PORTER & WIFE TO GUSTAVUS HEIDELBERG DEED Allegheny County Pennsylvania April 9, 1841 This Indenture, Made the ninth day of April in the year of our Lord one thousand eight hundred and forty one Between Andrew C. Porter of Plum Township in the County of Allegheny and State of Pennsylvania and Sarah his wife of the one part and Gustavus Heidelberg of the County and State aforesaid of the other part. Witnesseth that the said Andrew C. Porter and Sarah his wife for and in consideration of the sum of two thousand seven hundred dollars to them in hand paid by the said Gustavus Heidelberg at and before the sealing and delivery hereof the receipt whereof they do hereby acknowledge and thereof acquit and forever discharge the said Gustavus Heidelberg his heirs executors administrators by these presents have granted bargained, sold , aliened, enfeoffed, released, conveyed and confirmed, and by these presents do grant, bargain, sell, alien, enfeoff, release, convey and confirm onto the said Gustavus Heidelberg, his heirs and assigns, All that messuage or tract of land situate in Plum Township, County and State aforesaid, Bounded and described as follows viz; Beginning at a white oak, thence by lands of Mary Johnston’s heirs north sixty degrees west seventy seven perches to a white oak thence by lands of Henry Morrison and the heirs of David Caldwell north two degrees west one hundred and eighty five perches to a white oak, thence by lands of James Kirk north thirty seven degrees east one hundred and sixty seven perches to a white oak, thence along other lands of which this is a part to the place of beginning. Containing one hundred and fifty four acres same perches and allowance of six percent for roads etc. Being a part of land called Hopewell, Containing three hundred and ninety five acres and three eights and allowance surveyed in pursuance of a warrant granted to John McKee dated the first day of July 1784 and which the Commonwealth of Pennsylvania by Patent bearing date the 1st day of February 1791 enrolled in the Rolls office for the State of Pennsylvania in Patent Book No. 15 page 462 granted unto the said John McKee and the said John McKee by deed bearing date the 20th day of March 1792 and recorded in the office for recording of deeds in and for the County of Allegheny in Book B page 526 & 527 granted and conveyed unto Andrew McLintock and the said Andrew McLintock by deed bearing date the 19th day of June 1827 and recorded in the office for recording of deeds in Allegheny County in Book F 2nd page the 30th day of June 1827 granted an conveyed unto Adam McLintock and the said Adam McLintock by deed bearing date the 1st day of May 1839 recorded in the office for recording of Deeds in Allegheny County in Book J 3rd Vol. 58 page 138 the 10th day of June 1839 granted and conveyed the same unto Andrew C. Porter being a part of the above mentioned tract of land called Hopewell situate on the water of Turtle Creek. Now this indenture Witnesseth that the aforesaid Andrew C. Porter and Sarah his wife for and in the consideration of the sum of two thousand and seven hundred dollars lawful money of Pennsylvania, to them in hand paid by the aforesaid Gustavus Heldelberg at and before the sealing and delivery of these presents the parties whereof do hereby acknowledge to have, granted, bargained, and sold, released, confirmed and by these presents do grant, bargain, and sell , release and confirm unto the aforementioned Gustavus Heidelberg , his heirs and assigns forever the above described tract of land. Together with all and singular other the houses, out houses, buildings, barns, stables, ways woods, water , water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever there unto belonging or in any wise appertaining and the reversions and retainers, rents, issues, and profits thereof; and also all the estate, right, title, interest property, claim and demand whatsoever of them the said Andrew C. Porter and Sarah his wife in law or equity or otherwise howsoever of into or out of the same to have and to hold the said messuage or tenement and tract of one hundred and fifty four acres and some perches of land hereditaments and premises hereby granted or mentioned or intended so to be with the appurtenances unto the said Gustavus Heidelberg his heirs and assigns to the only proper use and behoof of the said Gustavus Heidelberg his heirs and assigns forever. And the said Andrew C. Porter and Sarah his wife, Do for themselves, their heirs, executor or administrator, Do hereby covenant, promise and grant, to and with the said Gustavus Heidelberg, his heirs, and assigns forever that the said Andrew C. Porter and Sarah his wife the last described tract of one hundred and fifty four acres some perches with the allowance and appurtenances to the said Gustavus Heidelberg his heirs and assigns , against them their heirs and assigns, and all other personal lawfully claiming or to claim the same shall and well warrant and forever defend by these presents, In Witness Whereof the said parties to these present have nere unto set their hand and seal the day and year above written. Sealed and delivered in the presence of us Andrew C. Porter {seal} James McGenley Jno. Morrison Sarah his wife Porter {seal} Received on the day of the date of the above written Indenture of the above named Gustavus Heidelberg the sum of two thousand seven hundred dollars in full of the consideration money for the above granted premises $2700 Witness at signing Andrew C. McGenley Allegheny County} SS The ninth day of April in the year of our Lord one thousand eight hundred and forty one personally appeared before me the subscriber one of the Justices of the Peace in and for the County aforesaid the above named Andrew C. Porter and Sarah his wife did acknowledged the above indenture to be them and each of these act and deed and desired the same as such might be recorded according to Law. She the said Sarah being of lawful age separate and apart from her said husband by me examined and the full contents of the said indenture unto her made known whereupon she did declare that she did voluntarily and of her own free will and accord seal and as her act and deed deliver the same without and coercion or compulsion of her said husband.
