Attlesperger personally comes the claimant, who, being first sworn on oath, says that he was enrolled as a Private in Co. "E" 165th Regt. Pena Drafted Militia on the 16th day of October, 1862 to serve for nine months, and was discharged from the service of the United States the 28th day of July 1863, at Gettysburg, Pennsylvania by reason of expiration of service. The affiant also states that he was enrolled as a Prv. In Co. "G" 209th Regt. Penna Infty. Vols. On the third day of September 1864 to serve one year or during the war, and was honorably discharged from service of the United States on the 31st day of May 1865, at Alexandria, in the state of Virginia, by order of War Dept. of May 17 & 18 1865. The affiant further states that he has not been in the Military or Naval Service since the 31st day of May 1865 and that the above description of his service rendered comprise all services rendered by him in the U.S. Service. In the claim for Orig. Invalid Pension, no. 723447 of James W. Attlesperger, late a private of Co. "G" 209th Regt. PA Vols., personally came before me a Notary Public, in and for the aforesaid county and state. James W. Attlesperger, the above named claimant a citizen of Germany Township, in the County of Adams and State of Pennsylvania, well known to me to be respectable and entitled to credit and who being duly sworn, declares in relation to the aforesaid case as follows: That he has not been able, after having made every reasonable effort, to procure ? affidavit of a Commissioned Officer, or the First Serfeant of Claimants' company. Setting forth when, where, and under what circumstances the alleged injury to right testicle was incurred and by reason thereof has submitted the affidavits of two enlisted men of his company. That the said claimant further states that he has not been able after having made every reasonable effort, to procure the affidavit of the Surgeon, or of Assistant Surgeon, of Claimants regiment as to treatment for said injury while in the service; but more especially for the reason that he had not received medical treatment while in the service for said injury; but that he had received while in the service med'l treatment for the chronic diarrhea and in the absence of such testimony has submitted the affidavit of the physician who frequently treated and prescribed for him since his discharge for the said ""chronic diarrhea." On this 5th day of August A.D. one thousand eight hundred and eighty nine personally before me, a clerk of the Quarter Sessions, a court of record within and for the county and state aforesaid, James W. Attlesperger, aged 60 years, a resident of the Township of Germany county of Adams State of Pennsylvania, who, being duly sworn according to law, declares that he is the identical James W. Attlesperger who was enrolled on the third day of September 1864, in Company G of the 209 regiment of Penna Inf. Vol. Commanded by Captain Charles F. Hinkel, and was honorably discharged at Alexandria, VA on the 31st day of May 1865; that his personal description is as follows: Age, 36 years; height 5 feet 7 inches; complexion, fair; hair, black; eyes, blue. That while a member of the organization aforesaid, in the service and in the line of his duty at Point of Rocks, in the state of Virginia on or about the first day of November 1864, he was loadi! ng for the execution of hospitals, where a hand spike struck him on right testicle which resulted in a permanent enlargement or hypertrophy of the organ. And about the 31st day of March 1865 he was afflicted with chronic diarrhea at Petersburg Virginia which continued bad for fourteen months, and never been well of it-to this day. That he was treated in hospitals as follows: was never laid up in hospital. That he has been as stated above a private in company E 165-Reg Penna Draughts malitia enrolled 16 October 1862, served 9 months, discharged at expiration of term July 28 1863 at Gettysburg, PA. That since leaving the service this applicant has resided in the Township of Germany Adams Co., in the state of Pennsylvania, and his occupation has been that of a laborer. That prior to his entry into the service above named he was a man of good, sound physical health, being when enrolled a laborer. That he is now partially disabled from obtaining his subsistence by manual labor by reason of his injuries, above described, received in the service of the United States; and he therefore makes this declaration for the purpose of being placed on the invalid pension-roll of the United States. He hereby appoints C.W. Fabre of Warbright, state of D.C. his true and lawful attorney to prosecute his claim. That he has not received or applied for a pension. That he is to a great extent unable to earn a support by reason of a ruptured right testicle, chronic diarrea and rheumatism. That said disabilities are not due to his vicious habits, and are to the best of his knowledge and belief permanent. He hereby appoints Charles W. Personally appeared before me a Notary Public in and for the aforesaid County & State James W. Attlesperger. The claimant above named, a citizen of Germany Township in the County of Adams and State of Pennsylvania, well known to me to be reputable and entitled to credit, and who being duly sworn declared in relation to the aforesaid case as follows: That on about the month of December 1864, while at Bermuda Hundred in the state of Virginia, the claimant was detailed along with a force of other soldiers to help carry and load logs on the wagons to be used for a new hospital, where and when the claimant received a severe injury to his right testicle by a stroke from the hand spike in his other hand from the fall of a log too heavy for the detail. Namely about fifteen men were in the group. The claimant is not certain that any comrade of claimants' company were present as an e! ye-witness of the injury he received then and there, but that at least one dozen soldiers were present as eye-witnesses of the same but that the claimant is unable to recall any names of said soldiers who were present at the time, and is heretofore unable to furnish the testimony of eye witnesses. That the claimant the ? of the same day that he received the said injury and his right testicle showed his injury to his commander, namely, George W. Lauseinger and Adam Sasley, whose testimony he has submitted to show origin of claimants disability; that said claimant did not make known the said injury to any other comrades except two comrades above named, nor did said claimant receive any hospital or medical treatment for the same while in the service; that he can not, therefore, furnish the evidence of his regt' Surgeon or Asst. Surgeons as to the fact of merit while in the service. Nor the evidence of a Commissioned Officer or First Order Sargeant showing where, when and under which circumstances the claimant contracted the said disability. Signed James W. Mustered out with Co. at Gettysburg, PA July 28, 1863 as Private. Also borne as Attlesperger James W. Attlesperger Private Co. "G" 209th Penna was enrolled September 3, 1864 at Gettysburgh, PA for 1 year on rolls to Feb 28 1865 present - March and April 1865 (was in action on that date in front of Petersburg, VA) Mustered out with Co. at Alexandria VA May 31, 1865 as Private. He is not reported absent on Return for November 1864 or March 1865 Co. Desc. Book shows him wounded in front finger at the capture of Petersburg, Va April 2 NO further information. E 165th PA from Oct 16, 1862 to July 28, 1863 at Gettysburg, PA and was discharged at Alexandria, VA May 31, 1865. While serving in Co. G, 209 Regt. Attlesperger late a Pvt in Co's "E" & "G" of the 165th & 209th Regt's of Penna Infty Vols for Original Invalid Pension No. 723447 ON THIS 15th day of September A.D. 1890, personally appeared before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths George W. Lansinger aged 52, a resident of Littlestown in the County of Adams and the State of Pennsylvania whose post office address is the same as residence and Adam Sasely aged 58 years, a resident of Germany Township, in the County of Adams and State of Pennsylvania, whose post office address is Kingsdale, Adams County, Penna well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case, as follows: That in addition to and explanation of their testimony now on file they desire to state as follows: Sometime in December 1864 at Bermuda Hundred, Va. Claimant (with officer) was detailed with wagons to get logs to build a hospital. When he left the company on this duty he was sound and free from any injury or affliction of the testicle or pernant parts. He was away about best part of one day and when he returned to camp in the evening he was ? and apparently suffering intense pain in the privates and upon being asked what was the matter informed affiants that in handling a heavy log he had accidentally received a blow from a handspike which had severely injured his right testicle; that he exposed his privates to the affiant Geo. W. Lausinger, above named, who was an eye witness that the right testicle had received a severe injury and was much swollen; that he alleged to the said affiant then and there that he had received his disability aforesaid as stated above, and that they! were eye witnesses that said disability appearance there and then to cause claimant intense suffering and they know that he continues to suffer from this injury to a greater or less degree during the remainder of his service. The affiants further state that claimants story was corroberated by other comrades who were present with him as members of the above detail when the injury was incurred. Affiants further declare that they have no interest in said case and they are not concerned in its prosecution. Signed George W. Personally came before me a notary Public in and for the aforesaid County and State, duly commissioned and qualified to administer oaths, C.H. Duttera, a citizen of Germany Township, in the County of Adams, and State of Pennsylvania, well known to me to be reputable and entitled to credit, and who being duly sworn declares in relation to the aforesaid case as follows: That he has known the said claimant for the last twenty years and for the last ten years has given employment to him, more or less regularly during that period; and that he has frequently complained during those ten years of suffering with chronic diarrehea, which he alleged to have contracted while on duty in the U.S. Service and that during that time the diarrhea has made him less able to perform manual labor and for past three years to the extent of about one third of his time; and that the said claimant has for the last ten years suffered from the injury to his right testicles which he alleged to have contrac! ted in the U.S. Service that about seven years ago the claimant showed the swollen and injured testicle to the affidant which was greatly enlarged and by times he would suffer pain, especially when engaged at hard labor; and that in the opinion of the affiant, his injury to the right testicle has made him less able to perform services manual labor. The affiant further declares that he has no interest direct or indirect in the prosecution of this claim. C.H. Keeper age 64 years, a resident of Littlestown in the County of Adams and State of Pennsylvania whose postoffice address is the same as residence and well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: I am a wheelwright & Jas W. Attlesperger the above mentioned claimant is a day laborer. I became acquainted with him in the 1860 & from that time to the present (except while he was in the Army) have resided within a mile of him, seen him at least once each week & have at different times worked with him. Up to and at the time of his enlistment, claimant appeared to be (and was to the best of my belief) a sound and able bodied man but when he returned home from the army at discharge he was suffering from chronic diarrhea and an injury to right testicle & has continued to be more or less affected with both those disabilities from that time to the present. His bowels have been loose & irregular causing frequent going to stool & consequent weakness & emaciation & pale, haggard appearance. His right testicle frequently swells up and causes such pain that he is unable to work & he is compelled to wear a suspensory bandage. As a consequence of these disabilities claimant has lost considerable time from his work every year since discharge (averaging about one day every two weeks) & for the same reason has never in my opinion, been able to do more than three fourths the labor of a sound and able bodied man since he left the Army. I know these facts from long and intimate acquaintance and association with claimant being in his company frequently seeing him affected as described and hearing his complaints. I further declare that I have no interest in said case and I am not concerned in its prosecution. James W. Keefer General Affidavit State of Pennsylvania, County of Adams. In the matter of Jas W. Attlesperger late a Pvt in Co's "E" & "G" of the 165th & 209th Regt's of Penna Infty Vols for Original Invalid Pension No. 723447 before me, a Notary Public in and for the aforesaid County, duly authorized to administer oaths George Smith age 55, a resident of Littlestown in the County of Adams and the State of Pennsylvania whose postoffice address is the same as residence and well known to me to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: I am a carpenter & Jas. W. Attlesperger the above mentioned claimant is a day laborer. I became acquainted with him in 1855 from that year to the present (except while he was in the Army) I have resided within about a mile of him and have seen him about once a month. I have also at various times worked at the place where the claimant has been employed. Up to the time of claimants enlistment he was a sound and! able bodied man but when he returned home from the Army at discharge he was suffering from chronic diarrhea and complaining of an injury to right testicle & has continued to be so affected to so complain from that time to the present. His bowels have been irregular at all times & frequently very loose, causing frequent going to stool & consequent weakness, pallor, haggard appearance & thinness of flesh. I have never seen the injured testicle but have heard claimant's frequent complaints of same & have heard from him & from others that the right one is the one injured & from his actions I believe that at times it is a source of great trouble & pain. In consequence of said disabilities claimant has lost considerable time from his work each year & for the same reason has, in my opinion, been unable to do more than two thirds the labor of a sound & able bodied man at any time since discharge. I know the above facts by reason of long acquaintance with claimant hearing his complaints & seeing him affected as above described. I further declare that I have no interest in said case and I am not concerned in its prosecution. George Smith DECLARATION FOR WIDOW'S PENSION Act of June 27, 1890 This may be executed before a Notary Public, Justice of Peace, or any other officer authorized by law to administer oaths for general purposes, but unless such officer uses an official seal, the certificate of the Clerk of Court, certifying to his official character, must be attached thereto. State of PA County of Adams SS personally appeared before me, a Justice of the Peace within and for the County and State aforesaid, Abigail Attlesperger aged 63 years, a resident of the town of Littlestown county of Adams state of PA, who, being duly sworn according to law, declares that she is the widow of James W. Attlesperger who enlisted under the name of James W. Attlesperger on the 3rd day of September 1864, in Co. G 209th Regt. PA Vol Inf. As private and served at least ninety days in the late war of the Rebellion, who was honorably discharged May 31, 1865 and died December 23, 1896. That she was married under the name Abigail Wolf to said James W. Attlesperger on the first day of July 1855 by Rev. Solomon Sentmen at Taneytown, Maryland there being no legal barriers to such marriage. That she has not remarried since the death of James W. Attlesperger that she is without other sufficient means of support than her daily labor. That no prior application for pension has been filed by the widow. LeFauvre GENERAL AFFIDAVIT In the matter of the claim for Widow's original pension of Abigail Attlesperger, widow of James W. Attlesperger Pvt. Co. G 209 Regt. PA Vols. Personally came before me, a Justice of the Peace in and for the county and state aforesaid Abigail Attlesperger, Littlestown, Adams County, Pennsylvania person of lawful age, who, being duly sworn, declares in relation to the aforesaid claim, as follows: I received by will from my late husband James W. Attlesperger, (and now own same) one acre of ground with dwelling house thereon situate lying and being in Germany Twp Adams County, state of PA, and personal property worth about two hundred and seventy five dollars~ there is no incumbrance on property~ I have no income from any source and am not able to do my own household work. I do not own bonds, stocks, or mortgages and have no investments of any kind, and no one is legally bound to support me. The soldier, James W. Attlesperger never served in the military or naval service of the Un! ited States before Sep 3, 1864 or after May 31, 1865, except as Private in Co E 165th Regt PA from Oct 16, 1862 to July 28, 1863. As the soldier died at home and not in service there is no military record of his death. That the statements contained in the affidavit were written in my presence and from my oral statements (to the person) by Wm. H. Sharetts, that said oral statements were made to the person preparing the affidavit on the 21st day of January 1897~at Littlestown, Adams County, PA, and that in making the same I did not use and was not aided or prompted by any written or printed statements or recital prepared or dictated by any other person. G 209th PA Vol. Personally came before me, a Justice of the Peace in and for the county and state aforesaid Isaiah E. Mehring of Littlestown, Adams County, PA person of lawful age, who, being duly sworn, declares in relation to the aforesaid claim as follows: I have been personally and intimately acquainted with James W. Attlesperger and Abigail Attlesperger his wife for thirty-five years prior to his death, and know that they lived together as man and wife to the time of his death on December 23, 1896 and they were never divorced. James W. Attlesperger left real and personal property worth about two hundred and fifty dollars to his wife by will; and funeral expenses and doctor's bill are to be paid~~ and she Abigail Attlesperger has no income excepting what is derived from her own labor, and no one is legally bound to support her;! and for a year or more her health has been so bad that she was not able to do her own work. I was at the late home of James W. Attlesperger on December 24, 1896 and saw the dead body of the late James W. Attlesperger and attended the funeral. The widow has not remarried since the soldier's death. That the statements contained in the affidavit were written in his presence and from his oral statements by Wm. H. Sharetts that said oral statements were made on the 5th day of January 1897, at Littlestown, Pa and that in making the same he did not use and was not aided or prompted by any written or printed statement or recital prepared or dictated by any other person.
