No. 261 Will Book 7 In the name of God Amen I Joseph Vankirk of Marion County State of Virginia do make this my last will and testament as follows that is to say___ 1st My desire is to be removed to Pennsylvania to be buried at round hill church burying ground and I desire that my Executor or Administrator pays fifty dollars out of my estate to whoever he employs to remove me to the above named buring ground, and I desire that four pare of toom stones of marble be purchased one for my father, one for my mother and one for my brother John and one for myself not to costs exceeding fifty dollars each to be paid out of my estate, also my dear wife Elizabeth desires that if she should die my widow, that she be removed to Pennsylvania, and buried by me, and expense paid out of my estate__ 2nd I desire that my dear wife Elizabeth have full possession of my land with all its & appurtenance lying and being in the County of Marion Va. And as much of my personal estate as is necessary for her maintenance and the maintenance and education of my child Sarah Frances so long as she remains my widow if she should marry again, I give to her Five hundred dollars out of my estate, and I further desire that if in accordance with law that my wife Elizabeth if she wishes shall have power to sell and convey my real estate in Virginia___ 3rd I give all the remainder of my estate to my daughter Sarah Frances both what may accrue now and what may accrue after the death of my wife Elizabeth provided she Sarah Frances lives to the age of maturity ___ but if she should not live to the age of maturity I give and bequeath Fifteen hundred dollars Joseph Vankirk Means, also give and bequeath to William Vankirk son John Vankirk deceased the sum of Fifteen hundred dollars, and provided that a balance should accrue after all my expenses and debts are paid I will it to the above named Joseph V. Means, and William Vankirk to be divided equally between them____ 4th I appoint Culbert Means myEexecutor to settle all my businefs in Pennsylvania also I appoint and impower the above named Means to sell and convey my house and lot in the Borough of Elizabeth Pennsylvania and apply the proceeds to the use of my wife and child____ 5th I appoint Albert Morgan my Executor or Administrator to settle all my business in Virginia and to apply the means according to the above direction___ In witness where of I the said Joseph Vankirk have to this my last will set my hand and seal this 28th day of May 1852. Boggys Clerk Virginia to wit} In the County Court of Marion Co September Seven 1852 Sept 7th 1852 The Last will and Testament of Joseph Vankirk deceased was this day produced in Court and proved by the oaths of Peter Wolf Amos Powell and John P. Morgan three of the subscribing witnefses thereto, and thereupon was ordered to be recorded20 A Copy testo20 Thomas L.Boggys, C, C Virginia Marion County to wit I Thomas L. Boggys Clerk of the County Court of Marion hereby certify that the forgoing writing, purporting to be a copy of the last will and testament of Joseph Vankirk deceased is a true copy of the original will of said deceased recorded in my office, and that the above is a true copy of the order made in said court on admitting the same to record___ In Testimony whereof I have hereunto subscribed my name and affixed the seal of said Court at Fairmont in said County of Marion this 10th day of December 1852 Thomas Boggys State of Virginia to wit I Thomas S Haymond presiding Justice of the County Court of Marion County hereby certify that Thomas L.
