The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net/pa/pafiles.htm ____________________________________________________ Book E Page 369 Adams County, Pennsylvania 2744 Last Will of John Lady The Last Will and Testament of John Lady of Franklin Township, Adams County: I, John Lady, considering the uncertainty of this mortal life, and being of sound mind and memory, (blessed be Almighty God for the same) do make and publish this my last Will of Testament, in manner and form follows, (that is to say) That my Daughter Elizabeth, intermarried with Abraham Spangler has received Seventy-One Dollars towards her share and no interest to be charged at any time. Item that my daughter Susan, intermarried with Henry Steinhower has received One Hundred and Seventy Dollars towards her share and no interest to be charged at any time, and the rest of the said Susan’s share is to be given to her daughter Mariah Steinhower now intermarried with John Hart. Item That my son Daniel Lady has received Two Hundred Dollars towards his share and no interest to be charged at any time. Item That my son Jacob Lady has received Two Hundred Dollars towards his share and no interest to be charged at any time. Item That my son John Lady has received Two Hundred Dollars towards his share and no interest to be charged at any time. Item That my son Henry Lady has received Three Hundred & Fifty Dollars towards his share and no interest to be charged at any time. Item That my son George Lady has received Two Hundred Dollars towards his share and no interest to be charged at any time. Item That my son Abraham lady has received Two Hundred Dollars towards his share and no interest to be charged at any time. Item That my daughter Sarah, intermarried with William Settle has received Fifteen Dollars towards her share and no interest to be charged at any time. Item That my daughter Anna intermarried with Peter Ketterman has received Fifteen Dollars towards her share and no interest to be charged at any time. In the first place, my wish and desire is, that my children or heirs, shall all have alike share with those who have already got their share and all, in the first place, shall be made alike with the one that has the larger sum of money mentioned. Second, my wish and desire is, that immediately after my Death, my Personal Property shall be appraised and sold to the best advantage and turned into money, except those articles that where got or prepared for Mary Ann Haingh. Third, No Real Estate to be sold till after the expiration of three years after my death, and the Farm that my son Henry Lady now lives on, he shall stay on said Farm for the term of Three years after my death, in the same way he lives there now, and at the same bargain he had it now. And the Farm that I now live on, shall also be rented to the best advantage, three years after my death, and after the expiration of the three years also mentioned, all Real Estate shall be sold, and then all my children and heirs shall have share and share alike: 1 Elizabeth, intermarried with Abraham Spangler, 2 Mariah Steinhower, intermarried to John Hart, 3 Daniel Lady, 4 Catherine, intermarried to Jacob Settle, 5 Mary intermarried to John Settle, 6 Jacob Lady, 7 Margaret intermarried with Henry Mauer, for which I appoint my son Jacob Lady and my son-in-law Peter Ketterman, as Trustees to give said Margaret, in such a way or manner as they think proper, and if she stands in actual need of support, 8 John Lady, 9 Sarah, intermarried with William Settle, 10 Henry Lady, 11 George Lady, 12 Anna, intermarried with Peter Ketterman, 13 Abraham Lady. I hereby appoint my Son-in-law, Abraham Spangler & my Son-in-law, William Settle, Executors of this my Las Will & testament, hereby revoking all former Wills by me made. In witness Whereof, I have hereunto set my hand & Seal, the Fourth day of April, in the year of our Lord, One thousand Eight hundred Forty-nine. Signed, Sealed, Published & declared by the above named John Lady to be his Last Will & Testament in the presence of us, who at his request & in his presence have inscribed our names as witnesses thereunto. Hamersly, Register for the Probate of Wills and granting Letters of Administration, in and for the County of Adams, in the State of Pennsylvania, personally came Adolph Kloepper, John Herbst & John Carbaugh, the subscribing witnesses to the foregoing instrument of writing, who on their solemn oaths do severally say that they were personally present and saw and heard the therein named John Lady sign his name unto and Seal and publish the foregoing instrument of writing as and for his Last Will and Testament, and at the time of doing thereof he the said John Lady was of a perfect, sound and disposing mind, memory and understanding, to the best of their knowledge, observation and belief, and that they subscribed their names thereto as witnesses, in his presence and at his request, and also in the presence of each other at the same time. Sworn & subscribed fore me the 17th day of May A.D. 1849. Wm. W. Hamersly, Reg. Adolph Kloepper John Herbst John Carbaugh Memorandum - Letters Testamentary were on this day granted in due form of Law unto Abraham Spangler & William Settle, Executors of the Last Will & Testament of John Lady, Decease, an Inventory to be exhibited into the Registers Office at Gettysburg for the County of Adams, within thirty days from the date hereof, and a just and true account of their administration, within One year from the date hereof or when thereunto legally required.
