All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Peggy Smith PegECSmith@aol.com April 7, 2007, 11:39 pm Source: Adams County Courthouse Written: April 1802 In the name of God Amen, I Samuel McConaughy of the township of Monallen in the county of Adams the State of Pennsylvania Yeoman being weak of body but perfect sound and d(?) mind and memory thanks be to almighty God for the same Calling to mind the uncertainty of death and the uncertainty of this mortal life, So make & publish this my last will & testament in manner & form following ( that is to say) First I order and allow that all my just debts & funeral expences be discharged & paid out of my estateby my Executor herein after named. Also I give to my dear and well beloved wife Jean McConaughy one feather bedsted and furniture, her cafe of drawers and cubbord and all the articles of every kind she brought with her, also one horse creature her choice of my horse (?) sadle and bridle and two cows, her choice of my cattle also the use and benefit of the fireroom we sleep in, and a part of the kitchen with suffiency of firewood brought convenient and prepared for the fire. With free egress and (?) thereto from induring her widowhood or natural life or as long as she shall think fit to remain there and no longer. Also the aforesaid creatures sufficiently keep with hay and straw in winter and pasture in summer. And he keeps own off my real estate induring the time aforesaid, and the sum of twelve pounds in real spicia per annum induring her widowhood or natural life and the sum of sixty pounds to be paid to her heirs the sum of twenty pounds in five years after my decease. And to be considered in full her dower out of my estate both real and personal and of everything she can claim of me in any pretence whatsoever. Also I give and beqeath unto my two sons Robert McConaughy and John McConaughy to each of them the sum of one pound and ten shillings in real specia and to be paid to them or their heirs in one year after my decease. And it is my will and intention and I would have the same sums/ they already having been already by me in full advanced to be understood and taken to be in full shares of my estate both personal and in full of everything they can claim of me for any services hereto for done or in any other pretense whatsoever_ Also I give unto my well beloved daughters (viz. Jean intermarried with Alexander Hunter, Elizabeth intermarried with Robert ?Ridare. Sarah intermarried with William Thompson, Margaret intermarried with David Stewart, Mary intermarried with Richard Blear, and Nancy intermarried with Joseph Blear. To each of them the sum of seven pounds ten shillings in real specia and tp be paid to them or their heirs two years after my decease. And it is my will and intention and I would have the same sums/ they already having been already by me in full advanced to be understood and taken to be in full shares of my estate both personal and in full of everything they can claim of me in any form what soever_ Also I give & bequeath unto my grandaughter Jean Glasgow, daughter of my daughter Ann McConnaughy the sum of fifteen pounds in real specia and to be paid by my son Samuel out of my real estate when she arrives at the age of eighteen years. But if she should die before she arrive at said age leaving no issue then I allow said sum to remain in my sais Samuel's hands for his own use and benefit_ Also I order and allow that all my kitchen furniture together with my tea equiping be equally divided between my wife and my daughter-in-law Polly, wife to my son Samuel_ Also I give desire and bequeath unto my son Samuel McConnaughy all my plantation and tract of land whereon I now live situate lying and being in the township of Monallen in the county of Adams aforesaid, Together with all the heriditaments and appurlenances thereunto belonging or in any wife appertaining to hold him his heirs or assigns forever_ Also I give and bequeath unto my son Samuel all the residue and remainder of my estate of what ever kind or natures to him or his heirs. And lastly I do hereby constitute and appoint my trusty friend David Moore of the Township of Cumberland & William Gilliland of the Township of Straban to be my joint Executors to see the orderly accomplishments of this my Last will and Testament Revoking and disclaiming all former and other Wills by me heretofore made ratifying and Confirming this and no other to be my last will and testament. In Witness where of I have hereunto set my hand and seal this Second Day of December in the year of our Lord one thousand eight hundred & one_ Also to my wife one book entitled Crawfords Dying~ Sam'l McConaughy. Signed Sealed Published pronounced & declared by the ? Samuel McConaughy to be his last will & testament in the presence of us who have hereunto subscibed our names as Witnesses_ the words with hay and straw in winter and pasture in summer as he keeps his own being enterlined between the Twenty first and twenty second lines before signing_ Also the Second and Third Lines in the Last page being crossed before signing. William Laird Robert Graham Sam'l Gilliland ADAMS COUNTY Before James Duncan Esquire Register of the Probate of Wills and granting letters of Administration in and for the County of Adams aforesaid in the state of Pennsylvania personally came William Laird, Robert Graham two of the subscribing witnesses to the foregoing instrument of writing and on their solemn oaths do separately say that they were personally present and saw and heard the within named Samuel MCConaughy sign his name unto and seal and publish the foregoing instrument as and for his last will and testament and at the time of doing thereof the said Samuel McConaughy was of a sound and disposing mind memory and understanding to the best of their knowledge and belief and that they subscribed their names thereto as witnesses in the presence of the said testator and at his request and also in the presence of each other at the frametime_ Sworn, & Subscribed before me at Gettysburgh, the 24th day of April A.D. 1802 James Duncan MEMORANDUM, Letters testamentory were this day granted to David Moore and William Gilliland, Executors of the last will and testament of Samuel McConaughy deceased_ Inventory to be exhibited into the regiters office at Gettysburgh, on or before the twenty fourth day of May next, and an amount or reckoning on or before the twenty fourth day of April, 1803 or when thereunto legally required.
