Written: 1846 Recorded: December 22, 1846 Orphan Court December 22 AD 1846 The Petition of Isaac Palmer was read to the court setting forth that the petitioner is a minor said above the age of fourteen years , of John Palmer deceased, State of Union township, Adams County, that he has no person legally arthorised to take care of his person and estate and he prays the court, that he may be permitted to make choice of a suitable guardian for that purpose, Whereupon the court appoint Jacob Palmer to be guardian of the person and estate of the said Minor. *********************************************************************************** Source: Adams County Historical Society, Gettysburg, Pa. Written: 1848 Recorded: April 17, 1848 Orphan Court April 17th 1848 The petition of John Palmer, was read to the court setting forth, That John Palmer the elder, Late of Union Township, Adams County, deceased, died in the month of September one thousand eight hundred and forty six intestate leaving a widow named Catharine and nine children as follows, viz, John the Petitioner, Jacob, Frederick whose interest has been assigned to William Slifer, by deed of trust for the use of creditors, Henry who is deceased leaving issue one child Ann Eliza a minor who has for her guardian Daniel Palmer, George, Daniel, Elizabeth intermarried with Henry Willet, David and Isaac who are still minors having for their guardian Jacob Palmer, that the Petition is intestate died de--------in his --------- as of fee, Of and in a certain tract of land situate in the township of Union aforesaid, adjoining lands of Peter Wolf, John Bear and Daniel Keeports containing about forty Acres with a one story log house and log barn. No partition or valuation of said premises has been made and the petitioner respectfully agreements that Jacob Lake, David Sell, Michael Unger, Jacob Sterner, Daniel Keeports, George Kershler, and Jacob Sell have been named, on behalf, and with the consent of all Parties concerned, no make partition of the real estate of the said consent to wit, the premises afore described as in case the same cannot be divided among the said parties without prejudice to or spoiling the whole or if the same.... ********************************************************************* Source: Adams County Historical Society, Gettysburg, Pa. Written: June 10, 1848 Recorded: August 21, 1848 Came into court Jacob Lohn, David Sell, Michael Unger and Jacob Steaner,, Daniel Keeports, George Kersler, and Jacob Sell and made return of an order granted at a former orphans court, Whereby they were commanded to make partition or valuation of certain real estate. therein mentioned of which John Palmer Sr. Late of Union Township, Adams County, said in the following words to will. Inquisition indented and taken at the dwelling House, late of John Palmer died in the township of Union, in the county of Adams, and state of Pennsylvania on the tenth day of June in the year of our Lord one Thousand Eight hundred and forty eight by us whose names are hereunto subscribed that is to say, Jacob Lake, David Sell, Michael Unger, Jacob Sterner, Daniel Keeports, George Kershler, and Jacob Sell. Seven good, honest and lawful men of said county of Adams, appointed by the court at the prayer and with thee consent of the widow and all the heirs. and legal representation of said deceased, as by the said annexed writ of partition or valuation appears, who having all been duly sworn or affirmed, and it appearing to us that proper and timely notice had been given to all the heirs of the time of the execution of said will on our oaths and affirmations aforesaid, do say, that are the day and year a fore said, at the place aforesaid in the presence of such of the heirs as chose to be present. They having severally dispensed with and accepted notice of the same, They went to and upon the lands and premises of which the said John Palmer died said. and they than and there did find that the said land and premises could not be parted and divided to and among all the heirs and legal representation of the said interstate in the said will mentioned without prejudice to or spoiling the whole thing and the inquest aforesaid upon thier oaths and affirmations aforesaid, didfurther find that the land and premises aforesaid cannot be parted and divided to and among any of the said heirs, without prejudice to or spoiling the whole through. and therefore the inquest aforesaid on thier oaths and affirmation aforesaid, finding that the said lands and tenements to with a tract of land situate in the township of Union aforesaid adjoining land of Peter Wolf, John Bear, and Daniel Tiepoits containing about forty Acres more or less with the appointenance will accommodate but one heir- have valued and appraised the same at and for the sum of one thousand dollars at and for which said sum the inquest aforesaid upon their oaths and affirmation aforesaid do value and appear the same- This tenth day of June one thousand eight hundred and forty eight, In testimony where of the inquest aforsaid have to this inquisition in terminability, let thier hands and seals the day and year first above written. Jacob Lake Jacob Sterner David Sell Daniel Keeports Michael Unger George Hershler Jacob Sell Jr. The undersigned widow and heirs of John Palmer late of Union Township, Adam County deceased, do hereby come into court and pray that the inquisition and valuation made under and order of inquest to seven men directed and executed this day, May be confirmed- and we do hereby dispense with the using and service of the rule upon the heirs to except or refuse the said real estate at the valuation and agree and request the said court to decree the same to John Palmer eldest son of said deceased upon his entering into recognizance for the payment to the widow and heirs of their respective shares of said estate and we do hereby ratify and confirm the said proceedings the same as if the said will had issued and c- writing one hands the tenth day of June AD 1848. Whereupon the court being satisfied with the sufficiency of the security tender and the said John Palmer with his surety having interred into recognizance according to the lot of assembly it is allowed to the said John Palmer to accept the same and the court order and decree that the said John Palmer be allowed to return in his hand the sum of Seventy four dollars and seven cents his share of the valuation of said real estate now due and the further sum of thirty seven dollars and three cents after the death of Catheirne Palmer the widow of the said deceased in full for his share in the said premises. That the pay unto Jacob Palmer, William Slifer, the sign of Frederick Palmer , Ann Eliza Palmer, George Palmer, Daniel Palmer, Elizabeth intermarried with Henry Willet, David Palmer and Isaac Palmer or the quardine of such as are minors, each the sum of Seventyfour dollars and seven cents. on the first day of Sept. in the year of our lord one Thousand eight hundred and forty eight and after the death of the said Catharine Palmer, widow of the said inter tate the further sum of thirty seven dollors and three cents in full of thier respective shares of the said valuation provided that such sums should not be paid to the said Henry Willet until he shall have his own security to the satisfation of the court that the amount there of or so there of .) The court shall dream proper be paid after his death to his said wife as if the shall not survive him to her heirs,as if the same had been real estate- and if the said Henry Willet shall be unable or refuse to give security as aforesaid the same may be vested in trustees to be appointed by the court for the same purpose but reserving to he said husband the interest through during his life.- and the court further decree that when The said John Palmer shall pay the aforesaid several sums of money or give security to the satisfaction of the court to pay the same according to this decree, then the said premise best and be held by him his heirs and asigns forever, as fully and effectually and for the same estate as the said John Palmer deceased in his life time at and immediately before his decease had and held the same. John Palmer and Jacob Palmer We acknowledge ourselves indebted to the commonwealth of Pennsylvania jointly in the sum of two thousand dollars to be levied of our goods and chattel Lands and tenements respectively upon the condition that John Palmer to whom the real estate of John Palmer the elder deceased has this day been decreed by the orphans court of Adams County at the valuation there of , Shall well and Truly pray or cause to be paid to Catharine Palmer widow of the said John Palmer Yearly and every year during her natural life the sum of twenty dollars the first payment to be made out the first day of April one thousand eight hundred and forty nine that being the interest on the one third of the valuation money, that he pay to Jacob Palmer, William Slifer, a sign of Frederick Palmer, Ann Eliz Palmer, George Palmer, and Isaac Palmer on the guardians of such as are Monor, each the sum of seventy four dollars and seven cents on the first day of September in the year one thousand eight hundred and forty eight, and on the death of the said Catharine Palmer widow the further sum of thirty seven dollars, and three cents in full of thier respective shares of the said valuation provided that such sums share no be paid to the said Henry Willet until he shall have ---------security there of or so much there ofas the court shall deem proper be paid after his death to his said wife as if the share not survive him to her heirs as if the same had been real estate, as if the said Henry Willet shall be unable or refuse to give security as aforesaid the same may be vested in trustees to be appointed by the orphans court for the same purpose but reserving tothe said Henry Willet the interest thereof during his life- Then this recognizance to be void and of no effects to be and remain in full force and virtue taken and each----------- ----- in your court this 21st day of August AD 1848 before Me William HamiltonC/H John Palmer Jacob Palmer *************************************************************************************** Source: Adams County Historical Society, Gettysburg, Pa. Written: 1848 Recorded: August 21, 1848 Orphans Court August 21st 1848 Whereas I, Elizabeth Willet wife of Henry Willet, am entilled to the sum of one hundred and twelve dollors, ten cents proceeding form the patition of the real estate of John Palmer the Elder in the county of Adams and I do certify and declare, that I consent and agree that the same be given to my husband, the said Henry Willet, without any condition or security whatever writing my hand this 21st day of August A.D. 1848. On the twenty first day of August A.D. 1848. Personally appeared befor me, one of the judges of the Orphans Court for the County of Adams, Elizabeth Willet the wife of Henry Willet of Union Township in the said County labourd who being of full age, and by me examined seperate and apart from her said husband and the contents and legal effect of the foregoning insterment by me, feeling explained and made known to her declared that the exacted the same freely and voluntarly without any threats or compulsion on the part of her husband or any other peron.
