I David Moore of Cumberland Township in the county of Adam's & State of Pennsylvania, being sick & weak in body, but of sound mind, memory & understanding (blessed, be God for the same). Do make & publish this my last Will & Testament in manner & form following to wit. Principally & first of all, I commend my immortal Soul into the hands of God, who gave it & my body to the Earth, to be buried in a decent & Christian like manner, at the discretion of my Executor hereinafter named, & as to such worldly Estate, wherewith it hath pleased God to bless me in this life. I Give & dispose of the same in the following manner Viz. First. It is my will & I order & direct that all my Just debts & funeral expenses shall be paid out of my Estate by my Executors hereinafter named. Item. I Give & bequeath unto my beloved Wife Elizabeth Moore her Bed & Bedstead with all the Furniture thereunto belonging, her spinning wheel & the cupboard in her room with itıs furniture, one horse creature, two cows & four sheep all her choice absolutely, also the full & free use & privilege of the Room in which her Bed now stands, the use of the kitchen fire when she chooses, her horse, cows & sheep all to be kept for her in good order, free, a sufficiency of firewood to be cut & put on the fire for her at all times, with the use of the new milk house, & the Sum of Twenty two pounds yearly, which money I allow to be paid & the above priviledge to be given her on the Farm where I now dwell from the time of my decease untill the said land be sold, & then to cease; & in Lieu thereof I give & bequeath to my said wife the Interest of one third part of the value of all my Lands to be paid her yearly Page 2 & every year after the sale of the aforesaid land, during her natural life, which valuation is to be found & determined as follows viz. That of the land on which I now dwell by the sale thereof, the yearly payments being reduced to Cash; that of my land in Westmoreland County, by three neighbors there to be chosen by my Executors, & that of my lands in Virginia by three neighbors there also, to be chosen by my Executors & my two eldest sons mutually. I also give and bequeath to my said wife the use of all my books so long as she chooses & to be given by her to whom so ever she may think proper, except my large Bible which I allow her to give to my eldest son living at the time of my decease. I also Give & bequeath to my said wife all my wearing apparel to be divided by her amongst my sons as she may think proper, except my Great Coat which I allow to my son Joseph. It is also my Will that my said wife shall live with which of my sons she pleases & be conveyed thither, the first time, clear of all expense to her. Item. I Give & Devise to my Son Joseph Moore, one hundred acres to be laid off my plantation on which he now dwells in the State of Virginia, during his natural life, & at his decease I Give & devise the same to his eldest Son, then living, to hold to him, his heirs & assigns forever. As to the rest of the said plantation I allow it to be divided into three equal shares, One third part where of I give & devise to my son William Moore & to his heirs & assigns forever, One third part where of I Give Page 3 & devise to my Son David Moore, & to his heirs & assigns forever. Item. I Give & Devise to my son Patrick Moore my Land in Westmoreland County to hold to him & his heirs & assigns forever. Item. It is my will & I order & direct that my whole Estate Real & Personal whether in the State of Pennsylvania or Virginia, except what is herein before given or devised shall be sold by my Executors herein after mentioned, who are also hereby empowered to convey the same to the purchaser or purchasers in the space of, not less than two nor more than three years after my decease (except any Articles of personal property that might be considered unnecessary or perishable). Out of which whole amount, I Give & bequeath Fifty dollars to be paid into the hands of the Rev. David McConaughy in one year after my Decease, to hold four years without interest & then to pay over to the Trustees of the Upper Presbyterian Congregation of Marsh Creek, the annual Interest thereof to pay towards the support of the Gospel of Jesus Christ in said Congregation & the principal to belong to the funds thereof so long as they continue a Presbyterian Congregation, otherwise to be paid over by the said Trustees, to the nearest incorporated Presbyterian Congregation or College. Item. I Give & Bequeath to my Granddaughter Eliza Wright Moor, only child of my Son Samuel Moor Dec. One hundred pounds to be paid her four years after my decease, but & if she should die under the age of twenty one years & without Page 4 lawful (issue) the same is to be equally divided between my Six Sons Patrick, David, Archibald, John, Robert & Moses; & if one or more of them my said six sons shall die under age or without lawful issue, then the share or shares of them so dying, in the said hundred pounds shall be equally divided amongst the survivors of my said Six Sons. Item. It is my will that after the foregoing Legacies are taken off the whole head, the remainder of my Estate shall be divided into nine shares, one share where I give & bequeath to my sons Joseph & William equally at the same time allowing that the land herein before devised to them severally or the value thereof shall make a part of their share thus bequeathed. The said value to be ascertained as is herein before mentioned. Then the residue I allow to be divided into seven equal shares, which seven shares I Give & bequeath to my seven Sons Patrick Moore, David Moore, Archibald Moore, Thomas Moore, John Moore, Robert Moore & Mosis Moore equally & if one or more of my said Sons should die under age & without Issue such share or shares to be equally divided amongst the survivors of them my said seven sons. And Lastly, I do hereby constitute & appoint my two Sons Patrick Moore & David Moore to be the Executors of this my last Will & Testament, & that they shall have no other or farther compensation for settling the above Estate, than the lands herein Page 5 Before devised to them severally over & above their other brethren. It is also my will that my Son Thomas Moore shall pay to my granddaughter Eliza Wright Moore, before mentioned Twenty pounds out of his share herein bequeathed to him when she arrives at the full age of twenty one years. And I do hereby revoke & disannul all other Wills, Legacies & bequests by me heretofore made. Ratifying & confirming this & no other to be my last Will & Testament. In Witness where of I have hereunto set my hand & seal the Seventeenth day of June in the year of our Lord One thousand eight hundred and three. Signed, Sealed, published pronounced & declared by the said Testator, as & for his Last Will & Testament, in our presence, who in his presence & at his request, have subscribed as Witness hereto. John Wilson David Moore William McGaughey (seal) Alex Russell ADAMS COUNTY Before James Duncan Esquire Register for Probate of Wills and Granting Letters of Administration in and for the County of Adams in the State of Pennsylvania Personally Came John Wilson, William McGaughey, & Alex Russell the Subscribing Witnesses to the foregoing Instrument of Writing and on their Solemn Oaths doth severally say that they were Personally Present and saw and heard the within named David Moore sign his name ­ unto and Seal & Publish the foregoing Instrument as and for his last will & Testament and at the time of doing thereof he the said David Moore ­ was of a sound and disposing Mind Memory and understanding knowledge and belief and then they Subscribed their names thereto as Witnesses in the Presence of the Testator and at his request and also in the presence of each other at the same time.
