Both above notices must remain when copied or downloaded. I have transcribed this will from a photocopy of the original in my possession. Samuel Neely was born in Ireland in approximately 1759. He came to the United States in the late 1700's and settled in Allegheny County sometime before 1801. I believe that he was married when he came from Ireland and several of the children listed below were also born in Ireland. His first wife died in the first decade of the 1800's and he remarried to Mary [Maiden Name Unknown]. It appears that Thomas Neely, my gg grandfather, was the first child born to Samuel and Mary Neely. There are 16 children listed in his will. Based on Mary Neely's will it appears that another son, Henry Neely, was born after Samuel died and at the time of his will he was unaware of this child. ____________________________________________________________ Transcription of the will of Samuel Neely, Pine Township, Allegheny County, Pennsylvania, Will Book 3-237. in the name of God Amen. I Samuel Neely of Pine, Township of Pine, County of Allegheny and State of Pennsylvania being weak in body but sound and perfect in Mind and Memory - I do make and publish this my last will and Testament in manner and form following, that is to say first I leave and bequeath to my beloved Wife Mary Neely the Sum of one dollars - I do also give and bequeath to my son John Neely the Sum of one dollar I do also give and bequeath to my son James Neely the Sum of one dollar I do also give and bequeath to my son Samuel Neely the sum of one dollar I do also give and bequeath to my daughter Letsy Sarver the sum of one dollar I also give and bequeath to my son Alexander Neely the sum of one dollar I also give and bequeath to my daughter Elizabeth Sarver the sum of one dollar I also give and bequeath to my dauter Rebeca Neely the sum of one dollar I also give and bequeath to my son William Neely the sum of one dollar I also give and bequeath to my son Robert Neely the sum of one dollar I also give and bequeath to my son George Neely the sum of one dollar I also give and bequeath to my son Thomas Neely the sum of one dollar I also give and bequeath to my son David Neely the sum of one dollar I also give and bequeath to my daughter Nancy Neely the sum of one dollar I also give and bequeath to my son Hugh Neely the sum of one dollar I also give and bequeath to my daughter Jane Neely the sum of one dollar I also give and bequeath to my youngest son Joseph Neely the sum of one dollar Which said several sums or legacies of money I will and order shal be paid to the said several legatees within one year after my Decease out of my private property and after my lawfull debts and funeral Expence owing first fully paid ------- I further give and devise to my beloved wife Mary Neely the use of my farm in pine Township consisting of one hundred acres of land that I now live on with the appurtenances belonging to the same with one hundred acres of land of No 106 in franklin Township and County afforesaid known by Kenedys hundred and where William McDonald now lives on and to be in her hands after the expiration of Said McDonald lease all of which I give and place in my wifes power and under her control - to help to raise my six youngest children to be in her possesin as long as she remains my widdow and behaves her self in a prudent womanly like way and no longer --- and after it leaves her hands by death or otherwise I will and order that the hundred acres of land in Pine Township Shall be my two sons to wit Thomas Neely & David Neely to be divided between them Equal in quantity and quallity and the hundred acres above named that McDonald now lives on to be divided Eaqual between Hugh Neely and Joseph Neely my two yongest sons by the Said, Thomas Neely David Neely Hugh Neely & Joseph Neely Each of them paying Twenty Dollars to my two yongest Daughters to wit Thomas and David to pay Nancy her forty dollars in one year after the come of age or within one year after they get thire hundred acres of land in their own hands & Hugh and Joseph Neely to pay Jane her forty Dollars in like manner as Thomas & David is to do. ???? the above six heirs should die befoe they have a partner in life or an Heir then in that case thire Share to be Divided Eauqualy amongst the surviving children of my present wife & I further leave my beloved wife one Mare now with colt two cows nine head of sheep with all my private property and household furniture of every kind to her own proper use ------- I further give and devise to my son George Neely one hundred acres in franklin Township & County afforesaid being the north end of lot No 106 & where William Skiles did live on. I further will & Devise to my two Sons William Neely and Robert Neely the South end of my place on Saweckly franklin Township Suposed to be one hundred and fifty acres be the same more or less to be divided Equally between them by an East & West line and William to have the share next Kenedys line & Robert to be where he now lives by the said George Neely, William Neely and Robert Neely paying the judgement that now stands against me in Pittsburgh for the use of Benjamin Hare pay of the legatees above Named thire dollar each my funer Expenses and what Ever Expense may accrue in having this my will carried into Effect William and [__]bin Neely I order shall pay Elizabeth Sarver Ten Dollars in cash within one year after my decease & George Neely to pay my Daughter Rebeca Neely Ten Dollars in Cash within one year after my Decease --- I further appoint Thomas Gibson and Martin Byrnes of Pine Township to be my sole Executors of this my last will and testament in witness whereof I have hereunto set my hand and Seal this Twenty Ninth day of December in the year of our Lord one thousand Eight hundred and twenty Eight Signed Sealed Published Signed Sam Neelly SEAL and delivered by the above named Samuel Neely to be his last will and Testament in presance of us who have here unto Subscribed our names in presance of the Testator Robert Neelly Sworn 26th Febry 1829 George Neely Allegheny County SS On the 26th February AD 1829 Personally appeared Robert Neely George Neely the two Subscribing Witness to the within Will who on their solemn oaths and depose and say that they were present and did see and hear Saml Neely the Testator sign seal and publish & Pronounce and declare the foregoining instrument of writing to be and as for his last will and Testament and that at the time of so doing he was of Perfect and sound mind memory understanding to the best of their observation and belief M. Stewert Regr Given under my hand the date aforesaid. Be it remembered that on the 26 February AD 1829 Letters Testamentary of the within will were duly granted to Thomas Gibson Martin Byrnes who was solemnly sworn to exhibit into the Equities Office at Pittsburgh within one month a true and perfect Inventory of the personal state of said decd and to settle the account of his administration within one year or when thereunto legally required Given under my hand the date aforesaid.
