All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/pa/pafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Jeff Homes jeffhomes@yahoo.com July 9, 2006, 5:29 pm 169 / 1 Written: January 26, 1825 Recorded: June 6, 1840 DEED ADAM PAINTER'S HEIRS TO Elijah Lower ENTERED JUNE 6th, 1840 THIS INDENTURE Made the twenty sixth day of January, In the year of our Lord,one thousand eight hundred and twenty five- BETWEEN JOHN PITTS and ANNA his wife of Beaver County, State of Pennsylvania, JACOB PAINTER AND BARBARA his wife, ADAM PAINTER AND POLLY his wife,DANIEL RUDISILL AND ELIZABETH his wife, JOHN RAUB AND MARGARET HIS WIFE, PETER PAINTER AND ELIZABETH his wife, DAVID AND CATHARINE PAINTER of Columbiana County, Ohio, of the one part and ELIJAH LOWER of Beaver County and State of Pennsylvania of the other Part- WITNESSETH that the aforesaid John, Anna, Jacob, Barbara, Adam, Polly, Daniel, Elizabeth, John, Margaret, Peter, Elizabeth, David and Catharine for and In consideration of the sum of One hundred and twenty five dollars In hand paid the receipt whereof they do hereby acknowledge have granted, bargained and sold, and by these present do grant, bargain, and sell unto the said ELIJAH LOWER and to his heirs and assigns, all their right and title, in and to a piece of land, lying In North Beaver Township, Beaver County, State of Pennsylvania and in the first Donation District and In lot number One hundred and Sixty nine, which lot of land was sold for taxes by the Commissioners of Beaver County or their Treasurer Robert Moore and deeded the same to the highest bidder, John Douglass on the thirteenth day of December In the year of our Lord one thousand eight hundred and nine and John Douglass and Nancy his wife did on the fifteenth day of November one thousand eight hundred and ten, convey all their right and title of one hundred and fifty acres, with the usual allowance of six per cent of the west end of said tract to Adam Painter of Columbiana and State of Ohio, and the said Adam Painter did by his last will and testament will the same to Jacob, James, Adam, Anna, Elizabeth, Margaret, Peter, David, and Catharine dated the twenty sixth day of February In the year of our Lord, one thousand eight hundred and twelve the Part now sold by the above recited heirs. BEGINNING at the north west corner of said lot, thence along with the line of the same north eighty six degrees east, eighty perches to a post thence south fire and ‡ degrees east two hundred and sixteen perches along with lands of some of the heirs of the aforesaid Adam Painter dec'd. to a Post thence along with lands of Hugh McIbbins south eighty six degrees west, seventy seven perches and ten hundredths to a chestnut or red oak, thence along with lands of Jacob Pitts north five and half degrees west two hundred and sixteen Perches to the Place of beginning. Containing one hundred arid six acres and eighty eight perches neat measure- be the same more or leas, TO HAVE AND TO HOLD the said tract or parcel of land hereby granted or intended so to be, with the appurtenances unto the said Elijah Lower his heirs and assigns to the only proper use and behoof of the said Elijah Lower his heirs and assigns, forever. AND the said Jacob, Barbara, Adam, Polly, Peter, Elizabeth, David and Catharine Painter and John Pitts and Anna his wife, David Rudisill and Elizabeth his wife, John Raub and Margaret his wife for themselves their heirs, executors, administrators, do covenant, promise, grant and agree to and with the said Elijah Lower his heirs and assigns, by these present that they the said Jacob, Adam, Peter Painter and their wives, David Painter and Catharine Painter together with John Pitts, Daniel Rudisill and John. Raub, with their wives heirs of law to the said Adam Painter deceased, and their heirs, the said above described piece or parcel of land hereditaments, and premises hereby granted or Intended so to be, with the appurtenances unto the said Elijah Lowsr, his heirs and assigns, against themselves the said Jacob, Adam, Peter Painter, John Pitts, Daniel Rudisill, John Raub and their wives, together with David and Catherine Painter and their heirs and assigns and all and every other Person or Persons, lawfully claiming or to claim by from or under them or any of then shall and will warrant and forever defend. But It is clearly understood to be the time Intent and meaning of the parties, that no other or better "title" is hereby granted or warranted by the said Jacob Painter and his wife, Barbara, Adam Painter and his wife Polly, Daniel Rudisill and his wife Elizabeth, John Raub and his wife Margaret, Peter Painter and his wife, Elizabeth, David Painter end Catharine Painter of Columbiana County Ohio and John. Pitts and his wife Anna of Beaver County, Pennsylvania, to the said Elijah Lower or his heirs than that which the said grantors had and held in the said Premises by virtue of the within recited sale and Treasurer's deed poll, and of the last will and testament of the aforesaid Adam Painter dec'd. of which the said Elijah Lower is to take his risk. IN TESTIMONY WHEREOF the aforesaid Jacob, Barbara, Adam, Polly, Peter, Elizabeth, David and Catharine Painter, Dan'. Rudisell and Elizabeth, his wife, John RAUB and Margaret his wife, of Columbiana county Ohio and John Pitts and Anna his wife of Beaver County Pennsylvania have hereunto set their hands and seals, the day and year first above written. Emry BEAVER COUNTY SS: Personally appeared before William Miller one of our Justices of the Peace in and for said County the within named Jacob Painter and his wife, Barbara, Adam Painter and his wife Polly, John Pitts and his wife Anna, Daniel Rudisill and his wife Elizabeth, John Raub and his wife Margaret, Peter Painter and his wife Elizabeth, David and Catherine Painter, and acknowledged the foregoing within Indenture to be their act and deed, and desired that the same might be recorded as such. Their several wives, together with Catharine Painter (single, woman) being of full and Separate and apart from their said husbands by me examined, and the contents of fully made known to them, did declare that they executed the same without fear, or coercion from their husbands.
