The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net/pa/pafiles.html ********************************************************* Will #115, Allegheny County Will book, Volume 1 page 172 In the name of God Amen, I William Tucker of Fayette Township in the County of Allegheny and Commonwealth of Pennsylvania, Being very sick and weak in body, but of sound mind, memory and understanding--Blessed be God for the same, do hereby make and publish this my last will and testament in manner and form following to wit: Principally and first of all, I commend my Immortal soul into the hands of Almighty God, who gave it and my Body to the earth, to be buried in a decent and christianlike manner, at the Discretion of my Executor herein after named, and as to such worldly estate wherewith it hath pleased God to bless me in this life, I give and dispose of the same in the following manner to wit: First of all it is my will and I do order that all my just debts and Funeral expenses be fully paid and satisfied and as touching all the rest, residue and remainder of my Estate real and personal in Allegheny County or elsewhere, I give and devise as follows-- Imprimis, I do give and bequeath to my dearly beloved wife Anna Tucker my own riding mare and her saddle, one young flaked cow that's giving milk. Her [Anna Tucker] bed and bedding, her spinning wheel, ----------, one pewter dish and three plates, three chairs ( --------- at the discretion of my executors) as -------- the full sum of twenty six dollars and sixty seven cents lawful money of Pennsylvania, to be paid unto her, my said wife Anna, yearly and every year for and during her natural life, for her support. Item-It is also my will and I do hereby order that one hundred acres of land whereon Jonathan --------- now lives, after the expiration of his lease be [sold] to advantage and amount thereof (sixty pounds excepted) to be paid to my Grandson, Lewis Tucker, son of my son Lewis, deceased, and the sixty pounds above mentioned to be divided as follows, to wit: twenty pounds thereof to be paid to my Granddaughter Clementina, daughter of the aforesaid Lewis, deceased and twenty pounds thereof to be paid to my Daughter Mary Wine and the remaining twenty pounds to be paid to my Daughter Elizabeth Scott, or in case my said Executors shall think proper, to rent the aforesaid hundred acres of land. It shall be at their discretion and out of the rents and profits thereof to pay the above sixty pounds as aforesaid to the women and girl, in manner as aforesaid and all the residue and remainder thereof to be paid to my Grandson Lewis as aforesaid, when he shall arrive at the age of twenty-one years. Item-I do also give and bequeath to my Granddaughter Mary Thornsburgh, twenty pounds current money of Pennsylvania and also to my Grandson William Thornsburgh, ten pounds of said currency to be paid out of the money arising from the sale of my personal property which may remain after my wife receives what herein is before mentioned for her, and I do allow that this thirty pounds herein bequeathed to the said children, be in full and in lieu of their mothers part out of my estate (to wit Clementina Thornsburgh) Item-I do give and bequeath unto my two sons William and Edward, all the residue and remainder of my estate real and personal, herein not before bequeathed to be divided between them, by my executors, equal shares alike, as tenants in common and not as joint tenants, provided always that the -------- of forty five dollars, with the legal interest and -------- accrued, thereon be first deducted out of the -------- of son William and paid to his creditors and further in case it should so happen that there should not be sufficient to pay the thirty pounds aforesaid herein bequeathed to Mary and William Thornsburgh, out of the personal property as aforesaid, then, and in such case, I do hereby Empower my said Executors to deduct what may be deficient, equally out of the part aforesaid bequeathed to my two sons, William and Edward, as aforesaid. Item-I also bequeath to my wife, Anna, all her geese now on the premises or whatever may be at the time of my decease. As also one Ewe and two lambs, and my Daughter Mary Wine, I allow --------- and -------- where she now dwells during her natural life. And Lastly, I do hereby nominate and appoint Alexander McCandless and Alexander Burns, both of ----oon Township in the county and commonwealth aforesaid to be the Executors of this my will, hereby revoking all other wills, legacies and bequests heretofore made and declaring this and no other to be my last will and testament, In witness --------- I have hereunto set my hand and seal this twenty fifth day of April in the year of our Lord one thousand eight hundred and three. Signed, sealed, published, pronounced and declared by the said testator, as his his last will and testament, in the presence William X Tucker of us, who in his presence and at his------- mark subscribed as witnesses Edward Tucker Mathew Fisher Alexander McCandless Alexander Burns Allegheny County--Before me the subscriber, Register of Wills etc., in and for the county aforesaid, personally came Matthew Fisher, Alexander McCandless and Alexander Burns, three of the subscribing witnesses to the within will and being duly sworn according to law, deposeth and saith, that they were personally present and did see William Tucker, the Testator within named sign, seal and deliver the within as his last Will and Testament and that they heard him publish, pronounce and declare the same as such and that he was of sound mind and memory at the time of so doing to the best of their knowledge.
