Brown buwbrown@concast.net July 18, 2008, 12:11 pm Letter from George Shiras to Managers of the House of Refuge, no date: I have examined the papers left with me by Mr. Ringwalt showing the return of Judge Hampton, in the case of Robert Meikle, Orhl? Baughman, Sarah Smith, Robert Cunningham, and William Mayhugh. The power of the judge to revise the commitments and order the discharge of the infants (= minors)if he be dissatisfied with the regularity of the commitment or with the sufficiency of the evidence returned by the magistrate, is a very clear one, being conferred in plain terms by the Act of 1835. In the present instances, therefore, I see no other course open to the board than to discharge the infants in pursuance of Judge Hampton's order. So far as I have been able to examine the commitments and the accompanying evidence, I feel disposed to concur with the action of the Judge in the cases of Robert Cunningham and Sarah Smith; the other cases appear to me to have been properly disposed of by the presiding magistrate but, of course, the finding of the judge is final.
