Who gave it to me and my body to the earth from whence it was taken - and to prayeth - . To my wife, Mary Dougherty, my second marriage I do bequeath my ? real estate the one third or as much of the same as may be necessary for her substance which she lives together with the household furniture as follows: One bed and bedding, one large chest, kitchen furniture also the privilege of the house wherein I now live while she lives. To my son Samuel Dougherty by second marriage I bequeath of my real estate the one half as follows-of the land including the improvements where I now live reserving to my wife as before while she lives. To my son John Dougherty, by second marriage, I bequeath the other half of my landed estate including the improvements made by James Stuart reserving still the one half for my wife while she lives. At my deceased, I desire my personal property to put to saleand the value therof when recorded by my executors to be distributed as follows: First my funeral expenses and just debts to be paid. After that to my daughter Mary Craig by my second marriage I bequeath fifty dollars lawful money of the United States to be paid by my executor when ???of the value of my personal property. To my son, Francis Dougherty by my first marriage I bequeath two dollars lawful money lawful money of Pennsylvania to be paid when recovered as above. To my son James Dougherty by my first marriage I bequeath two dollars to be paid as before described, and to my daughter Nancy King by my first marriage two dollars to be paid as before described, at the deceased of my wife Mary Dougherty if she should survive me, it is my will that the share of landed estate be left for her substanance be equally left in the hands of my sons Samuel and John Dougherty in like mannerbetween my sons Samuel and John Dougherty. Also it is my will that the barn be completed on the imporvement that I have left to my son John and of the expense arrising for the same I bind my son Samuel ? the one half, and the line between my sons Samuel and John Dougherty to run so as to include to each their improvements or as near as possible. And lastly, I nominate and appoint my sons Samuel and John Dougherty to be my executors of this my last will and testamant as witness my hand and seal this fourteenth day of September, One thousand eight hundred and sixteen. Gibson and William Stewart the subscribing witness to the written will of James Dougherty deceased who being duly sworn according to law declare and say that their names within subscribed are in their own proper hand writing, that they were present and saw the said James Dougherty sign, seal, publish pronounce and declare the within instrument of writing as and for his last will and testament, and that at the time of his doing so the said James Dougherty was of perfect and sound mind and memory, and that they these deponanats signed their names to the said will as witnesses in the presence and at the request of the said James Dougherty.
