I, Ebenezer Caldwell, of Elizabeth Township, Allegheny County, and State of Pennsylvania, do make, devise, constitute, and publish this, my last will and testament. And first I commit my soul to God, who gave it, and my body to the ground from whence it came. As to such worldly estate as God in his providence has put under my care, I dispose of as follows: First. I direct that all my just debts and expenses be paid, and that all my outstanding claims be collected by my executor. I direct all my personal property not otherwise disposed of, be sold at public sale. Also I will and bequeath to my son, William Caldwell, all the farm on which I now reside, together with all my interest in the farming utensils,sower and reaper, grain drill, fork, and other farming machines, on condition that the said William Caldwell, my son, release all his claim to an article of agreement now existing betweeen him and me and dated April 1, 1847, and put to executors the sum of thirty five hundred dollars in manner following, to wit, viz: Fifteen hundred dollars in one year after my decease and the balance in four equal payments. I will and bequeath to my daughter, Ann Armstrong, two hundred dollars, also to my son, Joseph Caldwell, two hundred dollars, also to my son, James Caldwell, I will and bequeath the sum of two hundred dollars, and to my daughter, Mary Jane Caldwell one U.S. point f40 bond calling for one thousand dollars U.S., numbered 21835 and dated March 1st, 1864. Also I will and bequeath to my said daughter, Mary Jane Caldwell, two hundred dollars in U.S. $7.30 bond. Also, I will and bequeath to my daughter, Sarah McCullough, my house and lot in the town of Bridgewater, in Beaver County, State of Prnnsylvania. Also, I will and direct that any money arising from my estate not hereinfore disposed of shall be disposed of as follows,viz:: I direct my executor to pay fifty dollars for the Education of the Freedmen of the United States, and the remainder to be divided equally among six of my children to be paid them in the following order, viz: First, to my daughter, Ann Armstrong, second to my son, Joseph Caldwell, third to my daughter, Mary Jane Caldwell, fourth, to my daighter, Sarah McCullough, fifth, to my son, James Caldwell, and also to my daughter, Susan Elliott. I direct that the above be paid in full, in the order in which they are mentioned. I also direct that any money which my son, William Caldwell, has paid to the avove named legatees on account of their interest in my estate, shall be deducted from the dividend coming to such legatees. I also direct that my daughter, Mary Jane Caldwell, shall have the room upstairs in the southwest corner of the house I now live in., and also the room in the southwest corner downstairs together with the kitchen adjoining, and also the use of my horse and buggy,to be kept on the farm as long as she remains unmarried. I also will and bequeath to my daughter, Mary Jane Caldwell, her choice of the cows, to be kept on the farm as long as she remains, and to use said cow as she may design. I also direct that all my household and kitchen firniture be equally divided between my son, William Caldwell, and my daughter, Mary Jane Caldwell, except such articles as my beloved wife, named to my daughter, Mary Jane Caldwell, and articles to be first taken out by said Mary Jane. And I do hereby nominate, constitute, and appoint my trusty friend, Joseph Hall, and my son, William Caldwell, executors of this, my last will and testament, and I also hereby revoke and annul any previous will made by me. In testimony hereof, I have set my hand and seal this 13th day of December, One Thousnd Eight Hundred and Sixty Five. Signed, sealed,and delivered in the presence of Harvey Applegate and John Applegate Ebenezer Caldwell I, Ebenezer Caldwell, the above named testator, do hereby make and publish this codicil to my last will and testament, this nineteenth day of February, A.D. 1866, in manner following, to wit: I will and bequeath to my daughter, Mary Jane Caldwell, the sum of five hundred dollars, the said sum of five hundred dollars to remain in the hands of my son, William Caldwell, without interest as part of his first payment on the place I now occupy and to be paid to my said daughter, Mary Jane Caldwell, when she marries, then her part of the house, to my said son, William Caldwell In witness whereof, I hereunto set my hand and seal this twentyeth day of February, A.D. 1866.
