I, Daniel Rex Senior of Menallen Township Adams County Pennsylvania, Farmer, do make and publish this my last will and testament hereby revoking and making void all former wills by me at any time heretofore made, And first I direct my body after my decease to be intered in burying ground of Benders Church where my devotions were for the last year of my life offered to an all merciful God in a decent and becoming manner and as to such worldly estate as I die possessed of I dispose in manner as follows, whilst I have my understanding perfectly to do so. First I direct that all my just debts and funeral expenses be paid as soon as funds shall be in the hands of my hereinafter named executor arising out of my Estate, Item; I give and bequeath unto my son Henry the place or farm I now live on, with the appurtinances to him and his heirs forever subject to the following conditions and bequests made to my Daughter Molly Rex, my said Son Henry is to pay for said place two thousand dollars in a manner as follows the one third of the whole $2000 shall be the hand money which I acknowledge having already received from my said son Henry including one hundred pounds which he was entitled making him equal to my other sons who have already received the like sums. The Ballance of the whole after deducting the handmoney shall be paid in equal annual payments of one hundred dollars cash commencing one year after my death until the whole shall have been fully paid and as soon as my said son Henry shall have paid one half of the payments I order and direct my hereinafter named Executor to make him a good and sufficient deed hereby vesting in my Executor full and absolute power to make deeds for this tract and all of the other tracts that I either bequeath or direct to be sold. Item; I give and bequeath unto my said son Henry a tract of Mountain land situate in Menallen Township Adams County adjoining lands of Foal and others contained in the following lines and bounds being part of a larger tract of land conveyed to me by John Cozer. Beginning at a Spanish oak South twenty degrees West fifty four perches and four tenths to a chestnut oak in a line of lands formerly of John Fighner thence south seventy two and one half degrees West twenty nine perches to a post thence North forty degrees West forty eight perches and four tenths to a chestnut oak thence by lands of Jacob Foal North 19 degrees East forty five perches and four tenths to a post thence North sixty two degrees East sixty seven perches and three tenths thence by a line to be run from the last mentioned corner to the place of beginning upon the following conditions, my said son Henry shall take the same at the apraisment put upon it by three men to be chosen by my said son Henry and my Executors and the said Henry shall pay fifteen dollars each and every year until the sum so appraised shall have been paid, the payments commencing one year after my Death and at the time the deed is made to my said son Henry for the other tract the deed for the Mountain Land shall also be made. I further give and bequeath unto my said son Henry 1 hand saw, 1 drawing knife, 3 augurs and my windmill. Item; I give and bequeath unto my beloved Daughter Molly Rex three hundred Dollars one hundred of which shall be paid her within one year after my Death. Item; I will and direct my hereinafter named Executors to sell the Ballance of my real Estate within one year after my death giving them full power to convey the same to the purchasers. I further bequeath to my Daughter Molly Rex the use of the rooms I now occupy in the house on the place bequeathed to my son Henry and the privilege of keeping two cows and sufficient hay and stable room in winter and pasture in summer, the use of Kitchen and well seller the one half of the small Garden and one fourth of the large Garden and dung for same and to be ploughed for [her] by my said son, a piece of land for flax and potatoes not exceeding 1/4 of an acre and sufficient firewood to be furnished by my said son Henry these bequests meaning the priviledge allowed in the house and on the place and the use of my stove shall continue for four years after my Death if my said Daughter should so long live and remain single together with sufficient fruit for her use and two sheep her choice I further give and bequeath unto my Daughter Molly the one third of the crop which I shall die possessed of being my share and portion due me from my son Henry and for the firewood furnished or so to be by my son Henry I order my Executors to exonerate him from the payment of fifteen Dollars upon the Woodland. I further give and bequeath unto my Daughter Molly two cows, her choice, my corner cupboard and all the contents including a copper tea kettle two beds and bedding and bedstead, her choice one table and stand and my small candle stand my chest and a salt box one case of drawers one iron kettle 2 iron pots 3 buckets coffee mill, 2 tubs and churn as many empty vessels she stands in need of for her own use together with knives and forks ladles each out of those I die possessed of together with 6 chairs and the one half of all the linens I die possessed and in case my said Daughter Molly should die before she enters in to the Married state it is my will that the bequests except the priviledges granted to my Daughter Molly shall fall back to my Daughters share and share alike. I further give and bequeath unto my Daughter a hog or pig and the priviledge of keeping the same on the place of my Son Henry. Item; I give and bequeath to my Daughter Catharine intermarried with Michael Miller and to my Daughter Margaret intermarried with Moses Crum, to my Daughter Elizabeth intermarried with Henry Peter and to my son in law Frederick Eigholtz each two hundred dollars all the money received to be deducted and all such as have been overpaid to receive so much less in the after distribution of my Estate. Item; I give and bequeath to each of my sons John Daniel Jacob Jonas William and Henry each one hundred pounds these who have received more to refund or receive so much less at the second distribution on my Estate and those who have not yet received that sum to be paid them I order and direct that the balance of my Estate, both real and personal shall be sold by my hereinafter named Executor and that the amount arising from the same after the bequests already made shall be fully complied with shall be equally divided between all my children and my son in law Frederick Eigholtz share and share alike. and lastly; I make and ordain and appoint my beloved son William Rex Executor of this my last will and testament this first day of March 1832 in witness whereof I have set my hand [and] seal to this Instrument of Writing, acknowledging it to be my last will and testament. Daniel Rex Signed sealed acknowledged by the Testator this instrument of Writing contained two separate sheets or pieces of paper attached by a wafer signed by me on each sheet to be his last will and testament in presents of the subscribers whose names are hereunto signed as witnesses this first day of March Anno Domini 1832.
