate in various townships of Luzerne county, Pa., which were purchased at sales for taxes, to be conveyed in trust, to be sold by the trustees, and the proceeds to be divided amongst the owners of the lands. That R. RUNDLE SMITH, administrator of T. LEAMING SMITH, late of the city of Philadelphia, dec. si hereby authorized to sell all the interest being an undivided half of a certain lot situate on the east side of Delaware Second st. and south side of Oxford St. in the district of Kensington, Philadelphia county, bounded southward by ground granted by JOHN J. An act concerning roads and for other purposes. HAUSE, thence through Columbia county, near the residence of JOHN BULL, thence through Lycoming county line, near THOMAS LAWS. That the streets, lanes and alleys, situated in that portion of the town of Danville, Columbia county, called North Danville, bounded by Church St. east, Mill street west, Bloomsburg road north, and south by lands of WILLIAM HARTMAN and others, are hereby declared public highways. 17 Mar 1842. 52. An act authorizing the sale of real estate held by Congregations of the German Reformed Presbyterian Church, in the county of Perry. That HENRY HIPPLE, trustee of Zion's Church, JOHN RITTER, trustee of Lebanon Church, JACOB SHIVELY, trustee of St. Peter's Church, WILLIAM ALLBRIGHT, trustee of Fishing Creek Church, and PETER SMITH trustee of Christ's Church, in the county of Perry, are hereby authorized to sell a certain tract of land situate in Tyrone township in the county of Perry, containing 14 acres and 28 perches, now held in trust for the use of five churches and by deed to convey the same to the purchaser. 17 Mar 1842. 53. ROBERTS, JOHN FELTON and BENJAMIN CRISPIN of the county of Philadelphia, are hereby appointed commissioners. 17 Mar 1842. 54. An act to authorize RICHARD U. MORGAN to receive certain moneys. That Richard U. Morgan of the borough of Reading, Berks county, is hereby authorized to ask, demand, sue for and receive of JOHN ZEIBER, executor and trustee appointed by the last will and testament of JOHN MARKLEY, late of the borough of Norristown, Montgomery county, dec. or any other person a certain pecuniary legacy given and bequeathed in the will, and therefore directed to be secured by mortgage or real estate, and the interest therefrom, to be paid to his daughter SARAH MARKLEY, now SARAH MORGAN, wife of Richard U. Morgan, during the term of her natural life and after her decease to be paid to her surviving children. Richard U. Morgan is hereby invested with the right and authority to make an assignment or transfer of the mortgage, by which the legacy is secured. That THOMAS MERCER and BENJAMIN G. MITCHELL, duly appointed by the court of common pleas, for the city and county of Philadelphia, in the place of BENJAMIN JONES JR., and RICHARD GARWOOD, trustees named in the last will and testament of HANNAH C. SNOWDEN, late of the county of Philadelphia, dec. and are hereby authorized to sell for cash, a certain wharf and lot of ground on the east side of Swanson St. in the Southwark district, Philadelphia county, bounded south by ground of JOSIAH HAINES, east by the Delaware river. Also a lot on the east side of Front St. and west of Church St. which were made subject to the appointment of Hannah C. Snowden, by the will of HENRIETTA WARE, late of Southwark district, dec. and to convey the same to the purchasers by a good and sufficient deed. 17 Mr 1842. 55. An act to annul the marriage contract of CHARLES R. TALLEY and ELIZABETH TALLEY. That the marriage contract entered into by Charles R. Talley and Elizabeth Talley his wife, is hereby annulled and made void, and the parties released from the contract, and from all legal duties as fully as if they had never been joined in marriage. That the issue of the marriage shall be deemed and considered legitimate. We certify that the bill was presented to the Governor on the 4 Mar 1842, and was not returned within 10 days after it had been presented to him. An act concerning various matters. That the township of Woodward, Clinton County, shall be a separate election district and the qualified voters shall hold their elections at the public house of NATHANIEL HANNA, now in the occupancy of ROBERT M. HANNA. That JAMES LYON is hereby authorized to sell certain lots, situate in the town of Beaver, numbered 125, 126, and 127, and James Lyon shall give public notice of the sale in two weekly newspapers of Beaver County for eight weeks, and also give notice to the heirs of HENDERSON C. HALL, dec. to appear before the date of sale and pay to him the balance of the purchase money due the Commonwealth on the lots. If not paid, the sale made to the purchaser shall vest in the purchaser against the Commonwealth, and upon a return of the balance of the purchase money the Secretary of the Commonwealth shall issue patents. That the titles of BANNER THOMAS and SAMUEL F. An act to change the name of JAMES SMITH OTIS, of the city of Philadelphia, and for other purposes. That James Smith Otis, son of ISAAC OTIS, of the city of Philadelphia, is hereby authorized to change his name from James Smith Otis to Isaac Otis and he shall be able act to all intents and purposes as if no change had been made. That GEORGE CARY THARP SCHNAUFFER, of Perry county, is hereby authorized to change his name to GEORGE CARY THARP, and by that name he shall be able in law to all intents and purposes as if no change had been made and he shall be capable of taking and inheriting any estate of GEORGE THARP and MARY THARP his wife, as fully as if he were their own child, born in lawful wedlock. 18 Mar 1842. 60. An act for the relief of the children of DAVID LONG and for other purposes. That it shall be lawful for the court of common pleas, of Lancaster county, on the application of the committee of the person and estate of David Long, a lunatic, to make an order authorizing the committee to pay to any of the children of David Long, such portions of the trust moneys belonging to the estate of the lunatic, as the court shall deem reasonable and proper, for the purpose of their maintenance or furtherance in life and business and shall be considered advancements and upon the death of David Long the same together with interest from the date of payment, shall be deducted from their shares of the estate of the lunatic. 18 Mar 1842. 62. An act authorizing JOHN PRALL to sell and convey certain real estate in Bucks county. That John Prall, the surviving trustee named in a deed of Nov 1797, is hereby authorized to sell and convey to the purchaser the lot with appurtenances situate in the township of Middletown, Bucks county, on the west side of the road beginning at a corner of LEWIS RUE and JOHN PRALL's land, thence by land of GABRIEL VANHORN, containing nine perches. BEITEL, surviving administrators of CHRISTIAN MIKSCH, dec. to sell and convey certain real estate. Whereas, Christian Miksch, of Upper Nazareth Twp., Northampton county, became seized in his demesne, in a certain piece of land, sutuated on Green Creek, Columbia county, formerly Northumberland, containing 424 acres and 60 perches. An act to incorporate the Southern Mutual Insurance Company, of Lancaster county. That JAMES PATTERSON, JACOB ECKMAN, SLATER BROWN, GEORGE MORRISON, JOHN KING are hereby constituted and declared a body politic and corporate to insure their respective dwelling houses, stores, shops and other buildings, household furniture, goods and chattels, and other property against loss or damage by fire. 24 Mar 1842. 67. An act to incorporate the Mutual Beneficial Insurance Association of Bucks county, against losses sustained by fire and for other purposes. That JOHN LUKENS, CHRISTIAN VAN ARTSDALEN, EZEKIEL TYSON, LEMEN BANES, ISAIAH DELANY, SAMUEL THOMPSON, and CORNELIUS S. BAKER, are hereby made a body politic and corporate. That ELLIS KIRK, son of JOHN KIRK, dec. and TABITHA LUKENS, at present TABITHA KIRK, of Abington township, Montgomery county, Pa. shall have and enjoy all the rights of a child born in lawful wedlock as fully as if he had been born in lawful wedlock. 24 Mar 1842. 68. An act giving assent to an act of the Legislature of New Jersey to incorporate the Carpentersville Delaware Bridge company. That LUTHER COLVIN, PETER SHIVELY, DANIEL RAUB, ABRAHAM ARNDT, GEORGE RAUB, all of the county of Northampton, are hereby appointed commissioners, on the part of Pa. 24 Mar 1842. 69. An act to authorize CHARLES SMITH to erect a Dam across Dunning creek, in Bedford county, and for other purposes. That Charles Smith is authorized to erect a dam above the bridge on the road leading from Bedford, past his farm, not exceeding 4 feet in height, for the purpose of supplying his mill with water, provided it does no injury to the private rights of others. 24 Mar 1842. 70. An act to authorize WILLIAM LINN, trustee of the minor children of ROBERT STOCKTON, and ANN STOCKTON, to sell and convey certain real estate, and for other purposes. Whereas, on 26 Jun 1823, W.B. GALBRAITH, conveyed to William Linn, a lot of ground situate in the borough of Shippensburg, Cumberland county, numbered 42, in trust for the sole use of Ann Stockton, the wife of Robert Stockton, and after her death to her children. And whereas, Ann is dead, leaving issue six children, and in the interest of the children, four of whom are minors, that the real estate be sold. William Linn, trustee, is hereby authorized to sell and convey the lot and make title to the purchaser. He shall pay over the balance of money arising from the sale to the children, and to the guardian of the minors to be expended in their education and support. That the guardians of the minor children of DAVID SCOTT, late of Luzerne county, dec. shall have full power to sell and convey portions of the real estate of the minors that is unproductive, and to pass title to the purchasers. Whereas, JOHN MCCULLOUGH, late of the county of Washington, dec. did in his lifetime, authorize his son JAMES MCCULLOUGH, of the borough of Canonsburg, to sell and dispose of a house and lot, with tanyard, on Greer st. in said borough, and he did sell the same to JOSEPH BROWN, and ROBERT DONALDSON, but no deed was made during the life time of John. Therefore, James McCullough is authorized to make and execute a good deed for all the rights and title of the deceased to Joseph Brown, and Robert Donaldson. That BENJAMIN HAYWOOD, STRANGE N. PALMER, and JOHN C. SIMS, are hereby created a body corporate and politic by the name of North branch Coal and Iron Company, to mine coal, construct railroads, and transporting to market. That the trustees of the Methodist Episcopal church of the borough of Lewistown, Mifflin county, are hereby authorized by good deed to sell and convey to JOHN R. WEEKS and DAVID HOUGH, in trust for the use of the First Regular Baptist Church of the borough of Lewistown, the lot and building known as the old Methodist meeting house on third st. John R. Weeks and David Hough are hereby authorized to execute a mortgage on the property to FRANCIS MCCLURE, and MOSES KELLEY, in trust for the use of the Associate Church of Lewistown. Whereas, JOSEPH ARCHAMBAUTH and wife, of the then village of Newtown, Bucks county, by a deed of trust dated 1 Apr 1831 conveyed to JOHN LINTON, SILAS PHILIPS, JOHN BOND, AMOS WILKINSON, SAMUEL PHILIPS, THOMAS GOSLIN and JAMES DIVINE a lot of ground in trust for an association of inhabitants of Newtown, for the purpose of erecting an independent anti-sectarian house of worship with a burying ground. That John Bond, Amos Wilkinson, Samuel Philips, and Thomas Goslin are hereby authorized to convey to the burgess and town council of the borough of Newtown, the said trust for the purposes mentioned. That WILLIAM RAMSEY, administrator of the estate of JAMES FARRA, late of Warrington Twp., York county, dec. is hereby authorized to sell all the real estate vested in William Ramsey by virtue of a deed dated 1 Apr 1841 by JAMES F. MACHLEN and ELLEN MACHLEN his wife conveyed to William Ramsey as administrator with the will annexed, of James Ferra, dec. two tracts of land situate in Warrington Twp., York county, one containing 113 acres and 148 perches, the other containing 31 acres and 33 perches, and he is further authorized to sell all the estate which James Ferra dec. hae and to convey to the purchaser by deed all the right and title of James Farra dec. and to distribute the money amongst those who shall be entitled to the same. That the Auditor General is hereby authorized to transfer to JAMES HERRIOTT, during his natural life, 120 shares of stock in the Erie and Waterford turnpike road company. Said transfer shall be in lieu of any further claim in reference to the construction of said road. 25 Mary 1842. 71. An act to incorporate the Clifford and Carbondale Turnpike Road Company, and for laying out a state road from the Virginia state line, Fayette county to Centerville, Somerset county, and for other purposes. That JACOB C. CADDEBACK, WILLIAM WELLS, WILLIAM FINN, PHILIP J. STEWART and ORREN THATCHER, of the county of Susquehanna, are hereby appointed commissioners of the Clifford and Carbondale Turnpike. That the road shall begin in the township of Clifford, Susquehanna, between the house of WILLIAM JACKSON and MICHAEL WEST, and thence to Carbondale township line in the county of Luzerne, near school house #4. That THOMAS BROWN SEN. and SAMUEL RUSH of Fayette county, and ABRAHAM COLBURN of Somerset, are hereby appointed commissioners to view and lay out a state road beginning where the Brandonville and Fishing creek Virginia state road intersects the Pa. state line, in Henry Clay Twp., Fayette county, from thence to the national road near the house of Thomas Brown, Fayette county, then to the town of Centerville, Somerset county. 25 Mar 1842. 72. An act to appoint commissioners to re-survey and mark the county line, which divides the township of Bristol, Philadelphia county, from the township of Cheltenham, Montgomery county, and for other purposes. That JOHN FOULKROD of Philadephia county, JOEL K. MANN of Montgomery county, and HENRY TREMPER of Bucks county, are hereby appointed commissioners of re-serveying and marking the county line. That the trustees of the German Reformed Congregations of Youngmanstown, Longstown, Driesbach's meeting house, and Aaronsburg, in the counties of Union and Centre are hereby authorized to sell and convey by deed to the purchaser a lot of land situate in Youngmanstown, Union county, adjoining the road leading from Youngmanstown to Lewisburg, a lot of RICHARD VAN BUSKIRK, and a lot of THOMAS YOUNGMAN, containing 1 and 1/4 acres, being the premises which FREDERICK CONRAD and wife, by Indenture dated 31 Mar 1810, did grant and confirm to HENRY YORICK and others, trustees. That the qualified voters of the township of Wysox, in the county of Bradford, shall hold their elections at the house of GEORGE SCOTT. An act to incorporate a company for the purpose of erecting a permanent bridge overt the river Conemaugh, at Lockport, in Westmoreland county, and for laying out a state road from Blairsville, in Indiana county, to Mount Pleasant, in Westmoreland county, and for other purposes. That PETER MAXWELL, ROBERT RIDDLE, and JOHN TAYLOR, of Indiana county, and JOHN CAVODE, THOMAS MABON and HENRY HERR of the county of Westmoreland, are hereby appointed commissioners to build the above named bridge. An act concerning tax collection. Whereas, SAMUEL AWL, of Augusta twp. in Northumberland county, was appointed collector of taxes for the years 1839 and 1840 and Samuel is since deceased and a considerable amount of taxes remain due and uncollected, therefore, the HONORABLE GEORGE C. WELKER and GIDEON LEISENSING who are the bail of Samuel Awl, by bond, are hereby authorized to proceed with the warrants directed and issued to Samuel to collect the taxes remaining due. 30 Mar 1842. 78. An act to incorporate for the making of an artificial road from the Monongahela and Coal Hill Turnpike Road, in the county of Allegheny to Beallville in Washington county, and for other purposes. SNOWDEN, JOHN FINLEY CURRY, WILLIAM KIDDOO, JOHN HOLMES, THOMAS VERNER, HENDERSON WEIGHTMAN and JOHN WORK of Allegheny county, and LEVI FINLEY, ROBERT BARR, JEREMIAH RODGERS, JOHN FREEMAN, JOSEPH HAMILTON and JAMES ESTEP of Washington county, are hereby appointed commissioners, with the power to lay out a road by way of DR. CURRY's burned mill and Finleyville to Beallville. The canal commissioners are hereby authorized to contract with ABRAHAM STAUB of Milton, Northumberland county, for the use of such supply of water, out ot the West Branch canal, for his mill in Turbut Twp., Northumberland county, provided the same can be spared without injury to the public works. That the president of the town council of the borough of Butler is hereby authorized to cause proof to be made by one or more witnesses, of the original draft of the borough as made by JOHN CUNNINGHAM, and on such proof to cause the same to be recorded in the office of deeds, in the county of Butler, to be used in evidence in any controversy resection property. That WILLIAM WILSON, merchant, ROBERT FARIES of Williamsport, and THOMAS BENNET of Loyalsock Twp., Lycoming county, are hereby appointed commissioners to make a survey of the borough of Williamsport to designate lots, streets, lanes and alleys thereof, according to the original plan of the town plot as laid out by the original proprietor, to erect a town, and file the same with the recorder of deeds which shall be evidence of the boundaries. That JAMES REBER and JOSHUA REBER, of Berks county, are hereby authorized to construct a toll bridge over the river, and after paying the various owners of the land, James and Joshua Reber shall have, hold and enjoy the lands, and enpowered to erect gates and demand and receive tolls. 5 Apr 1842. 83. A supplement to the act authorizing JACOB SORRICK and MICHAEL HETTRICK, trustees of the Lutheran congregation of Clover Creek, Huntingdon county, to sell and convey certain real estate, and for other purposes. That JACOB SORRICK and MICHAEL HETTRICK trustees of the Lutheran congregation at Clover creek, Huntingdon county, Pa. are hereby authorized to sell and convey unto the trustees of the Williamsburg and Sinking Valley congregation all the rights and title in a certain house and lot situate in the town of Williamsburg which has heretofore been held in common, and to execute a good deed for the same. That SAMUEL R. WOOD, CHARLES W. HEGINS, and ROBERT RICHARDSON, are hereby constituted a body corporate and politic, by the name of Locust Mountain Coal and Iron Company, in the counties of Columbia and Northumberland. Whereas, CHARLES F. ROBERTS, late of the city of Philadelphia did on 18 Apr 1834, by a certain indenture did grant and convey interalia all his real estate, situate in the city and county of Philadelphia, unto JOSEPH P. NORRIS JR., and JOHN J. SMITH upon certain trusts. Whereas, the property has by the decease of John J. Smith and the conveyance of Joseph P. Norris Jr. became vested in BENJAMIN GERHARD. Certain persons claiming to be creditors of Charles Fl Roberts have instituted to invalidate the trusts by bringing the said title into disrepute so that he is wholly unable to sell the property, although sales might otherwise be effected to the advantage of all persons interested in the real estate. Therefore Benjamin Gerhard may make any contract for the sale of the whole or part of the real estate by the confirmation of the orphans' court of Philadelphia, and he may then convey the property unto the purchaser, exempt from all claims of any creditor of Charles F. Roberts. Money from the sale is to be invested in securities and shall stand in lieu of the real estate until a ruling by the supreme court of the eastern district of Pa. That JOHN H. A supplement authorizing the incorporation of the Delaware and Susquehanna Railroad Company and other purposes. That the time for carrying into effect the object of the charter shall be extended for 5 years, after the 28 Feb 1842. That ANDREW T. That the qualified voters of St. Thomas Twp., Franklin county, shall hereafter hold their electons at the house of SAMUEL BRINDLE, in the village of St. Thomas. That the township of Birmingham, Delaware county, shall be a separate election district and hold their elections at the public house of MILTON STAMP. That hereafter the qualified voters of the northwest ward in the borough of Reading, in the county of Berks, shall hold their elections at the house of JACOB DONOHOWER. That hereafter that part of the township of East Pennsboro, Cumberland county, lying north and east of the Allen Twp. line, and the road from near ADAM EICHELBERGERS, across the North mountain, shall be a separate election district and hold their elections at the house now occupied by HENRY CHURCH, at the west end of the Harrisburg bridge. An act relative to the last will of WILLIAM M. CAMAC. Whereas William Masters Camac of Penn twp., Philadelphia county, dec. died seized of real estate in said county and other real estate lying in the kingdom of Ireland, he did empower his trustees here to sell his real estate here and in the kingdom of Ireland, using the money from the later for payment of his debts. Whereas, the production of the will and codicils is required in the Kingdom of Ireland and England, in order to their due probate therein, and the execution of the trusts thereof in order to the due sale and perfection of the title thereupon to the purchaser of the Irish estates. PENNOCK and SAMUEL MURDOCK are hereby created a body corporate and politic, by the name and style of the Board of Education, for the Cumberland Presbyterian Church in the United States. That HANNAH CHRISTIANA M. BAIRD, widow of ISAAC BAIRD, late of Manayunk, Philadelphia County, dec. and guardian of WILLIAM J. BAIRD, a minor child of the deceased, and CHRISTIANA M. BAIRD, a daughter of full age, of the deceased are hereby authorized to sell a lot situate on Main St. in Manayunk, adjoining lands of WILLIAM M'GLINCHEY and GEORGE SHIELDS, whereon have been erected since the death of Isaac Baird, two stone houses two stories high, and to make and execute to the purchaser a good conveyance for the same, and to pay and discharge the amount due and owing to GEORGE MOYER of Roxborough Twp. for work done and materials furnished in the erection and construction of the houses, and to pay and extinguish a certain ground rent, of thirty dollars per annum issuing out of the lot and another lot in Manayunk, and with the balance of the money to erect on the last lot one or more houses and if no houses are built to invest the money. Whereas, RICHARD HUMPHREYS, a citizen of Philadelphia, died in the year 1832, bequeathing the sum of $10,000.00 in trust, having for its object the benevolent design of instructing the descendants of the African race in school learning, in the various branches of the mechanic arts and trades, and in agriculture, in order to prepare and qualify them to act as teachers in such branches of business, as they may appear best qualified for. The institution to be located not far from Philadelphia and to be under the care and management of the religious Society of Friends, commonly called Quakers. MILLER and ISAAC COATES, trustees to sell and convey certain real estate, and for other purposes. Whereas, a lot in the village of Coatesville, in Chester county, was sold and conveyed in the year 1831 to certain trustees for the purpose of having erected thereon a house for public worship, to used by Presbyterians, Baptists, Friends, Episcopalians and Methodists, and whereas it now appears that it has been found impracticable to carry into effect the original intention. That JOHN BOYLE of Susquehanna county, HENRY COLT of Luzerne county, and GEORGE MACK of Columbia county, are hereby appointed commissioners to survey, measure and mark the line between the townships of Benton and Nicholson. 28 Jun 1842. 107. A supplement concerning the erection of the academy of Sumneytown, Montgomery county. The second section under the act passed 13 Apr 1841 be so construed as to authorize the corporation to bring action at law, against PHILIP REED ESQ., and recover of him the sum of money he may have received or recovered from, any one of the commissioners of the house lottery, either without or by suit brought against them by HENRY SNYDER, concerning a school house erection and the interest on the moneys concerned. That the state treasurer pay to ANDREW MANN, of Bedford county, late a brigade inspector of the first brigade, twelfth division of the militia of Pa., the sum of $114.86, for his services and expenses incurred in convening and organizing a general court martial for the trial of delinquent militia men, for a disobedience of the orders of the president of the United States in not performing a tour of duty during the late war. That JOHN HEEFNER, JOHN SMALL, and WILLIAM HORNER JR., the building committee of the St. John's church, in Funkstown, Franklin county, are hereby authorized to raise by loan on mortgage a sum to pay whatever money may remain due and unpaid on the building for its erection and construction. That the state treasurer is hereby authorized to pay to SUSAN MARTZ of Northumberland county, the sum of thirty dollars, in full of a claim due her late husband as lock tender on the West Branch Division of the Pa. canal. That the state treasurer is hereby authorized to pay to WILLIAM B. KNOX, $25.00 for his services as judge advocate at the court marshal which recently assembled at Mechanicsburg, for the trial of CAPTAIN WILLIAM BIGLEY. Whereas, ALEXANDER JACKSON, formerly resident within the county of Lycoming, was by commission in the nature of a writ de lunatico inquirendo, found to be an habitual drunkard, and his estate committed to a trustee, the proceedings relative to which remain of record in Lycoming county, since said proceedings were had, Clinton county was erected including that part of Lycoming county, in which Jackson resides, and in which his estate lies, therefore, the commission is to send record of proceedings to the Clinton county common pleas court. 2 Jul 1842. 108. An act relating to the Claims of SAMUEL S. BARTON, and others, and for other purposes. That the state treasurer is hereby authorized to pay to S.S. Barton, the sum of $59.75 which shall be in full of his retained per centage on the Juniata division of the Pa. canal. Whereas, a mistake was made in the final estimate of the work done by THOMAS COLLINS on the Gettysburg extension of the Pa. Railroad, therefore, the canal commissioners are hereby directed to examine the accounts and correct the same for the amount due. That the canal commissioners are hereby authorized to examine into the claim of D.M. BULL, contractor for section #27 and lock #7 on the Tioga Division of the North Branch Extension, Pa. canal, and if the damage was caused by the failure of the commonwealth, then to allow such compensation to him as they deem proper, covering the buildings and tools and materials caused by the flood in Mar 1841. That the canal commissioners are hereby required to examine and adjust the claim of GEORGE D. FOREMAN, for work done and materials furnished on his contract, for the completion of the dams #4 and 5, and for raising the towing path on the Beaver Division of the Pa. canal. That BENJAMIN WITMER JR. of Lancaster county, trustee of ELIZABETH HUNSHBERGER, under a deed of trust executed by ABRAHAM HUNSHBERGER, on 26 Feb 1834, is hereby authorized after the settlement of his account as trustee to pay over and transfer unto Abrahm Hunshberger, the husband of Elizabeth Hunshberger, all moneys, goods and evidence of property, belonging to the trust estate of Elizabeth Hunshberger. 8 Jul 1842. 109. An act to incorporate the Farmers Mutual Fire Insurance Company of Philadelphia and Bucks counties, and for other purposes. That WILLIAM B. VANDERGRIFT, JAMES CARTER, JACOB SHERER, GEORGE HARRISON, JOHN P. TOWNSEND, CYRUS PIERCE, CHARLES KNIGHT, JESSE JAMES, JAMES TOWNSEND, SETH KNIGHT, JOSIAH WALTON, EZRA CROASDALE JR., and SAMUEL KIRK are hereby constituted to be one body politic and corporate for the purpose of insuring their respective dwelling houses, barns, stores, shops and other out buildings, household furniture, agricultural products, merchandize and other property against loss or damage by fire. 9 Jul 1842. 110. An act regulating election districts and for other purposes. That the qualified voters of the township of Shade, Somerset county, shall hold their elections at the house of GEORGE SPECHT. An act to annul the marriage contract of EMILY ALBRO and WILLIAM ALBRO, of the county of Luzerne. That the marriage contract between Emily and William Albro, of the county of Luzerne, is hereby annulled and made void, and the parties released from all duties as fully as if they had never been joined in marriage. We do certify that the above bill was presented to the Governor on 29 Jun 1842 and was not returned within 10 days after it had been presented to him, wherefore, it became a law as if he had signed it. That the trustee of the residuary estate of Hugh Roberts, dec. late of the township of the Northern Liberties, Philadelphia county, devised by his last will dated 30 Apr 1827 and the codicil thereto, are hereby authorized to purchase at sheriff's sale any real estate for the security of any debt due or owing the testator, and to sell from time to time the same for cash, which shall be held for trusts in the will. etc. That JAMES WELLS JR., and PHILIP J. That JAMES FINNEY, guardian of SARAH REZNOR, ROBERT REZNOR, ELIZABETH REZNOR, SAMUEL RAZNOR, SUSAN REZNOR, and MARY AGNES REZNOR, minor children of JAMES REZNOR, late of Hartley Twp., Union county, dec. is hereby authorized to vest the money of the minors, $590.00 in the purchase of real estate adjoining other lands of the minors. Whereas, DAVID WHITE, complains that serious damage had been done, by the construction of a dam on the Neshanock creek, adjoining the borough of New Castle, and by the canal and guard lock on the side of the creek adjoining the property of David White, he being deprived of the use of a valuable water power, and as he has not asked damages, but desired as a right a share of the surplus water not needed for public use. The canal commissioners are hereby required to examine into the claim of David White, of Beaver county, for a share of the surplus water not needed for public use, and if his claim is just, they shall award him his proportion of the surplus water, as far as it can be done without injuring or impairing the public works. That JOHN REED, SAMUEL GALBRAITH of Westmoreland county, and R.T. THOMPSON of Indiana county, are hereby appointed commissioners to view, lay out and mark a state road, beginning at the borough of New Salem, in Westmoreland county, thence by way of JOHN BOARDS and WILLIAM MCQUAID's mills, to intersect the graded raod leading from Saltsburg to Indiana, in Indiana county, near the house of ADAM THOMPSON. Whereas, JAMES GRUGAN, ALEXANDER GRUGAN, NATHAN M'LOSKEY, JAMES FAREWELL and MARY RITCHEY, of the county of Clinton, have complained that by reason of the construction of the dam across the West Branch, of the river Susquehanna, at Queens Run, a slack water has been formed above said dam, which is the receptacle of large bodies of ice, which causes the water to overflow the farms situate along the pool of the dam, that the farms were overflown and laid waste in consequence of the erection of the dam, that their houses and barns were swept away with their contents, and their personal property was very materially injured. Therefore, the canal commissioners are hereby authorized to examine the claims and if true, they are authorized to allow them the amount of damages sustained. That the canal commissioners are hereby authorized to examine the claim of WILLIAM BEVANS, contractor on section 147, Tunkhannock division, North Branch canal, and settle and pay him according to the last contract, for all work done and to pay amount ascertained. That the commissioners of the county of Washington, are hereby authorized to grant to JAMES HOLMES, late collector of county and school tax, for the years 1837 and 1838 and also 1838 and 1839 for West Finley Twp., a warrant to collect any deficiency of tax for said years, which remains uncollected. That the Governor is hereby authorized to commission CHARLES W. FISHER of Berks county, as third lieutenant of the National Greys, of the borough of Reading. 16 Jul 1842. 117. An act concerning various purposes. That EDWARD B. HOSKINS, son of GEORGE HOSKINS of Chester county, shall have and enjoy all the rights and advantages of a child born in lawful wedlock, as fully as if he had been born in lawful wedlock. Whereas, a tax was levied on the township of Swatara, Dauphin county, for the education of poor children, amounting to $67.84, and has been collected by ROBERT R. ELDER and since that time said township has accepted the common school system. Therefore, Robert R. Elder is authorized to pay said sum into the hands of the treasurer of the school district to be applied in aid of the common school fund. Whereas BENJAMIN B. COOPER, died seized of a large body of unseated lands, situated in the county of M'Kean, and also of other unseated lands which he held in trust for the use of his children, after they should arrive at the age of twenty-one years. By his last will and testament, devised all his lands to RALPH V.M. COOPER, SARAH ANN COOPER, (now SARAH ANN LEE) and WILLIAM M. COOPER, his only children and heirs in equal proportions, and directed his executors to sell and convey the same and apply the proceeds to their respective uses. Whereas, CHARLES C. GASKILL and Ralph V.M. Cooper, the acting executors named in the will have affected a contract of sale of a large body of lands, including 3863 acres of that portion held by Benjamin B. Cooper, dec in trust. The said Ralph V.M. Cooper having arrived at the age of twenty-one years, sold and conveyed his undivided interest in said lands to ISAAC STOKES, who approves and joins in the contract of sale made above, by the executors of the remaining undivided two third parts, and Sarah Ann Cooper, now Sarah Ann Lee, having arrived at the age of twenty-one together with her husband FRANCIS P. LEE approves the contract of sale. And whereas, William Cooper, now of the age of eighteen years and his guardian RICHARD W. HOWELL approve of the sale and desire that the same be carried out and perfected on the part of William M. Cooper, and the lands be conveyed clear of any incumbrance. The executors are authorized to sell and convey the land mentioned above. That there shall be established in the borough of Clarion, in the county of Clarion, a female seminary or public school for the education of female youth, in the English and other languages, and in the useful arts, sciences and literature, by the name of Clarion Female Seminary. CAREY of the city of Philadelphia, SAMUEL BELL, GEORGE D.B. KEIM and DR. LUTHER of Berks county, and G.G. PALMER, HUGH KINSLEY, JOHN PINKERTON, BURD PATTERSON and CHARLES ELLET of Schuylkill county, are hereby appointed commissioners. That it shall be lawful for OLIVER BROOKS, guardian of SARAH BROOKS CORNISH, and THOMAS H. BROOKS of Philadelphia city, and MARY MARTIN of Lycoming county, widows of soldiers of the revolutionary and Indaian wars, forty dollars each immediately as a gratuity and an annuity of forty dollars to each during life, payable half yearly, to commence on 1 Jan 1842. That EZRA STILES ELY, formerly of the city of Philadelphia, clergyman, trustee under a trust dated 29 Apr 1837 and recorded in Deed book S.H.F. #15, page 49, is hereby authorized to sell and to make a deed of conveyance, for a lot in the district of Spring Garden, Philadelphia county, with the church edifice and school house thereon erected. Whereas, JACOB MUFFLY and GEORGE MUFFLY are the owners of 3/4 of several contiguous tracts of land situate in Upper Mount Bethel Twp., Northhampton county, formerly owned by a number of persons then residing in Philadelphia and New Jersey, who are now deceased or have disposed of their interests, in such manner that the title cannot be traced and their portions are exceedingly small. Therefore, a writ of partition may be sued by Jacob and George Muffly against any person who shall be in possession of any part, and the court shall examine the title and give judgement, said judgement shall be valid. An act to provide for the education of the poor, in the non-accepting school districts of this commonwealth, and for other purposes. That the territory contained within the following boundaries, partly in Pinegrove twp., Venango county, and partly in Pinegrove twp., Clarion county, shall hereafter form a separate school district to be known by the name Pingrove district #2. Commencing at the house of ADAM KORB, in Clarion county, southwest to the house of DANIEL SWAB in Venango county, south to the house of BENJAMIN KEEFER, thence south west to the house of JOHN HAYBARGER, south to the house of ISAAC BECK, thence east to the house of ADAM SWAB, thence north east to the house of GEORGE KICKENBROAD, Clarion county, thence east to the house of GEROGE HOLT, thence north to the house of SAMUEL ZINK ESQ. That the qualified electors of Heidelberg twp. in the county of Lehigh, shall hold their elections at the house of OWEN SAYER. That the electors of North Butler twp., in the county of Butler, shall hold their elections at the court house in ROBERT GRAHAM and ABIJAH EVANS, shall be the inspectors. That so much of Aston Twp. Delaware county, as is now included in the following boundries, beginning at a corner of THOMAS Y. BRINTON's land, intersecting the southern line of Thornbury twp. to a corner of ABRAHAM W. SHARPLESS' farm, near Stony Bank meeting house, thence along the line of the farm of the heirs of THOMAS PENNEL, dec. east to Chester creek, etc. Hereafter the limits of the borough of Gettysburg, shall be extended as follows: near the lands of HENRY WASMUS, to lands of ROBERT SMITH, JOHN BARRETT and DAVID M'MILLEN. That the canal commissioners are hereby authorized to examine the claim for damages of WILLIAM SEARIGHT, Dripps and Ferguson, contractors on the Erie extension of the Pa. canal, occasioned by the suspension of the work on their contracts, also for work done, unjustly estimated by the engineer, and settle the same. The Twentieth section of an act passed 14 Apr 1838, as authorizes an action of ejectment pending in the court of Common Pleas of Schuylkill county, wherein HAMMOND DUGAN and others are plaintiffs, and HENRY W. CONRAD and others defendants, to be removed into the court of an adjoining county, is hereby repealed. That an act passed the 23 Jun 1842, entitled an act to authorize THOMAS GARDNER, BENJAMIN J. MILLER and ISAAC COATS, to sell and convey certain real estate, be so amended that the names Thomas Gardner and Isaac Coats, shall read THOMAS H. GARDNER and JESSE COATS. That all the acts, service of writs, or other done or executed by WILLIAM SHAW, as deputy of GEORGE MEASON, late high sheriff of Fayette county, are hereby declared legal and valid, as if William Shaw had been legally deputed and sworn according to law. 30 Jul 1842. 129. An act for various purposes. The qualified voters of Monongahela twp., in the county of Greene, will hold their election at the house now occupied by JOHN JONES, in the town of Greensboro. The auditors of the county of Tioga are hereby authorized to settle the accounts of JOHN COCHRAN, AARON BLOSS and JACOB S. KOHLER, commissioners appointed to lay out the state appropriation on the road from Blossburg to the Lycoming county line, through Liberty Twp., with power to compel the attendance of witnesses. That the state treasurer be directed to pay to BERNARD FLYNN, late a contractor for section #3 on the Columbia and Philadelphia railroad, the sum of $120.00 the balance due him on settlement of his accounts. That JAMES DUNCAN and JOHN MORRISON of Fawn twp., York county, are hereby authorized to sell all the real estate of JOHN IRWIN, late of the township aforesaid, dec. containing 150 acres, adjoining lands of ANDREW SWITZER, HUGH MCDONALD, JOHN W. LAIRD and others, and to make title to the purchaser. They shall pay over the balance of the money to the children of John Irwin and to the guardians of such as are minors, to be disposed of for their use, according to the last will and testament dated 2 Jan 1838. That the qualified voters of the township of Damascus, Wayne county, shall hold their elections at the house of JOHN N. LUKENS. Whereas, by a joint resolution of the legislature, passed 14 Apr 1835, JAMES PEACOCK, O.F. JOHNSON and WILLIAM AYRES were appointed commissioners to survey and lay out a street from the State Capitol grounds to the Pa. canal and the commissioners have long since completed the street and damages of private property assessed and paid for, the commissioners claim the balance of $208.70 for their compensation. Therefore, the auditor general is directed to allow them to retain for their compensation the sum of $208.70. That ISAAC HEYLIN of the city of Philadelphia, trustee of LOUISA M. DUNCAN is hereby authorizd to dispose of any of the lots of ground situate in Hamiliton village, Blockley Twp., Philadelphia county, devised to him in trust by JOHN CREAN SEN. by his last will dated 25 Apr 1832, and make a full and complete title to the purchaser. The proceeds after discharging the liens on the lots, which were for paving, curbing, or taxes up to the time of the sale, shall be held by Isaac Heylin and invested by him. That the township of Portage, in the county of Potter, shall from a separate election district, and the qualified voters shall hold their elections at the house of HIRAM SIZER. That WILLIAM AYRES, JACOB M. HALDEMAN, CHRISTIAN SEILER, SAMUEL POOL, AARON BOMBAUGH, FREDERICK K. BOAS, MICHAEL BURKE, SAMUEL H. CLARK, GEORGE S. KEMBLE, WILLIAM CATRELL, JOHN C. BUCHER, CHARLES F. MUENCH and HERMAN ALRICKS are hereby appointed commissioners of a company called the Harrisburg Fire Insurance company. That GEORGE W. SMITH, a minor child, now living with George W. Smith of Butler, shall be entitled to all the rights and privileges of a child born in lawful wedlock. That JEREMIAH M. CARPENTER and ZACHARIAH G. STEWART, of the county of Westmoreland and DAVID CLEMENTS of the county of Allegheny, are hereby authorized to review that part of the state road leading from Logan's Ferry, in Allegheny county, to a point on the road from Greensburg to Chalfants near the farm of MCKEMERY, five miles west of Greensburg, lying between the town ofMurrysville and SILVEY's blacksmith shop, and to change the location of the road. 2 Aug 1842. RESOLUTIONS 4. A resolution relative to lots in the borough of York. By deed dated 11 Jun 1816, the proprietors of Springetsbury Manor granted to the burgesses and inhabitants of the borough of York, a tract of ground, situated in the borough, bounded by lands of SAMUEL ILGENFRITZ, CHRISTIAN HILDEBRAND, and IMFELT's heirs, 20 acres of land to be kept as open public common forever for the use of the borough. Residents of York are requesting lots be sold, therefore the legislature does consent to the sale. 2 Mar 1842. 6. A resolution relative to elections. That the qualified voters of Porter Twp. in the county of Clarion, shall hold their elections at the house of ALEXANDER PAINE, now occupied by JOHN B.B. LORD. 7. A resolution in certain criminal prosecutions against GEORGE HANDY. That the attorney general is hereby authorized to enter a nolle prosequi in any criminal proceedings, in any court, against George Handy on account fo any act or participation by him in obtaining any money from the United States Bank of Pa., or conspiring with any person to influence the action of the Legislature or Executive, in 1840, provided George Handy shall appear before either branch of the legislature and testify all his knowledge in relation to said transaction. 29 Mar 1842. 9. A resolution authorizing the payment of certain moneys to the widow of JOHN B. MENOUGH. Whereas, John B. Menough, late a car agent upon the Philadelphia and Columbia railroad, died in consequence of injuries received by a car running over him whilst engaged in the service of the Commonwealth. There was due him $50.87 for forty-four days service, and it appears that the same is the only known debt due form any source to the estate, and the expense of administering to the estate by the widow would amount to nearly the sum which is due. That the superintendent of motive power is hereby authorized to pay to the widow of John B. Menough, MRS. MENOUGH, the sum due the deceased. 5 Apr 1842. 21. A resolution concerning various purposes. That the right of the Commonwealth to the real estate of which DAVID HAMILTON alias DAVID CROUCH, dec. died seized and which estate has escheated to the commonwealth is hereby vested in the administrator of the estate in trust. The administrator shall have full power to sell all the real estate situate in Nottingham Twp., Washington county, adjoining lands of JOHN HAMILTON and ANDREW BAITTY, heirs of SAMUEL MUNN, JAMES MCMURRY, JOHN MUNN and LEVERTON THOMAS, containing 86 acres and 96 perches, and out of the proceeds, first pay all legal demands against the decedent and the balance to be paid over to RACHEL HAMILTON, mother of the decedent. 7 Jul 1842. 22. A resolution relative to the distribution of the colonial records, and for other purposes. That copies be distributed to the Senate and House of Representatives, officers of both houses, colleges and public libraries.
