McCONAGHY TO ABIGAIL MAYNARD ENTERED AUGUST 17TH, 1838 THIS INDENTURE, made the eighth day of September in the year of our Lord, one thousand eight hundred and thirty seven- BETWEEN WILLIAM McCONAGHY of Shenango Township Beaver County and Commonwealth of Pennsylvania and Mary his wife of the one Part and ABIGAIL MAYNARD of New Brighton in the county and commonwealth aforesaid of the other part- WITNESSETH: That the said William MCCONAGHY and Mary his wife for and in consideration of the sum of nine hundred dollars lawful money of the United States to them in hand paid by the said Abigail MAYNARD at or before the ensealing or delivery hereof, the receipt whereof is hereby acknowledged, have granted, bargained, sold, aliened, enfeoffed, released and confirmed, and by these presents doth grant, bargain, sell, alien, enfeoff, release and confirm unto the said Abigail MAYNARD her heirs and assigns ALL the following described part of the following tract of land situated in Shenango Township, Beaver County, bounded and described viz: beginning at a Hickory stump believed to be the original corner of said Tract, running North making allowance for the variation of the compass one hundred and fifty eight perches to a post, thence East one hundred and fourteen perches to a maple grub thence south one hundred and fifty eight perches to a post; thence west one hundred and fourteen perches to the place of beginning. Containing one hundred and twelve acres and one fifth of an acre strict measure, which being a part of larger tract of land (called Chester) which the Commonwealth of Pennsylvania by Patent bearing date the fourteenth day of January one thousand eight hundred and five did convey to Benjamin CHEW of Philadelphia and the said Benjamin CHEW did by his deed dated the second day of April 1808 conveyed and confirm a part of said larger tract of land to Charles MORROW and the said Charles MORROW by his deed dated the 10th of October 1808, did convey and confirm the above described part of said tract containing One hundred acres more or less unto John THOMPSON which deed is duly recorded in the office for recording deeds in the County of Beaver in Deed Book C, page 57 and 58. And the said John THOMPSON and Mary his wife by their deed dated the 10th day of March 1815, conveyed the same to Samuel SPRINGER and the said Samuel SPRINGER and Mary his wife did by their Indenture dated the fourth day of October 1815, convey the same to John CLINEFELTER and John CLINEFELTER and Lettica his wife by their deed dated the thirteenth day of October 1819, conveyed the same to John MARTIN, and the said John MARTIN and Ruth his wife did by their deed dated the twenty eighth day of June 1828, convey and confirm the same to Thomas McCONAGHY and the said Thomas McCONAGHY and Mary his wife by their deed of assignment on said deed dated the 30th of June, 1830, convey and confirm the same to William MCCONAGHY the present grantor which deed is duly recorded in the office for recording deeds in the said county of Beaver in Deed Book I, page 289, on the 13th day of July 1830, by reference to the foregoing Deeds recited the title will more fully appear. TOGETHER with all and singular, the buildings, improvements, woods, ways, water-courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining and the reversions and remainders, rents, issues and profits thereof and also, all the estate, right, title, interest, property, claim, and demand whatsoever of them the said William McCONAGHY & Mary his wife, in law or equity, or otherwise howsoever, of, in and to the same. TO HAVE AND TO HOLD the said described lot or parcel of one hundred and twelve and one fifth acres of land hereditaments and premises hereby granted or mentioned, or intended so to be, with the appurtenances, unto the said Abigail MAYNARD her heirs and assigns in fee simple. To and for the only proper use, benefit and behoof of her the said Abigail MAYNARD and her heirs and assigns forever. And the said William MCCONAGHY and Mary his wife do hereby covenant, promise, and agree to and with the said Abigail MAYNARD and her heirs and assigns, by these presents that they the said William McCONAGHY and Mary his wife and their heirs the said described lot of land & hereby granted with the appurtenances, unto the said Abigail MAYNARD and her heirs and assigns against all and every other person or persons whatsoever lawfully claiming or to claim the same shall and will warrant and forever defend by these presents. IN WITNESS WHEREOF the said William MCCONAGHY and Mary his wife have hereunto set their hands and seals the day and year first above written. CUNNINGHAM RECEIVED on the day of the date of the above Indenture of and from the above named Abigail MAYNARD the sum of lawfull money of the United States, being the consideration money above mentioned in full. CUNNINGHAM BEAVER COUNTY SS: Be it remembered that on the eighth day of September in the year one thousand eight hundred and thirty seven before me the subscriber a Justice of the Peace in and for said County, personally appeared William McCONAGHY & Mary his wife the grantor in the above and foregoing Indenture or instrument of writing and did severally acknowledge the same to be their act and deed, for the purpose therein expressed and desired that the same might be recorded as such. She the said Mary being of full age, being examined separate and apart from her husband and the contents of the said Indenture being first to her made fully known at the same time she did declare that she did of her own free will and accord sign, seal and as her act and deed deliver the same without any coercion or compulsion of him her said husband.
