PORTER, Governor JAMES ROSS SNOWDEN, Speaker of the House of Representatives. WILLIAM BIGLER, Speaker of the Senate. 1. An act to annul the marriage contract of EVE HAMILTON and WM. HAMILTON. That the marriage contract entered into between Eve Hamilton, of Franklin county, and William Hamilton is hereby annulled and the parties released from all legal duties as if they had never been joined in marriage. We do certify that the above bill was presented to the governor on 17 Apr 1843, and was not returned within three days after the meeting of the present legislature, wherefore it has become a law as if he had signed it. That the marriage contract entered into between Lydia M'Whorter of Adams county, and John M'Whorter is hereby annulled and the parties released from all legal duties as if they had never been joined in marriage. We do certify that the above bill was presented to the governor on 12 Apr 1843, and was not returned within three days after the meeting of the present legislature, wherefore it has become a law as if he had signed it. MILLER of Crawford county, and MARY ANN MILLER his wife. That the marriage contract entered into between Dr. Hiram C. Miller of Crawford county, and Mary Ann his wife, is hereby annulled and the parties released from all legal duties as if they had never been joined in marriage. We do certify that the above bill was presented to the governor on 18 Apr 1843, and was not returned within three days after the meeting of the present legislature, wherefore it has become a law as if he had signed it. That the marriage contract entered into between John F. Millen, of Berks county, and Catharine his wife, is hereby annulled and the parties released from all legal duties as if they had never been joined in marriage. We do certify that the above bill was presented to the governor on 18 Apr 1843, and was not returned within three days after the meeting of the present legislature, wherefore it has become a law as if he had signed it. That the qualified electors of Perry county, residing in the following bounds, including parts of Tyrone, Seville and Madison Twps., beginning at Sherman's Creek, opposite Bowers' mountain, thence to Centre township line, on the coaling ground of ____ LOY, ______ EVERHART and _______ KOUGH, thence between Tyrone and Centre, to the top of the ridge north of JACOB TURNBAUGH in Seville, thence by the ridge to ADAM WOLF, thence by a line to the great road north west of JACOB BIXLER, so as to include JONATHAN MIRRICH, thence straight to the summit of Bowers' mountain, to include ALEXANDER M'CLURE and DAVID SHAFFER, thence to the beginning, to include PETER BOWER, shall form a separate election district, and hold their elections at the school house in Andersville. That the qualified electors residing in Franklin twp., Huntingdon county, shall hold their elections at the house of JACOB MATTERN, now occupied by GEORGE W. MATTERN. That the qualified electors residing in Bradford twp., Clearfield county, shall hold their elections at the house of WILLIAM HOOVER. That the qualified electors residing in Redbank twp., Armstrong county, shall hold their elections at the house of ADAM SMITH. That part of West Salem twp., Mercer county, situate north of a line, beginning on the west line of Salem twp., west by DAVID SHERBAUDY's land, to the Ohio state line, is hereby erected into a separate twp., to be called Green, and the electors shall hold their elections at the public house now occupied by JOHN KERR, in the village of Jamestown That the qualified electors residing in the south ward of the borough of Chambersburg, Franklin county, shall hold their elections at the public house now owned and occupied by JOHN RADEBAUGH. That the qualified electors residing in Middle Creek twp., Union county, shall hold their elections at the public house of JACOB MOORE, now occupied by ABRAHAM FREDERICK. That the borough of Birmingham, with several tracts of land, now owned or occupied by THOMAS M. OWENS, JOHN K. M'CAHEN, ANDREW ROBESON, JOHN GUISEMER and WILLIAM GUISEMER, situate in the township of Warrior Mark, Huntingdon county, shall constituate a separate township election, and school district. That the qualified voters shall hold their elections at the public school in Birmingham; that JOHN NEVLING and JOHN GRAFFIUS, inspectors, and JOHN CALDERWOOD, judge, are declared lawful officers of elections. The qualified voters of the new township of Franklin, Columbia county, shall hold their elections, at the school house, near the house of JOHN MENCH. That the qualified electors residing in Banks twp., Carbon county, shall hold their elections at the Beaver Meadow hotel, formerly kept by WILLIAM BRUCE. That the qualified voters of the township of Towanda, Bradford county, shall hold their elections at the school house, near the house of ANDREW C. GREGG. That the qualified electors residing in Union Twp., Huntingdon county, shall hold their elections at the school house near NATHAN GREENLANDS. That the qualified electors residing in Derry twp., Westmoreland county, voting at the town of New Derry, shall hold their election at the house of EDWARD LATON. That the qualified electors residing in Middle Smithfield twp., Monroe county, shall hold their elections at the vacant store house, near MOSES W. COOLBAUGH's. That the qualified electors residing in Armenia twp., Bradford county, shall form a new election district, and hold their elections at the house now occupied by LYMAN HINMAN. That the qualified voters of the south part of Delaware twp., in Mercer county, which heretofore held their elections in the borough of Mercer, shall hereafter hold their elections together with the electors of the north part of the township, at the house of ROBERT M'KEAN. That the qualified electors of Little Beaver twp. Beaver county, who have heretofore held their election at the house of A. Reed, shall hereafter hold them at the house of JOHN S. M'COY. That hereafter the citizens of East Pennsboro twp., who heretofore voted at the public house of ANDREW KREITZER, Cumberland county, shall hold their elections at the public house of Andrew Kreitzer, on the south side of the turnpike leading from Harrisburg to Carlisle. That the qualified voters of Centre twp., Butler county, shall hold their elections at the house now occupied by JOHN SUTTON and JESSE SUTTON. That so much of the townships of Heidelberg and Jackson, Lebanon county, lying east of a line beginning at the Lancaster and Lebanon line, at the forks of a public road adjoining lands of MICHAEL SHARP, Heidelberg twp., thence to a post on the Jackson twp. line near the house of CATHARINE MILLER, thence to the road from _____ KAPP's mill in Berks county, to the Mill creek church, Lebanon county, to be erected into a separate election district and qualified voter to hold their elections at the public house of DAVID MATTHEW in Newmanstown. E. CHERINGTON ESQ., SAMUEL BECKER and GEORGE PFLEGER, are hereby appointed commissioners to run the boundry lines for the township of Mill Creek. I do certify that the above bill, has been disapproved by the governor, and returned with his objections to the House of Representatives, in which it originated, was passed by two-thirds of the House of Representatives, on 19 Jan 1844, and is passed by the House. I do certify that the above bill which was disapproved by the governor, and returned with his objections, was approved by two thirds of the Senate, on 22 Jan 1844, and is approved by the Senate. An act directing the Leacock and Upper Leacock twps., Lancaster county, be each a separate election district, and for other purposes. That the township of Leacock, Lancaster county, shall be a separate election district and the qualified voters shall hold their elections at the house of JACOB RUTTER. That DAVID GRAFF, is hereby appointed judge, and WILLIAM MANAHAN and ELI RUTTER, inspectors. That the township of Upper Leacock, Lancaster county, shall be a separate election district, and the qualified voters shall hold their elections at the house of FREDERICK SWOPE. That JOSEPH WENGER, is hereby appointed judge, and SAMUEL JOHNS and REUBEN WEIDLER, inspectors. 26 Jan 1844. 12. An act relative to the sale of the real estate of JOHN MATHEYS deceased. Whereas JACOB SLOUGH SR., late of Montgomery county Pa., dec., who died in the year 1826, intestate, leaving a widow, CATHARINE SLOUGH SR., and seven children: JACOB SLOUGH, MARGARET SLOUGH intermarried with JONAS RAMBO, ELIZABETH SLOUGH, JOSEPH SLOUGH, CATHARINE SLOUGH, SARAH SLOUGH and REBECCA SLOUGH, all of whom were of full age, at the time of his death, seized of a certain messuage and tract of land, situated in Norriton twp., Montgomery county, containing 100 acres and 122 perches. In consequence of the personal estate not being sufficient to pay his debts, his widow and children, by letter of attorney, dated 1 Aug 1826, duly executed and appointed Jacob Slough and MATHIAS BRUMBACK, the administrators of Jacob Slough Sr., dec. to sell and convey the above land and out of the purchase money to pay the debts and distribute the residue among the heirs. Whereas, Jacob Slough and Mathias Brumback, sold the land to John Matheys for the sum of $3625.00 and together with Jacob Slough and SUSAN SLOUGH his wife, delivered a deed conveying the land dated 2 Apr 1827, and duly recorded same. The whole of the purchase money was paid, debt paid and remaining money distributed and bond dated 15 May 1827 acknowledging the receipt thereof. John Matheys, died seized of the tract of land, with other real estate, having first made his last will and testament, dated 31 Dec 1836, by which he directed his executors to sell his farm, including the above mentioned messuage and land who sold the premises to THOMAS OWEN. And as doubts have arisen about the deed was duly executed by Jacob Slough and Mathias Brumback, and whereas, MARGARET RAMBO, one of the children of Jacob Slough Sr., dec., who received her full share is now dead and leaving minor children, and there is no person authorized to execute a release, on their part to remove the supposed defect in the legal title, therefore, Jacob Slough and Mathias Brumback, administrators, are authorized to make and execute a deed to the executors of John Matheys, for the tract of land, and any declaration which may be deemed necessary to perfect the title to the purchaser. 29 Jan 1844. 13. An act to incorporate the Farmers' mutual insurance company in the county of Lancaster. That JOHN M'CARTNEY, JOHN STROHM, JOHN ROHRER, FRACIS HERR and JOHN MUSSELMAN, are hereby constituted and declared a body politic and corporate. The object of the company is the insurance of their respective dwelling houses, stores, shops and other buildings, household furniture, goods and chattels against loss or damage by fire. 31 Jan 1844. 18. An act relative to the claim of JOSEPH MORRISON of Crawford county. Whereas, an act passed 8 Apr 1843, that no claim will be entered in the books after 1 Dec 1843, for sale of state stocks, and the claim of Joseph Morrison has been settled, but the same was neglected to be entered at the time stated, therefore the state treasurer is authorized to pay such sum as has been ascertained to be due. 5 Feb 1844. 23. An act authorizing NEVILLE B. CRAIG, committee of SIDNEY GREGG, widow of ISAAC GREGG, and the children and heirs-at-law of Sidney and Isaac, to borrow money on real estate. Whereas, on 1 Apr 1837, an act authorizing Neville B. Craig, committee of the person and estate of Sidney Gregg, widow of Isaac Gregg, late of the county of Allegheny, O.O. GREGG, ISAAC GREGG, SARAH E. GREGG and SIDNEY J. ROBINSON, formerly SIDNEY J. GREGG, children of Isaac and Sidney Gregg, to sell certain lots situate in the township of St. Clair, adjoining the borough of Birmingham, Allegheny county, known and designated in a plot of lots recorded in the office for recording of deeds. In consequence of the depreciation in the value of real estate, it is not deemed advisable, to make the sale thus authorized; and it has been represented by Neville B. Craig and the children, all above the age of 21, to raise on the mortgage of the property such sum of money for the purposes either of discharging the debts, improving the property, or re-investment for the benefit of all. Therefore, Neville B. Craig, O.O Gregg, Isaac Gregg, MOSES F. EATON and SARAH EATON his wife, formerly Sarah E. Gregg, and JOHN G.B. ROBINSON and Sidney his wife, are hereby authorized to borrow, any sum and to secure the re-payment by mortgage of the property. 12 Feb 1844. 24. An act to confer on MELINDA FILBERT the rights and privileges of a child born in lawful wedlock. That Melinda Filbert, of the township of Upper Tulpehocken, Berks county, daughter of ELIZABETH KLEIN, who after the birth of Melinda, was legally intermarried with DANIEL FILBERT, the father of Melinda, shall have all the rights of a child born in lawful wedlock, as fully as if she had been born in lawful wedlock. 13 Feb 1844. 25. An act directing that the borough of Clearfield, Clearfield county, shall be a separate election district. The borough of Clearfield bounded: Beginning on the river Susquehanna, along the river to land owned by MATTHEW OGDEN, .... thence along the line of land surveyed in the name of CHARLES SMITH to the river, is hereby erected into a separate election district and the qualified voters of this district shall hold their elections at the court house. 13 Feb 1844. 27. An act to change the name of a certain young lady therein named. That CLARISSA TAYLOR, of the borough of Franklin, Pa. is hereby authorized to change her name to CLARISSA TAYLOR HOWE, to all intents as if no change had been made. 16 Feb 1844. 28. An act to incorporate the borough of West Philadelphia. That the township of Blockley, Philadelphia county, on the westwardly line of Hamilton village and the Darby road, thence west to Chestnut St., thence to the river Susquehanna river,..... to the north line of HUGH M'ILVAIN's property,... to the eastwardly line of the late _____ CREAN's estate,..... to the eastwardly line of _____ ROSE's estate etc. That HENRY LEECH, H.G. FREEMAN, JACOB BROOM, RICHARD M'ILVAIN, JAMES HANNA, JAMES TWADDELL, are hereby appointed commissioners. 17 Feb 1844. 29. An act to confer on CATHARINE PIKE the rights and benefits of a child born in lawful wedlock. That Catharine, now the wife of JAMES PIKE, and daughter of GEORGE MILLER, of Northmoreland twp., Wyoming county, shall have and enjoy all the rights of a child born in lawful wedlock, as fully as if she had been born in lawful wedlock. 17 Feb 1844. 31. An act to enable CATHARINE KEMP, the wife of JACOB KEMP, of Oley township, Berks county, to dispose of her real estate by will. Whereas, Catharine Kemp, of Oley twp., Berks county, intermarried with Jacob Kemp, holds in her own right, a tract of land situate in Berks county, containing 500 acres, and as she is desirous of disposing of her real estate by will, and Jacob has signified his assent, therefore, she is hereby authorized to dispose of her real estate by will, as if she were feme sole and unmarried. 17 Feb 1844. 34. An act to authorize the register of wills, in the county of Adams, to admit to probate the nuncupative will of THOMAS M'KEE, deceased. That the muncupative will of THOMAS M'KEE, late of Liberty twp., Adams county, dec., shall be admitted to probate and the estate in the will, devised or bequeathed, shall be held, possessed, enjoyed and disposed of by the persons to whom the same was devised, as if the will had been in writing. 24 Feb 1844. 35. An act to authorize SAMUEL HOLSTEIN to collect certain ground rents. That THOMAS PRICHETT, of the city of Philadelphia, trustee of ABRAHAM R. PRICHETT, JOSEPHINE TIMLOW, late JOSEPHINE PRICHETT, and ANNA E. HOLSTEIN, late ANNA E. PRICHETT, is hereby authorized and required to pay over to Samuel Holstein, assignee of Abraham R., Josephine and Anna E., all moneys received by Thomas Prichett, as trustee from certain rents and ground rents, arising out of a certain trust created by the last will and testament of ANNA CATHARINE PRICHETT, late of the city, dec. and by the same will directed to be laid out and expended in improving certain real estate, devised by the will, in trust for the use of Abraham R., Josephine, and Emma E. for life. If Thomas Prichett refuses, he may be sued to obtain the money. 24 Feb 1844. 41. An act authorizing the state treasurer to refund to the REV. DR. JOSEPH M'ELROY, certain moneys erroneously paid by him into the state treasury. That the state treasurer is hereby authorized to refund to the Rev. Dr. Joseph McElroy, the sum of $68.75, the said amount having been erroneously paid into the state treasury, as collateral inheritance tax on the estate of MRS. SARAH MCELROY, late of the city of New York, deceased. 26 Feb 1844. 43. An act authorizing the laying out of a state road from the Three Springs, on the Bald Eagle and Punxatawney state road, Centre county to the road leading from Ebensburg to Phillipsburg, near the house of RICHARD DAVIS, Clearfield county. That DAVID FURGESON, SAMUEL WHITESIDE and SAMUEL HAGERTY, of Clearfield county, are hereby appointed commissioners to view and lay out a state road. 26 Feb 1844. 44. An act authorizing the canal commissioners to examine and adjust the claim of the heirs of DOCTOR JAMES TRIMBLE, for damages done their property. The canal commissioners are to examine and adjust the claim of the heirs of Doctor James Trimble, of Huntingdon county, dec. for damages don to lots #760, 761, in the fourth district of donation lands in Mercer county, by reason of the location and construction of the Erie extension of the Pa. canal, by overflowing the same and the state treasurer is required to pay the adjusted amount. 26 Feb 1844. 45. An act to erect the township of White, Indiana county, into a separate election district. That SAMUEL TRIMBLE, is hereby authorized to act as judge, and ROBERT MCLANAHAN and JOHN RICE as inspectors of the elections. 26 Feb 1844. 48. An act to confer on CATHARINE HINES, JOHN HART, MARY HART, BARBARA HART, ANN HART and MARTHA HART the rights and privileges of children born in lawful wedlock. That Catharine Hines, John, Mary, Barbara, Ann and Martha Hart, shall have and enjoy all the rights of children born in lawful wedlock, as fully as if they had been born in lawful wedlock. 28 Feb 1844. 49. An act authorizing REV. FRANCIS PATRICK KENRICK to convey to MICHAEL O'CONNOR certain properties for the uses and trusts therein mentioned. Certain lands, tenements and other property have been conveyed to the RIGHT REVEREND HENRY CONWELL, late the Roman Catholic bishop of Philadelphia and also unto the Right Reverend Francis P. Kenrick, the new bishop of Philadephia, upon the trust to transmit the same to the successors for the use of the congregation. As the dishopric of Philadelphia has been divided, and Rev. Michael O'Connor has been appointed the bishop of Pittsburg, therefore any grants, deed, etc. held by either may be conveyed by deed by either bishop or their successors. 28 Feb 1844. 50. A supplement to the acts of assembly relating to the real estate of CHARLES WHARTON, late of the city of Philadelphia, deceased. That WILLIAM WHARTON, the remaining trustee appointed by the will of Charles Wharton, late of the city of Philadelphia, dec. for that part of his real estate which was devised by him, in trust, for his daughter HANNAH HOLLINGSWORTH, her husband and children, shall be invested with the power conferred upon the trustees by an act passed 20 Jan 1841 and amended 23 Apr 1841. 2 Mar 1844. 52. An act relating to the borough of Shippenburg, in the county of Cumberland. That the lot, the property of HUGH CRAIG, situate in the borough of Shippensburg, Cumberland county, containing 1 acre and 140 perches, which is divided from the residue of his farm, is hereby made a part of Shippensburg township, as is his farm for the remedy for the collection of taxes. 2 Mar 1844. 56. An act to annul the marriage contract of JAMES A. M'ALLISTER and ELIZABETH M'ALLISTER his wife. That the marriage contract entered into by James A. M'Allister and Elizabeth his wife, late ELIZABETH ALLEN of Crawford county, is hereby annulled and the parties released as fully as if they had never been joined in marriage. We do certify that the above bill was presented to the governor on 26 Feb 1844 and was not returned within ten days wherefore it became law as if he had signed it. An act to authorize the settlement of the claims of CHARLES FULLER for work done on section #183, North Branch extension of the Pa. canal. The amount of retained percentage due the contractor of section #183 on the North branch extension of the Pa. Canal has never been paid, the contractor having neglected to file his demand and procure a certificate of indebtedness from the auditor general, therefore, the auditor general is hereby authorized to enter a credit in favor of Charles Fuller, for the amount due him. 9 Mar 1844. 58. An act regulating election districts. That the qualified voters of the township of Fox, Clearfield county, shall hold their elections at the house of JOHN J. BUNDY. That the qualified voters of Cherry twp., Butler county, shall hold their elections at the house of JOHN THOMPSON. That the qualified voters of Deerfield Twp., Warren county, shall hold their elections at the house of JOSHUA TURNER. That Eldred twp., Warren county, shall be a separate election district, and the qualified voters shall hold their elections at the house of NOAH HAND. That the township of Ceres, M'Kean county, shall be a separate election district and the qualified voters shall hold their elections at the house of F.W. Leonard. That the township of Jackson, Monroe county, shall be a separate election district, and the qualified voters shall hold their elections at the house of JOSEPH FELKER. That Beaver Twp., Union county, shall be a separate election district and the qualified voters shall hold their elections at the house of SIMON FRANK in Beavertown. That the township of Lewis, Northumberland county, shall be a separate election district, and the qualified voters shall hold their elections at the of MICHAEL READER, in Turbetville. That Turbet twp., Northumberland county, shall be a separate election district and the qualified voters shall hold their elections at the house of ABRAHAM KISSINGER. That Delaware twp., Northumberland county, shall be a separate election district and the qualified voters shall hold their elections at the house of HENRY READER, in McEwensville. That the qualified voters of Concord twp., Erie county, shall hold their elections at the house now occupied by SIMEON STEWART. That the qualified voters of Limestone twp., Warren county, shall hold their elections at the school house near HENRY M'GEE. That the qualified voters of the township of Red Bank, Armstrong county, shall hold their elections at the house of JOHN THOMPSON. That the qualified voters of the township of Franklin, Armstrong county, shall hold their elections at the house of JOHN M'DONALD ESQ., in the town of Worthington. That the township of Cogan House, Lycoming county, shall be a separate election district, and the qualified voters shall hold their elections at the house now occupied by JOSEPH STRYKER. That Fairfield twp., Lycoming county, shall be a separate election district, and the qualified voters shall hold their elections at the public house now occupied by WILLIAM TOMLINSON, in Monturesville. That the qualified voters of Hanover twp., Luzerne county, shall hold their elections at the house now occupied by ISAAC G. GULICH. That the qualified voters of Hopewell Twp., Beaver county, shall hold their elections at the house now occupied by DANIEL M'ALLISTER, in the town of Independence. That the qualified voters of the township of Cattawissa, Columbia county, shall hold their elections at the house of STACY MARJORAM, in the town of Cattawissa. That the qualified voters of Armenia twp., Bradford county, shall hold their elections at the house of WIGHTMAN PIERCE. That the township of Carroll, Washington county, shall be a separate election district, and the qualified voters shall hold their elections at the house of THOMAS COLLINS. That the qualified voters of Union twp., Berks county, shall hold their elections at the public house of EZEKIEL BEARD, and ballot shall determine if future elections shall be held at the public house of HARMAN UMSTEAD or Ezekiel Beard. That the qualified voters of Conewago twp., York county, shall hold their elections at the house of FREDERICK HAKE, innkeeper. That the qualified voters of Red Bank twp., Clarion county, shall hold their elections at the house of ARCHIBALD MCKILLIP. That the North ward, in the borough of Pottsville, Schuylkill, shall be divided into two wards, with Centre street the dividing line. The qualified voters of the north-east ward, shall hold their elections at the house now occupied by MAXIMILIAN DORFLINGER, and the qualified voter of the north-west, shall hold their elections at the house now occupied by NATHANIEL J. MILLS. That the farm of JACOB G. DEVORE of Londonderry twp., Bedford county, is hereby attached and connected to Harrison school district. The township of Cecil, Washington county, shall be a separate election district, and the elections shall be held at the house of ROBERT JOHNSON. The township of West Beaver, Union county, shall be a separate election district, and the qualified electors shall hold their elections at the public house of ANDREW ULSH, now occupied by ISAAC FEES. That one of the judges of the supreme court is hereby authorized to hold at the court house at Cambria, on the 4 Apr 1844, a special court of oyer and terminer, and to determine why the verdict of the jury and sentence of the court should not be set aside and a new trial granted in the case of the commonwealth against BERNARD FLANAGAN and PATRICK FLANAGAN, indicted for the murder of ELIZABETH HOLDEN. If the court shall grant a new trial, the entire record shall be removed and sent to the court of Huntingdon county, along with Bernard and Patrick Flanagan shall be sent to jail in said county. That the directors ofthe poor and of the house of employment for the county of Chester, are hereby authorized to sell, all the right and title of ANN BOYERS, now in the poor house, to any lands in which she may have any title in the county of Chester, and convey the same to the purchaser, and the proceeds to the payment of the debts of Ann Boyers and to her support and maintance, so long as she remains a charge of the county of Chester, and pay the balance, after she ceases to be a charge, or dies, to her or her legal representatives. That the commissioners of Armstrong county, are hereby authorized to convey to the Kittanning cemetery company, out lot #2, in the borough if Kittanning, held by them in trust, by virtue of a deed dated 21 Sep 1818, recorded in Vol 3, pg 42, from PAUL MORROW, and LYDIA MORROW, his wife, to ISAAC WAGLE, DAVID REYNOLDS and JOSEPH RANKIN, then commissioners, and the deed made by them to the Kittanning cemetery company, shall be good and valid. 4 Apr 1844. 129. An act to incorporate the Northern mutual insurance company of Lancaster county. That SAMUEL KELLER, J.J. KELLER, DANIEL KELLER, WILLIAM H. PAUL, ABRAHAM BEAR, JACOB HIBSHMAN, JACOB SHIRK SEN., B. SMITH, are hereby constituted to be a body politic and corporate to insure dwelling houses, stores, barns, shops and other buildings, household furniture, goods and chattels against loss or damage by fire. 4 Apr 1844. 130. An act to authorize the trustees of the Methodist church, in the town of Warren, Armstrong county, to sell and convey real estate. That JOHN ELLWOOD, JOHN COCHRAN, and HENRY CALDWELL, trustees of the Methodist Episcopal church, are authorized to sell a lot of ground, lot #15, together with the house of worship erected thereon, and convey by deed to the purchaser. An act to authorize the trustees of the Methodist Episcopal church of Edenburg, Mercer county, to sell and convey real estate and for other purposes. LLOYD, and ZACHARIAH G. BROWN, of the borough of Hollidaysburg, JOHN FREEMAN and DOCTOR SAMUEL SMITH of the city of Pittsburg, are hereby appointed commissioners to employ engineers to survey, mark out, lay down, and fix the route for the railroad, beginning at the Bennington coal mines in Sugar Gap, Allegheny twp., Huntingdon county, and terminating at the Allegheny Portage railroad, near the borough of Hollidaysburg. 5 Apr 1844. 138. An act to incorporate the Monroe county mutual fire insurance company. That JOSEPH KELLER, JOSEPH TRACH, HENRY FENNER JR., EDWARD POSTENS, PETER KELLER, JAMES BELL, BENJAMIN V. BUSH, CHARLES B. SHAW, JACOB SHOEMANKER, JOHN EDINGER, JAMES TRACH, JOHN SHIVELY and DANIEL BROWN, are hereby made a corporation, a body politic, to make insurance against losses by fire on any house, tenement, manufactory, barn or other buildings and on goods, wares, merchandize and effects and household furniture etc. 5 Apr 1844. 141. A supplement to an act incorporating a company to erect a bridge over the Lackawaxen, near Paupack eddy, Wayne county. The period limit of the act passed 6 Apr 1841, is hereby extended five years. An act authorizing BENJAMIN JONES JR., trustee of the children of THOMAS ASH, deceased, to mortgage real estate, and for other purposes. That Benjamin Jones Jr., trustee of the children of the late Thomas Ash, by virtue of an indenture dated 25 Mar 1839, between JOSEPH ASH, CALEB ASH, ALEXANDER ELMSLIE and SARAH ELMSLIE his wife, ROBERT TAYLOR and ELIZABETH A. TAYLOR his wife, SARAH E. JONES of the one part, and Benjamin Jones of the other part, recorded City and county of Philadelphia, deed book G.S. #4, page 158, is hereby authorized to raise a sum not exceeding $3500.00, by mortgage of the premises and to apply the sum to relieve a house an dlot situate in Swanson St. #144, in the district of Southwark, from a mortgage executed by JOSHUA ASH and Joseph Ash, in favor of GEORGE WILLIAMS; and it shall be lawful for REBECCA ASH, the owner of the house and lot, to apply to the court by petition setting out the facts which entitle heer to be relieved from the mortgage, agreeably to the directions of the will of Joshua Ash. The representatives of EDWARD BARTHOLOMEW and ALEXANDER A. ANDERSON, dec. and SAMUEL PATTON in his lifetime, sold serveral lots in the town of Covington, Tioga county, to JOHN GRAY and others and these lot have been improved and sold to persons who claim the rights of John Gray and others, and are in possession of the lots, but no deeds have been executed to the purchasers, therefore it shall be lawful for EPHRAIM B. GEROULD, of the town of Covington, on the receipt of purchase money still due to convey title and any moneys received shall be distributed amongst the person entitled to receive it. 6 Apr 1844. 148. An act to authorize the executors of DAVID WOLMER, deceased, to sell and convey a certain ground rent. That the executors of David Wolmer, late of the borough of Norristown, Montgomery county, dec. are hereby authorized to sell and convey any ground rent which had been granted and conveyed to David Wolmer. 8 Apr 1844. 155. An act for the relief of PETER HESS and others, recently of Fayette county, Pa. Whereas, SAMUEL MULLEN, lately of Fayette county, Pa., but now of Guernsey county, Ohio, intermarried with SUSAN HESS, a daughter of Peter Hess, in the year 1839 sold a certain tract of land situate in Fayette county to ISAAC CROW, but in consequence of her being then and ever since, non compos mentis, SUSAN MULLEN has been incapable of joining her husband in any conveyance for the tract of land to Isaac Crow, and in event of her surviving her husband, Samuel Mullen and Peter Hess, executed a bond and judgement to Isaac Crow, and it remains a lien on the real estate of Peter Hess. Therefore, JAMES FULLER, of Fayette county, uncle of Susan Mullen, is hereby appointed trustee of Susan Mullen and is to continue trustee during her unsoundness of mind, and he is required to signify his assent to the sale and conveyance, of the land sold by Samuel to Issac Crow in 1839 and a deed granted as if Susan Mullen had signed same. Peter Hess shall issue a bond to the trustee upon unincumbered real estate for the payment to Susan Mullen annually, during her life, in the event she survive her husband. 9 Apr 1844. 157. An act to incorporate Emanuel church, Holmesburg, Philadelphia county. Whereas, the rector, church wardens and vestrymen, of All Saints church, Lower Dublin twp., Philadelphia county, together with certain members of the corporation worshiping at Emanuel chapel, Holmesburg, have united for the separation of the later from the former, and grant permission for the All Saints church, to a new corporation situate in Holmesburg. Therefore, the elected rector of the church, ALEXANDER BROWN and EDWARD J. GLEN, church wardens, and RICHARD P. LARDNER, GEORGE FOX, SIMMONS H. BARRETT and JOSHUA B. SMITH, vestrymen, are hereby erected into a separate body politic or corporate. That the rector, church wardens and vestrymen are hereby authorized of All Saints church are hereby authorized to make and execute a deed to the wardens and vestrymen of Emanuel church, Holmesburg for a lot of land deeded 21 Mar 1831 from WILLIAM BARTOLETT and wife to various churches recorded in deed book A.M. #26, page 63. 9 Apr 1844. 158. An act providing for the erection of a house for the employment and support of the poor of the city of Allegheny. That the councils of the city of Allegheny are hereby empowered to direct be erected upon land purchased, and THOMAS BARNETT, HENRY HANNEN, ROBERT S. CASSAT, THOMAS FARLEY, E.W. STEVENS, THOMAS H. STEWART and JOHN MORRISON, WILLIAM TATE and S.O. REYNOLDS are hereby appointed commissioners to purchase a site within ten miles of the city. 9 Apr 1844. 161 An act to annul the marriage contract of ROBERT BARTON and CAROLINE BARTON, his wife. That the marriage contract entered into between Robert Barton and Caroline his wife, late CAROLINE HALDEMAN, both of the county of Montgomery, is hereby annulled and the parties released from all duties as fully as if they had never been joined in marriage. We do certify the the above bill was presented to the governor on the 27 Mar 1844 and was not returned within 10 days, wherefore, it has become a law as if he had signed it. John J. An act authorizing ALEXANDER CROW to collect outstanding tax in Springhill twp., Fayette county, and for other purposes. That Alexander Crow, late a collector, is hereby authorized at any time within one year to collect the outstanding state, county and school tax in the township, for the year 1839. That SAMUEL COOPER of Nottingham twp., Washington county, one of the executors of FREDERICK COOPER, dec. and he is hereby authorized to collect the outstanding tax on the duplicates which were in the hands of Frederick Cooper, at the time of his decease. 10 Apr 1844. 168. An act to legalize the marriage of ROMAN F. BRUNSON and FANNY J. BRUNSON, and to legitimate their children. That the marriage contract entered into between Roman F. Brunson and Fanny J. Brunson, Susquehanna county, is hereby declared valid and legal, and the children born since their marriage are hereby declared legitimate and entitled to all the rights of children born in lawful wedlock. 11 Apr 1844. 169. An act regulating election districts. That Eldred twp., M'Kean county, shall be a separate election district, and the qualified voters shall hold their elections at the house occupied by JAMES BAKER. The qualified electors of Bald Eagle Twp., Clinton county, shall hold their elections at the dwelling house of ROBERT FLAREN. The qualified electors of New London twp., Chester county, shall hold their elections at the public house of BENJAMIN SEAL, in the village of New London Cross-roads. That part of Mahoning twp., in Mercer county, within the following bounds to be separated from the election district and the qualified voter shall hold their elections at the house of HENRY ROBISON, etc, That the twp. of Upper Providence, and part of the twp. of Skippack and Perkioming, lying west of Perkioming creek, Montgomery county, shall be a separate election district and the qualified electors shall hold their elections at the house now occupied by WILLIAM GOODWIN, at the "Trappe" in Upper Providence twp. That the qualified voters of Allegheny twp., Armstrong county, shall hold their elections at the house of DAVID BOYERS. An act to enable SHUBAEL DIMOCK, executor of the estate of SIMON MARCY, deceased, to sell and convey real estate. That SHUBAEL DIMOCK, the acting executor named in the last will and testament of SIMON MARCY, late of Susquehanna county, dec. (under the instructions and directions of the orphans' court of Luzerne county,) is hereby empowered to sell a parcel of land situate in the twp. of Benton, Luzerne county, bounded northerly and easterly by lands of IRA LEWIS, southerly by lands of ACKUS CARD, and westerly by lands of ASAHEL GARDNER, containing about 50 acres, and to make deed to the purchaser and proceeds applied to the estate. 11 Apr 1844. 173. An act relative to the claim of HATHORN FREELAND, and for other purposes. That the canal commissioners are hereby authorized to examine the claim of Hathorn Freeland, for damages aledged to have been sustained by reason of a section boat, while upon the state trucks and in charge of a state agent, running against and breaking three of his cars standing at the head of the Schuylkill inclined plane, not to exceed the sum of $100.00 and draw their warrant for that amount. That hereafter any damages sustained upon any of the canals or railroads of the commonwealth, by reason of neglect or misconduct on the part of any agent or officer in the employment of the state, he shall be held liable for the amount of such damages, and it shall be the duty of the canal commissioners to discharge such agent or officer from all further employment, and retain any balance which may be due him for salary or wages, until the amounty of his liability for such damages shall be fully ascertained and paid. 11 Apr 1844. 175. An act to incorporate the Northern Liberties gas company. That JOSEPH REAKIRT, AUGUSTIN STEVENSON, JOSEPH GRATZ, ROBERT V. MASSEY, PETER WEYANT, EDWARD D. MARTIN, ISAAC HAYS, CHARLES W. BACON, ALEXANDER BROWNE, JOSEPH TROTTER, JACOB S. MINTZER and THEOPHILUS T. DERRINGER, the present trustees of the Northern Liberties gas work, Philadelphia county, shall be the trustee of the corporation, for the manufacture of carbureted hydrogen gas from bituminous coal for the purpose of public and private illuminations. 13 Apr 1844. 188. An act providing for the repair of the Warren and Ridgeway turnpike road, and for other purposes. That RICHARD DUNHAM and ERASTUS BARNES of Warren county, and JOSEPH S. HYDE of Elk county, are hereby appointed commissioners and shall receive one dollar each per day they may be actually engaged in having the road repaired. 13 Apr 1844. 190. An act to authorize the canal commissioners to examine and adjust the claim of MERCY BENNETT. Whereas, it is alleged by Mercy Bennett, of Lycoming county, Pa., that great injustice has been done to the estate of her late husband, JOHN BENNETT, dec. by compelling the building of a farm bridge across the West Branch canal, as she is fully prepared to prove. Therefore, the canal commissioners are hereby authorized to examine the claim of Mercy Bennett, and if anything should be proved due her or the estate of John Bennett, dec. a credit for the amount shall be entered. 13 Apr 1844. 193. An act to pay RICHARD DURBIN for work done in securing property belonging to the commonwealth. That the canal commissioners are hereby authorized to examine the claim of Richard Durbin, for work alleged to have been done by him in 1842, under the direction of the state engineer, in securing property belonging to the commonwealth, on the North Branch division, Pa. canal, and draw their warrant on amount found due, not to exceed the sum of $150.00. 16 Apr 1844. 195. An act to legalize a deed of conveyance from the trustees of MATHIAS BERNDHEISEL, of Lebanon county. Whereas, Mathias Berndheisel and NANCY BERNDHEISEL, his wife, of Lebanon county, executed and delivered a deed in trust for their creditors, to CHRISOPHER BANEY, EUNOS BERNDHEISEL and JOHN G. STEIN, as trustees, with full power, to sell and convey any part of the real estate. John G. Stein was discharged from his trusteeship, and the remaining two trustees, executed and delivered to DANIEL STEIN, a deed of conveyance, for a tract of land containing 7 acres, lying in Jackson twp., adjoining other lands of MATHIAS BERNDHEISEL, JOHN LEHMAN, and CHRISTOPHER BANEY. An act to authorize THOMAS HOOPES to sell certain real estate of CALEB M'FANN, deceased. Whereas, Caleb M'Fann, of Little Britain twp., Lancaster county, dec., did in his last will and testament, made 28 Jul 1843, direct his executor Thomas Hoopes, to sell his personal property, and if the proceeds are not sufficient to pay his debts, then to sell part of his real estate. Whereas, the personal property is not sufficient to pay his debts, nor can a part of the real estate be sold without serious injury and damage to the whole, therefore, Thomas Hoopes shall sell the whole of the real estate, and the court shall distribute the balance of the proceeds. 16 Apr 1844. 202. An act for the relief of R.C. NEWPORT. That the canal commissioners are hereby authorized to settle the claim of R.C. Newport, for rebuilding or repairing one of the state bridges over the canal, in the borough of Sharpsburg, county of Allegheny, and allow him the amouont actually expended, not exceeding the sum of $50.00. 17 Apr 1844. 203, An act relating to the docket of JAMES SINGER, late a justice of the peace, in the county of Clearfield. That it shall be the duty of JOHN HALL, a justice of the peace, Lawrence twp., Clearfield county, to deliver the docket of James Singer, Esq., late a justice of the peace, in Curwensville, Pike twp., to any acting justice of the peace in the town, and that justice shall have the same power to close unfinished business. 17 Apr 1844 207. An act to annul the marriage contract of JOSE ANTONIA ARBELO and MARIA ARBELO. It appears that Maria Arbelo, formerly MARIA CARR, was married in Cuba, in 1829, to Jose Antonia Arbelo, who by his neglect, ill usage, and abandonment of Maria, compelled her to separate and return to her parents in the county of Philadelphia, where she has resided since the year 1840, separate from and without any further tidings of Jose Antonio Arbelo. Therefore, the marriage contract entered into between Jose Antonio Arbelo and Maria Arbelo is declared null and void, and the parties discharged form all obligations as fully as if they had never been joined in marriage. We certifiy that the above bill was presented to the governor on 4 Apr 1844 and was not returned withing 10 days wherefore, it became a law as if he had signed it. SAGERS, JAMES M'NAIR, JOHN LUKENS, THOMAS WARNER, JAMES SIMPSON, SIMPSON THOMPSON, HENRY GILL, JESSE P. CARVER, SAMUEL COMFORT, GEORGE CHAPMAN, FRANKLIN COMLY, THOMAS CHAPMAN, WILLIAN N. THOMPSON, GEORGE WARNER, THOMAS SMITH, and ISAIAH WARNER, are hereby appointed commissioners to complete a road, and shall be entitled to levy tolls. 18 Apr 1844. 211. ROBERT DONALDSON, and GEORGE M'COMBS, of the county of Allegheny, are hereby appointed commissioners and shall be entitled to levy tolls. 18 Apr 1844. 212. An act to change the names of certain persons named. That ELIZA JANE JARVIS of Allegheny county, the daughter of OLIVER J. JARVIS, and now the adopted child of JAMES MILES and HANNAH MILES, shall henceforth be known by the name of ELIZA JANE MILES. That JOHN A. MERVIN, of Philadelphia county, is hereby authorized to change his name to JOHN A. SCLOUSSHER, and by that name to do all legal acts as if no change had been made. That JAMES E. BACKHOUSE, city of Pittsburg, son of THOMAS BACKHOUSE and EMILY BACKHOUSE, is hereby authorized to change his name to JAMES E. KING, and by that name to do all legal acts as if no change had been made. That THOMAS GREEN, son of ESTHER GREEN, late of Crawford county, now the adopted child of WILLIAM WAIT, shall hereafter to known as THOMAS SHEPHARD WAIT, and by that name do all legal acts as if no change had been made. That the name of THOMAS EVANS, son of JOHN C. EVANS and HANNAH R. EVANS, of the city of Philadelphia is hereby changed to THOMAS L. EVANS, and the name of DAVID WESLEY HAZZARD, of the same city, shall be changed to WESLEY HAZZARD, and by these names do all legal acts as if no change had been made. 18 Apr 1844. 213.
