BY THE TENOR OF THESE PRESENTS I, M. Stewart Esquire, Register for the Probate of Wills, and granting Letters of Administration in and for the County of Allegheny aforesaid, in the Commonwealth of Pennsylvania. Do Make known unto all Men, That on the day of the date hereof, at Pittsburgh, in the said County, before me was proved, approved and insinuated the last Will and Testament of Joseph McCurdy late of Robinson Township in the county aforesaid, deceased, (a true copy whereof is to these presents annexed) having whilst he lived, and at the time of his death, divers goods, chattels, rights and credits within the said Commonwealth, by reason whereof the approbation and insinuation of the last Will and Testament and the committing the administration of all and singular the goods, chattels, rights and credits which were of the said deceased, and also auditing the accounts, calculations and reckonings of the said administration, and a final dismission from the same to me are manifestly known to belong; and that the administration of all and singular the goods, chattels, rights and credits of the said deceased, any way concerning his last Will and Testament, was committed to Andrew McCurdy and William Hall, Executors in the said Testament named, they having first been duly qualified well and truly to administer the goods, chattels, rights and credits of the said deceased, and make a true and perfect Inventory thereof, and exhibit the same into the Registers Office at next, and to render a true and just account, calculation and reckoning of the said administration, on or before the twenty-first day of September one thousand eight hundred and twenty-six or when thereunto lawfully required. IN TESTIMONY WHEREOF, I have hereunto set my hand and seal of Office, at Pittsburgh, the 21st day of September in the year of our Lord one thousand eight hundred and twenty-five. M. Stewart, Register In the name of God, Amen J. Joseph McCurdy of the Township of Robinson and County of Allegheny and State of Pennsylvania being poorly in health of body but of perfect soundness of mind and recollection blessed be God, make this my last will and testament in the like form and manner falling to wit. First of all, I bequeath my soul to God who gave it and my body to be buried in a decent Christian-like manner and as to such wordly estate wherewith it has pleased God to bless me with in this life I give and dispose of the same in the following manner to wit. After my funeral expenses and all my lawful debts are paid out of such of my chattel property as shall not hereinafterwards be devised and if this shall not be sufficient to pay the same, the remainder shall be taken from and out of my real estate and likewise one seventh part of the remainder of my real estate I will and bequeath to Mary my beloved wife and also one mare and coult [sic] and side saddle and bridle, three cows, eight sheep and four hogs of her own choosing and likewise I will and devise unto Mary my beloved wife one cupboard and with its contents, one bureau, three beds and bedding, one half dozen Windsor chairs and one table of her own choice, one looking glass, with all the grain and oats hay in the barn, and this my beloved wife is to enjoy the benefits of all they houses until my son Joseph comes of age without any rent whatever. And likewise unto Letty, my beloved daughter, I will and devise one seventh part of my real estate, and unto Emeline, my beloved daughter, I will and devise one seventh part of my real estate, and also unto Sarah Ann, my beloved daughter, I will and devise one seventh part of my real estate, and also unto Mary, my beloved daughter, I will and devise one seventh part of my real estate, and likewise unto Elizabeth, my beloved daughter, I will and devise one seventh part of my real estate, and unto Joseph, my beloved son, I will and bequeath one seventh part of this my real estate, that each of these my children shall be decently schooled and likewise my son Joseph if it shall please God he shall live to the years of maturity my will is that he shall be taught so that he may be able to teach school and further my will is that all expenses until this my son Joseph becomes of age shall be taken out of the whole and from their several parts and unto Hugh Glen my nephew I will and devise the tanyard and houses with one acre and one half adjoining the same the first line to run below the shop and then to extend up the hill the inside line to come up by the west end of the milk house for and during the term of forty years and further my will that he that said Hugh Glen shall have a constant supply of water from the spring. The spring for the tanyard as heretofore enjoyed and further my my will is that he the said H shall pay or cause to be paid unto my heirs, administrators or assigns the sum of one hundred dollars at two equal payments the first payment to be made one year after my decease and the other one year afterwards and if he the said Hugh shall think proper not to enjoy said demised lot he shall leave it to the rest of my heirs clear of all debts whatever and likewise he shall not remove the mill and further my will is if any of these my children shall die before they come of age there [sic] part shall go to the remainder of my children share and share alike and should any die of these my children before they come of age having issue lawfully begotten there [sic] part shall go [to] the said children shair [sic] and shair [sic] alike. Lastly I nominate, constitute and appoint my brother Andrew McCurdy and my brother-in-law William Hall, both of Allegheny County, my executors of this my last will and testament with full power to execute the same hereby revoking all other wills, legacies and bequeasts [sic] by me heretofore made and do declare this and no other to be my last will and testament and in testament of this, my desire and have in the full exercise of my reason set my hand and affixed my seal this third day of September in the year of our Lord one thousand eight hundred and twenty-five.
